R-TRANSIT SERVICES
(Fees are supplemented by grant funding; therefore, they are not adjusted based on ECI) With the new Measure J funding allocation voted on by WCCTAC, the City of Richmond could be getting more funding. If there is a substantial amount of funding, it would be used to provide later, after hours, and weekend service which has been a request by the community. The proposed farebox fee would prepare Paratransit in the event there is more funding.

* The annual base flat permit fee for a metered space is calculated as the average gross revenue per meter during the most recent completed fiscal year.
**The annual base flat permit fee for vehicles at a time zone(non-metered) space is $40 multiplied by 12 months.

The annual base flat permit fee of a dedicated space for a gas-powered car share vehicle is the annual base permit fee for metered spaces and annual base permit fee for time zone (non-metered) space, when parked at thos respective spaces.

The annual permit fee of a dedicated space for a zero emission powered (ZEV) car share vehicle is based on a 25% discount off the annual base permit free for metered spaces and a 25% discount off th annual base fee for time zone (non-metered) spaces (i.e., equla to 75% of the annual base permit fee).

Re: Initial Fee Analysis for the Housing Division
The City of Richmond’s HousingAdministrationDivision(Division) contracted with NBS tocompletea User Fee Study. The Divisiondoes not currently havean adopted schedule of fees. Adoption of a fee schedulecan providecost recovery options for essential City services.

Prior to this Study, Division staff performed initialresearch to compile a list of fees chargedfor similar services by otheragencies. This list served as abaseline for establishing acomprehensivelist offees for evaluation.

Due to timeconstraints for meeting the Finance Department’s deadline for the City’s annual Master Fee Scheduleupdate, NBS and Division staffprioritized an analysis offees for themost routine services provided by the Division. Once these fees are implemented, the Division plans to continue with analysis of additional fees that could be added at mid-year or within the next fiscal year’s budget adoption process.

This memorandum contains a summarized description of the Study’s approach and outcomes for the City’s consideration.

Section 1.Methodology and Approach
Under the legal frameworkprovided by the California ConstitutionArticle XIII C, a fee may not exceed the estimated reasonable cost of providing the service or performing the activityfor which the fee is charged.

The goal of a fee study is toestablishthe total cost of providingservices andthen translate those costs into a schedule of fees for services. The City Council can then consider feesfor adoption either at or below the 100% cost recovery level established by the Study. The following three phases of analysis were required to accomplish the Study’s goal: 1) Cost of service analysis, 2)Fee establishment, and 3)Cost recovery evaluation.

Page 829 of 846 ends

2 Section2. Cost of Service Analysis
A cost of service analysis compilesand analyzesthe full cost of providing governmental services and activities.

There are two primary types of costs considered: direct and indirect costs.Direct costs are those which specifically relate to the activity in question, including the real-time provision of the service.Examples of direct costs include salary, wages and benefits expenses for personnel specifically involved in the provision of services and activities to the public. Indirect costs are those which support the provision of services but cannot be directly or easily assigned to the activity in question.Examples of indirect costsinclude personnel costs of line supervisors and/or departmental management,and/or the costs of City-widesupport services such as City Manager, Finance, Human Resources, etc. sourced from theCity ofRichmond’sCost Allocation Plan.

Section 3.Fully-Burdened Hourly RateCalculation
Because labor is the primary underlying factorrequiring specific actions on the part of Division staff to provide services, the full cost of service was most appropriately expressed as a fully-burdened cost per available labor hour.To derive the fully-burdened labor rate, two figures were required: the full costs of service and the number of hours available to perform those services. The full costs of service were quantified generally through the earlier steps described. The number of hours was derived from a complete listing of personnel within theDivision andreflected in the labor expenses embedded in the full cost of service. Each employee’s annual paidleave hours were approximated.Paid leave includes holidays, vacation, and sick leave.Annual allowable paid leave hours were removed from the total number of regular paid hours to generate the total number of available labor hours for the Division. These available hours represent the amount of productive time during which servicesand activities can be performed.

