16-VII.E. CONFIDENTIALITY [24 CFR 5.2007(b)(4)]
All information provided to the PHA regarding domestic violence, dating violence, sexual assault, or stalking, including the fact that an individual is a victim of domestic violence, dating violence, sexual assault, or stalking, must be retained in confidence. This means that the PHA (1) may not enter the information into any shared database, (2) may not allow employees or others to access the information unless they are explicitly authorized to do so and have a need to know the information for purposes of their work, and (3) may not provide the information to any other entity or individual, except to the extent that the disclosure is (a) requested or consented to by the individual in writing, (b) required for use in an eviction proceeding, or (c) otherwise required by applicable law.
PHA Policy
If disclosure is required for use in an eviction proceeding or is otherwise required by applicable law, the PHA will inform the victim before disclosure occurs so that safety risks can be identified and addressed.

EXHIBIT 16-1: SAMPLE NOTICE OF OCCUPANCY RIGHTS UNDER THE VIOLENCE AGAINST WOMEN ACT, FORM HUD-5380
Port Hueneme Housing Authority
Notice of Occupancy Rights under the Violence Against Women Act1 To all Tenants and Applicants
The Violence Against Women Act (VAWA) provides protections for victims of domestic violence, dating violence, sexual assault, or stalking. VAWA protections are not only available to women, but are available equally to all individuals regardless of sex, gender identity, or sexual orientation.2 The U.S. Department of Housing and Urban Development (HUD) is the Federal agency that oversees that public housing is in compliance with VAWA. This notice explains your rights under VAWA. A HUD-approved certification form is attached to this notice. You can fill out this form to show that you are or have been a victim of domestic violence, dating violence, sexual assault, or stalking, and that you wish to use your rights under VAWA.” Protections for Applicants
If you otherwise qualify for assistance under public housing, you cannot be denied admission or denied assistance because you are or have been a victim of domestic violence, dating violence, sexual assault, or stalking.
Protections for Tenants
If you are receiving assistance under public housing, you may not be denied assistance, terminated from participation, or be evicted from your rental housing because you are or have been a victim of domestic violence, dating violence, sexual assault, or stalking.
Also, if you or an affiliated individual of yours is or has been the victim of domestic violence, dating violence, sexual assault, or stalking by a member of your household or any guest, you may not be denied rental assistance or occupancy rights under public housing solely on the basis of criminal activity directly relating to that domestic violence, dating violence, sexual assault, or stalking.
Affiliated individual means your spouse, parent, brother, sister, or child, or a person to whom you stand in the place of a parent or guardian (for example, the affiliated individual is in your care, custody, or control); or any individual, tenant, or lawful occupant living in your household. 1 Despite the name of this law, VAWA protection is available regardless of sex, gender identity, or sexual orientation.
2 Housing providers cannot discriminate on the basis of any protected characteristic, including race, color, national origin, religion, sex, familial status, disability, or age. HUD-assisted and HUD-insured housing must be made available to all otherwise eligible individuals regardless of actual or perceived sexual orientation, gender identity, or marital status.

Removing the Abuser or Perpetrator from the Household
The PHA may divide (bifurcate) your lease in order to evict the individual or terminate the assistance of the individual who has engaged in criminal activity (the abuser or perpetrator) directly relating to domestic violence, dating violence, sexual assault, or stalking.
If the PHA chooses to remove the abuser or perpetrator, the PHA may not take away the rights of eligible tenants to the unit or otherwise punish the remaining tenants. If the evicted abuser or perpetrator was the sole tenant to have established eligibility for assistance under the program, the PHA must allow the tenant who is or has been a victim and other household members to remain in the unit for 30 days, in order to establish eligibility under the program or under another HUD housing program covered by VAWA, or, find alternative housing.
In removing the abuser or perpetrator from the household, the PHA must follow Federal, State, and local eviction procedures. In order to divide a lease, the PHA may, but is not required to, ask you for documentation or certification of the incidences of domestic violence, dating violence, sexual assault, or stalking.
Moving to Another Unit
Upon your request, the PHA may permit you to move to another unit, subject to the availability of other units, and still keep your assistance. In order to approve a request, the PHA may ask you to provide documentation that you are requesting to move because of an incidence of domestic violence, dating violence, sexual assault, or stalking. If the request is a request for emergency transfer, the PHA may ask you to submit a written request or fill out a form where you certify that you meet the criteria for an emergency transfer under VAWA. The criteria are:
1. You are a victim of domestic violence, dating violence, sexual assault, or stalking.
If your PHA does not already have documentation that you are a victim of domestic violence, dating violence, sexual assault, or stalking, your housing provider may ask you for such documentation, as described in the documentation section below.
2. You expressly request the emergency transfer. Your PHA may choose to require that you submit a form, or may accept another written or oral request.
3. You reasonably believe you are threatened with imminent harm from further violence if you remain in your current unit. This means you have a reason to fear that if you do not receive a transfer you would suffer violence in the very near future.
OR
You are a victim of sexual assault and the assault occurred on the premises during the 90-calendar-day period before you request a transfer. If you are a victim of sexual assault, then in addition to qualifying for an emergency transfer because you reasonably believe you are threatened with imminent harm from further violence if you remain in your unit, you may qualify for an emergency transfer if the sexual assault occurred on the premises of the property from which you are seeking your transfer, and that assault happened within the 90-calendar-day period before you expressly request the transfer.

The PHA will keep confidential requests for emergency transfers by victims of domestic violence, dating violence, sexual assault, or stalking, and the location of any move by such victims and their families.
The PHA’s emergency transfer plan provides further information on emergency transfers, and the PHA must make a copy of its emergency transfer plan available to you if you ask to see it.
Documenting You Are or Have Been a Victim of Domestic Violence, Dating Violence, Sexual Assault or Stalking
The PHA can, but is not required to, ask you to provide documentation to “certify” that you are or have been a victim of domestic violence, dating violence, sexual assault, or stalking. Such request from the PHA must be in writing, and the PHA must give you at least 14 business days (Saturdays, Sundays, and federal holidays do not count) from the day you receive the request to provide the documentation. The PHA may, but does not have to, extend the deadline for the submission of documentation upon your request.
You can provide one of the following to the PHA as documentation. It is your choice which of the following to submit if HP asks you to provide documentation that you are or have been a victim of domestic violence, dating violence, sexual assault, or stalking. • A complete HUD-approved certification form given to you by the PHA with this notice, that documents an incident of domestic violence, dating violence, sexual assault, or stalking. The form will ask for your name, the date, time, and location of the incident of domestic violence, dating violence, sexual assault, or stalking, and a description of the incident. The certification form provides for including the name of the abuser or perpetrator if the name of the abuser or perpetrator is known and is safe to provide. • A record of a Federal, State, tribal, territorial, or local law enforcement agency, court, or administrative agency that documents the incident of domestic violence, dating violence, sexual assault, or stalking. Examples of such records include police reports, protective orders, and restraining orders, among others.
• A statement, which you must sign, along with the signature of an employee, agent, or volunteer of a victim service provider, an attorney, a medical professional or a mental health professional (collectively, “professional”) from whom you sought assistance in addressing domestic violence, dating violence, sexual assault, or stalking, or the effects of abuse, and with the professional selected by you attesting under penalty of perjury that he or she believes that the incident or incidents of domestic violence, dating violence, sexual assault, or stalking are grounds for protection.
• Any other statement or evidence that the PHA has agreed to accept.
If you fail or refuse to provide one of these documents within the 14 business days, the PHA does not have to provide you with the protections contained in this notice.
If the PHA receives conflicting evidence that an incident of domestic violence, dating violence, sexual assault, or stalking has been committed (such as certification forms from two or more members of a household each claiming to be a victim and naming one or more of the other petitioning household members as the abuser or perpetrator), the PHA has the right to request that you provide third-party documentation within thirty 30 calendar days in order to resolve the conflict. If you fail or refuse to provide third-party documentation where there is conflicting evidence, the PHA does not have to provide you with the protections contained in this notice.

