SUBJECT: Consideration of First Reading and Introduction of Ordinance No. 1013, to be Read by Title Only and Waive Further Reading, Adding Chapter 9.6 to the Rancho Cucamonga Municipal Code to Prohibit the Possession of a Catalytic Converter without Legal Authority in Rancho Cucamonga. (ORDINANCE NO. 1013) (CITY)
RECOMMENDATION:

Staff recommends that the City Council, introduce, as read by title only, Ordinance No. 1013, adding Chapter 9.6 to the Rancho Cucamonga Municipal Code to prohibit the possession of a catalytic converter without legal authority.

BACKGROUND:

Catalytic converters are an external component of a vehicle, accessible from the underside of a parked car. They convert most of a vehicle’s emissions into less harmful forms, improving air quality and vehicle performance. As part of their construction, catalytic converters contain valuable materials such as platinum and palladium, rare metals that command increasing prices in the recyclables market.

Catalytic converter thefts are on the rise because individuals are incentivized to commit catalytic converter thefts for multiple reasons including, but not limited to the ease and undetectable nature of committing such thefts, potentially in a matter of seconds and through the use of common tools, and the ability to recycle catalytic converters at scrap metal yards for high dollar returns ranging from $200-$1,200 per catalytic converter.

According to the National Insurance Crime Bureau, the number of monthly catalytic converter thefts in California were 14 times that of 2019. Many cities have also reported experiencing an average of 40-50 catalytic converter thefts per week.

ANALYSIS:

Rancho Cucamonga is no exception to this trend, with residents experiencing an increase in catalytic converter thefts from their automobiles over the past several years. With no City, State, or Federal legislation effectively deterring unlawful possession of a catalytic converter, criminal enforcement remedies are limited. Individuals in possession of stolen catalytic converters are able to recycle them for substantial profit at relatively low risk, while victims are forced to commit to costly repairs. By criminalizing the possession of an unattached catalytic converter absent proof

Page 116 ends

of ownership or lawful possession, the attached ordinance would combat this criminal practice by establishing zero-tolerance for catalytic converter thefts, establish penalties for possessing stolen catalytic converters, and prevent criminals from profiting from the sale and recycling of stolen catalytic converters.

FISCAL IMPACT:

There is no fiscal impact associated with introducing Ordinance No. 1013.

SUBJECT: Public Hearing to Consider Establishing, Repealing, and Amending Certain Service and User Fee Adjustments for Various Departments (Building and Safety Services, Planning, Public Works, Engineering Services, City Clerk’s Office, Finance, Community Services and Library Services) and Consider a Resolution Approving Such New Service and User Fees and Authorizing Automatic Annual Adjustments on Certain Fees. (RESOLUTION NO. 2022-155) (CITY)
RECOMMENDATION:

Staff recommends the City Council:

1. Conduct a public hearing on the proposed new and amended fees;

2. Adopt a Resolution to establish new fees, repeal outdated fees, and amend certain existing fees to Citywide user fees, and authorize annual adjustments to certain fees based on an inflationary factor established by the United States Bureau of Labor Statistics, where designated.

BACKGROUND:

The City can impose fees under the authority granted by California Government Code Section 66000 et. Seq. Fees are allowed to be imposed in order to recover costs associated with the provision of specific services benefiting the user, thereby reducing the use of General Fund monies for such purposes. To impose fees, the City must hold at least one public hearing as part of a regularly scheduled meeting to allow for public comment on the proposed fees.

Page 120 ends
Page 2 ends

9 3
The City of Rancho Cucamonga has established fees by authority of the Municipal Code, City Ordinances, City Resolutions, City development/funding agreements, and State and Federal statutes. As a matter of routine, City departments revisit fees at least once per year to ensure that small adjustments can be made over time to keep up with operational and construction costs. In accordance with this approach, departments have reviewed fees to recommend what adjustments should be made at this time. To reduce the number of fees brought before the City Council on an annual basis, certain fees are adjusted annually by applying a fee escalator approved by prior resolutions. As part of the proposed City resolution, staff is requesting that the City Council approve the application of an annual escalator to all City fees, where applicable, to provide greater consistency and streamline the annual fee update process.

City staff also desires to memorialize all existing fees in a consolidated Master Fee Schedule, reflecting amendments approved by the City Council to date. The comprehensive Master Fee Schedule will be posted on the City's website making it easier for citizens, staff, and interested parties to understand and access the City's various fees. It is anticipated that the Master Fee Schedule will be posted on the City’s website in January 2023.