The productive labor hours were then divided into the annual full costs of service to derive a composite fully- burdened labor rate for the Division at the current service level (FY 2021). This composite labor ratemay then be usedto quantify costs at an individual fee level. The composite labor rate may also be used by theCity for other purposes when the need arises to calculate the full cost ofother types ofservices.

The followingtablecategorizes theHousingDivision’s costs, resulting in the fully-burdened hourly rate applicable towardrecovery of costs throughfees for services.

Housing Division Fully-Burdened Hourly Rate – Fiscal Year 2020-21 Cost Element Division Direct
Labor 431,667$
Recurring Non-Labor 20,450
Citywide Overhead 135,175
Division Admin 238,577
Division Total 825,868$
Fully Burdened Hourly Rate $ 238
3,469Reference: Direct Hours Only

Page 830 of 846 ends

3 As shown above, the total cost of theHousing AdminDivision is approximately$826,000. Based on NBS’ analysis, all subsequent cost of service calculations at the individual feelevel would assumea fully-burdened hourly rate of $238.

Section4. Cost RecoveryEvaluation
Appendix Ato this memopresents the results of the detailed cost recovery analysis of fees for theHousing AdministrationDivision. In the Appendix, the “Cost of Service per Activity” column establishes the maximum adoptable fee amount for the corresponding service identified in the “Fee Name” list.

NBS provided a full cost of service evaluation and the framework for considering fees, while theDivision determined the appropriate cost recovery levels at or below full cost amounts. The “Recommended Fee / Deposit Level” column inAppendix A displaysDivisionstaff’s initial recommended fee amounts. Based on this information, the staff recommendssettingfees between 60-66% cost recovery, depending on the fee. These initialrecommendations reflect discretion on the part of the Division based on a variety of factors, such as existing Divisionpolicies and Division-wideor City-wide revenue objectives, economic goals, community values, market conditions, level of demand, and others. For more information regardinginitial recommendations, please consult the Division’s staff report.

Section5. Conclusion
Based on the outcomes presented in thisanalysis, theDivisioncan use this informationas an interim step to establishsome initial fees for theHousingDivision’s services.

To keep pace with cost inflation theDivisionshould consider adjusting the hourly rate outcome and/or fee schedule on an annual basisby an inflationary factorsuch as Consumer Price Index, or other factor currently applied by the Finance Department to the Master Fee Schedule each year. While acomprehensive Cost of Service Analysis is not required every year,in NBS’ experience,it is bestto be performedevery three to five years as organizations change over time.

Cease Expending Funds of Litigation Against the Mayor.

FINANCIAL IMPACT: The City has expended approximately $182,000 on cost related to litigation against the mayor. Another $100,000 is anticipated in the continuance of litigation.

STATEMENT OF THE
ISSUE:

Instead of using city funds to investigate elected officials, the City of Richmond can and should request that the
Grand Jury, Contra Costa County District Attorney, or the Attorney General have the authority to investigate elected officials when needed.

RECOMMENDED ACTION:

CEASE expending funds to litigate the mayor –

DISCUSSION:

The city is spending too much of taxpayer dollars on litigation against the mayor. There are other means to investigating and taking legal action against elected officials instead of using city resources.

If City Officials have determined the need for an investigation of an elected official, the city can contact the Grand Jury, the District Attorney’s Office, and/or the Attorney General’s Office to report actions or request investigations.

Approximately $182,000 has been expended relative to litigation against the mayor and an additional $100,000 is anticipated. The city has too many other fiscal responsibilities to expend this much money and staff resources on litigating an elected official.

REPORT

February 15, 2022
DISCUSSION:

The City Council regularly conducts lengthy discussions and asks an excessive amount of questions during the City Council meetings. As a result, many time-sensitive items have been continued to future meetings, and in some cases, an item has been continued several times. Staff members, members of the public, and consultants routinely wait for hours, time and time again to hear, present, or participate in the discussion of an item, only to learn that the item will be continued to another meeting.

City Councilmembers are expected to read the agenda packet and contact staff prior to the meeting to ask detailed questions related to items. More times than not, the questions that are asked during the City Council meetings are a result of councilmembers not reading the agenda reports and supporting documentation. The City Council meetings could be more efficient if time limits were established.

