That the City Council approve and authorize the execution of the First Amendment to Trade Services Agreement No. A8171 with Garcia’s Landscaping Maintenance, Inc. to increase the not to exceed amount from $3,120,435 to $4,300,607 and to extend the term from November 5, 2022 to November 5, 2023 for the performance of Landscape and Ballfield Maintenance in Riverpark CFD 5.

BACKGROUND
The Riverpark Community Facilities District (CFD 5) contains landscape improvements that add value and enhance the aesthetic qualities of the District. All parcels within CFD 5 are assessed for the annual cost of maintenance within the District.

On November 6, 2019, the City and Garcia’s Landscape Maintenance, Inc. (Garcia’s) entered into the current Agreement for the landscape and ballfield maintenance in CFD 5. The Agreement contains the option to extend the term up to two years. Staff is recommending that the Agreement is extended for only one year to allow staff time to rescope a new agreement that accounts for the impacts of prolonged drought conditions and incorporates new language as recommended by the City’s legal counsel. The one year extension will also provide staff with time to prepare the next fiscal year budget that will include increases for landscape services, if necessary.

DISCUSSION
Due to cost increases over the last three years for labor, fuel, irrigation parts, and other landscaping supplies, it was deemed likely by staff that bidding a new agreement could result in a substantial increase in cost to CFD 5. Garcia’s has been responsive to the requirements of the Agreement, as well as being responsive to specific issues brought up by the residents. It should be noted that there were five incidents within the past year that services fell short of the standards as defined in the Agreement. Garcia’s was monetarily penalized, in accordance with the terms of the Agreement, and staff believes that these issues were a result of labor shortages and had no long term implications.

Staff finds that the landscape in CFD 5 is in good condition and Garcia’s has been proactive in replacing plants that have died while under their care. However, with the ongoing drought and the amount of turf in CFD 5, staff anticipates that this contract will need to be amended again once the drought restrictions have ended. There is currently enough flexibility 823
within the language of this Agreement to ensure that Garcia’s crews are able to shift resources to services that are most needed. With this flexibility and the expected increase in cost, staff believes that extending this Agreement offers the residents of CFD 5 the most cost effective option for this fiscal year.

This Amendment extends the term for one more year ending on November 5, 2023. It also increases the annual cost by up to an additional $108,160 for weekend opening, inspecting, and closing of the restrooms. This amount also covers on-call services for trash removal and cleaning of the park reservation areas, both prior to and after each reservation. Since the number of reservations that will occur in CFD 5 are unknown, the maximum number of reservations possible was considered in order to calculate the additional not to exceed contract amount. City Corps has been providing these weekend services and for FY 2021-22 the cost was $6,680. However, City Corps is experiencing staffing issues and staff recommends that these services be provided by Garcia’s. When City Corps staff becomes available again, these services will no longer be performed by Garcia’s. These services were included in the original 2019 bid from Garcia’s, so no addition to the scope of services is required.

The purpose of the Infrastructure and Natural Resources strategy is to preserve and improve our roads, utilities, parks, trees, water supply and natural resources through effective planning, prioritization, and an equitable and efficient use of available funding.

The original not to exceed amount of this Agreement with Garcia’s was $3,120,435. The Amendment, as recommended by staff, will increase the total not to exceed amount to $4,300,607. This includes the 2% annual increase, as stipulated in the terms of the Agreement, with the additional not to exceed costs for weekend servicing of the restrooms, trash cans, and park bbq reservation areas.

There are sufficient funds available in the adopted CFD 5 FY 2022-23 budget (Fund# 120-60503801) for the anticipated current fiscal year expenditures. Funding for the subsequent fiscal year will be requested in the FY 2023-24 recommended budget.

BACKGROUND
At the September 20, 2022 City Council meeting, staff was requested to provide an update on two specific intersections as noted below in items #1 and #2. In addition, staff will also be providing updates on other intersections and related Capital Improvement Program (CIP) projects, noted in items #3, #4, and #5 below.

The Public Works Department is providing an update on the following traffic signal improvement projects:

1. Ventura Road and Doris Avenue (Grant funded, part of a 10-signals upgrade)

2. Ventura Road and 2nd Street/Teal Club Road (City funded)

3. 7-Signals and 5-Signals Upgrade Projects (Grant funded)

4. Citywide Traffic Signal Timing Project (ARPA funded)

5. Modernization of Traffic Signal System (City and grant funded) This report has been pre-recorded so that it is compliant with Measure M.

That the City Council adopt a resolution:

1. Authorizing the City Manager to submit a grant application for an amount not to exceed $9,450,000 in 2022 Urban Community Drought Relief Grant Program funds to be used for Education, Outreach, Direct Installation Programs, Rebate Programs, and Other Activities to Increase Water Conservations and Large-Scale Turf Replacement Projects (matching requirement of up to $2,400,000); and

2. Authorizing the City Manager or designee to execute grant agreements; the Finance Director or designee to submit financial reports and grant claims; and the Director of Public Works or designee to submit non-financial reports. (This item did not originate in Committee.)

BACKGROUND
In August 2022, the California Department of Water Resources (“DWR”) issued draft guidelines and proposal solicitation package for the 2022 Urban Community Drought Relief Grant Program (“Program”), allocating $545 million to DWR to award grants for drought relief, turf replacement, conservation for urban supplies, and project administration.

Public agencies are eligible applicants under the Program. There is a minimum award amount of $3 million per award, with a 25% match requirement. Smaller projects may be bundled together in a single application to meet the minimum grant award requirement. DWR began accepting applications on October 10, 2022, and will begin announcing grant awards in phases in December 2022 and March 2023. The deadline to submit applications for this grant is January 31, 2023.

Projects must be completed by December 31, 2026, including all reporting and retention, to allow time for final invoice processing and retention payment before the funds expire on June 30, 2027. Project/grant administration should end at least three months after construction.

DWR especially encourages projects providing direct install programs and large scale turf replacement for schools, community centers, government centers to Underrepresented Communities and Tribes. City staff recommend prioritizing projects that match the most competitive projects to the specific grant opportunities described below.

DISCUSSION
To maximize staffing availability and ensure realistic delivery of projects based upon staffing levels and existing project 937
workload, the following eligible projects are recommended:

Education, Outreach, Direct Installation Programs, Rebate Programs, and Other Activities to Increase Water Conservations
Residential Water Use Efficiency Survey and Retrofit Program With California’s current drought status there are many actions directed at customers on ways they should save water which has led to information overload, and sometimes the information is confusing. Many customers have an interest in being water efficient, they just don’t know how or where to begin.

The City’s Water Division would like to offer a Residential Water Use Survey and Retrofit Program to single family residential water customers within Oxnard’s service area. The survey would customize the recommendations to each individual customer and allow person-to-person discussion of each recommendation.

The survey would be conducted by a third party and consist of:
 Teaching the customer how to read their water utility bill and meter  Checking for leaks and recommending repairs
 Checking showerhead and faucet flow rates
 Checking toilet flush volumes
 Inspecting irrigation systems and recommending improvements  Providing and installing free high-efficiency fixtures and devices if warranted The direct installation of indoor and outdoor high-efficiency devices would include: shower heads, faucet aerators, low precipitation rate irrigation nozzles, rain shut off sensors, and weather-based irrigation controllers (WBICs). By including the direct installation of these devices, the City will take advantage of the interest the customer has in being water efficient and guarantee a greater amount of actual water savings than would be obtained with a separate rebate program.

Single family residential water use makes up on average 35% of the City’s total annual water use. According to the United States Environmental Protection Agency (EPA) the average household's leaks can account for nearly 10,000 gallons of water wasted every year.

