STAFF REPORT

MEETING DATE: July 20, 2026

TO: Mayor and Council Members

FROM: Darin E. Gale‚ City Manager
Kolette Simonton, Director of Recreation

SUBJECT: Adoption of a City Council Resolution Authorizing the City Manager to Execute a First Amendment to the Consulting
Services Agreement with Entertainment Lane, Inc. for the Operation and Management of the California Theatre

EXECUTIVE SUMMARY

Staff recommends that the City Council approve the First Amendment to the Consulting Services Agreement with Entertainment Lane, Inc. ("Agreement") for the continued operation and management of the City-owned California Theatre. The amendment extends the agreement one year through June 30, 2027, modifies the compensation schedule, and increases the total not-to-exceed contract amount to $1,400,000.

Entertainment Lane, Inc. has provided management and operational services for the California Theatre under the Agreement since July 1, 2023. The proposed amendment will ensure continuity of theatre operations while the City continues to evaluate long- term operational needs and programming opportunities.

FISCAL IMPACT

The First Amendment provides for compensation of $29,166.66 per month, for a total annual amount of $350,000 for the one-year extension period. Funding for Fiscal Year 2026/27 is included in the adopted budget for California Theatre operations.

In addition, the Agreement allows reimbursement for the cost of parts necessary to repair lighting, sound, audiovisual equipment, and other theatre-related systems. The Agreement also maintains the existing revenue-sharing provision, under which the Entertainment Lane, Inc. is to receive 20% of gross theatre revenues exceeding $650,000, including grants, donations, and other applicable revenue sources.

Page 510 of 587 ends

The amendment increases the not-to-exceed amount to $1,400,000 over the life of the agreement.

RECOMMENDATION

Staff recommends the City Council adopt a Resolution authorizing the City Manager to execute the First Amendment to the Consulting Services Agreement with Entertainment Lane Inc.

BACKGROUND

On July 1, 2023, the City Council adopted Resolution No. 23-14335, authorizing the execution of the Agreement with Entertainment Lane, Inc. to provide management and operational services for the California Theatre. The Agreement sets forth responsibilities of Entertainment Lane Inc. for the day-to-day management of the facility, event scheduling and coordination, marketing, facility oversight, tenant and client relations, and other services necessary to support the successful operation of the City's historic performing arts venue. Entertainment Lane, Inc. has continued to provide these services in accordance with the agreement, supporting a variety of community, cultural, educational, and commercial events at the theatre.

The current agreement expired on June 30, 2026. Staff recommends extending the agreement for one additional year to maintain uninterrupted operations while the City continues to assess future operational strategies for the facility.

SUBCOMMITTEE FINDINGS

This item was not presented to a subcommittee.

STAFF ANALYSIS

The First Amendment provides for the continuation of existing theatre management services under substantially the same terms and conditions as the original agreement.

The amendment includes the following:
• Extends the agreement term through June 30, 2027;
• Replaces Compensation Schedule (Exhibit B) and establishes annual compensation of $350,000, payable in monthly installments of $29,166.66; • Authorizes reimbursement for parts required to repair lighting, sound, audiovisual equipment, and other theatre-related systems; and
• Continues the existing provision allowing Entertainment Lane, Inc. to receive 20 percent of gross revenues exceeding $650,000.

Page 511 of 587 ends

Staff believes the proposed amendment will provide operational continuity for the California Theatre while preserving the existing service model, which has proven to be a community resource and benefit. The amendment also maintains the current performance expectations and compensation structure. Except as amended, all provisions of the original Consulting Services Agreement remain in full force and effect.

STAFF REPORT

MEETING DATE: July 20, 2026

TO: Mayor and Council Members

FROM: Darin E. Gale‚ City Manager
Jennifer Brizel, Director of Human Resources
Griselda Clift, Senior Human Resources Analyst

SUBJECT: Adoption of a City Council Resolution Amending the Master Pay Schedule to Include Amendments to the Salary
Schedule and Authorized Positions Listing

EXECUTIVE SUMMARY

To comply with CalPERS’s interpretation of the requirements of California Code of Regulations, Title 2, Section 570.5, the City must periodically amend the single Master Pay Schedule (MPS) on the City’s website, reflecting all previously approved actions related to salaries and approved positions.

