TITLE: Confirmation of Appointments to the General Plan Advisory Committee
ABSTRACT:

As directed by Resolution No. 2022-59, the General Plan Update Steering Committee reviewed applications for appointment to the General Plan Advisory Committee and recommends the appointment of thirty (30) applicants to the General Plan Advisory Committee, which will be tasked to: (1) ensure there is sufficient stakeholder input regarding the update to the City of Newport Beach General Plan; (2) review and provide guidance to City staff and its consultant(s) on changes to the General Plan goals and/or policies as part of the update process that are deemed necessary or advisable to reflect the community's vision for the City; and (3) make recommendations to the General Plan Update Steering Committee regarding changes to the General Plan goals and/or policies.

RECOMMENDATION:
a) Determine this action is exempt from the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) and 15060(c)(3) of the CEQA Guidelines because this action will not result in a physical change to the environment, directly or indirectly; and
b) Confirm the General Plan Update Steering Committee's recommended appointments of Dennis Baker, Curtis Black, James Carlson, Jeff Cefalia, Annalisa Clougherty, Corine Doughty, Jeremy Evans, Arlene Greer, David Guder, Lynn Hackman, Laird Hayes, Jared Hill, Charles Klobe, Ruth Kobayashi, Denis LaBonge, Jonathan Langford, Katie Love, Anthony Maniscalchi, Thomas Meng, Jim Mosher, Maxwell Pearson, Robert Rader, Nancy Scarbrough, Amber Snider, Debbie Stevens, Laurel Tippett, Graham Wahlberg, Christine Walker, Paul Watkins, and Lori Williams to fill the seats on the General Plan Advisory Committee.

DISCUSSION:

On September 13, 2022, the City Council approved Resolution No. 2022-59 attached hereto as Attachment A, creating the General Plan Advisory Committee (Advisory Committee) and directing that the General Plan Update Steering Committee (Steering Committee) review all applications for appointment to the Advisory Committee and make a recommendation to the City Council. Pursuant to Resolution No. 2022-59, the Advisory Committee members must be residents and registered voters of the City, cannot be members of the City Council, and should generally fit within the membership composition guidelines to help ensure a diverse representation of the community. Additionally, the Advisory Committee shall expire and sunset without further action by the City Council upon adoption of the General Plan Update, or sooner if acted upon by the City Council.

Pursuant to Resolution No. 2022-59, the Advisory Committee is an ad hoc committee, subject to the Ralph M. Brown Act, that will be tasked to:

A. Ensure there is sufficient stakeholder input regarding the update to the City of Newport Beach General Plan (General Plan Update);
B. Review and provide guidance to City staff and its consultant(s) on changes to General Plan goals and/or policies as part of the update process that are deemed necessary or advisable to reflect the community's vision for the city; and
C. Make recommendations to the Steering Committee regarding changes to General Plan goals and/or policies.

In accordance with the Maddy Act, the City Clerk prepared and posted a Notice of Vacancies on Wednesday, September 14, 2022, in the City Clerk's Office, on the bulletin board in the City Council Chambers, on the City's webpage, and published it in the Daily Pilot. In addition, given the larger number of vacancies, City staff shared the Notice on Nextdoor, in an eNotification distribution, and via direct email messages to contacts on a list of community associations in Newport Beach.

As provided in the Notice, applications were accepted by the City Clerk's Office until noon on Wednesday, September 28, 2022. At the conclusion of the application period, the applications were forwarded to the Steering Committee for review.

The Steering Committee held a duly noticed public meeting on Thursday, October 13, 2022. As authorized by Resolution No. 2022-59, the Steering Committee was assigned to review the applications and had the discretion to determine the process for selecting the Advisory Committee members. The Steering Committee was not required to comply with procedural or timing requirements set forth in City Council Policy A-2 (Boards, Commissions and Committees).

After consideration of the applications and deliberation at the meeting, the Steering Committee recommends that the individuals listed in Table 1, below, be appointed to the Advisory Committee. Draft minutes from the October 13, 2022, Steering Committee meeting are attached as Attachment B, and copies of the redacted applications are attached as Attachment C. Additionally, the Steering Committee requested that the entire list of applicants be provided to the City Council, which are attached as Attachment D.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY

OF NEWPORT BEACH, CALIFORNIA, CREATING THE

GENERAL PLAN ADVISORY COMMITTEE
WHEREAS, on January 25, 2022, the City Council adopted Resolution No. 2022- 2 establishing the General Plan Update Steering Committee ("Steering Committee") to guide the work of the comprehensive Newport Beach General Plan Update ("General Plan Update");
WHEREAS, the City Council values and respects the opinions, knowledge, and experiences of its residents and community stakeholders, and desires those residents and community stakeholders to play an important role in the General Plan Update process;
WHEREAS, one of the responsibilities of the Steering Committee is to make a recommendation to the City Council on the formation and membership of a General Plan Advisory Committee ("GPAC") that will help guide policy changes associated with the General Plan Update;
WHEREAS, the Steering Committee believes a GPAC will also provide an important public forum for the community's participation in shaping the goals and policies of the General Plan Update;
WHEREAS, at a duly noticed public meeting on August 8, 2022, the Steering {Committee discussed GPAC's membership and composition and directed staff to prepare a draft recommendation for consideration; and
WHEREAS, at a duly noticed public meeting on August 24, 2022, the Steering Committee reviewed and approved a recommendation to the City Council for the establishment of a GPAC, as described in Attachment "A" of this resolution.

