Discussion:

Crimson submitted its request for franchise renewal on August 12, 2024, seeking to continue operation of approximately 580 linear feet of existing 4-inch and 6-inch crude oil pipelines. These facilities include:
• 400 linear feet of 6-inch pipeline along Beverly Road near the Rio Hondo River • 80 linear feet of 4-inch pipeline in Beverly Road near the San Gabriel River • 100 linear feet of 4-inch pipeline in Beverly Road, east of the San Gabriel River Pursuant to Division 3, Chapter 2 of the California Public Utilities Code (PUC), municipalities are authorized to grant franchises for oil pipeline operations beneath public rights-of-way. Under PUC Section 6232 et seq., the franchise process includes:

1. Approval of a resolution expressing intent to grant the franchise and setting a public hearing date;

2. Publication of the hearing notice within 15 days of the resolution being passed in a newspaper of general circulation;

3. Conducting a public hearing no fewer than 20 days and no more than 60 days after the resolution is passed.

PUC Section 6234 permits interested parties to submit signed, written protests to the City Clerk prior to or during the public hearing. If no protests are received—or if submitted protests are deemed insufficient or are overruled—the City Council may adopt the ordinance granting the franchise.

As a renewal of an existing franchise, this request is governed by Section 4.04.020 of the Pico Rivera Municipal Code. Crimson California Pipeline has consistently operated its pipelines in Pico Rivera safely and in compliance with all applicable regulations. The applicant has agreed to adhere to the provisions of Title 4 of the Municipal Code, including:
• § 4.12.020 – Payment of a $1,400 granting fee within 30 days of franchise approval;
• § 4.12.050 – Payment of an annual franchise fee based on $0.33 per linear foot for pipelines with a diameter of 8 inches or less.

In compliance with procedural requirements, the City published a notice of the public hearing in the Los Cerritos Newspaper on May 2, 2025.

All legal documentation has been reviewed by the City Attorney and found to be in order.

There is no fiscal impact to the General Fund.

Background:

On September 22, 2024, the State Legislature passed, and Governor Gavin Newsom signed into Law, Assembly Bill (AB) 2561, amending the Meyers-Milias-Brown Act.

Effective January 1, 2025, this legislation establishes a new requirement for public agencies to publicly disclose and address the status of their vacant positions. As a basis for the new requirements, the California Legislature determined that vacancies are widespread and can be a significant problem in the public sector. According to AB 2561, vacancies require employees to take on heavier workloads, resulting in burnout, low morale and increased turnover, which could negatively impact the delivery of public service.

AB 2561 imposed three (3) requirements on local agencies:

1. At least once per fiscal year, and before the final budget is adopted, an agency’s governing board must hold a public hearing and receive the agency’s report on the status of vacancies, recruitment and retention efforts;

2. During the hearing, the agency must identify any necessary changes to policies, procedures, and recruitment activities that may lead to hiring obstacles; and 4 CITY COUNCIL AGENDA REPORT – MEETING OF MAY 27, 2025
PUBLIC HEARING - STATUS UPDATES ON JOB VACANCIES – AB 2561

COMPLIANCE

Page 2 of 3 ends

3. The agency must allow a bargaining unit representative of a recognized employee organization to make a presentation at the hearing at which the public agency presents the status of vacancies, recruitment and retention efforts for positions within that bargaining unit.

Discussion:

If the number of job vacancies within a single bargaining unit meets or exceeds 20% of the total number of authorized full-time positions, the public agency shall, upon request of the recognized employee organization, include all the following information during the public hearing:

1. The total number of job vacancies within the bargaining unit;

2. The total number of applicants for vacant positions within the bargaining unit;

3. The average number of days to complete the hiring process from when a position is posted; and

4. Opportunities to improve compensation and other working conditions.

In response to AB 2561, the City conducted a review of the total staffing and vacancy rates using the fiscal year (FY) 2024-25 Budget and using staffing levels as of May 1, 2025. For FY 2024-25, the City Council authorized 159 full-time positions citywide, with only the City Manager position being non-represented.

The current staff vacancy rate in the City does not exceed the twenty percent (20%) threshold for any of its full-time bargaining units:

The vacancies in the Mid Managers, Professionals and Confidential Employees’ Association (CEA) are three (3) Coordinators, two (2) Analysts, one (1) Deputy City Clerk and one (1) Assistant City Engineer.

Based on the foregoing, there are no necessary changes to policies, procedures and recruitment activities. The City continues to enhance its recruitment efforts to attract and retain a diverse and qualified workforce. This includes updating job descriptions to ensure they feature accurate titles and responsibilities, helping to attract candidates whose skills and qualifications align more closely with the role. These updates also ensure that postings reflect current organizational needs, ultimately improving the quality of applicants.

In addition, we are actively exploring innovative approaches to the interview process. This includes selecting diverse and qualified interview panelists, conducting virtual interviews to increase accessibility and efficiency, and implementing strategies that enhance the overall candidate experience.

Conclusion:

Staff recommends that the City Council conduct a public hearing and receive and file this report.

A Study Session of the City Council and a regular meeting of the City Council and Water Authority was held in the Council Chamber, Pico Rivera City Hall, 6615 Passons Boulevard, Pico Rivera, California.

Mayor Garcia called the Study Session to order at 3:48 p.m. on behalf of the City Council.

PRESENT: Lara, Sanchez, Garcia
ABSENT: Camacho, Lutz

1. Study Session – Five-Year Capital Improvement Program – Fiscal Years 2025 through 2030. (700)
Public Works Director Negrete provided a comprehensive update on the Five-Year Capital Improvement Plan (CIP), outlining its strategic priorities and objectives. The presentation included an overview of newly developed projects, a summary of completed CIP projects for fiscal year (FY) 2024-25, and highlights of key projects such as the PFAs Treatment Facility and the Youth Center Renovation projects. Director Negrete also presented upcoming construction projects scheduled for FY 2025-26, offered a detailed overview of the five-year CIP project list with corresponding cost estimates, and provided an update on the Pavement Management Plan.

Specific projects discussed included the Smith Park Turf Replacement, Alebrije Dog Park, City Hall Council Chambers, HVAC upgrades at Rivera and Pico Parks, the Smith Park Aquatic Center, and the Rio Hondo Park Renovation projects. Additionally, he reviewed the CIP funding sources, identified grant-funded projects, and listed the current unfunded projects.

City Councilmembers discussed the next phase of water projects, future plans for the PFAS treatment facilities, the selection criteria for streets classified as “very poor” in accordance to the Pavement Condition Index, future maintenance plans for the new turf at Smith Park, the potential risk of federal grant fund cancellations, and the removal of trees that pose a risk of damaging City sidewalks.

They also offered the following recommendations: track PFAS water readings for historical recordkeeping, coordinate water main line repairs with road improvement projects, install renderings or construction notices at project sites at the start of construction, highlight completed City projects on the City’s social media platforms for public awareness, and explore a joint-use partnership with the Armenian Mesrobian School to utilize its basketball courts during periods of City park gymnasiums construction closures. Mayor Garcia requested that the gymnasium HVAC project be expedited in response to extreme heat conditions typically experienced during the summer months. Regarding the City Council Chambers project, Mayor Garcia also 5 5-13-25.CityCouncilMinuteswithStudySession

12. First Reading – Introduce Ordinances Adopting the New City Brand and Logo and Protecting Use of the City Seal. (300)
Innovation and Communications Director Hernandez delivered a brief presentation on the City’s Branding, Signage, and Furniture Master Plan. The presentation covered the project’s goals, master planning process, asset inventory and mapping, and a review of the current seal and logos. Director Hernandez also unveiled the new City logo concept and its variations, discussed the phased implementation strategy, the signage system, and the overall project timeline. He emphasized that the existing City seal would remain unchanged and is not part of this project.

