CITY OF MURRIETA
City Council Meeting Agenda
Report
10/6/2026
Agenda Item No. 13.

TO: HONORABLE MAYOR AND MEMBERS OF THE CITY COUNCIL
FROM: Bob Moehling, Public Works Director
PREPARED BY: Jeff Hitch, City Engineer
SUBJECT:

Appeal of the Denial of an Encroachment Permit at 38765 Clearbrook Drive

ABSTRACT
This item considers an appeal filed by Dennis Tarlecki regarding the City of Murrieta’s (City) denial of an encroachment permit to construct a second driveway apron within the public right-of-way at 38765 Clearbrook Drive. The proposed driveway would provide access to the side/rear yard for vehicle parking; however, the City determined that the location presents inadequate sight distance and could create a dangerous condition due to the roadway curvature. Staff recommends that the City Council deny the appeal and uphold the Department of Public Works and Engineering’s decision to deny the encroachment permit.

RECOMMENDATION
Staff recommends the City Council deny the appeal and uphold the decision of the Department of Public Works and Engineering to deny the encroachment permit based on the findings discussed in this report; and Adopt Resolution No. 26-4976 entitled: A Resolution of the City Council of the City of Murrieta, California Denying the Appeal of the Denial of an Encroachment Permit for A Second Driveway Apron at 38765 Clearbrook Drive and Upholding the Decision of the Department of Public Works & Engineering.

PRIOR ACTION/VOTE
None.

STRATEGIC ALIGNMENT
This item aligns with the City Council to foster and promote an engaged, connected and caring community.

DISCUSSION
Recreational Vehicles (RVs) can generally be parked on residential private property, including in the side and rear yard, so long as they are screened by an approved fence or wall (Murrieta Informational Bulletin 229, Section II; Attachment 1). RVs cannot be stored within the front yard setback, including the driveway. Under Murrieta Municipal Code (MMC) Section 15.54.040, a property owner must obtain an encroachment permit CITY OF MURRIETA Page 1 of 4 Printed on 10/1/2026

10/6/2026
Agenda Item No. 13.

Murrieta Municipal Code (MMC) Section 15.54.040, a property owner must obtain an encroachment permit from the City prior to constructing or repairing a driveway or placing any encroachment in or across any street right-of-way. Accordingly, an RV can only access a side or rear yard via a permitted driveway opening.

Unpermitted ramps and driving an RV over the curb and sidewalk are not allowed.

Dennis Tarlecki owns a residential property at 38765 Clearbrook Drive. On December 18, 2025, Mr. Tarlecki filed an application for an encroachment permit (Attachment 2) to add a second driveway apron within the public right-of-way on his property to allow him to drive over the right-of-way to park vehicles in his yard behind a fence. The application was denied. Mr. Tarlecki subsequently approached staff requesting a reconsideration of his application, and staff realized that Mr. Tarlecki had not been advised of his appeal right in writing.

Accordingly, Mr. Tarlecki was asked to resubmit his application.

On July 1, 2026, Mr. Tarlecki filed a subsequent application for an encroachment permit to add a second driveway apron in the public right-of-way. On July 9, 2026, the City issued a Notice of Encroachment Permit Denial (Attachment 3) explaining that the permit was denied for two reasons. The primary reason is that the second driveway would constitute a dangerous condition because of the lack of adequate sight distance. The second reason is that the combined driveways would exceed forty percent of the lot frontage, which is contrary to the region-wide standard. A Site Plan for the City’s analysis of the application is Attachment 4.