Confidentiality
The PHA must keep confidential any information you provide related to the exercise of your rights under VAWA, including the fact that you are exercising your rights under VAWA.
The PHA must not allow any individual administering assistance or other services on behalf of the PHA (for example, employees and contractors) to have access to confidential information unless for reasons that specifically call for these individuals to have access to this information under applicable federal, state, or local law.
The PHA must not enter your information into any shared database or disclose your information to any other entity or individual. The PHA, however, may disclose the information provided if:
• You give written permission to the PHA to release the information on a time limited basis.
• The PHA needs to use the information in an eviction or termination proceeding, such as to evict your abuser or perpetrator or terminate your abuser or perpetrator from assistance under this program.
• A law requires the PHA to release the information.
VAWA does not limit the PHA’s duty to honor court orders about access to or control of the property. This includes orders issued to protect a victim and orders dividing property among household members in cases where a family breaks up.
Reasons a Tenant Eligible for Occupancy Rights under VAWA May Be Evicted or Assistance May Be Terminated
You can be evicted and your assistance can be terminated for serious or repeated lease violations that are not related to domestic violence, dating violence, sexual assault, or stalking committed against you. However, the PHA cannot hold tenants who have been victims of domestic violence, dating violence, sexual assault, or stalking to a more demanding set of rules than it applies to tenants who have not been victims of domestic violence, dating violence, sexual assault, or stalking.
The protections described in this notice might not apply, and you could be evicted and your assistance terminated, if the PHA can demonstrate that not evicting you or terminating your assistance would present a real physical danger that:
1. Would occur within an immediate time frame, and
2. Could result in death or serious bodily harm to other tenants or those who work on the property.
If the PHA can demonstrate the above, the PHA should only terminate your assistance or evict you if there are no other actions that could be taken to reduce or eliminate the threat.

Other Laws
VAWA does not replace any Federal, State, or local law that provides greater protection for victims of domestic violence, dating violence, sexual assault, or stalking. You may be entitled to additional housing protections for victims of domestic violence, dating violence, sexual assault, or stalking under other Federal laws, as well as under State and local laws.

SEXUAL ASSAULT, OR STALKING AND ALTERNATE DOCUMENTATION, FORM HUD-5382
CERTIFICATION OF U.S. Department of Housing OMB Approval No. 2577-0286 DOMESTIC VIOLENCE, and Urban Development Exp. 06/30/2017
DATING VIOLENCE,
SEXUAL ASSAULT, OR STALKING,
AND ALTERNATE DOCUMENTATION
Purpose of Form: The Violence Against Women Act (“VAWA”) protects applicants, tenants, and program participants in certain HUD programs from being evicted, denied housing assistance, or terminated from housing assistance based on acts of domestic violence, dating violence, sexual assault, or stalking against them. Despite the name of this law, VAWA protection is available to victims of domestic violence, dating violence, sexual assault, and stalking, regardless of sex, gender identity, or sexual orientation.
Use of This Optional Form: If you are seeking VAWA protections from your housing provider, your housing provider may give you a written request that asks you to submit documentation about the incident or incidents of domestic violence, dating violence, sexual assault, or stalking.
In response to this request, you or someone on your behalf may complete this optional form and submit it to your housing provider, or you may submit one of the following types of third-party documentation:
(1) A document signed by you and an employee, agent, or volunteer of a victim service provider, an attorney, or medical professional, or a mental health professional (collectively, “professional”) from whom you have sought assistance relating to domestic violence, dating violence, sexual assault, or stalking, or the effects of abuse. The document must specify, under penalty of perjury, that the professional believes the incident or incidents of domestic violence, dating violence, sexual assault, or stalking occurred and meet the definition of “domestic violence,” “dating violence,” “sexual assault,” or “stalking” in HUD’s regulations at 24 CFR 5.2003.
(2) A record of a Federal, State, tribal, territorial or local law enforcement agency, court, or administrative agency; or
(3) At the discretion of the housing provider, a statement or other evidence provided by the applicant or tenant.
Submission of Documentation: The time period to submit documentation is 14 business days from the date that you receive a written request from your housing provider asking that you provide documentation of the occurrence of domestic violence, dating violence, sexual assault, or stalking. Your housing provider may, but is not required to, extend the time period to submit the documentation, if you request an extension of the time period. If the requested information is not received within 14 business days of when you received the request for the documentation, or any extension of the date provided by your housing provider, your housing provider does not need to grant you any of the VAWA protections. Distribution or issuance of this form does not serve as a written request for certification.
Confidentiality: All information provided to your housing provider concerning the incident(s) of domestic violence, dating violence, sexual assault, or stalking shall be kept confidential and such details shall not be entered into any shared database. Employees of your housing provider are not to have access to these details unless to grant or deny VAWA protections to you, and such employees may not disclose this information to any other entity or individual, except to the extent that disclosure is: (i) consented to by you in writing in a time-limited release; (ii) required for use in an eviction proceeding or hearing regarding termination of assistance; or (iii) otherwise required by applicable law.

EXHIBIT 16-3: EMERGENCY TRANSFER PLAN FOR VICTIMS OF DOMESTIC
VIOLENCE, DATING VIOLENCE, SEXUAL ASSAULT, OR STALKING
Attachment: Certification form HUD-5382
Port Hueneme Housing Authority
Emergency Transfer Plan for Victims of Domestic Violence, Dating Violence, Sexual Assault, or Stalking
Public Housing Program
Emergency Transfers
The PHA is concerned about the safety of its tenants, and such concern extends to tenants who are victims of domestic violence, dating violence, sexual assault, or stalking. In accordance with the Violence Against Women Act (VAWA),
3 the PHA allows tenants who are victims of
domestic violence, dating violence, sexual assault, or stalking to request an emergency transfer from the tenant’s current unit to another unit. The ability to request a transfer is available regardless of sex, gender identity, or sexual orientation. 4 The ability of the PHA to honor such
request for tenants currently receiving assistance, however, may depend upon a preliminary determination that the tenant is or has been a victim of domestic violence, dating violence, sexual assault, or stalking, and on whether the PHA has another dwelling unit that is available and is safe to offer the tenant for temporary or more permanent occupancy.
This plan identifies tenants who are eligible for an emergency transfer, the documentation needed to request an emergency transfer, confidentiality protections, how an emergency transfer may occur, and guidance to tenants on safety and security. This plan is based on a model emergency transfer plan published by the U.S. Department of Housing and Urban Development (HUD), the federal agency that oversees that the public housing and housing choice voucher (HCV) programs are in compliance with VAWA.
Eligibility for Emergency Transfers
A tenant who is a victim of domestic violence, dating violence, sexual assault, or stalking, as provided in HUD’s regulations at 24 CFR part 5, subpart L, is eligible for an emergency transfer, if the tenant reasonably believes that there is a threat of imminent harm from further violence if the tenant remains within the same unit. If the tenant is a victim of sexual assault, the tenant may also be eligible to transfer if the sexual assault occurred on the premises within the 90-calendar- day period preceding a request for an emergency transfer. 3Despite the name of this law, VAWA protection is available to all victims of domestic violence, dating violence, sexual assault, and stalking, regardless of sex, gender identity, or sexual orientation. 4Housing providers cannot discriminate on the basis of any protected characteristic, including race, color, national origin, religion, sex, familial status, disability, or age. HUD-assisted and HUD-insured housing must be made available to all otherwise eligible individuals regardless of actual or perceived sexual orientation, gender identity, or marital status.
Agenda Item No. 06 Page 978 of 985 HA Agenda 05-05-2025 © Copyright 2023 Nan McKay & Associates, Inc. Port Hueneme HA ACOP 7/1/2025 Unlimited copies may be made for internal use.
A tenant requesting an emergency transfer must expressly request the transfer in accordance with the procedures described in this plan.
Tenants who are not in good standing may still request an emergency transfer if they meet the eligibility requirements in this section.
Emergency Transfer Request Documentation
To request an emergency transfer, the tenant shall notify the PHA’s management office and submit a written request for a transfer to any PHA office. The PHA will provide reasonable accommodations to this policy for individuals with disabilities. The tenant’s written request for an emergency transfer should include either:
1. A statement expressing that the tenant reasonably believes that there is a threat of imminent harm from further violence if the tenant were to remain in the same dwelling unit assisted under the PHA’s program; OR
2. A statement that the tenant was a sexual assault victim and that the sexual assault occurred on the premises during the 90-calendar-day period preceding the tenant’s request for an emergency transfer.
Confidentiality
The PHA will keep confidential any information that the tenant submits in requesting an emergency transfer, and information about the emergency transfer, unless the tenant gives the PHA written permission to release the information on a time-limited basis, or disclosure of the information is required by law or required for use in an eviction proceeding or hearing regarding termination of assistance from the covered program. This includes keeping confidential the new location of the dwelling unit of the tenant, if one is provided, from the person or persons that committed an act of domestic violence, dating violence, sexual assault, or stalking against the tenant. See the Notice of Occupancy Rights under the Violence against Women Act for All Tenants for more information about the PHA’s responsibility to maintain the confidentiality of information related to incidents of domestic violence, dating violence, sexual assault, or stalking.
Emergency Transfer Timing and Availability
The PHA cannot guarantee that a transfer request will be approved or how long it will take to process a transfer request. The PHA will, however, act as quickly as possible to move a tenant who is a victim of domestic violence, dating violence, sexual assault, or stalking to another unit, subject to availability and safety of a unit. If a tenant reasonably believes a proposed transfer would not be safe, the tenant may request a transfer to a different unit. If a unit is available, the transferred tenant must agree to abide by the terms and conditions that govern occupancy in the unit to which the tenant has been transferred. The PHA may be unable to transfer a tenant to a particular unit if the tenant has not or cannot establish eligibility for that unit.
If the PHA has no safe and available units for which a tenant who needs an emergency transfer is eligible, the PHA will assist the tenant in identifying other housing providers who may have safe and available units to which the tenant could move. At the tenant’s request, the PHA will also assist tenants in contacting the local organizations offering assistance to victims of domestic violence, dating violence, sexual assault, or stalking that are attached to this plan.