Councilmembers Dr. Sanchez and Lutz raised concerns about how copyright matters will be addressed and emphasized the importance of securing a trademark for the new logo. City Attorney Alvarez-Glasman responded that the ordinances presented to the City Council for adoption incorporate copyright protections and prohibitions. As such, trademarking is not necessary, as the Pico Rivera Municipal Code provides full legal protection for the City seal and logo. Unauthorized use of these assets may result in legal action and prosecution to the fullest extent of the law.

Motion by Mayor Pro Tem Camacho, seconded by Councilmember Dr. Sanchez to: 1) Introduce and waive the first reading of Ordinance No. 1195 amending Chapter 1.10 City Logo, adopting the new City Brand and Logo; and 2) Introduce and waive the first reading of Ordinance No. 1196 including identifying and prohibiting unauthorized use of the City Seal. Subject: SECOND READING AND ADOPTION OF ORDINANCES ADOPTING

THE NEW CITY BRAND AND LOGO AND PROTECTING USE OF

THE CITY SEAL
Recommendation:

1. Adopt ordinance No. 1195 amending Chapter 1.10 City Logo, adopting the new City Brand and Logo; and

2. Adopt ordinance No. 1196 identifying and prohibiting unauthorized use of the City Seal.

Fiscal Impact:

There is no fiscal impact to the General Fund. This project is fully funded by $220,000 from the Public Image Enhancement (PIE) Fund (Account No. 220.11.1110-54500), $45,500 from the Water Authority Fund 550 (Account No. 550.11.1110-54500), and $84,500 from the PRIME Fund 560 (Account No. 560.11.1110-54500) as approved by the City Council on September 26, 2023.

Background:

In 2020, the City of Pico Rivera (City) developed a community and economic recovery framework to address major challenges introduced by COVID-19, the economic downturn, climate change, impacts from the Whittier Narrows Dam Safety Project, and multiple unfunded state and federal mandates. Based on input from the City Council, the framework evolved into what is now the Pico Rivera 2035: Community Revitalization Program (PR 2035), a holistic approach to establishing a dynamic downtown, vibrant uptown, lively riverfronts, and inspiring places that reflect the rich history, culture, and diversity of Pico Rivera.

PR 2035 will undoubtedly reshape the physical landscape and reposition the City as an inviting place to live, work, and play within the region. The current state of transition presented an opportunity to reconsider and modernize the City’s identity, brand, and logo with a goal of introducing an appealing sense of place and style that elevates the City’s 7 CITY COUNCIL AGENDA REPORT – MEETING OF MAY 27, 2025

marketability as a hotbed for new public and private development. The City’s current brand/logo has been in use for nearly 10 years, whereas the previous brand had not changed in over 20 years.

Discussion:

Over the past couple of years, the City has prioritized the development of master plans, strategic plans, specific plans, and revitalization programs that outline a path for enhancing infrastructure, beautifying the community, upgrading facilities, and advancing new development within the City. These plans help to convey the City’s intent to invest resources, coordinate actions, and synchronize improvements with broader regional and statewide goals. Such plans also help to translate a common vision into a consistent, coherent, and harmonious theme that inspires community pride.

As plans and projects advance through implementation, additional needs and considerations typically arise. The Historic Whittier Boulevard Revitalization Program, for example, gave rise to the establishment of a formal “uptown” district that merits a unique identity and branding. Distinct design styles, artistic features, special qualities, and nuanced character can be integrated into the urban form through architecture, street signage, furniture, landscaping, infrastructure, and much more. Although Whittier Boulevard and the “uptown” area are indeed special, the new and revitalized identity must also be consistent and reinforce the overarching Citywide image.

In September 2023, the City Council approved a contract and authorized staff to develop a City Branding, Signage, and Furniture Master Plan. Through the initial discovery stage, the project consultants did extensive research, collected input from the City’s Stakeholder Advisory Group, conducted surveys, and evaluated the City’s history, unique attributes, demographics, culture, geographic position, and plans for the future. The analysis identified the Rio Hondo and the San Gabriel River as the most prominent, recurring, and constant theme. Based on further guidance from the City Council and staff, the design team developed branding and logo concepts that:

A) Represent the City’s history, current environment and culture, and future vision
B) Integrate the two rivers as a prominent element of the logo C) Reinforce the City’s primary colors of blue and gold to remain consistent with the official City Seal.

Staff provided a status update on the project to the full City Council during the February 25, 2025, City Council Meeting. The presentation showcased a variety of design styles ranging from colorful and whimsical, rigid and corporate, literal symbols and iconography, and much more.

After further refinement and input from the Ad-Hoc Committee, the project team presented CITY COUNCIL AGENDA REPORT – MEETING OF MAY 27, 2025

the following brand/logo as the preferred alternative:
 The two waves in each design variation represent the two rivers in the City.  The blue in the waves symbolizes the flow of water and energy, while the gold represents the sun’s reflection in the water.
 The circular motion of the waves represents the cycles of life; continuous flow of energy; a focus on sustainable use and reuse.
 The circular motion also embodies the concept that “everything old is new again,” thereby emphasizing the City’s history, current environment and culture, and future vision.

It’s important to note that this effort did not explore changes and does not propose any modifications to the official City Seal. Although the City Seal will remain unchanged as part of the City’s rebranding initiative, staff have determined that this is an appropriate time to update the Pico Rivera Municipal Code as it relates to the Seal’s use and protection. In the past, the Seal was used and altered without proper authorization. Given its role as the official legislative mark of the City of Pico Rivera, staff recommend revising the existing ordinance to include stronger protective language to safeguard its integrity.

A final memorandum was distributed to all members of the Council on April 7, 2025, requesting final comments and points of consideration. Staff did not receive any written or verbal comments regarding the proposed preferred alternative. The project team proceeded to prepare the attached ordinance and Brand Guidelines, which provide the permitted and recommended uses and describe improper applications of the new City brand and logo.

Next Steps
Upon approval, City staff will re-engage the technical consultant to complete the Branding, Signage, and Furniture Master Plan. Combined, the Master Plan and Design Guidelines will provide clear direction for the systematic implementation of the new brand and logo throughout all City departments, publications, digital platforms, and signage. This Design Guide will standardize the use of colors, typography, and visual elements, ensuring consistency in all official communications and promotional materials. The Master Plan will also include a phased approach for replacing outdated branding with the new design and logo, minimizing disruptions while maximizing clarity and adoption throughout the organization.

The Master Plan is essential for integrating the new branding into the City’s built CITY COUNCIL AGENDA REPORT – MEETING OF MAY 27, 2025

Page 4 of 4 ends

environment, guiding the design of street signage, public wayfinding, and urban furniture to maintain a cohesive and professional appearance. The project team will also work with the City Council to explore new styles, types, and alternative signage and furniture to be deployed throughout the City. The continuation of this work will align the City's planned infrastructure improvements with its refreshed identity, enhancing the overall aesthetic appeal and functionality of public spaces.

Rebranding is particularly timely as the City prepares to position itself as a key Cultural Celebration Hub for upcoming international events, including the 2026 FIFA World Cup and the 2028 Olympic and Paralympic Games. As these global events bring heightened visibility to the region, a strong and contemporary brand will enhance the City’s ability to attract visitors, businesses, and investment opportunities. By proactively updating its identity, Pico Rivera will be well-positioned to showcase its unique character, cultural vibrancy, and modern amenities to a broader world-wide audience.

Staff anticipates bringing the complete and final City Branding, Signage, and Furniture Master Plan for Council approval in the fall of 2025.

Conclusion:

Staff recommend that the City Council adopt an ordinance amending chapter 1.10 City Logo approving the new City brand and logo and adopting an ordinance protecting use of the City Seal.

Our Future
The City
This logo seeks to convey the vibrant and energetic attitude of this city by manifesting a state of continuous flow and energy through its wavy shapes and color palette.

The two waves in each design variation represents the two rivers in the city.

The blue in the waves symbolize the flow of water and energy while the gold represents the suns reflection in the water.