NOW, THEREFORE, the City Council of the City of Newport Beach resolves as follows:

Section 1: The City Council does hereby create the General Plan Advisory Committee ("GPAC"), which shall be an ad hoc committee, with the number of members, term, qualification of members, selection process, responsibilities and other related rules as set forth in Attachment 'A" which is incorporated herein by reference.

Section 2: The recitals provided in this resolution are true and correct and are incorporated into the operative part of this resolution. 17-5

Section 3: If any section, subsection, sentence, clause or phrase of this resolution is, for any reason, held to be invalid or unconstitutional, such decision shall not affect the validity or constitutionality of the remaining portions of this resolution. The City Council hereby declares that it would have passed this resolution, and each section, subsection, sentence, clause or phrase hereof, irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared invalid or unconstitutional.

Section 4: The City Council finds the adoption of this resolution is not subject to the California Environmental Quality Act (CEQA) pursuant to Sections 15060(c)(2) (the activity will not result in a direct or reasonably foreseeable indirect physical change in the environment) and 15060(c)(3) (the activity is not a project as defined in Section 15378) of the CEQA Guidelines, California Code of Regulations, Title 14, Division 6, Chapter 3, because it has no potential for resulting in physical change to the environment, directly or indirectly.

Section 5: This resolution shall take effect immediately upon its adoption by the City Council, and the City Clerk shall certify the vote adopting the resolution.

AUTHORIZATION: Established by Resolution No. 2022- _ adopted on September 13, 2022.

MEMBERSHIP: Up to thirty (30) members consistent with the composition set forth below. Members will be
recommended by the General Plan Update

CURRENT BUSINESS
a. Discussion of General Plan Advisory Committee (GPAC) Applicants Chair Gardner indicated that the first order of business is to determine if the Committee thinks there is sufficient representation or if reopening the application process is necessary.

The Committee unanimously agreed that there was sufficient representation of the categories among the current applicant pool and no need to re -open the application process.

Jim Mosher, resident, suggested that draft meeting minutes be prepared and posted promptly after the meeting, thought the response to the application was anemic and the net of applicants is not as large as it should be. He relayed the 2002 visioning festival where the City solicited applications and had a mass newsletter mailing result in 252 applications received which was reduced to 52 before going to the Council who selected 37 people. Mr.

Mosher believed it would be a stretch to expect 30 positions to be filled by 37 applicants and there may be more qualified people who did not know about the opportunity.

While Chair Gardner acknowledged Mr. Mosher's comments, she thought the application process was robust and widely distributed and the Committee was ready to move forward.

She further commented that the Committee spent a lot of time reviewing the applications and took it seriously and agreed on 22 applicants who she thought should be placed on the GPAC and the remaining applications be discussed among the Committee with the possibility of conducting interviews.

Chair Gardner reminded the audience that the GPAC formation was not about rushing, 17-11

personality, or likeability, it is about filling holes to satisfy the needs in the City's planning process.

Committee Member Carter suggested the Committee focus on the 11 applicants who received "yes" votes from two Committee Members.

Committee Member Brown suggested taking an informal vote without a discussion to narrow down the 11 applications.

Chair Gardner asked the Committee to allow her to make a pitch for a few applicants.

Debbie Stevens, applicant and resident, expressed interest in serving on the GPAC again, noted she served on the previous GPAC, hoped for a diversified group, and thought the only way to reach the goal of gaining approval from the City is with a lot of variety.

Chair Gardner noted some young applicants.

Chair Gardner explained that she added Dennis Baker due to his environmental credentials and Denis LaBonge for his experience with Complete Streets and the Bike Safety Committee, as well that he is from District 7 which she believed to be underrepresented.

She corrected her statement to reflect one applicant from District 5 and three from District

7. Denis LaBonge, applicant and resident, provided his background, expressed interest in serving on the GPAC, and offered to answer questions.

Chair Gardner favored Christine Walker who owns property in Santa Ana Heights and David Guder.

Committee Member Carter indicated that it is most important to have representation from all the areas and as many as possible for areas underrepresented.

In response to Committee Member Carter's question, Principal Planner Zdeba confirmed that Mr. Mosher will not be able to serve on the GPAC if he wins a Council seat.

Chair Gardner encouraged the audience to not become disengaged if they do not end up on the GPAC because people drop out and their voice can be heard.

Mr. Mosher, applicant and resident, concurred with Chair Gardner and questioned if the applicant's current committee or commission involvement was relevant. In response, Chair Gardner recognized an applicant's experience and knowledge versus current involvement in a commission or committee.

Committee Member Brown and Carter agreed with Chair Gardner's suggested applicants, LaBonge, Baker, and Walker, and were added to the list along with David Guder.

