COMPREHENSIVE WATER, RECYCLED WATER, AND
SANITARY SEWER RATE STUDY
City of Santa Ana, California
The City of Santa Ana, located in Orange County CA provides water, recycled water, and sewer services to a population of approximately 334,000. The City wished to review the cost basis for existing rates and establish a long-term financial plan that would allow them to proactively repair and replace capital infrastructure. Similar to other utilities in California, the water demand in Santa Ana has declined for a myriad of reasons. Our team worked with the City to develop updated water, recycled water, and wastewater rates for the City to recover projected operating cost increases; continue to repair and replace aging infrastructure; enhance financial stability of the utility; avoid the depletion of reserves; and comply with state and federal regulatory and legal requirements.
Stantec has worked with the City to establish a long-term/ten-year financial plan for each enterprise fund. As part of this effort, the project team assisted the City to evaluate multiple capital improvement scenarios and funding strategies. Our team has also worked with the City to review and update cost-of-service analysis to support equitable rates and fees. The recommended rate structure was designed for compliance with Proposition 218, enhancement of revenue stability, and both maintenance and enhancement of affordability for customers.
To augment the City’s messaging of the proposed rates, our team developed Proposition 218 mailers in multiple languages, developed a proposed rate increase website, and developed a rate survey for the water and wastewater enterprises. These deliverables allowed for the rate payers to understand the proposed rates, what services they are paying for, why they are needed, and how the resulting rates compare to other communities in the area.

WATER SYSTEM CAPACITY CHARGE STUDY
East Bay Municipal Utility District, Oakland, California The East Bay Municipal Utility District (EBMUD) is a public utility district which provides high quality water to approximately 1.4 million customers in the east bay communities of the San Francisco bay area. Among the chief challenges facing EBMUD are the needs to serve a rapidly growing community that is redeveloping old neighborhoods with new housing stock (especially multifamily housing redevelopment), and the need for additional investment to enhance EBMUD’s resilience to drought.
EBMUD utilizes Water System Capacity Charges (SCC) to recover appropriate shares of the costs of water distribution and water supply investments from new customers. The SCC program works in the same way as comparable programs in that it provides a mechanism to minimize the impacts of growth on the existing customer base. But EBMUD’s SCC program differs from many other fee programs in that it recognizes differences in typical demand profiles and capacity costs across geographic sub-areas. EBMUD has been collecting SCCs since 1983. SCC fee schedules have been increased annually based on a construction cost escalation factor for over a decade. EBMUD engaged Stantec in 2019 to conduct a comprehensive review of the existing SCC fee methodology, followed by an analysis to re-establish the cost basis of the fees to ensure they adequately fund the cost to provide water infrastructure to serve future development.
The ongoing SCC Study includes a comprehensive review of the methodology employed to calculate SCCs, as well as all procedures used to assess SCCs to individual applicants, with a particular focus on the justification and feasibility of adjusting the fee schedule to reflect lower the demand profiles of smaller multi-family residential units or other low water use situations. The water industry appropriately relies on “equivalent unit” approaches to manage multiple types of capacity related charges; EBMUD’s interest in the potential to reflect the reduced demand characteristics of small residential units created an opportunity for Stantec to support the District in a fresh and comprehensive analysis on this issue of increasing importance to many utilities.
The ongoing study also includes analysis of enhanced water demand records and updated projections to better understand peak and seasonal water demand patterns, and to reflect that knowledge in EBMUD’s SCC schedule. Seasonal demands and drought year water supply considerations are tremendously important in determining costs of water supply and infrastructure establishment, yet most capacity charge programs lean heavily on comparatively generic average daily demands. Recognition of individual peaks or seasonal or drought condition demand factors could have the potential to contribute to the development of a “next level” of beneficial differentiation and specificity in the allocation of costs to different types of new customers, as well as a meaningful enhancement in the equitable recovery of these costs through refined SCC approaches.

15 INDEPENDENT WATER AND WASTEWATER RATE REVIEW
City of San Diego, California
Ongoing upward pressures on rates, combined with changes in the City’s utility cost structures and complex state requirements, led the City of San Diego to create an independent review function to aid the City in meeting its goal of providing safe and reliable services at the lowest possible costs while improving transparency of the City’s rate development and review processes. Stantec was engaged to provide this independent review function.
The cost-of-service studies conducted by the Public Utilities Department (PUD) and the existing rate consultant were seen by some stakeholders as needing a fresh look from an outside perspective to minimize risk of carrying forward outdated policies, assumptions, and methodologies. The San Diego City Council charged the City’s Independent Budget Analyst (IBA) with the responsibility of managing an explicitly independent review process to address future cost-of-service studies and rate proposals developed by the City’s PUD. The IBA fulfills this role in conjunction with the City’s Independent Rates Oversight Committee (IROC) as the key stakeholder, which serves as an official advisory body to the Mayor and City Council on policy issues relating to City PUD’s operations, financial management, and rate setting practices.
The complexity and difficulty of creating a meaningful independent review process led the IBA to engage Stantec to provide clear, objective, and unbiased analysis and advice regarding proposed rate changes. As is the case for many agencies around the country, the financial requirements for operation, maintenance, and rehabilitation of major systems of urban infrastructure create significant challenges to that specific goal of providing low-cost reliable service. Added to those challenges, the City’s Pure Water Program, a potable water recycling program that will provide one-third of San Diego’s water supply by 2035, as well as a shift in the wholesale water provider’s rate structure toward higher fixed charges will yield changes in the City’s cost structure, increased operational and planning complexity, and burdens that can seem enormously difficult from many perspectives as increases in rates and charges will be necessary.

financial feasibility study for the Authority as required by the 2017 legislature. As part of the study, our
team quantified the amount of excess capacity
available on a locational basis to evaluate the
potential of firm and interruptible service offerings
that would effectively change the Authority’s primary
role to more of a pure wholesaler of water to local
private water companies. The study incorporated
potential revenue from a new concession-based
business model, with the intent of stabilizing cash
flows and achieving financial sustainability to
support continued domestic rural water supply in the
region.
Pinellas County | Florida
Andy has served as the Project Manager for the
County for nearly ten years, including a
comprehensive Water, Wastewater and Solid Waste
Rate Study and several annual updates. During
these studies, Andy has used our FAMS-XL model
to develop ten-year financial plans for the water,
sewer, and solid waste enterprise funds. He has
also conducted a benchmarking analysis, assisted
County staff in evaluating the underlying cost of
operations, and conducted detailed cost allocation
and overhead studies for the Utilities Department.
Brunswick-Glynn County Joint Water & Sewer
Commission | Georgia
Andy has 1) developed annual ten-year financial
management plans for the water and sewer systems
within the JWSC’s two districts, 2) prepared loan and
bond feasibility reports, 3) calculated updated water
and sewer capital tap fees (impact fees) for each
district, 4) calculated public and private fire
protection charges, 5) developed a uniform
conservation rate structure for its two service
districts, and 6) prepared a detailed rate manual that
explains the purpose, intent, and structure of all its
rates and charges.
Town of Gilbert | Arizona
Andy served as the Project Manager for a
comprehensive Water, Sewer, Reclaimed Water,
Environmental Services (Sanitation), and
Stormwater Rate Study (Study) for the Town. As part
of the study, for each utility system, we performed a
revenue sufficiency analysis, detailed cost-of-service
allocation, and rate structure analysis. We
developed several modifications to the Town’s
existing rate structures, notably including a new
inclining block water rate structure. He also
completed a cost allocation study for the wastewater
system and a stormwater rate program feasibility
study.
City of Olathe | Kansas
Andy served as the Project Director for a
Comprehensive Utility Rate Study for the City. For
each service – including Solid Waste, Water, Sewer,
and Stormwater – we developed customized
financial models including ten-year financial plans
and identification of alternative plans of rate
adjustments, reviews of alternative capital spending
and operational scenarios, and other sensitivity
analyses. Andy provided guidance to support the
detailed cost allocation analyses for each fund and
developed alternative rate structures to ensure fair
and equitable rates for each service.
City of Greenfield | California
Andy served as Project Manager during the conduct
of a long-overdue comprehensive water and
wastewater rate study for Greenfield. Rates were
designed to fund the utility’s projected costs of
providing service while proportionally allocating
costs among customers, providing a reasonable and
prudent balance of revenue stability, and complying
with the substantive requirements of California
Constitution Article XIII D, Section 6 (Prop 218).
City of Denton | Texas
Andy led a comprehensive cost-of-service and rate
design study for the City’s water and sewer utilities.
The study included the development of a ten-year
financial management plan, including identification
of annual rate increases, amount, and timing of
required borrowing to fund the capital improvement
program, establishment of proper reserve levels,
and maintenance of adequate debt service coverage
levels. An important component in the study was a
rate stabilization reserve to address the issue of
revenue volatility due to weather conditions and
demand reductions.

