4.4.4 Deductibles and Self-Insured Retentions. Professional shall disclose to and obtain the approval of City for the self-insured retentions and deductibles before beginning any of the services or work called for by any term of this Agreement.
During the period covered by this Agreement, only upon the prior express written authorization of Contract Administrator, Professional may increase such deductibles or self-insured retentions with respect to City, its officers, employees, agents, and volunteers. 4.4.5 Waiver of Subrogation. Professional hereby agrees to waive subrogation which any insurer or contractor may require from vendor by virtue of the payment of any loss. Obtain such insurance and deduct and retain the amount of the premiums for such insurance from any sums due under the Agreement;
Order Professional to stop work under this Agreement or withhold any payment that becomes due to Professional hereunder, or both stop work and withhold any payment, until Professional demonstrates compliance with the requirements hereof; and/or Terminate this Agreement.

5.1 General Requirement. Professional shall indemnify, defend with counsel selected by the City, and hold harmless the City and its officials, officers, employees, agents, and volunteers from and against any and all losses, liability, claims, suits, actions, damages, and causes of action arising out of any personal injury, bodily injury, loss of life, or damage to property, or any violation of any federal, state, or municipal law or ordinance, to the extent caused, in whole or in part, by the willful misconduct or negligent acts or omissions of Professional or its employees, subcontractors, or agents, by acts for which they could be held strictly liable, or by the quality or character of their work. The foregoing obligation of Professional shall not apply when (1) the injury, loss of life, damage to property, or violation of law arises wholly from the negligence or willful misconduct of the City or its officers, employees, agents, or volunteers and (2) the actions of Professional or its employees, subcontractor, or agents have contributed in no part to the injury, loss of life, damage to property, or violation of law. It is understood that the duty of Professional to indemnify and hold harmless includes the duty to defend as set forth in Section 2778 of the California Civil Code. Acceptance by City of insurance certificates and endorsements required under this Agreement does not relieve Professional from liability under this indemnification and hold harmless clause. This indemnification and hold harmless clause shall apply to any damages or claims for damages whether or not such insurance policies shall have been determined to apply. By execution of this Agreement, Professional acknowledges and agrees to the provisions of this Section and that it is a material element of consideration.
5.2 PERS Indemnification. In the event that Professional or any employee, agent, or subcontractor of Professional providing services under this Agreement is determined by a court of competent jurisdiction or the California Public Employees Retirement System (“PERS”) to be eligible for enrollment in PERS as an employee of City, Professional shall indemnify, defend, and hold harmless City for the payment of any and all employee and/or employer contributions for PERS benefits on behalf of Professional or its employees, agents, or subcontractors, as well as for the payment of any penalties and interest on such contributions, which would otherwise be the responsibility of City, and any attorneys’ fees and costs incurred by the City to enforce this Section.
5.3 Design Professionals. To the extent that the services under this Agreement include design professional services subject to California Civil Code Section 2782.8, as may be amended from time to time, Professional’s duty to indemnify under Sections 5.1 and 5.2 shall only be to the maximum extent permitted by California Civil Code Section 2782.8.
Section 6. STATUS OF PROFESSIONAL.
6.1 Independent Contractor. At all times during the term of this Agreement, Professional shall be an independent contractor as defined in Labor Code Section 3353, and shall not be an employee of City. Nothing contained in this Agreement shall be construed to be inconsistent with the foregoing relationship or status. City shall have the right to control Professional only insofar as the results of Professional's services rendered pursuant to this Agreement and assignment of personnel pursuant to Subparagraph 1.3; however, ITEM 9.9. Professional shall have no power or authority by this Agreement to bind the City in any respect. All employees and agents hired or retained by Professional are employees and agents of Professional and not of the City. The City shall not be obligated in any way to pay any wage claims or other claims made against Professional by any such employees or agents, or any other person resulting from performance of this Agreement.
Notwithstanding any other City, state, or federal policy, rule, regulation, law, or ordinance to the contrary, Professional and any of its employees, agents, and subcontractors providing services under this Agreement shall not qualify for or become entitled to, and hereby agree to waive any and all claims to, any compensation, benefit, or any incident of employment by City, including but not limited to eligibility to enroll in PERS as an employee of City and entitlement to any contribution to be paid by City for employer contributions and/or employee contributions for PERS benefits. Professional shall not allow any employee, agent or subcontractor to become eligible for a claim for PERS benefits.
6.2 Professional Not an Agent. Except as City may specify in writing, Professional shall have no authority, express or implied, to act on behalf of City in any capacity whatsoever as an agent. Professional shall have no authority, express or implied, pursuant to this Agreement to bind City to any obligation whatsoever.
Section 7. LEGAL REQUIREMENTS.
7.1 Governing Law. The laws of the State of California shall govern this Agreement.
7.2 Compliance with Applicable Laws. Professional and any subcontractors shall comply with all laws and regulations applicable to the performance of the work hereunder, including but not limited to, the California Building Code, the Americans with Disabilities Act, and any copyright, patent or trademark law. Professional’s failure to comply with any law(s) or regulation(s) applicable to the performance of the work hereunder shall constitute a breach of contract.
7.3 Other Governmental Regulations. To the extent that this Agreement may be funded by fiscal assistance from another governmental entity, Professional and any subcontractors shall comply with all applicable rules and regulations to which City is bound by the terms of such fiscal assistance program.
7.4 Licenses and Permits. Professional represents and warrants to City that Professional and its employees, agents, and any subcontractors have all licenses, permits, qualifications, and approvals of whatsoever nature that are legally required to practice their respective professions. 7.5 Nondiscrimination and Equal Opportunity. Professional shall not discriminate, on the basis of a person’s race, religion, color, national origin, age, physical or mental handicap or disability, medical condition, marital status, sex, or sexual orientation, against any employee, applicant for employment, subcontractor, bidder for a subcontract, or participant in, recipient of, or applicant for any services or programs provided by Professional under this Agreement. Professional shall comply with all applicable federal, state, and local laws, policies, rules, and requirements related to equal opportunity and nondiscrimination in employment, contracting, and the provision of any services that are the subject of this Agreement, including but not limited to the satisfaction of any positive obligations required of Professional thereby.
Professional shall include the provisions of this Subsection in any subcontract approved by the Contract Administrator or this Agreement.
Section 8. TERMINATION AND MODIFICATION.
8.1 Termination. City may cancel this Agreement at any time and without cause upon written notification to Professional.
Professional may cancel this Agreement upon _____________ days’ written notice to City and shall include in such notice the reasons for cancellation.
In the event of termination, Professional shall be entitled to compensation for services performed to the effective date of termination; City, however, may condition payment of such compensation upon Professional delivering to City any or all documents, photographs, computer software, video and audio tapes, and other materials provided to Professional or prepared by or for Professional or the City in connection with this Agreement.
8.2 Extension. City may, in its sole and exclusive discretion, extend the end date of this Agreement beyond that provided for in Subsection 1.1. Any such extension shall require a written amendment to this Agreement, as provided for herein. Professional understands and agrees that, if City grants such an extension, City shall have no obligation to provide Professional with compensation beyond the maximum amount provided for in this Agreement. Similarly, unless authorized by the Contract Administrator, City shall have no obligation to reimburse Professional for any otherwise reimbursable expenses incurred during the extension period.
8.3 Amendments. The Parties may amend this Agreement only by a writing signed by all the Parties.
8.4 Assignment and Subcontracting. City and Professional recognize and agree that this Agreement contemplates personal performance by Professional and is based upon a determination of Professional’s unique personal competence, experience, and specialized personal knowledge. Moreover, a substantial inducement to City for entering into this Agreement was and is the professional reputation and competence of Professional.

Professional may not assign this Agreement or any interest therein without the prior written approval of the Contract Administrator. Professional shall not subcontract any portion of the performance contemplated and provided for herein, other than to the subcontractors noted in the proposal, without prior written approval of the Contract Administrator.
8.5 Survival. All obligations arising prior to the termination of this Agreement and all provisions of this Agreement allocating liability between City and Professional shall survive the termination of this Agreement.
8.6 Options upon Breach by Professional. If Professional materially breaches any of the terms of this Agreement, City’s remedies shall include, but not be limited to, the following:
8.6.1 Immediately terminate the Agreement;
8.6.2 Retain the plans, specifications, drawings, reports, design documents, and any other work product prepared by Professional pursuant to this Agreement;
8.6.3 Retain a different Professional to complete the work described in Exhibit A not finished by Professional; or
8.6.4 Charge Professional the difference between the cost to complete the work described in Exhibit A that is unfinished at the time of breach and the amount that City would have paid Professional pursuant to Section 2 if Professional had completed the work.
Section 9. KEEPING AND STATUS OF RECORDS.
9.1 Records Created as Part of Professional’s Performance. All reports, data, maps, models, charts, studies, surveys, photographs, memoranda, plans, studies, specifications, records, files, or any other documents or materials, in electronic or any other form, that Professional prepares or obtains pursuant to this Agreement and that relate to the matters covered hereunder shall be the property of the City. Professional hereby agrees to deliver those documents to the City upon termination of the Agreement. It is understood and agreed that the documents and other materials, including but not limited to those described above, prepared pursuant to this Agreement are prepared specifically for the City and are not necessarily suitable for any future or other use. City and Professional agree that, until final approval by City, all data, plans, specifications, reports and other documents are confidential and will not be released to third parties without prior written consent of both parties.
9.2 Professional’s Books and Records. Professional shall maintain any and all ledgers, books of account, invoices, vouchers, canceled checks, and other records or documents evidencing or relating to charges for services or expenditures and disbursements charged to the City under this Agreement for a minimum of three (3) years, or for any longer period required by law, from the date of final payment to the Professional pursuant to this Agreement.

