BACKGROUND/DISCUSSION:
On April 28, 2017, the Governor signed Senate Bill (SB) 1 (Beall, Chapter 5, Statutes of 2017).
To address basic road maintenance, rehabilitation and critical safety needs on both the state highway and local streets and road system, SB 1 increases per gallon fuel excise taxes, increases diesel fuel sales taxes and vehicle registration fees, and provides for inflationary adjustments to tax rates in future years.
The State Controller (Controller) deposits various portions of this new funding into the newly created Road Maintenance and Rehabilitation Account (RMRA). A percentage of this new Road Maintenance and Rehabilitation Account funding will be apportioned by formula to eligible cities and counties pursuant to Streets and Highways Code Section 2032(h) for basic road maintenance, rehabilitation, and critical safety projects on the local streets and roads system.
SB 1 emphasizes the importance of accountability and transparency in the delivery of California’s transportation programs. Therefore, to be eligible for Road Maintenance and Rehabilitation Account funding, statute requires cities and counties to annually provide basic project reporting to the Commission for projects anticipated for and funded through the Road Maintenance and Rehabilitation Account. The City will receive approximately $956,228 for street rehabilitation for FY 2023-24.
The Streets and Highways Code requires that prior to receiving an apportionment of RMRA funds from the Controller in a fiscal year, all eligible cities or counties shall submit to the California Transportation Commission (Commission) a list of projects proposed to be funded Pacifica City Council 2

with these funds pursuant to an adopted resolution by the applicable City Council or County Board of Supervisors at a regular public meeting. The attached resolution is in the strict format provided by the Commission and includes a list of all streets that are eligible for SB1 funding.
These streets are part of the City’s 5-Year Street Maintenance program for FY 2023-24.
This year, the City Manager recommends the following project for SB1 funding for Fiscal Year 2023-24:
• FY 2023-24 Pavement Resurfacing Project. The project will follow the City’s approved 5- year street maintenance program and resurface approximately 7.72 miles (28 street sections) of City pavement and includes asphalt overlay, cape seal, double slurry seal, slurry seal, microsurfacing, base repair, pavement striping and markings and other miscellaneous related work.
ALTERNATIVE ACTION:
If the Council chooses not to adopt the Resolution, it will result in the City not meeting statutory requirements for the SB1 Funds. Therefore, staff does not recommend this alternative action.
RELATION TO CITY COUNCIL GOALS AND WORK PLAN:
• Fiscal Sustainability: includes investing in economic development to increase revenues, funding a reserve/emergency fund, and being well prepared for grant opportunities.
Adopting the resolution and approving the Proposed Project List meets statutory requirements that will allow the City to receive SB1 Funds. • Stewardship of City Infrastructure: includes repairing/replacing outdated city facilities such as city hall, the libraries, fire stations, etc., improving streets, and responding to impacts of sea level rise. Adopting the resolution and approving the Proposed Project List meets statutory requirements that will allow the City to receive SB1 Funds and repair City infrastructure.
FISCAL IMPACT:
There is no Fiscal Impact associated with the Adoption the Resolution. Separate Council action is required for appropriation of funds for each of the projects listed.

WHEREAS, Senate Bill 1 (SB 1), the Road Repair and Accountability Act of 2017 (Chapter 5, Statutes of 2017) was passed by the Legislature and Signed into law by the Governor in April 2017 to address the significant multi-modal transportation funding shortfalls statewide; and
WHEREAS, SB 1 includes accountability and transparency provisions that will ensure the residents of the City of Pacifica are aware of the projects proposed for funding in our community and which projects have been completed each fiscal year; and WHEREAS, the City of Pacifica must adopt by resolution a list of projects proposed to receive fiscal year funding from the Road Maintenance and Rehabilitation Account (RMRA), created by SB 1, which must include a description and the location of each proposed project, a proposed schedule for the project’s completion, and the estimated useful life of the improvement; and
WHEREAS, the City of Pacifica, will receive an estimated $956,228 in RMRA funding in Fiscal Year 2023-24 from SB 1; and
WHEREAS, this is the seventh year in which the City of Pacifica is receiving SB 1 funding and will enable the City of Pacifica to continue essential road maintenance and rehabilitation projects, safety improvements, repairing and replacing aging bridges, and increasing access and mobility options for the traveling public that would not have otherwise been possible without SB 1; and
WHEREAS, the City of Pacifica has undergone a robust public process to ensure public input into our community’s transportation priorities/the project list; and WHEREAS, the City of Pacifica used a Pavement Management System to develop the SB 1 project list to ensure revenues are being used on the most high-priority and cost-effective projects that also meet the communities priorities for transportation investment; and WHEREAS, the funding from SB 1 will help the City of Pacifica maintain and rehabilitate several streets/roads throughout the City of Pacifica this year and other similar projects into the future; and
WHEREAS, the 2021 California Statewide Local Streets and Roads Needs Assessment found that the City of Pacifica streets and roads are in an “poor” condition and this revenue will help us increase the overall quality of our road system and over the next decade will bring our streets and roads into a “at risk” condition; and
WHEREAS, the SB 1 project list and overall investment in our local streets and roads infrastructure with a focus on basic maintenance and safety, investing in complete streets infrastructure, and using cutting-edge technology, materials and practices, will have significant positive co-benefits statewide.