| City of San Diego, California
Benjamin is serving as the Project Manager in an
engagement with the City of San Diego to assist the
Independent Budget Analyst’s office and provide an
independent review function to aid the City in
meeting its goal of providing safe and reliable
services at the lowest possible costs while improving
transparency of the City’s rate development and
review processes. Stantec is providing technical
assistance to the IBA and the IROC to help the City
make the right decisions, including independent
review of cost of service and rate proposals for
accuracy and compliance with industry practices and
substantive requirements of Proposition 218,
perspective from rate and user charge strategies
used in other communities, analysis in response to
IBA, IROC, or Council questions or comments, input
and innovative solutions as might be beneficial from
other rate proceeding processes, and assistance in
communicating the implications of any proposed
changes in rates. By independently assessing the
accuracy, clarity, and fiscal responsibility and
appropriateness of rate proposals, Benjamin is
helping the IBA and IROC to build the context
needed by City Council as it contemplates further
rate increases.
City of Sacramento | California
Benjamin is responsible for project management of a
Department of Utilities Storm Drainage Fund
Review, managed by Sacramento’s City Auditor’s
office. The project is intended to provide an
independent review of the Storm Drainage Fund’s
financials in addition to an assessment of their
operations, asset valuation, and capital plan.
Through benchmarking and a detailed review of the
fund’s historical and near-term projected financial
performance, the project will produce a financial gap
analysis to better understand the drivers of historical shortfalls. Using this information, we will develop a
fiscal forecast, incorporating a range of potential
funding options, to provide the City with a detailed
understanding of the options available to meet their
funding needs into the future.

30 Stormwater Funding Analysis | San Diego,
California
Benjamin was responsible for project management,
research, and analysis as Stantec’s team, with Tetra
Tech stormwater engineers, developed a
Stormwater Infrastructure Needs Assessment and
Funding Strategy for the City of San Diego. This
work consisted of developing a historical funding
gap analysis, funding options evaluation, and
stormwater funding roadmap to help the City meet
its stormwater infrastructure investment needs.
Funding options were primarily composed of
enhancing internal revenue sources (fees, transfers,
parking citations), developing new internal revenue
sources (new fees, assessments, special taxes),
grants and loans. Benjamin is currently responsible
for project management and model development in
a subsequent engagement, again partnered with
Tetra Benjamin is currently responsible for project
management and model development in a

Tech, to forecast potential funding options (e.g.
grants, loans, alternative revenues, transfers, etc.),
in addition to creating a long-term planning and
tracking tool that the City can incorporate into its
financial and operations planning process. The
model will integrate with the City’s asset
management and financial/account data systems for
streamlined updating, tracking of plan vs. actuals,
and a central point of contact for operations, capital, and financial reporting.
City of Fullerton | California
Benjamin developed a comprehensive financial plan,
cost-of-service (COS), and rate design study. In
addition to the expiration of the City’s existing rate
ordinance, this project was focused on addressing
the City’s extensive needs for reinvestment in their
buried infrastructure. Development of the 10-year
financial forecast focused on providing the ability to
evaluate capital planning scenarios, flexing key
variables including annual buried pipe replacement,
operating and capital reserve development, and a
combination of capital financing alternatives. The
COS and rate design process enabled the City to
eliminate unnecessary or redundant customer
classes while ensuring an equitable allocation of
costs among customers with differing consumption
characteristics
City of Merced | California
Benjamin oversaw research and analysis of viable in
the establishment of a Special Assessment District
for the City. Specific work consisted of determining
methods of allocating special benefits to parcels
within the district in a defensible manner. As the City planned for continued development, a special
assessment district was desired to fund capital
projects required to provide sewer service to the
new parcels. Our guidance helped define the
parameters of the District. Benefit apportionment
methods compliant with CA Proposition 218 were
identified and proposed to assist in the formation of
the new district.
City of Whittier | California
Benjamin was responsible for overseeing modeling
and spearheading sewer portion of the rate study as
the team worked with the City to develop a politically
viable schedule of rate adjustments, in addition to
structural changes to the way the City charges
customers, ensuring the City can meet ongoing
capital investment needs and introducing a fixed
charge component to the City's sewer rate revenue
stream. Additional analyses were required to
develop a defensible justification for the City's
maximum bill level for residential customers, in
addition to determining the appropriate level of credit to be applied to customers living in private
developments with privately maintained sewer
infrastructure.
City of Omaha | Nebraska
Benjamin served as the lead consultant responsible
for developing, updating, and customizing financial
planning models. Financial plans were developed to
evaluate multiple capital, operating, and financing
scenarios within the City’s CSO program to assess
the impact of debt financing and necessary rate
increases. The financial planning model was
licensed to the City following a training workshop
conducted with City Public Works and Finance
Department staff. Benjamin also led in the
development of a financial capability assessment
(FCA) including a complete WARi™ affordability
analysis to analyze affordability impacts to rate
payers at the census tract level accounting for lowincome assistance programs.

SCOPE OF WORK
The Project entails a qualified professional consulting firm to assist the City in analyzing its current rate structure for water and sewer services and then evaluating other potential rate structures that might provide increased revenue stability utilizing equitable and easily explainable and defendable rates. Staff is open to evaluating creative rate options that could more equitably address the different regions of the City and the unique needs of those communities. • A rate structure based on cost of service sufficient to meet the short and longterm revenue requirements of the water, sewer and reclaimed water system; • Separately identify those portions of system revenues that fund water, sewer and reclaimed water system operating costs;
• A rate structure that considers and makes provisions for the following factors:
o Current and future cost of providing water, sewer and reclaimed water services in accordance with established and anticipated standards and regulations.
o Projected demands.
o Availability of supply or capacity.
o Age and condition of the system and the need to fund long-term capital improvements/replacements.
o Analysis of a Capital Improvement Program (CIP), identify scope and appropriate annual expenditures to develop levels of rate increases for implementing such projects based on at least three levels of expenditures. • Recommendation of rates based on the current rate structures and at least two alternative rate structures
• A recommended rate structure that is in compliance with the rate covenants of the outstanding Revenue Bonds and Proposition 218;
• Weigh the benefits of any proposed system improvements/replacements against the financial impacts on ratepayers;
• Provide a comparison of current rates to surrounding water purveyors; • Consideration of funding past and future depreciation (replacement of facilities); • The type and amount of reserves appropriate to the City’s operations taking into consideration reserves for cash flow, catastrophes, infrastructure replacement and other appropriate purposes;
• Take into consideration the Norco billing system capabilities;
CA-17
• An easy-to-use electronic model in Microsoft Excel or Access, to be used by Norco for future rate setting;
• A comparison of customer groups and cost of service with neighboring agencies of comparable size, type of treatment, and level of service;
2. Assist with the training of internal staff to update, maintain, and analyze the rate models.
3. Assist Norco with the approval process for such rates including preparing testimony for rate hearings and providing expert witness services during the rate hearings.
The selected consultant will meet with City staff to determine the best approach to evaluate the current rate structures and development of new reclaimed water rate structure. The consultant may also meet with City Council and other stakeholders as part of this project.

Project Understanding and Approach
KWC understands the City desires to install approximately 1,950 linear feet of 10” and 12” VCP sewer pipe within City of Norco right-of-way and existing sewer easement. Sewer design shall include mainline pipe, laterals, and manholes.
The new sewer pipe shall be constructed first horizontally avoiding the existing storm drain, sewer and water pipelines if possible or replace the existing sewer in the same alignment. Next, sewer shall be designed vertically to provide:
connection to existing sewer mains and laterals, using sufficient pipe size, minimum cover, at least minimum slope to upstream end.
Sewer Improvement Plans shall be prepared by KWC including: plan and profile for sewer main, manholes, and laterals as needed to verify design using City of Norco standard drawings.
This project also includes sewer flow monitoring in the field to establish the existing flows in the pipe to evaluate the size of sewer needed to replace the existing sewer based on typical sewer main sizing criteria.
Proposal excludes sewer bypass pumping plan, to be prepared by the contractor or KWC Engineers per separate authorization.