FISCAL IMPACT

There is no fiscal impact related to the amendment of the pay schedules as a single MPS. Classification and salary changes have been projected in the Fiscal Year (FY) 2026/2027 budget, adopted by the City Council on June 15, 2026. No additional funding is requested.

RECOMMENDATION

Staff recommends the City Council adopt a resolution amending the City of Pittsburg’s Master Pay Schedule for all employee classifications to ensure compliance with the requirements of the California Code of Regulations, Title 2, Section 570.5 and the California Public Employees’ Retirement System (CalPERS) relating to publicly available pay schedules for purposes of determining the amount of “compensation earnable” pursuant to Government Code Sections 20630, 20636, and 20636.1.

Page 538 of 587 ends

BACKGROUND

CalPERS, pursuant to its interpretation of California Code of Regulations, Title 2, Section 570.5, recommends that all CalPERS employers maintain their compensation levels in a single, publicly available document approved and adopted by the governing body, which must meet all the following requirements:
• Duly approved and adopted by the employer's governing body in accordance with the requirements of applicable public meetings laws; • Identifies the position title for every employee position; • Shows the pay rate for each identified position, which may be stated as a single amount or as multiple amounts within a range;
• Indicates the time base, including but not limited to, whether the time base is hourly, daily, bi-weekly, monthly, bi-monthly, or annual; • Is posted at the office of the employer or immediately accessible and available for public review from the employer during normal business hours or posted on the employer's internet website;
• Indicates an effective date and date of any revisions; • Is retained by the employer and available for public inspection for not less than five years; and
• Does not reference another document in lieu of disclosing the pay rate.

SUBCOMMITTEE FINDINGS

This item was not reviewed by a subcommittee.

STAFF ANALYSIS

The updates to the MPS, effective July 5, 2026, reflect salary adjustments approved by the City Council on June 16, 2025, July 7, 2025, and July 21, 2025, for classifications represented by Management/Professional/Confidential (MPC) and Miscellaneous A Unit represented by the American Federation of State, County, and Municipal Employees (AFSCME) Union Local 512, International Brotherhood of Electrical Workers Union, Local 1245 (IBEW), Police Officers’ Association (POA), Police Managers’ Group (PMG), Teamsters Union Local 856 (Teamsters), Management Group, and Senior Executive Team.

Additionally, updates to the MPS reflect a salary adjustment to the Police Records Supervisor salary range, as well as the addition of a Geographic Information Systems (GIS) Technician classification and Utility Superintendent classification. Staff met and conferred with the respective bargaining group representatives from AFSCME and MPC.

Due to potential compaction, the City and AFSCME agreed to maintain a 7.5% compaction adjustment between the Utility Superintendent classification and the next,

Page 539 of 587 ends

lower-level classification in the work unit. The Utility Superintendent classification will also receive Standby Pay when assigned by the department head, as provided to the other supervisors and superintendents in the bargaining unit. Further, a 4.1% standard salary adjustment is recommended to be maintained between the Utility Superintendent and the Power Company Manager. This will be measured using the base pay salary range only (top step-to-top step of the range of both classifications).

These modifications do not change the City’s staffing allocation totals. Departments may reclassify existing position allocations as long as they do not exceed City Council- approved budgetary authority.

Exhibit A demonstrates the proposed changes to the salary schedule, while Exhibit B demonstrates the proposed changes to the staffing allocation. In accordance with the City’s Personnel Rule 11.1, staff recommends that the City Council establish salary ranges. Salary ranges are set for each class by the City Council.

The adoption of the resolution will comply with CalPERS’s interpretation of the requirements of Code of Regulations section 570.5 by amending the single MPS available on the City’s website, which reflects all previously approved actions on the individual classifications of the pay schedule.

