PLACENTIA CITY COUNCIL AGENDA REPORT
Meeting Date: October 1, 2024
Submitted by: Chris Tanio
From: Public Works
Subject:
Amendment No. 5 to Professional Services Agreement with Totum Corporation for Construction Inspection Services on Citywide Fiber Optic Deployment Project Financial Impact:
Fiscal Impact:
Expense: $73,000 Amendment No. 5 for Additional Inspection Services for Citywide Fiber Optic Deployment
Budget: $73,000 FY 24-25 Operating Budget (103551-6099) Summary:
On September 24, 2019, the City Council approved a Development Agreement with SiFi Networks ("SiFi") to build a citywide fiber optic network that will bring direct fiber connections to the Internet to every home and business in the City. As part of that agreement, SiFi helped fund the cost of a Specific Point of Contact who works on behalf of the City assisting in managing the project and providing daily construction inspection on the project. On May 18, 2021, the City Council approved a Professional Services Agreement with Totum Corporation ("Totum") for $600,000 for a term of three (3) years to provide construction inspection services for this project and on February 6, 2024, the City Council extended the term an additional two (2) years as part of Amendment No. 3. The overall Professional Services Agreement with Totum also includes work related to the Public Safety Center Project with the scope and funding for Amendments 1 through 4 being solely related to the construction management and inspection services for the Public Safety Center Project.
The proposed Amendment No. 5 to this agreement is presented to the Council for its consideration to provide added hours and fees for Totum to cover additional inspection services needed for the Citywide Fiber Optic Deployment which is expected to be completed by the end of the calendar year. Totum is overseeing and coordinating with SiFi's fiber optic contractor to ensure their work is built per the plans and specifications approved by the City and acting as the City's representative on the job site.
Recommendation:
Recommended Action: It is recommended that the City Council:
1. Approve Amendment No. 5 to a Professional Services Agreement with Totum Corporation to provide construction inspection services for the Citywide Fiber Optic Deployment Project for a new not -to -exceed amount of $673,000; and 177
2. Authorize the City Administrator to approve contract amendments up to 10% of the cumulative contract not -to -exceed amount, or $67,300; and
3. Authorize the City Administrator to approve the agreement in a form approved by the City Attorney.
Strategic Plan Statement:
This item conforms to Strategic Plan Objective 1.7, Identify ways to monetize the new CitywidE fiber optic system and Objective 3.2, Include promotion of Citywide fiber in City economic development recruitment and retention strateaies.
Discussion:
On September 24, 2019, the City Council approved a Development Agreement with SiFi for the deployment of a citywide fiber optic network that will service all City facilities, residences, businesses, and institutions within Placentia. The project will bring gigabit level internet and data transfer speeds to every doorstep in Placentia. SiFi will then lease the fiber lines to Internet Service Providers (ISPs) to whom customers may subscribe. SiFi will own the backbone infrastructure but is not an ISP. Maintenance and repair of the physical fiber network is entirely the responsibility of SiFi. Residents and businesses have the option to continue with their existing ISPs or seek subscriptions with providers who have leased fiber from SiFi and receive a fiber service drop directly into their homes or businesses. In addition, this Agreement does not prevent any other service providers from installing their own citywide fiber optic networks or expanding their existing fiber infrastructure and providing a similar service. From an economic development perspective, the concept of a privately funded and managed citywide fiber network is a significant opportunity for strengthening Placentia's competitive advantage for retaining and attracting businesses, jobs, and private investment into our community.
As part of SiFi's Agreement with the City, they have agreed to help fund the cost of a Specific Point of Contact ("SPOC") that will work on behalf of the City solely on this project, 40 hours per week. The City's SPOC is an experienced construction inspector in municipal Public Works construction and will be responsible for managing all work zone permits as well as providing daily field construction observation to ensure SiFi's contractor builds the network per the plans and specifications approved by the City. The inspector will also ensure that SiFi's contractor complies with all work zone permit conditions of approval. To date, all of the microtrenching work has been completed and over 20,000 addresses are available for service, with many homes and businesses already underway.