Typical Scope of Work Program
We have listed the work activities that are needed in order to complete the design effort for the proposed sewer line. Our activities are based upon the specific tasks identified by the City in its RFP as well as our experience working on other similar pipeline projects and working with the City. The required work tasks are as follows:
TASK 1: PROJECT ADMINISTRATION
KWC has included budget to attend meetings including: Kickoff Meeting, 30% Plan Check, 90% Plan Check, 100% Plan Check and Pre-construction meetings as well as to participate in project coordination: status reports, and schedule updates. KWC has included budget for the submittals and picking up comments as well as processing, although digital submittals may be required instead.
KWC Team Members: Victor Elia, P.E. (Vice-President), Tom Caseldine, P.E. (VP-Project Manager) Task 1 Deliverables: Meeting notes, Status Reports, Updated Project Schedules TASK 2: RESEARCH AND SURVEY
This task includes: research, field topographic surveying and site visit, potholing and preparation of summary of research finding – Technical Memorandum. KWC will perform our own research of record survey maps to determine the right-ofway within the project limits. KWC will research the existing plans and wet utility plans with the City and RCFC&WCD, right-of-way maps (parcel maps, tract maps, records of survey, etc.) on the County database (KWC has in-house) and compile dry utility maps received from the letters to be sent out by the City. Dry utility research is performed by mailing letters to the utility companies on City of Norco letterhead to limit fees from the utility companies. It is understood, the City will typically forward the dry utility maps to us to compile. KWC will review the record drawings and field investigate the site to verify the location of existing utilities. KWC will provide all research to the City in the Technical Memorandum.
KWC will utilize the City benchmark system to establish survey control and the street centerline for the project base files.
Our survey crews will set five (5) aerial targets for the aerial topographic company to utilize in the preparation of the aerial topographic file in the City benchmark control system (Parkridge Site Only). Inland Aerial will fly the site to prepare a, 1”=40’ scale with 1’ contours, topographic survey map with above ground features including one foot contours, curbs, above ground utilities, manholes, street lights, and traffic stripes and will provide a 100’ strip in order to ensure that we have sufficient design topography. KWC will survey monuments to prepare the surveyed base map including: street centerlines, right-of-way lines, property lines and bench marks, which shall be shown on the plans. KWC will perform a field visit to verify existing features, utilities, and proposed locations of services. KWC will field survey the North Drive site and utilize aerial imagery for design purposes.
Next, KWC will draft the existing utilities into a base file per the researched documents offset from the calculated centerline, verified with the GIS Atlas maps, and conducted field walk to make sure existing utilities are all accounted and identified. To determine the alignment alternatives, KWC will prepare a preliminary alignment study utilizing the prepared base files to review with the City staff at the Design Workshop Meeting/30% Submittal. Once a preliminary alignment has been selected, KWC will prepare a pothole plan with a table including: pothole number, type of utility, size to be verified and approximate depth for the City to review.

Boudreau will perform the potholing after they obtain the encroachment permits with approved WATCH Traffic Control, verify the locations with Mr. Elia, and setup necessary traffic control. Boudreau will provide a summary report detailing the findings of the potholing. KWC has assumed 10 potholes per the RFP, however, you will be invoiced per pothole.
Potholing the utilities can be the longest lead item for the project if not managed properly. KWC, Victor Elia will manage Boudreau’s schedule of Traffic Control and Permit Application preparation. Mr. Elia will kick off Boudreau to be prepared to pull a pothole permit, and to have crews ready as soon as feasible. Prior to potholing the existing utilities to determine the type, size and location of existing utility crossings, Mr. Elia will walk the locations with Boudreau’s superintendent to make sure the correct potholes are dug and extra potholes are avoided. KWC will also dip the sewer and storm drain manholes with traffic control measures. Once potholed KWC’s two-man survey crew will field survey the nails set by Boudreau above the found utility which will give us survey accuracy on the location of existing utilities at the crossings.
US3 staff will install all sewer flow monitoring equipment in accordance to manufacture recommendations at manhole location confirmed with City. Sensor shall be calibrated by the US3 before installation. The project binder shall be created to include the appropriate installation, weekly maintenance, and equipment removal field reports for the site, including sensor identification of the site as well as identification of any additional materials to be used at the site.
1. Installation will take 1 day using WATCH Manual Traffic Control.
2. Data from the location will be available within the hour of installation.
3. Data will be collected for a one month period
4. All data is backed up.