Emergency Transfers: Public Housing (PH) Program
If you are a public housing resident and request an emergency transfer as described in this plan, the PHA will attempt to assist you in moving to a safe unit quickly. The PHA will make exceptions as required to policies restricting moves.
Emergency transfers for which you are not required to apply for assistance include the following:
• Public housing unit in a different development
• Public housing unit in the same development, if you determine that the unit is safe At your request, the PHA will refer you to organizations that may be able to further assist you.
You may also request an emergency transfer to the following programs for which you are required to apply for assistance:
• HCV tenant-based program
• HCV project-based assistance
• Other programs administered by the PHA (such as state housing programs) Emergency transfers will not take priority over waiting list admissions for these types of assistance. At your request, the PHA will refer you to organizations that may be able to further assist you.
Safety and Security of Tenants
Pending processing of the transfer and the actual transfer, if it is approved and occurs, the tenant is urged to take all reasonable precautions to be safe.
Tenants who are or have been victims of domestic violence are encouraged to contact the National Domestic Violence Hotline at 1-800-799-7233, or a local domestic violence shelter, for assistance in creating a safety plan. For persons with hearing impairments, that hotline can be accessed by calling 1-800-787-3224 (TTY).
Tenants who have been victims of sexual assault may call the Rape, Abuse, and Incest National Network’s National Sexual Assault Hotline at 1-800-656-HOPE, or visit the online hotline at https://ohl.rainn.org/online/.
Tenants who are or have been victims of stalking seeking help may visit the National Center for Victims of Crime’s Stalking Resource Center at https://www.victimsofcrime.org/ourprograms/stalking-resource-center.

EXHIBIT 16-4: EMERGENCY TRANSFER REQUEST FOR CERTAIN VICTIMS OF
DOMESTIC VIOLENCE, DATING VIOLENCE, SEXUAL ASSAULT, OR STALKING, FORM HUD-5383
EMERGENCY TRANSFER U.S. Department of Housing OMB Approval No. 2577-0286 REQUEST FOR CERTAIN and Urban Development Exp. 06/30/2017
VICTIMS OF DOMESTIC
VIOLENCE, DATING VIOLENCE,
SEXUAL ASSAULT, OR STALKING
Purpose of Form: If you are a victim of domestic violence, dating violence, sexual assault, or stalking, and you are seeking an emergency transfer, you may use this form to request an emergency transfer and certify that you meet the requirements of eligibility for an emergency transfer under the Violence Against Women Act (VAWA). Although the statutory name references women, VAWA rights and protections apply to all victims of domestic violence, dating violence, sexual assault or stalking. Using this form does not necessarily mean that you will receive an emergency transfer. See your housing provider’s emergency transfer plan for more information about the availability of emergency transfers.
The requirements you must meet are:
(1) You are a victim of domestic violence, dating violence, sexual assault, or stalking.
If your housing provider does not already have documentation that you are a victim of domestic violence, dating violence, sexual assault, or stalking, your housing provider may ask you for such documentation. In response, you may submit Form HUD-5382, or any one of the other types of documentation listed on that Form. (2) You expressly request the emergency transfer. Submission of this form confirms that you have expressly requested a transfer. Your housing provider may choose to require that you submit this form, or may accept another written or oral request. Please see your housing provider’s emergency transfer plan for more details. (3) You reasonably believe you are threatened with imminent harm from further violence if you remain in your current unit. This means you have a reason to fear that if you do not receive a transfer you would suffer violence in the very near future.
OR
You are a victim of sexual assault and the assault occurred on the premises during the 90-calendar-day period before you request a transfer. If you are a victim of sexual assault, then in addition to qualifying for an emergency transfer because you reasonably believe you are threatened with imminent harm from further violence if you remain in your unit, you may qualify for an emergency transfer if the sexual assault occurred on the premises of the property from which you are seeking your transfer, and that assault happened within the 90-calendar-day period before you submit this form or otherwise expressly request the transfer.
Submission of Documentation: If you have third-party documentation that demonstrates why you are eligible for an emergency transfer, you should submit that documentation to your housing provider if it is safe for you to do so. Examples of third party documentation include, but are not limited to: a letter or other documentation from a victim service provider, social worker, legal assistance provider, pastoral counselor, mental health provider, or other professional from whom you have sought assistance; a current restraining order; a recent court order or other court records; a law enforcement report or records; communication records from the perpetrator of the violence or family members or friends of the perpetrator of the violence, including emails, voicemails, text messages, and social media posts.

Confidentiality: All information provided to your housing provider concerning the incident(s) of domestic violence, dating violence, sexual assault, or stalking, and concerning your request for an emergency transfer shall be kept confidential. Such details shall not be entered into any shared database.

