Staff Report
Agenda Item: F.10
Date: May 17, 2022
Department: Administration
AGENDA TITLE: Resolution Declaring Juneteenth, June 19th, as a City Holiday RECOMMENDATION:

Adopt a Resolution Establishing Juneteenth or June 19th a Public Holiday for the City of Orinda.

BACKGROUND: In June 2021, President Joe Biden signed legislation that established Juneteenth as a federal holiday after a measure doing so made it through Congress.

Juneteenth, which is observed on June 19th, became the first new federal holiday since the addition of Martin Luther King Jr. Day in 1983. Since that time many States and neighboring cities have added Juneteenth as an additional holiday.

DISCUSSION:

Juneteenth essentially celebrates the Emancipation Proclamation, which ended slavery.

Specifically, it commemorates when Union Gen. Gordon Granger arrived in Galveston, Texas, to announce to enslaved African-Americans they were free and the Civil War ended. President Lincoln announced the Emancipation Proclamation 2½ years earlier, but it didn't take effect as the Civil War raged on.

In California, AB 1655 was introduced in January of this year in the State Legislature to add Juneteenth as a public holiday for State employees and that bill is working its way through the legislature in this session after having passed out of two Assembly committees and is now set for a hearing later this month in the Appropriations Committee.

In many cities, holidays are primarily established through agreements with employee bargaining groups and often are just referred to by reference as the same as Federal and/or State holidays without being specifically listed, as such the establishment of a new Federal holiday resulted in an additional holiday last year for many. In Orinda, the observed holidays are specifically enumerated in the Memorandum of Understanding with our Teamster bargaining group and the Unrepresented Employee Manual as follows:

Independence Day
Labor Day
Veterans Day
Thanksgiving Day
Day after Thanksgiving
Christmas Eve – half day
F.10
Packet Pg. 181
Christmas Day
New Year’s Day
Martin Luther King, Jr.’s Birthday
Presidents’ Day
Memorial Day
Should the City Council approve the recommended action, the employee agreements will be updated in the next negotiations cycle which is underway now. Like most holidays, if the actual holiday were to fall on a Saturday or Sunday it would be observed on the Friday before for a Saturday holiday or the Monday after for a Sunday holiday.

Orinda is a community which values diversity and as part of the greater Bay Area, which is one of the most diverse regions in the country, it is appropriate to join others in the region in observing Juneteenth as a holiday.

NEXT STEPS: Upon adoption of the resolution the City would commence observing Juneteenth as a holiday and City offices would be closed. In 2022, June 19th is a Sunday, so the holiday would be observed on Monday, June 20th.

FISCAL IMPACT: There is an indirect cost through the loss of staff time by providing an additional paid holiday as this would represent 4/10ths of a percent of regular work hours for each employee with an estimated value of $18,238.

AGENDA TITLE: Camino Pablo and City Wide Speed Surveys
RECOMMENDATION:

Adopt Resolution 21-22 Traffic Order #215 lowering the existing speed limit on Camino Pablo between Camino Sobrante and Santa Maria Way and accept attached Speed Surveys re-establishing existing speed limits throughout the City.

BACKGROUND: Engineering and Traffic Surveys (ETS) are required by the California Vehicle Code (CVC) Sections 22357 and 22358 to determine legal speed limits on certain local streets. The City completes ETS periodically in accordance with CVC section 40802 and Section 627, and as recommended by the California Department of Transportation Manual on Uniform Traffic Control Devices (CA-MUTCD).

In the past, ETS are not brought to City Council unless speed limits are altered from the established limits which require a traffic order.

DISCUSSION: Staff requested Advanced Mobility Group (AMG) to conduct ETS on 11 street segments in the City of Orinda as shown in Attachment A to reestablish speed limits. The ETS for 10 of the segments recommend keeping the existing speed limit.

The ETS for the Camino Pablo segment from Camino Sobrante to Santa Maria Way is recommended to decrease the existing speed limit from 45 MPH down to 40 MPH. The table below summarizes the findings for Critical Speeds and the recommended change in speed limits on Camino Pablo.

This is a two-lane roadway with no on-street parking nor sidewalks.

Comments:

Pursuant to CVC Section 21400 (b), and pursuant to Section 2B.13, Subsection 12a (Option 1) of the California MUTCD 2014, it is recommended that the speed limit be reduced by 5 mph from the nearest 5 mph increment of the 85th-percentile. The 85th percentile speed is 36 mph. It is recommended that the speed limit be established at 30 mph. The reason for reduction of additional 5 mph is that this area is a residential area with no adequate walkway for pedestrians. Also, there Ave been crash experience in this area.

This survey conforms to Section 627 and 22358.5 of the California Vehicle Code and Section 2B.13 of the California MUTCD 2014 and recommends a speed limit appropriate to facilitate the safe and orderly movement of traffic.

Factors
Roadway Geometrics:

Roadside Development:

This area is generally residential with many driveways along Ivy Drive. These driveways can cause through traffic to suddenly slow or stop when being accessed.

This is a two-lane undivided roadway with on-street parking. Class I bicycle path exists on both sides of the street. Pedestrian walkway exists on some portions of Ivy Dr.