Consultant shall avoid any violation of any such law during the Term of this Agreement by participating in an electronic verification of work authorization program operated by the United States Department of Homeland Security, by participating
CA-4
in an equivalent federal work authorization program operated by the United States Department of Homeland Security to verify information of newly hired employees, or by some other legally acceptable method. Consultant shall maintain records of each such verification, and shall make them available to the City or its representatives for inspection and copy at any time during normal business hours. The City shall not be responsible for any costs or expenses related to Consultant’s compliance with the requirements provided for in Section 3.2.8 or any of its sub-sections.
3.2.8.2 Employment Eligibility; Subcontractors, Consultants, Sub-subcontractors and Subconsultants. To the same extent and under the same conditions as Consultant, Consultant shall require all of its subcontractors, consultants, sub-subcontractors and subconsultants performing any work or Services relating to the Projects or this Agreement to make the same verifications and comply with all requirements and restrictions provided for in Section 3.2.8.1.
3.2.8.3 Employment Eligibility; Failure to Comply. Each person executing this Agreement on behalf of Consultant verifies that they are a duly authorized officer of Consultant, and understands that any of the following shall be grounds for the City to terminate the Agreement for cause: (1) failure of Consultant or its subcontractors, consultants, sub-subcontractors or subconsultants to meet any of the requirements provided for in Sections 3.2.8.1 or 3.2.8.2; (2) any misrepresentation or material omission concerning compliance with such requirements (including in those verifications provided to the Consultant under Section 3.2.8.2); or (3) failure to immediately remove from the Projects any person found not to be in compliance with such requirements.
3.2.8.4 Labor Certification. By its signature hereunder, Consultant certifies that it is aware of the provisions of Section 3700 of the California Labor Code which require every employer to be insured against liability for Workers’ Compensation or to undertake self-insurance in accordance with the provisions of that Code, and agrees to comply with such provisions before commencing the performance of the Services.
3.2.8.5 Equal Opportunity Employment. Consultant represents that it is an equal opportunity employer and it shall not discriminate against any subconsultant, employee or applicant for employment because of race, religion, color, national origin, handicap, ancestry, sex or age. Such non-discrimination shall include, but not be limited to, all activities related to initial employment, upgrading, demotion, transfer, recruitment or recruitment advertising, layoff or termination. Consultant shall also comply with all relevant provisions of City’s Minority Business Enterprise program, Affirmative Action Plan or other related programs or guidelines currently in effect or hereinafter enacted.
3.2.8.6 Air Quality. To the extent applicable, Consultant must fully comply with all applicable laws, rules and regulations in furnishing or using equipment and/or providing services, including, but not limited to, emissions limits and permitting requirements imposed by the South Coast Air Quality Management District (SCAQMD) and/or California Air Resources Board (CARB). Although the SCAQMD and CARB limits and requirements are broader, Consultant shall specifically be aware of their application
CA-5
to "portable equipment", which definition is considered by SCAQMD and CARB to include any item of equipment with a fuel-powered engine. Consultant shall indemnify City against any fines or penalties imposed by SCAQMD, CARB, or any other governmental or regulatory agency for violations of applicable laws, rules and/or regulations by Consultant, its subconsultants, or others for whom Consultant is responsible under its indemnity obligations provided for in this Agreement.
3.2.9 Insurance.
3.2.9.1 Time for Compliance. Consultant shall not commence work under this Agreement until it has provided evidence satisfactory to the City that it has secured all insurance required under this section. In addition, Consultant shall not allow any subconsultant to commence work on any subcontract until it has provided evidence satisfactory to the City that the subconsultant has secured all insurance required under this section.
3.2.9.2 Minimum Requirements. Throughout the life of this Contract, Consultant shall pay for and maintain in full force and effect all policies of insurance required hereunder with an insurance company(ies) either (i) admitted by the California Insurance Commissioner to do business in the State of California and rated not less than "A- VII" in Best's Insurance Rating Guide, or (ii) as may be authorized in writing by City Manager or his/her designee at any time and in his/her sole discretion. The following policies of insurance are required:
(i) COMMERCIAL GENERAL LIABILITY insurance which shall be at least as broad as the most current version of Insurance Services Office (ISO) Commercial General Liability Coverage Form CG 00 01 and include insurance for “bodily injury,” “property damage” and “personal and advertising injury” with coverage for premises and operations (including the use of owned and non-owned equipment), products and completed operations, and contractual liability (including, without limitation, indemnity obligations under the Contract) with limits of liability of not less than the following:
$1,000,000 per occurrence for bodily injury and property damage $1,000,000 per occurrence for personal and advertising injury $2,000,000 aggregate for products and completed operations $2,000,000 general aggregate applying separately to the work performed under the Contract
(ii) COMMERCIAL AUTOMOBILE LIABILITY insurance which shall be at least as broad as the most current version of Insurance Service Office (ISO) Business Auto Coverage Form CA 00 01, and include coverage for all owned, hired, and non-owned automobiles or other licensed vehicles (Code 1 Any Auto) with limits of liability of not less than $1,000,000 per accident for bodily injury and property damage. (iii) WORKERS' COMPENSATION insurance as required under the California Labor Code.
CA-6
(iv) EMPLOYERS’ LIABILITY insurance with limits of liability of not less than $1,000,000 each accident, $1,000,000 disease policy limit and $1,000,000 disease each employee.
(v) PROFESSIONAL LIABILITY Professional Liability (Errors and Omissions) insurance appropriate to Consultant’s profession, with limits of liability of $2,000,000 per claim/occurrence and $2,000,000 policy aggregate.
In the event Consultant purchases an Umbrella or Excess insurance policy(ies) to meet the minimum limits of insurance set forth above, this insurance policy(ies) shall “follow form” and afford no less coverage than the primary insurance policy(ies).
Consultant shall be responsible for payment of any deductibles contained in any insurance policies required hereunder and Consultant shall also be responsible for payment of any self-insured retentions. Any deductibles or self-insured retentions must be declared to, and approved by, the City Manager or his/her designee. At the option of the City Manager or his/her designee, either: (i) the insurer shall reduce or eliminate such deductibles or self-insured retentions as respects to VVTA, its board members, officers, officials, employees and agents; or (ii) Consultant shall provide a financial guarantee, satisfactory to VVTA’s Executive Director or his/her designee, guaranteeing payment of losses and related investigations, claim administration and defense expenses. At no time shall the City be responsible for the payment of any deductibles or self-insured retentions.
All policies of insurance required hereunder shall be endorsed to provide that the coverage shall not be cancelled, non-renewed, reduced in coverage or in limits except after 30 calendar day written notice has been given to City. Upon issuance by the insurer, broker, or agent of a notice of cancellation, non-renewal, or reduction in coverage or in limits, Consultant shall furnish City with a new certificate and applicable endorsements for such policy(ies). In the event any policy is due to expire during the work to be performed for City, Consultant shall provide a new certificate, and applicable endorsements, evidencing renewal of such policy not less than 15 calendar days prior to the expiration date of the expiring policy.
The General Liability and Automobile Liability insurance policies shall be written on an occurrence form. The General Liability (including ongoing and completed operations) and Automobile Liability shall name City and its officers, officials, employees, agents and volunteers as an additional insured. Such policy/ies of insurance shall be endorsed so Consultant’s insurance shall be primary and no contribution shall be required of City. The coverage shall contain no special limitations on the scope of protection afforded to the City and its officers, officials, employees, agents and volunteers. The Workers’ Compensation insurance policy shall contain a waiver of subrogation as to City and its officers, officials, employees, agents and volunteers. Should Consultant maintain insurance with broader coverage and/or limits of liability greater than those shown above, City requires and shall be entitled to the broader coverage and/or the higher limits of liability maintained by Consultant. Any available insurance proceeds in excess of the specified minimum limits of insurance and coverage shall be available to City.
CA-7
If the Professional Liability (Errors and Omissions) insurance policy is written on a claimsmade form:
1. The retroactive date must be shown, and must be before the effective date of the Agreement or the commencement of work by Consultant.
2. Insurance must be maintained and evidence of insurance must be provided for at least 3 years after any expiration or termination of the Agreement or, in the alternative, the policy shall be endorsed to provide not less than a 3-year discovery period.
3. If coverage is canceled or non-renewed, and not replaced with another claimsmade policy form with a retroactive date prior to the effective date of the Agreement or the commencement of work by Consultant, Consultant must purchase extended reporting coverage for a minimum of 3 years following the expiration or termination of the Agreement.
4. A copy of the claims reporting requirements must be submitted to VVTA for review.
5. These requirements shall survive expiration or termination of the Agreement.
Consultant shall furnish City with all certificate(s) and applicable endorsements effecting coverage required hereunder. All certificates and applicable endorsements are to be received and approved by the City Manager or his/her designee prior to City’s execution of the Agreement and before work commences.
If at any time during the life of this Agreement or any extension, Consultant or any of its subconsultants fail to maintain any required insurance in full force and effect, all work under this Agreement shall be discontinued immediately, and all payments due or that become due to Consultant shall be withheld until notice is received by City that the required insurance has been restored to full force and effect and that the premiums therefore have been paid for a period satisfactory to City. Any failure to maintain the required insurance shall be sufficient cause for City to terminate this Agreement. No action taken by City hereunder shall in any way relieve Consultant of its responsibilities under this Agreement.
Upon request of City, Consultant shall immediately furnish City with a complete copy of any insurance policy required under this Agreement, including all endorsements, with said copy certified by the underwriter to be a true and correct copy of the original policy. This requirement shall survive expiration or termination of this Agreement.
The fact that insurance is obtained by Consultant shall not be deemed to release or diminish the liability of Consultant, including, without limitation, liability under the indemnity provisions of this Agreement. The duty to indemnify City and its officers, officials, employees, agents and volunteers shall apply to all claims and liability regardless of whether any insurance policies are applicable. The policy limits do not act as a limitation upon the amount of indemnification to be provided by Consultant. Approval or purchase
CA-8
of any insurance contracts or policies shall in no way relieve from liability nor limit the liability of Consultant, its principals, officers, employees, agents, persons under the supervision of Consultant, vendors, suppliers, invitees, sub-consultants, subconsultants, or anyone employed directly or indirectly by any of them.
If Consultant should subcontract all or any portion of the services to be performed under this Agreement, Consultant shall require each subconsultant to provide insurance protection in favor of City and its officers, officials, employees, agents and volunteers in accordance with the terms of each of the preceding paragraphs, except that the subconsultants' certificates and endorsements shall be on file with Consultant and City prior to the commencement of any work by the subconsultant.
3.2.10 Safety. Consultant shall execute and maintain its work so as to avoid injury or damage to any person or property. In designing the Projects, the Consultant shall at all times be in compliance with all applicable local, state and federal laws, rules and regulations, and shall exercise all necessary precautions for the safety of employees appropriate to the nature of the work and the conditions under which the work is to be performed. Safety precautions as applicable shall include, but shall not be limited to: (A) adequate life protection and lifesaving equipment and procedures; (B) instructions in accident prevention for all employees and subconsultants, such as safe walkways, scaffolds, fall protection ladders, bridges, gang planks, confined space procedures, trenching and shoring, equipment and other safety devices, equipment and wearing apparel as are necessary or lawfully required to prevent accidents or injuries; and (C) adequate facilities for the proper inspection and maintenance of all safety measures.
3.3 Fees and Payments.
3.3.1 Rates and Total Compensation. Consultant shall receive compensation, including authorized reimbursements, for all design services rendered under this Agreement at the rates set forth in Exhibit B for each design Projects, attached hereto and incorporated herein by reference. The total compensation, including authorized reimbursements, shall not exceed the total costs outline in Exhibit B. Extra work may be authorized, as described below, and if authorized, will be compensated at the rates and manner set forth in this Agreement.
3.3.2 Payment of Compensation. Consultant shall submit to City a monthly itemized statement which indicates work completed by Consultant. The statement shall describe the amount of Services and supplies provided since the initial commencement date, or since the start of the subsequent billing periods, as appropriate, through the date of the statement. City shall, within 45 days of receiving such statement, review the statement and pay all approved charges thereon.
3.3.3 Reimbursement for Expenses. Consultant shall not be reimbursed for any expenses unless authorized in writing by City.
3.3.4 Extra Work. At any time during the term of this Agreement, City may request that Consultant perform Extra Work. As used herein, “Extra Work” means any work which is determined by City to be necessary for the proper completion of the
CA-9
Projects, but which the parties did not reasonably anticipate would be necessary at the execution of this Agreement. Consultant shall not perform, nor be compensated for, Extra Work without written authorization from City’s Representative.
3.4 Accounting Records.
3.4.1 Maintenance and Inspection. Consultant shall maintain complete and accurate records with respect to all costs and expenses incurred under this Agreement. All such records shall be clearly identifiable. Consultant shall allow a representative of City during normal business hours to examine, audit, and make transcripts or copies of such records and any other documents created pursuant to this Agreement. Consultant shall allow inspection of all work, data, documents, proceedings, and activities related to the Agreement for a period of three (3) years from the date of final payment under this Agreement.
3.5 Ownership of Materials and Confidentiality
3.5.1 Documents & Data; Licensing of Intellectual Property. This Agreement creates a non-exclusive and perpetual license for City to copy, use, modify, reuse, or sublicense any and all copyrights, designs, and other intellectual property embodied in plans, specifications, studies, drawings, estimates, and other documents or works of authorship fixed in any tangible medium of expression, including but not limited to, physical drawings or data magnetically, electronically or otherwise recorded or stored, which are prepared or caused to be prepared by Consultant under this Agreement (“Documents & Data”). All Documents & Data shall be and remain the property of City, and shall not be used in whole or in substantial part by Consultant on other projects without the City's express written permission. Within thirty (30) days following the completion, suspension, abandonment or termination of this Agreement, Consultant shall provide to City reproducible copies of all Documents & Data, in a form and amount required by City. City reserves the right to select the method of document reproduction and to establish where the reproduction will be accomplished. The reproduction expense shall be borne by City at the actual cost of duplication. In the event of a dispute regarding the amount of compensation to which the Consultant is entitled under the termination provisions of this Agreement, Consultant shall provide all Documents & Data to City upon payment of the undisputed amount. Consultant shall have no right to retain or fail to provide to City any such documents pending resolution of the dispute. In addition, Consultant shall retain copies of all Documents & Data on file for a minimum of five (5) years following completion of the Projects, and shall make copies available to City upon the payment of actual reasonable duplication costs. In addition, before destroying the Documents & Data following this retention period, Consultant shall make a reasonable effort to notify City and provide City with the opportunity to obtain the documents.
3.5.2 Subconsultants. Consultant shall require all subconsultants to agree in writing that City is granted a non-exclusive and perpetual license for any Documents & Data the subconsultant prepares under this Agreement. Consultant represents and warrants that Consultant has the legal right to license any and all Documents & Data.

