MULTIFAMILY DEVELOPMENT PROJECTS
A. INTRODUCTION & OVERVIEW:

Sargent Town Planning is pleased to provide the following professional services proposal to assist the City of Norco in refining and expanding its Objective Development Standards (ODS) for mixed-use and multifamily development projects.

We understand that these updates are of pressing importance for future development projects subject to the City’s Housing Development Overlay (HDO), given the HDO allows for considerably higher densities (20 - 30 DUA, and up to 35 DUA with density bonus) than is allowed and present elsewhere in the city. Accordingly, more tailored regulatory tools and standards are needed for these sites to ensure that new development is compatible with Norco’s community character, and adds positive value to the city.

We understand that the City’s main goals for this effort include:
• Visualizing and clarifying the types of multifamily / mixed-use development that are appropriate for Norco: Identifying and visualizing the key attributes (building form, character, configuration, intensity, activities & amenities, etc.) of multifamily / mixed-use development projects that are compatible with Norco’s small-town, semi-rural community character. • Promoting / incentivizing shared equestrian and agricultural amenities: Integrating shared community amenities into such projects that reflect Norco’s agrarian heritage and expand opportunities for community participation in equestrian and small-plot agriculture activities. • Ensuring compatibility of future multifamily / mixed-use development with Norco’s established urban patterns and community character: Establishing (updating and expanding) development standards that can consistently deliver built outcomes — including site planning, building form and massing, building and site design character, and potentially others —that are compatible with Norco’s small-town, semi-rural community character.

We also understand that this is of pressing concern to the City and City Council, due to current private development interest in one or more HDO sites.

B. PROPOSED SERVICES:

To meet these goals, we recommend the following approach, major tasks and deliverables, and timeline for this effort:

TASK 1: VISION CONFIRMATION (INITIAL SITE DESIGN CONCEPTS): The purpose of Task 1 is to develop site design concepts that enable staff and City Council to visualize and articulate the built outcomes that are intended for HDO sites, and to provide our team with sufficient direction, parameters and criteria to craft updated development standards. To do so, we recommend developing design concepts for two “case study” HDO sites:
a. Hamner Ave & Fourth St: As one of the General Plan’s “Focus Areas”, refined vision concepts developed for this site will help clarify and expand the General Plan’s goals, vision and policies for these areas. These concepts will also provide clear guidance on the City’s intentions and expectations for this area to potential investors/developers. b. Second St & River Dr: Located along the city’s southern boundary, this site provides a unique and challenging design opportunity for future development. Its single-family neighborhood context requires tailored development compatibility standards that require building height and massing to appropriately scale-down toward the surrounding single-family neighborhood patterns.

For each site, we recommend studying two basic development scenarios:

1. Market-Based Scenario: Assumes, at a minimum, the development potential assumed by the adopted Housing Element (75% of the total area of each site developing at 20 DUA). We will consult with City staff to confirm the parameters of this scenario, taking into account recently entitled or constructed comparative projects (i.e. the Norco Valley Square project and other recently constructed regional precedents).

2. Max Development Scenario: To test the existing ODS, this second scenario assumes that development potential consists of 100% of the total area of each site developed at the maximum 30 DUA plus equestrian and/or agricultural amenities.

Design concepts for each scenario will include building footprints and/or basic 3D building massing and layout/configurations of parking and shared on-site open space and shared amenities (agriculture, equestrian and recreational) and be illustrated by precedents of relevant development types, styles, and shared amenities, and/or new illustrations prepared by STP to highlight intended built form and architectural / public realm character.

Development program summaries, (including total built square footage, number/type of residential units, commercial square footage, and types/amounts of shared open/recreational (including agricultural and equestrian) space will also be provided for each concept.

Once developed, we would share these concepts with City staff in the form of a summary PowerPoint presentation (and/or simple summary report) for review and discussion with City Council either in a study session or individual meetings with Councilmembers. Assuming no major revisions or changes are requested, we would take notes of any topics needing additional clarity, and incorporate that feedback and direction into the draft ODS to be developed as described in Task 2 below.

Task 1 Deliverables:
• Conceptual CAD-based Annotated Site Plans, and Development Program summaries; • Basic 3D site massing models, as needed, to highlight building form and massing attributes.