HA Agenda 05-05-2025
DATE: May 5, 2025
TO: City Council and Boards of the Surplus Property Authority and the Port Hueneme Housing Authority
FROM: James Vega, City Manager
Ashley Chaparro, Interim Finance Director
SUBJECT: BIENNUAL BUDGET FISCAL YEARS 2025-26 AND 2026-27 BUDGET
WORKSHOP
RECOMMENDATION:
It is recommended the Council and Boards take the following actions:
1. Receive a high-level overview of economic trends and current budget outlook with a focus on the General Fund;
2. Provide feedback and general direction;
3. Allow for public participation and comments for Council/Board consideration; and
4. Direct staff to incorporate any direction and return with a second budget workshop on Monday, May 19, 2025.
BACKGROUND/ANALYSIS:
This initial budget workshop is intended to provide a high-level overview of recent economic trends, as well as a high-level current budget outlook, to allow the City Council, staff and public to understand the general direction of the draft budget. A second budget workshop will be scheduled on Monday, May 19, 2025, that will be more detail oriented.
Staff recommends that the City Council/Board review the information, ask any questions of staff and receive public input. At the end of the review, it is recommended that the City Council/Board provide general direction and feedback to staff regarding the budget approach.
A thorough overview of the City’s economic outlook is being prepared for the May 19, 2025, City Council meeting. However, staff would like to take this opportunity to discuss high-level economic trends and forecasts to explain the general direction of the budget process.
City’s General Economic Outlook:
The City anticipated decreased revenues in its September 2023 budget discussion, and the City Council prudently approved reductions in anticipation of the decrease. The Agenda Item No. 07 Page 1 of 6 CC/HA/SPA Agenda 05-05-2025 decrease has occurred and the reductions proved necessary. Those reductions were based on staff’s anticipation that cannabis revenues (and sales tax revenues) were at their highest level but likely to reduce significantly from 2023 to 2026 due to Oxnard and Ventura opening several competing cannabis businesses.
The actions taken in September 2023 to prepare for this downturn included beginning to reduce operating expenditures over time in anticipation of this decrease, creating a CIP reserve fund, postponing non-essential projects to reduce CIP expenditures, and reallocating funding from those items to one priority project to ensure that funding was available to complete that project (Bubbling Springs Park). The goal of the discussion was to begin to decrease spending in anticipation of revenue reductions, to attempt to build up a CIP reserve before those reductions took place, and to ensure the City had the funds to complete the Bubbling Springs Park project without jeopardizing millions of dollars in grant funding.
These efforts were anticipated to be a large first step towards creating a sustainable budget, helped the City prepare for the reduction in revenues.
However, staff anticipates that we are now reaching a second challenge point due to additional broader challenges such as inflation, economic uncertainty, etc., have compounded these issues, resulting in projections from experts of further declines (such as HdL’s updated sales tax projections) and cost increases which may result in requiring further reductions. As noted above, the first step that the City has completed was reducing expenditures to match anticipated revenues, however these recent economic uncertainty related concerns could reduce these revenues even further.
These broader economic challenges may be more difficult because they are not within the City’s control, as they are issues facing the U.S., state and regional economies. 2019-20 Revised

However, this “second wave” of impacts forecast over the next two years may require more aggressive efforts. Structural changes may be necessary while efforts are made to minimize service level impacts.
Fortunately, the difficult reductions made to date ensure that general fund reserves are available for times of economic uncertainty. However, it is unclear how long this period of economic uncertainty may last, or how deep the reductions may be. The unreserved General Fund Balance remains at approximately $7.3 million at this time. This was a key outcome of the decisions made by Council and staff in September 2023 to make reductions rather than deplete the reserve, which now allows the city the time to continue to take steps towards financial sustainability, and avoid any immediate drastic actions that would have an impact on the services provided to the community.
Draft Budget Process:
With this budget outlook, City staff is finalizing a draft budget that will be presented to the City Council on May 19. As you may recall, a preliminary General Fund forecast provided in February of 2025 anticipated a $2.3 million deficit in FY 25/26 which increased to a $3.6 million deficit in FY 26/27 and then to $4 million in FY 27/28. Staff has worked diligently since that period to reduce the deficit towards a sustainable budget. Reductions have focused on the following areas:
• 5% Department Reductions: Although many reductions were already made over the prior two years, an additional 5% reduction was proposed for each department, with a focus on reductions that minimized service level impacts. All departments proposed reductions in the draft budget. Unfortunately, with recent cost increases, these reductions will likely be absorbed over the next 1-2 years. • External Hiring Freeze: An external hiring freeze has been implemented by the City Manager, and recruitments will be evaluated on a case by case basis based on service level impacts and available funding. The City added many full-time equivalent positions when sales tax, measure “U” and cannabis revenues increased – and those expenses continue and even increase as those revenues decrease. Staff has made diligent efforts to manage these costs more closely and identify efficiency opportunities since September 2023, but anticipates additional attrition is needed to address future year budgets. This is a difficult process and will not be easy, but at this time staff recommends this process which prioritizes current employees. As positions become vacant, modifications to positions and organizational structures will likely be proposed before filling to reduce costs and increase efficiencies.
• Utilizing the recently created CIP reserve to fund CIP to reduce General Fund Impacts: Creating the CIP reserve in late 2023 proved timely as it will allow for CIP projects to be funded and reduce impacts to General Fund. It is important to note though that a continued downturn would likely mean no further revenue being allocated to a CIP reserve, creating a long-term funding challenge that will need to be addressed in the future.
• Continue to Work towards Being Prepared for Economic Uncertainty: Staff expects volatility over the next 1-2 years. Staff will provide mid-year updates and likely continue to make adjustments based on real-time economic data over coming year. The proposed budget takes aggressive steps to prepare for this but does not yet implement “worst case scenario adjustments.” If broader economic concerns materialize, further changes will be needed.
Agenda Item No. 07 Page 3 of 6 CC/HA/SPA Agenda 05-05-2025 The proposed budget includes several additional reductions from prior level and continues to work towards sustainability despite economic uncertainty. Staff has made all budget adjustments using the City Council’s adopted Goals and Strategic Priorities (i.e.
Goal 1’s focus on service levels for residents and businesses), and will continue to utilize those goals in decision making. Staff will continue to work on closing the gap, however, the budget may still include a budget gap due to all of the circumstances above. At this time, staff is asking City Council for general direction on potential options:
• Additional reductions of annual/ongoing expenses such as: Cancellation of City events (Holiday Events, Touch a Truck, Other Recreation Events), Elimination of programs and/or services, Elimination of memberships in organizations, Temporary Elimination in Travel/Training Budgets, etc. At this time, staff is not recommending this item due to impact on community and also due to difficulty in restarting programs or events once canceled. This may be a permanent cancellation to address a temporary issue – staff recommends holding off on this until more certainty in coming year.
• Budgeted Use of General Fund Balance: As mentioned above, the difficult reductions made since September 2023 have ensured fund balance remains available in the event of a temporary economic downturn. It is unclear the length and severity of a potential economic downturn, but staff will likely recommend this option until more data is available in coming year, but will continue to narrow the gap to avoid depleting the fund balance.
• Revenue Increases: To date, most of the conversation has revolved around reducing expenditures, but as noted above with costs increasing it will cost more to provide the same or less services than in the past, so revenues will be discussed further in coming months as revenue increases will also be needed to cover the cost of providing services for the long-term health and sustainability of the budget.
This will not be an immediate solution because it takes time for cities to analyze and increase revenue appropriately, but this should be considered as part of a longer-term solution.
• Direct Staff to Explore Options with Surplus Property: One-time revenue from sale of a property is not generally a solution to ongoing budget issues. However, with a lack of clarity about the impacts of economic uncertainty and the timeframe for these issues, this option should be explored in the coming year.
Because staff has already made reductions since September 2023 totaling millions of dollars, additional reductions would be very impactful. Staff will continue to look for lower impact opportunities, but anticipates focusing on revenue increases and budgeted use of fund balance as tools, and exploring options with surplus property. As noted in recent City Council meetings, staff is also beginning to analyze City utility rates, including Solid Waste (trash) and Wastewater (sewer) rates. These rates have not been regularly analyzed or updated, and need to be reviewed further. It will likely be a combination of these items that will help to create a sustainable and balanced budget into the future.
FISCAL IMPACT:
The Fiscal impact of any recommendations from Council will be incorporated into the proposed budget.

