STAFF REPORT
TO: Mayor and City Council DATE: June 1, 2023
FROM: Ian Lasley, Assistant Public Works Director
SUBJECT: Park Maintenance District Special Tax Levy for Fiscal Year 2023/2024
SPECIFIC REQUEST OR RECOMMENDATION
That the City Council:
A. Adopt Resolution No. 2023-(Next-in-Order), ordering the levy and collection of the Park Maintenance Special Tax pursuant to Ordinance No. 685 for Fiscal Year 2023/2024; and B. Direct the City Clerk to file certified copies of the above Resolution and accompanying exhibits, attachments, and reports with the appropriate agencies as required.
JUSTIFICATION OR INFORMATION
On November 5, 1996, California voters approved Proposition 218, known as the Right to Vote on Taxes Act. Prior to approval of Proposition 218, maintenance of City parks had been funded by a city-wide assessment. Under Proposition 218 the existing assessment was not classified as an assessment, but rather a special tax, because the money collected was being used for one specific purpose, that purpose being park maintenance. Under the provisions of Proposition 218, implementation of a special tax required a 2/3rd5 vote of the electorate. On April 18, 1998 Rancho Mirage residents voted to discontinue the city-wide assessment in favor of a Park Maintenance Special Tax ("Special Tax"), which took effect on July 1, 1998.
The initial Special Tax for Fiscal Year 1998/99 was set at $18.96 per equivalent dwelling unit.
The Special Tax was approved by the voters to allow for annual increases to keep pace with inflation. The calculation for an increase in the Special Tax is based on the change in the prior year Consumer Price Index (CPI). According to the Bureau of Labor Statistics, the change in Riverside County CPI from calendar year 2022 to 2023 was 8.70%. For Fiscal Year 2022/2023 the Park Tax was levied at $34.84 per dwelling unit; increasing the Park Tax in Fiscal Year 2023/2024 by 8.70% will result in a levy of $37.86 per equivalent dwelling unit, an increase of $3.02 per equivalent dwelling unit.
On June 30, 2023, the Parkland Fund is estimated to have a total fund balance of $1,075,744.00.
Pursuant to Section 2.68.040(0)(4) of the Rancho Mirage Municipal Code, the annual special park tax to be levied shall be based on the "actual revenues estimated to be required by the City to pay its reasonable and necessary expenses for such year." With the increasing operational AGENDA ITEM#

expenses required to maintain the City parks, staff is recommending that the special tax be increased from the current rate of $34.84 per dwelling unit to a rate of $37.86 per dwelling unit for Fiscal Year 2023/2024 to keep pace with CPI.

STAFF REPORT
TO: Mayor and City Council DATE: June 1, 2023
FROM: Ryan Stendell, Public Works Director
SUBJECT: Award of Contract for Sidewalk Gaps Improvements - City Project CP 20-361
SPECIFIC REQUEST OR RECOMMENDATION
That the City Council award the contract for the Sidewalk Gaps Improvements, City Project CP 20-361, to the lowest responsive and responsible bidder, LC Paving & Sealing, Inc., in the amount of $263,410.00.
JUSTIFICATION OR INFORMATION
BACKGROUND:
It is requested that the City Council award the contract for the Sidewalk Gaps Improvements, City Project CP 20-361, to the lowest responsive and responsible bidder, LC Paving & Sealing, Inc., in the amount of $263,410.00.
The project was advertised for bid on April 13, 2023, and bids were opened on May 10, 2023, with the results listed below.
Contractor
Voltaire Engineering Inc.
LC Paving & Sealing, Inc.
Granite Construction Company
Total Bid
$251,465.00
$263,410.00
$329,520.00
Upon review of the apparent low bid prepared by Voltaire Engineering Inc., City staff upon consultation with City Attorney's office determined the bid was non-responsive due to failing to comply with the strict requirements of the bid documents, including not providing references from three public agencies on similar projects and failing to provide a subcontractors' license number as required in the public contract code (and failing to correct the omission within 24 hours of bid opening). City staff informed Voltaire Engineering Inc. on May 23, 2023 of the same determination. Voltaire Engineering Inc. informed the City of its intention to protest the non responsive determination at the City Council meeting. Based on the recommendation and the conclusions noted above, staff is requesting that the City Council reject the bid protest as part of this action item.

Award of Contract for Sidewalk Gaps Improvements - CP 20-361 JUSTIFICATION OR INFORMATION CONTINUED:
The City of Rancho Mirage Public Works Department is planning to fill in missing sections of sidewalk on Dinah Shore Drive, Key Largo Drive and Gerald Ford Drive near Oasis Way. The project will also widen the section of Key Largo Avenue along the new sidewalk to complete the west side of the street.
The proposed improvements will consist of constructing 1, 180 linear feet of concrete sidewalk, constructing 24' wide ADA-compatible driveway, and asphalt paving along the proposed sidewalk on Key Largo Avenue, as well as all other appurtenant or related work.
This project includes the removal and replacement of forty-eight (48) curb access ramps throughout the city to comply with current Americans with Disabilities Act (ADA) requirements.
Forty-four (44) of the ramps are located on Bob Hope Drive from Highway 111 to Casino Way, two (2) are located on Country Club Drive and Vista Del Sol, and two (2) are located on Monterey Avenue and Avenida Las Palmas.
FISCAL IMPACT:
Sufficient funds have been budgeted for the project from the General Fund and no budget adjustments are required. If the contract is awarded, work on this project will begin in mid-June, and completion is anticipated by late July.
Staff recommends that the City Council award the contract for the construction of Sidewalk Gaps Improvements, City Project CP 20-361 to the lowest responsible and responsive bidder, LC Paving & Sealing, Inc., in the amount of $263,410.00.