3.5.2 Right to Use. City shall not be limited in any way in its use or reuse of the Documents and Data or any part of them at any time for purposes of this Projects or another project, provided that any such use not within the purposes intended by this Agreement or on a project other than these Projects without employing the services of Consultant shall be at City’s sole risk. If City uses or reuses the Documents & Data on any project other than these Projects, it shall remove the Consultant’s seal from the Documents & Data and indemnify and hold harmless Consultant and its officers, directors, agents and employees from claims arising out of the negligent use or re-use of

City Council
STAFF REPORT
Date: December 21, 2022 Agenda Item:
2.K.
To: Honorable Mayor and City Council Members
Prepared By: Alma Robles, Planning Director
Department: Planning
SUBJECT:
Project Management Consultant Contract with Civic Solutions for the General Plan Update
RECOMMENDATION:
Authorize staff to begin processing a Project Management Consultant Contract with Civic Solutions to complete an update to the City of Norco General Plan, in the amount of $244,800 over a two year time frame.
SUMMARY:
At the meeting of December 7, 2022, the City Council gave approval for staff to move forward with a comprehensive update of the City of Norco General Plan. This is the first step in this process of the General Plan Update, which is to retain the services of a qualified project manager.
BACKGROUND:
At the meeting of December 7, 2022, the City Council approved for staff to move forward with a comprehensive update to the City of Norco General Plan. Staff informed the City Council that the cost for a comprehensive update to the General Plan is estimated in the range of $1 - $1.3 million, based on recent contracts for comparable cities, including a Project Manager.
The first step in this process is to retain the services of a qualified Project Manager. There was no Request for Proposal (RFP) as Civic Solutions was chosen based on their qualifications and their most recent experience with managing the magnitude of this type of project (ref attached proposal). Staff worked with Civic Solutions to refine the scope and evaluate the cost, and recommends approval.
As Project Manager, Jean Ward from Civic Solutions will function as the leader of the project on behalf of the city team, providing 10-15 hours per week of senior level planning and project management services. The Project Manager will first lead the RFP process
for the consultant team, then shepherd the project's consultants, city staff, commissions, and the community through the various phases to completion. Only the largest of cities have the internal resources needed to manage a project of this scope. Retention of a qualified project manager with a successful track record is foundational for success of the process.
Funding
The City Council was informed at the meeting of December 7, 2022 that funding for the comprehensive update of the General Plan would come from:
• The General Plan (GP) maintenance update designated balances, which are derived from fees that are assessed on all building permits for the sole purpose of the GP maintenance/updates. Currently, the estimated designated balance for the maintenance update is approximately $279,000 and increases as building permits are issued.
• The General Fund will have available funding due to the one-time savings as a result of the American Rescue Plan Act (ARPA) revenue loss for the provision of general government services. It is recommended that some of that one-time savings be allocated for this one-time cost of the GP update.
The cost for a Project Management Consultant is estimated at $244,800 (ref Cost Schedule) and funding will be derived from the GP maintenance update designated balances.
FISCAL IMPACT:
$244,800 over a two year time frame, to be paid out of the General Plan maintenance update designated balances.
RELATIONSHIP TO STRATEGIC PLAN:
This item is consistent with Strategic Plan Direction No. 3 - Economic Development and Financial Stability: Assure financial stability by expanding development efforts, diversifying revenue sources and continuing prudent financial management; Action Plan No. 4 - "Update the General Plan", Sub-actions 4.1 - Update the Circulation Element, 4.2 - Update the Land Use Element, 4.3 - Update the Open Space Element, 4.4 - Update the Noise Element, 4.5 - Update the Safety Element, and 4.6 - Update the Conservation Element.

Proposal to Provide Project Management Services for the City of Norco General Plan Update October 20, 2022 ♦ 1
Project
Understanding
The City of Norco is embarking on a comprehensive update of its General Plan, and is looking to build on its vision as a family-friendly community with a high quality of life and a diverse resident, business, recreation, and animal-keeping lifestyle. Norco is known for its traditional western character and equestrian lifestyle, and provides horse trails, hitching rails, and corrals placed close to businesses. The City has established itself as a destination and branded itself Horsetown USA, with an annual fair, rodeo, and Norco Horseweek, and home to the George Ingalls Event Center, one of the premier equestrian venues in the nation.
The community is passionate about maintaining its high public safety, equestrian lifestyle, and low-density character in the midst of growth pressures and the statewide housing crisis. While the City has a goal of preserving an animal-keeping/small-plot agricultural lifestyle, the City also strives to ensure that all residents have housing opportunities regardless of income. During the City’s recent 6th Cycle Housing Element process, accessory dwelling units (ADUs) rose to the top of community sentiment as one way to meet the City’s Regional Housing Needs Allocation (RHNA) while maintaining community character, resulting in programs that go above and beyond state ADU law to facilitate the development of affordable housing through the promotion and subsidization of ADUs.
Norco’s business sector is growing and the City is becoming a major player in the region based on its strong hospitality sector, growing retail and industrial businesses, connectivity to San Bernardino, Riverside, Los Angeles, and Orange counties via Interstate 15 and Metrolink rail service, significant recent infrastructure investments, and interest in expanding its green energy and sustainable initiatives. The City aims to build on and further cultivate its economic development through the directives of its 2022-2026 Strategic Plan to expand development efforts, diversify revenue sources, and build a sustainable workforce to meet the needs of all stakeholders in the community.
With the exception of the recently certified 2021-2029 Housing Element, Norco’s General Plan is outdated with some elements over 20 years old. A city must update its General Plan periodically to keep up with changing needs and conditions of the City and the region. Several elements have been updated in a piecemeal manner over the past two decades, but a comprehensive update is needed to solidify the City’s long-range vision and establish clear policy direction to guide the community through the next 10 to 20 years.
The City’s General Plan must also be updated to reflect new local, state, and federal laws. There have been significant legislative changes over the past decade that more closely integrate elements of the General Plan than what is currently included in the Norco General Plan. In addition, new areas of focus have been introduced and are now mandated to be addressed by

state law, including balanced land use and transportation solutions and multimodal circulation to reduce vehicle miles traveled; environmental justice and equity; and climate resiliency and hazard mitigation. This is the time for Norco to expand and refine its goals and objectives and define a strong vision and policy direction that preserves the character, history, and quality of life that make Norco special while also adapting to change for a more sustainable, innovative, healthy and economically vibrant future.
We understand the City plans to update its General Plan to build on and enhance its identity and qualities with visionary planning, specialized and multi-disciplinary expertise, and a strong partnership between the City and the community to create a community-based, implementation-oriented General Plan. We also understand the City maintains a small staff and intends to select a qualified consultant team to prepare the updated General Plan. As such, the City is seeking consulting project management services to lead the General Plan Update process and to engage with City staff to ensure that every department is involved in this important planning effort. We would welcome the opportunity to provide these services to the City and be a part of this important and collaborative endeavor. Our proposed services, experience, and qualifications are outlined below.

Qualifications This project is of great interest to Civic Solutions, because it is an opportunity to work with the City and the community to strengthen its vision and foundation for the future, and it builds upon our extensive experience managing and preparing innovative community-based plans in jurisdictions throughout Southern California. Civic Solutions is a full-service planning firm, providing a range of services including project management and preparation of comprehensive plans and policy documents, community engagement efforts, zoning and development codes, specific plans and design guidelines preparation, ministerial and discretionary processing, and CEQA documentation.
Civic Solutions has successfully provided community development services for city and county planning departments in Southern California for 31 years. The firm is established around the principle that community planning and development ultimately serve the public interest. Civic Solutions is ideally equipped to successfully provide planning services to the satisfaction of our clients and the communities we serve. A major component of our services is to provide contract planning staff at all levels to our municipal clients. With this experience, we have the unique perspective of implementing policy plans and regulatory documents on a daily basis, giving us the depth of understanding of how plans and regulations function “at the counter” and how policies function in their use to decision makers. Most importantly, by working in municipalities all over Southern California as contract planners, we are adept and responsive, providing the highest level of customer service to our clients. We fit seamlessly into the cities we serve and maintain open lines of communication.
The decision to update a General Plan is an important one. Not only does it commit the City to embarking on an involved planning process, but it creates the opportunity to generate a new vision for the City’s future that is shared by all stakeholders. To ensure a successful process, it is important that the City have a talented and creative consultant team who knows how to engage the community and employ cutting edge urban design and planning principles; and an experienced and responsive project manager who can successfully collaborate with City staff, a multi-disciplinary team of specialists, and the community to create a community-based, implementation-oriented General Plan document.
As the City’s Project Manager for the General Plan Update, Jean Ward would manage all components of the General Plan effort and coordinate the efforts of the consultant team. With over 20 years of experience in planning, Jean has directed numerous comprehensive plans, specific plans, community engagement efforts, and other complex planning projects, and has provided consulting management services to public agencies for large-scale planning efforts. She has a successful track record of managing a diversity of