The proposed Amendment No. 5 to this agreement is presented to the Council for its consideration to provide added hours and fees for Totum to cover additional inspection services needed for the Citywide Fiber Optic Deployment which is expected to be completed by the end of the calendar year. Totum is overseeing and coordinating with SiFi's fiber optic contractor to ensure their work is built per the plans and specifications approved by the City, and acting as the City's representative on the job site. The overall Professional Services Agreement with Totum also includes work related to the Public Safety Center Project with the scope and funding for Amendments 1 through 4 being solely related to the construction management and inspection services for the Public Safety Center Project. Totum has also previously provided construction management and inspection services on the Placentia Navigation Center as well as other cities in the surrounding Orange County area. 178
Fiscal Impact Summary:
The total inspection costs for the citywide fiber optic network deployment amounts to $673,000 which includes $600,000 previously approved and an additional $73,000 needed to carry out the project to final completion. For reference, the overall Professional Services Agreement with Totum which includes this Amendment No. 5 and also includes work related to the Public Safety Center Project under Amendments 1 through 4 amounts to $1,295,965. Under Section
2.5.2 of SiFI's Agreement with the City, SiFi will reimburse the City up to $150,000 annually until construction of the project is completed to fund the cost of the SPOC. A total of $73,000 for the cost of this agreement amendment and corresponding revenue from SiFi has been appropriated in the adopted Fiscal Year 24-25 Operating Budget. As such, sufficient funds exist for the recommended actions.

c. Method Of Sharing
If all of the other insurance permits contribution
by equal shares, we will follow this method also.
Under this approach each insurer contributes
equal amounts until it has paid its applicable
limit of insurance or none of the loss remains,
whichever comes first.
If any of the other insurance does not permit
contribution by equal shares, we will contribute
by limits. Under this method, each insurers
share is based on the ratio of its applicable limit
of insurance to the total applicable limits of
insurance of all insurers.
d. Primary And Non -Contributory Insurance If
Required By Written Contract
If you specifically agree in a written contract or
agreement that the insurance afforded to an
insured under this Coverage Part must apply on
a primary basis, or a primary and non-
contributory basis, this insurance is primary to
other insurance that is available to such insured
which covers such insured as a named insured,
and we will not share with that other insurance,
provided that:
(1) The "bodily injury" or "property damage" for
which coverage is sought occurs; and
(2) The "personal and advertising injury" for
which coverage is sought is caused by an
offense that is committed;
subsequent to the signing of that contract or
agreement by you.
5. Premium Audit
a. We will compute all premiums for this Coverage
Part in accordance with our rules and rates.
b. Premium shown in this Coverage Part as
advance premium is a deposit premium only. At
the close of each audit period we will compute
the earned premium for that period and send
notice to the first Named Insured. The due date
for audit and retrospective premiums is the date
shown as the due date on the bill. If the sum of
the advance and audit premiums paid for the
policy period is greater than the earned
premium, we will return the excess to the first
Named Insured.
c. The first Named Insured must keep records of
the information we need for premium
computation, and send us copies at such times
as we may request.
6. Representations
By accepting this policy, you agree:
a. The statements in the Declarations are
accurate and complete;
b. Those statements are based upon
representations you made to us; and
c. We have issued this policy in reliance upon
your representations.
The unintentional omission of, or unintentional error
in, any information provided by you which we relied
upon in issuing this policy will not prejudice your
rights under this insurance. However, this provision
does not affect our right to collect additional
premium or to exercise our rights of cancellation or
nonrenewal in accordance with applicable insurance
laws or regulations.
7. Separation Of Insureds
Except with respect to the Limits of Insurance, and
any rights or duties specifically assigned in this
Coverage Part to the first Named Insured, this
insurance applies:
a. As if each Named Insured were the only
Named Insured; and
b. Separately to each insured against whom claim
is made or "suit" is brought.
8. Transfer Of Rights Of Recovery Against Others
To Us
If the insured has rights to recover all or part of any payment we have made under this Coverage Part,
those rights are transferred to us. The insured must
do nothing after loss to impair them. At our request,
the insured will bring "suit" or transfer those rights
to us and help us enforce them.