SUBJECT: TREASURER’S QUARTERLY INVESTMENT REPORT – MARCH 31, 2025
RECOMMENDATION:
It is recommended the City Council receive and file the March 31, 2025 Treasurer’s Reports as presented.
BACKGROUND/ANALYSIS:
The information provided in the attached March 31, 2025 Treasurer Report has been verified to be in conformity with the City of Port Hueneme updated Investment Policy approved by the City Council on September 18, 2023.
The City's cash management system is designed to accurately monitor and forecast expenditures and revenues, thus enabling the City to invest funds to the fullest extent possible. The City attempts to obtain the highest yield obtainable as long as investments meet the criteria established for safety and liquidity. The basic premise underlying the City’s investment philosophy is, and will continue to be, to ensure that money is always safe and available when needed.
The Treasurer Report includes the Investment accounts and the pooled cash accounts.
For the quarter ended March 31, 2025, the total quarterly investment earnings were $905,618.
The City started the investment with Chandler Management in October 2023; this investment has provided solid returns with an average return of 4.63% or $346,311 in the reporting quarter.
The pooled cash account with Wells Fargo is the funding source for all of the City’s operating expenses and capital improvement projects. The net decrease in the balance of the Wells Fargo Pool Account from $18.6M at December 31, 2024 to $15.7M at March 31, 2025 or a $2.9M decrease is primarily due to various outflows of cash outflows as follows:
- $1.2M for the Bubbling Springs Park Project Construction - $1.7M for the Road Sewer Forcemain Break Repair Project Docusign Envelope ID: 84969DFC-1FE1-479C-812B-C2129FDA2754 Agenda Item No. 10 Page 1 of 3 CC Agenda 05-05-2025

