C723MEM012. DOC This memorandum addresses the change in Level- of-Service (LOS) for the intersections within the Shastina Ranch Traffic Impact Study (TIS) study area resulting from the removal of project- associated industrial trips segment of Churn Creek Road east of the I-5interchange. The Shastina Ranch project contains both residential and light industrial land uses. The elimination ofindustrial trips attributed to the Shastina Ranch project results in a decrease of 2,632 daily, 343 AM peak, and 360 PM peak hour trips, based on the trip generation estimates for the proposedproject zoning contained in Table 4.11-7 of the EIR. The absence of light industrial trips corresponds to a37%, 50%, and 44% reduction in project trip volumes for the daily, AM peak, and PM peak hour basis. As shown in Tables 1 and 2, the reduction in delay at Intersections 9 and 10 are such that mitigation is still required.

According to the EIR, "If an intersection or roadway facility is significantly impacted by the proposed project for short-term conditions, and theproject's
pro-rata share is equal to or above twenty
five (25)percent, then the project will be required to construct the necessary improvements. If an intersection orroadway facility issignificantly impacted bythe proposed project (as defined in No. 1above) for existing plus approved project conditions, andthe project' s pro- rata share is belowtwenty five ( 25)percent, then the project will be required topay their pro- rata share ofthe cost of constructing these improvements. Full mitigation forthe project is assumed bypayment ofthe project' s Traffic Impact Fee and the City will ensure that impacts are reduced toaless than significant level through ongoing implementation of the
Capital Improvement Plan ( CIP). " The volumes at Intersections 9and 10, with project industrial development, aresuch that the project' spro- rata share is1% ( 27.464 / (2,971-1,257)). Withoutindustrial development, the pro. ject's pro- rata share 17. is 2% ( 259 / (2,766-1,257)). Therefore, because the project' s impact on the deficient intersections is less than 25%, the project should be required to pay their pro-rata share ofthe cost of constructing these improvements rather than berequired

CITY OF REDDING

REPORT TO THE CITY COUNCIL
Recommendation
Accept update regarding the Emergency Repair and Replacement of Substandard Sewer Pipe and Failing Asphalt Concrete Pavement on Placer Street Project and, in accordance with Public Contract Code Section 22050(c)(1), make a determination by a four-fifths vote that there is a need to continue the emergency work.

Fiscal Impact
The Emergency Repair and Replacement of Substandard Sewer Pipe and Failing Asphalt Concrete Pavement on Placer Street Project (Project) costs will be funded by Public Works’ Wastewater, Water, and Streets Divisions. The updated, estimated total project cost of the repairs is $3,405,000.

Alternative Action
The City Council (Council) may choose not to accept the project status report and provide further direction to staff.

Background/Analysis
On May 7, 2024, Council adopted an emergency resolution for the project and authorized the negotiation of an emergency public works contract. Cox & Cox Construction (Contractor) completed all underground repairs at all locations by August 30, 2024, and also completed repaving of Placer Street on September 9, 2024. Additionally, the contractor has continued to complete the remaining items for the project - restriping of Placer Street on September 27, 2024, and the raising of manhole and valve lids along Placer Street on October 16, 2024. The remaining work to be performed includes, new sign installation at various locations along Placer Street and minor punch list items which are anticipated to be completed by the end of October 2024, with final project closeout before the end of the calendar year.

The below table provides further details of the contractor’s progress based on the number of MEETING DATE: November 5, 2024

CITY OF REDDING

REPORT TO THE CITY COUNCIL
Recommendation
Authorize the following actions relative to the Emergency Repair and Replacement of Substandard Sewer Pipe and Failing Asphalt Concrete Pavement on Placer Street Project (Project):
(1) Adopt Resolution, by not less than four-fifths affirmative vote, authorizing the City Manager to negotiate and award an emergency public works contract for the Project in an amount not to exceed $2,000,000;
(3) Authorize the City Manager, or designee, to approve construction contingency amounts up to a total of $300,000;
(4) Authorize the City Manager, or designee, to approve construction management and inspection amounts up to a total of $175,000; and
(5) Find that the Project is exempt from review under the California Environmental Quality Act Guidelines, pursuant to Section 15269(b) – Emergency Projects.

Fiscal Impact
The estimated Emergency Repair and Replacement of Substandard Sewer Pipe and Failing Asphalt Concrete Pavement on Placer Street Project (Project) total cost is $2,475,000. These costs include construction, construction contingency and staff time for construction management and inspections. The project will be funded with remaining Magnolia Area Sewer Improvements Phase 1 funds. Including withheld retention, liquidated damages and uncompleted work items which is approximately $2,160,000. Supplemental funding of $315,000 will come from the Wastewater, Water and Streets Division’s Fiscal Year 2023-24 budgets which have sufficient funds appropriated.