Page 344 of 420 ends

3 of 7
• Precedent photography development types and shared amenities highlighting intended form and character of new development, public realm, and shared amenities; • Additional Renderings and Illustrations (such as illustrative site plans, 3D renderings or 3D perspective illustrations) as needed for vision confirmation and as budget permits*.

Task 1 Cost Estimate: $10,000-$15,000 per site (not to exceed $20,000* total for Task 1). * If additional or more detailed renderings or illustrations are needed to help staff / City Council visualize and confirm key design attributes and outcomes for these sites, we would recommend funding those illustrations with General Plan Contingency Funds. Such illustrations would be “document quality” illustrations that could be used within their relevant General Plan “Focus Area” subsections.

Task 1 Estimated Timeline:
• Concept Development: 3 weeks (by week of Thanksgiving). • Council Study Session or Individual Meetings with Councilmembers: 1st week of December.
• Concept Refinement: 1 week.

TASK 2: UPDATED OBJECTIVE DEVELOPMENT STANDARDS (ODS) FOR HDO SITES: Based on a confirmed vision and/or additional feedback and direction provided from staff and City Council in Task 1, we will draft updates to the current ODS for HDO sites. Based on our initial review and understanding of the current ODS, we recommend the following approach:

1. Introduce new ODS Topics addressing:
a. Subdivision and Connectivity: Objective standards to ensure that new development is creating and completing (and not preventing) a complete, connective public realm network of walkable blocks, streets, trails, and open spaces;
b. Street and Public Frontage Design: Objective design standards for Roadway (curb-to-curb) and Public Frontage (curb to private property) design to ensure safe, comfort-able, attractive and walkable streets and public spaces;
c. Private Building Frontage Design: Objective design standards for private development, with an emphasis on building frontage & access (use or porches, stoops, shopfronts, street-facing windows and primary entries, etc.) ensuring that buildings front-onto and activate streets and public spaces;
d. Site Design: Objective design standards building placement, pedestrian access to site and units and shared open spaces, and vehicular access and parking placement; e. Shared Open Space Design and Requirements: Identifying requirements for the amount and types of shared open space and recreational (including agricultural and equestrian) required or incentivized (see Density Bonus & Community Benefits in #2 below) by new development; f. Retail-Ready” Frontage Locations: Identifying any locations where ground floor commercial or “retail ready” frontages are required, and what uses are allowed within those frontages to support an active public realm environment and strong tax base.

Page 345 of 420 ends

4 of 7

2. Refine and expand existing ODS topics addressing:
a. General Development Standards (Ch 2): recommend potential refinements to specific topics (i.e. lot coverage, setbacks, etc.) that might better support the activated public realm environment intended for these areas and the common amenities that are provided, and for consistency with Public and Private Frontage Design standards (and potentially other topics) described above.
b. Site & Landscape Design (Ch 3): Refine and expand standards addressing building placement and orientation, pedestrian access to site and units and shared open spaces, and vehicular access and parking placement;
c. Building Design Standards (Ch 4): refine and expand standards to ensure that new (higher density) development is massed, articulated and scaled to be compatible with Norco’s smalltown, semi-rural character, and that it appropriately transitions/scales down (in height, mass, scale and form) as it approaches surrounding neighborhoods. d. Architectural Style: refine existing architectural standards to potentially expand or replace the “Western” style with additional true/authentic styles that are contextual to Norco and/or regionally appropriate*, and add basic objective standards related to building materials and configurations, as appropriate.
*Note: Adding additional architectural style guides would be considered an “Optional Additional Service” – see below.

3. Refine and Expand City’s Density Bonus Program:
a. Density Bonus & Community Benefits: recommend revisions to the City’s existing Density Bonus program to recognize provisions of specific types of shared agricultural and equestrian amenities as qualifying community benefits for density bonuses, parking reductions, and potentially other city-provided incentives.

Task 2 Deliverables:
• Draft Objective Design and Development Standards (ODDS) per topics outlined above; • Draft recommendations for refinements to the City’s Density Bonus Program.

Task 2 Cost Estimate: $30,000*
* Once Task 1 Outcomes have been confirmed with Staff and Council – we will confirm and clarify the scope of Task 2 updates and revisions needed, including any additional budget requirements.

