Memorandum
TO: Honorable Mayor and Members of the City Council, City of National City FROM: SCI Consulting Group
DATE: March 24, 2026
SUBJECT: Commercial Cannabis Business Fee Study and Updated Fee Schedule

This memorandum provides background and supporting documentation regarding the updated Commercial Cannabis Business Fee Schedule, including the methodology used to develop the proposed fees.

BACKGROUND :

The City’s Commercial Cannabis Business Fee Schedule was originally adopted on December 7, 2021, by Resolution No. 2021-194. The fee schedule established five new commercial cannabis business permit fees necessary to recover the costs associated with creating and administering the application process for commercial cannabis business permits. These fees went into effect on February 7, 2022.

Since adoption, the City has gained several years of experience administering the cannabis regulatory program. Based on this operational experience, staff has identified the need to refine the fee structure to better align with actual program costs and ensure full cost recovery consistent with State law.  Cannabis Business Permit Renewal Fee
 Annual Cannabis Business Permit Fee
 Compliance Inspection Fee
 Financial Audit Fee
FEE STUDY OVERVIEW AND METHODOLOGY :

The City retained SCI Consulting Group to conduct a cost recovery analysis of the costs associated with the development, operation, and administration of the cannabis regulatory program, including the processing of cannabis business permit applications.

The fee study is grounded in a cost-of-service methodology that aligns with the legal framework for regulatory fees under California law, including Proposition 26. Under this framework, regulatory fees must not exceed the reasonable cost of providing the service and must bear a fair relationship to the burden placed on City resources by the fee payer.

To develop defensible and accurate fees, SCI utilized an activity-based costing approach. This methodology is widely recognized as a best practice in municipal fee studies and involves the following steps:
 Identification of all program activities required to administer the cannabis regulatory program.  Estimation of staff and consultant time required to perform each activity based on actual program experience and operational data collected since program implementation.

Page 862 of 908 ends

 Application of Fully Burdened Hourly Rates for each department or contractor involved, which include salary, benefits, overhead, and administrative costs.  Aggregation of total costs associated with each activity to determine the appropriate fee level necessary to achieve cost recovery
DATA AND METRICS USED:

The analysis relied on multiple data sources, including:
 Actual staff and consultant time spent on permitting, compliance, and enforcement activities  Contracted service costs under the City’s professional services agreement with SCI Consulting Group
 Relevant requirements outlined in the Napa County Municipal Code, including Chapters

9.60.230, 9.60.340, and 9.60.350
 Industry benchmarks and SCI Consulting Group’s experience administering similar programs across California
SUMMARY OF PROPOSED NEW FEES:

1. Cannabis Business Permit Renewal Fee:

Pursuant to NCMC 9.60.340 and 9.60.350, commercial cannabis permits expire 12 months after issuance and must be renewed annually. This fee recovers the costs associated with reviewing renewal applications and issuing renewed permits. Activities include evaluating compliance history, verifying required documentation, and confirming continued adherence to local and state regulations. The fee is based on the estimated staff and consultant time required to complete these tasks.

2. Annual Cannabis Business Permit Fee:

This fee applies to all permitted cannabis businesses and supports ongoing administration of the regulatory program. It covers compliance monitoring, enforcement activities, and program updates necessary to ensure continued compliance. Based on observed program operations over the past four years, the annual effort is conservatively estimated at approximately five hours per business.

3. Compliance Inspection and Financial Audit Fees:

Pursuant to NCMC 9.60.230(N)(1), the City may conduct compliance inspections and financial audits at its discretion. These fees are based on the fixed cost of services provided under the City’s agreement with SCI Consulting Group. The inspection fee includes the contracted amount of $2,000 per inspection plus an additional $400 to recover travel-related costs. Audit fees are similarly based on contracted service costs.

Fee Description Type Fee 1 Unit
CBP Renewal Fee Fee $1,011 per application
Annual CBP Fee Fee $1,500 per business
Compliance Inspection Fee Fee $2,400 per inspection
Finacial Audit Fee Fee $6,500 per audit

NATIONAL CITY POLICE DEPARTMENT

MEMORANDUM

DATE: March 26, 2026

TO: Alejandro Hernandez, Acting City Manager

FROM: Christopher Sullivan, Captain

SUBJECT: Live Scan Services

The Police Department is recommending that Live Scan fingerprinting services be offered to the public. With the introduction of this new service, we are requesting the implementation of a fee schedule to ensure a small cost recovery.

