CITY OF REDDING
REPORT TO THE CITY COUNCIL
Recommendation
Approve the City of Redding as an applicant for up to $15 million from the U.S. Environmental Protection Agency’s Community Change Grant for the Panorama Park and Resiliency Center ; and authorize the City Manager, or designee, to execute all documents necessary to apply for the grant.
Fiscal Impact
The Environmental and Climate Justice Community Change Grant program (Community Change Grants) application will request up to the program ’s maximum of $ 15 million to construct Panorama Park and Resiliency Center. The grant does not require a match. However, the City of Redding (City) has already secured $8.5 million from the Statewide Park Program, $9.25 million from the California Department of Food and Agriculture Community Resiliency Program , and will contribute $1.5 million from the Park Development Fund. If awarded , the grant funds will supplement the existing project budget for a combined total of up to $34.25 million and move the project into construction. Though the c urrent estimate place s the full cost of the project at $25 million, staff is applying for additional funds as a buffer for potentially higher bid pricing. The grant program operates on a reimbursement basis, and the City will need to cashflow the project until reimbursement requests are made. The grant will not impact the General Fund.
Alternative Action
The City Council (Council) could decline to apply for the funds under this grant opportunity or provide staff with alternate direction.

Re: 4.6(c)--Approve EPA's Community Change Grant Application for Panorama Park and Resiliency Center Page 2
Background/Analysis
Created by the Inflation Reduction Act , t he Environmental and Climate Justice Community Change Grant program (Community Change Grants) is offering $2 billion in grants for projects throughout the country. The Community Change Grants will fund projects that address climate challenges and reduce pollution while strengthening communities. The program’s financial support aims to assist communities in o vercoming longstanding environmental challenges , such as Redding’s extreme heat, and implement meaningful solutions to meet community needs now and for future generations. The City’s application will request up to $ 20 million to supplement the project’s current budget of $19.25 million. Combining multiple funding sources will provide the opportunity to outpace the inflation -caused budget issues to build the City’s first purpose - built resiliency center.
The project consists of a 10.5 -acre community park with an approximately 22,100 -square-foot resiliency center. The project features park amenities such as trails, landscaping, playground, dog park, parking, and more. The proposed resiliency center will provide services during natural disasters, extreme heat events, and other emergency or climate -related instances. Current cost estimates place the full cost of the project at $25 million, and staff continues to seek out funding to fill the gap. The grant application is due November 21, 2024. If awarded, these funds would fill the funding gap to support the construction of a purpose-built facility in the City’s northwest quadrant and increase th e geographic distribution and availability of emergency shelter infrastructure.
Environmental Review
On June 22, 2021, the Planning Commission (Commission) adopted the Mitigated Negati ve Declaration and the Mitigation Monitoring Programs and approved the Panorama Park Project, thereby satisfying the requirements of the California Environmental Quality Act Guidelines §15074. At this meeting, the Commission also approved Site Development Permit SDP -2021- 00785, General Plan Amendment GPA -2021-0786, and Rezoning Application RZ -2021-0787.
No further actions are required at this time.

(2) Designate the following authorized account signers : Greg Robinett, Direc tor of Finance/City Treasurer; Bailey Worley, Finance Officer; Tammy Mann, Finance Officer; and Tessa Wayda, Management Analyst; and

Alternative Action

Background/Analysis

Re: 4.7(a)--Authorize opening an Investment Account with California CLASS Page 2
California CLASS is a pooled investment option that was created by California public agencies via a joint exercise of powers agreement in 2022. CLASS is a permitted investment for all California public agencies under California Government Code 6500 and 6509.7. All investments are made in accordance with California Government Code section 53601. CLASS is a pooled cash, short -term reserve portfolio that provides public agencies safety, same day liquidity, competitive yield, and interest paid daily.
California CLASS will afford the City the opportunity to invest idle funds on a short -term basis, if needed, in order to maintain liquidity, meet cash needs, and maximize return. As of the writing of the staff report, California CLASS has a current 7 -day yield of 5.3 5%. Currently the City utilizes Local Agency Investment Funds (LAIF) and California Asset Management Program (CAMP). As of the writing of this report, LAIF is earning 4.6% and CAMP is earning 5.35%.
Currently, the City is holding $78,078,416 with CAMP and $1,070,366 with LAIF. Adding CLASS would give the City another short -term cash management fund allowing the City to maintain more liquidity if necessary and/or choose the option with the highest rate of return.

