Preliminary Plans (dated 12/12/2024) meet the Standard Conditions for New Development and have been approved considering that the following conditions below be met upon submittal of the landscape construction documents.

Preliminary Plans (dated) have not been approved. Corrections noted below are required before Preliminary Landscape Plan approval.

A RESPONSE SHEET IS REQUIRED WITH RESUBMITTAL OR PLANS WILL BE RETURNED AS INCOMPLETE.

DIGITAL SUBMITTALS MUST BE 10MB OR LESS.

Civil/ Site Plans

1. Mitigation for removed trees shall equal the trunk diameter of heritage trees removed per the Development Code Tree Preservation Policy and Protection Measures, section 6.05.020. A total of 795.5 inches of trunk replacement is required; see below for mitigation options.

2. Show on demo plans and landscape construction plans trees to be preserved, removed or mitigation measures for trees removed, such as:
a. New 15 gallon trees min 1” diameter trunk, in addition to trees required. b. New 24” box trees min 1.5” diameter trunk, in addition to trees required. c. Upsizing trees on the plan one size larger such as 15 gallon to 24” box, or 24” to 36” box size.
d. Monetary value of the trees removed as identified in the “Guide for Plant Appraisal,” approved certified arborist plant appraiser, may be equal to the value of the installation cost of planting, fertilizing, staking, and irrigating 15-gallon trees (100$ each) to the City of Ontario Historic Preservation Fund for city tree planting or city approved combination of the above items.

3. Include improvements to the Cucamonga Flood Control Channel.

4. Before permit issuance, stormwater infiltration devices located in landscape areas shall be reviewed and plans approved by the Landscape Planning Division. Any stormwater devices in parkway areas shall not displace street trees.

5. Stormwater chamber systems shall be designed and configured to allow for required tree locations.

6. Show transformers set back 5’ from paving all sides. Coordinate with landscape plans. Note that if SCE requires bollards (less than 5’ setback from vehicular paving), permanent, decorative bollards will be required; submit cut shets to the Planning Department. 7057

7. Show all backflow devices set back 4’ from paving on all sides. Locate on level grade

8. Locate utilities including light standards, fire hydrants, water, drain, and sewer lines to not conflict with required tree locations—coordinate civil plans with landscape plans.

9. Provide a utility clear space 8’ wide in parkways and 30’ apart for street trees. Move water meters, drain lines, and light standards to the utility minimum spacing and show utility lines at the edges of the parkway, toward the driveway apron, to allow space for street trees.

Landscape Plans

10. Shrub and Ground Cover Palette: Replace Dendromecon and Mimulus are easily overwatered, Isomeris (large and rangy, OK with ample planter areas), Ericameria (invasive), Lavandula (short-lived), Pennisetum/Nassella (invasive) and limit the use of non-invasive ornamental grasses to accent areas (difficult and costly to maintain in masses and poor winter appearance).

11. Show backflow devices with 36” high strappy leaf shrub screening and trash enclosures and transformers, a 4’-5’ high evergreen hedge screening. Do not encircle utility; show as masses and duplicate masses in other locations at regular intervals.

12. Locate light standards, fire hydrants, water, and sewer lines to not conflict with required tree locations. Coordinate civil plans with landscape plans

13. Show all utilities on the landscape plans. Coordinate so utilities are clear of tree locations.

14. Landscape construction plans shall meet the requirements of the Landscape Development Guidelines. See http://www.ontarioca.gov/landscape-planning/standards

15. After a project’s entitlement approval, the applicant shall pay all applicable fees for landscape plan check and inspections at a rate established by resolution of the City Council.

SUBJECT: A CONSOLIDATED PUBLIC HEARING TO CONSIDER ADOPTION OF A RESOLUTION

APPROVING THE DIF NEXUS REPORT UPDATE AND MODIFY DEVELOPMENT

IMPACT FEES

CITY OF ONTARIO
Agenda Report
March 18, 2025
SECTION:

PUBLIC HEARINGS
RECOMMENDATION: That the City Council consider and adopt a Resolution to approve the City's Development Impact Fees (DIF) 2024 Nexus Report Update and modify the DIF fees.

THE FOLLOWING COUNCIL GOALS ARE BEING ACHIEVED:

Invest in the Growth and Evolution of the City's Economy Operate in a Businesslike Manner
Focus Resources in Ontario's Commercial and Residential Neighborhoods Ensure the Development of a Well Planned, Balanced, and Self-Sustaining Community in Ontario Ranch
FISCAL IMPACT: The recommended update of the Development Impact Fees (“DIF”) continues to reflect the City Council's direction that new development pays its fair share of the costs for infrastructure and those costs of new development taking place in the City do not impact existing residents. There is no General Fund impact from adopting the DIF update. The update of the DIF Program is conducted periodically to reflect modifications to specific DIF projects based on changes in projected infrastructure needs, actual costs, revised engineering estimates and updated cost estimates. DIF, assessed on per unit or per square foot basis, is intended to cover the cost of infrastructure improvements needed to support new development. With adoption of the fees as proposed, the City’s DIF Program is estimated to generate sufficient revenue for infrastructure construction/installation over the buildout of the City.

BACKGROUND & ANALYSIS: On July 1, 2003, the City Council adopted Ordinance Nos. 2779 and 2780 to approve Development Impact Fees (DIF) for the City. The DIF has been updated periodically since 2005. Since its inception, the DIF Program has had separate DIF amounts and funds for what has historically been termed the "New Model Colony" (known as Ontario Ranch) and the "Old Model Colony" (known as General City) areas.
7071
The development impact fees were last updated on August 16, 2022, and the Master Facility Plan was last updated on May 16, 2023. In the DIF updates since its inception, there have been only minimal changes in the scopes and estimated costs of DIF Program projects. The most recent update to the DIF Program's methodology was adopted in August 2022.

In support of the revised DIF amounts, Revenue & Cost Specialists, LLC ("Consultant") prepared comprehensive updates to the Development Impact Fee Calculation and Nexus Update Report (the "DIF Nexus Report"). The completed DIF Nexus Report is on file in the Records Management Department. The report includes the cost details of the changes reflected in the update and schedules used in the calculation of the updated DIF amounts. The proposed DIF Nexus Report includes adjustments to the land use database reflected within The Ontario Plan 2050 ("TOP 2050") update. TOP 2050 incorporates changes in land use types and densities which necessitates material revisions to the City's infrastructure (Streets, Storm Drains, Water and Sewer) Master Plans and DIF Program.

The major changes incorporated in the 2024 update include the following:

The cost per acre for land acquisition has been increased from $700,000 to $1,000,000.

The individual 2024 project cost amounts in numerous infrastructure categories have been escalated by application of the change in an applicable cost index.

In the Police, Fire, Streets, Storm Drain, Water, Sewer, and Fiber Optic categories, numerous individual project cost estimates have been adjusted to reflect updated engineering estimates and/or actual costs.

In the Police and Fire categories, Staff is recommending an increase of fees because of the actual cost increase associated with the equipment in these respective categories.

The City continued its practice established in 2022 by applying outstanding (available) developer held "DIF Credits" in each infrastructure category were added as continued costs for projects that have not necessarily been constructed and/or paid for by the City. Numerous DIF projects were financed or constructed by individual developers, and they will ultimately expect repayment for that over-build via the DIF Credits that have been issued by the City.

Pursuant to the City's DIF Program Policies, DIF Credits are available for use at permit issuance to offset (reduce) the fee in the respective infrastructure category for which the DIF Credit was issued. The availability of credits decreases the amount of DIF revenue that the City will ultimately collect. Therefore, any outstanding DIF Credit amount that has been included in this Report's calculations within the DIF calculation methodology, was done to establish the appropriate DIF fee schedule necessary to finance both the remaining infrastructure costs and total developer's DIF Credits at General Plan build-out.

In 2024 the City expanded on this practice by factoring outstanding "DIF Credits" in the calculation of the Local / Regional percentage split across applicable infrastructure categories.

The incorporation of outstanding DIF credits assists the City in recuperating additional DIF in order to eliminate any City subsidy for the long-term development of the Ontario Ranch Area.

Assembly Bill 602 ("AB 602") became effective January 1, 2022. Per AB 602, if a local jurisdiction adopts a calculation and nexus study report after July 1, 2022, it must calculate its DIF imposed on a housing development project proportionately to the square footage of proposed units of the development, unless it makes the following findings: A) an explanation 7072
as to why square footage is not an appropriate metric to calculate fees imposed on housing development projects; B) an explanation that an alternative basis of calculating the fee bears a reasonable relationship between the fee charged and the burden posed by the development; and C) that other policies in the fee structure support smaller developments, or otherwise ensure that smaller developments are not charged disproportionate fees. The proposed DIF Nexus Report attached to this agenda report, and incorporated herein by reference, details supportive justifications for the City to continue to impose residential development impact fees in the same manner that additional development service demands are calculated - that is, on a per unit basis (see DIF Nexus Report - Appendix F). The City will not impose development impact fees for residential development projects based on the square footage of proposed units for completing the City's General Plan. The current and proposed set of fees fosters greater accuracy in planning and provides the City with the required level of certainty in impact fee collection.

The City also added an additional section to the 2024 document identifying an estimated completion date for each DIF Project identified in the Update.

The City is maintaining the methodology established in the 2022 Nexus Study; however, updating the cost of the projects related to the actual costs reported by Developers and the City within the 2024 study. The attached "Exhibit A" of the proposed Resolution specifies the updated DIF amounts for the General City and Ontario Ranch areas as of July 1st, 2025. The attached "Exhibit B" of the proposed Resolution specifies the updated DIF amounts for the General City and Ontario Ranch areas as of July 1st, 2026. The City is practicing a phased approach to its DIF Update No changes are proposed to the DIF Program implementation policies or land use categories definitions as part of this DIF Program update.

Staff notified and worked with the Building Industry Association ("BIA") and NMC Builders, LLC ("NMC") on this recommended update to the DIF and provided both entities with a copy of the proposed fees and the back-up materials. Several meetings were held with representatives of NMC Builders to provide and exchange cost information related to the proposed modifications to the DIF Program. NMC Builders have communicated that they have no further comments on the proposed revisions to the DIF Program and have provided notice to the City indicating that they do not object to adoption of the fees as proposed. Under State law, fee increases cannot become effective any sooner than 60 days after adoption by the legislative body.

Staff recommends the City Council adopt the attached Resolution approving the proposed DIF Nexus Report and increased Development Impact Fees.

RESOLUTION NO. ________

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ONTARIO,

CALIFORNIA, ADOPTING THE DEVELOPMENT IMPACT FEE

CALCULATION AND NEXUS UPDATE REPORT AND ADOPTING AN
UPDATED AND MODIFIED DEVELOPMENT IMPACT FEE SCHEDULE.

WHEREAS, on July 1, 2003, the City Council of the City of Ontario (the "City Council") adopted Ordinance Nos. 2779 and 2780 to implement new and modified Development Impact Fees in recognition of the need to finance adequate infrastructure and other public improvements and facilities made necessary by new development in the City of Ontario ("City"); and
WHEREAS, the City Council previously adopted Resolution No. 2003-039 to establish policies for the implementation of the new and modified Development Impact Fees; Resolution No. 2003-070 to establish additional definitions and policies for the application of Development Impact Fees; and Resolution Nos. 2005-005, 2005-099, 2007-023, 2007-150, 2011-011, 2012-092, 2015-008, 2017-102, 2019-135, and 2022- 133 to update and modify Development Impact Fee amounts; and WHEREAS, the City previously retained Revenue and Costs Specialists LLC to develop development impact fees, supported by nexus findings in the Development Impact Fee Calculation Nexus Report for the City of Ontario, California, dated July 15, 2022 (“2022 Study”); and
WHEREAS, City staff and Revenue and Costs Specialists LLC, have reviewed the Development Impact Fee (“DIF”) program and the infrastructure Master Plans and determined that the findings in the 2022 Study still support the City’s DIF program, but that the 2022 Study requires certain updates to reflect current costs, projections, and plans; and
WHEREAS, accordingly, City staff and Revenue and Cost Specialists LLC produced an update to the DIF program documents, titled “Development Impact Fee Calculation and Nexus Update Report” (the “DIF Update Report”) for the City of Ontario, dated March 18, 2025, on file with the City Clerk and incorporated by this reference, which includes recommendations and support for updated Development Impact Fee amounts; and
WHEREAS, the City has previously adopted an updated DIF Master Facilities Plan on March 16, 2023 via Resolution No. 2023-036 pursuant to section 66016.5(a)(6) of the Act, and such DIF Master Facilities Plan is on file with the Office of the City Clerk and incorporated herein by this reference; and
WHEREAS, the DIF Update Report, together with the DIF Master Facilities Plan, and the 2022 Study, comprise the “DIF Nexus Report” supporting the DIFs; and 7608
WHEREAS, the DIF Nexus Report, referenced above, complies with the Mitigation Fee Act (Government Code, section 66000 et seq.) (the “Act”), specifically, section 66001(a) by establishing the basis for the imposition of fees, and the fee amounts for new development. In particular, the DIF Nexus Report:

1. Identifies the purpose of each development fee;

2. Identifies the use to which the fee will be put;

3. Shows a reasonable relationship between the fee’s use and the type of development project upon which the fee is imposed;

4. Shows a reasonable relationship between the need for the public facility and the type of development project upon which the fee is imposed;