STAFF REPORT

MEETING DATE: July 20, 2026

TO: Mayor/Chair and Council/Governing Board Members

FROM: Darin E. Gale‚ City Manager/Executive Director
John Samuelson, Director of Public Works/City Engineer
Sharon Paz, Administrative Analyst II

SUBJECT: Adoption of a City Council Resolution and a Geologic Hazard Abatement District (GHAD) II Resolution Approving a List of On-Call Engineering Services Firms, Authorizing the
Execution of Agreements, Authorizing the Execution of up to Two One-Year Extensions, and Authorizing the Execution of Task Orders

EXECUTIVE SUMMARY

The On-Call Engineering List of pre-qualified firms allows City staff to engage consultants or contractors to support capital improvement projects, land development review, and operational needs. This action would approve a list of qualified firms for on- call engineering services, authorize the City Manager/Executive Director to enter into service and/or consulting agreements with selected firms, extend the term of agreements by up to two years via separate one-year extensions, and authorize the Public Works Director/City Engineer to execute Task Orders.

FISCAL IMPACT

There is no impact associated with approving the On-Call List or executing agreements.

Each On-Call Agreement will have a maximum compensation amount of $500,000, and no Task Order may exceed $250,000 unless authorized by City Council or Governing Board. Costs for each Task Order will be paid from capital project budgets or operating budgets approved by the City Council and/or Governing Board.

RECOMMENDATION

Staff recommends the City Council and Governing Board adopt the resolutions approving the On-Call Engineering List of qualified firms for various services, authorize

Page 552 of 587 ends

the City Manager/Executive Director to execute agreements with selected firms and to extend the term of agreements by up to two years through one-year extensions, and authorize the Director of Public Works/City Engineer to execute Task Orders.

BACKGROUND

On July 1, 2024, the City Council adopted Resolution Nos. 24-14500, 24-14501, and 24-14502, approving lists of qualified firms to provide engineering services on an on- call basis. Those agreements expired on June 30, 2026.

On April 28, 2026, Engineering Division staff published a Request for Qualifications (RFQ) for on-call professional services across multiple technical disciplines to include civil engineering, surveying, traffic engineering, dry utility and electrical engineering, construction material testing, biological, hydrologist, environmental, hazardous material testing, geotechnical, landscape architecture, and architectural services. Prior to the May 28, 2026, deadline, staff received Statements of Qualification (SOQ) from 63 firms.

SUBCOMMITTEE FINDINGS

This item was not presented to a subcommittee.

STAFF ANALYSIS

A list of pre-qualified consultants streamlines the process for engaging professional engineering firms to provide on-call services for capital improvement projects, land development review, and operational needs, preventing unnecessary delays in project completion.

Staff reviewed and scored each SOQ across parameters including technical competence, project understanding, capacity and responsiveness, familiarity with Public Works projects, compliance with the RFQ, and fee schedule. Staff recommends that the highest-ranking firms from the review be approved for the On-Call List.

If adopted, the City Manager/Executive Director would be authorized to enter into agreements with individual firms on the On-Call List, which will be valid through June 30, 2028. Pittsburg Municipal Code (PMC) Section 2.85.060 states a particular task identified for on-call work requires at least three quotes obtained from professional service providers on the list. Each Agreement will have a maximum compensation of $500,000. Additionally, the City Manager/Executive Director shall be authorized to approve up to two, one-year extensions of the executed agreements.

The Director of Public Works/City Engineer shall be authorized to execute Task Orders pursuant to the agreements when a specific task is identified and a consultant is selected from the On-Call List. The maximum compensation for each Task Order will be negotiated prior to execution, and no Task Order shall exceed $250,000 unless

Page 553 of 587 ends

specifically authorized by the Council/Board.

Multiple Task Orders may be issued over the term of each agreement, though the City and the GHAD II will not be under any obligation to issue any Task Orders or to utilize any agreement to its limits. Consultants on the approved On-Call List will not be restricted from submitting proposals for future City or Governing Board requests for proposals or requests for qualifications. However, a separate proposal will be required to be considered in any other selection process.

