WHEREAS, a universal Form 130 is effective for all open disasters and grants and for those declared up to three (3) years after the date of approval, and Cal OES requires a new resolution if the prior resolution is more than three years old, invalid, or not on file; and WHEREAS, the City does not have a current Form 130 on file with Cal OES; and WHEREAS, on September 21, 2026, the Governor proclaimed a statewide State of Emergency due to the developing 2026–2027 El Niño event; on September 30, 2026, the County of San Diego proclaimed a countywide local emergency that includes National City; and the City Council is concurrently proclaiming a local emergency by Resolution No. 2026-___, Section 8 of which directs staff to confirm or update the City’s Form 130; and WHEREAS, designating authorized agents by title, rather than by name, keeps the designation valid when the people holding those positions change, and Cal OES accepts a separate List of Authorized Agents (Form OES-FPD-012) identifying the current officeholders by name.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA, DOES HEREBY RESOLVE, DETERMINE, AND DECLARE AS FOLLOWS:

Cal OES Form 130 Instructions
A Designation of Applicant’s Agent Resolution for Non-State Agencies is required of all Applicants to be eligible to receive funding. A new resolution must be submitted if a previously submitted resolution is older than three (3) years from the last date of approval, is invalid, or has not been submitted.

When completing the Cal OES Form 130, Applicants should fill in the blanks on pages 1 and 2. The blanks are to be filled in as follows:

Resolution Section:

Governing Body: This is the group responsible for appointing and approving the Authorized Agents.

Examples include: Board of Directors, City Council, Board of Supervisors, Board of Education, etc.

Name of Applicant: The public entity established under the laws of the State of California.

Examples include: School District, Office of Education, City, County or Non-profit agency that has applied for the grant, such as: City of San Diego, Sacramento County, Burbank Unified School District, Napa County Office of Education, University Southern California.

Authorized Agent: These are the individuals that are authorized by the Governing Body to engage with the Federal Emergency Management Agency and the California Governor’s Office of Emergency Services regarding grants for which they have applied.

There are two ways of completing this section:

1. Titles Only: The titles of the Authorized Agents should be entered here, not their names. This allows the document to remain valid if an Authorized Agent leaves the position and is replaced by another individual. If “Titles Only” is the chosen method, this document must be accompanied by either a cover letter naming the Authorized Agents by name and title, or the Cal OES AA Names document. The supporting document can be completed by any authorized person within the Agency (e.g., administrative assistant, the Authorized Agent, secretary to the Director). It does not require the Governing Body’s signature.

2. Names and Titles: If the Governing Body so chooses, the names and titles of the Authorized Agents would be listed. A new Cal OES Form 130 will be required if any of the Authorized Agents are replaced, leave the position listed on the document, or their title changes.

Checking Universal or Disaster-Specific Box: A Universal resolution is effective for all past disasters and for those declared up to three (3) years following the date of approval. Upon expiration it is no longer effective for new disasters, but it remains in effect for disasters declared prior to expiration. It remains effective until the disaster goes through closeout unless it is superseded by a newer resolution.

Governing Body Representative: These are the names and titles of the approving Board Members.

Examples include: Chairman of the Board, Director, Superintendent, etc. The names and titles cannot be one of the designated Authorized Agents. A minimum of three (3) approving board members must be listed. If less than three are present, meeting minutes must be attached in order to verify a quorum was met.

Certification Section:

Name and Title: This is the individual in attendance who recorded the creation and approval of this resolution.

Examples include: City Clerk, Secretary to the Board of Directors, County Clerk, etc. This person cannot be one of the designated Authorized Agents or Approving Board Member. If a person holds two positions (such as City Manager and Secretary to the Board) and the City Manager is to be listed as an Authorized Agent, then that person could sign the document as Secretary to the Board (not City Manager) to eliminate “Self-Certification.”