The circular motion of the waves represents the cycles of life; continuous flow of energy; a focus on sustainable use and reuse. The circular motion also embodies the concept that “everything old is new again,” thereby emphasizing the city’s history, current, and future environment.

The result is a composition full of strength that seeks to accompany this city in its constant growth.

Respecting and maintaining this configuration will be essential to achieve a solid identity that will adequately represent us over time.

Logo Variations
Structure
In terms of structure, the logo has three different distributions:
1- Horizontal version: This will be the main version of the logo to be used predominantly. 2- Stacked version: This version will have a complementary use to the first one and will be used when the space for the placement of the logotype requires narrower proportions in order to achieve a better fit. 3- Reduced version: This version, finally, is a simplification of the logo. Considering that the name of the city does not appear in this configuration, it should never be used independently, but it will be used as a complementary resource or accent when generating any type of corporate material, as well as in those contexts where a very small size application of the logo is required..

Pico Rivera Brand Guidelines V1.0 05
Logo Variations
Color variations V1
Likewise, the logo has negative versions whose purpose is to offer an alternative that generates an adequate contrast when used on dark backgrounds.

The use of these versions will be equal in importance to those previously mentioned, being always the highest priority to obtain a good contrast and optimum legibility.

Pico Rivera Brand Guidelines V1.0 06
Logo Variations
Color Variations V2
Last but not least, there are secondary chromatic versions whose function is to provide the logo with the necessary versatility when applied on complex supports.

These versions include both polychromatic options with plain colors and monochromatic options in corporate colors and black and white.

The order of priority of use will be as follows:
1- Polychromatic versions with plain colors
2- Monochromatic versions with corporate colors
3- Monochromatic black and white versions

Sublogo System
The brand will have a system of sublogos dedicated to give each of the government subsections and local initiatives their own identity.

These sublogos will be built from the horizontal version of the logo, adding a color block at the bottom, on which the name of the section in question will be placed.

Below is a system of sublogos for the main existing sections, with the possibility of creating new sublogos as long as the established conditions are followed.

Logo Usage
We will now proceed to detail the guidelines for the use of this logotype, which can be summarized in the following three basic concepts:
1- Respect at all times the original configuration of the logotype, from its distribution to its colors and typographies.
2- Always prioritize an adequate contrast whatever the context or support, making use of the official alternatives offered by the logotype. 3- Proceed with coherence when generating any type of corporate material or complementary graphic element, respecting the generating principles of the logotype as well as its visual characteristics.

By following these guidelines, it will be possible to maintain a stable identity over time that will make us easily recognizable whatever the context or application.

Pico Rivera Brand Guidelines V1.0 10
As previously mentioned, contrast and legibility must be the top priority when applying this logotype.

In order to achieve such contrast, it will be essential to make a correct use of those alternatives that the logotype has to make it stand out properly on any background.

The use of the main versions will be a priority on both light and dark backgrounds, being advisable to use the monochromatic versions when the background has characteristics that make legibility difficult (for example, backgrounds of multiple colors that do not allow an adequate contrast).

In these cases, it is possible to play with the different options available to find the one that best highlights the logo.

Buffer Zone
The buffer zone is the area that must be kept empty around the logo to avoid conflict with other elements.

Each version will have a different buffer zone according to the following specifications:
- In both the horizontal and stacked versions, the width of the buffer zone will be defined by the height of the letter “O” of the word ‘PICO’ in the logo
- In the reduced version, the width of the buffer zone will be half the width of the letter “P”.

Thus, by taking these measures and generating a safety perimeter around the logotype, we will be able to ensure a correct legibility at all times.

Meeting Date: May 27, 2025
Subject: RESOLUTION AUTHORIZING A COMMERCIAL SOLID
WASTE RATE ADJUSTMENT WITH NASA SERVICES, INC.

Recommendation:

1. Approve a resolution approving an extraordinary adjustment to the commercial solid waste collection and disposal rates as authorized under Section 6.5 of Franchise Agreement No. 12-1290-3 with NASA Services, Inc. (NASA), effective July 1, 2025.

Fiscal Impact:

There is no fiscal impact to the General Fund, as commercial refuse rates are collected directly by NASA Services from business accounts. The proposed adjustment reflects a 10% increase to the base commercial rate, resulting in a monthly increase of $19.85 per account for one 3-yard bin collected once per week. The new monthly rate will be $208.02, inclusive of a 4.5% Senate Bill (SB) 1383 compliance fee.

The SB 1383 Fee—established under Section 3.6 of the Franchise Agreement— increases annually by 0.5% and is applied to gross receipts from commercial refuse services to fund local implementation of California’s organic waste diversion mandates.

For fiscal year (FY) 2025–26, the 4.5% commercial SB 1383 Fee is projected to generate approximately $364,000 in revenue to Fund 671, which is $33,000 more than previously projected. The anticipated revenues will be deposited into GL Account No. 671.00.0000- 44150 (SB 1383 Fee) to support compliance programming, public education, and enforcement activities.

Background:

On March 13, 2012, following a competitive procurement process, the City of Pico Rivera (City) entered into a Solid Waste Franchise Agreement (Agreement No. 12-1290) with NASA Services, Inc. for the exclusive collection of solid waste, recyclables, and green waste from residential and commercial customers. The original agreement was designed to ensure high-quality service standards, regulatory compliance, and fair and stable rate structures for the community.
8 CITY COUNCIL AGENDA REPORT – MEETING OF MAY 27, 2025

RESOLUTION AUTHORIZING A COMMERCIAL SOLID WASTE RATE ADJUSTMENT WITH NASA SERVICES, INC.

Page 2 of 3 ends

Subsequent amendments to the agreement were approved by the City Council in 2014 (Amendment No. 1) and 2015 (Amendment No. 2), which adjusted the franchise fee and extended the term of the contract. In 2021, Amendment No. 3 was approved to incorporate significant changes related to SB 1383, California’s mandate to reduce organic waste disposal and increase edible food recovery. This amendment added new service obligations for organics collection, public education, enforcement, and data reporting.

As a part of the agreement, Section 6.5 provides for Extraordinary Adjustments to refuse rates when unforeseen cost increases arise, such as changes in tipping fees or regulatory compliance. These adjustments must be reviewed and approved by the City Council.

Since 2012, NASA has submitted extraordinary adjustment requests on a limited basis.

Notably, two (2) commercial rate increases were approved by the City Council in 2016 and 2019, each linked to major increases in landfill fees imposed by the Los Angeles County Sanitation District and the closure of Puente Hills Landfill. Unlike standard Consumer Price Index adjustments allowed under Section 6.3, extraordinary adjustments are infrequent and typically result from systemic disruptions in the waste management system.

The current request by NASA stems from the recent closure of the Chiquita Canyon Landfill, which has led to increased transportation distances and higher tipping fees at alternate facilities. This regional disruption has created substantial cost pressure for haulers across Southern California, including NASA.

Discussion:

On March 1, 2025, NASA submitted a formal request for an extraordinary adjustment to commercial solid waste rates, as permitted under Section 6.5 of the Franchise Agreement. The request is based on significant cost increases resulting from the closure of the Chiquita Canyon Landfill, which has disrupted regional waste disposal operations and increased NASA’s operational expenses.

NASA’s analysis, reviewed and verified by City staff, estimates that the total cost impact of this disruption is equivalent to an 11.24% increase in commercial waste hauling costs.

This is primarily attributed to elevated tipping fees and longer hauling distances to available disposal facilities. For instance, commercial refuse haulers now dispose of waste at facilities such as the Puente Hills Materials Recovery Facility, where tipping fees have risen to an average of $95 to $105 per ton. This marks a significant increase from the previous tipping range of $45 to $55 per ton prior to the closure of the Chiquita Canyon Landfill.

Despite the full cost recovery being eligible under the terms of the agreement, NASA has opted to limit its rate adjustment request to 10%. This reflects an effort to lessen the CITY COUNCIL AGENDA REPORT – MEETING OF MAY 27, 2025

RESOLUTION AUTHORIZING A COMMERCIAL SOLID WASTE RATE ADJUSTMENT WITH NASA SERVICES, INC.

Page 3 of 3 ends

financial impact on local businesses, demonstrating a balanced approach between fiscal sustainability and economic sensitivity. The proposed increase would raise the monthly rate for a standard commercial bin (3-yard container collected once weekly) from $188.17 to $208.02, an increase of $19.85 per account per month.

City staff independently reviewed NASA’s cost justification and found the assumptions to be reasonable and supported. To provide additional context, staff surveyed commercial refuse rates in nearby cities. The analysis compared the City’s proposed FY 2025–26 rates against the current rates in surrounding jurisdictions. Even with the proposed increase, Pico Rivera remains competitively and favorably positioned:
 Montebello (Athens Services): $219.50/month
 Downey (CalMet Services): $212.85/month
 Bellflower (CR&R): $210.00/month
 Whittier (Athens/Republic): $205.00/month
 Pico Rivera (Proposed for FY 2025–26): $208.02/month
It is important to note that these cities have not yet adopted rate adjustments for the upcoming fiscal year, and increases are anticipated based on regional landfill and operational trends. As such, the City is well-positioned both competitively and proactively, with a reasonable and measured adjustment that supports service continuity while remaining aligned with peer cities.

Conclusion:

Staff recommends approving the resolution authorizing an adjustment to commercial solid waste rates to ensure continued high-quality service delivery, address rising operational costs, and support the long-term financial stability of the City’s waste franchise agreement.

WHEREAS, among other things, the Agreement sets the rates to be charged to residential and commercial customers, providing for circumstances under which such rates may be increased; and
WHEREAS, per the Agreement, a request for rate adjustment shall not be deemed as action by the City to establish or set rates, but rather the City's approval is solely required to verify the accuracy and appropriateness of the requested adjustment; and WHEREAS, Section 6.3 of the Agreement (“Schedule of Future Adjustments”) allows for annual administrative rate adjustments up to 5%, and Section 6.5 (“Extraordinary Adjustments”) provides a mechanism for rate increases above 5% due to unforeseen or extraordinary cost increases, subject to City Council approval; WHEREAS, NASA has submitted a request for an extraordinary commercial rate adjustment due to significant increases in landfill tipping fees following the closure of the Chiquita Canyon Landfill and increased disposal costs at alternative facilities; and WHEREAS, based on NASA’s calculations—verified by City staff—the closure of the Chiquita Canyon Landfill has resulted in an estimated 11.24% increase in operational costs related to commercial waste disposal; however, in an effort to minimize the financial burden on Pico Rivera’s business community, NASA is limiting its rate adjustment request to 10%, reflecting a business-friendly approach.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Pico Rivera as follows:

Subject: RESOLUTION APPROVING PROJECTS FOR ROAD REPAIR
AND ACCOUNTABILITY ACT OF 2017
Recommendation:

1. Approve a resolution approving project(s) for fiscal year (FY) 2025-26 funded by Senate Bill 1 (SB1): The Road Repair and Accountability Act of 2017.

Fiscal Impact:

The projected amount the City of Pico Rivera (City) will receive from Senate Bill 1 (SB) - Road Repair and Accountability Act of 2017 for FY 2025-26 is estimated at $1,630,144.

The state requires that the City Council approve a resolution appropriating such funds for road resurfacing projects and eligible construction work by submitting the approved resolution by or before July 1, 2025.

It is recommended that next year’s funding allocation for SB1 (Fund 202) for FY 2025- 26 in the estimated amount of $1,630,144 be allocated and relisted to Residential Resurfacing Program – Overlay and Reconstruction Project FY 2024-25, CIP No. 50106, in the amount of $1,400,000 (Account No. 202.70.7300.54500-CIP50106). The remaining balance of $230,144 would be allocated to Public Works operational needs, such as engineering staff time overseeing the road resurfacing projects, in accordance with SB1 guidelines.

Discussion:

On April 28, 2017, Governor Jerry Brown signed SB1 - Road Repair and Accountability Act of 2017, to address basic road maintenance, rehabilitation and critical safety needs on both the state highway and local street road system.

The State Controller will apportion, by formula, a percentage of Road Maintenance and Rehabilitation Account (RMRA) funds to eligible cities and counties in accordance with 9 CITY COUNCIL AGENDA REPORT – MEETING OF MAY 27, 2025

APPROVE A RESOLUTION TO ADOPT PROJECTS FOR ROAD REPAIR AND ACCOUNTABILITY ACT OF 2017 (FISCAL YEAR 2025-26)

Page 2 of 2 ends

Streets and Highways Code Section 2032. The City is projected to receive $1,630,144 in FY 2025-26.

Prior to receiving an apportionment of RMRA funds from the State Controller each fiscal year, the City must submit to the City Council a list of projects proposed to be funded with SB1 funds. Pursuant to Streets and Highways Code Section 2034, all projects must be adopted via resolution by the applicable legislative body at a regularly scheduled public meeting. The projects must include a description of the type of improvement, the location of each proposed project, a proposed schedule for completion and the estimated useful life.

Conclusion:

Staff recommend approving the resolution allocating the estimated $1,630,144 in FY 2025-26 SB1 funds (Fund 202) to the Residential Resurfacing Program – Overlay and Reconstruction Project FY2024-25, CIP No. 50106, in the amount of $1,400,000.

These funds will be accounted for in the Budget for FY 25-26 that will be presented to the City Council for approval at a future council meeting. The remaining balance of $230,144 would be allocated to Public Works operational needs, such as engineering staff time overseeing resurfacing projects, in accordance with SB1 fund guidelines.

Recommendation:

1. Approve Amendment No. 1 to Professional Services Agreement No. 24-2397 with DG Civil Engineering, Inc. for an additional amount of $92,400, increasing the total contract amount not-to-exceed $128,400 to provide plan check services for the Smith Park Aquatic Center Renovation Project, CIP No. 50043; and

2. Authorize the City Manager or his designee to execute Amendment No. 1 in a form approved by the City Attorney.

Fiscal Impact:

The City of Pico Rivera (City) will utilize $92,400 of County of Los Angeles Grant funding for the additional plan check services of the Smith Park Aquatic Center Renovation Project (Project). Sufficient funding is available in the fiscal year (FY) 2024- 25 Adopted Budget, within the fund Account No. 697.70.7300.54500-CIP50043. There is no fiscal impact to the General Fund.

Discussion:

The Smith Park Aquatic Center, located at the southeast corner of Rosemead Boulevard and Mines Avenue, has been closed to the public since the onset of the COVID-19 pandemic and remains closed indefinitely until it can return to acceptable operational levels. Originally built in 1982, the pool has seriously deteriorated and is no longer compliant with current code standards. The Project will replace the pool, pooldeck, and all associated equipment, which also includes a new pool equipment building, as well as a full remodel of the existing recreation facility. 11 CITY COUNCIL AGENDA REPORT – MEETING OF MAY 27, 2025 SMITH PARK AQUATIC CENTER RENOVATION PROJECT (CIP NO. 50043) – AMENDMENT NO. 1 TO PROFESSIONAL SERVICES AGREEMENT NO. 24-2397 WITH DG CIVIL ENGINEERING, INC.

Page 2 of 2 ends

On October 23, 2024, the City Manager executed the Agreement No. 24-2397 with DG Civil Engineering, Inc. for an amount of $36,000 to provide plan check services for the Project.