Tony Stewart, AICP, Director of Community and Economic Development SUBJECT: ANNUAL DEVELOPMENT AGREEMENT COMPLIANCE REVIEW FOR EMERALD PERSPECTIVE COOPERATIVE, INC. AND FINDING OF
EXEMPTION FROM CEQA
RECOMMENDATION:
It is recommended the City Council:
1. Open the public hearing to take testimonial and documentary evidence; and
2. Close the public hearing and consider the evidence; and
3. Adopt a Resolution Determining that Emerald Perspective Cooperative, Inc is Out of Compliance with their Development Agreement; and
4. Make a determination the project is exempt under CEQA; and
5. Take such additional, related, action that may be desirable, including determining which course of action to take regarding the subject business’ default of the Terms and Conditions of its Development Agreement, per the options noted in the staff report dated May 5, 2025.
BACKGROUND/ANALYSIS:
Government Code section 65865.1 requires periodic review of development agreements, at which time the applicant, or successor in interest thereto, shall be required to demonstrate good faith compliance with the terms of the agreement. Moreover, Government Code section 65865 states, “[e]very city, county, or city and county, shall, upon request of an applicant, by resolution or ordinance, establish procedures and requirements for the consideration of development agreements upon application by, or on behalf of, the property owner or other person having a legal or equitable interest in the property.”
Resolution No. 4483 (the City’s cannabis "Implementing Resolution") provides the general procedures by which the City is to evaluate development agreements. Each development agreement contains individual terms, which may include unique time frames, obligations, and/or requirements. These terms can be one-time or ongoing; some are fees, some are actual physical improvements, and some are ongoing services.
Review of development agreements is subject to public hearing and is a quasi-judicial action with the potential to affect a vested property right (Gov. Code § 65867). Because Agenda Item No. 12 Page 1 of 36 CC Agenda 05-05-2025
Annual Development Agreement Review – Emerald Perspective May 5, 2025
of the quasi-judicial nature of these proceedings, City Council Members should not leave the dais during discussion or receive any ex parte communications regarding the subject matter. A development agreement may only be terminated or modified by the reviewing body if the evidence before the City Council demonstrates by substantial evidence that the developer has not complied with the terms of the agreement in good faith (Gov. Code § 65861.1).
Currently, the City has development agreements with 18 different developers relating to retail cannabis in accordance with The Control, Regulate and Tax Adult Use of Marijuana Act (“Proposition 64”).
In June 2024, the City amended all of the Development Agreements to provide clarity for the following items: to verify exclusion of the payment of excise taxes paid by the developers from the definition of “gross revenues” (a benefit for the developers); to clarify the developers would pay for the cost of an annual audit of their records (also a potential benefit for the developers, since this could result in fewer audits); and to include the required payment of a minimum of one percent (1%) of each business’ gross revenues towards community benefits.
The subject business, Emerald Perspective Cooperative, Inc. (“Emerald Perspective”) has been in operation as a cannabis dispensary since April 16, 2018. The business is a leased premises of approximately 2,000 square feet located at 100 W. Pleasant Valley Road. In past years, the business has been found to be in compliance with the requirements of its original Development Agreement. However, since the business’ last Development Agreement review (conducted in December 2022), the business has become significantly delinquent in financial obligations owed to the City as follows:
Required 5% payment to City’s General Fund, with interest: $76,216.87 Remaining balance of previous audit cost: $7,028.14
2024 compliance inspection cost: $1,250
Balance of penalties for late payments Oct-Dec. 2022: $3,017.74 Past due business license: $1,641.94
TOTAL DUE TO CITY (as of April 3, 2025): $89,154.69
(Note: an additional $1,680 is also now due to cover the cost of this Annual Development Agreement Review.)
Since December, 2023, staff has made over two dozen attempts to reach the business regarding the amount owed to the City. As a result of these outreach efforts, the business owner (a.k.a. “Developer”) either claimed they were owed money by the City and/or were being overcharged, or ignored staff’s outreach altogether. What documentation was provided to the City by the business was unsubstantiated and requests from staff for the Developer to provide substantiated backup data were also ignored. Note that at this time, staff is working with a collection agency to collect the monies owed to the City. However, due to the timing of this annual Development Agreement review, one of the actions listed at the end of this staff report still call for the full payment of the monies owed to the City within a certain timeframe.
Agenda Item No. 12 Page 2 of 36 CC Agenda 05-05-2025
Annual Development Agreement Review – Emerald Perspective May 5, 2025
In addition, an annual inspection of the business’ operations was conducted by the City’s contract inspector at HdL. The inspector found the business to out of compliance with regard to maintaining the appropriate documents and records on the premises for inspection, nor did the employees have the proper id badges as required by the City and the state’s Department of Cannabis Control (DCC). A letter was mailed to the Developer with the inspection results and requested the deficiencies be corrected by November 30, 2024. The Developer did not respond and therefore, staff reached out again to the Developer about this in January 2025. To date, the Developer has not acknowledged the letter or staff’s reminder nor corrected the violations, and as noted above, has yet to pay for the inspection.
As noted above, the City amended the original Development Agreement between the City and the Developer last June. To date, the Developer has not signed the amended Agreement nor acknowledged its existence.
Consequently, for the reasons cited in the staff report herein, staff requests that the City Council determine the following with regard to the Original and Amended Development Agreements between the City and Emerald Perspective:
Summary of Public Benefits Required by the Development Agreement:
• Complete development and open the business within one year of the effective date of the Ordinance approving the Development Agreement;
• Provide a long-term source of employment opportunities and assisting in the revitalization of the economic base of the community;
• Provide the City directly with additional revenue in the form of an increase in certain taxes;
• Provide additional monies for the City’s general fund through contractual payments to the City with supporting audited documentation; and
• Provide certain community benefits.
Status of Compliance with Development Agreement:
Areas of Compliance with Development Agreement
The Developer is in compliance with the terms and public benefits of the Development Agreement listed above as follows:
• The Developer opened for business in April 2019, one year of the date the Ordinance approving the business’ Development Agreement (application no. PHDA-845) was adopted, which was April 2, 2018.
• Since opening, the business has been a source of employment opportunities, thus assisting with the economic base of the community.
• In addition to the five percent contractual payment to the City's General Fund, the City also expects each cannabis business to provide the equivalent of an additional one percent of the business' gross revenues (less taxes paid) to various community organizations, per the Developer's community benefits plan that was approved in conjunction with the business' CUP and Development Agreement. The Developer has technically complied with this requirement, having made contributions to Community Agenda Item No. 12 Page 3 of 36 CC Agenda 05-05-2025
Annual Development Agreement Review – Emerald Perspective May 5, 2025
Vibes Garage, a non-profit operated by the owner of Emerald Perspective to teach automotive repair skills to underserved youth in the Ventura/Oxnard/Port Hueneme area and to provide free or low-cost automotive repair services to the community.
Areas of Non-Compliance with Development Agreement
• The Developer has consistently not made monthly payments to the City in the amount of five percent of the business' gross revenues (less taxes paid to the state and other entities) of cannabis products sold in the City. Terms and Condition #12 of the Development Agreement between the Developer and the City requires the contractual payment of 5% of the Developer’s gross revenues (less sales taxes paid) to the City on a monthly basis.
To date, the Developer has not paid their required contractual 5% payments to the City’s General Fund for November and December 2023 and then since April 2024.
Subsequently, with penalties, the Developer currently owes the City $76,216.87 as of April 3, 2025.
As the City Council is aware, the primary purpose for allowing the operation of cannabis businesses in the City is to enhance the City’s General Fund. Since the City does not have a cannabis tax in place, the Development Agreement is used as the primary tool for ensuring revenues due to the City are paid by the subject cannabis business. Therefore, the lack of the required payment to the City has a negative impact on the City’s finances and its ability to provide services to ensure the health and safety of the public.
• Along with the required contractual 5% payments, the owners of each business are required to provide paperwork to support the amount of the payments made to the City, along with the taxes collected. However, since the Developer has not made their required contractual payments in many months nor provided substantiated paperwork regarding revenues received by the business, as discussed above, staff is not able to determine whether the business has been providing the City directly with additional revenue in the form of an increase in certain taxes. Further, as noted above, the Developer has not renewed their required Business License nor paid the required Business License Tax.
Therefore, per the Terms and Conditions of the Original and Amended Development Agreement between the Developer and the City, the City Council may find that the Developer is in default of the following Terms and Conditions of the subject Development Agreement:
Section 8:
“8. Vesting of Development Rights.
(b) Existing Rules to Govern. In accordance with the terms of Gov. Code, § 65866, the City and Developer agree that the ordinances, rules, regulations and official policies of the City in effect as of the date of this Development Agreement governing the design, permitted uses, improvement and construction standards applicable to the Development (collectively, the “Existing Development Regulations” shall govern during the Term of this Development Agreement.” Agenda Item No. 12 Page 4 of 36 CC Agenda 05-05-2025
Annual Development Agreement Review – Emerald Perspective May 5, 2025
As noted in the table above, the Developer has not renewed their Business License nor paid their required Business License Tax with the City. Port Hueneme Municipal Code sections 5003(c) and 5016 require that no business shall operate in the City without first paying the required Business License Tax. Consequently, the City Council may find that by not renewing their Business License nor paying their required Business License Tax, that the Developer is not complying with the requirements related to permitted uses in the City, and is therefore, in default of Section 8(b) of the subject Development Agreement.
Section 17:
“17. Default and Remedies.
(a) Developer’s Default. Developer shall be in default under this Agreement upon the happening of one or more of the following events or conditions:
(ii) A finding and determination by the City Council made following a periodic review under the procedures provided in this Agreement that, upon the basis of substantial evidence, Developer has not complied in good faith with a material requirement of this Development Agreement.
(v) Any violation of the CUP.
As discussed herein, the City Council may find that the Developer is in default of the Development Agreement due to the nonpayment of the required five percent contractual payment towards the City’s General Fund in the amount of $76,216.87 nor proof the business has been providing the City directly with additional revenue in the form of an increase in certain taxes, as well as the Developer has not paid the required Business License Tax. Therefore, the City Council may find that the Developer is in default of Section 17(a)(ii) of the Development Agreement, since the Developer has not paid the required Business License Tax as required by Section 8 of the Development Agreement, has not paid the Contractual Payment as required by Section 9 of the Development Agreement. The City Council may further find the Developer has not paid for the payment of the past annual audit, nor provided the documents required for this year’s audit, as required per Section 9.c. of the Original Development Agreement and Section 9.c. of the Amended Development Agreement.
Additionally, the City Council may further find that the Developer is in default of Section 17(a)(v) in that the business is not operating per the Conditions of Approval of the Conditional Use Permit (CUP) that was approved by the City Council for the project (PHCU-844, approved on April 2, 2018) by being out of compliance with the following Conditions of Approval:
1. This approval is granted to the Applicant for the use of a medicinal and recreational cannabis dispensary as described in the Applicant's written application and as depicted on exhibits specifically labeled as sheets "A1" and "A2" along with related photosimulations of the subject building;
4. The terms and conditions of Certificate of Approval No. PHCA-07 and Development Agreement No. PHDA-845 shall also apply to this Permit; Agenda Item No. 12 Page 5 of 36 CC Agenda 05-05-2025
Annual Development Agreement Review – Emerald Perspective May 5, 2025
31. Permittee shall ensure all on-site personnel will wear visible identification cards on their persons while on the property. The identification card will include a photo, the employee’s name, employee’s position/title, and hire date. The identification card will be presented to law enforcement or any City official upon request;
40. Permittee must agree to the City's consultant, HdL, and City staff reviewing the business operations, including, but not limited to, accounting, security, staffing, etc., on a quarterly and annual basis for at least the first year of business operations, and for an extended period of time if deemed necessary by the City, and must agree to pay all fees associated with these reviews. Said reviews shall be conducted to ensure compliance with the Conditions of Approval of this Resolution, and related Certificate of Approval PHCA-07 and Development Agreement PHDA-845.
As noted above, a regular, annual inspection of the subject business’ operations was conducted by HdL staff in October, 2024. During the inspection, it was determined the business did not have the required documents and plans available for the inspector’s review, nor did the employees have the required identification. In order to be approved by the City, a cannabis business must demonstrate all City, DCC and other regulations will be complied with within the business’ Certificate of Approval and CUP application packages. Therefore, while the Certificate of Approval and CUP application packages for Emerald Perspective contained this information, the business was found to be not following these plans and requirements during the October 2024 inspection. To date, the Developer has not verified these items have been corrected. Therefore, the City Council may find that the Developer is not in compliance with CUP conditions 1, 4 and 31, and therefore, is in default of Section 17(a)(v) of their Development Agreement.
Further, as noted above, the Developer has not paid for their past audit or inspection.
Therefore, the City Council may find the Developer is not in compliance with CUP condition 40, and therefore, is in default of Section 17(a)(v) of their Development Agreement.
Consequently, in accordance with Terms and Conditions No. 11 of the subject Development Agreement, which states that any interruption in or diminution of any City Benefit or of the revenue source discussed within the Development Agreement is sufficient ground for finding that the Developer is not in good-faith compliance with this Development Agreement, the City Council may opt to:
1. Demand compliance with development agreement requirements and full payment of all monies owed to the City as noted in the table above by a certain date (i.e. 30 days from the date of this hearing) and if not paid in full within this period, revoke the Developer’s Development Agreement, subject to the procedures set forth in the Development Agreement and City’s adopted requirements and procedures, and (should the City Council choose this option, staff will begin the process to also revoke the business’ CUP).
Alternatively, the City Council may:
Agenda Item No. 12 Page 6 of 36 CC Agenda 05-05-2025
Annual Development Agreement Review – Emerald Perspective May 5, 2025
2. Allow a one-time “payment plan” with fixed terms and conditions requiring an immediate payment of not less than $12,000, to cover the outstanding annual audit, inspection and Development Agreement review fees and Business License Tax within 30 days of this hearing, with the remainder of the payments to be completed within no greater than six months. The agreement for the payment plan must be entered into within 30 days of this hearing. The payment plan would be based on the unaudited gross receipts. Upon completion of the Financial Audit, a true up adjustment will be calculated based on the audit results. If there are additional revenues owed to the City, the amount of additional revenues will be due within 30 days of completion of the audit. These amounts will not be included in the payment plan. The business would be able to continue operations subject to complying with all terms and conditions of the payment plan; or
3. Take other such additional action as may be desired.
In conclusion, as discussed above, the Developer has repeatedly ignored staff’s requests to produce the information necessary to validate the Developer’s claims of how much is owed to the City or has ignored staff’s outreach altogether, and further, has refused any attempt to pay the monies owed to the City, has not paid the required Annual Business License Tax, has not provided the required documents nor paid for this year’s annual audit, and is also operating in violation of the Conditional Use Permit for the business, which is also a violation of the Development Agreement. Therefore, at this time, it is recommended the City Council find Emerald Perspective to be in violation of their Development Agreement with the City (as well as their Conditional Use Permit) and exercise Option 1, above.
California Environmental Quality Act (CEQA)
The project is exempt from CEQA as set forth in CEQA Guidelines (14 California Code of regulations §§ 15000, et seq.) § 15309, which states "Class 9 consists of activities limited entirely to inspections, to check for performance of an operation, or quality, health, or safety of a project."
FISCAL IMPACT:
As noted above, Emerald Perspective currently owes (as of April 3, 2024) $90,834.69 (89,154.69 in past due fees and penalties plus $1,680 currently due for this annual Development Agreement Review) in General Fund revenues to the City. In addition, at this time, it is not known whether the business is producing additional revenue in the form of an increase in certain taxes.

NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF PORT HUENEME DOES HEREBY RESOLVE:
SECTION 1: Under the provisions of PHMC Section 10201.C., the City Council finds and declares that in accordance with the Revised Implementing Resolution, the applicant, or successor in interest thereto, shall be required to demonstrate good faith compliance with the terms of the Development Agreement for the subject business and the City Council will review every development agreement authorized by this Resolution for compliance with the following criteria:
A. Payment of contractual payments amounting to no less than five percent of the annual gross revenues, unless another amount is specified in the Development Agreement, based upon an annual audited financial statement;
B. Review of any audits of the business conducted, if any; C. Compliance with the City’s Ordinances, any discretionary or ministerial permits, or other regulations to which the Commercial Cannabis Activity may be subject.
SECTION 2: DETERMINATION OF COMPLIANCE. The City Council finds and declares Emerald Perspective is in compliance with the public benefits summary, as identified in the Development Agreement and Amended Development Agreement for the cannabis dispensary operated by Emerald Perspective which include, without limitation:
A. Said cannabis dispensary has provided a long-term source of employment opportunities and assisting in the revitalization of the economic base of the community; B. Said cannabis dispensary has provided certain community benefits.
SECTION 3: DETERMINATION OF NON-COMPLIANCE. The City Council further finds and declares Emerald Perspective is out of compliance with the public benefits summary, as identified in the Development Agreement and Amended Development Agreement for the cannabis dispensary operated by Emerald Perspective which include, without limitation:
A. Terms and Condition #9 of the Development Agreement between Emerald Perspective and the City requires the contractual payment of 5 percent of Emerald Perspective’s gross revenues to the City on a monthly basis. Although the 2022 Development Agreement Review determined Emerald Perspective was in compliance with the Development Agreement’s provisions, in late 2023 and most of 2024, Emerald Perspective has not made monthly payments to the City in the amount of five percent of the business' gross revenues (less taxes paid to the state and other entities) of cannabis products sold in the City.
To date, Emerald Perspective has not paid its 5 percent payments to the City’s General Fund for the months of November and December 2023 and from May 2024 to present.
A purpose for allowing the operation of cannabis businesses in the City is to enhance the City’s General Fund. Since the City does not have a cannabis tax in place, the Development Agreement is used as the primary tool for ensuring revenues due to the City are paid by the subject cannabis business. Therefore, Emerald Perspective’s lack of the required payment to the City has a negative impact on the City’s finances and its ability to provide services to ensure the health and safety of the public.
Terms and Conditions #9 (a) – (c) of the Development Agreement between the City and Emerald Perspective requires Emerald Perspective to provide an annual audited Agenda Item No. 12 Page 10 of 36 CC Agenda 05-05-2025
CC Resolution No. ___, Page 3 of 7
financial statement, a copy of which shall be provided by Emerald Perspective’s auditor directly to the City. Such audited financial report shall be produced within ninety (90) days of the end of the fiscal year. These Development Agreement terms further require Emerald Perspective to maintain its books and records in a manner consistent with generally accepted accounting principles (GAAP), and to fairly report all monies received by Emerald Perspective during the relevant period. Finally, these Development Agreement terms provide that if any audit of Emerald Perspective demonstrates that Emerald Perspective has underpaid the annual Contractual Payment, Emerald Perspective shall make payment to the City of any shortfall in the Contractual Payment, together with interest thereon from the date each portion of the shortfall should have been paid until it is in fact paid, at the annual rate of seven percent (7%). If the amount of the shortfall exceeds the amount actually paid by seven percent (7%) or more, developer shall also pay to the City, as compensation for its efforts in enforcing the payment provisions of this Agreement and not as a penalty, an amount equal to ten percent (10%) of the shortfall (including interest). To date, Emerald Perspective has not provided such audited documents necessary to determine the actual amount due to the City. Subsequently, with penalties, the Developer currently owes the City $76,216.87 as of April 3, 2025.
Since December, 2023, staff has made over two dozen attempts to reach the business regarding the amount owed to the City. As a result of these outreach efforts, the Developer either claimed they were owed money by the City and/or were being overcharged, or ignored staff’s outreach altogether. What documentation was provided to the City by the business was unsubstantiated and requests from staff for the Developer to provide substantiated backup data were also ignored.
Further, as required by Terms and Conditions #9 (c) of the Development Agreement and Amended Development Agreement, along with the required contractual 5% payments, the owners of each business are required to provide paperwork to support the amount of the payments made to the City, along with the taxes collected. However, since the Developer has not made their required contractual payments in many months nor provided substantiated paperwork regarding revenues received by the business, staff is not able to determine whether the business has been providing the City directly with additional revenue in the form of an increase in certain taxes.
B. Terms and Conditions #8 (b) of the Development Agreement requires that in accordance with the terms of California Government Code § 65866, the City and Developer agree that the ordinances, rules, regulations and official policies of the City in effect as of the date of this Development Agreement governing the design, permitted uses, improvement and construction standards applicable to the Development shall govern during the Term of this Development Agreement. However, the Developer has not renewed their Business License nor paid their required Business License Tax with the City.
C. Terms and Conditions #17 (a)(ii) and (v) of the Development Agreement state that Developer shall be in default under the Development Agreement upon the finding and determination by the City Council made following a periodic review under the procedures provided in this Agreement that, upon the basis of substantial evidence, Agenda Item No. 12 Page 11 of 36 CC Agenda 05-05-2025
CC Resolution No. ___, Page 4 of 7
the Developer has not complied in good faith with a material requirement of this Development Agreement and any violation of the Conditional Use Permit (CUP) approved for the operation of the subject dispensary.
In addition to the findings Emerald Perspective is out of compliance with the Development Agreement between the business and the City, as discussed in subsections A and B above, the business is currently in violation of Conditional Use Permit No. PHCU-844, approved to allow the operation of the subject cannabis dispensary on April 2, 2018 by being out of compliance with the following Conditions of Approval:
1. This approval is granted to the Applicant for the use of a medicinal and recreational cannabis dispensary as described in the Applicant's written application and as depicted on exhibits specifically labeled as sheets "A1" and "A2" along with related photosimulations of the subject building;
4. The terms and conditions of Certificate of Approval No. PHCA-07 and Development Agreement No. PHDA-845 shall also apply to this Permit;
31. Permittee shall ensure all on-site personnel will wear visible identification cards on their persons while on the property. The identification card will include a photo, the employee’s name, employee’s position/title, and hire date. The identification card will be presented to law enforcement or any City official upon request;
A regular, annual inspection of the subject business’ operations was conducted by the City’s consulting cannabis business inspector in October, 2024. During the inspection, it was determined the business did not have the required documents and plans available for the inspector’s review, nor did the employees have the required identification. In order to be approved by the City, a cannabis business must demonstrate all City, California Department of Cannabis Control, and other regulations will be complied with within the business’ Certificate of Approval and CUP application packages.

