All Occasions Services is pleased to submit this proposal to serve as the City of Pico Rivera’s lead event production partner for the 2026 Celebration Hub during the FIFA World Cup. We recognize that this event represents far more than a single weekend activation — it is a benchmark opportunity to support PR 2035, strengthen community pride, advance cost-recovery strategies, and establish a scalable framework leading into the 2028 Olympic and Paralympic Games.

Budget: Approximately $105,000
All Occasions Services | City of Pico Rivera Special Event Planning & Management Services |4 Event Overview
Fiesta de los Peñasquitos is a large-scale, open-streets community parade and festival that temporarily closes major roadways to vehicular traffic and transforms the corridor into a pedestrian-focused civic celebration. In the past, the event featured a multi-division parade, live music stages, youth programming, vendor marketplace, food court, sponsor activations, and family-oriented activities.

Services Managed In-House
All planning and coordination were performed by All Occasions Services, including:
● Master event planning and timeline development
● Vendor acquisition and management
● Entertainment booking and stage programming
● Parade route design and staging
● City liaison and stakeholder coordination

Management Approach
AOS utilized a structured project management framework with milestone tracking, weekly coordination meetings, and a centralized communication system to align public safety, vendors, and production teams. The event was executed under a scalable safety plan to accommodate peak attendance surges while maintaining operational flexibility.

Unique Challenge & Strategic Solution
The parade route required complex traffic detours affecting multiple neighborhoods. AOS coordinated closely with public works and law enforcement to design staggered road reopening strategies.

Budget & Schedule Performance
All Occasions Services | City of Pico Rivera Special Event Planning & Management Services |5 The event was delivered on schedule and within the approved budget through proactive vendor contracting, early procurement pricing, and conservative contingency planning.

2. A Day at the Park – Pepper Park Multi-Cultural Festival Client: San Diego Unified Port District
Location: National City, CA (San Diego County)
Attendance: 5,000+
Budget: Approximately $70,000
Event Overview
This waterfront cultural festival required coordination with multiple agencies including public safety, port authorities, and environmental compliance bodies.

Unique Circumstance & Solution
Three days prior to the event, inclement weather required postponement. Transparent communication and flexible contract structures allowed the event to be successfully re-executed within revised parameters.

Record of Performance
All events referenced above were delivered:
● Within approved budget
● Within defined scope
● In compliance with municipal permitting requirements
● Without public safety incidents
Record of Negotiation & Cost Containment
In multiple instances, municipal stakeholders requested scope adjustments due to budget constraints. AOS worked collaboratively with city partners to:
● Re-sequence entertainment programming
● Adjust infrastructure layout
● Modify staging requirements
● Increase vendor revenue offsets
These negotiated compromises preserved the integrity of the event while maintaining financial sustainability.

● Clear reporting to City staff
● Real-time visibility into revenue performance
● Alignment between estimated and actual event financials Our process prioritizes financial discipline over complexity, ensuring the City maintains full understanding of revenue pathways and cost offsets.

Development of an Event Operations Framework
Although AOS does not maintain a pre-packaged operations manual, we develop event-specific documentation throughout the planning and implementation process, including:
● Site maps and infrastructure layouts
● Staffing schedules and role assignments
● Load-in and load-out timelines
● Public safety coordination summaries
● Vendor and sponsor performance tracking
Following the event, these materials can be consolidated into a structured operational summary to support the City’s evaluation and long-term planning objectives.

This approach ensures that documentation reflects the actual event conditions rather than a generic template.

Procedural Risk Mitigation Practices
AOS utilizes established event management practices, including:
● Incident action planning
● Defined command structure coordination
● Clear communication protocols
● Vendor contract enforcement mechanisms
● Contingency planning for weather and attendance surges All Occasions Services | City of Pico Rivera Special Event Planning & Management Services | 16 These practices have allowed AOS to deliver events without public safety incidents and to adapt effectively when circumstances required rapid adjustment.