Additional plan review services are necessary due to the scope and complexity of the project, as well as, availability of Public Works staff resources, to complete plan review of the 90% and 100% design submittals. Section 3.20.030 of the Pico Rivera Municipal Code allows sole source purchasing if the City finds that the supplies, services, or equipment are unique because of their quality, durability, availability, or fitness for a particular use and are available only from one source, or, if available from more than one source, can be purchased from the manufacturer or service provider for a lower price. Staff recommend proceeding with sole source procurement for additional plan check services from DG Civil Engineering, Inc. since they are familiar with the proposed design plans as they completed the initial plan review, have expertise in the subject matter of the work and are the only vendor that can meet the delivery schedule of the project. The negotiated fee of $92,400 with DG Civil Engineering, Inc. is for the completion of the plan review tasks. DG Civil Engineering, Inc. is knowledgeable with the construction of municipal facilities and public works construction.

The project is currently at 90% design and the anticipated project schedule is as follows:
• Design Completion……………………. Summer 2025
• Bid and Award Construction…………. Fall 2025
• Begin Construction……………………. Winter 2025
Conclusion:

Staff recommend approval of Amendment No. 1 to Agreement No. 24-2397 with DG Civil Engineering, Inc. to provide additional plan check review services for the Smith Park Aquatic Center Renovation Project, CIP No. 50043 for an additional $92,400, bringing the total contract amount not to exceed $128,400, and authorizing the City Manager to execute Amendment No. 1.

Subject: AMENDMENT NO. 3 TO THE PROFESSIONAL SERVICES
AGREEMENT NO. 22-2138 WITH DUDEK FOR THE
COMPREHENSIVE UPDATE OF TITLE 18, ZONING, OF THE PICO

RIVERA MUNICIPAL CODE
Recommendation:

1. Approve Amendment No. 3 to Professional Services Agreement No. 22-2138 with Dudek to extend the term of the agreement to December 31, 2025; and

2. Authorize the City Manager to execute Amendment No. 3 in a form approved by the City Attorney for a term of one (1) year with a second-year extension option if required.

Fiscal Impact:

There is no fiscal impact on the General Fund as the proposed amendment only extends the expiration date and does not involve additional funding.

Background:

Staff is requesting approval of Amendment No. 3 for the Comprehensive Zoning Code Update to extend the expiration date for completing the update to December 31, 2025.

The extension will allow for required public hearings, continued robust public participation and a flexible timeframe to complete all deliverables.

Discussion:

On November 8, 2022, the City entered into a Professional Services Agreement with Dudek to prepare City wide Design Standards and Guidelines for residential, commercial, industrial, and mixed-use development. Planning Division staff began the effort in earnest, which included a thorough review of Title 18 Zoning to understand how best to incorporate the guidelines section into the Municipal Code. The exercise to review a policy document last updated in 1993 led staff to the conclusion that a comprehensive update to Title 18 12 CITY COUNCIL AGENDA REPORT – MEETING OF MAY 27, 2025 AMENDMENT NO. 3 TO THE PROFESSIONAL SERVICES AGREEMENT NO. 22-2138 WITH DUDEK FOR THE COMPREHENSIVE UPDATE OF TITLE 18, ZONING, OF THE

PICO RIVERA MUNICIPAL CODE

would be necessary to best accommodate the proposed new standards and guidelines.

Toward this end, the following amendments were approved:

1. On September 12, 2023, the City Council approved Amendment No.1 to expand the agreement for city-wide Design Standards and Guidelines to include a Comprehensive Zoning Code Update.

2. On September 10, 2024, the City Council approved Amendment No. 2 to authorize an Addendum to the 2014 General Plan Environmental Impact Report to ensure the Comprehensive Zoning Code Update attained California Environmental Quality Act (CEQA) compliance.

While staff anticipates completing the project by the Fall of 2025, the extended timeline allows ample time for robust public outreach, public hearings and stakeholder involvement. The proposed amendment only extends the expiration date and does not involve additional funding.

The table outlines the contract values and amendments approved to date:

Environmental Analysis:

The amendment to the Professional Service Agreement is exempt from the CEQA pursuant to State CEQA Guidelines Section 15060(c)(3) because it is not a project as defined by the CEQA Guidelines Section 15378. Here, it can be seen with certainty that there is no possibility that the proposed amendment, in and of itself, will have a direct physical change in the environment or reasonably foreseeable indirect physical change in the environment.

Agreement/Amendment Amount
Agreement No. 22-2138 $300,000.00
Amendment No. 1 $213,940.00

Conclusion:

Staff recommends that the City Council approve Amendment No. 3 Agreement No. 22- 2138 with Dudek, to extend the expiration date to December 31, 2025, and a one (1) year extension with a second-year extension option if required.

Subject: Amendment No. 2, Comprehensive Zoning Code Update Dear Estefany Franco,
Dudek is pleased to provide the following scope of services for California Environmental Quality Act (CEQA) review and clearance for the Comprehensive Zoning Code Update (CZCU) project. Dudek understands City staff is concurrently revising necessary zoning changes for the CZCU project in the following zones, Community Commercial (C-C), Neighborhood Commercial (C-N), Residential Multiple-Family (R-M) zones, Mixed Used Overlay Zone and R-40 Overlay Zone and amending the General Plan for zone name consistency.

Amendment No. 2 – Scope of Services
PREPARATION OF ADDENDUM TO THE OCTOBER 2014 GENERAL PLAN EIR The Comprehensive Zoning Code Update is considered a “Project” under CEQA and will require environmental clearance. While changes to the Zoning Code will be consistent with the General Plan, Dudek will prepare an Addendum to the October 2014 General Plan EIR to document that minor changes and/or additions to the Zoning Code are necessary for consistency with the General Plan and that none of the conditions identified in CEQA Guidelines Section 15126 calling for the preparation of a Subsequent EIR or Mitigated Negative Declaration (MND) have occurred. It is not anticipated that the proposed changes would result in new significant impacts, substantial increases in previously identified significant impacts, or the requirement for new mitigation measures.

Therefore, an Addendum, rather than a Subsequent EIR, is appropriate. In accordance with CEQA Guidelines Section 15164(e), the Addendum will include a brief explanation of the decision not to prepare a Subsequent EIR or MND pursuant to Section 15162, and the explanation will be supported by substantial evidence. Dudek will utilize the CEQA Guidelines Appendix G to document that no new or different impacts other than those previously considered in the 2014 General Plan EIR will occur. The Addendum need not be circulated for public review, will be made available to decision makers, and may simply be attached to the adopted General Plan EIR.

Task 1.2 Deliverables
• One (1) combined in-person kickoff meeting and city tour held over the course of a day, led by City Staff and attended by select Dudek key personnel
TASK 2: EXPANDED REVIEW AND EVALUATION
TASK 2.1 CITY STAFF INTERVIEWS

2.1.1 City Staff Interviews Round 1
Dudek values the insight that City staff has to offer as those who are implementing the zoning code on a day-today basis. Therefore, Dudek will conduct interviews with key City staff from the Community and Development Department, Public Works Department, or other relevant departments to get a better understanding of the existing technical issues or interpretations from City staff; concerns, effectiveness, and usability of the existing design standards, guidelines, processes, and enforcement; and overall aspirations for the project. The feedback received from City staff during these open and informal interviews will be used to identify areas of opportunities, highest priorities for the project, and staff's overarching desires for the project. Dudek assumes that the City Staff interviews will be scheduled via Zoom. The City will identify potential interviewees and be responsible for scheduling interviews. Dudek staff will facilitate interviews and take notes.

Task 2.1.1 Deliverables

The feedback received from City staff during these open and informal interviews will be used to identify areas of opportunities and highest priorities that the zoning code update should address. Dudek assumes that the City Staff interviews will be scheduled via Zoom. The City will identify potential interviewees and be responsible for scheduling interviews. Dudek staff will provide interview questions prior to the interview meeting, facilitate interviews, and take notes. A summary of key interview takeaways to be incorporated into Expanded Code Diagnostic Analysis. --------------------------- ---------- Proposal Title A-3 DUDEK
Task 2.1.2 Deliverables
• (2) 1-hour interviews with key City staff with key findings and recommendations to be incorporated into the Expanded Code Diagnostic Analysis.