Live Scan is an inkless, electronic fingerprinting process use to conduct criminal record background checks through the Department of Justice (DOJ) and the Federal Bureau of Investigations (FBI). The City currently uses the Live Scan process internally for prospective employees, while the public could use the service for employment, licensing, or certification.

At present, the City absorbs the full cost of all Live Scan services, including personnel time and DOJ processing fees, resulting in an impact to the General F und. Staff recommends implementing a fee structure that ensures cost recovery for staff time associated with administering fingerprinting services including customer assistance, processing , and administrative duties. Other Police Departments in the County have similar fees between $18 - $20.The DOJ fee is a mandated cost set by the State of California and will be collected without markup.
- Roll-Out Fee (Personnel Cost): $20
- DOJ Processing Fee: $32 per application
- Total cost to the applicant is $52.

If this proposal is approved, the recommendation will be for fingerprinting services to be offered two days per week, for a two-hour window on an appointment-only basis. Appointments will be scheduled in 30-minute intervals to ensure efficient operations . Th e proposed fee structure will allow the City to recover costs associated with this new service available to the public.

AGENDA REPORT

Department: Community Services
Prepared by: Mike Pacheco, Community Services Director Meeting Date: Tuesday, April 21, 2026
Approved by: Alejandro Hernandez, Acting City Manager

SUBJECT:

Approval of an Amendment to the Lease and Operating Agreement Between the City of National City and American Golf Corporation for the Operation of the Las Palmas Municipal Golf Course.

RECOMMENDATION:

Adopt the Resolution Entitled, “Resolution of the City Council of the City of Natio nal City, California, Authorizing the Mayor to Execute an Amendment to the Agreement with American Golf Corporation for the Maintenance and Operation of the National City Golf Course to Extend the Agreement by Five-Years, Among Other Updates to the Agreement Terms.

BOARD/COMMISSION/COMMITTEE PRIOR ACTION:

Not Applicable.

EXPLANATION:

The City of National City entered into a Lease and Operating Agreement with American Golf Corporation (AGC) on May 3, 1984, for the operation of the Las Palmas Municipal Golf Course, a City-owned facility. The agreement provided for an initial five-year term with seven (7) five-year extensions at AGC’s discretion, and two (2) additional five-year options at the City’s discretion.

AGC exercised all seven of its extensions, with the lease scheduled to expire on August 31, 2025.

On August 19, 2025, per Resolution 2025-100, the City and AGC approved a short-term sixty-day extension to allow time for staff and legal review of the e xisting agreement, given that many provisions were outdated and did not reflect current operational standards or City policy. On December 2, 2025, per Resolution 2025-178, the City and AGC approved further extending the Agreement by an additional one hundr ed twenty (120) days to February 28, 2026 to allow additional time to negotiate potential modifications to the Agreement, and to ensure continuation of golf course operations in the interim.

The proposed Second Amendment represents a comprehensive update to ensure continued operation of the golf course while improving accountability, maintenance oversight, and financial return to the City.

Key Terms of the Second Amendment
The amendment includes the following substantive updates:

1. Term Extension
a. Extends the agreement an additional five (5) years, through February 28, 2031

2. Updated Rent and Revenue Sharing
a. Increases the minimum annual rent to $100,000 per year. b. Establishes a 10% gross revenue share across all categories, including green fees, cart rentals, driving range, food and beverage, and pro shop sales.

Page 865 of 908 ends

3. Landlord Approval f or any construction, repair, renovation or modification valued at $10,000 or more
a. AGC must submit detailed plans and specifications to the city and receive approval before starting any work.
b. All work must strictly follow the plans that the city approved. c. Once finished, AGC must provide the city with one set of reproducible "As -Built" plans.

4. Youth Golf Lessons
a. Language added to existing section that this provision only applied during the first 5 years, to reflect the current practice to provide a golf lesson program at no cost to the Community Services Department (services continued beyond 5 years).

5. Emergency Repairs
a. The City has the right to make necessary repairs in emergency situations, with cost recovery from AGC.

6. Indemnification and Hold Harmless Clause
a. Adds a comprehensive indemnity provision requiring AGC to defend, indemnify, and hold harmless the City, its officers, and employees against claims arising from AGC’s operations or site conditions.