Task 2 Estimated Timeline:
• Draft Standards Preparation: 1 month (by mid-January 2025). • Staff Review: 2 weeks? (by end of January 2025)
• Refinement/Revisions: 1-2 weeks.
• Study Session with Council: Mid-February 2025?
• Adoption Hearings*: February/March 2025?
* See “Optional Additional Services” Task X.4 below.

Page 346 of 420 ends

5 of 7
C. OPTIONAL ADDITIONAL SERVICES:

Potential related additional services for consideration might include:

X.1 – EXPANDED ARCHITECTURAL STYLE GUIDES: As described in Task 2 above, we recommend expand or replacing the “Western” style defined in the current ODS, with additional 3-4 true/authentic styles that are contextual to Norco and/or regionally appropriate. These could be in the form of style guides that define the basic defining characteristics of each style, and provide basic objective design standards for the appropriate application of that style. This task might also be expanded inform development in other parts of the city - potentially linking to / referencing information from related / future historic resources surveys (not included this Task) to identify elements of Norco’s historic architectural vernacular that should be memorialized in such architectural standards.

Task X.2 Cost Estimate: $5,000 - $20,000 (based on number of styles included) X.2 - UPDATED HDO APPLICATION / DESIGN REVIEW PROCESS: We recommend that the city consider amending the HDO site plan submission requirement described in Chapter 18.64 (Housing Development Overlay (HDO) Zone) of the Zoning Code to establish a more iterative design review process that follows a logical sequence/hierarchy of topics (related to those outlined in Task 2 above).

Through the introduction of a preliminary review submittal and clearly defined findings, this process would be designed to ensure that critical elements of the proposed development (subdivision & connectivity, public realm activation, etc.) are consistent with the vision of General Plan, before diving into detailed architectural design, infrastructure engineering, etc.).

Task X.2 Cost Estimate: $2,500-$5,000
X.3 – ADDITIONAL STUDY SESSIONS / ADOPTION HEARING SUPPORT: The cost estimates for Task 1 and Task 2 Services in Section B above, assume STPs participation in one (1) Council Study Session.

STP will be available to participate in additional Study Sessions and/or Adoption Hearings as needed and requested.

Task X3 Cost Estimate: $1,000-$2,500/meeting (based on amount of additional preparation / presentation materials required)
X.4 – PUBLIC/PRIVATE AMENITY STRATEGY: In order to ensure that that the proposed agricultural and equestrian amenities are realistic for developers to implement, we recommend that outreach be conducted to developers, economic development departments, and/or Norco equestrian/agricultural organizations in Norco regarding how these amenities are managed, maintained, and funded/financed.

Task X.4 Cost Estimate: TBD

Page 347 of 420 ends

D. PROPOSED BUDGET & STP STAFF BILLING RATES:

Based the City’s urgency in having strengthened development standards in place, we recommend an initial “not-to-exceed” budget of $50,000. All billing for the services described herein will be based on our 2024-2025 staff billing rates, provided as “Attachment A”, and based on the proposed services described herein, we anticipate an average billing rate of approximately $190/hr. We will work with the City to confirm the details of a scope of services that best aligns with their needs within this initial budget, and if necessary, identify topics and tasks that may be of lower-priority and/or require additional funding provisions.

We are happy to discuss any of the recommendations in this proposal in further detail at your convenience and request.

Best,
Peter VanderWal, Principal

SUBJECT:

Recognizing the 100th Anniversary of the Opening of the Norco School RECOMMENDATION:

Appropriate additional funding in the amount of $1,000 to host a one-time event to recognize the 100th Anniversary of the opening of the Norco School.

SUMMARY:

Mayor Kevin Bash has requested that the City of Norco recognize the 100th Anniversary of the opening of the Norco School, which still stands today as the Norco Community Center. Staff recommends hosting a one-time event to recognize this significant anniversary.

BACKGROUND:

In January 2022, the Norco City Council took action to formally recognize various national holidays, observances and commemorative days. It has become customary for the City Council to review plans to recognize City anniversaries.

Observance Background
The Norco School opened on January 5, 1925, marking next year (2025) as the 100th Anniversary. The building, which still stands today as the Norco Community Center, was a key piece of Rex B. Clark's dream to create a self-contained and thriving community.

The building was later dedicated in honor of Mildred Whiteside Fluetsch, a long-time teacher and principal of the Norco School.

One-Time Anniversary Event
In 2025, the City Clerks' Office will launch a new series at the Historical Collection & Heritage Room at the Community Center (formerly the Norco School) in which the room

Page 350 of 420 ends

will be open to the public for one-day exhibits that highlight different periods of the community's history. This new series, titled "Discover the History," will launch in conjunction with the 100th Anniversary of the Norco School. During the drop-in style exhibit, visitors will be able to meet with Historic Preservation team members and view archived photos, documents, and relics reflecting on the history of the Norco School.

The Norco School has been written about in multiple books, including A Brief History of Norco and From One Room...The 125-Year History of Corona-Norco-Eastvale Schools, therefore the City Clerk's Office will also coordinate a speaker to read historical excerpts about the Norco School.

Event Details:

Date: Saturday, January 11, 2024
 The new series will be scheduled on a Saturday to not interfere with existing rentals on Sundays at the Community Center.

Time: 10 a.m.-12 p.m.
 The event will be drop-in style with a speaker scheduled at 11 a.m.

Location: 3900 Acacia Avenue in Norco
Cost: Parking and admission are free. There is potential to invite a food truck to sell food onsite.

Promotion: Staff will create multimedia content to promote the new series and the onetime event via the City's official communication platforms. Staff does not recommend creating a custom logo or selling merchandise for this anniversary.

FISCAL IMPACT:

This event is not included in the Fiscal Year 2024-25 Operating Budget. Staff recommends a budget appropriation of $1,000 from the General Fund uncommitted fund balance to host the one-time anniversary event. The budget for special departmental related to the Communications Division will be increased by $1,000 in the Fiscal Year 2024-25 Operating Budget.

RELATIONSHIP TO STRATEGIC PLAN:

This agenda item is consistent with Strategic Direction #4 - Communication and Stakeholder Experience: Enhance the stakeholder experience, engage the community, and build brand awareness through proactive, effective and consistent communication.

Acceptance of Bids, Approve Project Plans, and Award Contract for the Parmenter Park Parking Lot Improvement Project
RECOMMENDATION:

Accept bids, approve project plans, and award contract to RG General Engineering Inc. in the amount of $424,386; and authorize the Interim City Manager to approve contract change orders up to 10% of the original contract.

SUMMARY:

The Parmenter Park Parking Lot Improvement Project will address ADA deficiencies and enhance infrastructure by resurfacing the parking lot, installing ADA-compliant walkways, ramps, and handrails, and adding a new drinking fountain and safety features. The project will also include a Filterra system for stormwater management.

Staff recommends awarding the contract to RG General Engineering, Inc., the lowest bidder at $424,386, based on their qualifications and experience. Approval of the project plans and contract award is requested.

BACKGROUND:

The Parmenter Park Parking Lot Improvement Project, located at 2769 Reservoir Drive, Norco, is designed to address accessibility deficiencies identified in the 2021 Certified Access Specialist (CASP) report, which documented non-compliance with the Americans with Disabilities Act (ADA) within the existing parking lot. This project represents a critical step toward fulfilling the City’s commitment to improving public infrastructure and ensuring equitable access to public spaces. By addressing these ADA deficiencies, the project aims to enhance accessibility and promote an inclusive environment that accommodates individuals of all abilities.

In addition to the ADA upgrades, the project will incorporate the installation of a Filterra infiltration system to improve stormwater management. This advanced system is designed to capture and filter rainwater runoff, thereby reducing pollution. The system will also ensure compliance with the National Pollutant Discharge Elimination System (NPDES) requirements, contributing to enhanced water quality and supporting the City’s broader sustainability objectives.

The project encompasses a range of improvements, including resurfacing the parking lot, constructing accessible walkways, and installing ADA-compliant ramps and handrails. Other upgrades will include the installation of a new ADA-compliant drinking fountain, the addition of bollards for safety and traffic control, the reconstruction of the existing monument, the replacement of damaged and uneven asphalt, and the construction of new sidewalks to improve pedestrian access. These improvements will ensure full compliance with ADA standards, enhance safety, and upgrade the park’s overall infrastructure.