A sample On-Call Consulting Services Agreement is attached to this staff report.

STAFF REPORT

MEETING DATE: July 20, 2026

TO: Chair and Governing Board Members

FROM: Darin E. Gale‚ Executive Director
Jordan Davis, Director of Community and Economic
Development
Vanessa Xie, General Manager of Pittsburg Power Company

SUBJECT: Adoption of a Pittsburg Power Company Resolution Authorizing the Executive Director to Execute a Second
Amendment to the Operations Agreement with the City of
Vallejo to Provide Natural Gas Service to Mare Island and a Second Amendment to the Operations Agreement with the
City of Vallejo to Provide Electric Service to Mare Island

EXECUTIVE SUMMARY

Pittsburg Power Company (PPC) Resolution No. 25-479 authorized the execution of the first amendments to operations agreements between the City of Vallejo (Vallejo) and Island Energy (IE) regarding distribution of natural gas and electricity to Mare Island (the "Gas OA" and "Electric OA," hereafter referred together as the "Agreements") extending the Agreements for one (1) year with a six (6) month mutual extension, effectively extending the term through August 31, 2026. Both IE and Vallejo agree additional time is necessary to negotiate the terms and conditions of a long-term agreement(s), as well as the necessity of such agreements in general, and propose second amendments to both Agreements extending the term for an additional twelve (12) months through August 31, 2027, with a six-month mutual, optional extension, to extend the Agreements through February 29, 2028.

FISCAL IMPACT

During the Term of the Agreements, IE is required to collect 2% of gross receipts of electricity and natural gas sales on Mare Island to the City of Vallejo. Further, continued negotiation regarding these Agreements is anticipated to require significant staff time, and may require IE to hire one or more consultants to support negotiations. The adopted IE Budget (Fund 580) currently has adequate funding available to support

Page 577 of 587 ends

these costs.

RECOMMENDATION

The PPC Board adopt a resolution authorizing the Executive Director to execute a Second Amendment to the Operations Agreement with the City of Vallejo to Provide Natural Gas Service to Mare Island and a Second Amendment to the Operations Agreement with the City of Vallejo to Provide Electric Service to Mare Island.

BACKGROUND

On September 23, 1996, PPC, a joint powers authority, was formed. On April 1, 1997, PPC commenced the sale and service of electricity and gas on Mare Island, Vallejo, as a municipally owned utility under the name Island Energy. On August 22, 2001, Island Energy accepted from the federal government, acting through the Department of the Navy, a Grant of Non-Exclusive Easements for Gas and Electric Distribution Systems and Associated Buildings at Mare Island ("Easements").

Under the Easements, IE acquired both the existing assets, including all utility distribution systems and related buildings and the non-exclusive easements upon, under and over which the systems and buildings were or are located. As such, PPC retained the right to continue to serve gas and electric load on Mare Island in perpetuity.

In 2005, IE and the City entered into Operation Agreements to provide electric and natural gas services on Mare Island. The Agreements each had a twenty-year term and expired on or after March 1, 2025. In 2024, IE and the City began discussions on potential revisions to the Operating Agreements for electric and gas services to Mare Island.

On February 25, 2025, IE and the City executed the First Amendments to the Agreements, extending the term for twelve (12) months through February 28, 2026, with a six (6)-month option to extend.

On February 5, 2026, IE and the City, through their respective Executive Director and City Manager, mutually agreed to extend the terms of the Agreements for an additional six (6) months, through August 31, 2026.

SUBCOMMITTEE FINDINGS

This item was not presented to the subcommittee.

STAFF ANALYSIS

IE and the City agree that additional time is warranted to negotiate revised agreements, in part to assess the utility requirements per the new proposed Mare Island Specific

Page 578 of 587 ends

Plan. The proposed Second Amendment to the Gas OA and Second Amendment to the Electric OA would extend the Agreements for another twelve (12) months through August 31, 2027, with a six (6)-month option to extend through February 29, 2028.