TASK 2.2 GENERAL PLAN CONSISTENCY REVIEW
Dudek will work closely with City staff to develop a comprehensive understanding of the existing regulatory framework for development in the City. Our team will conduct a thorough review of the General Plan to confirm consistency with goals and implementation policies, assess for conflicts/inconsistencies related to land use and intensities/densities, and identify locations for zone changes, consolidation of zones, application of existing base zones, or creation of new zones. The General Plan will also be reviewed for consistency with State law. The summary of General Plan Consistency Review be incorporated into Expanded Code Diagnostic Analysis.

Task 2.2 Deliverables
• Review of General Plan consistency with key findings and recommendations to be incorporated into the Expanded Code Diagnostic Analysis.

TASK 2.3 EXPANDED CODE DIAGNOSTIC ANALYSIS
Task 2.3.1 - Document Review
Dudek will work closely with City staff to develop a comprehensive understanding of the existing regulatory framework for development in the City. Our team will conduct a thorough review of all relevant documents and data. This will include an analysis of the data received from City staff as part of Task 1, along with any other relevant planning efforts currently underway by and within the city. In addition, the team will conduct an indepth technical review of the City's adopted policy documents, guidelines, standards and regulations, and procedures, as they relate to the existing design standards and guidelines that govern the development of single- and multiple-family residential, mixed-use, commercial, and industrial uses. The team will consider the objectivity of existing design standards and determine which standards are effective in implementing the City's vision for development and where revisions may be needed. Existing documents, guidelines, standards, and regulations that may be reviewed include the following:
• General Plan, Chapter 2 Core Values and Guiding Principles and Chapter 3 Land Use Element (2014) • 2021-2029 Housing Element
• 5-Year Strategic Plan, Strategic Priorities, Goals, and Strategies • Pico Rivera Urban Greening Plan
• Support goals for trees along commercial corridors, neighborhood streets, bike rack design, and Pico Rivera Street Design Toolbox
• Pico Rivera Municipal Code, Title 18, Zoning
• Chapter 18.42 PROPERTY DEVELOPMENT REGULATIONS
Proposal Title A-4
DUDEK
Building upon the insight and knowledge gained through the City tour and the City staff interviews from Task 1, as well as the findings of the review of relevant data, regulations, policies, and additional documentation, the team will synthesize this information in the form of a memorandum that will include a summary of key findings and recommendations. The recommendations will consider where revisions to adopted regulations may be needed, where opportunities for codifying informal requirements or guidelines may exist, and where new design standards that are clear, objective, in conformance with state law, and consistent across the City's policy documents, design guidelines, and development standards and regulations, including the City's General Plan are needed. The outcome of Task 2.3.1 will be a code diagnostic with findings from the evaluation and recommendations for the City to consider to improve the development review and permitting process.

Task 2.3.1 Deliverables
• Review of key documents with findings and recommendations to be incorporated into the Code Diagnostic Analysis
Task 2.3.2 - Current Project Review
Dudek understands that expedited processing can occur through multiple avenues and that both regulatory processes and internal procedures can affect the time associated with development permitting. While the time allocated to cities to review development permits may be regulated under state law (i.e., 60 days to act on an ADU application or 60 days to determine consistency for a proposal under SB 35), internal procedures or limited staffing may make such timeframes challenging. Dudek will review development permit data and project applications provided by City staff that are currently under review. Through this review, Dudek will evaluate development proposals to fully understand how existing development standards are presently being interpreted and applied during the permit review process. Based on the review of recent permit data, current project applications, and the understanding of internal permit review procedures gained during the City staff interviews in Task 1, Dudek will evaluate the existing development permit processes to determine which existing processes are furthering the City's goal of having clear and consistent project review and permitting procedures. The evaluation will consider existing processes through the lens of state legislative requirements to determine where existing regulatory processes may be in conflict with requirements under state law and will identify further areas for improvement and opportunities for increased clarity to increase certainty in the development review process and maximize efficiency for streamlined review or improved permitting processes. We understand that the City will be deploying an online permitting website in the near future; this will be taken into consideration as part of the evaluation. The outcome of Task 2.3.2 will be a code diagnostic with findings from the evaluation and recommendations for the City to consider to improve the development review and permitting process.

Task 2.3.2 Deliverables
• Review of current projects with findings and recommendations to be incorporated into the Code Diagnostic Analysis
Task 2.3.3 Expanded Code Diagnostic Analysis
Proposal Title A-5

D U DEK
The Dudek will expand on the design focused document review and current project review in Task 2.3.1 and Task

2.3.2 to assess the City zoning code, such as identifying and incorporating Zone Text Amendments, streamlining of Administration/Permit Procedures, updating Land Use Chart and definitions, assessing usability of all Development Standards (not just Design Standards), etc., and review for compliance with State law, including accessory dwelling units and density bonus.

Task 2.3.3 Deliverables
• (1) Draft and (1) Final Code Diagnostic with key findings and recommendations from the analysis of the City's existing city documents and residential, mixed-use, commercial, and industrial standards, regulations, and design standards and guidelines and current project review. • (1) Draft and (1) Final Expanded Code Diagnostic Analysis with key findings and recommendations.

TASK 2.4 ANNOTATED ZONING CODE OUTLINE
Dudek understands that a comprehensive code update and reorganization of the code may result in a reorientation period for City staff. Based on findings from the Expanded Code Diagnostic Analysis (Tasks 2.1 - 2.3) and the recommended approach, Dudek staff will create an annotated outline of the new Zoning Code with descriptions for each proposed chapter and section. Dudek will also create a before/after reference table to illustrate how content in the current code is organized into the new code.

Task 2.4 Deliverables
• (1) Draft and (1) Final Annotated Outline with before/after reference table.

TASK 3: USE REGULATIONS
TASK 3.1 USE REGULATIONS AND ZONE TEXT AMENDMENTS
Based on findings and initial recommended changes from Task 2.3 (Expanded Zoning Code Diagnostic Analysis), Dudek will update existing or create new land use categories; draft regulations by zone, noting zone permissions, approvals process required, e.g., CUP, etc.; and draft regulations for special use conditions, including specific Zone Text Amendments per City direction as follows:
• Massage Parlors, Research and create new ordinance.
• Car Washes, Research and create new ordinance.
• Auto Repair Shops, Research and create new ordinance. • Recycling Centers, Update existing ordinance.
• Animals/Poultry/Livestock, Update existing ordinance to modernize. Note: Focus on issues with animal confinement, health/safety, etc.
• Water Efficient Landscape, Update existing ordinance. Transfer from Title 13 to Title 18. Expand ordinance to address landscaping in the public realm.
• Shopping Carts, Research and create new ordinance.

Proposal Title A-6

D U DEK
• Shopping Center Maintenance, Research and create new ordinance. Note: Existing issues with small strip centers that do no maintain their property well, e.g., re-striping of parking, lighting, awnings, etc. • Drive-Thru's, Research and create new stand-alone ordinance or consider folding into Design Standards and Guidelines.
• Outdoor Dining, Research and create new ordinance.
• Parking & Loading, including parking lot outdoor lighting, Update existing ordinance.

City staff and Dudek team will coordinate timing for additional City-led Zone Text Amendment efforts to ensure proper timing and location of implementation.

Task 3.1 Deliverables
• Work for this task to be incorporated into an Administrative Draft, Public Review Draft, and Final Draft of the new Zoning Code, while also addressing comments from the City and the public where appropriate.

TASK 4: DEVELOPMENT STANDARDS & DESIGN GUIDELINES
TASK 4.1 DEVELOPMENT STANDARDS
Dudek will draft new objective development standards as necessary per zone for residential, commercial, mixeduse, and industrial uses, and consider possible revisions to core development standards, such as FAR/density, and parking, dependent on the approach established by the Expanded Code Diagnostic Analysis and consistent with the 2014 General Plan. As needed, new objective development standards will be informed by prototypical site testing (Task 4.2.2) and supplemented by graphics, diagrams, lists, and tables as necessary.

