CITY COUNCIL AGENDA – JUNE 20, 2022
SUBJECT: Annual Adjustment of Fees by Application of the Engineering News-Record (ENR) Cost Index
SOURCE: Engineering and Project Management
COMMENT:
In accordance with prior City Council authorization, staff calculates and adjusts all of the attached fees annually. The policy, as of 2003, is to provide the Council notice of all the proposed adjustments, whether the fees are subject to the Mitigation Fee Act or not, sixty (60) days before the new fees become effective. The fees are adjusted annually by application of the Engineering News-Record (ENR) Cost Index.
Most of the fees in Exhibit "H" Connection Fees and Exhibit "A" Park Impact Fees were in effect prior to January 1, 1989, (the effective date of the Mitigation Fee Act) and have only been increased by the ENR 20-City Construction Cost Index. The fees subject to the Act that were adopted or increased after its effective date were adopted or increased in accordance with those regulations.
City staff has given sixty (60) days notice to the Building Industry Association (BIA) for the fees covered by the Mitigation Fee Act, along with notice to local developers and engineering firms of the proposed impact fee increase.
At its meetings on August 3 and August 17, 2021, Members of Council expressed concern regarding the Parks Impact Fee amount in comparison to other agencies in the area and the corresponding effect on new community park development. At Council's direction, staff has been diligently researching the history of the City's Park Impact Fee and its expenditure since its adoption in January 1999, which a summary report is attached. Staff is legally unable to propose changes or review this fee outside of what has already been noticed, as Government Code Section 66016 requires proper noticing and making public the data justifying any proposed changes at least fourteen (14) days prior to the Hearing. In addition, as previously mentioned, the City has an agreement with BIA to notify them of any fee changes at least sixty (60) days prior to implementation. Council may direct staff to return with a separate item to authorize the necessary studies and steps that are required to make additional changes to the fee beyond the ENR Cost Index.
If approved, the new fees will take effect on July 1, 2022.
Item No. 22.
RECOMMENDATION: That City Council:
1. Conduct the Public Hearing and consider all public testimony; and
2. Implement the ENR Cost Index automatic increase for Fiscal Year 2022-2023 of 8.14%.

5-l. PAYMENT ADJUSTMENTS FOR PRICE INDEX FLUCTUATIONS
GENERAL
Summary
This section applies to asphalt contained in materials for pavement structural sections and pavement surface treatments such as hot mix asphalt (HMA), plant run cold mix(PRCM), tack coat, asphaltic emulsions, bituminous seals, asphalt binders, and modified asphalt binders placed in the work.
The Engineer adjusts payment if the California Statewide Crude Oil Price Index for the month the material is placed is more than 5 percent higher or lower than the price index at the time of contract.
The California Statewide Crude Oil Price Index is determined each month on or about the last business day of the month by the Department using the average of the posted prices in effect for the previous month as posted by Chevron, ExxonMobil, and ConocoPhillips for the Buena Vista, Huntington Beach, and Midway Sunset fields.
If a company discontinues posting its prices for a field, Caltrans determines the index from the remaining posted prices. Caltrans may include additional fields to determine the index.
For the California Statewide Crude Oil Price Index, go to:
http://www.dot.ca.gov/hq/construc/crudeoilindex/
If the adjustment is a decrease in payment, the County deducts the amount from the monthly progress payment.
ASPHALT QUANTITIES
General
Interpret the term “ton" as "tonne" for projects using metric units.
Hot Mix Asphalt/Plant Run Cold Mix
The Engineer calculates the quantity of asphalt in HMA or PRCM using the following formula:
Qh = HMATT x [Xa/(100 + Xa)]
where:
Qh = quantity in tons of asphalt used in HMA or PRCM
HMATT= HMA or PRCM total tons placed
Xa= theoretical asphalt content from job mix formula expressed as percentage of the weight of dry aggregate
Material Contract
Renewal 03
Hot Mix Asphalt Containing Reclaimed Asphalt Pavement (RAP) The Engineer calculates the quantity of asphalt in HMA containing RAP using the following formulas:
Qrap = HMATT x [Xaa I (100 + Xaa)]
where:
Xaa=Xta-[(100-Xnew) x (Xra/100)]
and
Qrap = quantity in tons of asphalt used in HMA containing RAP HMATT = HMA total tons placed
Xaa = asphalt content of HMA adjusted to account for the asphalt content in RAP expressed as percentage of the weight of dry aggregate Xta = total asphalt content of HMA expressed as percentage of the weight of dry aggregate
Xnew= theoretical percentage of new aggregate in the HMA containing RAP determined from RAP percentage in the job mix formula
Xra = asphalt content of RAP expressed as percentage
Asphaltic Emulsion
The Engineer calculates the quantity of asphalt in asphaltic emulsions, including fog seals and tack coat, using the following formula:
Qe =AETT x (Xe I 100)
where:
Qe = quantity in tons of asphalt used in asphaltic emulsions AETT = undiluted asphaltic emulsions total tons placed
Xe = minimum percent residue specified in Section 94, "Asphaltic Emulsions." of the Standard Specifications based on the type of emulsion used Other Materials
For other materials containing asphalt not covered above, the Engineer determines the quantity of asphalt (Qo).
Material Contract
Renewal 03
PAYMENT ADJUSTMENTS
The Engineer includes payment adjustments for price index fluctuations in progress pay estimates. If material containing asphalt is placed within 2 months during 1 estimate period, the Engineer calculates 2 separate adjustments. Each adjustment is calculated using the price index for the month in which the quantity of material containing asphalt subject to adjustment is placed in the work. The sum of the 2 adjustments is used for increasing or decreasing payment in the progress pay estimate.
The Engineer calculates each payment adjustment as follows:
PA = Qt x A
where:
PA =Payment adjustment in dollars for asphalt contained in materials placed in the work for a given month.
Qt = Sum of all quantities of asphalt-contained materials in pavement structural sections and pavement surface treatments placed (Qh + Qrh + Qmh + Qrap + Qtc + Qe + Qss + Qmab + Qo).
A =Adjustment in dollars per ton of asphalt used to produce materials placed in the work rounded to the nearest $0.01.
For US Customary projects, use:
A = [(Iu /Ib) - 1 .05] x lb x [1 + (T / 100)] for an increase in the crude oil price index exceeding 5 percent
A = [(lu /lb) - 0.95] x Ib x [1 + (T / 100)] for a decrease in the crude oil price index exceeding 5 percent
For metric projects, use:
A = 1.1023 x [(Iu /Ib)- 1.05] x lb x [1 + (T I 100)] for an increase in the crude oil price index exceeding 5 percent
A = 1.1023 x [(lu /lb)- 0.95] x lb x [1 + (T I 100)] for a decrease in the crude oil price index exceeding 5 percent
Iu = California Statewide Crude Oil Price Index for the month in which the quantity of asphalt subject to adjustment was placed in the work.
Ib = California Statewide Crude Oil Price Index for the month in which the bid opening for the project occurred
T = Sales and use tax rate, expressed as a percent, currently in effect in the tax jurisdiction where the material is placed. If the tax rate information is not submitted timely, the statewide sales and use tax rate is used in the payment adjustment calculations until the tax rate information is submitted.

The Engineer adjusts payment if the California Statewide Crude Oil Price lndex for the month the material is placed is more than 5 percent higher or lower than the price index at the time of contract.
The California Statewide Crude Oil Price lndex is determined each month on or about the last business day of the month by the Department using the average of the posted prices in effect for the previous month as posted by Chevron, ExxonMobil, and ConocoPhillips for the Buena Vista, Huntington Beach, and Midway Sunset fields.
lf a company discontinues posting its prices for a field, Caltrans determines the index from the remaining posted prices. Caltrans may include additional fields to determine the index.
For the California Statewide Crude Oil Price lndex, go to:
http ://www. dot. ca. g ov/h q/construc/crudeoil ind ex/ lf the adjustment is a decrease in payment, the County deducts the amount from the monthly progress payment.
ASPHALT QUANTITIES
General
lnterpret the term "ton" as "tonne" for projects using metric units.
