DISCUSSION
As of January 2026, the OWTP Reliability Project is 85 percent complete, with anticipated completion in October 2027.

Project challenges have included existing electrical infrastructure, existing SCADA, and coordination with Southern California Edison. The original duration of the Agreement A-8281 was three years. Construction commenced in Fall 2022. The first amendment extended the term to March 31, 2026. However, the recent and extended coordination with Southern California Edison, the additional work required to address design-related issues with the existing electrical infrastructure and SCADA has pushed the project completion out to 2027. Continued construction management and inspection services are required to assist the City in completing the OWTP Reliability Project. This amendment for an additional $1,189,349 continues the daily services Kennedy Jenks provides, including but not limited to:
• Construction contract administration, contractor and design engineer coordination and correspondence, safety and security monitoring, environmental monitoring, contract controls and scheduling, cost estimating, pay application processing, document control (RFI’s, submittals, etc. through Procore), review of record drawings, providing technical support as necessary, assistance with operations and maintenance manuals, change orders, and claims management.
997
• Construction inspection services (civil, structural, mechanical, electrical, and instrumentation), including preparation of daily construction reports, photo documentation, ensuring contractor compliance with safety and contract documents, SWPPP inspection, pressure testing, disinfection testing, confirmation of payment requests, development of punch lists, and review of as-builts.

The current and planned City staff workload, combined with the complexity of this project, is such that continued contracted resources are recommended in order to properly manage the construction phase of this project. All City project managers currently have full workloads, and their available time resources would likely be insufficient to take over managing the construction of this project at the level of attention it requires. Additionally, temporary (i.e., military leave) and longer-term (i.e., recent resignation) vacancies of in-house construction project manager positions and Civil Engineers are impacting the team’s workload.

STRATEGIC PRIORITIES
This agenda item supports the Infrastructure and Natural Resources strategy. The purpose of the Infrastructure and Natural Resources strategy is to preserve and improve our roads, utilities, parks, trees, water supply and natural resources through effective planning, prioritization, and an equitable and efficient use of available funding.

FINANCIAL IMPACT
The fiscal impact section details a reallocation of funds, with many moving parts, across multiple projects to ensure continued compliance with State Revolving Fund (SRF) requirements, fulfillment of existing contractual obligations, and the accommodation of new funding requests.

In December 2025, the City Council approved a funding realignment to comply with State Revolving Fund (SRF) requirements. This action involved transferring $13.95M in overallocated SRF Fund (617) resources from the OWTP Reliability Project (C2201) and the Gravity Main Improvements Project (C2309) to the Primary Clarifiers & Activated Sludge Tank Project (C1814). This shift ensured that the $88.6M SRF allocation was correctly distributed among SRFeligible projects as designated in state documentation. Subsequent to the December 2025 City Council action, it was the intent to backfill this shift of SRF funds with other Wastewater funding, and this staff report provides the outline for that process.

To maintain project momentum for project C2201 and support ongoing professional construction management, engineering services, and construction costs, staff recommends (1) backfilling the previously reallocated SRF funding with Wastewater Operating Funds (611) and (2) adding additional funding to project C2201 to account for the increase in construction management services. This total of $6.7M comprises ~$5.6M to “backfill” and restore the project’s funding capacity previously approved by the City Council in December 2025 and ~$1.2M in additional funding for construction management services through completion. These resources will be drawn from the Wastewater Operating Fund (611).
• Budget Appropriation Transfer: A transfer of $1.5M within the Wastewater Operating Fund (611) from Wastewater OWTP: Effluent Pump Station Improvements Project (C2235) to OWTP Reliability Project (C2201).

There are sufficient project appropriations totaling $4.8M available for transfer from the Wastewater OWTP:

Effluent Pump Station Improvements Project (C2235). Project C2235 will be in the design phase for the next one and one-half years and does not require the total allocation until the construction phase. • Project Budget Appropriation: An appropriation of $5.2M to the Wastewater Capital Fund (612), funded from the Wastewater Operating Fund (611), for Project C2201.

The Second Amendment to Agreement A-8281 with Kennedy Jenks Consultants, Inc. increases the contract authority by an amount not to exceed $1,189,349, resulting in a total revised contract amount of $5,703,885. 998

Currently, based on the Contractor’s October Schedule update, the project is anticipated to be complete in November 2026, with the civil/mechanical work being complete in May 2026. We anticipate both those projects to be pushed at least a month and have included in this amendment completion of the civil/mech work by the end of June 2026 and the remaining work by the end of December 2026. Our scope of services are as follows:

SCOPE OF SERVICE
TASK 1: Project Management

BACKGROUND
The City of Oxnard owns and operates a Water Resource Recovery Facility (WRRF) located at 6001 Perkins Road in Oxnard, California. The facility is a conventional secondary treatment, activated sludge plant, with a design capacity of

31.7 million gallons per day (MGD). The liquid stream processes at the WRRF include screening, grit removal and pumping, primary clarification, interstage pumping, trickling filters, activated sludge treatment, secondary settling, flow 1038
equalization, disinfection, and effluent pumping.

The 2017 Public Works Integrated Master Plan identified the rehabilitation and upgrade of the primary clarifiers and activated sludge process as a high priority. The primary clarifiers were converted from dissolved air floatation tanks in 1975; the mechanical equipment has long exceeded the intended useful life of 25-30 years. The activated sludge tanks were constructed in 1990 and the mechanical equipment has exceeded the intended useful life of 25-30. Additionally, the diffusers and associated pipework were procured from a manufacturer that is no longer in business and replacement parts are unavailable.

The primary clarifier improvements include new odor control, equipment replacement, structural repair, underground piping replacement, paving, and replacement of the primary clarifier building roof. The activated sludge process improvements include new aeration piping and diffusers, instrumentation, controls scheme, process improvements, and structural repair. The improvements will extend the useful life of the facilities by an estimated 25-30 years and improve process efficiency. Additionally, the activated sludge process will be changed, allowing for the future demolition of the trickling filters; also identified in the 2017 Public Works Integrated Master Plan as a top priority, the trickling filters include a portion of the original treatment plant and are not compliant with modern seismic building codes.

The work is tentatively scheduled to begin in Winter 2025 and continue into Winter 2027 (500 working days) absent any delays for supply chain issues, unforeseen site conditions or weather.

On June 4, 2024, the City of Oxnard City Council approved Resolution 15,783, amending the amount of project expenditures to be reimbursed by proceeds from the Clean Water State Revolving Fund for the Wastewater Reliability Improvements Program from $66,700,000 to $88,601,724. The Primary Clarifiers & Activated Sludge Tank Improvement Project construction phase was included in the funded Program.

DISCUSSION
The Notice Inviting Formal Bids (NIFB) for the Project was originally published on June 26, 2025, in the local newspaper. Additionally, the NIFB was posted on multiple online platforms, including the City’s website, and distributed directly to 41 contractors who have registered with the City to be notified of Public Project bids within their license category. All bids were opened on October 9, 2025 and the City received the following bids:

Filanc: $46,812,422
Kiewit Infrastructure West Co.: $60,597,050
The lowest bidder is Filanc and its bid is responsive to the City’s NIFB. Following this determination, procurement staff reviewed all documentation received from Filanc and its subcontractors. Procurement staff from the Public Works Department verified possession of required, currently valid licenses, reviewed the federal Occupational Safety and Health Administration (OSHA) website for safety violations, and verified registration with the California Department of Industrial Relations (DIR). Based upon the available information and research performed to date, staff believes that the contractor is capable of satisfactorily completing the project. Thus, staff recommends that the City Council award the contract for this Project to Filanc.

The base bid of the project included work as described in the background section of this staff report. Additionally, the bid packet requested pricing from bidders on possible additive items. These are items that address maintaining operations during construction, coordination with the ongoing OWTP Reliability Project, potential conditions of underground utilities, and potential conditions of the structural rehabilitation. There were a total of five additive items as noted below:

Base Bid Total: $43,825,585
Additive Items: $2,986,837
Total Contract Amount: $46,812,422
1039
Public Works recommends the City Council approve the project, including the base bid and all five additive items. This will allow:

1. Cleaning of the activated sludge is a labor-intensive process of removing biological growth and is required to complete construction.

2. Temporary bypass pumping is required to maintain operation during construction. This item includes installation and removal of temporary infrastructure.

3. As part of the OWTP Reliability Project the motor control center (MCC) of the primary clarifiers is being replaced. This item includes wiring that could not be designed as the MCC was not installed.

4. Pipeline lining, repair, and replacement has been included due to multiple breaks since the time of design and the unknown condition of the underground facilities.

5. During the bid process multiple requests for information were submitted regarding structural condition and this item was included to account for existing field conditions that do not match as-built drawings.

In addition to the project award amount of $46,812,422, Staff recommends authorizing $9,362,484 for the project, which includes $4,681,242 for project contingency (~10% of the contract costs) and $4,681,242 for the cost for engineering services and City staff (~10% of the contract cost). Engineering services include the following activities during construction: engineering, inspection, survey and project management. These recommendations bring the total estimated cost of the project to $56,174,906.

The total cost for this Project is $56,174,906, which includes the construction agreement, construction contingency, and project allocation for items such as construction management, material testing and inspection, and staff time. There are two other staff reports on the December 2, 2025, City Council meeting agenda that cover construction management and inspection services in the amount of $3,781,680, and $1,259,207 to cover engineering services during construction.

The Primary Clarifiers & Activated Sludge Tank Improvement Project (C1814) has an available project budget balance of $18,822,172 from the Wastewater Bonds/SRF Fund (617) and $23,211,419 from the Wastewater Operating Fund (611), a total available project budget balance of $42,033,591. The 2025-29 CIP included the 2023 engineer’s estimate of $40M for construction; however, due to increased construction cost, construction management services, and engineering services during construction have resulted in a greater overall project cost.

An appropriation to Wastewater Bonds/SRF Fund (617) for $22,579,552 is requested for project C1814 to bring the total amount funded through the State Revolving Fund Loan to $41,401,724. Resolution 15,783 made the additional State Revolving Funding available. SRF funds originally appropriated to the Gravity Main Improvements Project (C2309) are being reallocated to Project C1814. This is because project C1814 was advertised as a SRF funded project and C2309 was not due to time constraints. The substitute funding needed for C2309 will be appropriated from the Wastewater Operating Fund (611).

DISCUSSION 6
• Project is 85% complete
• Scheduled completion is October 2027

DISCUSSION
7 Project Challenges: • Existing Electrical Issue • SCE coordination • Existing SCADA Issues • Equipment delivery These complications have
extended the construction time
needed for this project,
necessitating the extension of the
associated Construction
Management professional services
agreement.
1049
DISCUSSION 8
• Project Complexity: The technical demands of the
construction phase require dedicated oversight that exceeds current internal capacity.
• Full Staff Workloads: All existing City project managers are currently at maximum capacity, leaving insufficient time to provide the necessary level of attention this project requires. • Staff Vacancies: Recent resignations of in-house Construction Project Managers and Civil Engineers have thinned the
department's technical expertise.
• Temporary Leaves: Unforeseen absences, such as military leave, have further reduced the available personnel for project management.
• Operational Risk: Relying solely on internal staff during these vacancies would likely result in inadequate management of the construction phase.
1050
• Project challenges include issues with existing electrical infrastructure, SCADA systems, and coordination with
Southern California Edison
• Original duration of project was 3 years, starting in 2022, however it has now been extended to October 2027 due to design related issues
• Continued construction management and inspection services are required to assist the City in completing the OWTP
Reliability Project. This amendment continues the daily services Kennedy Jenks provides, including but not limited to:
• Full construction management and inspection, coordination, contract administration, cost/schedule control, document management, compliance, testing, and project closeout support DISCUSSION 9
1051
• The fiscal impact section details a reallocation of funds across multiple projects to ensure continued compliance with State Revolving Fund (SRF) requirements, fulfillment of existing contractual obligations, and the accommodation of new funding requests
• December 2025: Council approved a $13.95M fund 617 reallocation to maintain compliance with State Revolving Fund requirements • 617 Funding was shifted from Projects C2201 and C2309 to Project C1814 to align with the SRF loan agreement; It was the intent to backfill this shift of SRF funds with other Wastewater funding • The backfill for Project C2201 is with Wastewater Operating fund 611 totaling $6.7M
FINANCIAL IMPACT 10
1052
• This Second Amendment to Agreement A-8281 with Kennedy Jenks Consultants, Inc. increases the contract authority by an amount not to exceed $1,189,349, resulting in a total revised contract amount of $5,703,885.
• Budget Appropriation Transfer of $1.5M within the Wastewater Operating Fund (611) from Wastewater OWTP: Effluent Pump Station Improvements Project (C2235) to OWTP Reliability Project (C2201). • There are sufficient project appropriations totaling $4.8M available for transfer from the Wastewater OWTP: Effluent Pump Station Improvements Project (C2235). Project C2235 will be in the design phase for the next one and one-half years and does not require the total allocation until the construction phase.
• Project Budget Appropriation of $5.2M to the Wastewater Capital Fund (612), funded from the Wastewater Operating Fund (611), for Project C2201.