This i s not a project defined under the California Environmental Quality Act, and no further action is required.

A Sample of The Darfur Contracting Act form is provided on the next page; this form (DGS PD 1) can also be downloaded from the California Department of General Services website.
Effective January 1, 2009, all Invitations for Bids (IFB) or Requests for Proposals (RFP) for goods or services must address the requirements of the Darfur Contracting Act of 2008 (Act). A scrutinized company is a company doing business in Sudan as defined in Public Contract Code section 10476. Scrutinized companies are ineligible to, and cannot, bid on or submit a proposal for a contract with a State agency for goods or services. (Public Contract Code section 10477(a)).
Therefore, Public Contract Code section 10478 (a) requires a company that currently has (or within the previous three years has had) business activities or other operations outside of the United States to certify that it is not a “scrutinized” company when it submits a bid or proposal to a State agency. (See # 1 on the sample Attachment).
The following sample Attachment may be included in an IFB or RFP to satisfy the Act’s certification requirements of bidders and proposers.

The Redding Police Department has four full-time police officer positions for a Park Ranger Unit. The Park Ranger Unit is responsible for patrolling the parks and open space within the City of Redding. The City's large parks and open space areas are focused around the Sacramento River which runs through the heart of the City for just over nine miles. The jurisdiction for enforcement on the river within the city limits is
the responsibility of the Redding Police Department.
Outdoor activities on the Sacramento River have grown
significantly with the City's continued focus on the river, including the Sacramento River trail system (225 miles of trails in Redding), Sundial Bridge, Kayak launch ramp and world renowned trout fishing.
The Department has acquired a 1997 Jetcraft patrol boat from our fire partners for training and beginning implementation of our boating safety program. The four park rangers have attended and obtained POST certification for inland operation. The program has proven very successful to enhance recreation and safety on the river.

7. Three RECREATIONAL BOATING safety issues
This is a Federal Pass-Through ‘Recreational Boating Safety Grant’. The purpose of the grant is to promote boating safety and to decrease the number of accidents, injuries, and fatalities on U.S. waters. Clearly identify three BOATING safety issues that affect recreational boaters in your jurisdiction. Your answer to this question will be referenced throughout this grant application.
1 Safety Equipment/Rescues - The 9 miles of Sacramento River is relatively swift water with inaccessible banks covered in thick bushes. The water is 55 degrees in summer months which regularly causes hypothermic events. There are limited amounts of launch ramp access which causes further delays in response if the boat is not already on the water. The Sacramento River has increased in use for daily recreational users on small watercraft, kayaks, inflatables, etc. during the summer months. The winter months have seen an increased use for recreational fisherman on vessels. Due to the swift river water, safety equipment inspections and education for users is paramount to the safety of the users of the river. Four full-time Park Rangers with river coverage on all days of the week would provide education, visible enforcement, and an overall law enforcement presence.
1. The Department has seen a significant increase in calls for service for river rescues. The Department provides rapid response to river rescues due to the Department's close proximity to the Sacramento River launch facilities. The Department is also working with businesses on the river who have expressed interest in allowing a police patrol boat to be stored on the water for faster response times.
3. 2. Speed Violations - The increase in use has come with an increase in complaints about speed violations on the river. The City has adopted a City Ordinance restricting the speed for powered vessels on the river due to the complaints. The full-time park rangers allow the Department to increase visible enforcement and address citizen complaints.
1. 3. Education – The Department currently does not have any educational programs directed at the use on the river. With so many users, many new and inexperienced, educational programs directed to river safety is important. The ability to have a full-time team on the river and in the parks/open space surrounding the river to educate the public about river safety will reduce accidents, injuries, and fatalities.

