PROJECT LOCATION AND EXISTING SITE CONDITIONS
The project site of 8350 South Frankwood Avenue is located on the northern edge of the City of Reedley, just north of East Aspen Drive and east of North Frankwood Avenue. When the application was originally filed with the Community Development Department, Mohammad Jaber was the owner of the parcel. The parcel is currently owned by Nazha Jaber. The existing property includes a single-unit home that is not owner occupied. In the immediate rear of the property is an occupied two-unit accessory dwelling unit. The previous property owner illegally constructed two additional accessory dwelling units without the necessary building permits and inspections. This action required Pacific Gas & Electric to shut power off to all structures until electric defects and dangers were removed from all structures. To date, it is believed the unpermitted accessory dwelling units are still present and are being illegally occupied.

PROJECT DESCRIPTION
The applicant proposes to subdivide the existing parcel located at 8350 South Frankwood Avenue (APN: 363-090-84) into four separate parcels. Future development of the land would require consistency with the current General Plan Planned Plan Use Designations and zoning designations on the site which include High Density Residential and Low Density Residential.

The original application was submitted on December 23, 2021, by Central Valley Engineering & Surveying, Inc., on behalf of Mohammad Jaber of 1811 North Del Altair Avenue. The application required approximately four application resubmittals before finally being deemed complete on January 27, 2023, more than two years after the date the first application was submitted. The core reason the applicant received three deemed incomplete applications pertained to continually not accurately reflecting existing water and sewer utilities on the plan as well as not showing the required roadway improvements, which include East Evergreen Avenue being extended from the easternmost property line to connect to the proposed North East Avenue alignment, and the North East Avenue alignment itself.

With submittal number four, the applicant and their representative have requested to defer construction of the road until proposed Parcel number 4 is developed. At this juncture, the applicant wants to offer dedication of the future roadway to the City of Reedley, but does not want to construct the roads.

City staff rejects the applicant's assertion, and recommends that the Planning Commission's action be upheld. Typically, construction and dedication of required infrastructure such as a roadway is a standard condition of development. At times, such infrastructure may be phased in through the course of a large project. The concern of staff is that Parcel number 4 would remain undeveloped with new and existing neighborhoods continuing to be disconnected.

For the forgoing conclusions, City staff contends that the current proposed subdivision of the parcel, as presented, does not represent the highest and best use of the property for future residential development.

General Plan Consistency
The subject property is located within the boundaries of the 2030 General Plan. The General Plan Planned Land Use designation for the property is High Density Residential and Low Density Residential. High Density Residential allows for a density range of 15-29 dwelling units per acre, and Low Density Residential allows for a density range of 4-8 dwelling units per acre (Reedley 2030 General Plan, page 33).

While the project proposes to subdivide the parcel into four parcels for future residential development, the proposed project does not meet several General Plan Policies. The proposed project is not consistent with the following General Plan Policies:

1. LU 2.6A: New development (residential, commercial and public) shall be designed in a way that creates fully integrated neighborhoods with a variety of land uses arranged so that access by walking or bicycling is possible and encouraged.

2. LU 2.7.6: Ensure that residential development occurs in areas that have sufficient infrastructure to accommodate the density of residential development being proposed.

3. LU 2.7.7: Residential development shall be designed in a manner so that new development is well connected to the surrounding area and to encourage pedestrian and bicycle transportation.

4. LU 2.7.17: High Density residential land uses shall be designed to blend in with the surrounding neighborhoods.

Page 4 of 8 ends

5. LU 2.7.21: Mixing of residential uses, densities and lot sizes shall be encouraged, while maintaining traditional neighborhood values and emphasizing concepts for livable, walkable neighborhoods.

Based on the policies mentioned above, Tentative Parcel Map Application No. 2022-03 is not consistent with the Reedley General Plan.