Any failure to maintain the required insurance shall be sufficient cause for City to terminate this Contract. No action taken by City hereunder shall in any way relieve Contractor of its responsibilities under this Contract.

The fact that insurance is obtained by Contractor shall not be deemed to release or diminish the liability of Contractor, including, without limitation, liability under the indemnity provisions of this Contract. The duty to indemnify City shall apply to all claims and liability regardless of whether any insurance policies are applicable. The policy limits do not act as a limitation upon the amount of indemnification to be provided by Contractor. Approval or purchase of any insurance contracts or policies shall in no way relieve from liability nor limit the liability of Contractor, its principals, officers, agents, employees, persons under the supervision of Contractor, vendors, suppliers, invitees, consultants, sub-consultants, subcontractors, or anyone employed directly or indirectly by any of them.

In the event of a partial or total destruction by the perils insured against of any or all of the work and/or materials herein provided for at any time prior to the final completion of the Contract and the final acceptance by the City of the work or materials to be performed or supplied thereunder, the Contractor shall promptly reconstruct, repair, replace, or restore all work or materials so destroyed or injured at his/her sole cost and expense. Nothing herein provided for shall in any way excuse the Contractor or his/her insurance company from the obligation of furnishing all the required materials and completing the work in full compliance with the terms of the Contract.

If Contractor should subcontract all or any portion of the services to be performed under this Contract, Contractor shall require each subcontractor to provide insurance protection in favor of City, its officers, officials, employees and agents in accordance

No further payments shall be deemed due or will be made under this Agreement until any replacement bonds required by this section are accepted by the City. To the extent, if any, that the total compensation is increased in accordance with the Agreement, the Contractor shall, upon request of the City, cause the amount of the bonds to be increased accordingly and shall promptly deliver satisfactory evidence of such increase to the City. To the extent available, the bonds shall further provide that no change or alteration of the Agreement (including, without limitation, an increase in the total compensation, as referred to above), extensions of time, or modifications of the

Page 362 of 420 ends

9 time, terms, or conditions of payment to the Contractor, will release the surety. If the Contractor fails to furnish any required bond, the City may terminate this Agreement for cause.

City Council

STAFF REPORT
Date: November 20, 2024 Agenda Item:

5.A.

To: Honorable Mayor and City Council Members
From: Alma Robles, Community Development Director
Prepared By: Alma Robles, Community Development Director Department: Planning
SUBJECT:

Second Read of Ordinance No. 1126: Zone Code Amendment 2024-05 (City of Norco):

A City initiated amendment to Title 18, Chapter 18.13 – A-1 (Agricultural Low-Density) Zone and Chapter 18.68 - Accessory Building Use Permits, to update the requirements for open animal-keeping areas with the approval of an accessory building.

RECOMMENDATION:

Adopt the second reading of Ordinance No. 1126, approving Zone Code Amendment 2024-05.

SUMMARY:

Zone Code Amendment (ZCA) 2024-05 is a result of discussions by both the Planning Commission about the provision for animal-keeping areas to determine if changes/updates (i.e. increase in size) may be warranted. ZCA 2024-05 will commence a program of amendments aimed to improve the provisions and requirements for animal-keeping areas.

BACKGROUND:

The Planning Commission initiated a discussion about the provision for animal-keeping areas to determine if changes/updates (i.e. increase in size) may be warranted. The Planning Commission discussed potential changes on its regular meetings on April 10, 2024, May 8, 2024, and June 12, 2024, where the scope of the changes were narrowed down to two key areas/items. These key items were also discussed with the City Council on August 21, 2024, who concurred with the changes then directed staff to initiate a Zone Code Amendment.

The Planning Commission discussed ZCA 2024-05 on October 9, 2024, and their recommendation is reflected in the discussion below. The changes proposed with this ZCA are as follows:

Page 410 of 420 ends

I. OPEN ANIMAL KEEPING AREA (AKA) SIZE CHANGES
AKA Dimensions: Staff was directed to develop a “sliding scale” to accommodate a minimum dimension of at least 30 feet for AKAs, to make it consistent with the current 30-foot width requirement for Primary Animal Keeping Areas (PAKAs), while minimizing non-conforming situations for smaller lots that are unable to accommodate a 30-footwide AKA.