Re: 9.11(f)--Emergency Repair and Replace Substandard Sewer Pipe and Failing Pavement on Placer St. Page 2
Alternative Action
The City Council (Council) may choose to not authorize the award of an emergency contract, and instead have staff prepare plans and specifications to award a contract to the low bidder in accordance with state and local contracting procedures. Or, Council could provide alterative direction to staff.

Background/Analysis
On April 1, 2024, Council voted to enter into a Contract Amendment, Settlement Agreement and Release with the contractor for the Magnolia Area Sewer Improvements Phase 1 project. This settlement agreement was partially due to the contractor’s refusal to make required repairs to substandard work done on the project. This substandard work has the potential to create public health and safety issues.

Staff has considered repackaging the project plans and specifications for bidding; however, this process would likely require a minimum of six months in order to obtain an executed contract and ultimately provide a contractor with a notice to proceed. This timeline is unacceptable given the condition of the installed sewer infrastructure and would jeopardize being able to complete all the repair work, including re-paving Placer Street, prior to the onset of winter. In addition, current Magnolia Area Sewer Improvement Phase 1 project site conditions present potential impacts to public health, property and safety. Therefore, staff proposes an emergency contract to replace the substandard sewer pipe and associated infrastructure, failing asphalt concrete and minor associated public health and safety work on Placer Street and within Magnolia Area Sewer Improvements Phase 1 project limits. Staff estimates the work will be complete within four months of commencement of construction activities.

It is noted that the Public Contract Code (PCC) (Section 20168) provides that the local government’s legislative body may pass a resolution by a four-fifths vote of its members declaring that the public interest and necessity demand the immediate expenditure of public money to safeguard life, health and property. Further, the PCC (Section 22050) provides that “in case of emergency, a public agency, pursuant to a four-fifths vote of its governing body, may repair or replace a public facility, take any directly related and immediate action required by that emergency, and procure the necessary equipment, services, and supplies for those purposes without giving notice for bids to let contracts.”
It is in the public’s interest and necessity to repair the sewer system, pave Placer Street and repair or replace other associated minor items of work immediately to ensure protection of the public’s health, safety and personal property occurs.

The Resolution has been approved as to form by the City Attorney.

Environmental Review
Staff has determined that the project is exempt from review under the California Environmental Quality Act Guidelines, pursuant to Section 15269(b) – Emergency Projects. Section 15269(b) includes emergency repairs to publicly and privately-owned service facilities necessary to maintain service essential to the public health, safety, or welfare. The emergency repair and replacement will occur in areas of previous disturbance, and the repairs are necessary to maintain service essential to public health.

A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF REDDING TO

AUTHORIZE THE CITY MANAGER TO AWARD AN EMERGENCY
CONSTRUCTION CONTRACT TO REPAIR AND REPLACE SUBSTANDARD SEWER PIPE AND FAILING ASHPHALT CONCRETE

PAVEMENT ON PLACER STREET
WHEREAS, Public Contract Code section 22050 and Redding Municipal Code 4.22.120(A) provide that, in the case of emergency, a public agency may repair or replace a public facility, take any directly related and immediate action required by that emergency, and procure the necessary equipment, services, and supplies for those purposes without giving notice for bids to let contracts; and WHEREAS, on April 1, 2024, Council voted unanimously to enter into a Contract Amendment, Settlement Agreement and Release regarding the Magnolia Area Sewer Improvements – Phase I project; and WHEREAS, portions of the underground sewer improvements constructed as part of the Magnolia Area Sewer Improvements – Phase I project were not constructed in accordance with the contract documents; and
WHEREAS, proper sewer infrastructure is critical to public health; and WHEREAS, if not repaired immediately, the improperly installed sewer infrastructure has a high potential for failure during high-flow periods, winter, potentially ultimately causing significant disruptions in service, failures and damage to associated public and adjacent private infrastructure; and WHEREAS, Placer Street is a primary arterial with moderate traffic volumes and the asphalt concrete pavement is in a failing condition as a result of longitudinal and transverse sewer trench pavement patches within the roadway section presenting a public safety concern; and WHEREAS, a competitive solicitation for bids is anticipated to require six (6) months and would further delay the needed repairs to prevent sewer blockages, sink holes and further damage to the public and private infrastructure until 2025; and
WHEREAS, continued pavement failure and blockage of the sewer conveyance system would threaten the safety and property of roadway users and persons nearby; and WHEREAS, isolation of the impacted area so that the delay due to competitive bidding could be accommodated would not mitigate or eliminate the threat to persons and property; NOW, THEREFORE, BE IT RESOLVED THAT:

1. The City Council of the City of Redding finds that the recitals set forth above are true and correct and are hereby adopted as findings of fact.