11 a. Is this equipment general all-purpose gear? NOTE: person-specific and fitted items will not be funded.
Yes
No
11 b. Describe exactly what is being requested and how this equipment will help mitigate the recreational boating safety issues you identified in Question 7. If the requested quantity is more than one for any item, explain the need for multiple items. (max. 2000 characters)
The equipment requested was based on shortcomings discovered during all rescue operations during summer 2023. Each rescue operation or proactive patrol operation allowed the Rangers to identify this equipment list as they learned what was necessary from trial and error.
The Redding Police Department has one operational jet boat to promote recreational education, safety and rescue operations. The program was initiated during the spring of 2023. Since starting the program, the boat operators had the opportunity take part in numerous community events, proactive patrols to promote recreational safety and rescue operations. Many of the operations were joint operations with allied agency who have an established boating unit. During all operations, the Departments boating safety officers identified a list of necessary equipment to help achieve successful operations. This equipment will properly outfit the boat removing the need to call allied Date: 09/05/2024 Contract # C24L0601, City of Redding Police Department, Boating Safety and Enforcement Equipment Grant - FY 2024 / 25

11 c. Describe any negative impacts to boating safety and/or boating enforcement if your agency does not receive its requested grant award.
If the funding is not awarded, the Redding Police Department will need to continue relying on allied agencies to respond to emergencies on the Sacramento River. This poses a danger to those in need on the water since the allied agency does not have a boat located on the river. They have their boats in other waterways in the area. If the Redding Police Department has all of the needed equipment, the response time can be very quick even if the boat isn't already on the water because of close proximty to the river. The equipment also addressed officer safety on the water. Without the equipment, the officers put themselves at risk whenever they need to perform rescue operations. Equipment such as waders, ropes PFD go a long way in keeping officers safe. 11 d. Classify this request
Classify this request by choosing one of the following options and present a strong justification for the request
"Critical" (operations would cease without it)
"Increased efficiency" (if it would save staff time, identify how much time) "Convenience" (it would make life a little easier)
"Protection" of existing equipment (ex: shade tents, hoists to get the vessels out of the water, etc. to extend longevity)
Justify your classification of this request. (max. 300 characters) With out the equipment, operations on the river will not be as effective and possibly could delay response time Date: 09/05/2024 Contract # C24L0601, City of Redding Police Department, Boating Safety and Enforcement Equipment Grant - FY 2024 / 25

Yes
No
If yes, what percentage can you supplement? 10
11 f. What other capabilities exist in your region for this equipment? Justify why it is not feasible to borrow this equipment from a neighboring agency.
The Shasta County Sheriff's Office (SCSO) has a boating safety unit to patrol numerous waterways in the county.
The portion of the Sacramento River within the the city limits runs is the Redding Police Department's jurisdiction.
Since SCSO boating unit keep their boats on other waterways, it takes time to deploy them. This delays response to emergencies and put lifes in jeopoardy.
11 g. How and why was this particular model selected? Explain if this is standard equipment or do you need something specialized for your waterbody to meet your agency's needs? List less expensive models considered and explain why they are not being requested. List other funding sources available to your agency that could be used to purchase or partially purchase this equipment.
The equipment selected is the equipment needed to safely and effeceintly operate the boats. The Redding Police Department will ensure that the equipment purchased will be the proper equipment at the best price available.