Under California Government Code Section 8546.7, if the amount of public funds expended under this Agreement exceeds TEN THOUSAND DOLLARS ($10,000.00), the Agreement shall be subject to the examination and audit of the State Auditor, at the request of City or as part of any audit of the City, for a period of three (3) years after final payment under the Agreement.
Section 10 MISCELLANEOUS PROVISIONS.
10.1 Attorneys’ Fees. If a Party to this Agreement brings any action, including an action for declaratory relief, to enforce or interpret the provision of this Agreement, the prevailing Party shall be entitled to reasonable attorneys’ fees in addition to any other relief to which that Party may be entitled. The court may set such fees in the same action or in a separate action brought for that purpose.

10.3 Severability. If a court of competent jurisdiction finds or rules that any provision of this Agreement is invalid, void, or unenforceable, the provisions of this Agreement not so adjudged shall remain in full force and effect. The invalidity in whole or in part of any provision of this Agreement shall not void or affect the validity of any other provision of this Agreement.
10.4 No Implied Waiver of Breach. The waiver of any breach of a specific provision of this Agreement does not constitute a waiver of any other breach of that term or any other term of this Agreement.
10.5 Successors and Assigns. The provisions of this Agreement shall inure to the benefit of and shall apply to and bind the successors and assigns of the Parties.
10.6 Use of Recycled Products. Professional shall prepare and submit all reports, written studies and other printed material on recycled paper to the extent it is available at equal or less cost than virgin paper.
10.7 Conflict of Interest. Professional may serve other clients, but none whose activities within the corporate limits of City or whose business, regardless of location, would place Professional in a “conflict of interest,” as that term is defined in the Political Reform Act, codified at California Government Code Section 81000 et seq.
Professional shall not employ any City official in the work performed pursuant to this Agreement. No officer or employee of City shall have any financial interest in this Agreement that would violate California Government Code Sections 1090 et seq.

Professional shall provide proof satisfactory to City of such insurance that meets the requirements of this section and under forms of insurance satisfactory in all respects to the City. Professional shall maintain the insurance policies required by this section throughout the term of this Agreement. The cost of such insurance shall be included in the Professional's bid. Professional shall not allow any subcontractor to commence work on any subcontract until Professional has obtained all insurance required herein for the subcontractor(s) and provided evidence thereof to City. Verification of the required insurance shall be submitted and made part of this Agreement prior to execution. Professional shall maintain all required insurance listed herein for the duration of this Agreement. 1 Workers’ Compensation. Professional shall, at its sole cost and expense, maintain Statutory Workers’ Compensation Insurance and Employer’s Liability Insurance for any and all persons employed directly or indirectly by Professional. The Statutory Workers’ Compensation Insurance and Employer’s Liability Insurance shall be provided with limits of not less than ONE MILLION DOLLARS ($1,000,000.00) per accident. In the alternative, Professional may rely on a self-insurance program to meet those requirements, but only if the program of self-insurance complies fully with the provisions of the California Labor Code. Determination of whether a self-insurance program meets the standards of the Labor Code shall be solely in the discretion of the Contract Administrator. The insurer, if insurance is provided, or the Professional, if a program of self-insurance is provided, shall waive all rights of subrogation against the City and its officers, officials, employees, and volunteers for loss arising from work performed under this Agreement.
An endorsement shall state that coverage shall not be canceled except after thirty (30) days' prior written notice by certified mail, return receipt requested, has been given to the City. Professional shall notify City within fourteen (14) days of notification from Professional’s insurer if such coverage is suspended, voided or reduced in coverage or in limits.
The requirement to maintain Statutory Worker’s Compensation and Employer’s Liability Insurance may be waived by the City upon written verification that Professional does not have any employees.
2 Commercial General and Automobile Liability Insurance.
2.1 General requirements. Professional, at its own cost and expense, shall maintain commercial general liability insurance for the term of this Agreement in an amount not less than TWO MILLION DOLLARS ($2,000,000.00) and automobile liability insurance for the term of this Agreement in an amount not less than ONE MILLION DOLLARS ($1,000,000.00). The commercial general liability and automobile liability insurance shall be per occurrence, combined single limit coverage for risks ITEM 9.9. ATTACHMENT 2 Contract No. 2022-245

associated with the work contemplated by this Agreement. If a commercial general liability insurance or an automobile liability form or other form with a general aggregate limit is used, either the general aggregate limit shall apply separately to the work to be performed under this Agreement or the general aggregate limit shall be at least twice the required occurrence limit. Such coverage shall include but shall not be limited to, protection against claims arising from bodily and personal injury, including death resulting therefrom, and damage to property resulting from activities contemplated under this Agreement, including the use of owned and nonowned automobiles.

a. City and its officers, employees, agents, and volunteers shall be covered as additional insureds with respect to each of the following: liability arising out of activities performed by or on behalf of Professional, including the insured’s general supervision of Professional; products and completed operations of Professional; premises owned, occupied, or used by Professional; and automobiles owned, leased, or used by the Professional. The coverage shall contain no special limitations on the scope of protection afforded to City or its officers, employees, agents, or volunteers.
b. The insurance shall cover on an occurrence or an accident basis, and not on a claims-made basis.
c. An endorsement must state that coverage is primary insurance with respect to the City and its officers, officials, employees and volunteers, and that no insurance or self-insurance maintained by the City shall be called upon to contribute to a loss under the coverage. d. Any failure of Professional to comply with reporting provisions of the policy shall not affect coverage provided to City and its officers, employees, agents, and volunteers.
e. An endorsement shall state that coverage shall not be canceled except after thirty (30) days' prior written notice by certified mail, return receipt requested, has been given to the City. Professional shall notify City within ITEM 9.9. ATTACHMENT 2 Contract No. 2022-245

The City shall have the right to exercise, at the Professional’s sole cost and expense, any extended reporting provisions of the policy, if the Professional cancels or does not renew the coverage.

During the period covered by this Agreement, only upon the prior express written authorization of Contract Administrator, Professional may increase such deductibles or self-insured retentions with respect to City, its officers, employees, agents, and volunteers. The Contract Administrator may condition approval of an increase in deductible or self-insured retention levels with a requirement that Professional procure a bond, guaranteeing payment of losses and related investigations, claim administration, and defense expenses that is satisfactory in all respects to each of them.

2 | P a g e S u n r i v e r Q u i c k R e f e r e n c e G u i d e M a r c h 2 0 1 6 Section 1 – Purpose of Guide
This guide is a summary of operations and maintenance procedures for the D-07 Sunriver Drainage Pump Station, which can be identified in Appendix A “Vicinity Map”.
Section 2 – Purpose of the D-07 Pump Station
The purpose of the D-07 Sunriver pump station is to pump storm water from drainage Shed 12 into the American River. During heavy storm events, drainage water will flow into the pump station inlet basin and wet well from the surrounding area drainage systems. Storm water entering D-07 Sunriver is then pumped directly into the American River. In Appendix B “WaterShed Map” is a map that shows the watershed that contributes runoff to this facility. The watershed is 175 acres, or 0.27 square miles.
Section 3 - Background
History:
The D-07 Sunriver pump station is located at the west end of Yukon River Way. It was originally constructed in 1979, and consists of 2 electric powered pumps, 1 inlet basin, 1 wet well, 1 discharge vault, a 66” gravity bypass conduit, and 1 outfall structure.
Design Summary:
The D-07 Sunriver pump station was designed to handle a 100-year storm event, and will pump storm water as needed.
Section 4 – Station Operational Parameters
Diesel Engine and Generator:
There is no back-up generator located at the D-07 Sunriver pump station.
In the event of a power failure, a temporary portable generator sized at 200 kW would be sufficient to operate one 100 H.P. pump, or 400 kW to operate both pumps. Currently there is a portable generator, which is located at the D-13 Mills Tower Pump Station that will operate the D-07 Sunriver Pump Station. However, electrical connections are currently not available at the D-07 Sunriver Pump Station. It is anticipated the City will modify the D-07 Pump Station to connect a portable generator in the near future.
Slide Gates:
Two manual slide gates located in the inlet basin are used to isolate the pump station and gravity bypass conduit from the upstream drainage facilities during the sump annuals, or in case emergency access to the wet well is needed.
ITEM 9.9. ATTACHMENT 2 Contract No. 2022-245
3 | P a g e S u n r i v e r Q u i c k R e f e r e n c e G u i d e M a r c h 2 0 1 6 The gravity bypass slide gate is typically left in the open position to allow drainage water to flow directly into the discharge vault and into the American River, which minimizes pump usage. The gravity bypass slide gate should be closed when the flow rate on the American River reaches Stage 3 (releases of 50,000 CFS or higher from Nimbus Dam).
Inspect annually to ensure that the slide gates are able to open and close completely, and they should be checked by fully opening and closing the gates. Leave gates in open position after inspection.
Pumps:
There are two pumps installed at the pump station. The pumps each have 100 H.P. electric motors, and the capacity of each pump is 16,158 GPM / 36 CFS. The total pumping capacity of the station is 32,316 GPM / 72 CFS.
The two electric pumps are automatically set to alternately run as the lead (first) and lag 1 (second) pumps to equalize their operating hours. The pumps are programmed to turn on and off at the following water elevations (provided by the bubbler gage) in the basin:
Pump On Off
Lead 16.9 6.5
Lag 1 17.0 8.7
Trash Rack:
The D-07 Sunriver pump station is protected against debris by a set of double vertical trash racks.
The trash racks are located in the inlet basin to screen debris from storm water entering the station via the underground drainage pipe system. The trash racks are located under grated metal covers.
The trash racks are aligned vertically, and an electric overhead chain hoist is utilized to lift the trash racks out of the inlet basin whenever cleaning is required. A metal shelf attached to the bottom of each trash rack retains the debris that has been caught as the trash racks are lifted out of the inlet basin. One trash rack always remains in place during trash rack cleaning operations to assure that no debris is allowed to enter the wet well.
A high water level alarm at the trash rack inlet basin will warn if the trash racks are getting plugged up with debris and require cleaning. The trash racks should be inspected during wet weather to assure that they remain clear of debris.
Frequent inspection during wet weather, and remove trash and debris as needed.