The City Council should establish reasonable time limits for questions and comments from the City Council. The City Council once had a policy to limit the mayor and councilmembers to five minutes each for questions and comments on each item. The City Council should establish a similar rule.

The City Council has also started to routinely request to move items up on the agenda which also increases the probability of items related to the budget, contracts, projects, etc. to be continued to future meetings. The mayor, city clerk, and city manager should prioritize the City Council agendas. Prioritizing agendas includes the placement of items on the agenda relative to timeline constraints. Also, during the agenda setting meetings, the mayor, city clerk, and city manager should have the authority to place items on future meeting agendas, if the agenda is too long. Many times, there are too many items placed on one agenda and it is apparent the items closer to the end of the agenda will not be discussed.

It is my recommendation that the City Council establish a reasonable amount of time for comments, questions, and discussion on agenda items and allow the mayor, city clerk, and city manager to prioritize the City Council agendas.

AGENDA

DISCUSSION:

As a result of COVID-19, a substantial number of individuals, who previously routinely worked in offices and other commercial spaces found that working from home is both more convenient and equally productive. Also, the economic effects of COVID-19 resulted in a number of businesses downsizing or going out of business entirely.

There is an inventory of otherwise safe but unused or underutilized non-residential space that could be made available as affordable housing except that it is restricted to non-residential uses by zoning laws and general plan provisions.

Making this space available for use could substantially alleviate Richmond’s shelter crisis, which was adopted by the City Council as Resolution No. 79-18 on October 2, 2018.

ENVIRONMENTAL REVIEW:

This Ordinance is not a project under the requirements of the California Environmental Quality Act, together with related State CEQA Guidelines (collectively, “CEQA”), because it has no potential for resulting in a physical change in the environment, either directly or ultimately, in that allowing Junior Accessory Dwelling Units during the housing crisis is for a limited duration.

In the event that this Ordinance is found to be a project under CEQA, it is subject to the CEQA exemption contained in CEQA Guidelines section 15061(b)(3) because it can be seen with certainty to have no possibility of a significant effect on the environment.

CEQA applies only to projects which have the potential of causing a significant effect on the environment. Where it can be seen with certainty that there is no possibility that the activity in question may have a significant effect on the environment, the activity is not subject to CEQA. In this circumstance, the urgency Ordinance would have no or only a de minimis impact on the environment because allowing vehicles to park on certain properties for a limited duration does not have any direct or indirect physical impacts on the environment. The foregoing determination is made by the City Council in its independent judgment.

1 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF RICHMOND AMENDING CHAPTER 9.40 “GENERAL PROVISIONS” OF THE CITY OF RICHMOND MUNICIPAL CODE BY ADDING A NEW SECTION 9.40.019 “NON-RESIDENTIAL JUNIOR ACCESSORY DWELLING UNITS”

WHEREAS, the Richmond City Council, pursuant to police powers delegated to it by the California Constitution, has the authority to enact legislation that promotes public health, safety and general welfare of its residents; and

WHEREAS, the Richmond City Council adopted Resolution 79-18 on October 2, 2018, declaring a shelter crisis pursuant to SB 850 (Chapter 48, Statutes of 2028 and Government Code Section 8698.2; and,
WHEREAS, that shelter emergency continues to exist and has grown worse since 2019, with hundreds of unhoused individuals living in RVs, tents and improvised shelters throughout the City of Richmond; and,
WHEREAS, as a result of game-changing work habits and economic dislocation resulting from COVID-19, there is a surplus of commercial and institutional building space available, some of which could be used to provide housing for homeless individuals of a quality that is substantially higher than other alternatives such as shelters and hotel rooms; and WHEREAS, such temporarily repurposed commercial and institutional space could be vastly safer and healthier than camps on both private and public land throughout Richmond; and,
WHEREAS, Section 8689.2 states, “The governing body may declare a shelter crisis, and may take such action as is necessary to carry out the provisions of this chapter, upon a finding by that governing body that a significant number of persons within the jurisdiction of the governing body are without the ability to obtain shelter, and that the situation has resulted in a threat to the health and safety of those persons.”

THEREFORE, LET IT BE RESOLVED THAT NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF RICHMOND does ordain as follows:
