Any deductibles or self-insured retentions must be declared to, and approved by, the City Manager or his/her designee in his/her sole discretion. At the option of the City Manager or his/her designee, either (i) the insurer shall reduce or eliminate such deductibles or self-insured retentions as respects City, its officers, officials, employees and agents; or (ii) Contractor shall provide a financial guarantee, satisfactory to the City Manager or his/her designee in his/her sole discretion, guaranteeing payment of losses and related investigations, claim administration and defense expenses. At no time shall City be responsible for the payment of any deductibles or self-insured retentions.

All policies of insurance required hereunder shall be endorsed to provide that the coverage shall not be cancelled, non-renewed, reduced in coverage or in limits except after 30 calendar day written notice has been given to City. Upon issuance by the insurer, broker, or agent of a notice of cancellation, non-renewal, or reduction in coverage or in limits, Contractor shall furnish City with a new certificate and applicable endorsements for such policy(ies). In the event any policy is due to expire during the work to be performed for City, Contractor shall provide a new certificate, and applicable endorsements, evidencing renewal of such policy not less than 15 calendar days prior to the expiration date of the expiring policy.

The General Liability and Automobile Liability insurance policies shall be written on an occurrence form. The Contractors Pollution Liability insurance policy shall be written on either an occurrence form, or a claims-made form. The General Liability (including ongoing operations and products/completed operations), Automobile Liability and Contractors Pollution Liability insurance policies shall name City, its officers, officials, employees and agents as an additional insured. All such policies of insurance shall be endorsed so Contractor's insurance shall be primary and no contribution shall be required of City, its officers, officials, employees and agents. The Builders Risk (Course of Construction) insurance policy shall be endorsed to name the City as a loss payee. Any Workers' Compensation insurance policy shall contain a waiver of subrogation as to City, its officers, officials, employees and agents. The coverage(s) shall contain no special limitations on the scope of protection afforded to City, its officers, officials, employees and agents.

Should Contractor maintain insurance with broader coverage and/or limits of liability greater than those shown above, City requires and shall be entitled to the broader coverage and/or the higher limits of liability maintained by Contractor. Any available insurance proceeds in excess of the specified minimum limits of insurance and coverage shall be available to City.

Claims-Made Policies - If any coverage required is written on a claims-made coverage form:
(i) The retroactive date must be shown, and must be before the effective date of the Contract or the commencement of work by Contractor.

Page 216 of 262 ends

6 (ii) Insurance must be maintained and evidence of insurance must be provided for at least 5 years after completion of the work or termination of the Contract, whichever first occurs.
(iii) If coverage is canceled or non-renewed, and not replaced with another claims-made policy form with a retroactive date prior to the effective date of the Contract, or work commencement date, Contractor must purchase extended reporting period coverage for a minimum of 5 years after completion of the work or termination of the Contract, whichever first occurs. (iv) A copy of the claims reporting requirements must be submitted to City for review.
(v) These requirements shall survive expiration or termination of the Contract.

Contractor shall furnish City with all certificate(s) and applicable endorsements effecting coverage required hereunder. All certificates and applicable endorsements are to be received and approved by the City's Risk Manager or his/her designee in his/her sole discretion prior to City's execution of the Contract and before work commences. Upon request of City, Contractor shall immediately furnish City with a complete copy of any insurance policy required under this Contract, including all endorsements, with said copy certified by the underwriter to be a true and correct copy of the original policy. This requirement shall survive expiration or termination of this Contract.

If at any time during the life of the Contract or any extension, Contractor or any of its subcontractors fail to maintain any required insurance in full force and effect, all work under this Contract shall be discontinued immediately, and all payments due or that become due to Contractor shall be withheld until notice is received by City that the required insurance has been restored to full force and effect and that the premiums therefore have been paid for a period satisfactory to City. Any failure to maintain the required insurance shall be sufficient cause for City to terminate this Contract. No action taken by City hereunder shall in any way relieve Contractor of its responsibilities under this Contract.

