From: Dante Pecchenino, Interim City Engineer/Deputy Community Development Director Subject: Acceptance of Public Improvements for Sherwood Road within Tract 3154-1 (Vinedo Planning Area 15) and Rescind the Rejections of Offers of Right-of-Way Dedications for Tract 3155
CEQA Determination: In compliance with the California Environmental Quality Act (CEQA), an initial study and environmental impact report (SCH 2019011065) were prepared for the Olsen South Chandler Specific Plan (Vinedo). Staff recommends the City Council find that accepting Sherwood Road for public use does not require additional review under CEQA pursuant to Public Resources Code section 21166 and CEQA Guidelines section 15162 and 15182 (no subsequent or supplemental EIR is required, because no “substantial changes” to the project or to the circumstances under which the project was undertaken are proposed, and there are no “new significant environmental effects” or a “substantial increase in the severity of previously identified significant effects” under the existing EIR).

Facts
1. The Olsen South Chandler Specific Plan was approved by the City Council on February 20, 2020, and provides for development of approximately 1,293 residential units and associated backbone infrastructure improvements.
2. Vesting Tentative Tract Map 3155 was approved as part of the Specific Plan approvals and includes conditions requiring the construction of backbone roadway and infrastructure improvements.
3. The Final Map for Tract 3155 was approved and recorded; however, the City Council rejected without prejudice the offers of dedication for public right-of-way associated with certain portions of Sherwood Road (shown as Niblick Road), Exhibit A.
4. On November 21,2023, the City Council approved a Subdivision Improvement Agreement with SH AA Vinedo, LLC which included a portion of Sherwood Road as part of the Final Map for Tract 3154-1, Exhibit B.
5. The Developer has constructed the following streets, with associated utilities, storm drain, signage, striping, landscape, and irrigation, in accordance with the City approved improvement plans (Permit #E22-0033), Exhibit C, and Subdivision Improvement Agreement, and all applicable City standards:

6. City staff has inspected the Sherwood Road improvements and determined they are substantially complete.
7. The Applicant has provided Record Drawings and the final certifications to the City Engineer’s satisfaction.
8. The Developer has posted performance and payment bonds that guarantee completion of improvements within the Subdivision Improvement Agreement, Exhibit D, and referenced below:

9. The Developer has requested that the City Council accept the Sherwood Road public improvements as complete, exonerate the Vinedo PA 15 Frontage Performance and Payment Bonds, each in the amount of $2,706,700 pursuant to the Subdivision Improvement Agreement, and grant the City Engineer the authority to administratively release the performance bond.
10. Following ninety (90) days after the recordation of the notice of completion of the improvements, the City shall release the payment bonds for the work of improvement in accordance with the Subdivision Map Act.
11. In order to accept the improvements and incorporate them into the City-maintained road network, the City Engineer recommends rescinding the prior rejection of the right-of-way dedications and accepting the dedications as shown on the recorded Final Map for Tract 3155 and the Right-of-Way Plat Map.
12. The Applicant will provide a 10% warranty bond for public improvements to be held for a one-year period. Once the one-year period is complete and clear of any deficiency the bonds will be returned.
Options
1. Decline to accept the public improvements or dedications;
2. Rescind the prior rejection and formally accepting the right-of-way dedications for those public street segments shown on the Final Map for Tract 3155, accepting the public improvements for portions of Sherwood Road, exonerating Vinedo PA 15 Frontage Performance and Payment Bonds No.
ES00015902, each in the amount of $2,706,700, authorizing administrative release of the performance bond, and administrative release the payment bond ninety (90) days after the recordation of the notice of completion of the improvements;
3. Provide alternative direction to staff.
Analysis and Conclusions
Sherwood Road is a vital component of the Olsen-South Chandler Specific Plan circulation network, and the associated rights-of-way must be formally accepted into the public system. A portion of the public improvements, which the Developer was required to install for this subdivision, have been completed.
Further, the City will at a minimum, retain a Warranty Bond for a one-year period for warranty of the improvements installed. The City Engineer will release the warranty security, after the warranty requirements are satisfied.
Acceptance of the improvements and right-of-way dedications ensures long-term public access, connectivity, and maintenance authority.
The Sherwood Road improvements included within this acceptance action have been substantially completed, inspected by City staff, and determined to be suitable for incorporation into the Citymaintained roadway system. Sherwood Road is currently functional and capable of serving the intended circulation, utility, and access purposes associated with the Olsen South Chandler Specific Plan.
Fiscal Impact
Upon final acceptance and expiration of the one-year warranty period, the City will assume ongoing maintenance responsibilities for these improvements. These costs are consistent with long-term maintenance planning under the Specific Plan.
CEQA
In compliance with the California Environmental Quality Act (CEQA), an initial study and environmental impact report (SCH 2019011065) were prepared for the Olsen South Chandler Specific Plan (Vinedo) and were circulated between 10/17/2019 and 12/2/2019. Staff recommends the City Council find that accepting Sherwood Road for public use does not require additional review under CEQA pursuant to Public Resources Code section 21166 and CEQA Guidelines section 15162 and 15182 (no subsequent or supplemental EIR is required, because no “substantial changes” to the project or to the circumstances under which the project was undertaken are proposed, and there are no “new significant environmental effects” or a “substantial increase in the severity of previously identified significant effects” under the existing EIR).