Charles Klobe, president of Still Protecting Our Newport (SPON) and Newport Heights Homeowners Association (HOA), noted having attended every GPUSC meeting since its inception in 2019, and offered to answer questions. Committee Member Carter included Mr.

Klobe on her list for his involvement in a HOA.

Annie Clougherty, applicant and resident, provided her background, shared her interest in joining the GPAC after noticing all the changes in the area, and thought all the elements are important.

Anthony Maniscalchi, real estate developer in Glendale, CA, former pilot, and Newport Beach residence, shared his understanding of City codes, ordinances, and conflict, recognized serving on GPAC as an opportunity to volunteer, and believed he possesses the appropriate background.

Jeremy Evans, applicant and resident, thanked the Committee and expressed happiness to serve on the GPAC.

Chair Gardner read the list of applicants selected for the GPAC.

The Committee reviewed and recapped the list of unanimous "yes" votes. The Committee recommended adding Denis LaBonge, Dennis Baker, Christine Walker, Annie Clougherty, David Guder, Jim Mosher, Charles Klobe, and Anthony Maniscalchi.

In response to Committee Member Carter's questions, Deputy Community Development Director Campbell stated that the Committee can forward additional names to the City Council for alternates, however, the Council will receive the full applicant list and the Committee's recommendation from which to select.
b. Status Updates on the Housing, Circulation, and Land Use Elements Deputy Community Development Director Campbell noted the Housing Element being certified by the California Department of Housing and Community (HCD) and noted the amendment process initiated for implementation of the Housing Element with an adjustment to the Land Use Element policies and the Zoning Ordinance overlays. Furthermore, he indicated that staff is working with Kimley-Horn to prepare an EIR and conduct a traffic study, noted a schedule due to the City Council by December 2023, and indicated that the GPAC will examine policy changes and overlays to be brought back to the Committee in early 2023. Additionally, Deputy Community Development Director Campbell relayed a Circulation Element study session with the City Council and plans to bring it back to the City Council for adoption on October 25, 2022.

Since my retirement in 2000, 1 have immersed myself in community and civic issues. I have been active with and serve on multiple boards, most recently, SPON, CdM Residents Association, Line In The Sand, Orange Coast Diver Park, and others.

Especially as a SPON BOD member, I have been very active in monitoring and speaking, plus working with city staff on issues involving the quality of life in NPB. My background in civic activity provides me with a balanced understanding of haw our city functions. The General Plan, being the fundamental city document, is most important and is the basis on which all else rests. It Is very important that it clearly and unambiguously previde guidance for the upcoming years. As a teacher, I had to be able to work with a group (my students and the facility) to accomplish important task of education. That experience and my more recent experience working within various organizations prepares me well for serving on the GPAC. I took forward to serving it given the opportunity.

Harbor, boating or water quality and Environmental stewardship or conservation - t have advocated over the last 22 years for water quality (surface water) from the Santa Ana River to the 145 miles of Newport Bay Watershed to the ocean front. i have participated in State, County, and City hearings, committees, seminars, conferences and more regarding water quality. I was very active in the early 2000s in the successful effort to remove the federal waiver allowing the discharge of partially treated sewage into the ocean off of our coast.

I am also a paddler (surfski and outrigger), paddling in the bay and open ocean off our coast every 2 or 3 days year around. I see up close on a weekly basis the good and the bad in our ocean and bay.

I have worked closely with city staff on numerous occasions regarding water quality and environmental issues.

Public safety or community hazards - I am a current and up to date member of CERTS. As a Coron del Mar Residents Associaton (CdMRA) board director and neighborhood representative, ! have monthly interaction with our police district commander. CdMRA has ongoing communication with city council and city staff regarding community hazards and safety and as part of the BDD I am kept abreast.

Historic resources - I am a member of the CdMRA Historical Committee working closely with city, county, and private entities to document much of the history of Corona del Mar. I have also done volunteer work with the Sherman Gardens Library with regard to historic video.

Arts and cultural resources - While serving on the Board of Directors for Ballet Pacifica, I also served on the the City Arts Commission. As a commissioner, I was directly involved In art exhibition and selection In addition to multiple city events such as concerts in the park and Shakespeare in the park. My 23 years with the Newport Beach Film Festival as the Director of Short Film Programming has given me the opportunity to interact with filmmakers from around the world, many of whom the Festival hosts here in Newport Beach. I have total final responsibility for all of the short films that are selected and screened each year. My wife and I are long term supporters and consumers of the arts programs at UCI and also the Wooden Floor, We are also supporters of the Library Foundation.

Noise - I live at perhaps the noisiest intersection in the city, PCH and MacArthur. My experience with noise is first hand and outside my window.

Recreation - I am a recreational bicyclist and have independently toured, unsupported, throughout the world over the past 45 years. I have a very good understanding of the challenges and issues confronted by bicyclists. We not only have a large number of cyclists in the city, we also are a main North/South route for touring cyclists.