Applicable Law
The City has an obligation to maintain sidewalks and roadways in a safe condition. Under California's Government Claims Act, a public entity may be held liable for injuries caused by a "dangerous condition" of its property only when the plaintiff satisfies the four elements of Government Code Section 835: (1) the property was in a dangerous condition at the time of injury; (2) the dangerous condition proximately caused the injury; (3) the condition created a reasonably foreseeable risk of the kind of injury incurred; and (4) either a public employee's negligent or wrongful act created the condition, or the public entity had actual or constructive notice of the condition a sufficient time before the injury to have taken protective measures. Hence, the City should not issue an encroachment permit for a second driveway in a location where doing so could create a dangerous condition. With respect to Mr. Tarlecki’s proposal, he is seeking a second driveway in a location where the road curves, potentially obscuring visibility for drivers, cyclists, and pedestrians.

The location of the proposed second driveway on a curved road unfortunately creates a dangerous condition of public property by arguably foreseeably increasing collision risk as sight distances are inherently limited on curves, introducing additional conflict points between turning vehicles, through traffic, cyclists, and pedestrians, and disrupting the continuity and accessibility of the pedestrian path of travel, including ADA compliance on sidewalks, all of which may elevate foreseeable hazards to road users and expose the public right-of-way to avoidable risks.

The Appeal
On July 16, 2026, Mr. Tarlecki filed a timely appeal of the denial of the permit pursuant to MMC Section

15.54.280. The Appeal and all documents in support of the Appeal submitted by Mr. Tarlecki are included as Attachment 5. The Appeal’s assertions are shown in red below. The text about the speed sign reflects comments from staff where assertions made by the Appellant warranted a response.

Appeal Procedure
Pursuant to MMC Section 15.54.280, upon receipt of an appeal, the City Council has the power to reverse, modify, or otherwise alter the determinations and orders of the City Engineer. If the City Council is unable to render a decision, the hearing officer's decision will be considered to be upheld.

At the City Council meeting, staff recommends that staff be allowed to present the reason why it denied the encroachment permit application, then allow Mr. Tarlecki time to present his appeal, followed by a brief rebuttal period for each side. Council can then deliberate and render a decision.

PUBLIC NOTICING
The agenda item has been noticed according to the Brown Act (72 hours in advance of the meeting at which the City Council considers the item).

FISCAL IMPACT
None.

Information Bulletin
 Development Plan Permit Application
 Building Permit Application
 Encroachment Permit Application
This Information Bulletin is intended to provide
important information BEFORE you invest and install
an access drive or enclosure/shade structure for your
RV. These are general responses to common
questions. Following each response is the applicable
code section(s) that can be accessed via the link
provided.

Your individual circumstances may result in slightly
different requirements. As such, please contact the
appropriate department referenced below for more
information.

I. OVERVIEW
A recreational vehicle (RV) is a term often used
for a motorized vehicle or trailer that is equipped
with living space and amenities found in a home.

Other terms used to describe an RV include
motorhome, travel trailer, truck camper or
camping trailer, watercraft or vessel.

RVs can represent a significant investment and
many owners want to store their vehicle within an
enclosure or shade structure on their property to
help protect it from the elements.

II. CAN I PARK MY RV ON MY PROPERTY?
Yes. RVs can generally be parked anywhere on
your property (including the side and rear yard)
so long as they are screened by an approved
fence or wall. RV’s cannot be stored within the
front yard setback such as your driveway or on
your front lawn.

Additionally, RV’s cannot be parked on a public
street for more than two consecutive days.

MMC §10.44.020.A
III. CAN I BUILD AN ENCLOSURE OR SHADE
STRUCTURE FOR MY RV?
Yes; however, there are limitations on the size,
height, and location of the enclosure or shade
structure.
 Structure Setback
State & City laws require that structures be
set back a certain distance from the property
line. There are two code provisions that are
applicable to structure setbacks: 1) State
(and Murrieta) Building Code; and, 2)
Murrieta Development Code.
 California/Murrieta Residential Code
This code establishes the minimum
standards to address health/safety threats
such as fire. Under the code, all structures
must maintain a minimum setback of five
feet1.