community-based, implementation-oriented plans on schedule and within budget. Jean’s resume is provided at the end of this proposal.
With Civic Solutions, Jean has served as contract planning staff managing long-range planning projects for several cities in Southern California. This experience has provided Jean with valuable local knowledge and insight into each City’s goals and aspirations, community dialogue and perspectives, and existing plans, policies, regulations, and processes. In addition, Jean quickly builds relationships with staff in all city departments, allowing her to form a seamless team with city staff and lead projects efficiently and effectively. Through her consulting management experience, Jean works regularly with outside agencies, community groups, and organizations, and understands the communication needed to prepare and implement a General Plan update. Jean is an experienced and responsive Project Manager who can successfully collaborate with City staff, a multidisciplinary team of specialists, and the community to create a forwardthinking General Plan that reflects the unique goals and vision of the community and is focused on implementation and realization of that vision.
The role of the Project Manager is to manage the overall General Plan Update effort and coordinate City and consultant activities. The approach to a successful outcome requires leadership, clear communication, and a high level of collaboration, combined with technical planning experience to work with the consultant team and provide input to development of the General Plan. At Civic Solutions, we relish opportunities to work creatively and interactively with City staff, specialized consultants, and City boards and commissions to find policy and design solutions that meet the City’s vision and objectives while
also responding to the
practical considerations
of development
feasibility, contextual
awareness, and
municipal finances.

Proposed Services Civic Solutions is pleased to offer complete and comprehensive consulting management services to manage the City of Norco’s General Plan update process. Following is a description of the services to be provided.
As the City’s General Plan Project Manager, Jean will maintain regular communication with the City and the consultant team, virtually and inperson, as needed throughout the duration of the project. Jean will facilitate and organize regular conference calls, weekly meetings with City staff, and bi-weekly or monthly meetings as needed with the City and the consultant team to collaboratively and synergistically work together on branding, community engagement, planning, policy development, and environmental documentation as we create the updated General Plan. Jean will coordinate with other City departments and outside agencies as needed throughout the process and include them in meetings when appropriate.
As requested, Jean is also available to assist with preparation of the Request for Proposals (RFP) for the General Plan Update, as well as participate in interviews and refinement of the contract scope upon selection of a consultant team. Participation in the RFP and contract negotiation phases will allow the City’s Project Manager to most effectively manage the scope, schedule, and budget of the consultant team during the General Plan Update process. As such, Jean will oversee the team or individual contracts with the consultants, manage the schedule to ensure completion of major deliverables and work tasks, monitor the overall budget, and review consultant invoices on a monthly basis. Our work program also includes the preparation of staff reports, meeting and presentation materials as necessary, and continuous project updates throughout the process.
In addition, because Jean is a practicing planner, she is able to participate as needed in all aspects of the development and preparation of the General Plan by providing planning input as the plan is developed, reviewing and editing milestone deliverables and draft of the plan, and participating in all aspects of the community engagement process.
While not anticipated, if there is a need for additional assistance over this multi-year planning effort, Civic Solutions’ Vice President, Mary Wright, will provide support. Mary is a planning professional with over 25 years of planning and environmental experience in Southern California. She has extensive experience managing a diversity of projects, and, as former Deputy Director of the City of San Diego Planning Department, has leadership experience in municipal planning and directed many of the San Diego’s Community Plan updates.
The proposed services for consulting project management and our project management approach are summarized as follows:

City of Rancho Cucamonga
Jean has been providing consulting management
services to the City of Rancho Cucamonga since
2018. Jean recently served as Contract Project
Manager for PlanRC, Rancho Cucamonga’s
General Plan Update. Jean worked with a 10-
person core team of City staff throughout the
process, resulting in every department engaging
across disciplines, having hands-on involvement in the development of the General Plan, and a direct investment in and commitment to implementation. She also led and coordinated the efforts of the consulting team, which consisted of 10 firms, including management of scope and budget, contract and invoice review, and communications with the City core team. The scope of work also included preparing all staff reports and decision-maker presentations. In 23 months, Jean managed and shepherded the General Plan Update through the planning and engagement process to unanimous adoption by the City Council, with multiple community members speaking at the public hearings in support of the plan to which they contributed. This immense and comprehensive project came in on schedule and under budget, and has already received recognition as an exemplary comprehensive plan from SCAG’s Sustainability Awards Program and the Inland Empire Section and California Chapter of the American Planning Association (APA).

Following the General Plan Update, the City transitioned to developing a Form-Based Development Code, which Jean also managed, that takes the design of the Plan to the regulatory level and allows for development streamlining. Jean continues to work with City staff to “test drive” the new form-based standards against current mixed-use development proposals, and work with Planning staff to refine the standards as needed, to ensure the form-based zones are successful in implementing the vision of the General Plan.
In addition, as part of the PlanRC process, Jean managed the preparation of a Climate Action Plan adopted with the General Plan that provides streamlining options for future development while simultaneously reducing impacts to the climate, as well as other implementing plans, including a Local Hazard Mitigation Plan, an Evacuation Assessment, and an Economic Strategic Development Plan update.
Prior to the PlanRC effort, Jean was consulting Project Manager for another of the City’s largest planning and engagement efforts to date, the Etiwanda Heights Neighborhood & Conservation Plan, which was adopted in 2019, and annexation of over 4,000 acres in the northern portion of City. This community-based Plan was prepared to guide land use and shape new development within the Etiwanda Heights Neighborhood & Conservation Plan Area, and represents a unique opportunity to permanently preserve unspoiled views of the San
Gabriel foothills and mountains,
permanently conserve rural open
space and habitat resources, and
secure recreational access to the
foothills, while providing unique
new neighborhoods that reflect
Rancho Cucamonga’s heritage.
Jean managed all components of
the project, as well as
coordinated the multidisciplinary consultant team,
which was made up of ten firms.
Jean is continuing to provide consulting management services to the City as the manager of two master plans efforts for key locations in the City: the Epicenter Master Plan and the Civic Center Master Plan. Jean is also working with the City’s Economic Development staff. and an outside economist to develop a fiscal impact tool for new development based on a value-per-acre model used for the General Plan economic analysis.

City of Jurupa Valley
Jean has been providing consulting management services to the City of Jurupa Valley since 2017. Currently, Jean is leading a multi-disciplinary consultant team and inter-departmental City team to prepare the Pedley Town Center Plan. This area plan, funded with an SB2 grant, includes a robust community engagement component and community engagement effort. Pedley is a historically rural part of the city located around the intersection of Limonite Avenue and Van Buren Boulevard, which is perhaps the most significant crossroads of the city, and includes the Metrolink station and extends down to the Santa Ana River. The Pedley area is also the civic hub of the community as it includes City Hall. This Plan will guide development and public improvements to create a cohesive center that will anchor this historic equestrian area of the city and help solidify its identity within Jurupa Valley. The intent of this Plan is to clarify a unique vision and strong implementation strategies for the Pedley area to function as a walkable semi-rural downtown environment, or “Town Center” as envisioned by the General Plan.

Jean recently managed a team of City staff and
consultants to prepare Jurupa Valley’s Housing
and Safety Element Updates and associated
housing-related development code amendments
and implementing housing programs. The
comprehensive Housing Element Update
addressed how the City will accommodate its
substantial RHNA and was one of the first 6th Cycle
Housing Elements to be certified by the state in the
SCAG region. Jean has also prepared numerous
legislative text amendments, and managed other special projects for the City, including General Plan implementation programs.
In addition, Mary Wright, who will provide additional services if needed for the Norco General Plan Update, managed and prepared the City of Jurupa Valley’s General Plan, this young city’s first General Plan. The comprehensive update included a robust public engagement process including the involvement of a 32-member General Plan Advisory Committee (GPAC). Work began with a visioning process to establish community values and guide the update process. The General Plan includes all state-mandated General Plan Elements as well as four optional elements:
Economic Sustainability, Environmental Justice, Air Quality, and Healthy Communities. In adopting the General Plan, City Council members remarked that the team created a robust plan that truly reflects the goals and aspirations of the community. In addition, the Jurupa Valley General Plan received an Award of Merit from the Inland Empire Section and the California Chapter of the American Planning Association.
Prior to the preparation of the General Plan,
Mary prepared an Environmental Justice
Element to satisfy the City’s obligation
under lawsuit settlement. The Element was
only the second Environmental Justice
Element in the state and addressed issues of
environmental equity throughout the City.
Mary and her team worked actively with the
Center for Community Action and
Environmental Justice (CCAEJ) and other
stakeholder groups to lay out a plan that
clearly documents existing procedural and
geographic inequities and introduces
thoughtful policies that will make development decisions fair and inclusive.
This element set a standard for how to address environmental justice in a planning context, and is featured on the Office of Planning and Research’s website of best practices in environmental justice. The Element received awards from the local and state chapters of the American Planning Association for best practices and advancing diversity.