I'm also an avid surfski (kayak) paddler and also wind surf. I have been active in preserving public access to both our bay and ocean. As a paddler and docent I take groups, school children and adults, on kayak or outrigger tours of the Upper Newport Bay.

By submitting the application and completing the supplemental questionnaire, you acknowledge the multi -year commitment to help the community update its General Plan. I specifically focus on the committee's partnerships with other City boards (including the Harbor Commission), and our committee goals related to sand replenishment and sea level rise.

I am also a leader in the local technology community. I previously operated an Al company called Aktiy headquartered in Irvine. I'm passionate about bringing more technology jobs to Newport and the surrounding area.

Housing J Development J Economic Development 1 Urban desigr - I own two businesses directly correlated to housing and development. Understanding if the community needs SFR, Condos, types of commercial or apartments is a crucial part of my business. I have followed both city zoning and state mandates and implemented both to achieve the goals of the state as well as improve the neighborhood. I have been through the process of building homes, condos, apartments, retail, office, ADUs and also very low income housing projects. On all of these projects, I work very closely with the architect to design a structure that fits in the neighborhood but also improves the curb appeal of the area. We always take the local community into consideration when picking elevations, materials and overall design. I am also a stake hotder and a board advisor to a company called Cher, they are dedicated to helping renters make it to home ownership through co -buying. This position has required me to study the housing issues throughout the state.

Currently, I am the board president for the Park Lido Homeowners Association in Newport Beach. I have worked with the offices of planning, public works, parking and economic development both as a resident as well as Director, Community and Career Services at Orange Coast College.

I have a real estate license and am familiar with the housing market.

While dean at Irvine Valley College, I was charged with overseeing the development as well as hiring to architects and contractors to build a 30,000 sq ft building on the former Tustin Marine Corp air base.

As Chair of the Newport Beach Arts Commission, i have had primary responsibility for the production and presentation of all seven phases of the Sculpture Garden Exhibitions, the Concerts on the Green and various other arts programs throughout the city. As a member of, and chair, of EQAC, i have reviewed various plans for projects ranging from the Civic Center to Marina Park.

As a member of the Mayor's Economic Task Force, I understand the fiscal and financial needs of the city.

I have been actively engaged with the City since I first moved to Newport Beach in the late 1974's. Soon after retiring from Orange Coast College as a full-time faculty mernber in 2011 1 met with Nancy Gardner who I Knew through Surfrider Foundation (I've been teaching Surfirwj and Ocean Safety at OCC since the late 1970's and Nancy's been a frequent guest speaker). She suggested that I apply to the Water Quality and Coastal Tidelands Committee. I was grateful to have been appointed and served on it from 2013-2014, In 2014 1 was appointed to the Parks, Beaches and Recreation Commission to fill out an unexpired term of a former commissioner. I am currently in my last year of my second four-year term an PB&R_ Along with my wife, Maggie, I've been a NBPD Volunteer in Policing for the past seven years. This year I was honored to be selected as VlP "Volunteer of the Year." Our entire family has been involved in numerous activities and organizations in the city over the years. My wife volunteers at Share Our Selves. Our daughter, Katie, worked for SOS until recently. And son, Andy, is a Captain in the Newport Beach Lifeguard Department. The yellow lines have noticeably reduced the number of speeding drivers. - Hosted a neighborhood coyote educational seminar in conjunction with the NBPD and the California Department of Fish and Game.

- Environmental stewardship - I have been a member of Surfrider Foundation and participated in many of their beach clean-ups in Newport Beach. One of the requirements for the surf class that I teach is for every student to participate in a local beach, river or lake clean-up.

Noise - We own a home directly underneath the SNA flight path. I've donated money over the years to the Airport Working Group. Our quality of life is dependent on significantly reducing aircraft noise in our community along with excessive noise from cars and leaf blowers, lawn mowers and other sources of noise pollution.
- Recreation - I'm currently serving on the Parks, Beaches and Recreation Commission. I'm passionate about recreation and athletics. I owned and operated a nation-wide camp for youth football players from 1965-2016. 1 have taught and coached surfing at Orange Coast College since the late 1970's. I officiated football, basketball and baseball for over 50 years at all levels - youth, high school, college and professional.

I have lived in the Flower Streets for 1.5 years and have been looking to find an opportunity for involvement. I have enjoyed CDM Chamber events such as the Christmas Walk and would like to bring my professional experience with other local governments back to Newport Beach. The sense of community here is what makes me love the area. I have also attended the State of the City several times and enjoyed updates as well as listening to City Council meetings.

2. Describe your involvement in issues related to your neighborhood or business interests in the City.

Working at OCTA, I heard many concerns about homelessness surrounding the Newport Beach Transit Center and other bus stop locations. Working in Irvine, I have heard of issues with transients coming and going between cities. I have had a wonderful experience in Newport Beach and do not have any current involvement with issues.

3. Describe your knowledge and experience related to land use or zoning matters.

I have a masters degree in Public Administration which includes coursework in land use and zoning 1 RHNA background. 1 was with the Orange County Transportation Authority dealing with commuity relations for 4 years where we managed land use and zoning issues for streets, roads, metrolink stations and transit centers. Currently, I am working for Irvine City Council and make police reccomendations for land use and zoning.