All Occasions Services | City of Pico Rivera Special Event Planning & Management Services | 17 Proposed Fee Structure and Revenue
Sharing Framework
All Occasions Services is committed to providing flexible, transparent, and fiscally responsible event production services that align with the City of Pico Rivera’s operational preferences, budgeting practices, and long-term event strategy. Based on our experience supporting municipal partners, we offer two primary fee structure options: (1) a Project-Based Production Fee Model and (2) a Turnkey Event Budget Model. Each structure is designed to provide clarity, accountability, and scalability depending on the City’s desired level of administrative involvement and financial certainty.

Option 1: Project-Based Production Fee Model
Under the Project-Based Production Fee Model, All Occasions Services provides scalable event production services based on the level of planning, coordination, operational oversight, and program development required. Production fees are structured as a percentage of the total approved event budget and correspond directly to the scope of services requested by the City.

This structure provides flexibility, transparency, and the ability to align production services with the operational complexity, timeline, and overall objectives of each individual event.

Tier 1: Core Production Management (15%–20%)
The Core Production Management tier includes professional event planning, coordination, and executive-level operational oversight necessary to support successful event delivery. This tier includes recruitment and management of entertainment and procurement and management of operational service vendors required to support event infrastructure.

Meeting Date: March 10, 2026
Subject: CALIFORNIA HIGH-SPEED RAIL AUTHORITY – AMENDMENT NO. 1 TO REIMBURSEMENT AGREEMENT HSR24-26
Recommendation:

1. Authorize the City Manager, or his designee, to execute Amendment No. 1 to Reimbursement Agreement HSR24-26, in a form approved by the City Attorney, with the California High-Speed Rail Authority (HSRA) for the reimbursement of City costs associated with the review of project submittals and coordination with HSRA.

Strategic Priority:
3 - Infrastructure - Plan, fund, build, and maintain reliable and cost-effective infrastructure that contributes to enhancing quality of life.

Strategy:

3.3 Complete construction of necessary infrastructure projects to implement master plans in a timely manner.

Fiscal Impact:

Approval of Amendment No.1 to the Reimbursement Agreement HSR24-26 will allow the City to invoice the California HSRA for eligible costs incurred, such as staff time and consultant service fees, related to the review of project documents and coordination activities associated with the high-speed rail program. Although the total reimbursable amount cannot be estimated, any reimbursements received will be credited to Account No. 699.00.000.45000-CIP50029.

Discussion:

The California HSRA is responsible for the planning, design, construction, and future operation of the nation’s first high-speed rail system. As part of this effort, HSRA has initiated a detailed study of the Los Angeles–Anaheim segment, including the portion that 5 Back to Agenda Outline

traverses the City of Pico Rivera. Within the City, the alignment generally follows the Burlington Northern Santa Fe Railway right-of-way, which runs in an east–west direction north of Slauson Avenue.

The proposed Amendment No. 1 to the existing agreement establishes a new reimbursement threshold in an amount not-to-exceed $75,000 and extends the term of the agreement through April 30, 2027. This agreement provides a funding mechanism for the City to be reimbursed for staff time and consultant services required to review technical studies, legal and right-of-way documents, design plans, and other projectrelated materials associated with the project’s planning, design, and construction.

Execution of this reimbursement agreement is strictly administrative and financial in nature. It does not constitute or imply the City’s support for the high-speed rail project.

Furthermore, it does not affect the City’s policy or legal position, nor does it limit the City’s ability to review, comment on, or express concerns regarding the project during the public review process for environmental documents.

Conclusion:

To remain actively engaged in the planning and design phases of the high-speed rail project, staff recommend the execution of Amendment No. 1 to Reimbursement Agreement HSR24-26 with the California High-Speed Rail Authority.

To: Mayor and City Council
From: City Manager
Meeting Date: March 10, 2026
Subject: AMENDMENT NO. 3 TO AGREEMENT NO. 24-2348 WITH
SOUTHWEST PATROL, INC. FOR ARMED SECURITY SERVICES
Recommendation:

1. Approve Amendment No. 3 to Agreement No. 24-2348 with Southwest Patrol, Inc. for armed security services for an additional amount of $200,000 for a total not-toexceed amount of $918,000 through June 30, 2026; and

2. Authorize the City Manager to execute the amendment in a form approved by the City Attorney.

Strategic Priority:
4 - Health, Wellness & Safety - Create a safe and thriving City with low crime and high standards for health and wellness.