2. The public interest and necessity require the immediate expenditure of public money to restore the sewer conveyance system to full capacity, protect the public health, safety and welfare, and prevent further damage to the roadway.

Report to Redding City Council October 31, 2024
Re: 4.11(f)--Award Water Main 2024 Improvement Project Page 2 Project cost components are estimates and some shifting of the project development, construction management, and construction contingency funds may be necessary to balance the project within the approved budget.

Alternative Action
City Council may choose not to award the bid for the project and provide staff with alternate direction. Without this project, there is greater potential for increased maintenance costs, a decrease in reliability and an increased risk of water main breaks for the City of Redding (City) customers.

Background/Analysis
The City's water system includes approximately 2.98 million feet (565 miles) of conveyance and distribution pipelines of various pipe materials and sizes ranging from 1-inch to 48-inch.

Assessments of the City’s water distribution system indicate that the older steel, asbestos and cast-iron pipelines have had the highest rates of failure in recent years. To reduce pipeline failures and maintenance costs and to improve reliability to its customers, the Water Utility has focused on replacing older steel, cast-iron and asbestos piping in areas where breaks have occurred. This project will replace over 11,000 feet of aging steel, asbestos and cast-iron water mains, 85 water services, 18 fire hydrants and acquire any necessary easements. These mains have reached the end of their service life and have had several breaks in recent years that the Water Utility has repaired. This project will replace the old piping with new polyvinyl chloride (PVC) and ductile iron piping to reduce future maintenance and provide reliable service in these areas for the foreseeable future.

Attached is a tabulation of bids received and opened on October 17, 2024, for construction of the project. The low bid in the amount of $3,378,220.50 was received from Cox & Cox Construction, Inc., of Redding, California. The engineer's estimate was $3,114,025. Total project development costs for this project are estimated to be $521,300. Project development costs include engineering, surveying, right-of-way, environmental, and consultant services for the project.

Environmental Review
Staff has determined that the project is categorically exempt from environmental review under California Environmental Quality Act Guidelines, pursuant to Sections 15301 - Existing Facilities, 15302 – Replacement or Reconstruction, and 15305 – Minor Alterations in Land Use Limitations. Class 1 exemptions include the minor alteration of existing public structures and facilities. Class 2 exemptions consists of replacement or reconstruction where the new structure will be located on the same site and will have substantially the same purpose and capacity. Class 5 exemptions consist of minor alterations in land use limitations, which do not result in any changes in land use or density. The existing utilities will be replaced to provide reliable service that meets public health and safety standards. The project will be located in the right-of-way and will result in a negligible expansion of use. The action area does not have significant values for wildlife habitat or other environmental resources and the project has no potential to have a significant effect on the environment.

Council Priority/City Manager Goals

Re: 4.11(g)--Award BN No. 5475 Old Oregon Trail Shoulder Widening Page 2 Cost Summary
Item Estimated
Project Development Costs $1,580,000
Construction Contract + Contingency $2,654,655
Contract Administration, Inspection, Testing $454,336
Additional City Manager Authority $50,000
Total Project Costs $4,738,991
Project Budget $4,739,000
Project cost components are estimates and some shifting of the project development, construction management, and construction contingency funds may be necessary to balance the project within the approved budget.

Alternative Action
The City Council (Council) may choose not to award the bid for the project and provide staff with alternate direction. If the project is not awarded, the road will not be widened, and the hazardous conditions for motorists and cyclists may remain. In addition, the City would be at risk of losing federal funds and may have to reimburse project development funds spent to date.

Background/Analysis
Attached is a project tabulation of bids received and opened on October 3, 2024. The low bid in the amount of $2,354,655 was received from Tullis, Inc. of Redding, California. The engineer’s estimate was $2,555,635. Total project development costs for this project are estimated to be $1,580,000. Project development costs included engineering, surveying, right-of-way, environmental, and consultant services. Project development costs are significantly higher than normal due to extensive cultural environmental resources associated with the project.

The project includes a curve correction as well as geometric improvements including widening of Old Oregon Trail to provide six-foot-wide shoulders along both sides from Paso Robles to Bear Mountain Road. The work will include removal of portions of the existing road, utility relocation, roadway construction, and other miscellaneous items of work. It is anticipated that the project will be completed in summer 2025.