Zoning Code and Subdivision Ordinance Consistency
The existing parcel has two zone district designations with accompanying General Plan Planned Land Use designations. The property is zoned as RM-2 (Multi-Unit Residential) and R-1-6 (One-Unit Residential). Proposed parcel numbers 1, 2, and 3 are in the RM-2 (Multi-Unit Residential) zone district and parcel number 4 is in the R-1-6 (Single-Unit Residential) zone district.

The RM-2 (Multi-Unit Residential) zone district designation is on the western half of the subject property along North Frankwood Avenue and the R-1-6 (Single-Unit Residential) zone district designation is on the eastern half of the subject property towards North Sunny Lane. The eastern portion of the parcel closest to South Frankwood Avenue is surrounded by property with an R-1-9 (Single-Unit Residential) zone district designation to the south side of the parcel.

Additionally, the western portion of the parcel is surrounded by land to the north that has an RM-2 (Multi-Unit Residential) zone district designation. The easternmost portion of the property is surrounded by multiple parcels that are mostly situated within the built environment and have an R-1-9 (Single-Unit Residential) zone district designation.

Section 11 -2-7 of the Reedley Municipal Code prescribes the findings for the Planning Commission to deny or disapprove a tentative map application. The following findings include:
a. The proposed tentative map is not consistent with the General Plan or any applicable specific plan as specified in Government Code section 65451. b. The design or improvement of the proposed subdivision is not consistent with the General Plan or any applicable specific plan .
c. That the site of the proposed subdivision is not physically suitable for the type of development.
d. That the site of the proposed subdivision is not physically suitable for the proposed density of development.
e. That the design of the proposed subdivision is or the proposed improvements are likely to cause substantial environmental damage or substantially and avoidably injure fish or wildlife or their habitat.
f. That the design of the proposed subdivision or type of improvements is likely to cause serious public health problems.

Page 5 of 8 ends

g. That the design of the proposed subdivision or the type of improvements will conflict with easements, acquired by the public at large, for access through or use of property within the proposed subdivision; provided that the commission may approve the tentative map if it finds that alternate easements for access or use will be provided, and that these will be substantially equivalent to ones previously acquired by the public. This subsection shall apply only to easements of record or to easements established by judgment of a court of competent jurisdiction, and no authority is hereby granted to the commission to determine that the public at large has acquired easements for access through or use of property within the proposed subdivision. h. That the tentative map fails to meet or perform any of the requirements or conditions imposed by the subdivision map act or this title; provided, that such disapproval shall be accompanied by a finding identifying the requirements or conditions which have not been met or performed.

Tentative Parcel Map Application No. 2022-03 is not consistent with Section 11-2-7 because the application is inconsistent with the Reedley General Plan. The lack of roadway connectivity will make parcel numbers 1, 2, and 3 unsuitable for future development, and roadway connectivity will hinge on the development of parcel number 4. With the applicant not agreeing to construct the road, the tentative parcel map application would not be compliant with subsection h. Based on the information provided and the applicant's inability or unwillingness to construct the road described above, Tentative Parcel Map Application No. 2022-03 is defective and the applicant's appeal should be denied.

For the aforementioned reasons, staff recommends that the City Council, through Resolution No. 2023-050, approve Environmental Assessment No. 2023-06, and deny the applicant's appeal and uphold the Planning Commission's action. Should the applicant wish to proceed with the subdivision of the parcel situated at 8350 South Frankwood Avenue, the applicant could submit a new tentative parcel map application (with accompanying fees) for Planning Commission's consideration that includes the construction and subsequent dedication of the roadway alignments mentioned above.

PLANNING COMMISSION REVIEW
Tentative Parcel Map applications are typically acted upon by the Planning Commission. The Planning Commission considered Tentative Parcel Map Application No. 2022-03 at their regular meeting held on June 15, 2023. The public hearing notice was published in the MidValley Times on June 1, 2023 and was mailed to surrounding property owners on June 1, 2023.