Addressing inefficiencies found throughout single family residential properties aims to not only save a significant amount of water, but to help foster the message that water conservation is an important and necessary component to increase water supply reliability.

The Water Division’s goal would be to administer a total of 900 surveys. Based on this, staff is requesting $450,000 in grant funding with a match of $150,000, from the Water fund, for a total grant request of $600,000 for the Residential Water Use Efficiency Survey and Retrofit Program.

Large-Scale Turf Replacement Projects
Projects under this category are designated for replacing traditional turf with lower water use materials, with DWR especially encouraging Projects providing turf replacement.

The Special Districts Division manages 47 special assessment districts (“Districts”) throughout the City of Oxnard, each with their own funding sources, levels of service, Fund Balances, and ongoing and future maintenance projects. Staff are evaluating non-functional turf areas throughout each of the Districts and are proposing to utilize this grant for removal of these non-functional turf areas.

Initial evaluation indicates there may be anywhere between 1,000,000 to 2,000,000 square feet (“SqFt”) of non-functional turf throughout Special Districts that may be ideally suited for this Program. Based on this initial evaluation, staff are requesting $9,000,000 in grant funding with a match of $2,250,000 for a total grant request of $11,250,000 for LargeScale Turf Replacement Projects. 938
If awarded this grant, staff will:
 Conduct outreach to and have conversations with each Special District  Continue to evaluate appropriate areas for consideration of turf removal, including parkways and other nonfunctional turf areas  Incorporate existing and future City of Oxnard Landscape Standards into the evaluation of this Program  Evaluate maintenance agreements to determine appropriate levels of service and any cost-saving measures  Analyze historical water usage and forecast any future potential savings  Evaluation of costs for turf removal, irrigation evaluation and repair, design, and installation  Analyze Fund Balance contributions, by District, for the required 25% match  Evaluate any potential funding shortfalls and possible solutions It is important to note that because of the date of notice of this grant and the quick turnaround for grant applications, the Special Districts Division has not conducted outreach to each District yet regarding this Program. Some Districts may not want to participate in the Program and some Districts may not be able to participate due to internal funding availability.

Staff will begin the outreach process in October 2022 in anticipation of applying for this Program. Should the City be awarded grant funds for the turf replacement projects, the City Manager is committed to recommend to the City Council the use of General Fund money for the 25% match for Districts that may not have the available fund balance to proceed, where appropriate.

Successful grant projects are not expected to begin incurring charges until FY 2023-24. The table below provides the maximum grant amounts. Total project costs may not reach the maximum amounts.

Specific Financial Impact to the Large-Scale Turf Replacement Projects The Special Districts Division is working to identify the grant match funding source. Initial evaluation indicates seven (7) Districts are likely unable to financially meet the required 25% match at this time due to insufficient Fund Balances with District funds. These Districts are: LMD-11 (St. Tropaz), LMD-14 (California Cove), LMD-23 (Greystone), LMD31 (Rancho De La Rosa), LMD-49 (Cameron Ranch), MAD-4 (Mandalay Beach/Beach Maintenance), and Waterways Assessment District - Zone 2 (Harbour Island).

Authorizing the City Manager to submit a grant application for an amount not to exceed $9,450,000 in 2022 Urban Community Drought Relief Grant Program funds to be used for Education, Outreach, Direct Installation Programs, Rebate Programs, and Other Activities to Increase Water Conservations and Large-Scale Turf Replacement Projects (matching requirement of up to $2,400,000); and

2. Authorizing the City Manager or designee to execute grant agreements; the Finance Director or designee to submit financial reports and grant claims and approve budget appropriations for the use of grant funds; and the Director of Public Works or designee to submit non-financial reports.