The opportunity to have a small input in this Critical document that is receeiving a major refresh for the first time since 2066 is very exciting, As a 26 year old, young professional, with a love for being out on the water, trying new spots in Newport, and local government, I think I could offer a unique perspective from my age group.

I have many friends around my age and beyond in the area that I would love to discuss current issues with and create sensible solutions to reccomend to the Steering Committee.

I have approximately 6 years of experience in local government and am in tune with my community through an active social calendar. With both a bachelors and masters in this area as well as extensive work with topics such as the Great Park development, Metrolink station locartions, RHNA numbers, and homelessness, I feel I am well versed in the topics needed to develop smart policy reccomendations.

I attend or watch almost all public city meetings. Specific focus is on City Council, Planning Commission, Harbor Commission, Water Quality & Tidelands. I was one of three residents who regularly attended Will O'Neill's office hours until he quit having them. I attend all council member town hall meetings regardless of council district.

I have been a member of our Newport Heights HOA for several years. I have been it's president for the last two years. I am very aware of the need for a Mariner's Mile specific plan that the residents can support.

I have followed the General Plan upstate process closely since 2919. 1 am not a professional in land use or zoning but few Other residents have followed this process as closly as I have. I am a member of Livable California which tracks, supports, and opposes housing related legislation at the state level.

I have been involved with the NB General Plan update since 2019. 1 am one of three residents that have attended every public outreach meeting for the General Plan update, the Housing Element update, and the Circulation Element update, Housing: I have joined statewide citizens groups like Livable California to gain knowledge of how other municipalities are addressing their General Plans. I am a founding member of the formation group to develop the Newport Beach Housing Trust. The trust is envisioned as a vehicle to help finance 100% affordable projects in Newport Beach. It is expected to be formed by late 2022 or early 2023.

Environmental Stewardship or Conservation: As the 2021-2022 SPDN president f and my organization are involved in discussions and advocacy for many of our communities' natural assets. I have been actively supporting the Banning Ranch Conservancy's acquisition of that property for years.

Public Safety or Community Hazards: While I am not an expert in transportation, I have been involved with traffic management and calming in Newport Heights & Cliffhaven while on the board and now president of our HOA, the Newport Heights Association. Our community is unique with mostly rear alleys, and almost no sidewalks or streetlights. There are no guard gates or private communities in our neighborhood. Also Newport Heights is a cut -through neighborhood for traffic to access the services available on 17th Street in Costa Mesa. These areas have been a focus of our HOA for many years.

Historic Resources: I am not in a professional position related to preservation or recognition of historic resources. However as president of SPAN I am in direct contact with some of the folks who have been most active in the area over the last 48 years.

1. Housing -minimal: I participated in one of the council member -led community input meetings for the RHNA requirements.

2. Public Safety -Community Hazards: I'm exposed to some of the needs of the NBP❑ through my work on the Newport Beach Police Foundation, including meetings with the Police Chief. I come from a law enforcement family, with regular discussions about policing. I have a continual interest in safety and risk management, and I care deeply for our NBPD and NBF❑ personnel. My mom was a long time -member of the NBFD CERT program, the volunteer of the year in 2012 and received the Spirit of CERT award in 2010. Nancy Moran Sanchez.

3. Recreation: We are a sports family. I helped run a very large soccer tournament for many years for the Newport -Mesa Soccer Club (now part of the Slammers FC).

I also helped the Club Directors advocate for field access at the City of Newport Beach when our daughters were much younger. I volunteered for the Daily Pilot Cup as team administrator for 5 years at Mariners Christian School. I served in several capacities for Coach Sumner at the CdMHS Track and Field program.

Most recently, I worked with the NMUS❑ and the parent community to secure approval to name the CdM Track in Coach Sumner's name. Our daughters were multi -sport varsity athletes at CdMHS (soccer, track, lacrosse) and our youngest daughter was a D2 NCAA Track & Field student -athlete at Biola University.

P.S. My mom was a professional tennis umpire, working matches at Stanford University and the US Open in NYC. 1. I served on the City of Newport Beach Aviation Committee for about ten {10) years. I recently resigned last year. During my tenure, we worked on such subjects as noise issues for Eastbluff, Balboa Island, and West Cliff. I worked with a team to make recommendation on routing the airlines during takeoff dealing with flight path and height. We encouraged the airlines to use the newest and quietest aircraft at John Wayne Airport.

2. Describe your involvement in issues related to your neighborhood or business interests 1n the City.

2. 1 served on the Eastbluff Community Association Board of Directors many times since 2009. 1 was part of the committee to ensure that all homeowners re approved the revised and updated CC&Rs due to the expiration of the original CC&Rs. I served in many positions on the Eastbluff Homeowners Association Board during my involvement. I have recently resigned from the board to let newer homeowners participate.