4 | P a g e S u n r i v e r Q u i c k R e f e r e n c e G u i d e M a r c h 2 0 1 6 Pump Discharge Flap Gates (2 located in discharge vault):
Inspect monthly and after each major storm to confirm that the flap gates are free swinging, and are not jammed open with debris.
Gravity Bypass Flap Gate (1 located in discharge vault):
Inspect monthly and after each major storm to confirm that the flap gate is free swinging, and is not jammed open with debris.
Access Control Rack (at American River):
Inspect frequently during wet weather, and remove trash and debris as needed.
Bubblers:
One bubbler tube is located on the west wall of the wet well, and pump operation is controlled by readings from this bubbler, which can be located in Appendix C “Sensor Location Map”.
The possibility of debris clogging the bubblers is remote. The bubblers should have air blowing through the tubes at all times to ensure that they are kept free from debris. The bubbler system should be tested and cleaned every six months to ensure that the system is operating correctly and remains free of debris.
An alarm for high water level is located in the inlet basin, adjacent to the slide gate at the entrance to the wet well. The alarm should be tested and cleaned every six months to ensure that the system is operating correctly and remains free of debris.
Pump & Impeller Inspection:
Impellers should be inspected annually, before the rainy season, to verify that they are in proper working condition. Pump casings should be tapped with a ball peen hammer at numerous locations and all rusted areas, to assure the casing is still in good repair.
Lubrication:
There are several types of lubrication used at the pump station. Before lubricating any piece of equipment, verify that what is being used is compatible with manufacturer’s recommendations.
Motors:
Each day the motors should be checked for excessive vibration and heat if the motors are currently running. If motors are not running during daily inspections, each motor should be

Wetwell Cleaning:
The wet well should be inspected and cleaned annually.
General Cleaning:
A general inspection of the grounds should be conducted each day an operator is on site.

This guide is a summary of operations and maintenance procedures for the D-08 Citrus Road Pump Station, which can be identified in Appendix A “Vicinity Map”.
Section 2 – Purpose of the D-08 Pump Station
The purpose of the D-08 Citrus Road pump station is to pump storm water from drainage Shed 49 into West Branch Buffalo Creek. During heavy storm events, drainage water will flow into the pump station inlet vault and wet wells from the surrounding area drainage systems. Storm water entering D-08 Citrus Road is then pumped directly into a 78” pipe which crosses underneath State Highway 50 and then discharges into West Branch Buffalo Creek. In Appendix B “WaterShed Map” is a map that shows the watershed that contributes runoff to this facility. The watershed is 34 acres, or 0.053 square miles.
Section 3 - Background
History:
The D-08 Citrus Road pump station is located at the north end of Citrus Road. It was originally constructed in 1983, and consists of 3 electric powered pumps, 1 inlet vault, 2 wet wells, and 1 discharge vault.
Design Summary:
The D-08 Citrus Road pump station was designed to handle a 100-year storm event, and will pump storm water as needed.
In 1997, the original 5 H.P. and 10 H.P. electric motors were replaced with new 10 H.P. and 20 H.P. electric motors.
Section 4 – Station Operational Parameters
Generator:
There is no back-up generator located at the D08 Citrus Road pump station.
In the event of a power failure, a temporary portable generator sized 20 kW would be sufficient to operate a single 10 H.P. pump, 40kW to operate one of the 20 H.P. pumps, or 100 kW to operate all three pumps. Currently there is a portable generator, which is located at the D-13 Mills Tower Pump Station that will operate the D-08 Citrus Road Pump ITEM 9.9. ATTACHMENT 2 Contract No. 2022-245
3 | P a g e D-08 C i t r u s Q u i c k R e f e r e n c e G u i d e M a r c h 2 0 1 6 However, electrical connections are currently not available at the D-08 Citrus Road Pump Station. It is anticipated the City will modify the D-08 Citrus Road Pump Station to connect a portable generator in the near future.
Slide Gates:
One manual slide gate is located in the inlet vault, and it is used to isolate the pump station from the upstream drainage facilities during the sump annuals, or in case emergency access to the inlet vault, wet wells, or discharge vault is needed.
Inspect annually to ensure that the slide gate is able to open and close completely, and it should be checked by fully opening and closing the gate. Leave gate in open position after inspection.
Pump Discharge Flap Gates (3 located in discharge vault):
Inspect monthly and after each major storm to confirm that the flap gates are free swinging, and are not jammed open with debris.
Pumps:
There are three pumps installed at the pump station. Pump 1 has a 10 H.P. electric motor, and the capacity of the pump is 1,571 GPM / 3.5 CFS. Pump 2 and Pump 3 each have 20 H.P. electric motors, and the capacity of each pump is 3,142 GPM/ 7 CFS. The total pumping capacity of the station is 7,855 GPM / 17.5 CFS The three electric pumps are automatically set to alternately run as the lead (first), lag (second), and lag 2 (third) pumps to equalize their operating hours. The pumps are programmed to run on and off at the following water elevations (based on the bubbler gage) in the wet well:
Pump On Off
Lead 8.5 6.5
Lag 1 9.3 7.0
Lag 2 10.0 7.5
Trash Rack:
The D-08 Citrus Road pump station is protected against debris by a single vertical trash rack.
The trash rack is located in the inlet vault to screen debris from storm water entering the station via the underground drainage pipe system. The trash rack is located under grated metal covers.
ITEM 9.9. ATTACHMENT 2 Contract No. 2022-245
4 | P a g e C i t r u s Q u i c k R e f e r e n c e G u i d e M a r c h 2 0 1 6 The trash rack is aligned vertically, and an overhead chain hoist is utilized to lift the trash racks out of the inlet basin whenever cleaning is required. A metal shelf attached to the bottom of the trash rack retains the debris that has been caught as the trash rack is lifted out of the inlet basin.
There is no high water level alarm at the trash rack inlet vault to warn if the trash rack is getting plugged up with debris. The trash rack should be inspected during wet weather to assure that it remains clear of debris.
Bubblers:
One bubbler tube is located on the west side of the west wet well, and pump operations are controlled by readings from this bubbler, which can be located in Appendix C “Sensor Location Map”.
The possibility of debris clogging the bubblers is remote. The bubblers should have air blowing through the tubes at all times to ensure that they are kept free from debris. The bubbler system should be tested and cleaned every every six months to ensure that the system is operating correctly and remains free of debris.
An alarm for high water level is located adjacent to the bubbler in the west wet well.