Task 4.1 Deliverables
• Work for this task to be incorporated into an Administrative Draft, Public Review Draft, and Final Draft of the new Zoning Code, while also addressing comments from the City and the public where appropriate.

TASK 4.2 DESIGN STANDARDS AND GUIDELINES

4.2.1 - Design Standards & Guidelines
Paired with the work in Task 4.1 (Development Standards), Dudek will draft new design standards and guidelines as necessary per zone. Our team will build upon the City's existing development and design standards to create a set of regulations that balance flexibility and predictability, creating a streamlined pathway for development that meets the needs of the City. Dudek will develop a set of enforceable regulations that will be measurable and verifiable for incorporation into the City's Zoning Code. These regulations will allow flexibility through the provision of measurable ranges and a menu of options within standards allowing flexibility to avoid monotonous and undesirable development. Standards developed through this process will be reinforced through a User's Guide that provides clear, legible graphics and additional reference materials to support the implementation of the standards and guidelines, as outlined in Task 8.3
Proposal Title A-7
DUDEK
The draft design standards and guidelines will incorporate objective standards for single-family, multifamily, mixed-use, commercial, and industrial uses, responding to the building styles and typologies that are common to the City. Draft standards will address the codification of formal and informal design standards related to site planning, such as building orientation and building massing and elements, such as setbacks and step-backs, building frontages, fa~ades, entrances, materials, landscaping and screening, fencing, signage, open space, and parking design, such as location, screening, and access, as well as EV charging station design. Diagrams and illustrations will accompany the design standards and guidelines to help communicate their intent and function.

In tandem with the objective development standards, Dudek assumes objective design standards and guidelines for applicable residential, commercial, mixed-use, and industrial use zones.

4.2.2 - Prototypical Site Testing
Having trained and practiced as architects, our urban designers and planners are adept at both utilizing and creating objective development standards and design guidelines. For this task, our team will test the usability and feasibility of appropriate building typologies per zone (e.g., townhouse, podium, wrap, etc.) for both the draft development standards and design standards and guidelines established in Task 4.1 and 4.2.1. Studies will focus on those fundamental development and design standards that have the potential to physically inhibit future development, such as building height maximums, setbacks and step-backs requirements, and provisions for parking and open space (Dudek assumes that any recommended changes to standards resulting from these studies will be consistent with the 2014 General Plan) Studies will be represented as conceptual-level site plans and/or 3D axonometric diagrams, paired with program breakdowns as necessary illustrating constraints to the achievable yield of units, floor area square footage, parking, and open space. In doing so, this task will reveal any regulatory barriers the draft development standards and design standards and guidelines may present to future development.

Task 4.2 Deliverables
• Work for this task to be incorporated into an Administrative Draft, Public Review Draft, and Final Draft of the new Zoning Code, while also addressing comments from the City and the public where appropriate.

TASKS· ADMINISTRATION AND ENFORCEMENT
TASK 5.1 ADMINISTRATION AND PROCEDURES
Dudek will update existing or establish new provisions for roles and responsibilities for all zoning actions, e.g., City Council, Planning Commission, Zoning Administrator, Director, etc. Dudek will also update existing or establish new provisions for administration and procedures for all zoning actions, such as permits, approvals, and appeals, from ministerial to discretionary, including lot mergers, conditional use permits, variances, and zone amendments. Dudek understands that there are no existing provisions for a Design Review process and will establish new provisions ensuring that a Design Review process for residential and mixed-use projects do not conflict with State law. Dudek will also establish new provisions for Developer Agreements.

Proposal Title A-8
DUDEK
Task 5.1 Deliverables
• Work for this task to be incorporated into an Administrative Draft, Public Review Draft, and Final Draft of the new Zoning Code, while also addressing comments from the City and the public where appropriate.

TASK 5.2 ENFORCEMENT

Dudek will prepare an Administrative Draft of the new Zoning Code for City Staff, Working Group, and Planning Commission review based on work completed in Tasks 3 through 5, including graphics and tables, etc. To better manage/pace input received, Dudek recommends a phased approach to prepare the Administrative Draft in sections that coincide with the City Staff, Working Group, and Planning Commission Study Sessions listed in Task

6.2. At the conclusion of the Study Sessions, Dudek will prepare a complete and comprehensive Administrative Draft of the new Zoning Code for City Staff and Planning Commission review.

Task 6.1 Deliverables
• (1) Administrative Draft of the new Zoning Code for City Staff and Planning Commission review, with comments to be incorporated into Public Review Draft.

TASK 6.2 STUDY SESSIONS & WORKING GROUP

6.2.1 Study Session Rounds
Proposal Title A-9
DUDEK
To better manage/pace input received while drafting the Administrative Draft, Dudek will facilitate four (4) rounds of study sessions and focused meetings with City Staff, Working Group, Planning Commission, and City Council. The purpose of each of the Study Sessions is to provide each group with an update on the work completed to date and provide opportunities for input on the ongoing drafting of the Administrative Draft. Each round will consist of one (1) study session each with City staff, the Working Group, and Planning Commission, totaling up to four (4) City staff study sessions, up to four (4) Working Group study sessions, and up to four (4) Planning Commissions study sessions. Preliminary topics for each of the four (4) rounds of study sessions are listed below:

1. Introduction to Zoning Code Update, issues with existing Zoning Code, draft Zoning Code outline and summary of recommended changes by topic, chapter, and/or section

2. Zoning Map Updates and Use Regulations

3. Development Standards and Design Guidelines

4. Administration and Procedures, and User's Guide
For each round of study sessions, Dudek will develop and prepare a presentation summarizing the work completed to date based on the topics listed above. This presentation will first be used primarily for the City staff study session, and then revised (per City staff comments) and presented anew to the subsequent groups - Working Group, Planning Commission, and City Council - for additional input. Therefore, Dudek assumes one (1) round of City staff review and revisions to the presentation for each round of study sessions.

The last round of study sessions will culminate in one (1) study session with City Council to provide them a comprehensive summary of the work completed to date prior to the completion of the Administrative Draft.

Based on prior comments, Dudek will develop a draft and final presentation for the City Council study session and assist in preparing the necessary staff report for the City Council study session as needed.

Dudek assumes that City staff study sessions will be conducted virtually, while up to two (2) Senior Dudek staff will present in-person at the Planning Commission study sessions and City Council study sessions as needed.

TASK 9: OUTREACH AND ENGAGEMENT
TASK 9 .1 PUBLIC OUTREACH PLAN & EVENTS

9.1.1 Outreach and Engagement Plan
Proposal Title A-12
DUDEK
Dudek will work with City staff to draft the Outreach and Engagement Plan and establish a comprehensive approach for the Zoning Code Update and Citywide Design Standards and Guidelines. The Outreach and Engagement Plan will clarify the intended goals and objectives of the outreach process and define the desired outcomes such as awareness, education, accessibility, feedback, and involvement as part of the initial project kick-off. Example topics and content to be included in the Outreach and Engagement Plan include:
• Overview of Activities and Events: Including a high-level overview of the outreach events with the broader community, as well as the more focused conversations with the Working Group. Per City direction, the format of the outreach events included in this scope of work will be determined in collaboration with the Working Group. Dudek will also collaborate with the consultant team leading the Historic Whittier Boulevard Specific Plan and Multimodal Plan effort to understand that project's outreach efforts and potentially find opportunities for synergies as we understand there is a robust engagement program. • Schedule: Based on the project timeline to ensure that outreach and community engagement activities and events occur in a timely manner and contribute to the momentum and enthusiasm for this project.
• Marketing: To publicize the project and each outreach event. We recommend utilizing the City's existing social media channels and website as a go-to hub for project information, updates, upcoming outreach events, and any deliverables or work products determined by the City as suitable for online dissemination. In addition to sharing updates on the City's website, we will work with LANI to create and share email blasts, printed flyers posted in business windows or at community destinations with the City and create notices/mailers as appropriate to the community. We can also activate the public realm with marketing materials through banners, sidewalk decals, even with a vacant storefront window display decal that can share up-to-date project information. We have found this "on the ground" tactic to be extremely successful in raising awareness and interest for a project. • Project Brand: Dudek we will work with City staff to establish a project brand and consistent graphic identity for the Zoning Code Update and Citywide Design Standards and Guidelines for all project and outreach collateral, to effectively engage stakeholders throughout the project. This will include a style guide for project-specific fonts, colors, layout formats, and messaging for digital as well as print media for all engagement activities and public facing materials.