The building codes allow structures to
encroach into the setback if the structure
is built with ignition-resistive construction
and fire sprinkler protection1. Contact the
Building Division at 461-6062 for
requirements.
1CRC Tables R302.1(1)&(2);
 Murrieta Development Code
This code is intended to address
community character and quality of life
concerns such as potential visual impacts
to neighbors.

RV structures are considered an
‘Accessory Structure - Garage’ under the
Development Code and setback
regulations tend to be more restrictive (i.e.
greater than) than the Building Code and
vary depending upon the neighborhood
and whether the structure is attached or
detached1.

As such, determining setback
requirements can be challenging if not
familiar with the code. Contact the City at
(951) 461-6061 to determine exact
requirements for your situation.
1MMC §16.44.150, Table 3-14
In cases where the Building and
Development Code differ, the more restrictive
code is applied.
 Structure Size
RV structures are considered an ‘Accessory
Structure - Garage’ under the Development
Code and, are allowed to be a maximum of
803

Page 2 of 3 ends

Visit our Website at http://www.murrietaca.gov/746/Development-Services 1,000 square feet in size or 50 percent of the
primary residence, whichever is greater1.

Please note that depending upon the zoning
on your property, the maximum lot coverage
allowed ranges from 25% to 50%2, which may
impact the ultimate size of the structure.

Contact the City at (951) 461-6061 to
determine the zoning and exact requirements
for your situation.
(The maximum size and lot coverage noted
above do not apply to other unpermitted
structures (i.e., shed, barn, garage, patio
cover) built in the setback. Please refer to
Section V.)
1MMC§16.44.150.C; 2MMC§16.08.020, Table 16.08-3
 Structure Location
Pursuant to the CA Residential Code and CA
Fire Code, emergency escape and rescue
openings (e.g., windows, doors) must be
maintained without any obstructions, such as
from an RV structure that is too close to allow
access to the openings.

CRC §310.1.1; CFC §504.1
 Structure Height
Similar to setback requirements, height limits
vary depending upon your neighborhood.

Generally speaking, however, the height of
the RV structure cannot exceed the height of
the primary structure (home). Again, contact
the City at (951) 461-6061 to determine exact
requirements for your situation.

IV. DO I NEED A BUILDING PERMIT FOR AN
ENCLOSURE OR SHADE STRUCTURE?
Yes. At a minimum, a Building Permit is required
for all permanent or temporary (≥180
days/calendar year1) enclosures or shade
structures, with one exception: one-story,
detached enclosures or shade structures that do
not exceed 120 square feet are exempt from a
building permit2. Please note, however, that
exempt enclosures are still required to comply
with setback and location requirements described
in Section III.

Also, a Development Plan Permit will be required
if the size of the enclosure or shade structure is
>25% of the floor area of the primary structure or
500 square feet, whichever is less3. The
Development Plan Permit must be reviewed and
approved by the City prior to issuance of the
building permit.
1 CRC §R107.1;2 CRC §R105.2;3MMC §16.44.150;
V. IS THERE A ‘GRANDFATHERING’ POLICY
FOR UNPERMITTED STRUCTURES?
Yes. In an effort to help ensure public safety
while recognizing that some of the existing RV
structures have been erected for some time, the
City is authorizing structures that existed as of
November 2018 that encroach into the setback to
remain until the property is sold; at which time,
the non-compliant structure must be removed.

Structures that meet the criteria below are
eligible.
 RV structure is ≤560 square feet in size;
 RV structure is not enclosed (open on all four
sides from the ground to a height of at least
eight feet);
 There is no immediate health/safety issues
(i.e., exposed wiring, obvious structure
failures);
 The owner(s) shall provide an indemnification
& defense agreement holding the City
harmless for allowing the RV structure to
remain;
 The owner(s) shall record a certificate of nonconforming use on the title to the property informing all potential buyers that the nonconforming structure is to be removed upon the sale of the property.
 The code enforcement complaint did not
originate from the neighboring (adjacent)
property owner(s). .

Further, structures that maintain compliance with
this policy shall be allowed to remain until the
property is sold, even if the City later receives a
complaint from a neighboring property owner.

Existing structures not meeting the requirements
above will need to be removed or modified to
meet the requirements of this policy.

VI. ARE THERE LIMITATIONS ON HOW I CAN
ACCESS AN RV ONTO MY PROPERTY?
Yes. Under the Murrieta Municipal Code,
vehicular access to/from any ‘public place1’,
which includes public streets and sidewalks that
provide access to private property, requires
authorized ‘encroachment1’ over that public
place. RV access is only permissible via a City
permitted driveway opening2. The following are
examples of unlawful ways to access your
property with an RV under City code.
 Driving over the curb and sidewalk4
 Constructing an unpermitted ramp3
804

Page 3 of 3 ends

Visit our Website at http://www.murrietaca.gov/746/Development-Services  Unpermitted modifications to an existing
permitted driveway, curb, or sidewalk3
 Accessing the property from a pedestrian
ramp located at an intersection4
1 MMC §15.54.020;2MMC §15.54.040;3MMC §15.54.040.B;4MMC §15.54.040.G;
VII. ARE THERE LIMITATIONS ON THE DESIGN
OF PERMISSIBLE DRIVEWAY OPENINGS?
Yes. The City Council has adopted Public Street
Design Standards that include minimum
standards for driveway location1and driveway
apron design2. Some important requirements
specified in those standards include the following:
 Driveway opening must be a minimum of five
(5) feet away from the point of curvature at an
intersection to ensure safe sightdistance1
 A minimum of 20 feet between driveways is
required to allow on-street parking between
access points2
 Driveway width must be a minimum of 12
feet, and a maximum of 30 feet2
Driveways shall be consistent with the standards
adopted with original neighborhood construction,
unless otherwise approved by the City Engineer.

Please contact the City Engineer if you are
unable to comply with the standards.
1Drawing #307; 2Drawing #308a and #308b;
VIII. DO I NEED A PERMIT FOR A DRIVEWAY
OPENING?
Yes. A property owner must obtain an
Encroachment Permit from the City prior to
construction or modification of any driveway
opening1. Please contact the Engineering
Division at (951) 461-6077 to determine exact
requirements for your situation.
1MMC §15.54.040
IX. IS THERE A ‘GRANDFATHERING’ POLICY
FOR UNPERMITTED ACCESS?
No. Unlike private structures, driving over a
public pedestrian curb ramp or portion of the
public sidewalk without an approved driveway
apron constitutes a dangerous condition1
because such improvements are meant for
pedestrians, not vehicles. Should the City
knowingly authorize the continued use of
unpermitted access which then results in an
injury, the City can be held liable; even if the
property owner signs an indemnification and
defense agreement holding the City harmless2.