Eight residents testified in opposition to the application, and no comments in support of the application were made during the public hearing. The applicant's representative provided a rebuttal of staff's presentation and comments heard from the public. On a 4-0 vote, the Planning Commission approved Resolution No. 2023-14, approving Environmental Assessment No. 2023-06 and denying Tentative Parcel Application No. 2022-03.

The Planning Commission found that the approval of Tentative Parcel Map Application No. 2022-03 would be inconsistent with the goals and objectives of the Reedley General Plan.

Without the required construction and subsequent dedication of the road alignments of North East Avenue and East Evergreen Avenue, the tentative parcel map application would be substandard.

APPEAL AND HEARING PROCEDURE
Pursuant to Reedley Municipal Code Section 11-3-9, within ten days after the action of the Planning Commission, a written appeal can be filed. The applicant filed a timely appeal with the City Clerk that was accepted on Monday, June 26, 2023. It is required that the subdivider and appellant be notified of the date of the appeal hearing, which occurred on June 26, 2023.

It is not required that a notice be sent to surrounding property owners, however City staff chose to do so because the Planning Commission hearing was noticed. Additionally, a public hearing notice for the appeal was published in the Mid-Valley Times on July 6, 2023 and was mailed to surrounding property owners on June 27, 2023.The appeal hearing was scheduled to be heard before the City Council at their July 25th meeting, however the appellant request a continuance to the August 8th Council meeting.

Reedley Municipal Code Section 11-3-9:

The hearing shall be limited to those reasons stated in the written appeal and the notice as the appellant's basis for disapproving or modifying the planning commission's decision or other action. At the hearing, the appellant shall have the burden of presenting to the city council evidence in support of those reasons and the remedy the appellant is requesting. Thereafter, the burden shall shift to those persons opposed to the appeal to present evidence to the city council in support of their positions. Both written and oral evidence may be presented at the hearing.

ENVIRONMENTAL REVIEW
A discretionary action is one that requires the exercise of judgement or deliberation by a public agency in determining whether a project will be approved, or if a permit will be issued.

The approval or denial of a Tentative Parcel Map Application is an example of a discretionary action, which requires environmental review under the California Environmental Quality Act (CEQA).

On February 25, 2014, the City Council certified the Final Environmental Impact Report (SCH No. 2010031106), which was prepared for the General Plan. The EIR provides a comprehensive single programmatic environmental document that will allow the City of Reedley to carry out the proposed project and evaluates direct, indirect, and cumulative impacts of the proposed project, as well as project alternatives in accordance with the provisions set forth in CEQA and the CEQA Guidelines.

Pursuant to Section 15168( c)(2), the City as the lead agency, has determined that the denial of Tentative Parcel Map Application No. 2022-03 would have no effects that were not examined in the program EIR and that no new effects could occur or no new mitigation measures would be required as a result of the addition. Staff provided a comprehensive analysis and review of the proposed amendments to the Reedley Municipal Code, and determined the results to be within the scope of the project described in the Program EIR.

It has also been determined through Environmental Assessment No. 2023-06 that no new effect could occur beyond those identified and analyzed in the Program EIR (SCH No. 2010031106), and that no new mitigation measures are required for this project beyond those set forth in the program EIR (SCH No. 2010031106), pursuant to Section 15168(c)(2).

Therefore, no new environmental document is required for this Project.

ENVIRONMENTAL ASSESSMENT NO. 2023-06
Tentative Parcel Map Application No. 2022-03 pertains to the subdivision of an existing 4.8 acre parcel situated at 8350 South Frankwood Avenue into four parcels ranging from .31 acre to 2.49 acres for future single-unit and multi-unit residential development. The project site is located on the northern edge of the City of Reedley, just north of East Aspen Drive and east of North Frankwood Avenue. The existing General Plan Planned Land Use Designations are High Density Residential on the western half of the subject property along North Frankwood Avenue and Low Density Residential on the eastern half of the subject property towards North Sunny Lane. Staff is recommending that Planning Commission deny the application as presented.

On February 25, 2014, the City Council certified the Final Environmental Impact Report (SCH No. 2010031106), which has been prepared for the General Plan pursuant to the California Environmental Quality Act (CEQA).

Pursuant to Section 15168(c)(2), the City as the lead agency, has determined that denial of the tentative parcel map application would have no effects that were not examined in the program EIR and that no new effects could occur or no new mitigation measures would be required as a result of application denial. Staff provided a comprehensive analysis and review of the denial of the application to the Reedley Municipal Code, and determined the results of the review to be within the scope of the project described in the program EIR.

It has also been determined that no new effect could occur beyond those identified and analyzed in the Program EIR (SCH No. 2010031106), and that no new mitigation measures are required for the review and recommendation to deny the project beyond those set forth in the program EIR (SCH No. 2010031106), pursuant to Section 15168(c)(2),. Therefore, no new environmental document is required for this Project.

TENTATIVE PARCEL MAP APPLICATION NO. 2022-3

To David Harler Jr.:

The submittal of the entitlement application(s) referenced above were reviewed against the City's submittal requirements and were deemed incomplete pursuant to the Permit Streamlining Act.

Revisions and/or additional information to bring the application(s) into substantial compliance with the Community Development Department's submittal requirements must be made before the Department can deem the application complete and continue processing the application. In addition, this application submittal has not been routed to any other department or agency for comment, therefore, no other comments and/or conditions can be provided at this time.

The following items must be addressed before the application can be deemed complete:

1. Tentative Parcel Map (TPM) Comments:
a. TPM does not notate existing water and sewer utilities within the East Avenue Alignment as identified on the City of Reedley's Water Plat Map and Sewer Plat Map. TPM does not notate existing water utilities on Frankwood Avenue as identified on the City of Reedley's Water Plat Map.
b. TPM does not accurately reflect the existing structures on the property. City Planner met with the property owner at the counter on November 15, 2022. The property indicated that one of the structures would be an ADU. c. North East Avenue and East Evergreen Avenue shall be dedicated and fully constructed to City Standard ST-3 (Local Residential Street with Monolithic Sidewalk). Correct note on map. If the applicant insists on their request to only dedicate the road alignment and defer the road construction until future development, City staff will recommend that the Planning Commission deny this project in accordance with Section 11-2-7 of the Reedley Municipal Code. d. Once North East Avenue is dedicated, a new parcel would be created on the southeast corner of North East Ave and E Evergreen Ave. This means that five parcels would be created, which shall require a Tentative Subdivision Map Notice of Incomplete Application

submittal instead of a Tentative Parcel Map submittal. The City disagrees with the applicant's determination that the southeast corner would still be part of Parcel 4.

Once the items listed above are submitted, the Community Development Department will send a followup letter within 30 days indicating whether or not the application(s) will be deemed complete.

Dear respected Council Members:

This letter is to appeal against the decision made on June 15, 2023 by the planning commission.

Our request is to divide an existing 4.8 acer parcel located at 8350 South Frankwood A venue into four parcels and a remainder. Split is intended for the future development of multifamily units and single-family residential units.

As you can see from the map attached, we have included the appropriate information for the future constmction and dedication of the street. We feel that the split of the land should not be contingent on the construction of the street, but such development should be addressed at a sperate time during the planning process of the site. We ask that you take into account the business background we have within the city as good faith that the future development of the property will happen.

I ask that the City Council approve the requested split so we can move forward with the proposed development of the land. Should conditions be required for the approval of the division of the land we are open to comments.

Thank you for your consideration for appeal and look forward to your response.

Sincerely,
.I'

Rodney,
Thank you for calling me back. I have passed the information you provided to me to my team.

They wanted me to stress the fact that we would like for the city to approve a continuance based on the facts the owner won't be able to attend due to a family emergency in Los Angeles.

Please let me know as soon as you find out if City can accommodate an extension to the August 8th meeting.

Kind regards,
Elvia Lopez