Environmental Review
This action is not a project as defined by the California Environmental Quality Act (CEQA). On February 15, 2022, the Council adopted the Mitigated Negative Declaration and Mitigation Monitoring Program, and approved the Old Oregon Trail Safety Improvement Project thereby satisfying the requirements of the CEQA Guidelines §15074. No further action is required.

On January 21, 2022, Caltrans determined that the project is categorically excluded from review under the National Environmental Policy Act, pursuant to 23 CFR 771.117(c): activity (c)(26) – Modernization of a Highway.

CITY OF REDDING

REPORT TO THE CITY COUNCIL
Recommendation
Authorize the following actions relative to the Old Oregon Trail Safety Improvement Project:
(1) Adopt Mitigated Negative Declaration and Mitigation Monitoring Program; (2) Approve Old Oregon Trail Safety Improvement Project as described, thereby satisfying the requirements of the California Environmental Quality Act (CEQA Guidelines §15074); and
(3) Direct staff to file a Notice of Determination with the Shasta County Clerk’s Office and the State Clearinghouse.

Fiscal Impact
Approval of the project along with adoption of the Mitigated Negative Declaration (MND) and the Mitigation Monitoring Program (MMP) allows the project to move forward to the final design and construction phases. There is no fiscal impact as a direct result of adopting the MND, MMP, and approving the project.

The Old Oregon Trail Safety Improvement Project is estimated to cost $3,200,000. The project is grant funded through the Federal Highway Safety Improvement Program (HSIP) (90 percent) and the Streets Division (10 percent).

Alternative Action
The City Council (Council) could choose to not adopt the MND and the MMP, and not approve the project as described. Without approval, the project would not proceed as a City of Redding (City) project, as it would not be in compliance with the California Environmental Quality Act.

Re: 4.11(e)--Old Oregon Trail Safety Improvement Project Page 2 Background/Analysis
The project area lies in northeast Redding along Old Oregon Trail. Construction will begin approximately 100-feet west of Paso Robles Avenue and extend east to Bear Mountain Road.

The purpose of the project is to improve safety for pedestrians, cyclists, and motorists. The project is needed as this section of roadway has little to no roadway shoulder, and non-motorized access is limited. This section of roadway also has an accident rate that is higher than the statewide average for similar roadways. The project includes earthwork, vegetation removal, drainage modification, utility relocation, fencing and guardrail installation, paving, striping, sign installation, and right of way (ROW) acquisition.

The existing road alignment would be widened to create one standard 12-foot wide lane in each direction with 6-foot wide paved shoulders. A section of roadway would also be realigned to improve a compound curve. Tree removal would be necessary to allow for road widening, and existing culverts beneath the road would be replaced, extended, or abandoned in place as needed.

Utility poles, fire hydrants, and waterlines would be relocated if they conflict with the new roadway improvements. New guardrail would be installed where needed for public safety. Most work would occur within the existing ROW, but some permanent ROW would be needed from adjacent private lands to realign the roadway and improve the curve. A temporary construction easement (TCE) may be needed in one location to allow for culvert extension. Contractor staging areas would be located in existing graveled pullouts along the Old Oregon Trail existing ROW:
one is approximately 0.2 mile south of the southern end of the project’s construction area boundary, and one is approximately 0.1 mile north of the northern-most end of the project area.

Construction would require one-way traffic control, resulting in travel delays of up to 20 minutes. Some portions of the work may require partial roadway closures and traffic detours. It is anticipated that construction would take one season and is planned for 2023.

An Initial Study (IS) was prepared to satisfy the requirements of the California Environmental Quality Act (CEQA). It describes why the project is being proposed and the potential impacts to the existing environment. The IS shows that the proposed project could have a significant effect on biological resources, but with implementation of mitigation measures, those impacts will be reduced to a level considered less than significant. The mitigation measures and conservation measures to be implemented are common practices and include, but are not limited to, biological pre-construction surveys, impact minimization, and erosion control.

Based on the conclusions made in the IS, an MND was prepared. The MND describes the project, including mitigation measures, and makes the determination that there will be no significant effect on the environment provided that the defined mitigation measures are implemented as part of the project. In addition, a Mitigation and Monitoring Program has been written and incorporated into the MND (CEQA Section 21081.6). The MMP will be used by City staff, contractors, agencies, and monitoring personnel during and after the project to ensure effective implementation of the adopted mitigation measures outlined in the MND.

The IS/MND/MMP documents were sent to the State Clearinghouse for a 30-day public review period and distribution to pertinent state agencies. They were sent to local resource agencies, the Shasta County Clerk, and posted on the Public Works Department website. A public notice was also sent to landowners in the vicinity of the project and posted in the local newspaper. One comment letter was received during the public comment period. A response to the comment letter has been prepared and is attached to the final MND.