Re: 9.11(f)--Emergency Repair and Replace Substandard Sewer Pipe and Failing Pavement on Placer St. Page 2
Alternative Action
The City Council (Council) may choose to not authorize the award of an emergency contract, and instead have staff prepare plans and specifications to award a contract to the low bidder in accordance with state and local contr acting procedures . Or, Council could provide alterative direction to staff.
Background/Analysis
On April 1, 2024, Council voted to enter into a Contract Amendment, Settlement Agreement and Release with the contractor for the Magnolia Area Sewer Improvem ents Phase 1 project. This settlement agreement was partially due to the contractor’s refusal to make required repairs to substandard work done on the project. This substandard work has the potential to create public health and safety issues.
Staff has considered repackaging the project plans and specifications for bidding ; however, this process would likely require a minimum of six months in order to obtain an executed contract and ultimately provide a contractor with a notice to proceed. This timeline is unacceptable given the condition of the installed sewer infrastructure and would jeopardize being able to complete all the repair work , including re -paving Placer Street, prior to the onset of winter . In addition, current Magnolia Area Sewer Improvement Phase 1 project site conditions present potential impacts to public health, property and safety. Therefore, staff proposes an emergency contract to replace the substandard sewer pipe and associated infrastructure , failing asphalt concrete and minor associated public health and safety work on Placer Street and within Magnolia Area Sewer Improvements Phase 1 project limits . Staff estimates the work will be complete within four months of commencement of construction activities.
It is noted that the Public C ontract Code (PCC) (Section 20168) provides that the local government’s legislative body may pass a resolution by a four -fifths vote of its members declaring that the public interest and necessity demand the immediate expenditure of public money to safeguard life, health and property. Further, the P CC (Section 22050) provides that “in case of emergency, a public agency, pursuant to a four -fifths vote of its governing body, may repair or replace a public facility, take any directly related and immediate acti on required by that emergency, and procure the necessary equipment, services, and supplies for those purposes without giving notice for bids to let contracts.”
It is in the public’s interest and necessity to repair the sewer system, pave Placer Street and repair or replace other associated minor items of work immediately to ensure protection of the public’s health, safety and personal property occurs.
The Resolution has been approved as to form by the City Attorney.
Environmental Review
Staff has determined that the project is exempt from review under the California Environmental Quality Act Guidelines, pursuant to Section 15269(b) – Emergency Projects. Section 15269(b) includes emergency repairs to publicly and privately -owned service facilities neces sary to maintain service essential to the public health, safety, or welfare. The emergency repair and replacement will occur in areas of previous disturbance, and the repairs are necessary to maintain service essential to public health.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING TO
AUTHORIZE THE CITY MANAGER TO AWARD AN EMERGENCY
CONSTRUCTION CONTRACT TO REPAIR AND REPLACE SUB-
STANDARD SEWER PIPE AND FAILING ASHPHALT CONCRETE
PAVEMENT ON PLACER STREET
WHEREAS, Public Contract Code section 22050 and Redding Municipal Code 4.22.120(A) provide that, in the case of emergency, a public agency may repair or replace a public facility, take any directly related and immediate action required by that emergency, and procure the necessary equipment, services, and supplies for those purposes without giving notice for bids to let contracts; and
WHEREAS, on April 1, 2024, Council voted unanimously to enter into a Contract Amendment, Settlement Agreement and Release regarding the Magnolia Area Sewer Improvements – Phase I project; and
WHEREAS, portions of the underground sewer improvements constructed as part of the Magnolia Area Sewer Improvements – Phase I project were not constructed in accordance with the contract documents; and
WHEREAS, proper sewer infrastructure is critical to public health; and
WHEREAS, if not repaired immediately, the improperly installed sewer infrastructure has a high potential for failure during high-flow periods, winter, potentially ultimately causing significant disruptions in service, failures and damage to associated public and adjacent private infrastructure; and
WHEREAS, Placer Street is a primary arterial with moderate traffic volumes and the asphalt concrete pavement is in a failing condition as a result of longitudinal and transverse sewer trench pavement patches within the roadway section presenting a public safety concern; and
WHEREAS, a competitive solicitation for bids is anticipated to require six (6) months and would further delay the needed repairs to prevent sewer blockages, sink holes and further damage to the public and private infrastructure until 2025; and
WHEREAS, continued pavement failure and blockage of the sewer conveyance system would threaten the safety and property of roadway users and persons nearby; and
WHEREAS, isolation of the impacted area so that the delay due to competitive bidding could be accommodated would not mitigate or eliminate the threat to persons and property;
NOW, THEREFORE, BE IT RESOLVED THAT:
1. The City Council of the City of Redding finds that the recitals set forth above are true and correct and are hereby adopted as findings of fact.
2. The public interest and necessity require the immediate expenditure of public money to restore the sewer conveyance system to full capacity, protect the public health, safety and welfare, and prevent further damage to the roadway.