Strategy:

4.2 Promote public safety to foster a secure community.

Fiscal Impact:

The proposed amendment provides for an additional $200,000 in compensation to Southwest Patrol, Inc. for armed security services from March 10, 2026, through June 30, 2026. The $50 hourly rate remains unchanged from prior amendments, and sufficient funding is available in the fiscal year (FY) 2025-26 Public Safety Budget, Account No. 100.15.1500-54500 (Contract Services). No additional appropriation is needed at this time.

Background:

In February 2022, the City of Pico Rivera (City) adopted a Strategic Plan that identified five key priorities, with community health, wellness, and public safety at the forefront. This guiding vision underscored the City Council’s commitment to creating a safe and secure 6 Back to Agenda Outline

environment for all residents, visitors, and businesses. Subsequent voter approval of Measure AB in November 2022 further demonstrated the public’s support for enhanced public safety investments and provided the fiscal resources necessary to implement targeted initiatives.

As part of the City’s proactive strategy to address emerging public safety challenges, staff observed a growing number of quality-of-life complaints from residents and businesses, particularly related to after-hours loitering, theft, and homelessness-related activity in high-traffic commercial corridors and public facilities. While the Los Angeles County Sheriff’s Department continues to provide essential law enforcement services, the City recognized the need to supplement its capacity with dedicated, high-visibility security personnel capable of providing targeted deterrence and engagement in problem areas.

In May 2024, the City entered into Professional Services Agreement No. 24-2348 with Southwest Patrol, Inc. under a pilot program to provide armed security services.

Southwest Patrol was selected based on its long-standing experience providing similar services to other cities and school districts across Southern California and its ability to offer services at competitive rates through a cooperative agreement with the City of Lawndale. The pilot program proved successful, and on September 24, 2024, the City Council approved Amendment No. 1, which increased the not-to-exceed amount to $359,000 and extended the agreement term through June 30, 2026, with the option for two, one-year extensions. On June 24, 2025, the City Council approved Amendment No. 2, which increased the not-to-exceed amount to $718,000 and extended the agreement term through June 30, 2026, with the option for two, one-year extensions.

Southwest Patrol’s professionalism, responsiveness, and community presence have been well-received. The firm’s uniformed officers provide daily patrols at City parks, facilities, and in commercial areas, helping to deter criminal activity, monitor encampments, and report maintenance or safety issues. This level of engagement has enabled sworn law enforcement officers to focus on priority incidents, enhancing the City’s overall public safety response.

Discussion:

Amendment No. 3 to Agreement No. 24-2348 with Southwest Patrol proposes an additional appropriation of $200,000 to continue providing armed security services throughout the remainder of the current contract term ending June 30, 2026. With this amendment, the total not-to-exceed contract amount would increase to $918,000, allowing the City to sustain current coverage levels and meet the growing demand for visible, responsive security personnel in key areas.

The services rendered by Southwest Patrol are provided at a rate of $50 per hour per guard and align with the pricing established in the City of Lawndale’s competitively procured contract. This consistency allows the City to leverage cost efficiencies through CITY COUNCIL AGENDA REPORT – MEETING OF MARCH 10, 2026

its piggyback purchasing authority under Municipal Code Section 3.20.030(D), which permits cooperative purchasing arrangements with other government agencies.

Based on consultation with the City’s Public Safety Coordinator, feedback from the business community and residents, staff believes continued use of Southwest Patrol’s services is necessary to maintain a safe and secure environment. The contractor’s presence has been instrumental in addressing nuisance behavior, providing an elevated sense of security and providing peace of mind to the public, while allowing the Sheriff’s Department to respond to emergencies and calls for service.

Southwest Patrol has demonstrated its ability to operate in partnership with the City and uphold high standards of appearance, training, and accountability. As such, staff recommends approval of Amendment No. 3 and continuation of this successful public safety initiative.

Conclusion:

Staff recommends approval of Amendment No. 3 to Agreement No. 24-2348 with Southwest Patrol, Inc. to increase the contract amount by $200,000, bringing the total not-to-exceed amount to $918,000 through June 30, 2026, and authorizing the City Manager to execute the amendment in a form approved by the City Attorney.

Inc., 'for armed security services, as authorized under the City' s piggyback purchasing: procurement procedures in an amount not -to -exceed $ 359, 000. per fiscalyear from September' 25,'024, through- June :30, 2026, with the option for two'( 2)., one ( 1) — year extensions; and

2.. Authorize the City Manager to execute the amendment in a. form approved by. the.

City Attorney. ,:

Fiscal. Impact:

The rate for each security.. guard is $ 50 per hour, with the staff requesting 1.,. 00. hours of coverage annually for a duration of two. (2): years, amounting to a total of $359, 000 per fiscal year.. Sufficient funding is available' within the fiscal year ( FY) 2024-5 Adopted Budget -. General ' Fund- .(Fund 100) Public Safety Budget, Account No. 1: 00.5. 100- 54500 ( Contract Services). No additional appropriation is needed at this time:

Backgroun. di: :

In February . 2. 022, the City of Pico Rivera ( City) adopted a comprehensive Strategic Plan toguide itsdevelopment and priorities: Amongthe five. (5) key Strategic Priorities established by the City Council, the health, wellness, and safety of the community were at theforefront. This .priority reflects a :commitment to fostering a secure, healthy, and vibrant .environment, for all residents: city staff have :been diligently working toward this goal; by addressing the following core objectives: •
Mitigating homelessness: Implementing strategies to reduce, :the number of, individuals experiencing homelessness and providing resources. to support those in need.

Promoting' public safety: Creating a secure community through proactive .safety measures and collaboration with .law enforcement..

Maintaining a. clean and attractive environment: Ensuring that: public spaces are safe, clean, and well -maintained to enhance the quality of life for residents.

Building a thriving, low -crime city: Establishing high standards for health, wellness, and crime prevention to. create a flour. ishing,' secure urban space:.

This commitment to public safety and • infrastructure was further solidified by the. passage of Measure AB in November 2022. Approved by an overwhelming 75% 0. of voters, :thit measure was a resounding endorsement of the City' svision: Measure 'AB allocated critical • . funding for infrastructure improvements and . public safety enhancements; empowering - the City to better address the needs of its growing population.

In recent months; however,' th City has. seen :a rising. number of quality -of -life. concerns from both residents and: local businesses, particularly during: after- hours. While 'the Sheriff' sDepartment continues to provide exemplary service, there .has been an uptick in homelessness - related issues and crimes' of opportunity; particularly in ' commercial districts. These challenges highlight the -need for additional . resources and support beyond. traditional law enforcement capabilities.

In order toeffectively address : these :emerging issues, the .City. has explored innovative approachesto supplement .the . capacity . of the ' Sheriff' s. Department by pursuing alternative methodsto strengthenpublic safetyand improve community; well- being.' The City of Pico Rivera is dedicated to. safeguarding its residents. andensuring. a high quality of life for all. ' '
Discussion:

By consulting with other cities in the Gateway .area and our Public Safety- Coordinator,' the : City.: found that Southwest Patrol' Inc. ( Southwest Patrol), could. likely provide supplemental services under a pilot, program. In May 2024; the City entered into Professional Services Agreement No: 24-348 with Southwest Patrol,. :under . a pilot program for Armed Security Services for a not -to -exceed amount of $ 59, 000 (Enclosure 2). 'Under: this. agreement, Southwest Patrol was able to provide• additional support in handling issues such as homeless encampments and petty theft, hereby allowing deputy sheriffs to focus on more serious criminal activities.

For 29 years; Southwest. Patrol has provided security services to bothprivate and public institutions; placing a strong emphasis on staff training and; a thorough hiring processfor their guards. In addition, Southwest Patrol: maximizes the appearance and presence of CITY COUNCIL. AGENDA REPORT — MEETING OF SEPTEMBER' 24, 2024 ..

their- security : Sherriff deputies, which . includes uniforms, equipment and vehicles, to convey professionaiisrn. and competency to the residents of Pico Rivera.

Southwest Patrol has. been. well- received by the. community; providing high visibility and prompt responses in parks, 'City facilities, and business areas Furthermore, they have a proven. record -of providing' armed security services to cities like Lawndale, Lakewood, Bellflower, in addition to the Garden Grove. and. La Habra School Districts. The services offered to Pica Rivera are consistent with the contract Southwest Patrol has with the City of Lawndale, which was awarded following a competitive procurement process.

Procurement.

The Pico . Rivera _Municipal; Code ( PRMC) Subsection ( D) -of Section. 3. 20: 030 — Cooperative or Piggyback Purchasing,. provides an exemption to competitive bidding when purchases are made "... by, though, or 'in concert with another public .agency..."' if the purchase was -made in compliance, with state laws &- local' rules. ' In April 2023, the City of. Lawndale .issued a Request for Proposal -( Enclosure. 3)- for Armed Security Services and advertised it publicly. ;The. City. Of Lawndale invited three. 3), companies that provided. qualified and responsive proposals to interview with the' City staff. All proposals were evaluated by a selection- committee_ that weighed. multiple factors such. as .cost,. experience levels, presentation, and references.. Ultimately, the City of Lawndale selected Southwest Patrol as the best suited match for their city.

Southwest :Patrol _has offered the. City .of Pico Rivera the same.ervices and°. rates as its existing contract with:. the. City -of Lawndale ( Enclosure 3) which includes a $ 50 hourly rate for -each guard. Therefore, approving Amendment: No. 1 will ensure. the City. will receive the same services and rates as the City of Lawndale. and it is in. accordance with statutory. authorities. andthe PRMC:.

Conclusion:

Staff recommends that City Council authorize the City Manager to approve Amendment No. 1 to Agreement No. 24-348 with Southwest Patrol, Inc. to provide armed guard protection and security services. .

CODE (FIRST READING AND INTRODUCTION)
Recommendation:

1. Introduce and waive the first reading amending Title 2, Administration and Personnel, Title 5, Business Licenses and Regulations, Title 8, Health and Safety and Title 10, Vehicles and Traffic of the Pico Rivera Municipal Code; and

2. Find the ordinance exempt from the California Environmental Quality Act pursuant to CEQA Guidelines Sections 15060(c)(2) and 15061(b)(3).

Strategy:

4.3 Maintain a clean, safe, attractive environment to sustain a high quality of life for residents.

Fiscal Impact:

There is no fiscal impact on the General Fund associated with this ordinance.

Background:

As state statutes and local practices change over time, amendments to the PRMC are necessary to maintain legal compliance, eliminate 7 Back to Agenda Outline

outdated provisions, and improve administrative efficiency.

The proposed amendments are intended to clarify existing regulations, streamline procedures, and provide greater transparency and predictability for residents, businesses, and staff. By refining ambiguous language and removing redundant or obsolete provisions, the updates will enhance consistency in interpretation and enforcement, thereby better serving the public. Deleted and/or edited language is shown with a strikethrough, and new language is double underlined in the ordinance (Enclosure 1) for ease of reference and review.

Discussion:

The following sections below present the proposed amendments to each Title of the Municipal Code and provide a summary of and explanation of the corresponding changes.

Title 2, Administration and Personnel
Chapter 2.54, Sister City Commission
Update Section 2.54.040 Meetings—Time and place. The current ordinance requires at least one regular meeting each month. The amendment would require one regular meeting quarterly. This adjustment provides the Commission with greater flexibility in scheduling and reflects the current operational needs, while still ensuring ongoing communication and coordination between the Commission and City staff.

Title 5, Business Licenses and Regulations
Chapter 5.75, Tobacco Retail License
Update Section 5.75.110 Compliance monitoring. The current ordinance requires at least one unannounced inspection per year and a separate annual compliance check utilizing youth decoys. The proposed amendment clarifies that the use of youth-decoys may be conducted at the City’s discretion. This adjustment allows the City to make sure of youth decoys when warranted by observed retailer behavior while preserving a strong enforcement framework with annual inspections.

Title 8, Health and Safety
Chapter 8.36, Fireworks
Update Sections 8.36.080 Fee imposed upon wholesalers and distributors and 8.36.100 Retail sales permit─ Application and fee. The amendments remove the requirement for permit fees to be paid within five days of approval, as all applicable fees are now collected at the time of application submittal. The amendments eliminate a requirement for organizations to submit a separate statement identifying whether personnel staffing fireworks stands are adult members or immediate family members, as existing code provisions already requires an adult presence onsite at all times and this certification is now incorporated directly into the permit application. The amendments also remove the CITY COUNCIL AGENDA REPORT – MEETING OF MARCH 10, 2026

requirement for affiliated organizations to submit a separate authorization letter, as the application must already be signed by an authorized officer of the nonprofit organization.

Collectively, these changes streamline the permitting process while maintaining existing safety and accountability requirements.

Title 8, Health and Safety
Chapter 8.60, Demolition and Recycling
Update Sections 8.60.010 Findings; 8.60.020 Definitions; 8.60.030 Threshold for covered projects; 8.60.060 Review of waste management plan; and 8.60.070 Compliance with waste management plan. The California Waste Management Act of 1989 (AB 939) requires local jurisdictions to divert at least 50 percent of Construction and Demolition waste from landfills. In addition, the California Green Building Standards Code (CALGreen) requires that owners and builders of construction projects divert a minimum of 65 percent of construction and demolition (C&D) waste generated from a project, which took effect on or after January 1, 2017. The amendments increase the required diversion rate from 50 percent to 65 percent and thereby bring the City into compliance with CALGreen requirements.

Title 10, Vehicles and Traffic
Chapter 10.40 Stopping, Standing and Parking
Update Section 10.40.230 Parking enforcement officer powers and duties. The proposed amendment clarifies that City of Pico Rivera Parking Enforcement Officers are authorized to issue citations for a variety of California Vehicle Code (CVC) violations, including the premature towing section of CVC Section 22953(a): An owner or person in lawful possession of private property that is held open to the public, or a discernible portion thereof, for parking of vehicles at no fee, or an employee or agent thereof, shall not tow or remove, or cause the towing or removal, of a vehicle within one hour of the vehicle being parked.

Environmental Analysis:

Pursuant to the California Environmental Quality Act (“CEQA”) and associated Guidelines (“CEQA Guidelines”), the City Council finds that there is no possibility that the project would have a significant effect on the environment and as a result, no further CEQA review is necessary. The determination is in accordance with Section 15061(b)(3) of the CEQA Guidelines which states, a project is exempt from CEQA where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment. The amendments consist of administrative and regulatory updates and do not authorize or approve any specific development project.

Conclusion:

Staff recommends that the City Council introduce and waive the first reading of the ordinance amending Title 2, Administration and Personnel, Title 5, Business Licenses and Regulations, Title 8, Health and Safety and Title 10, Vehicles and Traffic of the Pico Rivera Municipal Code. The ordinance will be brought for a second reading at the next available regularly scheduled City Council meeting and will become effective 30 days after adoption.

B. The city finds that every city and county in California, including Pico Rivera, could face fines up to ten thousand dollars a day for not meeting the above mandated goal.

ORDINANCE NO. ____

Page 5 of 11 ends

C. The city finds that reusing and recycling construction and demolition (C & D) debris is essential to further the city's efforts to reduce waste and comply with AB 939 goals.

D. The city finds that C & D debris waste reduction and recycling have been proven to reduce the amount of such material which is landfilled, increase site and worker safety, and be cost effective.

E. The city finds that, except in unusual circumstances, it is feasible to divert an average of at least fifty sixty-five percent of all C & D debris from construction, demolition, and renovation projects.

F. The city finds that, to ensure compliance with this chapter and to ensure that those contractors that comply with this chapter are not placed at a competitive disadvantage, it is necessary to impose a performance security requirement.

demolition debris, but shall not be required to submit a waste management plan to the WMP Compliance Official.

C. City-Sponsored Projects. All city-sponsored construction, demolition, and renovation projects, whose total costs are equal to or greater than one hundred thousand dollars, shall be considered "covered projects" for the purposes of this chapter.