Hot Mix AsphalUPlant Run Gold Mix
The Engineer calculates the quantity of asphalt in HMA or PRCM using the following formula Qh = HMATT x [Xa/(100 + Xa)]
where
Qh - quantity in tons of asphalt used in HMA or PRCM
HMATT= HMA or PRCM totaltons placed
Xa= theoretical asphalt content from job mix formula expressed as percentage of the weight of dry aggregate
'iTl*'":t'i'"
Hot Mix Asphalt Containing Reclaimed Asphalt Pavement (RAp) The Engineer calculates the quantity of asphalt in HMA containing RAp using the following formulas:
Qrap = HMATT x [Xaa / (100 + Xaa)]
where:
Xaa=Xta-[(1 00-Xnew) x (Xral1 00)]
and
Qrap - quantity in tons of asphalt used in HMA containing RAp HMATT = HMA total tons placed
Qe =AETT x (Xe / 100)
where:
qs = quantity in tons of asphalt used in asphaltic emulsions AETT = undiluted asphaltic emulsions totaltons placed
The Engineer includes payment adjustments for price index fluctuations in progress pay estimates. lf material containing asphalt is placed within 2 months during 1 estimate period, the Engineer calculates 2 separate adjustments.
PA=QtxA
where:
PA =Payment adjustment in dollars for asphalt contained in materials placed in the work for a given month.
Qt = Sum of all quantities of asphalt-contained materials in pavement structural sections and pavement surface treatments placed (Qh + Qrh + Qmh + Qrap + Qtc + Qe+Qss+Qmab+Qo).
A =Adjustment in dollars per ton of asphalt used to produce materials placed in the work rounded to the nearest $0.01.
For US Customary projects, use:
4 = [(lu /lb) - 1 .05] x lb x [1 + (T / 100)] for an increase in the crude oil price index exceeding 5 percent
4 = [(lu /lb) - 0.95] x lb x [1 + (T I 100)] fora decrease in the crude oil price index exceeding 5 percent
For metric projects, use:
A = 1.1023 x [(lu /lb)- 1.05]x tb x [1 + (T / 100)]foran increase in the crude oil price index exceeding 5 percent
A = 1.1023 x [(lu /lb)- 0.95]x lb x [1 + (T / 100)]fora decrease in the crude oil price index exceeding 5 percent
lu = California Statewide Crude Oil Price lndex for the month in which the quantity of asphalt subject to adjustment was placed in the work.
lb = California Statewide Crude Oil Price lndex for the month in which the bid opening for the project occurred
T = Sales and use tax rate, expressed as a percent, currently in effect in the tax jurisdiction where the material is placed. lf the tax rate information is not submitted timely, the statewide sales and use tax rate is used in the payment adjustment calculations untilthe tax rate information is submitted.

CITY COUNCIL AGENDA – JUNE 20, 2022
SUBJECT: Asphalt Grinding Program for Fiscal Year 2022-2023 SOURCE: Public Works
COMMENT: Staff is seeking City Council authority for the expenditure of funds to contract with a grinding contractor for annual services. Such a contract would secure pricing for services and would greatly improve the efficiency and quality of efforts for the Fiscal Year 2022-2023 Overlay Season. It is proposed that the grinding services consist of the milling of city streets, gutters edge, and the blending of existing asphalt during dig-outs and transitions through the project areas. The proposed services would help maintain or replace the asphalt with the proper thickness, which is critical for the longevity and durability of overlay projects.
With the utilization of a grinding contractor, City staff are capable of overlaying streets that have a lower than normal Pavement Condition Index (PCI) rating in lieu of complete reconstruction, resulting in a quality finished product.
Maintenance actions combined with this process would add years to the life of a street, and the cost savings could be used to further the City's Street Maintenance Program. It would further assist the Public Works Department in maintaining minimum staffing levels, reducing equipment operations/maintenance costs, and improve the quality of the finished overlay product.
Staff have received three quotes for services from three local contractors for the Fiscal Year 2022-2023:
Grinding Contractor Quoted Cost of Service Mobilization Fee J. Mack Enterprises Inc. $4,000 @ 8hr Rental No Mobilization Fee Pavement Recycling
Systems Inc.
$3,800 @ 8hr Rental $480 /day
Precision Cold Planing
Inc.
$4,550 @ 8hr Rental $500 /day
After reviewing the three quotes received, staff's recommendation is to award J.
Mack Enterprises Inc., as they were the lowest bidder for the proposed scope of services. In the event of operational challenges, staff also seeks authority from the Council to authorize staff the ability to use all three grinding contractors should scheduling conflicts occur. Staff proposes to prioritize awarding the services in the quoted amount and in the order identified above. Funding for an Annual Grinding Contractor has been programmed in the Capital Improvement Item No. 25.
Budget 2022-2023 in the amount of $50,000 from the Special Gas Tax Fund.