5. Shows a reasonable relationship between the amount of the fee and the costs of the public facility or portion of the public facility that is attributed to the development upon which the fee is imposed; and
WHEREAS, Assembly Bill 602 (“AB 602”) became effective January 1, 2022. Per AB 602, if a local jurisdiction adopts a calculation and nexus study report after July 1, 2022, it must calculate its fees imposed on housing development projects proportionately to the square footage of proposed units of each development, unless it makes the following findings:

1. An explanation as to why square footage is not an appropriate metric to calculate fees imposed on housing development projects;

2. An explanation that an alternative basis of calculating the fee bears a reasonable relationship between the fee charged and the burden posed by the development; and

3. That other policies in the fee structure support smaller developments, or otherwise ensure that smaller developments are not charged disproportionate fees; and
WHEREAS, the proposed DIF Nexus Report details supportive justifications for the City to continue to impose residential development impact fees in the same manner that additional development service demands are calculated – that is, on a per unit basis; and
WHEREAS, prior to adopting the changes to the rates for the City’s DIFs, the City Council must adopt the DIF Nexus Report supporting the increases to the Development Impact Fee amounts and taking other actions to ensure compliance with the Act, including holding a noticed public hearing for the adoption of the DIF Nexus Report; and
7609
WHEREAS, in accordance with the Act and Assembly Bill 602, a copy of the above referenced DIF Nexus Report has been made available for inspection by the public at Ontario City Hall for thirty (30) calendar days prior to the adoption of this Resolution; and
WHEREAS, notice of a consolidated public hearing to consider the adoption of the DIF Nexus Report and the increases to the Development Impact Fees was published in the newspaper and mailed to all interested parties that have submitted written requests for such written notice, as applicable, in compliance with the Act; and WHEREAS, on March 18, 2025, the City Council held a noticed consolidated public hearing at which it heard and considered any and all verbal and/or written testimony from the public, reviewed and considered the information including the DIF Nexus Report, the increases to the Development Impact Fees, all supporting data, and information provided at the public hearing by staff, and has now determined to adopt the DIF Nexus Report and increases to the Development Impact Fees; and WHEREAS, the previously-adopted Ordinance No. 2779 stated that “The Fee Schedule may be amended from time to time by resolution of the City Council, in compliance with the Mitigation Fee Act, Government Code Section 66000, et seq.”

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ONTARIO:

SECTION 1. The above recitals are true and correct and are incorporated herein by this reference.

SECTION 2. The City Council has been presented with and has reviewed the information related to the DIF Nexus Report, including all supporting data and after being so informed hereby adopts the DIF Nexus Report and supporting data.

SECTION 3. Pursuant to Government Code § 66016.5(a)(5)(B) and in satisfaction of AB 602, the City Council hereby adopts the findings and conclusions set forth in Appendix “F” of the DIF Nexus Report and incorporates them herein by reference.

SECTION 4. The DIF amounts contained in “Exhibit A” and “Exhibit B” are hereby adopted. This Resolution, and the DIF amounts adopted herein, shall supersede any other action of the City Council only to the extent of any conflict.

SECTION 5. This Resolution, including the updated fee amounts contained in “Exhibit A” and “Exhibit B” attached hereto and incorporated herein, shall be effective for all new development projects occurring in the City, when applicable, sixty (60) days following its adoption.

SECTION 6. If any provision of this Resolution or the application thereof to any person or circumstance is held invalid, such invalidity shall not affect other 7610
provisions or applications, and to this end the provisions of this Resolution are declared to be severable.

The City Clerk of the City of Ontario shall certify as to the adoption of this Resolution.

Regarding: City of Ontario Master Plan and Development Impact Fee Program 2025 Update
Dear Mr. Ochoa:

The purpose of this letter is to express our support for the City’s updated Development Impact Fee (DIF) programs as proposed by City Staff.

We have spent a significant amount of time evaluating the updated fees and have worked in cooperation with the City staff to gain an understanding of the components and justifications for the increased fees. We do appreciate the City’s transparence and collaboration we experienced throughout this process.

While any increase in fees negatively impacts our property values, we understand that a certain level of fees is necessary to support the improvements and related program costs that the City of Ontario is planning and that our future residents will enjoy. After evaluation, we have concluded that the fee increases are reasonable and we support the updated DIF fee schedule as proposed. Given the significant increase in the program costs and fees, we also appreciate the City’s phasing in of the fees 50% per the effective date of the ordinance and the remaining 50% one year later.

Please feel free to contact me at (714) 637-4405 x107 with any questions or concerns you may have.

Sincerely,
Richard Cisakowski