City of Westlake Village
Jean has been providing consulting planning and project management services to the City of Westlake Village since 2010. Most recently Jean managed the City of Westlake Village’s 6th Cycle Housing Element, including targeted updates to the development code to implement new housing laws including density bonus special needs housing. The Housing Element Update included a significant community engagement, outreach, and educational component regarding housing development and current state law.
This Housing Element was the third in the SCAG region to be certified by HCD. Jean also managed and prepared associated Updates to the City’s Hazards Chapter of the General Plan. The scope of work included managing all aspects of the project, including the consultant and the City team, project budget and scope, leading the public engagement efforts, staff reports, presentations, and presenting to decision makers. The 6th Cycle Housing Element was the third in the state to receive certification from the Department of Housing and Community Development.

Jean also managed a multi-disciplinary team and prepared the North Business Park Specific Plan in the City of Westlake Village. The North Business Park Specific Plan was originally an effort to inject reinvestment and modify land use designations to allow for more development flexibility, including the addition of retail and housing, into an aging industrial and business park. Over time, the plan transitioned to one with an emphasis that put housing front and center.
The engagement methods used
helped to change previously
unwavering attitudes and address
concerns associated with adding
housing. This resulted in the
community and the City Council
eventually recognizing the benefits
of the Specific Plan. The Specific Plan
was ultimately adopted
unanimously in June of 2020, with strong community support and a shift in attitude towards housing, and received an award from the Los Angeles Section of the American Planning Association (APA).
As part of this plan, Civic Solutions developed Objective Multi-Family Residential Design Standards for the City to comply with SB330, and a byright review process for multi-family residential and mixed-use development. Jean also assisted the City with General Plan implementation, Specific Plan implementation, and special projects, including establishing a specific plan cost recovery fee and development impact fees.

SUBJECT:
Approval of a Side Letter Agreement with Utility Workers of America Local 606 Concerning Salary and Benefits for Public Works Department employees RECOMMENDATION:
Approve Side Letter Agreement with Utility Workers of America Local 606 concerning salary and benefits for Public Works Department employees.
SUMMARY:
The proposed Side Letter Agreement will adjust compensation for certain Public Works Department classifications in order to attract and retain skilled employees.
BACKGROUND:
The most recent Memorandum of Understanding with Utility Workers of America (UWA) Local 606 was approved in October 2022 for the term of July 1, 2022 to June 2023.
The Public Works Department has been challenged to retain skilled employees who are responsible for maintaining the City's water and sewer infrastructure, as well as streets, storm drains, and other assets. Turnover rates in this group have ranged from approximately 40% to as high as 60% annually within the last five years. The department has been challenged to fill its vacancies with highly skilled workers who can attend to the 24/7 nature of the utility system.
The City of Norco's salaries for these classifications have been lower than other neighboring agencies with water and wastewater utilities. This high turnover has also caused the small cadre of longer-term staff to be required to frequently be on stand-by to respond after hours and on weekends.
The proposed Side Letter Agreement is based in the employee Classification and Compensation Study that was completed within the last year. That study sought to adjust compensation to the approximate market average. The City approached UAW Local 606
to discuss possible implementation of the study at this time in order to address the issues noted above. The parties have discussed the issues and agreed to the proposed Side Letter Agreement.
The Agreement would adjust compensation to slightly above market average in order to incentivize retention and recruitment. It would also provide additional stand-by pay through June 2023; provide one-way mileage reimbursement for the second standby employee who is called out, through June 2023; and allow employees to accrue up to 40 hours per calendar year in compensatory time, in lieu of overtime. With these changes, it is expected that the turnover rate can return to a normal level, and the City will be successful in recruiting skilled and experienced personnel in these operations.
It should be noted that implementation of the classification and compensation is still pending for other UAW Local 606 employees in the Facilities and Maintenance Department, as well as employees in the Norco General Employees Association (NGEA) and Mid-Management/Supervisory groups. It is anticipate that those groups will be addressed as part of upcoming negotiations with NGEA and the budget process for FY 2023-24.
FISCAL IMPACT:
The Side Letter Agreement results in an additional cost of $190,100 for the remainder of FY 2022-23. Salary savings are anticipated in the current year resulting from ongoing recruiting challenges. Any budget adjustment required as a result of this action will be considered during the mid-year budget review process.
RELATIONSHIP TO STRATEGIC PLAN:
This item supports Strategic Plan Item #2, Human Capital - Build a sustainable workforce to meet the needs of all stakeholders; and specifically Action Plan 2.1, which is to complete and implement a citywide classification and compensation study.

SUBJECT:
Proposal from RKA Consulting Group for the Temescal Avenue School Circulation Study RECOMMENDATION:
Approve the proposal from RKA Consulting Group for the Temescal Avenue School Circulation Study, including the sharing of costs with the Corona-Norco Unified School District, and authorize the City Manager to take actions needed to execute the project and cost sharing arrangements.
SUMMARY:
School traffic issues are a challenge in many communities, and solutions require collaboration and creative problem-solving approaches. The completion of this study and getting consensus on the future solutions is an important first step toward addressing these challenges. The study will provide a road map for feasible improvements, rooted in data and good engineering, that can be implemented using grants and other funds in future months and years.
BACKGROUND:
Temescal Avenue, along with the surrounding streets and neighborhoods, is impacted by the compounding effect of having traffic from three schools (Norco Intermediate, Norco High, and Norco Elementary) in very close proximity to one another. The proposed Temescal Avenue School Circulation Study will gather data concerning the current issues, and provide recommendations from the City's Engineering firm that can be implemented over time to improve conditions. Corona-Norco Unified School District has agreed to partner with the City in this effort, and share the study costs.
The proposal for the study is attached for review. In summary, the work is divided into two major tasks:
• Task 1: Data Collection - This phase will include discussions with city staff and school representatives, including teachers, parents, and crossing guards from
each of the schools to gain their perspectives. The engineering team will then conduct observations in the field in both the morning and afternoon timeframes.
Traffic count data will also be obtained, including counts for pedestrians and bicycles.
• Task 2: Calculations and recommendations - Based on the data collected, RKA will conduct its analysis and develop initial recommendations for cost-effective infrastructure improvements. City staff, as well as the Streets, Trails, and Utilities Commission, will review and provide feedback on those draft recommendations before a final report is provided to the City Council.
If approved, the study will begin in February 2023 with the report and recommendations to follow in late Spring 2023.
FISCAL IMPACT:
The cost of this study is estimated to be $49,700, which will be shared between the City and CNUSD.
RELATIONSHIP TO STRATEGIC PLAN:
This item supports Strategic Plan item 1.4, which is to strengthen traffic safety in the community.