3. 1 own homes in both Newport Beach and Thousand Oaks. The property in Thousand Oaks is the last home going up the hill and there have been many issues regarding where and how you can build. I worked with the City and the Homeowner ' s Association and the neighbors on an issue with a developer who wanted to build on a vacant lot. The construction and new home would have interrupted the quiet enjoyment of myself and the adjacent neighbors. I am currently working on an issue with the City of Thousand Oaks, the Homeowners

During that time, I worked with using departments on their requirements for the safe operation of the buses and trains. This included soliciting bids and proposals for maintenance of various requirements on the rail right of way and bus corridors. I did the contract for all the elevators and esclators and Iandscapting for all LA Metro properties. This included rail lines, bus corridors, and buildings.

As I have indicated above, I spent a lot my time on the Newport Beach Aviation committee dealing with the noise issues of takeoffs and landings at John Wayne Airport as it affected the various neighborhoods.

I live on a 17-home cul-de-sac in an area not normally recognized as one of Newport's "villages." We share ownership of an 18th lot developed as a park and pool, governed by a non-profit corporation. 1 attend the corporation's meetings.

My neighborhood is heavily impacted by jet aircraft noise as well, for homes like mine, by traffic noise from Irvine Avenue. It also suffers from a limited visibility blind intersection exit.

I have studied the City's regulations regarding cell site placement since January 2009.

I have attended nearly every Planning Commission and Zoning Administrator hearing since early 2011. In researching the staff reports presented to them. I have developed in-depth familiarity with the City's General Plan, Local Coastal Program, Municipal Code and Council Policies, as well as knowledge of the kinds of matters that come before them.

Transportation - I go everywhere I can in Newport Beach by bicycle. I am familiar with the development of the City's Bicycle Master Plan. I am intimately familiar with most matters related to John Wayne Airporl. I have followed the development of the Circulation Element currently being considered for adoption.

Harbor, boating or water quality - I am not currently a boater, but I have attended almost all meetings of both the City's Harbor Commission and its Water Duality/Coastal Tidelands Committee since 2011.

Environmental stewardship or conservation - I at one time attended meetings of the Banning Ranch Conservancy and since around 2011 nearly all SPAN Board meetings. I face been deeply involved in efforts to remove a private fence from the Upper Newport Bay Nature Preserve, and the recognition of the property on which it stands as state public trust land. I am a supporter of the Coastal Act and have frequently opposed environmentally questionable City proposal presented to the California Coastal Commission.

Development - same as above under "Housing"
Economic development - I am ane of the few non-member citizens to have attended the meetings of the City's Business Improvement Districts when they existed.

Legal matters - I am not an attorney, but in addition to many years study of the City's Charter and codes and city -related California codes, I attempt to read all the opinions ("published" and "unpublished") related to municipal affairs posted by the California court system.

Urban design or architecture - same as above under "Housing" plus I have attended all the City's "revitalization" efforts since 2011.

Public safety or community hazards - My experience with this is limited mostly to what I learn from attendance at City Council meetings.

I am a lifelong resident of Newport Beach and have been involved with numerous charities, and have continued to volunteer my time to help wherever possible.

Some of the work I am most proud of was my time spent as a Corona Del Mar Middle School volleyball coach. This work involved mentoring 12-15 seventh and eighth grade boys and helping teach them about hard work and what it means to be on a team. In my five years of coaching, we went on to win four conference championships and I was able to watch all of these kids qrow through the sport. o Describe your involvement in issues related to your neighborhood or business interests in the City.

I have stayed involved in our city by donating my time to the schools as a middle school volleyball coach. I graduated from the Price School of Public Policy at the University of Southern California. The Price School is consistently ranked among the nation's top three public policy and urban planning schools. The bulk of my course load entailed matters regarding how cities work and what makes a good or bad city. I have had the privilege to learn from some of the brightest minds on these matters and have conducted research for David Sloane and Liz Falletta, who co-chair the urban planning department, and Christian Redfearn, who chairs the department for real estate development. I wrote my thesis on the topic of public planning and addressing the housing shortages in Los Angeles County. I have had work experience in real estate development, where I was involved in the development process of apartments, office buildings, and hotels across the county. I have traveled across the country and studied different cities as well as reviewed their general plans. I believe with my background in public policy, urban planning, and real estate development, I would be an ideal candidate for this committee.

Harbor, Boating - I am a life long boater and surfer in our community. I am a member of a yacht club in the harbor and worked in multiple jobs that were on the water. I am tied to this community because of our harbor and coastline.

Development - I have invested in and brokered multiple redevelopments and value -add opportunities.

Recreation - I grew up in the recreation activities of this City and my son participates in them as well. 1 have experienced how important the quality of our park system is for general recreation and youth sports.

I remember this City before the extension of San Joaquin Hills Rd which connected to Newport Coast and remembering how that changed our City. I want to be a part of this committee to help shape a connection to the past while realizing we have to evolve for the future. My passions revolve around the recreation of harbor and beaches with an appreciation for our trails and protected areas. The ability to raise a family and run a business in this community is enhanced by the nature and our development policies. I have purchased a home in Newport for me and my family so i understand the challenges that we face for new families that want to stay or move to Newport Beach. It is important that we maintain a balanced plan for the benefit of as many citizens as possible.