Approve Resolution No. 26-XXX, rescinding the prior rejection and formally accepting the right-of-way dedications for those public street segments shown on the Final Map for Tract 3155, accepting the public improvements for portions of Sherwood Road, exonerating Vinedo PA 15 Frontage Performance and Payment Bond No. ES00015902, each in the amount of $2,706,700, authorizing administrative release of the associated performance bond, and administrative release the payment bond ninety (90) days after the recordation of the notice of completion of the improvements.

RESOLUTION OF THE CITY COUNCIL OF THE CITY OF EL PASO DE ROBLES ACCEPTANCE OF PUBLIC IMPROVEMENTS FOR SHERWOOD ROAD WITHIN TRACT 3154-1,
AND RESCINDING PRIOR REJECTION OF RIGHT-OF-WAY DEDICATIONS,
CONSTRUCTED PURSUANT TO THE SUBDIVISION IMPROVEMENT AGREEMENT WHEREAS, Final Map for Tract 3155 was recorded on October 7, 2020, (Exhibit A); and WHEREAS, the City Council approved a Subdivision Improvement Agreement with SH AA Vinedo, LLC on November 21,2023, which included a portion of Sherwood Road, (Exhibit B); and WHEREAS, offers of dedication for public right-of-way purposes were included on the Final Map for portions of Sherwood Road (shown as Niblick Road on Tract 3155), but were rejected by the City Council at the time of map approval, without prejudice; and WHEREAS, the Developer has since completed the construction of certain public improvements along portions of Sherwood Road from STA 248+60 TO STA 257+43, in accordance with City approved improvement plans, (Exhibit C), the Subdivision Improvement Agreement, (Exhibit D), and applicable City standards; and
WHEREAS, City staff has inspected the work and determined that they are substantially complete; and
WHEREAS, the City Engineer recommends the partial acceptance of the work covered by the SIA and dedications into the City's maintenance system and recommends the reduction of associated performance, payment bonds pursuant to Section 6(a) of the Subdivision Improvement Agreement; and
WHEREAS, the proportional release of performance security is permitted under the Subdivision Map Act and Government Code section 66499.7; and
WHEREAS, this action is exempt from additional environmental review pursuant to Public Resources Code Section 21166 and CEQA Guidelines Sections 15162 and 15182, as it is consistent with the previously certified Environmental Impact Report (SCH 2019011065) for the Olsen South Chandler Specific Plan.
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF EL PASO DE ROBLES DOES HEREBY RESOLVE AS FOLLOWS:
Section 1. All of the above recitals are true and correct and incorporated herein by reference.