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NATIONAL CITY RATIFYING THE CITY MANAGERS’S DECLARATION OF AN EMERGENCY CONDITION FROM A LARGE

SINKHOLE AND DECLARATIONG THE NEED TO CONTINUE THE ACTIONS TAKEN BY THE

CITY MANAGER, AND ADOPTING A CEQA CATEGORICAL EXEMPTION WHEREAS, The City of National City has discovered an emergency condition on Highland Avenue between 24th and 26th Street where a large sinkhole developed within the City of National City, creating an immediate threat to public health and safety and causing potential damage to public infrastructure;
WHEREAS, failure to repair the condition caused by the sinkhole could result in significant damage to the City’s infrastructure, and could cause further damage; and WHEREAS, Public Contract Code Section 22050 allows for a public agency, in the case of an emergency, pursuant to a four-fifths (4/5) vote of its governing body, to repair or replace a public facility and procure the necessary equipment, services and supplies for those purposes, without giving notice for bids to let contracts or, alternatively, to delegate such emergency authority to its city manager, city engineer or other delegate with subsequent review and action by the public agency pursuant to a four-fifths (4/5) vote; and WHEREAS, the City Council has delegated authority to the City Manager over emergency public project work pursuant to section 2.60.230 of the National City Municipal Code; and WHEREAS, in order to protect the health, safety, and welfare of the public and City personnel, the City Manager has determined that there was a need for emergency work in order to remedy the emergency conditions on Highland Avenue between 24th and 26th streets (the “Project”), pursuant to his authority under subsection (B) of section 2.60.230 of the National City Municipal Code and Public Contract Code section 22050, and that the emergency would not permit a delay resulting from a competitive solicitation for bids for the Project; and WHEREAS, the City Manager determined that the Project required immediate repairs and related construction services (“Construction Services”) and that the City did not have sufficient and/or qualified staff to provide the Construction Services, and determined that the services of outside consultants were necessary for the special services required; and WHEREAS, Geosyntec (“Contractor”) has previously provided substantially similar Construction Services and Contractor represented that they are specially trained, experienced, and competent to provide the Construction Services, are on the City’s approved vendor list for public works, and are registered with the Department of Industrial Relations; and WHEREAS, pursuant to his emergency authority, the City Manager authorized entering into a construction agreement with Contractor for the Construction Services; and WHEREAS, the Project is exempt from the California Environmental Quality Act (“CEQA”) pursuant to CEQA Guidelines Section 15269, a categorical exemption for emergency repairs to publicly or privately owned serviced facilities necessary to maintain service essential to the public health, safety or welfare.

NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF NATIONAL CITY, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS:

Section 1. That the emergency condition for the developing sinkhole on Highland Avenue between 24 and 26th street, as declared by the City Manager is ratified.

Section 2. That the emergency condition declared by the City Manager still exists and, therefore, the actions taken by the City Manager pursuant to said emergency condition shall continue, including the construction services being provided Geosyntec.

Section 3. That the Project is exempt from the California Environmental Quality Act.

AGENDA REPORT
Department: City Manager's Office
Prepared by: Douglas J. Schulze, City Manager
Meeting Date: Tuesday, October 20, 2026
Approved by: Douglas J. Schulze, City Manager
SUBJECT:

Consideration of a Proposal to Reduce City Councilmember Budgets RECOMMENDATION:

Staff Recommends that the City Council:

1. Discuss the Proposal to Reduce City Councilmember Budgets

2. Provide Direction to Staff.

BOARD/COMMISSION/COMMITTEE PRIOR ACTION:

Not Applicable.

EXPLANATION:

Policy No. 105 Agenda Item Request was received and introduced by Councilmember Bush and Vice-Mayor Molina at the October 6, 2026, City Council Meeting. The item was introduced by Councilmember Bush as “Suspension or Elimination of Council Budgets.” Public Comment was received on the item from four members of the public. Councilmember Bush made the motion, seconded by Vice-Mayor Molina to add the item to the next City Council meeting agenda.

Motion carried by 4-1 vote, with Councilmember Rodriguez voting No.

As a result of that item this item is being presented for discussion and to provide City staff.

Councilmember Bush states, “his specific proposal is to reduce the Mayor/council budget by at least 25% across the board from the FY26 adopted budget amount of $100,000 for each councilmember and have expenditures not exceed $75,000 for each office. I’m open to any additional options from staff or Vice Mayor Molina including complete elimination of council budget, a bigger percentage reduction, or anything else.

I envision the next step would be to have the discussion at the next council meeting on 10/20, and council to provide staff direction. My potential motion would be to direct staff to work with each Council office on their proposal for 25% reduction in their costs and to come back with final council budget policy at the following meeting in November. This would allow each office to handle personnel issues with HR and legal and then we could come back with the specifics and the items that are confidential will either be discussed in closed session or handled between City Manager/HR office and the council office.”
FINANCIAL STATEMENT:

Not Applicable at this time.