I don't consider myself an expert on anything that i didn't check under question 4 but I am well aware of the importance and role they play in a community.

Housing:

As I mentioned before, I attended all of the General Plan Update Study Sessions and Workshops offered by the City. I have been a member of the Good Neighbor Newport Committee since it's inception in early 2020. That committee's focus has been on solutions to the housing issues that face Newport Beach. I have followed California legislation on housing issues for 3 years and participate in two statewide organizations that monitor and address housing issues, to the extent possible (CA laws have become more and more restrictive in terms of what Cities can do to control their own zoning), Those organizations are Livable California, and CALE (California Alliance of Local Electeds). Both organizations have meetings most weekends and plan statewide responses to housing issues, meet with members of the state legislature, and have informational discussions with other cities approaches to dealing with the State mandated housing laws.

I was selected to participate in the Southern California Association of Governments (SLAG) Global Policy Leadership Academy's 2022 Orange County Housing Policy Leadership Academy (sorry, it's a mouthful) which is a 10 month program involving a diverse group of community leaders and professionals to learn about and discuss affordability issues, nolicy and solutions including planning and zoning, development, finance, community stability, state housing laws and ordinances, advocacy and coalition building. I was one of 40 participants selected from over 400 applicants. The program concludes in the beginning of ❑ecember 2022.

I am a member of the Formation Committee for the Newport Beach Housing Trust (NBHT), which will complete the formation of the Housing Trust sometime late 2022 or early 2023. The NBHT will be a mechanism to assist in the financing for affordable housing projects focused on 100% affordable housing for local seniors, and workforce (police, fire, teachers, hospitality and medical) who struggle to afford housing in Newport Beach because of the high cost of housing (both rental and for purchase). The NBHT will be able to accept County, State and Federal grants as well as corporate and private donations to supplement the cost of developing these High percentage affordable projects.

Transportation:

Transportation and circulation are intimately connected to housing and development. I have attended every City Study Session and Workshop related to the Circulation Element. Although I do not have any traffic engineering experience, my professional experience in planning and building codes has given me a good working knowledge circulation and parking issues.

Harbor, Boating and Water Quality:

I do not own a boat. I wish I did, but don't. I am however, extremely interested in water quality. I have been attending the Water Quality and Tidelands Committee for the last half year or so and the Harboi Commission meetings on various occasior,s over the last year. issues in Newport Beach. I have attended multiple detailed presentations related to the Confined Aquatic Disposal project, toured the OC Sanitation District, and the City Water Utility Facility. These have been important issues for me since I was a child in Girl Scouts, I have a strong connection with the outdoors and am concerned about climate change and how our City plans to deal with it. As a Board member of Still Protecting Our Newport, I am informed about issues as they arise in Newport and participate in discussions and activities related to our beaches and the bay. ❑evelopment:

In my 41 year professional career as a commercial interior designer, I have been involved in many projects in the early stages of development. I have experience in code requirements and have participated in site planning and circulation issues for building projects as a function of the tenant requirements for various buildings.

Urban Design or Architecture:

My UCLA education was in a program that included classes in Interior Design, Urban Planning and Landscape Architecture. My professional career is in commercial interior planning and design. I prepare complete documentation of construction for interior improvements and site conditions for accessibility.

I hire engineers (electrical, mechanical, plumbing, civil, and structural) to prepare drawings in their specific areas of expertise. I assemble complete packages of drawings and specifications for city review and approval far thausands of square feet of commercial office space (mostly medical) every year.

Currently, my firm is in various stages of planning and construction for over 70,000 square feet of commercial medical office space. I am intimately familiar with how City Community Development, Planning and Building ❑epartments function at dozens of cities throughout southern California.

Public Safety or Community Hazards
have involved myself in Community issues relating to safety and community hazards in Newport Heights, specifically traffic and bicycle safety. I am familiar with fire safety from a building code perspective. I attended many planning Commission meetings where safety issues were addressed as a consideration for approval although as an observer, not as a decision maker.

SUPPLEMENTAL QUESTIONS

1. Housing: I was a member of the Newport Beach Housing Element Update Advisory Committee, which assisted the City and its consultant with review of the various versions of the Housing Element. The goal of this endeavor was to provide a Housing Element that could be certified by the state's Housing and Community Development as compliant with the applicable 6th cycle Regional Housing Needs Allocation (RHNA) requirements. With this experience, I'm very familiar with the state requirements for Housing Elements and how the City complied with the RHNA allocation, as well as its effect on the City.

2.. Transportation: I have conducted traffic analyses of various projects to determine the potential impacts on traffic delay (level of service) that may be generated by various project approvals, including estimates of the peak morning and evening traffic generated by a project or land use decision. More recently, I have experience with the calculation of the potential vehicle miles traveled (VMT) by projects or that would be associated with land use decisions, the potential significance of the VMT increases, and whether the VMT estimates would comply with state and/or local greenhouse gas (GHG) reduction goals.