Re: 4.11(e)--Old Oregon Trail Safety Improvement Project Page 3 The City of Redding is the lead agency for the project pursuant to CEQA. As the lead CEQA agency, the City Council is authorized to adopt the MND per Redding Municipal Code Section §18.24.070.E and state law. Upon adoption of the MND and approval of the project by the City Council, a Notice of Determination will be filed with the Shasta County Clerk’s Office and the State Clearinghouse, completing the environmental review process. The IS/MND is available in the City Clerk’s office for review and is currently available online at https://www.cityofredding.org/departments/public-works/environmental-management.

CITY OF REDDING

REPORT TO THE CITY COUNCIL
Recommendation
Authorize and approve the following actions related to the City of Redding California Street Bikeway Project:
(1) Approve Maintenance Agreement with the California Department of Transportation; and (2) Authorize the City Manager, or designee, to execute the Maintenance Agreement and any future amendments.

Fiscal Impact
The California Street Bikeway Project (Project) is a $4.53 million project funded through a combination of funds from the City of Redding (City) and the California Department of Transportation (Caltrans).

This Project Specific Maintenance Agreement (Maintenance Agreement) obligates the City to accept operational and maintenance responsibilities for the location and improvements indicated within the proposed maintenance agreement. Maintenance responsibility will commence following construction of the proposed bikeway improvements. These planned maintenance obligations are estimated to be less than $5,000 per year and will be funded by the Public Works’ Streets Division Maintenance fund.

Alternative Action
The City Council (Council) may choose not to approve the maintenance agreement or authorize the City Manager to sign the agreement with Caltrans. In such case, the Council could provide staff with an alternate direction. Without this agreement, Caltrans will not issue an encroachment permit to the City for the project, and the contractor will not be able to begin construction in the Caltrans right-of-way until a maintenance agreement is executed. This would also jeopardize California Department of Housing and Community Development’s Affordable Housing and Sustainable Communities Program grant funding for the project.

SUBJECT: 4.11(h)--Approve Maintenance Agreement with California Department of Transportation for California Street Bikeway Project and Authorize the City Manager to Execute Agreement.

Michael Webb, Public Works
Director
Packet Pg. 366
Report to Redding City Council October 30, 2024
Re: 4.11(h)--Maintenance Agreement with Caltrans Page 2 Background/Analysis
A maintenance agreement establishes a generalized plan for the location of shared improvements in the Caltrans right-of-way and outlines the general responsibilities for right-of-way acquisition, construction, and maintenance of completed facilities.

This maintenance agreement will incorporate improvements to be constructed with the project.

The project proposes to construct a separated two-way bikeway, also referred to as a cycletrack, on California Street from Yuba Street to Division Street. The project scope of work includes constructing curbs, curb ramps, asphalt concrete paving, intersection signal installations, storm drainage improvements, pavement markings, and other miscellaneous items of work. The City will need a Caltrans encroachment permit to complete the work in the state right-of-way on California Street from Yuba Street to Tehama Street. Caltrans will not issue an encroachment permit for the project until a maintenance agreement is executed.

The limits of the agreement and the generalized plan are shown on the attached maintenance agreement Exhibit A.

On June 18, 2024, the Council authorized a Cooperative Agreement with Caltrans approving its contribution to the funding for the project.

The maintenance agreement is approved as to form by the City Attorney and will be executed by Caltrans following the City’s approval.

Dear Mr. Trent,
The purpose of this letter is to certify that the CITY is self-insured and self-funded covering third-party claims arising out of its general operations (for example, commercial general liability and automobile liability insurance). Further the CITY is self-insured covering workers’ compensation claims and has received the consent of the State Department of Industrial Relations to do so.

Each fiscal year, as a part of its budgetary process, the CITY appropriates funds specifically to satisfy valid third-party claims and workers’ compensation claims, which may be brought against the CITY.

The CITY certifies its self-insured, general liability coverage for bodily injury liability and property damage liability, meets the required coverage amounts in section

6.1 (INSURANCE) of the Maintenance Agreement, specifically general liability insurance, coverage of bodily injury liability and property damage liability in an amount of $1 million per occurrence and $2 million in aggregate and $5 million in excess. The CITY further represents that regarding any claims made in connection with the Maintenance Agreement by the STATE, the STATE will be first-in-line regarding the reserved, self-insured amounts.

If you need any additional information regarding this letter, please direct those inquires through my office.