RESOLUTION NO. 26-4976

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF MURRIETA,

CALIFORNIA DENYING THE APPEAL OF THE DENIAL

OF AN ENCROACHMENT PERMIT FOR A SECOND DRIVEWAY APRON
AT 38765 CLEARBROOK DRIVE AND UPHOLDING THE DECISION OF

THE DEPARTMENT OF PUBLIC WORKS & ENGINEERING
WHEREAS, Murrieta Municipal Code (MMC) Section 15.54.040 requires a property owner to obtain an encroachment permit from the City prior to constructing or repairing a driveway or placing any encroachment in or across any street right-of-way, and recreational vehicles (RV) may only access side or rear yards via a permitted driveway opening; unpermitted ramps and driving over curbs/sidewalks are not allowed Under Murrieta Municipal Code Section 15.54.040, a property owner must obtain an encroachment permit from the City prior to constructing or repairing a driveway or placing any encroachment in or across any street right of way, and an RV can only access a side or rear yard via a permitted driveway opening; unpermitted ramps and driving an RV over the curb and sidewalk are not allowed; and WHEREAS, on December 18, 2025, appellant and property owner Dennis Tarlecki submitted an application for an encroachment permit to add a second driveway apron within the public right-of-way at 38765 Clearbrook Drive to drive over the right of way to park vehicles in the yard behind a fence on a residential property; and
WHEREAS, staff determined the initial application should be resubmitted to ensure the appellant received written notice of appeal rights, and on July 1, 2026, the appellant filed a subsequent application for an encroachment permit to add a second driveway apron in the public right-of-way; and
WHEREAS, on July 9, 2026, the City issued a Notice of Encroachment Permit Denial stating two grounds for denial: (1) the proposed second driveway would constitute a dangerous condition due to lack of adequate sight distance at the curved roadway location; and (2) the combined driveways would exceed forty percent of the lot frontage contrary to the region-wide standard; and
WHEREAS, the City has an obligation to maintain sidewalks and roadways in a safe condition, and under the Government Claims Act, a public entity may be held liable for injuries caused by a dangerous condition of public property that is reasonably foreseeable; therefore, the City should not issue an encroachment permit where doing so could create a dangerous condition, particularly where a second driveway would be located on a curved road potentially obscuring visibility for drivers, cyclists, and pedestrians; and
WHEREAS, the record reflects that the proposed second driveway location on a curved roadway could foreseeably increase collision risk by limiting sight distance, introducing additional conflict points among turning vehicles, through traffic, cyclists, and pedestrians, and disrupting the continuity and accessibility of the pedestrian path of travel including ADA compliance, thereby elevating foreseeable hazards to road users in the public right-of-way; and 829
01375.0024 2197449.2
WHEREAS, on July 16, 2026, the appellant filed a timely appeal of the denial pursuant to MMC Section 15.54.280, asserting that (1) line-of-sight distances are adequate and the area includes effective engineering and administrative traffic controls; (2) the City applied an incorrect regulation regarding the forty percent lot frontage limit and that Bulletin 229/standard drawings control; and (3) the encroachment is necessary for reasonable use/enjoyment and alternate access is not feasible; and
WHEREAS, pursuant to MMC Section 15.54.280, upon receipt of an appeal, the City Council has the power to reverse, modify, or otherwise alter the determinations and orders of the City Engineer; and
WHEREAS, the City Council scheduled the consideration of the appeal at a noticed public meeting to consider the appeal, staff’s report and analysis, the appellant’s submittals, and the administrative record; and
WHEREAS, staff recommends that the City Council deny the appeal and uphold the Department of Public Works & Engineering’s decision to deny the encroachment permit based on the findings in the staff report; and
WHEREAS, the City Council has independently reviewed, considered, and weighed the evidence in the entire administrative record, including but not limited to the staff report, the attachments to the staff report, and the testimony presented at the public meeting.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MURRIETA, CALIFORNIA DOES HEREBY RESOLVE AS FOLLOWS:

Section 1. The recitals above are true and correct and incorporated herein by this reference.

Section 2. Applicable Encroachment Permit Criteria and Standards.

A. Encroachment Permit Requirement and Safety Obligation. MMC Section

15.54.040 requires an encroachment permit for driveway construction in the public rightof-way. The City is obligated to maintain public property, including streets and sidewalks, in a safe condition; permits should not be issued where the encroachment would create or contribute to a dangerous condition in the right-of-way.

B. Lot Frontage Standard. The Department of Public Works & Engineering determined that the combined widths of the existing and proposed driveways would exceed forty percent of the lot frontage, a region-wide standard applied by the City in evaluating driveway encroachments.

Section 3.

A. Dangerous Condition/Sight Distance (Primary Basis). The record shows that the proposed second driveway is on a curved segment of Clearbrook Drive where sight distances are limited; adding a second curb cut would introduce additional conflict points among vehicles, cyclists, and pedestrians, and could disrupt the pedestrian path of travel, including ADA accessibility. The proposed driveway location on a curved road limits sight distance and would foreseeably increase collision risk by adding conflict points and 830
01375.0024 2197449.2
potentially disrupting the continuity and accessibility of the pedestrian path of travel including ADA compliance.

Authorizing an encroachment that foreseeably elevates collision risk would be inconsistent with the City’s obligation to maintain safe public property and administer encroachment permits to avoid creating dangerous conditions. The City has an obligation to maintain sidewalks and roadways in a safe condition and should not issue an encroachment permit for a second driveway in a location where doing so could create a dangerous condition. Mr. Tarleki is seeking a second driveway in a location where the road curves, potentially obscuring visibility for drivers, cyclists, and pedestrians. As a result, the City Council finds that granting the permit would create or contribute to a dangerous condition due to limited sight distance at the curve and added conflict points, and is therefore inconsistent with the safety-related administration of the encroachment permit program set forth in MMC Section 15.54.040. Staff identified that the second driveway would constitute a dangerous condition due to lack of adequate sight distance at the curve and would increase foreseeable hazards through added conflict points, and the City should not issue an encroachment permit in a location where doing so could create a dangerous condition.

B. Lot Frontage/Multiple Driveway Control (Independent, Secondary Basis). The record shows that the combined driveways would exceed forty percent of the lot frontage, contrary to the region-wide standard cited in the City’s denial and reflected in the site plan analysis. Limiting curb cuts and cumulative driveway frontage advances safety by reducing turning conflict points, preserving on-street parking, and maintaining pedestrian continuity. Therefore, independently of the safety finding above, the City Council finds the application fails the applied lot frontage standard and may be denied on this basis.

Section 4. Responses to Appellant’s Material Arguments.

A. Line-of-Sight Adequacy and Existing Traffic Controls. Appellant’s position is that the area includes adequate line-of-sight distances (approximately 500 feet north, 200 feet south) and multiple traffic calming/controls (posted 15 MPH, no parking signs, lighting, speed bumps, sidewalks, crosswalks), rendering the driveway safe. The City Council finds that the 15 MPH signs are advisory signs that recommend a safe speed due to the speed humps, they do not impose a speed limit and that notwithstanding the features identified by Appellant, the driveway would be located on a curve with inherently limited sight distance; adding a second curb cut introduces additional conflict points and could disrupt pedestrian path continuity, including ADA accessibility. For these reasons, the Appellant’s assertions do not overcome the City Engineer’s safety determination. Staff found the proposed second driveway at the curve would constitute a dangerous condition due to limited sight distance and added conflict points, and would disrupt pedestrian path continuity including ADA considerations.

B. Lot Frontage Standard vs. Bulletin 229/Drawings. The Appellant asserts that the City applied the wrong regulation and that Bulletin 229 and drawings govern, while staff cited that the combined driveways would exceed forty percent of the lot frontage contrary to the region-wide standard. The City Council finds that the denial relied on the regionwide forty percent lot frontage standard used by the City in evaluating driveway encroachments; even assuming spacing/setback compliance, the combined widths would 831
01375.0024 2197449.2
exceed the forty percent limit, providing an independent basis for denial as stated in the notice of denial and analyzed in the site plan.

C. Necessity/Alternate Access and Private Convenience. The Appellant also argues that the second driveway is necessary for reasonable use/enjoyment, aesthetics, home value, and trailer access and that alternate access to his rear yard is not feasible. The City Council finds that encroachment permits are evaluated against public safety and right-ofway standards and that identified safety hazards and applicable standards govern.

Accordingly, private convenience cannot justify an encroachment that would create or contribute to a dangerous condition. Staff identified safety hazards and standards governing encroachments that the proposed second driveway fails to satisfy.

Section 5. Decision. For the reasons set forth above and based on the entire administrative record, the City Council denies the appeal and upholds the Department of Public Works & Engineering’s denial of the encroachment permit application for a second driveway apron at 38765 Clearbrook Drive based on the findings discussed in the report, including dangerous condition due to sight distance at the curve and for exceeding the forty percent front lot coverage standard.