3. Water Quality: Have prepared a number of studies on water quality for the expansion of a wastewater treatment plant, modification of a treatment plant from secondary to tertiary treatment, and to determine compliance with National Pollutant Discharge Elimination System (NPDES) requirements. Have evaluated wastewater discharge or proposed modifications to wastewater discharge for compliance with water quality requirements including gasification plants, incineration projects, refinery modifications, plating facilities, electronics manufacturers, vehicle import facilities, and carpet manufacturers. Have also assisted with water quality issues with respect to site remediation and cleanup for a variety of facilities, including local cities, marine terminals, refineries, port facilities, vehicle manufacturers, commercial retail facilities, and gasoline stations. Have worked with various regulatory agencies regarding water quality including the U.S. EPA, the California Environmental Protection Agency (which includes the Regional Water Quality Control Boards and the Department of Toxic Substances Control), and the health departments of local cities and counties.

4. Environmental Stewardship/Conservation: By assisting project proponents with environmental compliance, CEQA compliance and implementing mitigation measures, I have worked to promote responsible development while protecting and improving the environment. As a California Air Resources Board (CARE) lead verifier, I assist facilities with compliance with California's greenhouse gas (GHG) requirements which seek the long-term improvement of the environment and minimizing the impact of climate change.

5. Development: Have assisted school districts, project applicants and developers (commercial, industrial/residential) to comply with various environmental permitting requirements and receive applicable entitlements (CEQA, conditional use permits, environmental clearance, air permits, waste discharge permits, etc.).

Legal Matters: I have provided technical assistance in the defense of CEOA documents including Negative Declarations, Mitigated Negative ❑eclarations, and Environmental Impact Reports (EIRs), including an EIR that was heard before the California Supreme Court. I have helped develop the administrative record for CEQA lawsuits and have served as an expert witness for CEQA litigation, as well as air quality and health risk assessment issues.

7. Public Safety/Community Hazards: Have experience in hazard consequence analyses for industrial facilities which include refineries, chemical plants, pipelines, transport of hazardous materials, a secondary lead smelter, liquid natural gas facilities, gas processing plants, and so forth. Hazard analyses generally include an estimate of the material(s) released, the size of the spill/release, the emissions generated from the spill release, and air quality modeling to determine the potential concentrations of a release on- and off -site. Also have experience in the completion of site assessments and remediation of hazardous materiaIs/waste s at schools and industrial facilities.

8. Historic and Cultural Resources: Assisted in determining the potential for projects to impact historic buildings, cultural resources and tribal cultural resources. Familiar with applicable regulations that protect these resources.

Last year, I attended a City Council meeting with my children along with a community service group I started called SHARE, where we were honored for our service.

Describe your involvement in issues related to your neighborhood or business interests in the City. ! became involved with neighborhood street safety in 2020. 1 walked my neighborhood asking neighbors to sign a petition that the city had created in order to ensure that speeding was reduced within Dover Shores. The measure was ultimately approved by City Council, I appreciated participating in our focal government and helping to effectuate change.

As a resident of Newport Beach, my primary involvement with the City includes partnering with the Parks department to assist and provide feedback on the design of our local park, Eastbluff Park in 2018. As our park began to show its age, I proactively reached out to the parks department to offer assistance in gaining feedback from the community and directly interfacing with City Staff. Our children have also attended Eastbluff Elementary school.

In addition, living in Eastbluff, I have participated in the Plaza HOA (local HOA), am a Shore Mooring slip owner on Balboa Island, am a Member for Bahia Corinthian Yacht Club in Corona del Mar, Newport Mesa YMCA and have taken an active interest in our local neighborhood including parks, safety, and land use.

My family and I also serve on a weekly basis with Trellis, a homeless advocate who directly partners with City of Newport Beach to assist the homeless population.

As a Vice President of Investment Management at Goodman, I have experience in Real Estate Development, Economic Develpoment, Legal Matters, Urban Design and Recreation. My desire to serve on the GPAC stems from my desire to be larger part of my community, to make a lasting impact on the city my family is being raised in, and to provide a younger perspective with long-term outcomes in mind for a better Newport.

My professional career provides me with exposure to various parts of the development process, with particular focus on the finance and entitlement process of commercial real estate development. I see first-hand how the impacts of a General Plan Update can greatly change the character of a city, the likelihood a blighted area will be redeveloped, how land values can rise and fall, and how revitalization and economic development can be created. The drafting of a General Plan is vital to a cities success and likelihood of future long-term investment in a city. A good General Plan makes a city an amazing place to live. I believe I was well prepared for each of our meetings and added value to the group, I have read and am familiar with the General Plan, the City Charter, and related GP documentation. I served under Chair Marian Bergeson on the 2610 NB Charter Update Commission and chaired the 2012 INB Charter Update Committee. I chaired the NB Chamber in 201 g-2011 and am the current three -time Chair of the Board of Library Trustees, ?. My wife (Ronnie) and I live in West Newport. I served as President or Co -President of the West Newport Beach Association for twelve years. I continue today as a member. I have practiced real estate law (including as the attorney for a number of land use clients) for fifty years and presently practice out of our home with a second office near Harbor High School.