7. Capital Reserve Fund
a. Establishes a Capital Reserve Fund requiring AGC to deposit 2% of monthly gross income into a restricted account for capital improvements and major repairs, subject to City approval before use.
b. Through community input, AGC established the following work listed in Exhibit D – total estimated cost is $276,500:
i. #1 Tee Bridge Replacement: To be manufactured and installed according to plans submitted for city permits. (Not included in costs.)

1. Complete on or before on before July 1, 2027
vii. Clubhouse Restroom Renovation - estimated cost is $50,000

1. Complete on or before April 1, 2028

8. Monthly Operational Meetings
a. Requires monthly coordination meetings between City staff and AGC management to discuss operations, revenues, maintenance, and community programming.

9. Annual Fee Review
a. Adds an annual review meeting with the City to assess golf course fees to ensure compliance with the original lease intent and market conditions.

2026 City of San Diego Golf Course Lease Audit
For comparison and reference, staff conducted an informal audit, or review, of the City of San Diego golf course leases in February 2026. The results of that review indicate that San Diego’s third-party golf leases are currently below market value. Comparing these results to National City is difficult, however, as the audited San Diego facilities do not include any 9 -hole courses that match National City’s specific scale and layout. It is also challenging to determine factors for an objective comparison across different locations. Nonetheless, National City’s golf course lease, with regards to revenue generated, appears to be outperforming some of the San Diego leases.

BOARD/COMMISSION/COMMITTEE PRIOR ACTION:

EXPLANATION:

The property located at 1508 E. 8th Street has been the subject of ongoing code enforcement due to the accumulation of junk, debris, and unsafe conditions, constituting a public nuisance.

The property owner failed to comply within the required timeframe. Between October 2024 and February 2025, the City issued seven administr ative citations for continued non -compliance.

Although the fines were ultimately paid, the violations persisted.

Due to continued non -compliance, the City obtained an abatement and inspection warrant on September 3, 2025, authorizing entry onto the propert y. A City -led abatement was conducted between September 16 and September 18, 2025, during which significant quantities of debris, trash, and discarded appliances were removed.

On November 24, 2025, the City issued and posted a Statement of Costs and Notice and Order (N&O), providing the property owner an opportunity to reimburse the City for abatement expenses. The compliance period expired on January 22, 2026, without payment.

All administrative and actual costs incurred by the City in abating the public n uisance may be assessed and recovered against the responsible person. AGENDA REPORT

Department: Finance
Prepared by: Paul Valadez, Budget Manager
Meeting Date: Tuesday, April 21, 2026
Approved by: Alejandro Hernandez, Acting City Manager

SUBJECT:

Fiscal Year 2026 Third Quarter Budget Review

RECOMMENDATION:

Accept and File this Report, and Adopt a Resolution Entitle d, “Resolution of the City Council of the City of National City, California, Authorizing Various Fiscal Year 2026 Third Quarter Budget Adjustments.”

BOARD/COMMISSION/COMMITTEE PRIOR ACTION:

Not Applicable.

EXPLANATION:

Summary
This report provides a look at the status of the City’s fiscal year 2026 General Fund Budget through March 31, 2026 . A quarterly status report was provided on December 2, 2025. This report also recommends various budget adjustments for fiscal year 2026.

The adopted fiscal year 2026 General Fund budget estimated a use of General Fund unassigned fund balance of $ 8.3 million, as well as $1.0 million from the Economic Contingency Reserve .

When factoring in mid -year appropriations for negotiated compensation agreements and other items, the adjusted budget expenditures are currently $12.8 million above budgeted revenues.

Based on a revised analysis of year -to-date actual revenues and expenditures and projected financial activity through year -end, the use of approximately $10.3 million of unassigned fund balance is now projected. The following sections of this report will discuss the significant factors leading to this outcome.

Revenues
For fiscal year 2026, General Fund revenues are expected to be greater overall than amounts budgeted by $0.7 million. The projected variances by revenue category are shown in Table A.

Page 901 of 908 ends

Table A
General Fund Revenues Fiscal Year 2026

Note: The Adjusted Budget equals the Adopted Budget plus any year-to-date amendments to the budget.