Sincerely,

FINANCE MANAGER

Re: 4.11(d)--Resolution-Cooperative Agreement CA Street Bikeway Project Page 2 Alternative Action
The City Council may choose not to authorize the Mayor to execute the Cooperative Agreement with Caltrans. This alternative will not allow the City to receive funding from Caltrans. The City will have to contribute more funding or identify additional funding sources to deliver the Project to construction. In addition, further delays beyond December 2024 in identifying funding would jeopardize loss of previously spent and remaining California Department of Housing and Community Development’s (HCD) Affordable Housing and Sustainable Communities (AHSC) Program grant funding.

Background/Analysis
In October of 2016, HCD awarded the City and K2 Development Company, Inc., (K2) AHSC Program funding in the amount of $20 million for the Redding Downtown Loop and Affordable Housing (RDLAH) Project located at 1551 Market Street. The RDLAH Project included construction of a four-story, mixed-use building and a subterranean parking facility. In addition, the RDLAH Project included reestablishment of the formerly abandoned street rights-of-way and reconstruction of pedestrian and bicycle-friendly streets along portions of Market, Yuba, and Butte Streets known as the Downtown Streets Circulation (DSC) Project; as well as constructing a separated two-way bikeway on California Street known as the California Street Bikeway Project. The RDLAH and DSC Projects were completed in February 2021.

The Bikeway Project proposes to construct a separated two-way bikeway, also referred to as a cycletrack, on California Street from Yuba Street to Division Street. The Bikeway Project work includes constructing curbs, curb ramps, asphalt concrete paving, intersection signal installations, storm drainage improvements, pavement markings, and other miscellaneous items of work.

The Bikeway Project has presented many design challenges not anticipated in the grant application process including complications using standard traffic control devices (signals) for the operation of the cycletrack with motor vehicles, identification of excessive pavement shoulder cross slopes and drainage constraints. In addition, the challenge of constructing a cycletrack in Caltrans right-of-way for the first time in Caltrans District 2 has required significantly more collaboration and engineering coordination.

Along with the increased design challenges, the Bikeway Project was initially underfunded for construction. Staff has been able to secure additional construction funding in the amount of $2.87 million from Caltrans for construction in the state right-of-way to supplement funds for the project. The City has been working with Caltrans on the attached construction funding Cooperative Agreement.

In addition, the City and Caltrans are working on a separate project oversight cooperative agreement required by Caltrans for project review and issuance of an encroachment permit. This is an administrative agreement and within the City Manager’s agreement signature authority.

However, staff is also requesting Council to authorize the City Manager to execute the oversight cooperative agreement.

The cooperative agreement for the construction funding has been approved to form by the City Attorney.

CITY OF REDDING

REPORT TO THE CITY COUNCIL
Recommendation
Authorize and approve the following actions relative to Consulting and Professional Services Contract (C-7355) for the Girvan Road Bridge at Olney Creek Replacement Project:
(1) Approve the Fifth Amendment to the Consulting and Professional Services Contract (C7355) with Morrison Structures, Inc. in the amount of $301,848.28 for a total not to exceed fee of $1,101,484.11;
(2) Authorize the City Manager, or designee, to execute the Amendment; and (3) Authorize the City Manager, or designee, to approve additional contract amendments not to exceed $40,000.

Fiscal Impact
The total project cost of the Girvan Road Bridge at Olney Creek Replacement Project (Project) is estimated at approximately $8.5 million dollars. The Project is 88.53 percent funded by the Federal Highway Bridge Program, with the remaining 11.47 percent being funded by the City of Redding’s (City) Transportation Impact Fee fund or the Streets Division Maintenance fund. The total project cost includes a consultant contract with Morrison Structures Inc., (Morrison) to provide bridge design services through construction. This amendment will increase Morrison’s consultant contract by $301,848.28.

See table below for a summary of amended costs to Morrison’s consultant contract (table only includes amendments that adjusted the contract amount).

SUBJECT: 4.11(i)--Approve the Fifth Amendment to Consulting and Professional Services Contract (C-7355) for the Girvan Road Bridge at Olney Creek Replacement Project Michael Webb, Public Works
Director
Packet Pg. 381
Report to Redding City Council October 31, 2024
Re: 4.11(i)--Approve the Fifth Amendment to Contract (C-7355) Page 2 Alternative Action
The City Council (Council) may choose not to authorize the amendment and provide staff with an alternate direction. Without the proposed amendment, Morrison will not be able to complete the bridge design or provide services during the construction phase of the project. This alternative would delay or likely eliminate the replacement of this bridge and jeopardize federal funding.

Background Analysis
In August 2017, an engineering and environmental services contract was executed with Morrison for the project. In December 2019 Council approved an amendment to increase the project funding for additional environmental tasks. In addition, in March 2020, and again in December 2022, administrative amendments were executed to update the end date of the contract. At that time, the project had almost completed the environmental phase and the consultant began working on obtaining necessary temporary construction easements and the final design.