ANALYSIS
It is necessary for the City to periodically update its user fees to ensure that fees charged are commensurate to the estimated cost of providing individualized services. Fee studies are conducted to justify modification to fees as needed. The City has adopted modified fees by resolution whenever a change in a specific fee has been warranted; however, a comprehensive master schedule of fees has not been maintained. Staff will create and maintain a consolidated master list of all current fees and fee updates moving forward.

As labor effort and costs associated with the provision of services fluctuate over time, a significant element in the development of fees is the flexibility to remain current. To allow fees to stay current over time, staff recommends an annual automatic adjustment based upon published information relative to costs to provide services. An automated process for annual fee updates will provide uniformity and consistency in Citywide fees and ensure continuous adjustment to recover costs.

Many cities base annual adjustments on the change in the Consumer Price Index (CPI), which measures the average change in the prices paid for a market basket of goods and services for a given region. The Employment Cost Index (ECI), which considers the change in compensation costs for state and local government workers, is also an appropriate factor to apply to City fees given that much of the cost for services are conditioned on employee costs. Additionally, the Engineering News-Record (ENR) Construction Cost Index (CCI) measures general cost trends for cement, lumber, structural steel, and labor and is widely used to forecast general construction costs.

The primary factor for the cost of a city’s services is typically the costs of the personnel involved to process and administer the services. In order to continue to recover costs associated with the delivery of services and programs, a city may apply an inflationary factor to the Master Fee Schedule to allow adjustments to fees annually. The Rancho Cucamonga City Council has authorized annual adjustments to certain fees in past resolutions, either by CPI, ECI, or ENR.

Staff recommends applying this approach across all user fees, where applicable. Approval of an inflationary factor allows for fees to be automatically adjusted annually by the percentage change in the Employment Cost Index (ECI) for state and local government workers, total compensation (not seasonally adjusted), during the 12-month period ending on December 31 of the immediately preceding calendar year, as published by the United States Bureau of Labor Statistics. The factor accounts for wage and benefits increases and such adjustments will apply to fees directly related

Page 121 ends

9 3
to City staffing. Adjusted fees will be rounded to the nearest whole dollar.

Each department has reviewed its fees to determine what category of fees should be adjusted annually based on an inflationary factor and the associated fee study for each such fee. Certain fees are set by government statute and are not subject to an automatic escalator (e.g., duplication fees for public records). Staff has also identified fees that should be excluded from annual adjustments so that they remain competitive, and thus result in a charge that is less than the City’s cost of providing the service (e.g., animal licensing fees). The City Council will continue to approve new fees or fees requiring additional studies or analysis to ensure that fees charged are sufficient to recover the cost of services provided. These fee adjustments will be presented separately for City Council approval and incorporated into the Master Fee Schedule. Comprehensive fee studies may be performed every five to seven years to periodically examine user fees and charges to ensure the fees do not exceed actual costs.

The Citywide Master Fee Schedule will incorporate all amendments proposed in this report, upon approval by the City Council. Modifications to existing fees have been requested by various departments, including the approval of new fees and deletion of fees no longer in use. The corresponding cost analysis worksheets for each new or increased fee were placed on file in the City Clerk’s office on November 23, 2022. Below is a summary from each department on proposed fee adjustments.

BUILDING AND SAFETY SERVICES
Fees for patio covers, barns, storage sheds, bathroom remodels, electrical receptacles, solar installations, and EV charging fees are associated with the costs of inspection and plan review.

The fees have been restructured to allow for more detailed categories and expanded descriptions or reduced where state requirements have changed.

Effective July 1, 2023, fees will be automatically adjusted annually by the percentage change in the Employment Cost Index (ECI) for state and local government workers, total compensation (not seasonally adjusted), during the 12-month period ending on December 31 of the immediately preceding calendar year, as published by the United States Bureau of Labor Statistics. The ECI escalator is consistent with other departments who apply the ECI to permit fees to ensure recovery of costs for administering the service. Additionally, these fees are subject to the current 7% Technology Fee and 10% General Plan Fee.

PLANNING
The Planning Department has proposed deleting several fees from the fee schedule and renaming certain fees to more appropriately reflect their purpose. Increases in various Planning Department deposit amounts reflect the increase in staffing costs related to processing development applications or petitions. As part of the development application process, several deposits may be required to be filed to defray the expenses incurred by the City in investigating and processing the petition or application. Once completed, any unused portion of the deposit is returned to the applicant.