This guide is a summary of operations and maintenance procedures for the D-44 Bear Hollow Drainage Pump Station, which can be identified in Appendix A “Vicinity Map”.
Section 2 – Purpose of the D-44 Pump Station
The purpose of the D-44 pump station is to pump storm water from a portion of drainage shed 13 to Morrison Creek. During storm events, water flows into the detention basin from the surrounding area drainage systems and is pumped up to Morrison Creek. In Appendix B “WaterShed Map 13” is a map that shows the watershed that contributes runoffs to this detention basin. The watershed is 687 acres, or 1.11 square miles.
Section 3 - Background
History:
The D-44 pumps station is located south of the intersection of Bear Hollow Drive and North Mather Drive, and was constructed in 2004 with the Villages of Zinfandel subdivision.
Previously, the land in the subdivision was used for aggregate mining by Lonestar Aggregates. The D-44 pump station is located at the west end of the former settling basin of the aggregate mine. The pump station consists of four large pumps, one low-flow pump, an inlet basin, one automated trash rack, one wet well, and a diesel back-up generator.
Design Summary:
The D-44 Bear Hollow pump station and detention basin is designed to handle a 100 year event, and will pump storm water as needed.
Section 4 – Station Operational Parameters
Diesel Engine and Generator:
The diesel engine and generator will automatically start and run if needed in the event of a power outage. The generator has been configured and sized to run the pumps, sluice gate, bubbler, and PLC in the event of a power outage for up to 24 hours.
The generator is programmed to start during a power failure under any of the 3 following conditions:
ITEM 9.9. ATTACHMENT 2 Contract No. 2022-245
3 | P a g e B e a r H o l l o w Q u i c k R e f e r e n c e G u i d e M a r c h 2 0 1 6 • Pumping is needed.
• Battery power level is low.
• Bubbler air pressure is low.
Once started, the generator will continue to operate until SMUD power is restored, and then it will automatically shut off.
The diesel engine and generator system should be inspected and operated weekly to assure reliability. Furthermore, the City was issued a Permit to Operate (permit #24562), by Sacramento Metropolitan Air Quality Management District (SMAQMD) on May 1, 2015, which details specific conditions with the operation and maintenance of the generator.
Conditions for this permit are strictly enforced by SMAQMD, and a copy of the permit with conditions is attached in Appendix C.
Sluice Gate (72” x 72”):
There is one motor-operated sluice gate that controls the amount of water that is allowed into the wet well from the inlet basin. The sluice gate is normally in the open position. The gate is there so that it can be closed to allow maintenance to be conducted in the wet well and on the pumps.
Pumps:
The pump station consist of four mixed-flow/vertical propeller pumps and one low-flow submersible pump. Mixed-flow pumps are in-line pumps that are used in applications that require high volume flow with a low discharge pressure.
The low-flow submersible pump has a 30 H.P. electric motor driving a pump with a capacity of 7.5 CFS. The low-flow pump is designed to pump the summer run off, and dewatering the wet well for service. The low-flow pump will shut off when the large pumps are called to operate.
Each of the large pumps has a 75 H.P. electric motor driving a pump with a capacity of 15 CFS, for a station capacity of 45 CFS capacity. One 15 CFS pump serves as backup.
The four large electrical pumps are set to run alternately as pumps 1, 2, and 3 to equalize their operating hours: with one pump always held as backup.
The pumps are scheduled to turn on and off based on the following water elevation (provided by the bubbler gage) in the basin:
Pump On Off
Lead 73.0 70.0
Lag 1 75.0 72.0
ITEM 9.9. ATTACHMENT 2 Contract No. 2022-245

Lag 3 Backup --
Low-Flow 67.0 (Apr 1 – Sept 30) 65.5
Low-Flow 70.0 (Oct 1 – Apr 1) 65.5
All pumping at the station will cease if the water surface elevation at the outfall in Morrison Creek reaches 91.5 feet. Pumping will resume when the elevation at these culverts goes down to 90.0 feet.
Trash Rack:
The D-44 Bear Hollow pump station is protected against debris by one automated trash rack located in the inlet basin to screen debris from storm water entering the station. There is an alarm for high water level in the inlet basin in the event the trash racks become plugged.
The trash rack is automatically cleaned with a Duperon mechanized raking system, which deposits debris directly into on dumpster permanently staged at the rear of the trash rack.
The trash rack should be inspected during wet weather to assure that it remains clear of debris, and to confirm that the automated raking system is operating properly.
Trash rack operations are based upon water head differential across the rake, and is determined with sensors LT051 and LT052 (see sheet E12 of the approved plans or the Sensor Location Map section of this report). The on/off settings are as follows:
• Head differential > 6” = Rake On.
Head differential < 3” = Rake
Off.
• Rake is also set to run every 12
hours of 10 minutes to keep grate
clear.
Automated Electric Operator and Slide Gate:
The automated electric operator (actuator) should be tested every 6 months to ensure that the actuator is ready to operate. In addition, the bolts between the actuator and the gear box should be checked and re-tightened every year a required. Seals and O-rings need to be checked regularly and replaced as necessary. The gear housing is filled with lubricant at the factory. The manufacturer recommend that the grease should be changed every 6-8 years.
The slide gate requires inspection to ensure that it is able to close completely and should be checked, by opening and closing the gate, at the same time the actuator is inspected.

5 | P a g e B e a r H o l l o w Q u i c k R e f e r e n c e G u i d e M a r c h 2 0 1 6 Basin Cleaning and Maintenance:
The basin is listed on the yearly maintenance schedule for mowing in the spring, and sprayed in the spring, summer, fall, and winter.
Bubblers:
The bubbler tubes are located upstream of the trash rack, inside the wet well, and at the outfall structure, which can be located on Appendix D “Sensor Location Map”. The possibility of debris clogging the bubbler is remote. The bubblers should have air blowing through the tubes at all times to ensure that they are kept free from debris. The bubbler system should be tested and cleaned every six month to ensure that the system is operating correctly and is free of debris.
If motors are not running during daily inspections, each motor should be manually ran on a weekly basis to complete inspection. Oil levels should be checked each day an operator is on site, but at a minimum at least every week.
Wet Well Cleaning:
Inspection of the wet well should be conducted each day an operator is on site but weekly as a minimum, and cleaned as required. A thorough cleaning shall be conducted on an annual basis.
General Cleaning:
Each day an Operator is on site a general inspection of the grounds should be conducted.
Trash and debris shall be picked up and disposed, and weed control measures maintained.
Alarm:
The facility has an auto dialer system in place that will notify Operators via telephone if the facility should encounter an alarm event. Appendix E “Alarm List” makes reference of the type of alarm, the priority, and if the alarm will “call out” to the Operator.

2 | P a g e M a t h e r I n d u s t r i a l Q u i c k R e f e r e n c e G u i d e M a r c h 2 0 1 6 Section 1 – Purpose of Guide
This guide is a summary of operations and maintenance procedures for the D-46 Mather Industrial Pump Station, which can be identified in Appendix A “Vicinity Map”.
Section 2 – Purpose of the D-46 Pump Station
The purpose of the D-46 Mather Industrial pump station is to pump storm water from drainage Shed 62 into a 60” pipe eventually leading to Mayhew Slough. During heavy storm events, drainage water will flow into the pump station inlet basin and wet well from the surrounding area drainage systems. Storm water entering D-46 Mather Industrial is then pumped directly into the 60” pipe. If pumping capacity is surpassed by incoming flow, water may flow back into the underground system and temporarily release into the adjacent detention basin. In Appendix B “Watershed Map” is a map that shows the watershed that contributes runoff to this facility. The watershed is 70.9 acres, or 0.11 square miles.
Section 3 - Background
History:
The D-46 Mather Industrial pump station is located on the northeast corner of Routier Rd. and Old Placerville Rd. It was originally constructed in 1985, and consists of 2 electric powered pumps, 1 low-flow submersible electric pump, 1 inlet basin, 1 wet well, and a 60” outfall pipe.
Design Summary:
The D-46 Mather Industrial pump station was designed to handle a 100-year storm event, and will pump storm water as needed.
Section 4 – Station Operational Parameters
Diesel Engine and Generator:
There is no back-up generator located at the D-46 Mather Industrial Pump Station.
In the event of a power failure, a temporary portable generator sized 20 kW would be sufficient to operate a single 10 H.P. pump, 40kW to operate one of the 20 H.P. pumps, or100 kW to operate all three pumps. Currently there is a portable generator, which is located at the D-13 Mills Tower Pump Station that will operate the D-46 Mather Industrial Pump. There are electrical connections, which are currently available at the D-46 Mather Industrial Pump Station that will operate the D-46 Mather Industrial Pump Station.

The slide gate should be checked by fully opening and closing the gate. Leave the gate in open position after inspection.
Pumps:
There are three pumps installed at the pump station. Pump 1 has 4 H.P. electric motor and Pumps 2 and 3 each have 60 H.P. electric motors. The capacity of Pump 1 is 449 GPM / 1 CFS and the capacity of Pump 2 and 3 is 7,650 GPM / 17 CFS. The total pumping capacity of the station is 15,749 GPM / 35 CFS.
The two 60 H.P. electric pumps are automatically set to alternately run as second and third pumps to equalize their operating hours. The smaller 9.4 H.P. electric pump is always set to operate first. The pumps are programmed to turn on and off at the following water elevations (based on the bubbler gage) in the wet well:
Pump On Off
Lead 8.8 6.0
Lag 1 11.1 6.5
Lag 2 12.4 7.0
Trash Rack:
The D-46 Mather Industrial pump station is protected against debris by a single vertical trash rack.
The trash rack is located in the inlet basin to screen debris from storm water entering the station via the underground drainage pipe system. The trash rack is located under a grated metal cover.
The trash rack is aligned vertically, and a truck winch or a come along strap hooded to the overhead frame is utilized to lift the trash racks out of the inlet basin whenever cleaning is required. A metal shelf attached to the bottom of the trash rack retains the debris that has been caught as the trash rack is lifted out of the inlet basin.
There is no alarm for high water level upstream of the trash rack.
Inspect frequently during wet weather, and remove trash and debris as needed.