The Outreach and Engagement Plan is intended to serve as a flexible and living document that can provide a roadmap for the outreach and engagement process, allowing for redirection or variations where needed.

Task 9.1.1 Deliverables
• One (1) Outreach and Engagement Plan with an overview of activities, a schedule, marketing, and a project branding and style guide
Task 9.1.2 Project Fact Sheets and Collateral
Proposal Title A-13
DUDEK
To encourage community members to learn about the project and engage with informational content in their own time, Dudek will develop a series of project fact sheets and collateral for integration on the City's website.

Dudek will work with City staff to prepare project fact sheets and collateral related to design standards and guidelines. Building off those documents, Dudek will update the project fact sheets and collateral to include information about the Zoning Code Update. Example fact sheets and collateral include (1) About the project, (2) What is the Zoning Code Update, and (3) Project timeline. Dudek assumes creation of all content and assumes that the City will integrate content within a landing page on the City's website.

Task 9.1.2 Deliverables
• (1) Fact Sheet and (1) Project FAQs for design standards and guidelines • (1) Fact Sheet and (1) Project FAQs for the comprehensive project, Zoning Code update Task 9.1.3 Outreach Events
Based on the Outreach and Engagement Plan developed in collaboration with City staff, Dudek will schedule, plan, and conduct at least two (2) and no more than three (3) public outreach events, as described in Task 9.2, to collect input from the broader community. We envision our outreach efforts phased across three rounds of input. The first round will focus on general education, information, and opportunities to collect input on issues, constraints, and opportunities in the built environment, the second round will be conducted at a mid-point in time to share progress on the drafting of the Zoning Code update, and a third round to be held in conjunction with the release of the Public Review draft.
• Event#1
During the first round of outreach, Dudek will facilitate one (1) public outreach event, ideally in conjunction with an existing outdoor community event to reach a wider audience. The format and design specifics of the event will be selected in collaboration with the City and the Working Group. The first event will be held after the research and review phase of the project has been completed and will be focused on understanding issues, opportunities, and goals for the project from the broader community so Dudek can obtain early feedback to inform the process. We will have Spanish speakers available at the event, along with English and Spanish translated materials. A combination of Dudek, LAN I, and City staff will staff the event. Materials will be interactive, colorful, and accessible to encourage greater participation and conversation. A mix of questions and feedback activities will be included to gather community input to shape the process.

We will launch a short online community survey in conjunction with the first event to share community members the opportunity to provide input on issues, opportunities, and goals for the project. Dudek will work with the City to determine the preferred online platform. The survey will be shared on all available City channels and be accessible via the landing page for the project within the City's website. If printed versions of the surveys are desired, Dudek assumes that the City will be responsible for printing and distribution.

Proposal Title A-14
DUDEK
• Event#2
During the second round of outreach, Dudek will facilitate (1) public outreach event, ideally in conjunction with an existing outreach community event to reach a wider audience. The event will be held at a mid-point in time during the preparation of the Administrative Draft and will focus on informing the community about the Zoning Code update, providing them with an update on the work completed to date, and invite their input. We will have Spanish speakers available at the second event, along with English and Spanish translated materials. A combination of Dudek, LANI, and City staff will staff the event. We will also launch a short online community survey in conjunction during the second event as agreed upon with the City. If printed versions of the surveys are desired, Dudek assumes that the City will be responsible for printing and distribution.

Task 9.1.3 Deliverables
• At least two (2) and no more than three (3) public outreach events coinciding with existing or planned community events (if possible). Dudek will develop outreach materials, including boards, and summaries, as well as provide necessary materials and supplies as relevant. Dudek will work with City staff to finalize locations, scheduling, planning and logistics for each event and staff each event with support from LANI and City staff. We will coordinate with City staff on logistics and marketing. We will have Spanish speakers available at each event, along with English and Spanish translated materials. • Draft and Final community surveys for the two (2) public outreach events. Dudek will work with the City to determine the preferred platform. If printed versions of the surveys are desired, Dudek assumes that the City will be responsible for printing and distribution.

TASK 9.2 ADDITIONAL PUBLIC OUTREACH EVENT
During the third round of outreach, Dudek will facilitate an additional (1) public outreach event, ideally in conjunction with an existing outreach community event to reach a wider audience. The event will be held in conjunction with the release of the Public Review Draft of the new Zoning Code and will focus on providing the community a comprehensive summary of the changes to the Zoning and inviting them to public comment. We will have Spanish speakers available at the second event, along with English and Spanish translated materials. A combination of Dudek, LANI, and City staff will staff the event.

Task 9.2 Deliverables
• Deliverables for the work for this task are described in Task 9.1.3.

The following information is a summary of activity in your account(s) for the month of April 2025 and the list of FDIC-insured institution(s) that hold your deposits as of the date indicated. These deposits have been placed by us, as your agent and custodian, in deposit accounts through IntraFi Cash Service. Funds in your deposit accounts at the FDIC-insured institutions at which your funds have been placed will be "deposits," as defined by federal law. Certain conditions must be satisfied for "pass-through" FDIC deposit insurance coverage to apply. To meet the conditions for pass-through FDIC deposit insurance, deposit accounts at FDIC-insured banks in IntraFi's network that hold deposits placed using an IntraFi service are titled, and deposit account records are maintained, in accordance with FDIC regulations for pass-through coverage.

To: Mayor and City Council
From: City Manager
Meeting Date: May 27, 2025
Subject: TREASURER’S MONTHLY INVESTMENT TRANSACTION
REPORT AS OF APRIL 30, 2025
Recommendation:

1. Receive and file the Treasurer’s Monthly Investment Transaction Report as of April 30, 2025.

Fiscal Impact:

There is no fiscal impact to the General Fund.

Background:

Per the City of Pico Rivera (City) Investment Policy, approved by the City Council on June 11, 2024, the City Treasurer submits a monthly investment transaction report to the City Council within 45 days of the end of the reporting period, in accordance with California Government Code Section 53607.

Discussion:

This report updates the City Council on the City’s monthly transactions of the City’s investment portfolio for the month ending April 30, 2025. The enclosed statements include transactions of the City’s investments with the Local Agency Investment Fund (LAIF), Chandler Asset Management, and Commercial Bank of California (Enclosures 1, 2, and 3).

On May 16, 2025, Moody’s downgraded the U.S. credit rating from Aaa to Aa1 with a Negative outlook, reflecting concern over rising government debt and fiscal challenges.

Agency bonds and securities generally carry the same rating as the U.S. government, which is currently rated Aa1 by Moody’s, and AA+ by both S&P and Fitch Ratings. While this action does not immediately impact the legality of holding U.S. Treasury or agency securities under California Government Code Section 53601, staff will continue to monitor and work with the City’s investment advisor to ensure the investment portfolio is sound. 13 CITY COUNCIL AGENDA REPORT – MEETING OF MAY 27, 2025 TREASURER’S MONTHLY INVESTMENT TRANSACTION REPORT AS OF APRIL 30, 2025

Page 2 of 2 ends

Conclusion:

As of April 30, 2025, the City’s portfolio remains highly rated, liquid, and stable. All investments are maintained in accordance with California Government Code Section 53601 and the City’s investment policy, which was approved by the City Council on June 11, 2024.