Over the course of the Preliminary Studies Phase and the Preliminary Engineering and Design for the project there has been a substantial increase in professional services required, mostly associated with the extended project duration and environmental/cultural concerns. As the consultant is approaching the end of the environmental phase they have estimated that the project will extend until 2027 for construction completion. For Morrison to continue to provide the services originally outlined in the contract, as well as the additional environmental studies being required by the California Department of Transportation (CalTrans), throughout design, bidding and construction, additional funds are required as requested in this amendment. The amendment has been approved as to form by the City Attorney.

The Girvan Road bridge was constructed in 1960 and is currently designated as “functionally obsolete” per Caltrans’ Bridge Inspection Reports. This designation is largely due to the amount of traffic using the bridge and the lack of shoulders, pedestrian facilities, and turning movement capacity. The Project will replace the existing 32-foot-wide 2-lane bridge with a 54-foot-wide bridge that includes two 12-foot travel lanes, two 8-foot shoulders, and two 7-foot Type 26 sidewalk barriers. These improvements meet the requirements of both the American Association of State Highway and Transportation Officials and the City.

Environmental Review
This action is not a project as defined by the California Environmental Quality Act (CEQA). As the environmental studies and design progress staff will prepare CEQA documentation for future Council approval.

Council Priority/City Manager Goals
This is a routine operational item.

CITY OF REDDING

REPORT TO THE CITY COUNCIL
Recommendation
Ratify the Second Amendment to Consulting and Professional Services Contract (C-7355) with Morrison Structures, Inc. in the amount of $302,397, for a total not to exceed fee of $799,636, for engineering services for the Girvan Road Bridge at Olney Creek Replacement Project; and authorize the Mayor to execute the amendment.

Fiscal Impact
The Girvan Road Bridge Replacement project (project) is 88.53 percent funded by the Federal Highway Bridge Program (HBP), and the remaining 11.47 percent is funded by the City of Redding’s (City) Transportation Impact Fee (TIF) fund. The total project cost is estimated at approximately $3.3 million to $4.3 million dollars.

Alternative Action
The City Council (Council) may choose to not authorize the Mayor to execute this contract amendment. This alternative would delay or eliminate construction of the replacement bridge and jeopardize federal funding.

Background/Analysis
The Girvan Road Bridge over Olney Creek was constructed in 1960 and, per California Department of Transportation (Caltrans) bridge inspection reports, is currently designated as functionally obsolete. The project will replace the existing 32-foot-wide 2-lane bridge with a 54- foot-wide bridge that includes two 12-foot lanes with eight-foot shoulders and seven-foot-wide Type 26 sidewalk barriers on each side. These improvements meet the requirements of both the American Association of State Highway and Transportation Officials (AASHTO) and the City.

Re: 4.11(d)Amendment to Contract C7355 Girvan Road Bridge over Olney Project Page 2 The total project cost for replacing the Girvan Road Bridge is expected to be $3.3 million to $4.3 million, which includes design, environmental clearance and permitting, right-of-way, construction and contingencies, and construction management.

In August 2017, an engineering and environmental service contract was executed with Morrison Structures, Inc. During the course of environmental field studies, Caltrans determined that the project would require subsurface testing, laboratory analysis, Tribal consultation, Native American monitoring, and specialized cultural report preparation for compliance with the National Environmental Policy Act (NEPA).

On February 9, 2018, the first amendment was executed for an administrative update. The consultant’s environmental sub-consultant company changed ownership from North State Resources to Stantec.

Staff is requesting approval of the second amendment which would provide additional funding for environmental tasks in the contract including:
Additional project management associated with cultural resource findings and increased complexity of new technical studies to support Section 106 compliance; Additional cultural Section 106 compliance documentation (Phase II Investigation); and Archeological monitoring during construction and changes to the California Environmental Quality Act (CEQA) initial study that will need to be addressed due to cultural resource findings.

CITY OF REDDING

REPORT TO THE CITY COUNCIL
Recommendation
Approve and authorize the following:
(1) Offer Ordinance amending Redding Municipal Code Title 11 (Vehicles and Traffic), Chapter 11.12 (Speed Limits) by amending Section 11.12.010 (Established on Certain Streets) for first reading by title only and waive the full reading; (2) Direct the City Attorney to prepare a summary ordinance, if needed, and authorize the City Clerk to publish the summary ordinance according to law; and (3) Find that the action is categorically exempt from review under the California Environmental Quality Act Guidelines, pursuant to Section 15061(b)(3) – Common Sense Exemption.