The General Fund’s primary sources of revenue are the sales & use tax, the district transactions & use tax, property tax in lieu of vehicle license fees, and property taxes. Projections are based on a combination of year-to-date and historical data, input from the City’s sales tax consultant, and information obtained from the State of California and County of San Diego :

 Sales & Use Tax and District Transactions & Use Tax: The adopted budget for these two major funding sources anticipated moderate growth . Retail sales are trending as anticipated, resulting in these revenues projecting to within 2% of the budget . Based on projections provided by the City’s sales tax consultant, Sales Tax revenues are expected to marginally exceed the adopted budget. The District Transactions & Use Tax is currently expected to finish the year at $0.9 million above the budgeted level. Staff is working on a continuing basis with the City’s sa les tax consultant to ensure that we have the latest information for each of these funding sources.
 Property Tax revenue is expected to come in below budget by approximately $ 70,000.

Assessed values that apply to the General Fund are in line with the ass umptions in the adopted budget.
 Property Tax in Lieu of Vehicle License Fees (VLF) is based on a formula that applies the City-wide increase in assessed property values to the prior year’s allocation. The exact increase in assessed values was not known at the time the budget was prepared, but the actual amount is now projected to be $134,000 less than budgeted.

Revenues in the “Other Revenues” category are expected to end the year below budget by $37,000, which is attributable to a combination of projected positive and negative variances in the various individual accounts. Contributing to the positive variances are amounts expected to be received from the Successor Agency residual balance and pass-through distributions ($300,000) and investment earnings ($300,000), while negative variances are projecting to be seen in Franchise Fees ( -$200,000), Fire Inspections ( -$150,000), Commercial Cannabis ( -$134,000), and Building Permits (-$100,000).

Expenditures

Expenditure totals at year-end are currently projected to end below the adjusted budget by $1.9 million. $1.0 million of this amount is related to the Economic Contingency Funds included in the adopted budget. The variances by expenditure category are shown in Table B. Budget adjustments, which are discussed below and detailed in Exhibit A, are being recommended as part of this report to ensure that expenditures stay within authorized appropriations.

Table B
General Fund Expenditures Fiscal Year 2026

Note: The Adjusted Budget equals the Adopted Budget plus any year-to-date amendments to the budget.

Personnel costs make up about 6 5% of the General Fund’s adopted budget. At fiscal -year-end they are projected to be less than budgeted by approximately $0. 5 million. The projection is the result of a combination of savings of approximately $2.3 million associated with employee attrition and vacant authorized positions. These savings are offset by costs for overt ime requirements, primarily in the Police and Fire departments, which are expected to exceed budgeted amounts by $1.8 million.

Maintenance & Operations expenditures are projected to be $1.3 million over budget overall. The majority of this amount ($1.0 million) is related to Economic Contingency Reserve fund included for the “City Revitalization Project”. This project is not anticipated to begin during fiscal year 2026, and the funds will return to the Economic Contingency Reserve.

The remaining $0.3 million is primarily attributable to anticipated savings across various accounts and departments.

Capital Outlay savings of $0.2 million are expected to be seen in various computer, safety, and communication equipment accounts.

In the Internal Service Charges and Transfers Out categories, all amounts budgeted are projected to be spent, although at year -end actual expenditures of the service provider funds will be reviewed for savings and charges will be adjusted accordingly. The $60,000 variance in the transfer out category reflects an additional transfer to the Parks Fund for additional contract services.

Net Impact on Unassigned Fund Balance

Table C below combines the revenue and expenditure projections discussed above to display the impact of those projections on fund balance. Unassigned fund balance is considered to be one of the City’s reserves and has a maintenance target level of 10% of the City’s General Fund operating budget. Amounts above the target level may be used to augment other reserves or for one-time expenditures.

As noted in the summary at the beginning of this report, the fiscal year 2026 adopted budget included the use of $8.3 million of General Fund unassigned fund balance and $1.0 million of Economic Contingency Reserve funds. The projected column, however, shows an estimated use of $10.3 million in fund balance.

Table C
General Fund Impact on Fund Balance Fiscal Year 2026

BUDGET ADJUSTMENTS

During the budget review process, the Finance Department, in conjunction with City department staff, identified budget adjustments necessary due to expenses unanticipated during the annual budgeting process. The attached schedule (“Exhibit ‘A’”) details the recommended adjustments.

The section below provides a summary of those adjustments by fund.

FINANCIAL STATEMENT:

Based on a review and analysis of General Fund expenditures and revenues through March 31, 2026, the projected use of unassigned fund balance is $10.3 million for the fiscal year ending June 30, 2026.