RE: PROFESSIONAL SERVICES FOR THE TEMESCAL AVENUE SCHOOL
CIRCULATION STUDY
Dear Mrs. Sassoon:
RKA Consulting Group is pleased to submit this proposal to provide professional engineering services for a Traffic Analysis and Study along the Temescal Avenue corridor and accompanying side streets which are being impacted by the schools located along this corridor.
It is understood that there are significant traffic impacts during the school hours along Temescal Avenue between First Street and Fourth Street due to the close proximity of Norco Intermediate School, Norco High School, and Norco Elementary School to each other. In order to fully comprehend the impacts generated by the traffic associated with the schools, information and data will need to be collected. This will involve conducting interviews with various school and City representatives. In addition, field visits will be conducted by RKA staff members to witness the current conditions first-hand. Finally, traffic counts will be conducted by a firm who specializes in data collection of vehicular, pedestrian, and bicycle volumes.
Existing Conditions
There are currently three of Norco’s largest schools located along Temescal Avenue between Fourth Street and First Street. When viewing the aerial imagery, each school appears to have their own circulation issues regarding traffic and student access ingress and egress. Temescal Avenue is a twolane roadway along this corridor, and the current pavement width does not accommodate turn pockets at the school driveways. In addition, there are several school crosswalks which provide direct access for the students, however some of these crosswalks are not at street intersections and are considered to be uncontrolled crossings. While there are sidewalks directly in front of the schools, they do not extend beyond the school properties, which severely limits the safe paths of travel for students. It has also been reported that several intersecting streets near the schools are utilized by parents as temporary parking for student drop-off and pick-up.
This proposal is provided in two parts. Task I will define the services required to collect information related to the various traffic issues at each school and collect traffic data during two (2) typical school
PAGE 2 CITY OF NORCO
TEMESCAL AVENUE SCHOOL CIRCULATION STUDY
days. This will be done by meeting with various representatives from each school, as determined by City Staff. Using their input, a more focused approach to the issues can be developed. Once this is completed, RKA staff will conduct field observations during the peak traffic times to witness the impacts in-person. Finally, traffic data collection will be performed at the desired locations to provide the necessary data suitable for the required capacity calculations and comparisons which is outlined further in Task 2.
Task 2 will involve assembling all the data collected to perform calculations for intersection capacity analysis, and possible warrant analysis at various intersections to determine the need for alternate traffic control devices. Using the results of these studies, along with all the input collected, initial recommendations to alleviate the traffic impacts will be outlined and presented to city staff. Based on discussions with city staff, final recommendations will then be prepared in report format and provided to the city.
The scope of work for the engineering services are as follows:
Task I - Data Collection
• Meet with city staff and suitable representatives from each school that are integral to school operations such as school officials, teachers, and/or concerned parents. It is recommended that an independent meeting occur for each school so that any unique situations pertinent to each school may be presented. RKA staff will also reach out to crossing guard personnel for each school to collect information and to obtain their perspective on the current issues and problems.
• Based on the input from school representatives and City staff, in-person field investigations of the areas around each school will be performed by RKA staff. The investigations will be performed at each school during both the AM peak and PM peak periods, based on each respective school schedules. The engineers will examine current street capacities, parking and routing procedures for student drop-off and pick-up, and overall traffic circulation patterns.
• Traffic Counts
o RKA will utilize National Data and Surveying (NDS) to perform turning movement traffic counts along with pedestrian and bicycle crossing counts at key intersections along the corridor. Currently RKA is proposing to collect this data at 10 key intersections, however the locations of those intersections may be adjusted pending input from school and City representatives.
o Pedestrian and bicycle crossing counts will also be performed at the remaining school crosswalks which are outside the limits of the key intersections.
Task II - Calculations and Recommendations
• Once RKA has assembled all input from the school and City representatives, along with the traffic data collected by NDS, the operation of the various intersections and crosswalks can be analyzed to determine if any deficiencies can be corrected.
PAGE 3 CITY OF NORCO
TEMESCAL AVENUE SCHOOL CIRCULATION STUDY
• Based on information obtained during the field visits and the results of the calculations, initial recommendations will be prepared regarding potential infrastructure improvements along with any operational improvements needed. These recommendations will be presented to City staff to receive their input and feedback.
• Pending feedback from City staff, the final recommendations will be prepared by RKA and presented in a final report format.
FEE PROPOSAL
RKA Consulting Group proposes to provide the above-described services on a time and materials basis with an expected fee amount of $49,708. A breakdown for each Task is as follows:
Traffic Analysis and Study
• Task 1 - Data Collection:
o The expected fee amount for meeting with the various representatives, conducting the in-field engineering analysis, and collection of the traffic data by NDS is $29,558. This amount could vary depending on input from City staff related to the number and locations for data collection.
• Task II - Calculations and Recommendations:
o The expected fee amount for calculations and recommendations is $20,150. This amount could vary depending on input from City staff.
We appreciate the opportunity to provide this proposal and look forward to working with you on this project.
Sincerely,

SUBJECT:
Discussion concerning Inclusion of Youth Members on City Commissions RECOMMENDATION:
Discuss and provide direction on the inclusion of youth members on City Commissions.
SUMMARY:
At the December 7, 2022 City Council meeting Council Member Katherine Aleman proposed a discussion concerning adding youth commission seats to our current Committee/Commissions.
BACKGROUND:
The City of Norco previously had a Youth Advisory Council. These Youth Council Members primarily served as volunteers for various city activities and programs. With the advent of the COVID pandemic, the Youth Advisory Council was discontinued.
A few current examples of cities that have youth on existing commissions are in the cities of Belmont, Walnut Creek, Long Beach, Berkeley, and Los Angeles. In reviewing these cities, the Youth Commissioner age requirements vary from 12 years old to 24 years old.
Youth Commissioners can offer guidance to the City on issues that affect the youth in the community. Youth Commissioners roles vary from advisory, with no vote; voting members, but vote is not counted in decision; and full voting members. There are cities that have implemented a one-year pilot program to test out their Youth Commissioner seats prior to rolling out a full program.
Adopting a Youth Commissioner program would provide an opportunity for youth input in their local government. It may also encourage young people to pursue careers in the public sector and/or participate in local civic activities. Inclusion of youth on commissions, in lieu of a Youth Advisory Council, does not require additional staff resources to support.
If the direction from the City Council is to implement a Youth Commissioner program, staff will create a draft structure for the program and will return back to City Council at a later date for discussion and approval. Depending on the Council's direction, an ordinance may be required.
Staff is asking for direction at this time. A pilot program that starts with a single commission, such as the Parks and Recreation Commission, may be an approach that the City Council would wish to discuss.
FISCAL IMPACT:
None at this time.

SUBJECT:
Amendments to City’s General Fee Schedule for Fiscal Year 2022-2023 RECOMMENDATION:
Adopt Resolution No. 2022-86, updating and adjusting the City’s General Fee Schedule for Fiscal Year 2022-2023.
SUMMARY:
Approve adjustments to the City’s General Fee Schedule for Fiscal Year (FY) 2022-2023, with most fees to be adjusted in the amount of 7.5%. The Consumer Price Index (CPI) from March 2021 to March 2022 was 10%.
BACKGROUND:
In 2019, Revenue & Cost Specialists (RCS) prepared a User Fee Study to update the City’s General Fee Schedule. The recommendations from the study resulted in the City Council adopting a resolution updating fees for general City services. The City Council has approved, as necessary, adjustments to the General Fee Schedule based on changes in CPI and supplemental studies by RCS or staff’s in-house estimates of cost.
On May 18, 2022 the proposed increase to the City's General Fee Schedule was presented to the City Council for consideration. At that time the CPI of 10% between March 2021 and March 2022 for Riverside, San Bernardino, Ontario was presented for approval. The Council Members did not feel that the increases were appropriate at that time and asked that the fees be reviewed and brought back to City Council for possible implementation during mid-year.
Staff reviewed the fees and has made adjustments to moderate the impacts of fee increases in many cases, in light of inflationary pressures on many stakeholders.
However, as a best practice, it is recommended to make modest fee adjustments over time so that the City's fees keep pace with the growth of costs that also occurs over time.
The following adjustments are recommended to be effective February 1, 2023.
Development-related fee adjustments will be effective 60 days following the adoption of the resolution:
• Most fees were calculated with an increase of 7.5%
• Fees set by statue are not changing
• Certain fees for Community Services (such as Senior Center, Community Center and Riley Gym) and trademark and licensing fees will not be adjusted at this time, in order to moderate impacts
• Gateway Sign Advertising were calculated with an increase of 2.5% for in-town entities and 5% for out-of-town entities. These fees have not been increased since they were established in July 2017; adjustments are necessary to continue to pay for program costs, and to build reserves for the eventual replacement of the digital sign
• Animal Control fees calculated with an increase of 10% • Fire Prevention fees calculated with an increase of 10% • Development related fees (i.e. Planning, Building and Safety, and Public Works) were calculated with an increase of 10%
No development impact fees are proposed for adjustment at this time. However, the City's development impact fees are outdated, and a fee study will be completed in the coming months to ensure that new development pays its own way for new infrastructure demands it creates.
NEW FEES
Facilities and Parks Maintenance:
• Corydon Staging Parking Area - $40.00
The Corydon Staging Parking Area rental fee would apply to daily parking lot rentals associated with private events in order to cover related operational, utility and maintenance costs. This fee would not apply to equestrians that trailer-in for the day. This rate is based on the fact that construction is limiting the parking capacity to 50%. When construction is complete the recommended fee is $81.00. • GIEEC Satellite Parking Lot/Staging Area - $500
The price requested takes into consideration large non-city sponsored events requesting the use of the parking lots/staging areas for satellite parking for events such as concerts and other large events where the sponsor charges parking fees.
The fee would include the cost of striping and preparing of grounds utilizing city staff and equipment.
MODIFICATION OF CURRENT FEES
Facilities and Parks Maintenance
• GIEEC Camping with Electricity for 20 amp, 30 amp and 50 amp - $30/$40/$50 respectively. Currently the Fee Schedule does not delineate a price difference between the 20, 30 or 50 amp fees. The fee takes into account additional electricity usage and maintenance needs.
• GIEEC Vendor Booth Fee (Food or Retail w/Electricity 10 x 10. Fee per vendor after 2 vendors per event) - $44 for 20 amp,$54 for 30 amp, and $64 for 50 amp.
Currently the Fee Schedule does not delineate a price difference between the 20, 30 or 50 amp fees. The fee takes into account additional electricity usage and maintenance needs.
In addition, the fee table format for business license fees was modified to detail the specific fee amount associated with each business license type. No modifications were made to the actual fee amounts other than the proposed CPI adjustment, if applicable.
FISCAL IMPACT:
Staff estimates that the majority of recommended fee adjustments will result in modest additional revenues to the General Fund to offset increasing costs. Revenue impact from the recommended changes will be captured as part of the Mid-Year budget revision process.
RELATIONSHIP TO STRATEGIC PLAN:
The proposed increases are consistent with Strategic Direction No. 3 - Economic Development and Financial Stability: Assure financial stability by expanding development efforts, diversifying revenue sources and continuing prudent financial management.