Section 6. Judicial Review Notice. Any judicial review of this decision shall be governed by applicable law.

Section 7. Effective Date. This Resolution shall take effect immediately upon its adoption.

PASSED AND ADOPTED this 6th day of October, 2026.

Discussion Regarding City Council Meeting Start Times

ABSTRACT
At the request of Council Member DeForest, the City Council will review the current start times for Closed Session and Regular City Council meetings and discuss potential adjustments. In October 2025, the City Council changed the Regular meeting start time to 4:00 p.m., with Closed Session immediately following. Staff will provide historical and current meeting data to support the City Council’s discussion.

RECOMMENDATION
Review and discuss the start time for City Council meeting days; and If applicable, begin any updates at the first regular meeting in 2027; OR
Take other actions the City Council considers appropriate.

PRIOR ACTION/VOTE
On September 16, 2025, the City Council adopted the 2026 City Council Meeting Schedule and discussed potential adjustments to the regular meeting start time and schedule. The City Council directed staff to return with options for adjusting meeting start times and workshop scheduling (Vote: 5-0).

On October 21, 2025, the City Council amended the start time of Regular City Council meetings to 4:00 p.m., with Closed Session following immediately thereafter (Vote: 4-0-1).

STRATEGIC ALIGNMENT
This item aligns with the City Council's goal of maintaining a high-performing organization that values fiscal sustainability, transparency, accountability, and organizational efficiency. As part of the ongoing review of the City Council Rules of Procedure, this discussion provides an opportunity to evaluate the provisions governing City Council meeting days and times and determine whether updates are appropriate.

DISCUSSION
The Murrieta Municipal Code provides that City Council meetings are held as determined by the City Council.

Currently, Resolution No. 19-4178, et al., governs that the City Council hold regular meetings on the first and third Tuesdays of each month beginning at 6:00 p.m., with the Consent Calendar business at 7:00 p.m. Under normal circumstances, Closed Sessions are to begin no earlier than 4:00 p.m. on regular meeting days.

Furthermore, workshops are not intended to begin before 4:00 p.m. Resolution No. 19-4178 et al., and the City Council Rules of Procedure are scheduled to be updated pending confirmation or potential changes to City Council Meeting start times.

At the September 16, 2025, City Council meeting, the City Council reviewed, discussed, and approved the 2026 City Council Meeting Schedule. Additionally, the City Council discussed whether to review and possibly change the start time and schedule of City Council meetings.

On October 21, 2025, after discussion, the City Council approved changing the time of the Regular City Council meetings to 4:00 p.m., with the Closed Session to follow immediately thereafter. Since January 2026, City Council Regular meetings have been held at 4:00 p.m.

During the August 18, 2026, Regular City Council meeting, under Council Member Requests to Add Items to Future Agendas, Council Member DeForest gained consensus for staff to return to consider holding Closed Session at 4:00 p.m., with the Regular City Council meeting to start at 5:00 p.m.

As a best practice, the City Council's Rules of Procedure (ROP), which govern City Council meeting days and times, are reviewed to ensure alignment with the City Council's goals and priorities. In the past year, due to City Council, administrative, and state mandates, amendments have been drafted to various sections of the ROP to better align with the organization's needs. This discussion provides an opportunity for the City Council to review the meeting schedule that best supports City Council operations and community participation. The outcome of this item may include final amendments to the ROP, which will then return to the City Council for formal adoption.

The City Council will consider: 1) start time of Closed Sessions; and 2) start time of the Regular City Council meetings; however, additional matters pertaining to the City Council meeting schedule may be brought forward to support City Council dialogue. During the October 6, 2026, City Council meeting, the City Clerk will provide the start times of prior and current City Council meetings, including the duration of each meeting.