D. Compliance as a Condition of Approval. Compliance with the provisions of this chapter shall be listed as a condition of approval on any building or demolition permit issued for a covered project.

8.60.060 Review of waste management plan.

A. Approval: Notwithstanding any other provision of this code, no building or demolition permit shall be issued for any covered project unless and until the WMP compliance official has approved the WMP. Approval shall not be required, however, where an emergency demolition is required to protect public health or safety, the WMP compliance official shall only approve a WMP if he or she first determines that all of the following conditions have been met:

1. The WMP provides all of the information set forth in Section

8.60.040;

2. The WMP indicates that at least fifty percent sixty-five percent of all C&D debris generated by the project will be diverted; and

3. The applicant has submitted an appropriate performance security in compliance with Section 8.60.050.

If the WMP compliance official determines that these three conditions have been met, he or she shall mark the WMP "Approved", return a copy of the WMP to the applicant, and notify the building division that the WMP has been approved.

B. Nonapproval. If the WMP compliance official determines that the WMP is incomplete or fails to indicate that at least fifty sixty-five percent of all C&D debris generated by the project will be reused or recycled, he or she shall either:

1. Return the WMP to the applicant marked "Denied", including a statement of reasons, and so notify the building official, which shall then immediately stop processing the building or demolition permit application; or

2. Return the WMP to the applicant marked "A Further Explanation Required", including a statement of reasons, and so notify the ORDINANCE NO. ____

building division, which shall then immediately stop processing the building or demolition permit application.

8.60.070 Compliance with waste management plan.

A. Documentation. Within thirty days after the completion of any covered project, the applicant shall submit to the WMP compliance official documentation that it has met the diversion requirement for the project. The diversion requirement shall be that the applicant has diverted at least fifty sixty-five percent of the total C&D debris generated by the project via reuse or recycling, unless the applicant has been granted an exemption pursuant to Section 8.60.080, in which case the diversion requirement shall be the maximum feasible diversion rate established by the WMP compliance official for the project. This documentation shall include all of the following:

1. Receipts from the vendor or facility which collected or received each material showing the actual weight or volume of that material;

2. A copy of the previously approved WMP for the project adding the actual volume or weight of each material diverted and landfilled;

3. Any additional information the applicant believes is relevant to determining its efforts to comply in good faith with this chapter.

B. Weighing of Wastes. Applicants shall make reasonable efforts to ensure that all C&D debris diverted or landfilled are measured and recorded using the most accurate method of measurement available. To the extent practical, all C&D debris shall be weighed by measurement on scales. Such scales shall be in compliance with all regulatory requirements for accuracy and maintenance. For C&D debris for which weighing is not practical due to small size or other considerations, a volumetric measurement shall be used. For conversion of volumetric measurements to weight, the applicant shall use the standardized conversion rates approved by the city for this purpose.

C. Determination of Compliance and Release of Performance Security. The WMP compliance official shall review the information submitted under subsection

8.60.070(A) and determine whether the applicant has complied with the diversion requirement, as follows:

1. Full Compliance. If the WMP compliance official determines that the applicant has fully complied with the diversion requirement applicable to the project, he or she shall cause the full performance security to be released to the applicant.

2. Good Faith Effort to Comply. If the WMP compliance official determines that the diversion requirement has not been achieved, he or she shall determine on a case-by-case basis whether the applicant ORDINANCE NO. ____

has made a good faith effort to comply with this chapter. In making this determination, the WMP compliance official shall consider the availability of markets for the C&D debris landfilled, the size of the project, and the documented efforts of the applicant to divert C&D debris. If the WMP compliance official determines that the applicant has made a good faith effort to comply with this chapter, he or she shall release the performance security, or a portion thereof, to the applicant. Any portion of the performance security not released to the applicant shall be forfeited to the city, and shall be used for the purposes of promoting recycling within the city.

3. Noncompliance. If the WMP compliance official determines that the applicant has not made a good faith effort to comply with this chapter, or if the applicant fails to submit the documentation required by subsection 8.60.070(A) within the required time period, then the performance security shall be forfeited to the city. All forfeited performance securities shall be used for the purposes of promoting recycling within the city.