TO ALL PROSPECTIVE BIDDERS:
Please see below for answers to the questions received prior to the Deadline for Written Questions/Clarifications (Friday, 9/16/2022 at 4:00 pm). There is no change in Proposal Deadline (Friday, 9/30/2022 at 4:00 pm). An optional site tour of the pump stations will be offered. Consultants may attend either 2:00 pm on Monday, 9/26/22, or 2:00 pm on Wednesday, 9/28/22 starting from the City Hall Lobby.
QUESTIONS AND ANSWERS
1. Can the city provide additional information on the spare parts and materials that will require off-site storage? Quantities, current parts being stored, etc..
The City has a storage container at the City’s Bear Hollow Pump station and additional storage availability at the City’s Corp Yard. Off-site storage is not anticipated.
2. Can the city provide specific information on the various makes and models of the pumps at each of the pump stations? I did not see this specific information in the RFP.
The pump stations have pumps of various makes and models including Munz Propeller Pumps, Aurora Pumps, Peerless 24 MF, Byron Jackson 20DH Type D, and Prime Pump M14. Consultants are invited to verify pump makes and models at each site at the site visits offered on 9/26/22 and 9/28/22.
3. Will there be a field meeting with the existing contractor to hand off keys and other equipment pertinent to the operation of the stations?
Yes, please expect a minimum of one field meeting. The existing contract and the new contract are expected to have 1 month of overlap to facilitate communication and continuity in pump station operations.
4. Can the city provide additional information on the current SCADA (remote monitoring system) that you are currently using? Does the city own a laptop for remote access/control of some or all of the stations?
The City has an Ignition Standard software subscription that includes control and alarms from all pump stations. The City will issue the consultant one City laptop equipped with Ignition and appropriate security software.
5. Are there currently any known deficiencies or incomplete maintenance activities that need to be completed?
The City has an existing pump station improvement project under design to incorporate upgrades to instrumentation & controls and intermittent electrical power issues. The project is anticipated to complete 90% design in early December 2022, with bid posting in January 2023.
ITEM 9.9. ATTACHMENT 2 Contract No. 2022-245
6. Is it possible to schedule a site visit to each of the 6 pump stations to review current conditions? Yes, the City will offer site visits to interested consultants on Monday 9/26/22 and Wednesday 9/28/22.
Please arrive at the City of Rancho Cordova City Hall Lobby at 2pm. Then, drive behind the City staff member from one pump station to the next, through all 6 pump station sites. The same route will be used on each day, so the preferred day may be chosen by the consultant based on individual convenience.
2:00pm Monday 9/26/2022 OR 2:00pm Wednesday 9/28/22
Site Visits starting at City Hall Lobby
7. Can provide the annual contract expenditures spent to maintain the 6 pump stations (or average annual cost)?
Pump station maintenance expenditures are estimated at approximately $110,000 annually, not including utility or permitting fees.
8. Is there currently or would the city consider, compensation for providing 24-hour emergency on-call services?
Yes. In the proposal, please include an approach for providing 24-hour per day, 365-days per year on-call availability as specified in Appendix D Technical Provisions, Section C On-call Emergency Response (page 41 of the RFP pdf). Compensation in the contract is based on time and materials. Cost proposals may include a separate after-hours/emergency response rate (see page 9 of the RFP pdf for Cost Proposal Details).
9. Section 3 – Proposal Requirements states that the proposal shall be limited to 5 double sided pages. Is this a total of 10 sheets of content?
Yes. 10 sheets of content.
10. Who is the current operator of the pump stations?
H2O Urban Solutions, Inc.
11. Does the City have a budgeted yearly cost for these services? Pump station maintenance expenditures are estimated at approximately $110,000 annually, not including utility or permitting fees.
12. Are the pump stations visited daily (Mon-Fri)?
Pump stations are inspected as needed to ensure they are operational, and no issues need to be addressed.
13. Is there preference on how costs for repairs will be handled? Contractor pays and reimburses client afterwards or will expenses go directly to client? The City preference is for repairs to be paid by the consultant with reimbursement by the City through standard monthly invoices.
ITEM 9.9. ATTACHMENT 2 Contract No. 2022-245
14. In regard to subconsultants, which ones should be named? For example, we would not normally name a local vacuum truck company but we would name a Systems Integrator that works on SCADA systems.
The City has an existing contract with Coastline Water Resources, Inc. for city-wide storm drain maintenance which may be used to coordinate wet well cleanings/vacuum at pumps stations through City-issued work orders. All other subconsultants should be named.

ITEM 10.1.
DATE: November 21, 2022
TO: Honorable Mayor and Council Members
FROM: Elizabeth Sparkman, Community Development Director SUBJECT: SUNCREEK FEE PROGRAM ORDINANCE AMENDMENT AND
APPROVAL OF TEMPLATE CREDIT/REIMBURSEMENT
AGREEMENTS
RECOMMENDATION
Waive the first reading and introduce the Ordinance and adopt the Resolution.
RESULT OF RECOMMENDED ACTION
The Ordinance Amendment would provide additional clarification to certain provisions related to collection of certain fees and adoption of the Resolution would approve template credit/reimbursement agreements related to the collection of certain Suncreek Specific Plan Fees (SCSP Fees).
BACKGROUND
On May 16, 2022, the City Council adopted a Fee Resolution and Nexus Study that implemented the Suncreek Specific Plan Development Impact Fee Program (SCSP Fee Program). Adopted on June 6, 2022, Ordinance No. 9-2022, the governing Ordinance for the SCSP Fee Program contains provisions for the payment and collection of various SCSP Fees, to fund certain On-site Roadways, Off-Site Roadways, Potable Water, Storm Drainage, Wetland Mitigation for Backbone Infrastructure, Park Corridors and Trails, Wetland Preserve Buffer, and Park Development facilities (“Facilities’), and Plan Area Formation fees to cover certain formation costs incurred by Suncreek owners. The SCSP Fee Program and Ordinance contain provisions for credit and/or reimbursement for construction of Facilities, and costs associated with Plan Area Formation, or portions thereof, in lieu of the payment of the related SCSP Fees.
The Resolution, Attachment 1, approves a template to be used for the SRSP Fee Program credit and/or reimbursement for the construction of Facilities funded by the SCSP Fee Program, attachment 2 and Exhibit A to the Resolution, and a template credit and/or reimbursement of plan area formation costs paid by various Suncreek owners, Attachment 3 and Exhibit B to the Resolution. Prior to any credit for fees or reimbursements from the SCSP Fee Program under the terms of the governing Ordinance, an agreement based on either of the attached corresponding templates will need to be entered into.
City Council Staff Report - Page 2 of 2
The Ordinance Amendment, Attachment 4, provides clarification about collection of and administration of certain development impact fees in the SunCreek Specific Plan Area.