Fiscal Impact
There is no direct fiscal impact with amending the Speed Limits Ordinance. Sufficient funds for the staff time to implement the requisite Engineering and Traffic Survey (E&TS) changes are included in the adopted Public Works’ Streets Division’s Fiscal Year 2023-24 budget.

Alternative Action
The City Council (Council) may choose not to adopt the attached ordinance and retain the zones as they were last adopted. The City of Redding Police Department would be restricted on where it could use radar or other electronic devices, and citations would be vulnerable to overturning by the courts based on speed trap laws in accordance with Sections 627 and 40802 of the California Vehicle Code (CVC).

Report to Redding City Council October 30, 2024
Re: 9.11(j)--Ordinance amending RMC Chapter 11.12, Speed Limits Page 2 Background/Analysis
Generally, speed limits between 55 miles per hour (mph) and 25 mph on local roadways may be determined by ordinance of the local authority if the speed zone is justified by an E&TS. Several E&TSs within the City of Redding (City) are approaching expiration and need to be updated to ensure they are enforceable. The process for preparing an E&TS, and the constraints on setting speed limits, is specified in the California Manual on Uniform Traffic Control Devices (CaMUTCD). This process has resulted in staff's recommendation to revise Chapter 11.12 of the Redding Municipal Code (RMC) to set intermediate speed limits that reflect the results of the recently prepared E&TS.

Section 22349 of the CVC establishes maximum speed limits of 65 mph on highways and 55 mph on two-lane undivided highways. CVC Section 22352 establishes prima facie speed limits of 15 mph for rail crossings, sight-obstructed intersections, and alleys, and 25 mph for business and residential districts and school zones. Additionally, CVC Section 22358.8 enables the retaining of a current speed limit, if after completing an E&TS, the local authority finds that the speed limit is still more than is reasonable or safe.

CVC Sections 22357 and 22358 also allow local authorities to declare intermediate speed limits between 55 mph and 25 mph on the basis of an E&TS. Speed zones that are justified by an E&TS allow the Police Department to enforce the limits using radar or laser technology in accordance with CVC Section 40802. This section also requires that the E&TS be reevaluated every seven years if local law enforcement officers are trained in the use of radar or laser equipment. This may be extended to every 14 years if, in addition to the radar training requirements, there are no significant changes in the roadway or traffic conditions.

The methodology for an E&TS is provided in CVC Section 627 and CaMUTCD Section 2B.13.

These sections require local authorities to consider the following when setting speed limits:
• Prevailing speeds;
• Accident records;
• Highway, traffic, and roadside conditions not readily apparent to a driver; • Residential density; and
• Pedestrian and bicyclist safety.

The CaMUTCD and CVC Section 21400(b) require that speed limits normally be set at the nearest five mph increment of the 85th percentile speed, which is defined as the speed at which 85 percent of the traffic travels, or slower. This is the speed traveled by a majority of drivers and it is considered to be reasonable and prudent. The posted speed limit may be reduced by five miles per hour with justification based on a limited set of conditions by a registered professional traffic or civil engineer. A larger reduction would constitute a speed trap. Consequently, some increases in speed limits are being recommended with this update. The CaMUTCD goes on to state that speed limits cannot be set arbitrarily low because they:
• Create violators of the majority of drivers;
• Require constant enforcement;
• Would not command the respect of the public; and
• Generally, result in an increase in collision rates.

Report to Redding City Council October 30, 2024
Re: 9.11(j)--Ordinance amending RMC Chapter 11.12, Speed Limits Page 3 RMC Section 11.12.010 sets forth the various streets, broken into four volumes, where speed limits other than prima facie apply within the City. The Council may amend this chapter to establish reasonable and prudent speed limits. Staff has prepared an updated E&TS Volume 3, as Volume 3 has recently expired. The attached summary (Attachment A) provides a list of the current and proposed speed limits for each of the street segments included in Volume 3 to be updated with this recommended action. In summary, staff is recommending the addition of one street, Meadow View Drive, decreasing the speed limit of three street segments, increasing the speed limit of one street segment and adjusting the boundaries of two street segments. The remaining street segments, including posted speed limits and boundaries, will remain unchanged.

The attached draft ordinance for the Council’s consideration incorporates the recommendations as described above.

Environmental Review
Staff has determined that the action is Categorically Exempt from review under the California Environmental Quality Act (CEQA) Guidelines, per Section 15061(b)(3). CEQA applies only to projects which have the potential for causing a significant effect on the environment. The action has been reviewed and it can be seen with certainty that there is no possibility that the action will have a significant effect on the environment; therefore, the activity is not subject to CEQA Council Priority/City Manager Goals
• This agenda item is a routine operational item.