RECOMMENDATION: That the City Council:
1. Authorize staff to utilize annual grinding contractor J. MACK Enterprise Inc. for Fiscal Year 2022-2023; and
2. Allow staff to substitute annual grinding contractor pending schedule conflicts as ranked by the quote for services.

Item No. 26.
CITY COUNCIL AGENDA – JUNE 20, 2022
SUBJECT: Street Striping Program for Fiscal Year 2022-2023 SOURCE: Public Works
COMMENT: The Public Works Department-Streets Maintenance Division is seeking authorization for the expenditure of funds for Annual Striping Services. Striping Services will consist of re-striping lane lines for arterial and collector streets throughout the city limits, in addition to the replacement of existing street markings after asphalt maintenance projects. City staff currently re-paint stop bars, stop legends, crosswalks, turn arrows, school legends, and school crosswalks. The City does not possess the equipment needed to maintain the existing travel lane lines; current efforts have been on an as-needed basis, dictated by overlay and street reconstruction projects, with a primary focus on implementing an aggressive road maintenance program.
The City's Street Maintenance Program coupled with the re-striping of lane lines is necessary for the visibility and safety of the traveling public and a requirement to keep traveling lane lines up to code with the Manual on Uniform Traffic Control Devices. Staff requested per linear feet quotes and services and received three quotes from surrounding area contractors for the Fiscal Year 2022-2023.
Striping Contractor Average Quote Per Linear
Feet
Mobilization
T&T Pavement
Striping
$0.25 Per Ft. $15,000
BBCS Seal &
Striping
$0.35 Per Ft. $17,000
California Striping
Service, Inc.
$0.32 Per Ft. $17,500
Services evaluated and included under the annual agreement are Mobilization, 4" edge line, 4" broken line, 8" single solid line, 4" two-way left turn, linear foot double yellow, linear foot bike lane, linear foot crosswalk removal, crosswalk thermoplastic, removal school xing legend, school xing thermoplastic, traffic control, and layout newly paved roads.
After reviewing the three quotes, the recommendation is to award T&T Pavement Markings as the lowest bidder for the proposed scope of services. In the light of operational challenges, staff would also request the City Council to Item No. 26.
authorize the ability to use all three striping contractors should scheduling conflicts occur, based on the order of quoted services (listed above). Funding for an Annual Striping Program will be determined by the areas of disturbance and performance. Funding will be made available from the following sources; Surface Transportation Program Funds, Measure I Funds, and Measure R Local Funds for the Fiscal Year 2022-2023 in accordance with Street Maintenance Operations, Capital Improvement Projects, Overlay Program, and Asphalt Hot Mix Program.
RECOMMENDATION: That the City Council:
1. Authorize staff to utilize annual striping contractor T&T Pavement Markings and Products Inc. for fiscal year 2022-2023;
2. Allow staff to substitute striping contractors pending schedule conflicts as ranked by the quote for services;
3. Allow for fund expenditures as defined by the operation for services from Street Maintenance Operations, Capital
Improvement Projects Overlay Program and Asphalt Hot Mix Program; and
4. Authorize payment of services upon satisfactory completion.

Item No. 27.
CITY COUNCIL AGENDA – JUNE 20, 2022
SUBJECT: Annual Hauling Services for Asphalt Maintenance Program SOURCE: Public Works
COMMENT: The City's Public Works Department-Streets Maintenance Division is asking for approval for the expenditure of funds for Annual Asphalt Hauling Services.
Secured pricing and services for asphalt hauling will facilitate efforts for the 2022-2023 overlay season. Historically, staff has had to secure transport of asphalt on a project-by-project basis, presenting challenges for project scheduling. As the City continues to develop a robust asphalt maintenance program, staff is continuing to look for opportunities to increase efficiency.
These efforts enable the Department to maintain staffing levels, reduce equipment operations costs, and complete a higher volume of overlays throughout the city, improving the quality of transportation. With the volume of asphalt material that needs to be delivered during the overlay session and overlay preparations, staff sought quotes for services from local trucking companies for hauling services during the Fiscal Year 2022-2023.
Hauling Services Contractor Quoted Cost of Service
Mike Clark Trucking @ $120.00 /hr.
Terry Johnson Trucking, Inc. @ $150.00 /hr.
W.T.B., Inc @ $150.00 /hr.
After reviewing the quotes received, staff recommends awarding Mike Clark Trucking as the lowest quote for the proposed scope of services. In the event of operational challenges, staff seeks authority from the City Council to authorize the ability to use all three haulers should staff encounter scheduling conflicts.
Staff proposes to prioritize awarding the services in the quoted amount and in the order identified above. Funding for services will be made available from the Capital Improvement Projects Overlay Program funded by STP funds and Local Measure R funds.
RECOMMENDATION: That the City Council:
1. Authorize staff to utilize an annual hauling services contractor, Mike Clark Trucking, for the Fiscal Year 2022-2023;
2. Allow staff to substitute annual hauling contractor pending schedule conflicts as ranked by the quote for services;
3. Allow for fund expenditures as defined by the operation of services from the Capital Improvement Project List and Selfperformed Street Maintenance Overlay Program; and Item No. 27.
4. Authorize payment of services upon satisfactory completion.

General Conditions: Unless otherwise specified a 6-hour day, 8-hour night/weekend minimum will be incurred on any trucking day, as well as an 8% increase on all rates for nights and weekends. On all night work there will be a 24-hour cancellation policy or an 8-hour minimum will be applied. There will also be a 10% increase for all rubberized asphalt in transfers. All tonnage quotes are per U.S. ton, based on full loads and direct routes to and from the jobsite and never will any averaging of standby be allowed. Standby will be assessed at the first point of arrival or delay due to the construction site (i.e., traffic control, detours, etc.) and will end when the truck is free and clear to return to the plant or point of origin without delay. Item No. 29.
CITY COUNCIL AGENDA – JUNE 20, 2022
SUBJECT: Authorization to Purchase Fixed Network Radio Water Meter Infrastructure SOURCE: Public Works
COMMENT: The City supplies potable water to residents through a network of pipes, pump stations, and storage reservoirs. There are currently 17,500 water connection meters installed throughout the city. The meters are conventional, multi-jet, turbine, compound meters, and Octave Ultrasonic meters ranging in size from 5/8" inches to 10" inches.
As water meters age, its accuracy diminishes because of the deterioration of moving parts, which become worn and slow down, decreasing the ability to accurately read water consumption levels. This compromises the billing for actual water consumption, resulting in unaccounted-for usage and reduced revenue to support City operations. The Public Works Department has implemented a continuous water meter replacement program, which targets deficient meters. Promptly replacing these old and/or malfunctioning meters with new meters will enhance the efficiency of meter-reading operations, and limit unaccounted-for usage. Master Meter, Inc. meters currently comprise roughly 3,600 (20%) of the total active meters in the distribution system. The purchase of various sizes of new and replacement meters and registers is necessary to maintain system accounting and service account establishment.
Master Meter, Inc. is a well-established manufacturer and supplier of meters throughout the industry, and the City's Water Utilities Division began installing Master Meter meters in the City's water distribution system in 2006. Hydro Pro Solutions, is the sole proprietor of Master Meter meters in California. The City started the implementation of Master Meter 4G radio read meters and the meter reading equipment during the East Porterville Water Supply Project and is moving towards the conversion of existing direct read meters to a fixed network radio read meter infrastructure.
Staff is seeking that City Council authorize the Public Works Director to purchase Master Meter 4G radio read fixed network infrastructure to include data point collectors (Base Stations) and supporting structures (Monopole, and Replacement Light Standards). Also, to be included in purchase authorization is an initial purchase of 16,793 4G Master Meters, ranging in size from 5/8” inches to 8” inches. Combining the purchase of the network infrastructure, data collectors, and endpoints prior to the end of the fiscal year provides savings to the City of Porterville of twenty-five percent (25%). As the Council is aware, supply shortages and unpredictable cost increases would impact future efforts to implement a project of this nature.
Item No. 29.
The cost breakdown of the proposed project is as follows:
Allegro Infrastructure $211,823
Monopole Tower $123,530
Light Standards $265,846
Master Meter AMI/AMR Meters $3,687,699
The proposed project is exempt from the California Environmental Quality Act (CEQA) Guidelines Section 15303, New Construction or Conversion of Small Structures. This exemption applies to the construction and location of limited numbers of new, small facilities or structures and the installation of small new equipment and facilities in small structures. It can also include accessory or appurtenant structures to existing facilities. The project includes the installation of minor utility improvements at ten (10) locations throughout the city. The proposed facilities are intended to be placed primarily as appurtenant structures to existing facilities (i.e., installation of extenders atop existing poles and structures and extension of existing poles), but also include new small structures that are in character with existing uses and facilities in the vicinity (i.e., new monopoles proximal to existing light and utility poles).
If approved, staff would begin the process of the recommended conversion, initiating purchase orders to secure the quoted project dollar amount before the end of the 2021-2022 Fiscal Year. Hydro Pro Solutions, as the sole source vendor, will provide project management of the infrastructure installation and startup. Meter endpoints will be the responsibility of the City to self-perform conversion efforts and coordinate the updating account information. The estimated cost of the proposed project is not to exceed $4,932,437 (inclusive of all parts, taxes, labor, prevailing wage, and a 15% contingency). Funding for the project will be made available as identified in the Fiscal Year 2022-2023 Capital Improvement Project Budget from the Water Replacement Fund.
RECOMMENDATION: That the City Council:
1. Find the project exempt from the California
Environmental Quality Act (CEQA) pursuant to State
CEQA Guideline Section 15303 New Construction or
Conversion of Small Structures and approve the purchase;
2. Authorize the Public Works Director to purchase and
implement a Master Meter 4G radio read fixed network
infrastructure project to include data collectors, supporting structures, and end point meters;
3. Direct the Finance Director to initiate a Purchase order to Hydro Pro Solutions for the purchase of Master Meter 4G radio read fixed network infrastructure, data collectors, supporting structures, and various end point meters at a cost not to exceed $4,932,437 (inclusive of all parts, taxes, Item No. 29.
and labor and a 15% contingency); and
4. Direct the Finance Director to make payment to Hydro Pro Solutions upon receipt of an invoice approved by the Public Works Director meeting all prevailing wage
requirements.

CITY COUNCIL AGENDA – JUNE 20, 2022
SUBJECT: Bid Results - Island Annexation Area 478 B & C Sewer Project SOURCE: Engineering and Project Management
COMMENT: On June 8, 2022, staff received two bids for the Island Annexation Sewer Project - Area 478 B & C. Area 478B is generally bound by Pioneer Avenue to the south, State Highway 65 to the east, and Prospect Street to the west. Area 478C is generally bound by Harrison Avenue to the north, Westwood Street to the east, and Road 222/Elderwood Street to the west.
The Engineer's Estimate of Probable Cost for the project was $2,634,511. The low bid presented by West Valley Construction of San Jose is $3,433,835, which is $799,324 higher than the Engineer's Estimate (30.34%). An additional $343,383 is necessary for construction contingency (10%) and $343,383 is required for construction management, surveying, quality control and inspection services (10%); equating to a total construction cost of $4,120,601.
It has been the City Council's policy to reject all bids when the bid exceeds ten percent (10%) of the Engineer's Estimate. Although the possibility exists that the City will receive favorable bids if re-advertised, the indicators in the current market suggest the chances of such are very small and the delays created in readvertising could jeopardize the funding source of the project.
Funding for this project in the amount of $1,100,000 will come from proceeds from the issuance of the 2019 Sewer Revenue Bonds, better known to staff as Certificates of Participation (COP) funds. An additional $3,020,601 from the Sewer Revolving Fund is necessary to fully fund the project.
The bids are as follows:
Contractor Amount
West Valley Construction
San Jose, CA
$3,433,835
Emmett's Excavation, Inc
Clovis, CA
$3,591,061
Staff has found the low bid acceptable.
RECOMMENDATION: That City Council:
1. Award the Island Annexation Area 478B & C Project to West Valley Construction for the amount of $3,433,835;
Item No. 30.
2. Authorize progress payments up to one hundred percent (100%) of the contract amount;
3. Authorize a ten percent (10%) contingency to cover unforeseen costs;
4. Authorize an additional $343,383 for construction
management, construction surveying, quality control, and inspection services;
5. Authorize the City Engineer to negotiate construction surveying services with one of the firms as approved by Council MO #04-041922; and
6. Authorize an additional appropriation of $3,020,601 from the Sewer Revolving fund to fully fund the project.

CITY COUNCIL AGENDA – JUNE 20, 2022
SUBJECT: SB 1205 Annual Fire Department Inspection Reporting SOURCE: Fire
BACKGROUND: California Senate Bill 1205 (SB 1205) was signed into law on September 27, 2018, after the fatal Ghost Ship Fire in December 2016 brought national attention to California and put a spotlight on fire safety laws as well as the performance of fire inspections. SB 1205 added Section 13146.4 to the California Health and Safety Code. This new law requires that an annual report on specific State-mandated inspections be submitted to the governing body of each jurisdiction having authority for inspections. The law also requires the report to be delivered when the administering authority discusses its annual budget, or at another time, as determined by the administering authority. Receipt of the report must be acknowledged in a resolution or similar formal document.