Sports lighting at Rancho Cucamonga parks are essential for residents to enjoy sports at night with the safety of lighted fields. The fees are proposed to be updated to clarify user groups and rates. Approved Rancho Cucamonga Sports Advisory Committee sports groups pay a subsidized fee of $10 per hour to partially offset the electric utility costs. This fee is reassessed annually based on the percentage increase in the Consumer Price Index (CPI) All Urban Consumers for the Riverside-San Bernardino-Ontario area, per Resolution 2020-120. New fee categories have been created for non-Sports Advisory Committee sports groups to include actual costs to light the Epicenter and all other fields. These fees account for labor, operations and maintenance, utilities, and some capital costs, and will be subject to annual CPI adjustments.

ENGINEERING SERVICES
Environmental Programs
An increase is proposed to the Unlawful Bin Removal Notice Fee, adopted in 2016 and last updated in 2020, for services performed by Engineering Services. This cost recovery includes the time to process the notice to remove the bin, such as contacting the bin owner, property owner, or contractor; request an invoice from the Finance Department; coordinate with Burrtec; and follow-up on payment. Staff spends a considerable amount of time researching responsible parties, particularly when the bin owner cannot be identified or does not comply with the 24-hour removal notice.

The Unlawful Bin Administration Fee was adopted to recover the cost of administration and enforcement of unlawful solid waste bins per Municipal Code 8.17.050. Analysis of the current fee revealed the existing fee does not sufficiently cover staff time costs to administer the program.

Page 124 ends
Page 6 ends

9 3
The proposed increase will close the gap and recover the program’s administration costs.

The Construction and Demolition (C&D) self-haul permit fee and the diversion program administration fees, based on square footage, were last updated in 2018 – Resolution No. 2018- 125. An increase is proposed to the fee for C&D project self-haul permits for services performed by Engineering Services. Staff has found that the current permit fee is not adequate to cover the staff time for review and approval of a C&D self-haul permit. Staff must research sites that are listed on the self-haul application or waste management plan and confirm that all state and local requirements have been met. The increase is based on the average time spent for all self-haul permits within the last year.

The ECI will not apply to deposit-based fees.

The current daily and monthly parking permit fees for the Metrolink Parking Lot – Cucamonga Station, have remained the same for the past six years (Resolution No. 16-004). In 2016, revenue covered 38% of the operating cost, in 2022 it dropped to 27%. Given the increased cost of maintenance, labor, and utilities, City staff is recommending adjustments of parking fees based on increases in the Consumer Price Index (CPI), which will be needed to ensure fiscal stability.

Effective July 1, 2023, fees will be annually adjusted according to the percentage change in the March index of the Consumer Price Index All Urban Consumers (CPI-U) for the Riverside-San Bernardino-Ontario, California area published by the United States Bureau of Labor Statistics.

Business Licensing
In addition to a business license tax required by an applicant intending to conduct business in the City (pursuant to Chapter 5 of the Rancho Cucamonga Municipal Code), separate fees for services performed by the Finance Department relating to Business Licensing have been set to recover the cost of administering certain special permits. These special permit fees have not been adjusted in several years while the costs for providing the services and processing of permit applications have increased. The table below is informational and does not propose changes to these fees; however, effective July 1, 2023, these permit fees will be automatically adjusted annually by the percentage change in the Employment Cost Index (ECI) for state and local government workers, total compensation (not seasonally adjusted), during the 12-month period ending on December 31 of the immediately preceding calendar year, as published by the United States Bureau of Labor Statistics. The escalator is consistent with other City departments who apply the ECI to permit fees to ensure recovery of costs for administering the service.

Special Districts
A new fee is proposed to cover the costs of annexation into Community Facilities Districts (CFDs).

The fee is for properties conditioned by the City to join existing CFDs to satisfy service mitigation impacts. Costs include staff time required to coordinate the annexation process which includes continuous communication with the property owner(s) regarding the application, annexation payment, creation of an annexation map (when applicable), consent and waiver RMA forms, ballot

package (instructions to voters, the official ballot, and the return ballot envelope), travel to record map at the County of San Bernardino, canvassing the ballot at the City Clerk’s Office, preparation of staff report and resolution for a City Council meeting, and recording a notice of special tax lien.

Effective July 1, 2023, the fee will be automatically adjusted annually by the percentage change in the Employment Cost Index (ECI) for state and local government workers, total compensation (not seasonally adjusted), during the 12-month period ending on December 31 of the immediately preceding calendar year, as published by the United States Bureau of Labor Statistics. The escalator is consistent with use by other City departments and will help ensure the fee stays current to the market.

COMMUNITY SERVICES
In 2019, staff conducted a comprehensive analysis of fees and recommended facility rental fees be restructured and streamlined in order to ensure adequate fees are charged to cover the costs of facility use. The last update to Community Services fees was in 2021, through Resolution No. 2021-129 which also authorized automatic adjustments to fees annually by ECI to ensure rates keep pace with the market and increases in operational costs such as minimum wage, employee salaries and benefits, utilities, contracted services, etc.

The Community Services Department proposes modifications to the description of certain fees but not the fee itself. Minor changes to language are recommended to increase clarity in the “Non- Room Fees” to allow rental deposits to be processed per day or per week instead of per event, and to reflect that some equipment is now available at all locations rather than only at the Victoria Gardens Cultural Center. Changes are proposed to reflect increasing costs to piano tuning services.

LIBRARY SERVICES
To maintain consistency with existing practices, the Library Services Department proposes adopting changes in Library facility rental fees, refunds, and staffing rates to ensure parity with other City facilities and to remain competitive with the surrounding region. The Library Services rental fees have been restructured and streamlined using the framework established by the Community Services Department in 2019.

Page 128 ends
Page 10 ends

The updated fees and charges schedule for Library Services defines user group categories, as well as rental fee information and policies. Facility and room rental fees are listed for each group category. In addition, specialized rentals involving equipment are listed separately. These costs are comparable to Community Services’ facility rentals and include consideration of purchase, operations, and maintenance costs. All previously established Library Services fees will be repealed concurrently with the effective date of the revised fees. See Exhibit A to Resolution No. 2022-155 for a summary of the Library Services Department fees. The Library Board of Trustees reviewed the proposed fee adjustments at their meeting on December 1, 2022 and recommends the City Council adopt the revised fee schedule.

Effective July 1, 2023, the Library Services rental fees will be automatically adjusted annually by the percentage change in the Employment Cost Index (ECI) for state and local government workers, total compensation (not seasonally adjusted), during the 12-month period ending on December 31 of the immediately preceding calendar year, as published by the United States Bureau of Labor Statistics. The escalator is consistent with use by other City departments and will help ensure rental fees stay current to the market. Individual staffing rates will be replaced with a standard fully burdened staff rate calculation of top pay step multiplied by the current fringe benefit rate.

General fees have been restated in the Library’s fee schedule. These include a proposed increase to the passport photo fee to recover service costs and deletion of the interlibrary loan service fee as this service is no longer provided.

RE
COMMENDATION:

Staff recommends the City Council:

1. C
onduct a public hearing on the proposed new and amended fees;

2. Adopt a Resolution to establish new fees, repeal outdated fees, and amend certai n ex
isting fees to Citywide user fees, and authoriz e annual adjustments to certain fees based on an inflationary factor established by the United States Bureau of Labor Statistics, where designated.

BA
CKGROUND:

The City can impose fees under the authority granted by California Government Code Section 66000 et. Seq. Fees are allowed to be imposed in order to recover costs associated with the provision of specific services benefiting the user, thereby reducing the use of General Fund monies for such purposes. To impose fees, the City must hold at least one public hearing as part of a regularly scheduled meeting to allow for public comment on the proposed fees. 12/7/2022 City Council Meeting - Item G1: Revised Staff Report and Attachment

Page 145 ends
Page 2 ends

The City of Rancho Cucamonga has established fees by authority of the Municipal Code, City Ordinances, City Resolutions, City development/funding agreements, and State and Federal statutes. As a matter of routine, City departments revisit fees at least once per year to ensure that small adjustments can be made over time to keep up with operational and construction costs. In accordance with this approach, departments have reviewed fees to recommend what adjustments should be made at this time. To reduce the number of fees brought before the City Council on an annual basis, c ertain fees are adjusted annually by applying a fee escalator approved by prior resolutions.