RECOMMENDATION

• In August 2022, the California Department of Water Resources (“DWR”) issued draft guidelines and proposal solicitation package for the 2022 Urban Community Drought Relief Grant Program (“Program”), allocating $545 million to DWR to award grants for drought relief, turf replacement, conservation for urban supplies, and project administration.
• Public agencies are eligible applicants under the Program. • There is a minimum award amount of $3 million per award, with a 25% match requirement.
• Smaller projects may be bundled together in a single application to meet the minimum grant award requirement.

BACKGROUND

• DWR began accepting applications on October 10, 2022 and will begin announcing grant awards in phases in December 2022 and March 2023.
• The deadline to apply for this grant is January 31, 2023. • Projects must be complete by December 31, 2026 including all reporting and retention, to allow time for final invoice processing and retention payment before the funds expire on June 30, 2027.

Project/grant administration should end at least three months after construction.
• DWR especially encourages projects providing direct install programs and large scale turf replacement for schools, community centers, government centers to Underrepresented Communities and Tribes.

• Under this category of the Program, the Water Division is proposing to administer a Residential Water Use Efficiency and Retrofit Program.
• With California’s current drought status, there are many actions directed at customers to save water, which has led to information overload and sometimes conflicting and confusing information. • Many customers have an interest in being water efficient, they just don’t know how or where to begin.

• Single family residential water use makes up on average 35% of the City’s total annual water use.
• According to the United States Environmental Protection Agency (EPA) the average household's leaks can account for nearly 10,000 gallons of water wasted every year.
• Survey’s coupled with the direct install of water efficient devices not only saves water, but fosters the message that water conservation is an important and necessary component to increase water supply reliability.

• Projects under this category are designated for replacing traditional turf with lower water use materials, with DWR especially encouraging Projects providing turf replacement.
• The Special Districts Division manages 47 special assessment districts (“Districts”) throughout the City of Oxnard, each with their own funding sources, levels of service, Fund Balances, and ongoing and future maintenance projects.
• Staff are evaluating non-functional turf areas throughout each of the Districts and are proposing to utilize this grant for removal of these non-functional turf areas.

• Initial evaluation indicates there may be anywhere between 1,000,000 to 2,000,000 square feet (“SqFt”) of non-functional turf throughout Special Districts that may be ideally suited for this Program.
• Based on this initial evaluation, staff are requesting $9,000,000 in grant funding with a match of $2,250,000 for a total grant request of $11,250,000 for Large-Scale Turf Replacement Projects.

• Conduct outreach to and have conversations with each Special District
• Continue to evaluate appropriate areas for consideration of turf removal, including parkways, detention basins, and other non-functional turf areas

• Evaluate maintenance agreements to determine appropriate levels of service and any cost-saving measures

• It is important to note that because of the date of notice of this grant and the quick turnaround for grant applications, the Special Districts Division has not conducted outreach to each District yet regarding this Program.
• Some Districts may not want to participate in the Program and some Districts may not be able to participate due to internal funding availability.
• Staff will begin the outreach process in October 2022 in anticipation of applying for this Program.

• There is no direct financial impact for this recommendation action. • Upon notification of successful award(s), City staff will return to Council to recognize and appropriate grant awards and identify required local fund amounts and sources.
• Successful grant projects are not expected to begin incurring charges until FY 2023-24.
• The table on the next slide provides the maximum grant amounts and total project costs may not reach the maximum amounts.

FINANCIAL IMPACT

• Special Districts Division is working to identify the grant match funding source. Initial evaluation indicates seven (7) Districts are unable to financially meet the required 25% match at this time due to insufficient Fund Balances. These Districts are:

LMD-23 (Greystone), LMD-31 (Rancho De La Rosa)
LMD-49 (Cameron Ranch), MAD-4 (Mandalay Beach/Beach Maint.) Waterways Assessment District - Zone 2 (Harbour Island) • Should the City be awarded grant funds for the turf replacement projects, the City Manager is committed to recommend to the City Council the use of General Fund money for the 25% match for Districts that may not have the available fund balance to proceed, where appropriate