California Health and Safety Code Sections 13146.2 and 13146.3 require all fire departments that provide fire protection services to perform annual inspections of every building used as a hotel, motel, lodging house, apartment house, and public or private school respectively, for compliance with building and fire safety standards. The California Health and Safety Code Sections 13146.2 and 13146.3 do not require fire departments to report or demonstrate compliance as the new law SB 1205 does.
Although there are no penalties identified in the law, adoption of this Resolution establishes the City's compliance with California Health and Safety Code Sections 13146.4 for reporting and 13146.2 and 13146.3 for completing the required inspections, which identify the State-mandated inspections above and as further described.
COMMENT: Public and private schools are generally classified as Educational Group E occupancies, which are schools used by more than six individuals at any one time, for educational purposes through the 12th grade and certain child daycare facilities. Within the City of Porterville, there are currently thirtynine (39) Group E occupancies, with multiple buildings, structures, and facilities. During the Fiscal Year 2021-2022 (FY21-22), the Porterville Fire Department inspected 39 Group E occupancies, buildings, structures, and facilities. This represents a compliance rate of one hundred percent (100%) for the State mandate to inspect all Group E facilities annually. It should be noted that there are some outstanding inspections in this category due to Item No. 31.
violation corrections that may have parts on backorder due to supply chain issues or scheduling delays with contractors. Prevention staff is working with responsible parties to ensure these violations are cleared as soon as possible.
Hotels, motels, apartments (three units or more), are generally classified as Residential Group R occupancies. The residential facilities have various sub-classifications and may contain residents or clients on a transient or non-transient basis that have a range of needs, such as, custodial care, mobility impairments, cognitive disabilities, and more. The residents may also be non-ambulatory. Within the City of Porterville, there are fifty-nine (59) Group R occupancies in the program. The Department will still find additional Group R occupancies in the city that are subsequently inspected and entered into the Department's records management system. The Department anticipates this number increasing due to annexations and new development coming online. During FY21-22, the Department inspected fifty-nine (59) Group R occupancies, including all buildings, structures, and facilities in the program. This is a compliance rate of one hundred percent (100%) for the State mandate to inspect all hotels, motels, and apartments annually. It should be noted that there are some outstanding inspections in this category due to violation corrections that may have parts on backorder due to supply chain issues, or scheduling delays with contractors.
Prevention staff is working with responsible parties to ensure these violations are cleared as soon as possible.
With the sudden onset of Covid-19 and the need to isolate Fire Department personnel from unnecessary exposure, and to realign the Department with the recommendations made through the Serious Accident Review Team (SART) report, the Department engine companies ceased conducting fire inspections. This has resulted in the Fire Marshal working to implement inspections to meet State mandates as well as keep up with requests and complaints. To achieve a one hundred percent (100%) compliance rate for State-mandated occupancy inspections requires a focused and dedicated effort that leaves little capacity to inspect other occupancies. Currently there are over 1,400 occupancies within the City that could be inspected. Of those, over 100 are State-mandated inspections (not all State mandated inspections are required to be reported to the City Council). The Prevention Division will continue to evaluate the inspection needs to meet the requirements in Section 13146.5 of the California Health and Safety Code and to keep up with the demands due to growth of annexations and new construction as well as increased compliance and the ability to capture additional mandated occupancies.
ANALYSIS: The Fire Chief recommends that the City Council adopt the draft Resolution acknowledging receipt of the Porterville Fire Department's annual inspections report and recognizing the Department's level of compliance with California Health and Safety Code Sections 13146.2 and 13146.3. This first report was completed following the current fiscal year Item No. 31.
to coincide with the budget adoption process. As the Health and Safety Code allows, should the Council desire, the Department can continue with this annual report, or this information can be presented annually based on the calendar year at a time of the Council's choosing.