ITEM 10.1. ATTACHMENT 2
Exhibit A to Resolution
WHEREAS, City and Developer have agreed to allow apportionment of credits over the real property identified in Exhibit B hereto;
NOW, THEREFORE, in consideration of the mutual promises contained herein, City and Developer agree as follows:
Section 1. Construction of Facilities
Developer shall complete construction of the Facilities in accordance with the plans and specifications approved by City staff, in accordance with City improvement standards, approved by another agency and their staff as appropriate, and this Agreement.
Developer understands and acknowledges that the terms and conditions contained in any contract that Developer has or may execute with any contractors or material suppliers regarding the construction of the Facilities have no force or effect upon this Agreement.
Section 2. Credit/Reimbursement Amount
The City agrees that upon presentation by Developer of written authorization by Cordova Recreation and Park District or other public agency of construction of certain improvements by Developer, the City shall provide credits and/or reimburse Developer for acquisition and/or installation of those Improvements constructed by the Developer on an amount based on the lesser of:
(a) the actual construction cost of eligible facilities, as determined by the City, in its sole discretion, through its review of the construction contract for the Improvements, plus an allowance for soft costs as determined by the City, or (b) the allowable costs, based on the cost schedules set forth in the Suncreek Specific Plan Development Impact Program and amendments and updates thereto, listed in Exhibit A (unless this total amount is increased pursuant to an amendment to this Agreement).
Funds will be reimbursed without interest.
Section 3. Credit/Reimbursement Timing
(a) Credit/Reimbursement Priority. As set forth in Chapter 16.82.190 of the City of Rancho Cordova Municipal Code, the Director or designee, may authorize the construction of any improvements, or portions thereof, reimbursable from one or more of the funds associated with the SCSP Fee Program (the “Fund(s)”) in lieu of all, or a portion of, the SCSP Impact Fees. If so authorized, the credit toward SCSP Impact Fees shall be equal to the credit allocation as authorized by the Director, or designee, up to a maximum of eighty percent (80%) of the programmed cost of the improvement, as shown on Exhibit A, upon approval of this Agreement. Upon acceptance of the Improvements and after reconciliation of the final Improvement costs, the remaining percentage of the programmed cost of the Improvements as shown in Exhibit A may be issued as a credit balance to the Developer from the
ITEM 10.1. ATTACHMENT 2
Exhibit A to Resolution
SCSP Fee Program against the SCSP Impact Fees, or may be reimbursed in order of priority as set forth in Section 3(b).
(b) Reimbursement Priority. As set forth in Chapter 16.82 190 of the City of Rancho Cordova Municipal Code, developers who have constructed improvements reimbursable from one or more of the funds associated with the SCSP Fee Program (the Fund(s)) shall be reimbursed in the order in which their respective improvements are formally accepted by the City, as the City determines there are adequate monies in the corresponding Fund(s).
(c) Payment Preconditions. No payment from the Fund(s) as set forth in Section 3(b) above shall be made unless all of the following conditions, together with any other conditions set forth in this Agreement, have been met to City's satisfaction:
i. City has given final approval to and has formally accepted the Improvements as complete; and
ii. City, in its sole discretion, has determined that there are adequate monies available in the applicable Fund(s) associated with the SCSP Fee Program. iii. Developer applies for reimbursement pursuant to Chapter 16.82.190 of the City of Rancho Cordova Municipal Code within five (5) years after acceptance of the Improvements.
Section 4. Limitation on Fee Credits
Notwithstanding Section 2 above, for any particular type of facility (i.e., roadway, water, storm drain, wetland mitigation, park corridors and trails, wetland preserve, plan area formation), the amount of fee credits granted to a Developer for that type of facility pursuant to this Agreement shall not exceed the amount of fees due from the Developer for that facility type within the area designated for such fee credits as identified in Exhibit B hereto. If the amount of credit from Section 2 for a particular facility type exceeds the fee obligation for the Developer for that facility type, the remaining credits may be assigned to lots within the Specific Plan Boundary as shown in Exhibit B.
In addition to the foregoing, no fee credits shall be applied to the Administrative Fee that is part of, and defined within, the SCSP Fee Program. The Administrative Fee shall be due and payable at such time as the Developer, or its successors or assigns, are issued building permits for property identified in Exhibit B hereto.
Nothing in this Agreement shall limit or affect the right of the Developer to request and/or the ability of the City to enter into an acquisition agreement whereby the Facilities are acquired by an applicable Community Facilities District, subject to any necessary approval by Cordova Recreation and Park District or other public agency. Developer’s right to the SCSP fee credits hereunder shall not be affected by any such acquisition.
Section 5. Cost Savings
ITEM 10.1. ATTACHMENT 2
Exhibit A to Resolution
If the Actual Costs (including soft costs) for the Facilities are less than the Programmed Costs, the City shall take the difference between the Programmed Costs and the Actual Costs and add this amount to the ongoing “Cost Savings Balance” for the SCSP Fee Program. The Cost Savings Balance shall be the cumulative total of cost savings that have been realized for facilities constructed within the SCSP Fee Program, less the amount of such savings that has been applied to offset cost overruns as discussed further in Section 6 below.
Section 6. Adjustment to Programmed Costs
If, when the final reconciliation of construction costs for the Facilities is conducted by the City, the Actual Costs for any of the Facilities exceeds the Programmed Costs for such Facilities, the Director, or designee, may review the Actual Costs and determine if the Programmed Costs that will be credited to the Developer should be increased above the amount shown in Section 2 of this Agreement. Such an adjustment to the Programmed Costs for the Facilities shall occur at the sole discretion of the City.
If the Director concludes that an adjustment to the Programmed Costs for the Facilities is appropriate, the City shall first check the Cost Savings Balance to determine if the current balance is sufficient to offset the cost overrun. If the Cost Savings Balance is greater than or equal to the cost overrun, the City may, at its sole discretion, amend this Agreement and increase the allowable credit amount in Section 2 to the original Programmed Costs plus the cost overrun. At the same time, the City shall decrease the Cost Savings Balance by the amount of the cost overrun.
If the Cost Savings Balance is less than the cost overrun, the City may first subtract any Cost Savings Balance from the cost overrun, leaving a Cost Savings Balance of zero dollars ($0). At the City’s sole discretion, any remaining amount of cost overrun may be factored into the next update to the SCSP Fee Program, as discussed further in Section 10 below.
Section 7. Distribution of Fee Credits
Upon execution of this Agreement, the Developer shall receive fee credits equal to eighty percent (80%) of the Programmed Costs for the Facilities. After the Facilities have been accepted by the City pursuant to the requirements set forth in this Agreement, the remaining amount of fee credits shall be granted to Developer. Unless the City adjusts the Programmed Costs of the Facilities pursuant to Section 6 above, such remaining credit shall be equal to the lesser of (i) the Actual Costs of the Facilities less the 80% credit already granted to Developers, or (ii) the remaining twenty percent (20%) of the Programmed Costs.
Notwithstanding the foregoing, if the Developer, through credits taken exhaust the original allocation of eighty percent (80%) of the Programmed Costs prior to the City accepting the Facilities, Developer as well as its successors and assignees shall be required to utilize other SCSP Fee credits and/or pay the SCSP Fee on the remaining building permits issued within the area identified in Exhibit B unless the Director authorizes the release of
ITEM 10.1. ATTACHMENT 2
Exhibit A to Resolution
additional credits as progress payments. Based upon project status and completion goals, the Director may at their sole discretion allow the release of progress payments in the form of additional credits prior to acceptance of the facilities.
If the Developer exhausts the original allocation of eighty percent (80%) of the Programmed Costs prior to the City accepting the facilities, and the Director does not authorize the release of additional credits as progress payment, those fees paid by Developer for building permits issued prior to the acceptance of the facility, shall be reimbursed to Developer by the City and the remaining twenty percent (20%) credit shall proportionally be reduced by the amount reimbursed.
Section 8. Application of Fee Credit
Fee credits provided pursuant to this Agreement shall be applied to the property identified in Exhibit B in any manner requested by the Developer. Based on the type of Facilities covered by this Agreement, such fee credits shall only apply to the appropriate fee within the SCSP Fee Program.
Section 9. Transfer of Fee Credits
Fee credits granted to Developer pursuant to this Agreement may be transferred to other owners, builders, or developers anywhere within the specific plan area boundary as shown on Exhibit B. To effect such a transfer, Developer shall submit a completed form to the City in substantially the same format as set forth in Exhibit C that will: (i) reference this Agreement; (ii) identify the Developer and assignee if credits are being assigned to a builder or other party; (iii) identify the number of lots against which the credits will be applied; (iv) identify the fee credit balance before and after the transfer; and (v) include a map or other method that is acceptable to the City that identifies the lots or parcels against which the fee credits will be applied. The form must be signed by the Developer and the City, and an executed copy of the form shall be kept on file at the City.
Section 10. SCSP Fee Program Updates
At least once annually, the City shall update the SCSP Fees to ensure that the Programmed Costs of facilities in the SCSP Fee Program are appropriate based on current estimates of land costs and construction costs, as well as Actual Costs that have been incurred for facilities within the SCSP Fee Program that have been constructed in the prior year. In addition to the annual update of the SCSP Fees, the City may initiate additional updates to the SCSP Fee Program in any year to increase the SCSP Fees to cover cost overruns that have been approved by the City to include in such fee updates. If the Director has identified a cost overrun pursuant to Section 6 above, the City may commence an SCSP Fee Program update immediately or within a reasonable time thereafter.
Section 11. Inspection
ITEM 10.1. ATTACHMENT 2
Exhibit A to Resolution
City shall, at all times, upon reasonable advance notice, have access to the construction site during construction of the Facilities and Developer shall furnish City with all reasonable information necessary for ascertaining full knowledge of the Facilities with respect to the progress, workmanship, and character of materials and equipment used and employed in the work.
Whenever the contractors retained by Developer vary the normal period during which work or any portion of it is carried out on each day, Developer shall give timely notice to the City so that the City’s representative may, if he or she wishes, be present to observe the work in progress. If Developer fails to give such timely notice, any work done in the absence of the City’s representative will be subject to rejection. Developer shall give timely notice to the City in advance of backfilling or otherwise covering any part of the work so that the City’s representative may, if he or she wishes, observe the work before it is concealed.
Observation of the work by the City shall not relieve Developer of any of their obligation to complete construction in accordance with the plans and specifications approved by the Director, or designee.
Section 12. Prevailing Wages
Pursuant to the provisions of Articles 1 and 2 of Chapter 1, Part 7, Division II of the Labor Code of the State of California, not less than the general prevailing rate of per diem wages, and not less than the general prevailing rate of per diem wages for holidays and overtime work, for each craft, classification or type of worker needed to execute the work contemplated under this Agreement shall be paid to all workers, laborers, and mechanics employed in the execution of said work by Developer’s contractor, or by any subcontractor doing or contracting to do any part of said work.
Developer shall require its contractor to post, at each jobsite, a copy of such prevailing rate of per diem wages as determined by the Director of the California Department of Industrial Relations (DIR). Prior to execution of this Agreement, Developer shall provide evidence that the contract for construction of the Faclities has been registered with the DIR.
Section 13. Insurance
Developer shall require its contractor to carry and maintain during the life of this Agreement, such public liability, property damage and contractual liability, auto, Workers’ Compensation and Builders’ Risk Insurance as required by the improvement plan specifications for the Facilities. The contractor shall name the City as an additional insured.
Section 14. Acceptance and Conveyance of Facilities
Once Developer has completed construction of the Facilities and the Facilities are accepted and deemed satisfactory by the City, the Facilities automatically become the property of the City, or other Agency as appropriate. Developer shall take any and all