The fact that insurance is obtained by Contractor shall not be deemed to release or diminish the liability of Contractor, including, without limitation, liability under the indemnity provisions of this Contract. The duty to indemnify City shall apply to all claims and liability regardless of whether any insurance policies are applicable. The policy limits do not act as a limitation upon the amount of indemnification to be provided by Contractor. Approval or purchase of any insurance contracts or policies shall in no way relieve from liability nor limit the liability of Contractor, its principals, officers, agents, employees, persons under the supervision of Contractor, vendors, suppliers, invitees, consultants, sub-consultants, subcontractors, or anyone employed directly or indirectly by any of them.

Subject: Construction Phase Engineering Services Proposal for Snipes Park Booster Station Upgrades and
Lake Norconian Flow Control Station Replacement
Dear Mr. Nelson:

We appreciate the opportunity to submit our proposal to provide engineering support services during construction for subject project. We have organized our services into the following components:

Task 1 - Preconstruction Meeting
Task 2 - Respond to Contractor RFIs
Task 3 - Technical Support and Assistance
Task 4 - Materials and Shop Drawing Submittal Review
Task 5 - Startup and Testing
Task 6 - Prepare Record Drawings
Each construction engineering component is described in detail in the following paragraphs:

1. Preconstruction Meeting
If requested by the City, we will attend the preconstruction meeting. The preconstruction meeting will provide the opportunity for complete review of the essential provisions of the Contract Documents by all parties prior to starting work. We will be prepared to respond to questions regarding Contract Document requirements, including special project requirements, sequence of work, scheduling restrictions, equipment installation requirements, and completion dates.

2. Respond to Contractor RFIs
We will respond to requests for information (RFIs) and Requests for Clarification (RFCs) from the Contractor regarding the Contract Documents to ensure that the improvements and related facilities are constructed in compliance with the Contract Documents. We will also prepare clarifications as needed. We will prepare and maintain RFI/Clarification logs for an ongoing record.

For purposes of this proposal, we have assumed that the Contractor will submit up to 15 RFI's, and each RFI response will require 3 hours of an engineer's time and 0.5 hours of support staff time.

Page 225 of 262 ends

Page 2 ends

3. Technical Support and Assistance
Throughout the course of construction, our Design Engineer will respond to inquiries regarding the Contract Documents to ensure that the project is constructed in compliance with the Contract Documents.

We will respond to requests for information (RFIs - see Task 2 above) and Requests for Clarification (RFCs) from the Contractor, City staff, and Inspector regarding the Contract Documents to ensure that the improvements and related facilities are constructed in compliance with the Contract Documents.

In addition, we will coordinate with the WRCWRA Booster Station design team and the City's SCADA Consultant to coordinate the required interface between the Snipes Park SCADA System and the WRCWRA Booster Station SCADA System.

For the purposes of this proposal, we have assumed the Project Engineer and Electrical Inspector will each dedicate 1-1/2 hours per week over the 26-week construction period.

4. Materials and Shop Drawing Submittal Review
We will review Contractor materials and shop drawing submittals (submittals) to ensure compliance with the Contract Documents. We expect submittal documents to be received for all construction materials and equipment.

Once received, submittal documents will be reviewed for completeness and compliance with the Contract Documents. Our review will include preparation of a Submittal Review Comments Sheet, which will inform the contractor whether the submittal is acceptable or not. For submittals that are not acceptable, the Submittal Review Comments Sheet will include detailed instruction to the contractor on what information or revisions are required on the re-submittal to obtain acceptance.

We will provide a digital pdf copy of each submittal and associated Submittal Review Comments Sheet to the City and the Contractor, and retain two copies of same (one for our inspector and one for our files).

We will prepare and maintain a detailed submittal log for an ongoing record of: submittal numbers, dates received and returned, quantities received and returned, descriptions, manufacturers, actions taken, and other comments as necessary. Said submittal log will be available for transmittal to City at any time.

For purposes of this proposal, we have assumed submittal review will require reviewing and approving 50 submittals with an average of 3 hours of review time per submittal (including resubmittals). Clerical hours are based on 0.5 hour per submittal.

5. Startup and Testing
The Contract Documents require the Contractor to provide startup, performance testing, and system validation of all equipment and components. The Contract Documents also require the field services of manufacturer's representatives to perform equipment pre-startup checkouts, certify proper equipment installation, and assist City and Contractor during performance of startup and testing.

During startup, we will provide a construction engineer with electrical, controls, and instrumentation experience to observe and record the Contractor's startup activities. During startup, we will verify that all equipment alarm and status signals are properly transmitted from field instrumentation and equipment control panels to the District's SCADA System (via the existing Pump Station RTU). In addition, we will verify that the flow control station, booster pump, and hydropneumatic tank all operate in accordance with Specification requirements. Upon completion of startup activities, we will provide the City with a remedial work list (punch list) of items requiring correction.

For the purposes of this proposal, 8 hours of time for the project engineer, and 40 hours of electrical inspector time to create pre-startup and start-up checklists, and attend pre-startup, startup, and remedial electrical and startup related inspections.

6. Prepare Record Drawings
Once project construction has been completed, we will provide the City with a complete set of record drawings which will reflect the facilities as constructed. The record drawings will be prepared in AutoCAD format based on information supplied by the City Inspector and the Contractor. Once the record drawings are prepared, copies will be submitted to City for approval.

Once approved, we will provide the Final Record Drawings to the City in electronic PDF format via email, removable flash drive, and/or CD, as requested by the City.

SUBJECT:

Update Part-Time Employee Salary Schedule to Correspond with the State of California Minimum Wage Requirements
RECOMMENDATION:

Adopt Resolution No. 2026-01, to approve an update to Part-Time Employee Salary Schedule to Correspond with State of California Minimum Wage Requirements SUMMARY:

Effective January 1, 2026, the minimum wage in California will be increased to $16.90 per hour for most employees. The current State minimum wage for most employers is $16.50 per hour.

BACKGROUND:

On August 1, 2025, California's Director of Finance certified that the minimum wage will increase to $16.90 per hour for all employers, effective January 1, 2026. This increase is based on a 2.49% increase in the Consumer Price Index (CPI) from July 1, 2024 to June 30, 2025, compared to the same period from July 1, 2023 to June 30, 2024.

The minimum wage increase will also affect the minimum salary for exempt employees, which will increase to $70,304 per year, or $1,352 per week. Exempt employees must be paid a fixed salary that is at least double the state minimum wage for full-time employment. Currently, there is only one employee that is below the new minimum wage. The employee will be placed at a step that meets the new minimum wage requirements. The entire salary schedule will be addressed in the upcoming Salary Resolution for classifications in Mid-Management, Professional, and Confidential Service.

FISCAL IMPACT:

Page 232 of 262 ends

Additional cost for the remaining of the Fiscal Year 2025-26 operating budget for salary and benefits for part-time employees is approximately $16,000. The cost will be covered by salary and benefits savings from applicable department's FY 2025-26 Operating Budgets.

RELATIONSHIP TO STRATEGIC PLAN:

This item is consistent with Strategic Plan Direction No. 2 - Human Capital: Build a sustainable workforce to meet the needs of all stakeholders.

From: Sam Nelson, Public Works Director
Prepared By: Sam Nelson, Public Works Director
Department: Public Works
SUBJECT:

Consideration of an update to the City's resolution establishing restricted parking areas, adding a "No Parking" Restriction on Industrial Avenue
RECOMMENDATION:

Adopt Resolution 2026-02 to add a "No Parking" designation for designated portions of Industrial Avenue.

SUMMARY:

A potential access issue has come to the attention of the City related to vehicle parking on Industrial Avenue impacting commercial truck ingress and egress. The Director of Public Works is recommending that the City Council approve the addition of a "No Parking" restriction along the southerly portion of Industrial Avenue.

BACKGROUND:

The City has received multiple complaints related to parked vehicles narrowing the roadway on at the southerly terminus of Industrial Avenue creating ingress and egress issues for commercial trucks. The Director of Public Works has reviewed the issue and determined that there is a potential access issue present when vehicles park within and adjacent to the bulb area of the roadway.

Chapter 10.06.110, "Posted Parking Zone Established," states "The City Council may from time to time by resolution or ordinance establish parking time limits on various streets in the City." Therefore, the Director of Public Works is recommending that the City Council approve the addition of a "No Parking" restriction in the southerly portion of Industrial Avenue. Staff has updated the parking restriction index and maps to reflect the requested change as shown on the map (page 15 of 19).

FISCAL IMPACT:

Page 237 of 262 ends