ANALYSIS
It is necessary for the City to periodically update its user fees to ensure that fees charged are commensurate to the estimated cost of providing individualized services . Fee studies are conducted to justify modification to fees as needed. The City has adopted modified fees by resolution whenever a change in a specific fee has been warranted; however, a comprehensive master schedule of fees has not been maintained. S taff will create and maintain a consolidated master list of all current fees and fee updates moving forward.

In order to continue to recover costs associated with the delivery of services and programs, a city may apply an inflationary factor to the Master Fee Schedule to allow adjustment s to fees annually.

Page 146 ends
Page 3 ends

to City staffing.

Modifications to existing fees have been requested by various departments, including the approval of new fees and deletion of fees no longer in use . The corresponding cost analysis worksheets for each new or increased fee were placed on file in the City Clerk’s office on November 23, 2022. Below is a summary from each department on proposed fee adjustments.

BUILDING AND SAFETY SERVICES
Fees for patio covers, barns, storage sheds , bathroom remodels, electrical receptacles, solar installations, and EV charging fees are associated with the costs of inspection and plan review.

PUBLIC WORKS

This cost recovery includes the time to process the notice to remove the bin, such as contacting the bin owner, property owner, or contractor; request an invoice from the F inance Department; coordinate with Burrtec; and follow-up on payment.

Page 149 ends
Page 6 ends

The proposed increase will close the gap and recover the program’s administration costs.

The Construction and Demolition (C&D) self -haul permit fee and the diversion program administration fees, based on square footage, were last updated in 2018 – Resolution No. 2018- 125. An increase is proposed to the fee for C&D project self-haul permits for services performed by Engineering Services. Staff has found that the current permit fee is not adequate to cover the staff time for review and approval of a C&D self -haul permit. Staff must research sites that are listed on the self-haul application or waste management plan and confirm that all state and local requirements have been met. The increase is based on the average time spent for all self -haul permits within the last year.

The ECI will not apply to deposit-based fees.

Rancho Cucamonga Municipal Utility (RCMU)
The current daily and monthly parking permit fees for the Metrolink Parking Lot – Cucamonga Station, have remained the same for the past six years (Resolution No. 16-004). In 2016, revenue covered 38% of the operating cost, in 2022 it dropped to 27%. Given the increased cost of maintenance, labor, and utilities, City staff is recommending adjustments of parking fees based on increases in the Consumer Price Index (CPI), which will be needed to ensure fiscal stability.

Effective July 1, 2023, fees will be annually adjusted according to the percentage change in the March index of the Consumer Price Index All Urban Consumers (CPI -U) for the Riverside -San Bernardino-Ontario, California area published by the United States Bureau of Labor Statistics.

Business Licensing
In addition to a business license tax required by an applicant intending to conduct business in the City (pursuant to Chapter 5 of the Rancho Cucamonga Municipal Code) , separate fees for services performed by the Finance Department relating to Business Licens ing have been set to recover the cost of administering certain special permits. These special permit fees have not been adjusted in several years while the costs for providing the services and processing of permit applications have increased. The table below is informational and does not propose changes to these fees ; however, effective July 1, 2023, these permit fees will be automatically adjusted annually by the percentage change in the Employ ment Cost Index (ECI) for state and local government workers, total compensation (not seasonally adjusted), during the 12- month period ending on December 31 of the immediately preceding calendar year, as published by the United States Bureau of Labor Statistics.

Minor changes to language are recommended to increase clarity in the “Non- Room Fees” to allow rental deposits to be processed per day or per week instead of per event , and to reflect that some equipment is now available at all locations rather than only at the Victoria Gardens Cultural Center .

The Library Services rental fees have been restructured and streamlined using the framework establi shed by the Community Services Department in 2019.

Page 153 ends
Page 10 ends

The updated fees and charges schedule for Library Services defines user group categories, as well as rental fee information and policies. Facility and room rental fees are listed for each group category. In addition, specialized rentals involving equipment are listed separately. These costs are comparable to Community Services’ facility rentals and include consideration of purchase, operations, and maintenance costs. All previously established Library Ser vices fees will be repealed concurrently with the effective date of the revised fees. See Exhibit A to Resolution No. 2022-155 for a summary of the Library Services Department fees.

Effective July 1, 2023, the Library Services rental fees will be automatically adjusted annually by the percentage change in the Employ ment Cost Index (ECI) for state and local government workers, total compensation (not seasonally adjusted), during the 12 -month period ending on December 31 of the immediately preceding calendar year, as published by the United States Bureau of Labor Statistics.