SECTION 4: City Council Options for Action on Developer’s Default. Per the Terms and Conditions of the Development Agreement and Amended Development Agreement between Emerald Perspective and the City, the City Council may declare that Emerald Perspective is in default of the Development Agreement and in breach of its contractual obligations. Specifically, the City Council may find per Terms and Conditions No. 17 of the subject Development Agreement:
“17. Default and Remedies.
(a) Developer’s Default. Developer shall be in default under this Agreement upon the happening of one or more of the following events or conditions:
(ii) A finding and determination by the City Council made following a periodic review under the procedures provided in this Agreement that, upon the basis of substantial evidence, Developer has not complied in good faith with a material requirement of this Amended Development Agreement.
(v) Any violation of the CUP.
Consequently, the City Council may opt to:
1. Demand full payment from the developer by a certain date (i.e. 30 days from the date of this hearing); or
2. Allow a one-time “payment plan” with fixed terms and conditions. The payment plan would be based on the unaudited gross receipts. Upon completion of the Financial Audit, a true up adjustment will be calculated based on the audit results, If there are additional revenues owed to the City, the amount of additional revenues will be due within 30 days of completion of the audit. These amounts will not be included in the payment plan; or
3. Revoke the developer’s Development Agreement, subject to the procedures set forth in the Development Agreement and City’s adopted requirements and procedures.
4. Take other such additional action as may be desired.
SECTION 5: City Council Action on Developer’s Default. Based on the options for action on Emerald Perspective’s default, as provided in Section 4 above, the City Council hereby demands full payment of the required 5 percent payment obligation of Emerald Perspective’s gross revenues to the City’s General Fund, with all applicable penalties, as well as all audit and inspection fees and taxes due for a total of $90,834.69, and to correct all violations of the Subject Business’ Conditional Use Permit conditions of approval as required to be in compliance with the Development Agreement, no later than 4:00 p.m. June 5, 2025. If payment is not received in full, and all outstanding violations are not corrected by that date and time, the City Council will take action to revoke Emerald Perspective’s Development Agreement, subject to the procedures set forth in the Development Agreement between Emerald Perspective and the City and the City’s adopted requirements and procedures. In addition, the City Council may direct legal counsel to commence an action for any outstanding sums due to the City.
SECTION 6: Environmental Review. This Resolution is exempt from additional review under Section 15309 of the California Environmental Quality Act (California Public Resources Code §§21000, et seq., “CEQA”), which states "Class 9 consists of activities limited entirely to inspections, to check for performance of an operation, or quality, health, or safety of a project." SUBJECT: ELECTRIC / MOTORIZED VEHICLES ON HUENEME BEACH PIER RECOMMENDATION:
It is recommended that City Council:
1. Receive information regarding current status of electric/motorized vehicles on Hueneme Beach Pier.
2. Direct staff to create a sign stating “Electric/Motorized Vehicles are not allowed on Hueneme Beach Pier” to be placed in the City’s kiosk located near the pier.
BACKGROUND/ANALYSIS:
This item is presented as a result of Council’s approval of Mayor Pro Tem Lopez’s request to discuss public safety mitigation measures related to the use of electric or motorized vehicles at the pier at the April 7, 2025 Council meeting. The request was made in response to a public comment focused on electric/motorized vehicles on the pier. The resident did request that staff clarify that their concerns were broader than simply this issue, and their past concerns have included dogs on beach, non-motorized bicycles on beach, fishermen casting their rods on the pier, large dogs being walked, and lack of signage regarding littering violations. Recently, to address similar concerns, Staff prepared and installed new general signage at the beach that identifies regulations regarding these and other items (Attachment B). However, this item is focused on the electric/motorized vehicle issue as this was the item requested for consideration by the City Council.
The item is presented to provide the Council with information about existing signage, relevant municipal code sections and to obtain direction.
Port Hueneme Municipal Code Article IV – Parks, Beaches and Community Recreation Facilities (Attachment A) outlines various rules and restrictions specifically applicable to the Hueneme Beach Park and Pier areas, which are not applicable to other areas in the City. Currently, as noted above, these special restrictions are clearly displayed on signage installed last year at Hueneme Beach following resident inquiries about specific prohibited activities. The City had several requests for signage, but to avoid “sign blight” the City Agenda Item No. 13 Page 1 of 17 CC Agenda 05-05-2025
Electric / Motorized Vehicles on the Pier
May 5, 2025
created one new sign that included several restrictions and placed these at Hueneme Beach (see Attachment B).
There are currently two sections of the Municipal Code that apply to wheeled vehicles at either the Beach Park and/or the Pier.
Municipal Code Section 4301 specifically prohibits riding, pushing, or pulling any wheeled vehicle on the Pier, except those vehicles designed and used for assisting handicapped or disabled persons.
Municipal Code 4212, which applies to Hueneme Beach Park, states “it shall be unlawful for any person to ride, push, pull or otherwise transport any wheeled vehicle for human conveyance on any unpaved areas at the beach park.”
These code sections are ambiguous about what defines a wheeled vehicle, and could lead to problematic enforcement. For example, the code sections could inadvertently restrict common items such as strollers, coolers, wagons, and similar wheeled vehicles frequently used by visitors. To further illustrate – a child in a stroller would not be allowed on the pier. Staff does not believe that this was the intent of adopting these code sections.
However, because it is clear between these two code sections that a prohibition is intended of electric/motorized vehicles on the Pier, staff recommends that Council direct staff to create a sign stating “Electric/Motorized Vehicles are not allowed on Hueneme Beach Pier” to be placed in the City’s kiosk located near the pier.
This will supplement the recently created signage at Hueneme Beach (Attachment B) which also explicitly states prohibitions, including motor vehicles on walkways and beaches, bicycles or wheeled vehicles on sand (except for handicap exemption), and other safety-related restrictions (Municipal Code Sections 4206, 4212). These signs contain information about the various prohibited activities at the beach. Having a single sign that presents rules in one place ensures consistency in messaging, decreases sign clutter, reduces costs and provides a centralized location where rules can be found.
Placing an additional sign in the kiosk would be intended to advise and educate the public regarding the prohibition. The addition of the flyer or any other signage would not have any direct impact on enforcement.
If Council wishes to pursue further updates to these code sections, staff would recommend that City Council direct the Citizens Advisory Commission to review those sections. These sections directly impact the community’s enjoyment of Hueneme Beach Park and the Pier and a public discussion that would allow for community input would be appropriate, as there are likely opinions from varying perspectives.
FISCAL IMPACT:
None. The recommend action does not require an expenditure of funds.

At such times as the blackball flag is displayed, swimming and bathing only shall be permitted in the waters of the Pacific Ocean opposite those areas of the beach within two hundred (200) yards of the point of display of said blackball flag, provided, however, that where said blackball flag is displayed from consecutive operational lifeguard towers, lifeguard stations and similar structures under the control of the city lifeguards along beach regulated by this Chapter then all waters of the Pacific Ocean opposite said beach shall be restricted to swimming and bathing only.
Such restrictions shall also be shown by pairs of red flags put in place by any city lifeguard. At such times as such red flags are displayed, swimming and bathing only shall be permitted in the waters of the Pacific Ocean opposite those areas of the beach lying between a given pair of such red flags. (b) No person shall use, possess or operate in the waters of the Pacific Ocean opposite any beach regulated by this Chapter any object commonly known as a surfmat, paddle board, belly board, surfboard or similar device except within two hundred (200) yards from shore or seventy-five (75) yards seaward of the point at which the average wave is breaking, whichever distance is greater or when used by a skin diver to hold a flag required by section 4202(c).

(d) Notwithstanding any provisions of this section, the Director may from time to time designate certain areas to be used exclusively by persons using surfboards and paddle boards. Such designation may be evoked at any time and the area covered by such designation may be enlarged or reduced at any time. No person shall swim or bathe in the waters of the Pacific Ocean included in an area so designated except while using a surfboard or paddle board or as is necessary in order to use a surfboard. (e) A person in violation of the restrictions set forth in this section shall not fail, refuse or neglect to leave the waters of the Pacific Ocean opposite any beach regulated by this Chapter when such restrictions are in force.