9. When We Do Not Renew
If we decide not to renew this Coverage Part, we will
mail or deliver to the first Named Insured shown in
the Declarations written notice of the nonrenewal
not less than 30 days before the expiration date.
If notice is mailed, proof of mailing will be sufficient proof of notice.

Agenda Item No: 1.f
PLACENTIA CITY COUNCIL AGENDA REPORT
Meeting Date: October 1, 2024
Submitted by: Patrick Powers
From: Administrative Services
Subject:
A Resolution of the City Council of the City of Placentia, California, adopting Purchasing Policy Language in Compliance with Health and Safety Code 1797.231.
Financial Impact:
Fiscal Impact: None
Summary:
This agenda item is submitted to City Council to seek approval to issue a competitive RFP to explore potential private ambulance providers for a possible partnership in providing ambulance transportation services serving one or more of the five exclusive operating area (EOA) regions managed by the County of Orange. The timing of this proposed action is essential for alignment with the County of Orange's upcoming competitive process for new Emergency Ambulance Transportation contracts for a five-year period. The action being requested with this agenda item is only a preliminary step allowing the City to continue researching a potential partnership. This action is non-binding, and no final decision will be requested from the City Council until Staff returns at a future meeting.
Recommendation:
Recommended Actions: It is recommended that the City Council:
1. Direct Staff to develop and issue an RFP to identify a potential private BLS (Basic Life Support) ambulance partner for ambulance transportation serving the Orange County Exclusive Ambulance Operating Area — A (EOA-A) that is comprised of the cities of Placentia and Yorba Linda and certain county unincorporated areas (Attachment 1) managed by the County of Orange; and
2. Using the results from the RFP, direct Staff to design a non-binding public/private partnership to present to the City Council for further consideration at a subsequent meeting, and for potential direction to submit a proposal to the Orange County RFP for the provision of 9-1-1 Basic Life Support emergency ambulance response; and
3. Adopt Resolution No. R-2024-67 establishing a written policy in compliance with Health and Safety code 1797.231.
Strategic Plan Statement:
There is no specific strategic planning goal or objective associated with this agenda item. 192
Discussion:
The County of Orange, through the Emergency Medical Services (OCEMS) agency is responsible for conducting competitive request for proposal processes for the selection of 911 - Basic Life Support (BLS) ambulance response services in five regions of the county. The five regions are made up of county unincorporated territory and cities that have not retained the rights to contract for ambulance services themselves according to Health and Safety Code 1797.201.
Since 2014, the OCEMS has conducted RFP's consistent with Health and Safety Code 1797.224 to establish exclusive contracts with responsible ambulance providers in designated regions. The competitive process is necessary to protect the county from violations of anti- trust laws in developing exclusive contracts. Currently, Emergency Ambulance Services (EAS) is contracted with the OCEMS to provide 911 -BLS ambulance to the City of Placentia as part of EOA-A. The contract is set to expire in June 2025 and the OCEMS will be conducting a new competitive process in the coming months.
State law authorizes a city like Placentia, as defined, to enter into a written subcontract with a private ambulance service provider for the purpose of contracting with the County (Health and Safety Code 1797.231(a)(1).) The first step to implement such a contract is to solicit interest in a partnership agreement from private ambulance providers through a competitive RFP process, once the required RFP policy governing the RFP process is in place.
Fiscal Impact Summary:
There is no fiscal impact to this action.

Subject:
Approval of the Design Concept Plan for the Jaycee Parkette Renovation CIP and Prop 68 Project No. 7313
Financial Impact:
Fiscal Impact:
The total grant award for the project at Jaycee Parkette is $610,000. The grant funds are reimbursed by the California Department of Parks and Recreation. The City is not required to provide any matching funds for this grant. Funding for the project has been appropriated in the FY 24-25 budget as part of the Capital Improvement Program (CIP). The project will also be carried over into subsequent Fiscal Years until completion of the project. Based on the grant guidelines, the project must be completed by June 30, 2028.
Summary:
In August 2019, after careful consideration and following City Council approval, the City submitted seven (7) project applications requesting grant funds for various improvements/renovations at several community parks through the California State Parks, Office of Grants and Local Services (OGALS). The Statewide Park and Community Revitalization Program (SPP) is a competitive grant program that provides funds to create new parks, expand existing parks, and/or renovate existing parks in critically underserved communities across California. Funding for the grant program is provided through the California Proposition 68 Parks and Water Bond of 2018.
The City was notified in February 2020, that the renovation project for Jaycee Parkette was chosen by OGALS to receive a grant award of $610,000. The Jaycee Parkette renovation project will include removal and replacement of the existing playground and rubberized surfacing, addition of water efficient irrigation, landscaping, and new park lighting. City Staff worked with Hirsch & Associates to create several conceptual designs for the parkette. The design concepts were presented at a community meeting on August 29, 2024 and presented to the Parks, Arts, and Recreation Commission (PARC) on September 10, 2024 for review and consideration. Based on feedback from the community and the PARC Commission, this item reviews the final design concept plan for the Jaycee Parkette playground project. Upon completion of the design, the City will publicly advertise the project to hire a contractor to construct and finalize the project well in advance of the SPP grant deadline of June 30, 2028. 199
Recommendation:
Recommended Action: It is recommended that the City Council:
1. Provide Staff with input to incorporate into the design plan for the renovation of the Jaycee Parkette playground project; and
2. Approve the design concept plan for the Jaycee Parkette playground renovation project.
Strategic Plan Statement:
This item is consistent with the City Council approved 5 -Year Strategic Goal #5 to Implement Public Infrastructure to Meet Community Needs, under Objective #5.2, which is working to complete the Placentia Parks Initiative Plan.
Discussion:
In 2021, the California State Parks, Office of Grants and Local Services announced the 2019 Statewide Park Development and Community Revitalization Program (SPP). Funds for this program are provided through Proposition 68 (Prop 68). California voters passed Prop 68 in June 2018 to safeguard natural resources, such as parks, and safe drinking water. This competitive grant program provides funds to create new parks, expand existing parks, and/or renovate existing parks in critically underserved communities. After careful consideration of the grant criteria, Staff recommended to the City Council that the proposed grant applications be submitted for renovations of existing parks, including Jaycee Parkette. The Council approved the submission of the grant applications at the November 17, 2020, City Council meeting.
The City was notified in January 2022, that the renovation project for Jaycee Parkette was chosen by OGALS to receive a grant award of $610,000. Located in the La Jolla neighborhood, Jaycee Parkette serves the hundreds of students who attend Melrose Elementary School and Valadez Academy. The Jaycee Parkette renovation project will include, removal and replacement of the existing playground and rubberized surfacing, addition of water efficient irrigation, landscaping, and new park lighting.
In addition, on November 21, 2023, the City Council approved a professional services agreement for on-call landscape architectural design firms. The City selected Hirsch & Associates, Inc. (HAI) based on experience and expertise in designing park projects throughout Southern California. In following the approved bench list, a Professional Services Agreement was prepared with HAI to design Jaycee Parkette playground.
In following the Placentia Parks Initiative Plan, a comprehensive plan aimed at improving aging park and facility infrastructure, HAI was tasked with providing the City with creative design concepts for the renovations of Jaycee Parkette. The design concepts were reviewed by Staff and was presented at a community meeting on August 29, 2024 held at the Whitten Community Center. The City received several comments and feedback from the community meeting, including the following comments:
• Request to include some type of water play element
• Concern about the hydration station and associated hardware being tamper resistant, as the existing water fountain has been broken into
• Concern about vandalism of the benches
• Discussion about the drainage channel chain link fencing being cut away for access to the channel. Suggestion to replace the chain link with a type of fencing that does not promote climbing and is more resistant to cutting. (City is currently discussing this with 200
the County of Orange)
• Concern with some of the enclosed play equipment providing spaces for hiding • Request to preserve and re -install the Jaycee Park Plaque • Question regarding the sound levels of the Flower Chimes, given their proximity to homes. City Staff noted that the Flower Chimes are installed in another City park near homes and there have been no complaints
• Request to install a security camera at the park and motion sensor lighting feature • Concern about the Nature Discover Playhouse providing a space for hiding/sleeping.
Suggestion to explore replacing with a different play feature such as a climbing feature or bug/animal
• Comment to add trees within Caltrans Right -of -Way and/or adding a mural to the sound wall. (City is currently discussing this with Caltrans) • Noted that residents use the park walkway to connect to the neighborhood/school.
Suggestion to include detour/closure signs while park is under construction Overall, the community was very excited to have their community park renovated. These comments were incorporated into the design concept and the revised design concept was presented to the Parks, Arts, and Recreation Commission (PARC) at the September 10, 2024, Commission meeting for their review and feedback. They recommended adding a mist feature as the Commission stated that many members of the community walk 1.2 miles to the Miraloma Park and Family Resource Center in Anaheim to enjoy their water features at the park. The Commission also recommended looking into incorporating a larger slide feature rather than have two small park slides.
Staff and the PARC Commission recommend the City Council approve the concept design plan prepared by HAI for the playground renovation project at Jaycee Parkette. The proposed action will approve the design concept plan for Jaycee Parkette. Upon completion of the design, the City will publicly advertise the project to hire a contractor to construct and finalize the project well in advance of the SPP grant deadline of June 30, 2028.
Fiscal Impact Summary:
The total grant award for the project at Jaycee Parkette is $610,000. The grant funds are reimbursed by the California Department of Parks and Recreation. The City is not required to provide any matching funds for this grant. Funding for the project has been appropriated in the FY 24-25 budget as part of the Capital Improvement Program (CIP). The project will also be carried over into subsequent Fiscal Years until completion of the project. Based upon the grant guidelines, the project must be completed by June 30, 2028.

Background
In 2021 the City of Placentia's Jaycee Parkette renovation project was awarded $610,000 of grant funding from California State Parks Office of Grants and Local Services (OGALS). Funding is through the Statewide Park and Community Revitalization Program (SPP).
Project Scope
• Removal and replacement of existing play equipment and rubberized surfacing ■ New water -efficient irrigation
• New landscaping
■ Renovation of park lighting
■ Replacement of existing park amenities
August 29t" Community Outreach Meeting Comments
1. Request to include some type of water play element.
2. Concern about the hydration station and associated hardware being tamper resistant, as the existing water fountain has been broken into.
3. Concern about vandalism of the benches.
4. Discussion about the drainage channel chain link fencing being cut away for access to the channel. Suggestion to replace the chain link with a type of fencing that does not promote climbing and is more resistant to cutting.
Council Member Rhonda Shader stated that the fencing is owned by the OCFCD. There were discussions several years ago regarding replacing the fencing and the City needs to re-engage the topic with OCFCD.
5. Concern with Option 1 play equipment providing spaces for hiding. Preference for Option 2 play equipment because it is more open and provides more shade.
August 29t" Community Outreach Meeting Comments
6. Request to preserve and re -install the Jaycee Park Plaque.
7. Question regarding the sound levels of the Flower Chimes in Option 2, given their proximity to homes. City Staff noted that the Flower Chimes are installed in another City park near homes and there have been no complaints.
8. Request to install a security camera at the park and motion sensor lighting feature.
9. Concern about the Nature Discover Playhouse providing a space for hiding/sleeping. Suggestion to explore replacing with a different play feature such as a climbing feature or bug/animal.
10.Comment to add trees within Caltrans Right -of -Way and/or adding a mural to the sound wall.
11. Noted that residents use the park walkway to connect to the neighborhood/school. Suggestion to include detour/closure signs while park is under construction.
September 10th Parks, Arts, and Recreation Meeting Comments
1.Commission selected Option 2 as the preferred concept. Requested to see if one of the slides could be replaced with a taller slide.
2. Request to remove the Nature Discovery Playhouse and replace with a water mister tower. Commission stated that many members of the community walk
1.2 miles to the Miraloma Park and Family Resource Center in Anaheim to enjoy their water features at the park.