Norco Municipal Code (NMC) 18.13.20(C) currently requires an AKA to be at least 24 feet wide, regardless of lot size:

C. A contiguous open animal area shall be rectangular in shape with a minimum of 24 feet on any side. The total open area shall be equal to the allowed number of animal units multiplied by 576 square feet. The contiguous open animal areas shall be free of any structures that require a building permit.

On lots one acre or less, the contiguous open area shall be one contiguous area.

ZCA 2024-05 is proposing that the first two sentences of the above code section be replaced with the following table, showing the minimum dimensions on any side that would increase as the lot increases in size. The dimensions would be in addition to the existing five-foot buffer requirement from property line and structure:

Lot Size Min. Open Animal Keeping
Area Dimension
Min. Open Animal
Keeping Area Size
Less than
20,000 sq. ft. 24’ on any side
20,000 but less than 25,000
sq. ft. 30’ on any side
25,000 but less than 30,000
sq. ft. 35’ on any side
30,000 but less than 35,000
sq. ft. 40’ on any side
35,000 but less than 40,000
sq. ft. 45’ on any side
40,000 but less than 45,000
sq. ft. 50’ on any side
45,000 but less than 50,000
sq. ft. 55’ on any side
50,000 but less than 55,000
sq. ft. 60’ on any side
55,000 sq. ft and above 65’ on any side
Total number of AUs x
576 SF
ZCA 2024-05 is also recommending that Chapter 18.68 - "Accessory Building Use Permit" cross reference NMC Chapter 18.13.20(C), for the required AKA and its standards with the approval of an accessory building. The attached ordinance has been drafted to reflect amending NMC Chapter 18.68.20 to state that:

Page 411 of 420 ends

"an open animal keeping area is required per the requirements in NMC Chapter

18.13.20 (C)", in the applicable sections.

The changes above will only be applicable to the AKAs (for when accessory buildings are proposed). At this time, no changes will be applicable to the existing or newly recorded Primary Animal Keeping Arears (PAKAs) created via a property subdivision.

AKA Size: The Planning Commission instructed staff to also investigate the possibility of creating a "sliding scale" to increase not only the dimensional requirements (noted above), but the size of the area as well. However, after discussion, the Planning Commission noted that with the existing provisions (number of allowed animal units x 576 square feet) the size of the the AKA already steadily increases as the size of the lot increases. In other words, the larger the lot, the larger the AKA.

As an alternative option, staff was directed to look at increasing the required size of the AKA from 576 to 806 square feet per animal unit. Following discussion, it was noted that this option would have a greater impact on smaller lots, than it would on larger lots thus creating a disadvantage on smaller lots. Ultimately, the Planning Commission voted 4-1 (Sullivan), to recommend approval of ZCA 2024-05 without change the requirements for size.

II. ALLOWED STRUCTURES IN PAKA and AKAs
ZCA 2024-05 has been drafted to clarify that no non-animal keeping structures are allowed in the AKA by amending the same section noted above [Chapter (NMC)

18.13.20(C)], to add the "sliding scale" table for AKA dimensions" and also include the following statement:
"Structures that are exempt from the requirements of a building permit are allowed in the open animal keeping area, provided they are animal-keepings shelters." (Note: Staff will be addressing the allowances within the PAKA's under a separate Zone Code amendment since it may affect not only sections of the NMC, but residential specific plans as well. Staff is recommending that a recommendation also be formulated with the assistance of the ad-hoc committee if it is ultimately formed).

Planning Commission October 09, 2024: As noted, the Planning Commission voted 4-1 (Sullivan), to recommend approval of ZCA 2024-05. Commission Chair Sullivan had concerns that adequate turn-out areas should be required. To address this issue, the Planning Commission directed staff to agenized a discussion on forming an ad-hoc committee to analyze and recommend the best approach to increase the required animal-keeping area/size (especially to accommodate a turn-out area), in a manner that minimizes discrepancies on smaller versus larger lots.

Conclusion: The full redlined changes to the zoning code are outlined in Exhibit A. The proposed changes are minor at this time, but are a step in the right direction on how the City continues to protect and promote animal-keeping, both today and into the future, protecting Norco's unique lifestyle in perpetuity. The efforts to enhance the animal keeping requirement's for both the PAKAs and AKAs will continue with the assistance of the ad-hoc committee.