CITY OF RANCHO CORDOVA
CREDIT/REIMBURSEMENT AGREEMENT
FOR PLAN AREA FORMATION FEES INCLUDED IN THE
SUNCREEK SPECIFIC PLAN DEVELOPMENT IMPACT FEE PROGRAM
This Agreement (the “Agreement”) is entered into by and between the City of Rancho Cordova (hereinafter “City”) and (INSERT NAME OF DEVELOPER), (hereinafter “Developer”) as of the ______ day of _________________ 2022.
RECITALS
WHEREAS, Developer is developing (insert name of Subdivision or Villages) (the “Projects”) and is seeking small lot final map approvals; and WHEREAS, on June 6, 2022, the City Council of Rancho Cordova adopted Ordinance No. 9-2022 which approved the Suncreek Specific Development Impact Fee Program (the “SCSP Fee Program”); implemented development impact fees to pay for a variety of public facilities (the “SCSP Impact Fees”), including the Facilities; and set forth policies associated with fee credits and reimbursements within the Suncreek Specific Plan (“SCSP”) area; and
WHEREAS, in the time since approval of the SunCreek Specific Plan in 2013, the original Suncreek owners have shared and incurred significant costs to prepare various studies, reports, plan area amendments, environmental and technical studies which allowed implementation of the SCSP Fee Program; and
WHEREAS, in order to equitably recover plan area formation costs paid by the various Suncreek owners, each Developer is required by the SCSP Fee Program and Ordinance No.9-2022 to pay a SCSP Plan Area Formation Fee prior to approval of their respective small lot final map; and
WHEREAS, on November 17, 2022, the City Council of Rancho Cordova approved a template form of this credit/reimbursement agreement, delegated authority to the Community Development Director, or designee, to authorize the credit of costs associated with plan area formation costs, or portions thereof in lieu of all, or a portion of the Plan Area Formation Fee, or the reimbursement of such plan area formation costs pursuant to the terms of the credit/reimbursement agreement and further authorized the City Manager, or designee, to execute said agreement; and
WHEREAS, City has agreed to allow Developer to proceed with approval of small lot final maps for the Project; and
ITEM 10.1. ATTACHMENT 3
Exhibit B to Resolution
WHEREAS, City and Developer desire to enter into an agreement to provide for allowable credits and/or reimbursements by the City to Developer for certain costs funded by Developer association with Plan Area Formation costs as identified in Exhibit A; and WHEREAS, City and Developer have agreed to allow apportionment of credits over the real property identified in Exhibit B hereto; and
NOW, THEREFORE, in consideration of the mutual promises contained herein, City and Developer agree as follows:
Section 1. Credit/Reimbursement Amount
The City agrees to provide credits to and/or reimburse Developer the allowable costs, based on the cost schedules set forth in the Suncreek Specific Plan Development Impact Program listed in Exhibit A. Funds will be credited/reimbursed without interest.
Section 2. Credit/Reimbursement Timing
As set forth in Chapter 16.82.130 of the City of Rancho Cordova Municipal Code, the Plan Area Formation Fee shall be paid prior to final map approval. For projects that are subject to building permits, but not subdivision map approval, the fees shall be both calculated and paid upon issuance of the building permit. Depending on the nature of the approval, the plan area formation fee credit will be applied at final map approval or building permit issuance.
Section 3. Limitation on Fee Credits
Notwithstanding Section 1 above, the amount of fee credits due to a Developer for plan area formation costs pursuant to this Agreement shall not exceed the amount of fees due from the Developers for that facility type within the area designated for such fee credits as identified in Exhibit B hereto. If the amount of credit from Section 1 for a particular facility type exceeds the plan area fee obligation for the Developer, the remaining credits may be assigned to lots within the Specific Plan Boundary as shown in Exhibit B.
Section 4. Distribution of Fee Credits
Upon execution of this Agreement, the Developer shall receive fee credits equal to the Programmed Costs for the Facilities indentified in Exhibit A. If the Developer, through credits applied towards their Project, exhausts the full allocation of creduts, Developer as well as its successors and assignees shall be required to utilize other SCSP Plan Area Fee credits and/or pay the SCSP Plan Area Fee on the remaining final maps approved or building permits issued within their Project area identified in Exhibit B.
Section 5. Transfer of Fee Credits
Fee credits granted to Developer pursuant to this Agreement may be transferred to other owners, builders, or developers anywhere within the specific plan area boundary as shown on Exhibit C. To effect such a transfer, Developer shall submit a completed form to the

The form must be signed by the Developer and the City, and an executed copy of the form shall be kept on file at the City.
Section 6. Indemnification
The Developer, by execution of this Agreement, specifically agrees to assume the defense of, indemnify and hold harmless City and its elected representatives, officers, employees, agents and consultants (the “Indemnitees”), from and against all liabilities, actions, damages, claims, losses, or expenses of every type and description, including attorneys’ and consultants’ fees and expenses, (collectively, “Liabilities”), to which they may be subjected or put, by reason of or resulting from the design, construction, or installation of the Facilities, except to the extent the Liabilities arise from the sole negligence, active negligence, or willful misconduct of City and/or the Indemnitees. This indemnification shall extend to Liabilities occurring after this Agreement is terminated as well as while it is in force. Notwithstanding the foregoing, following the acceptance of the improvements by City, or if there is an applicable warranty, following the end of any applicable warranty period, the Developer shall not be obligated to indemnify the Indemnitees for Liabilities to the extent that such Liabilities arise from Indemnitees’ active or passive negligence.

PROJECT
RECOMMENDATION
Adopt the Resolution.
RESULT OF RECOMMENDED ACTION
Adoption of the Resolution would declare the results of the property owner's protest and, if there exists less than a majority protest, authorize the mailing of a ballot to the property owner to approve the levy of the fee to pay for maintenance of storm drainage and flood protection systems for the Sun Center Drive Warehouse project. The action also sets 1:30 p.m. on December 20, 2022 in the office of the City Clerk, as the time and date for the ballot tabulation for the matter.
BACKGROUND
The Sun Center Drive Warehouse project has a condition of approval which requires funding for operation and maintenance of the storm drainage system. This condition will be satisfied by the participation in the new Stormwater Utility Fee for storm drainage and flood protection services which is the subject of tonight’s action.
The property owner of the Sun Center Drive Warehouse project has requested the City annex the project to the City’s Stormwater Utility Fee pursuant to the California Health and Safety Code Section 5471 et seq. to provide the method of financing for storm drainage and flood protection services required to meet the condition.
On November 7, 2022, Council adopted a resolution which established Procedures for the Conduct of a Protest Hearing and Balloting Relating to a Stormwater Utility Fee (the “Procedures”) and designated November 21, 2022, at 5:30 p.m. as the time and place for hearing protests in connection with the annual Stormwater Utility Fee for the Sun Center Drive Warehouse project.
City Council Staff Report - Page 2 of 2
DISCUSSION
The property owner has submitted a petition and waiver for the City to institute the proceedings to participate in the Stormwater Utility Fee. This annexation to the Stormwater Utility Fee will include the project generally known as the Sun Center Drive Warehouse project, see Attachment 2. The maintenance services to be funded include the furnishing of services and materials for the ordinary and usual operation, maintenance, and servicing of the storm drain and flood protection systems.
Attachment 1 is the Resolution declaring the results of the property owner protest and authorizing the mailing of the property owner ballot, as required by Article XIII D of the California Constitution (also known as Proposition 218). The Resolution sets forth the tabulation of ballots on December 20, 2022, at 1:30 p.m. in the office of the City Clerk. The results of the mailed ballot election will be presented to City Council at their regularly scheduled meeting on October 3, 2022, and additional actions will be recommended based on the ballot results.
A “Rate Analysis Report” was approved by City Council on September 4, 2014, by Resolution 103-2014 setting Fiscal Year 2014/2015 maximum annual Stormwater Utility Fee amount for each parcel proportionate to the estimated stormwater runoff for each parcel, see Attachment
3. The maximum annual fee will increase each subsequent Fiscal Year by the annual change in the Consumer Price Index (CPI), during the preceding year, for All Urban Consumers, for the San Francisco-Oakland-San Jose areas, published by the United States Department of Labor, Bureau of Labor Statistics. A sample of the Stormwater Utility Fees for Fiscal Year 2022-2023 are summarized in Attachment 4.