The 85th percentile speed is 32 mph. It is recommended that the speed limit be maintained at 25 mph. The reason for reduction of additional 5 mph is that this area is a residential area with no adequate walkway for pedestrians. Also, there have been crash experience in this area.

This survey conforms to Section 627 and 22358.5 of the California Vehicle Code and Section 2B.13 of the California MUTCD 2014 and recommends a speed limit appropriate to facilitate the safe and orderly movement of traffic.

I hear by attest that the foregoing is a true and correct copy of the original document on file at the Public Works Department of the City of Orinda.

Roadway Geometrics:

Roadside Development:

This area is generally residential with many driveways along Tara Road. These driveways can cause through traffic to suddenly slow or stop when being accessed.

This is a two-lane undivided roadway with no on-street parking. No bicycle path and pedestrian walkway exist on both sides of the street.

Comments:

Pursuant to CVC Section 21400 (b), and pursuant to Section 2B.13, Subsection 12a (Option 1) of the California MUTCD 2014, it is recommended that the speed limit be reduced by 5 mph from the nearest 5 mph increment of the 85th-percentile, 30 mph. It is recommended that the speed limit be maintained at 25 mph. The road is curvy in some portions and decreases the sight distance. Also, this is a residential area with pedestrians activities but there are no walkways to use.

This survey conforms to Section 627 and 22358.5 of the California Vehicle Code and Section 2B.13 of the California MUTCD 2014 and recommendes a speed limit appropriate to faciliate the safe and orderly movement of traffic.

Public Works and

AGENDA TITLE: Temporary Full Road Closure of St. Stephens Drive Overcrossing for Caltrans Seismic Retrofit Project
RECOMMENDATION:

Staff recommends the City Council receive presentation from Caltrans about their upcoming Seismic Retrofit Project of the St. Stephens Drive Overcrossing and provide feedback. No action is required at this time.

BACKGROUND:

The California Department of Transportation (Caltrans) has been coordinating with the City since August, 2021 about its St. Stephens Drive Overcrossing Seismic Retrofit Project. Although most of the work is anticipated to be performed on the bridge columns and abutments located on the freeway, Caltrans is also planning to replace the bridge approach slabs and replace the asphalt concrete surfacing on the bridge with polyester concrete overlay.

The project is currently in final design phase and the construction work is anticipated to start in Spring 2023 and end in Summer of 2024.

DISCUSSION:

Caltrans has determined that due to the narrow roadway width and the complexity of work involved, it is necessary to fully close St. Stephens Drive overcrossing during active construction work for the safety of the workers and the travelling public.

Construction work on the bridge is anticipated for two consecutive weekends circa Summer 2023 (to be determined).

Working with City Staff and the Moraga Orinda Fire District (MOFD), Caltrans is proposing the following road closure option:
 Road fully closed for all traffic except emergency vehicles: Between the hours of 10:00 P.M. to 5:00 A.M. on Friday, Saturday and Sunday.  Road fully closed for vehicular traffic but open to bicycles, pedestrians and emergency vehicles: Between the hours of 5:00 A.M. to 10:00 P.M. on Saturday and Sunday.

The project will improve the bridge’s structural capacity in addition to improving the ride quality and pedestrian safety and access.

H.1
Packet Pg. 219
NEXT STEPS:

Caltrans will incorporate feedback received from the Council to their approach and submit a request for road closure prior to start of construction, at which time a Resolution/Traffic Order will be submitted for Council consideration and approval.

FISCAL IMPACT:

There will be minimal costs related to City Staff time. Staff will continue to coordinate with Caltrans staff, review traffic control plans, and provide inspection oversight during the road closure.

4 Traffic Impact
Why a weekend closure?
• Peak vehicle demands are anticipated to
be on weekdays during daytime.
• All lanes will be open for traffic on
weekdays thereby eliminating peak
volume traffic impacts.
• Less overall impact to local traffic.
• Construction schedule acceleration by
reducing the overall number of work
shifts required to do this scope of work.
• Less overall night shifts so less nighttime
noise impacts to the local residences.
• Improved worker and public safety.

AGENDA TITLE: City Council Meeting Calendar for Remainder of 2022 RECOMMENDATION:

Review, discuss, and adopt revised City Council Meeting Calendar for remainder of 2022
BACKGROUND:

The City Council adopted their 2022 Meeting Calendar at their meeting on June 15, 2021.

DISCUSSION:

It is recommended that the City Council consider changes to the City Council Meeting Calendar for the remainder of the year as follows:

As is customary, City officials have received an invitation from Orinda’s Sister City in Tabor to participate in the Tabor Meetings in the Czech Republic in September. The timing conflicts with the regular City Council Meeting of September 20th. Since Mayor Fay is planning to attend (at his own expense), staff is recommending cancelation of September 20th meeting and rescheduling that meeting to September 27th.

In addition, the County is required to give the City election results within 30 days from the election which will be held on November 8, 2022 this year. Since we may not receive those results until December 8th, staff is recommending scheduling a City Council Meeting on December 13th. That would be the meeting where the City Council adopts the election results and Councilmembers are sworn into office. Staff will know closer to that date if there is a need for a December 6th meeting, but advises leaving it on the calendar for now.