Recommendation
Adopt Resolution, effective September 29, 2024, approving an amendment to the Red ding Independent Employees’ Organization - Supervisory/Confidential Unit Exempt Employee Schedule of Classifications and Salary Ranges to increase the salary for the Wastewater Laboratory Supervisor classification.
Fiscal Impact
The estimated cost assoc iated with this recommendation ranges between approximately $12,637 and $17,795 annually, including salary and benefits.
Alternative Action
City Council could decline to approve the resolution and the salary for the Wastewater Laboratory Supervisor classification would remain unchanged. Alternatively, the City could look into options to contract the Laboratory Technical Manager work out to a local vendor . This option is costly.
Background/Analysis
The Clear Creek Wastewater Treatment Plant (CCWTP) lab serves as a state -accredited testing facility for both of the City’s wastewater treatment plants and is certified by the State of California to perform required operational and regulatory testing.

Report to Redding City Council September 25, 2024
Re: 4.15(a)--Wastewater Laboratory Supervisor Class Change & Salary Increase Page 2
On January 1, 2021, the State of California implemen ted the transition to the standards from The NELAC Institute (TNI), which required laboratories to start implementing changes necessary to comply with a certain set of standards. These requirements are designed to ensure that wastewater laboratories in Cal ifornia operate with high standards of accuracy, reliability, and environmental responsibility.
In addition, there are certain staffing requirements that must be included to meet the required standards, including the requirement to have a Laboratory Dire ctor, Technical Manager, and Quality Assurance Officer. In 2021, the City of Redding created the Laboratory Supervisor position to absorb these roles and provide oversight to the wastewater laboratory. As this position is required for all environmental lab oratories within the state of California, it is a very competitive position with a certain set of skills as well as a specific area of expertise and certification.
Since February 2024, the City has conducted three failed recruitments and completed target ed advertising with enhanced social media posts only to receive no qualified applicants. Staff completed a salary and benefits study and has found that the City of Redding compensation package is substantially behind all of those compared. Staff recommends increasing the salary by 15 percent to be more competitive , which is important as this position is required for all environmental laboratories in California.
As stated above, the duties associated with the Wastewater Laboratory Supervisor position (Laboratory Director, Technical Manager and Quality Assurance Officer) are required by regulation. Since the City has been unable to fill the Wastewater Laboratory Supervisor position, Public Works has had to contract with a qualified consultant to perform dutie s of the Wastewater Laboratory Supervisor in order to maintain our State accreditation.
In addition to increasing the salary for the Wastewater Laboratory Supervisor position, the classification specification will be amended to recognize other qualifyin g experience in order to allow for a wider group of candidates which meet the job requirements and potentially increase the size of the applicant pool. Additionally, Public Works plans to transfer this position to the Wastewater Administration Division and have the position report directly to the Municipal Utilities Manager to reduce the potential conflict of interest of the plant supervisor having supervisory influence over the quality control of the laboratory.
The proposed changes have been discussed wi th, and have the support of, the Redding Independent Employees’ Organization – Supervisory/Confidential Unit.
Environmental Review
This is not a project defined under the California Environmental Quality Act, and no further action is required.