Q:\Sacramento\Storm Drain User Fee\Report\rancho cordova drainage fee rpt DRAFT 08.6.14.docx Introduction
The City of Rancho Cordova (City) is detaching from the County of Sacramento fee and is creating their own Stormwater Utility Fee, which is being levied per the California Health and Safety Code Section 5471 et seq.
The purpose of this Rate Analysis Report is to:
Review the Stormwater Utility Fee and improvements to be funded. Review the requirements of Article XIIID of the State Constitution (Proposition 218) relating to requirements for apportioning the costs associated with the City’s stormwater runoff system. Analyze and recommend an appropriate rate structure and provide estimated rates based on cost data information provided by the City.
Proposition 218 Requirements
This fee must comply with the provisions of Article XIIID of the California Constitution (Proposition 218). Section 6 of Proposition 218 has the following requirements for all “new, extended, imposed or increased” fees and charges:
1) “Revenues derived from the fee or charge shall not exceed the funds required to provide the property-related service.”
2) “Revenues derived from the fee or charge shall not be used for any purpose other than that for which the fee or charge was imposed.”
3) “The amount of a fee or charge imposed upon any parcel or person as an incident of property ownership shall not exceed the proportional cost of the service attributable to the parcel.” 4) “No fee or charge may be imposed for a service unless that service is actually used by, or immediately available to, the owner of the property in question. Fees or charges based on potential or future use of service are not permitted. Standby charges, whether characterized as charges or assessments, shall be classified as assessments and shall not be imposed without compliance with [the assessment section of this code].” 5) “No fee or charge may be imposed for general governmental services including, but not limited to, police, fire, ambulance or library services where the service is available to the public at large in substantially the same manner as it is to property owners.” Background Information
In accordance with the Federal Clean Water Act of 1972, the United States Environmental Protection Agency (EPA) is required to establish regulations setting forth National Pollution Discharge Elimination System (NPDES) permit standards. The enactment of 1987 amendments to the Federal Clean Water Act (Act) of 1972 imposes permit requirements for discharge of storm waters. The Act allows the EPA to delegate its NPDES permitting authority to states with an approved environmental regulatory program. The State of California is one of the delegated states.
The responsibility for implementing various NPDES permits in the State of California has been delegated to the State Water Resources Control Board (SWRCB). The SWRCB administers NPDES authority through its nine Regional Boards. As an NPDES permittee, the City is required to manage stormwater pollution within its jurisdiction.

Q:\Sacramento\Storm Drain User Fee\Report\rancho cordova drainage fee rpt DRAFT 08.6.14.docx In order to provide for the safety of the residents of the City and protect property in the City from the damage associated with flooding and to meet the requirements of the NPDES permit, it is necessary to design, construct, operate, maintain, improve and replace storm drainage facilities which collect storm and surface water runoff and convey and treat such runoff in a safe manner to an acceptable point of discharge. It is also necessary to inspect, monitor, and take enforcement action related to illegal dumping, and illicit discharges. In order to properly fund such facilities and activities, the City has determined that it is necessary to impose on all developing properties in Rancho Cordova a user charge for storm drainage service.
Based on the 2030 General Plan and current specific plan areas, Rancho Cordova is expected to develop as shown in Table 1 below. The proposed boundary for the stormwater utility is shown in Appendix A.

8. Develop programs to promote, publicize, and facilitate public reporting of illicit discharges to the storm drain system.
9. Encourage the proper disposal of household hazardous waste (HHW) to prevent the improper disposal to the storm drain system or to the sewer system.
10. Discourage the improper disposal of litter, garden clippings, leaves, and pet waste into the street or the storm drain system.
11. Capital replacement of storm drainage and flood control improvements at the end of the expected useful life for such improvements.
Rate Structure Analysis
Section 6.b of Article XIIID of the State Constitution (Proposition 218) states that:
“The amount of a fee or charge imposed upon any parcel or person as an incident of property ownership shall not exceed the proportional cost of the service attributable to the parcel.” and
“No fee or charge may be imposed for a service unless that service is actually used by, or immediately available to, the owner of the property in question.” By definition, all properties that shed stormwater into the City’s stormwater drainage system use, or are served by, the City’s stormwater drainage system. The amount of use attributed to each parcel is measurable by the amount of storm runoff contributed by the property, which is directly proportional to the amount of impervious area on a parcel (such as buildings and concrete). The more impervious area on a property, the more storm runoff the property generates, the more demand placed on the storm drain system.
The amount each parcel uses the stormwater drainage system is computed by the following formula:
(Parcel Area) x (Impervious Percentage) = Drainage Units The typical percent impervious (% Impervious) for land uses in the City, have been applied for the purposes of estimating the runoff generated by each property. These are shown in Appendix B.
The more Drainage Units a parcel has, the more storm run-off it generates, and the more it uses and impacts the stormwater drainage system.
It is standard practice to relate other land uses to a developed single family residential (SFR) parcel, instead of working exclusively with drainage units. The median size of a SFR parcel will be approximately 0.16 acre. Therefore, it makes sense to relate all parcels to this median residential property. The runoff from a 0.16-acre SFR parcel is set equal to one Drainage Measurement Unit (DMU) and this base DMU is calculated as follows:
(0.16 acres of area) x 50% = 0.0800 Impervious Area = 1 DMU
ITEM 10.3. ATTACHMENT 3
City of Rancho Cordova August 7, 2014
Stormwater Utility Fee
Rate Analysis Report Page 6
Q:\Sacramento\Storm Drain User Fee\Report\rancho cordova drainage fee rpt DRAFT 08.6.14.docx Single Family Residential Parcels
As a SFR property increases in size over the median parcel size, the typical percentage of impervious area decreases, as shown in Appendix B. Conversely, as a SFR parcel decreases in size below the median parcel size, the typical percentage of impervious area increases, and such increase is typically proportional to the decrease in size. Therefore, SFR properties are separated into five (5) groups.
The median parcel area for each group was used and their DMUs are calculated as follows:
SFR Category DMU/ Formula
SFR1 – SFR parcels 0.16 acres or less 1.00 DMU
SFR2 – SFR parcels 0.17 - 0.25 acres 1.10 DMUs
SFR3 – SFR parcels 0.26 – 0.33 acres 1.175 DMUs
SFR4 – SFR parcels 0.34 – 0.50 acres 1.25 DMUs
SFR5 – SFR parcels greater than 0.50 acres 1.25 + [(acres – 0.50) x 5%] = DMUs
0.0800
Multi-Family Residential Parcels
Multi-Family Residential (MFR) units (including condominiums) are split into categories by the density, or number of dwelling units per acre (DU/Ac) as follows:
MFR Category Density % Impervious
MFR1 - High Density Greater than 18 DU/Ac 75%
MFR 2 - Med Density 10 – 18 DU/Ac 70%
Acreage x %Impervious = DMUs
0.0800
Condominium unit parcel areas are calculated by dividing the total area of the condominium complex (which includes the common area) by the number of condominium units, and the total imperviousness of the entire complex is attributed to each individual condo parcel in the complex. (This divides the runoff of the entire complex to each of the individual units.) Because these condominium common areas are taken into consideration in this manner, they are exempt from the charge.
Non- Residential Parcels
All non-residential parcel DMUs will be based on the impervious area (runoff coefficient) table shown in Exhibit B, using the following formula:
Acreage x %Impervious = DMUs
0.0800
All parcels draining into Rancho Cordova Stormwater Utility Fee-maintained drainage infrastructure are proposed to be charged the same user fee rate per DMU for stormwater runoff treatment. The Rancho Cordova Stormwater Utility Fee is proposed in perpetuity.
For the purposes of this report, City-maintained drainage infrastructure includes streets, pipes, inlets, outlets, and natural drainage courses. Parcels related to these types of property uses are exempt from the runoff charge, as they are part of the infrastructure being funded. Also exempt from the runoff charge is Caltrans right-of-way, because Caltrans handles its own runoff under a separate NPDES permit.

Table 4 below shows the estimated costs to maintain infrastructure in the developing areas. Unit costs for maintenance were derived using budget information provided by the County, since the County currently maintains the storm drainage system. The budget information is shown in Appendix C.
Table 4 – Estimated Costs
Fee Calculations
The estimated annual costs for the proposed storm drain improvements are $5,401,709 as shown in Table 4 above. Dividing that by the total number of proposed DMU’s in Rancho Cordova (47,124), the maximum estimated annual Stormwater Utility Fee rate is $114.63 per DMU.
This would be the proposed maximum fee rate for fiscal year 2014-15. The maximum rate will be increased each subsequent Fiscal Year by the annual change in the Consumer Price Index (CPI), during the preceding year, for All Urban Consumers, for the San Francisco-Oakland-San Jose areas, published by the United States Department of Labor, Bureau of Labor Statistics (or a reasonably equivalent index should the stated index be discontinued, as determined by the Director of Public Works).

Appeals Process
If a property owner disagrees with the calculation of his or her fee, based on the parcel area and estimated impervious percentage assigned to the property, then the property owner may appeal the calculation as follows:
1. Property owner must provide written documentation explaining the reason why the charge should be changed. This documentation must include:
a. The name, phone number, mailing address, and email address, if available, of the property owner.
b. The Assessor’s Parcel Number (APN) of the property in question.
2. If additional documentation is required or insufficient documentation was submitted, a representative of the Department of Public Works (Staff) will notify the property owner in writing.
3. Once Staff has determined that sufficient documentation has been submitted, Staff will perform the initial review. Staff will notify the property owner in writing within four (4) weeks from the time sufficient documentation was submitted as to whether or not the fee amount will be changed.
a. If the determination is to change the fee amount, then the new fee amount will be documented within the City’s fee database.
