7. All prior proceedings taken by this City Council with respect to the CFD and the proposed annexation of territory thereto have been duly considered and are hereby determined to be valid and in conformity with the Act, and the CFD has been validly established pursuant to the Act.
Section 2. The description and map of the boundaries of the territory to be annexed to the CFD, as described in said Annexation Map No. 85 to the CFD on file with the City Clerk are hereby finally approved, are incorporated herein by reference, and shall be included within the boundaries of the CFD, and said territory is hereby ordered annexed to the CFD, subject to voter approval of the levy of the special taxes therein as hereinafter provided.
Section 3. The provisions of the Resolution of Intention as heretofore adopted by this City Council are by this reference incorporated herein, as if fully set forth herein.
Section 4. Pursuant to the provisions of the Act, the proposition of the levy of the special tax within the territory to be annexed to the CFD shall be submitted to the voters of the area to be annexed to the CFD at an election called therefor as hereinafter provided.
Section 5. This City Council hereby finds that fewer than 12 persons have been registered to vote within the territory proposed to be annexed to the CFD for each of the 90 days preceding the close of the hearing heretofore conducted and concluded by this City Council for the purposes of these annexation proceedings. Accordingly, and pursuant to Section 53326 of the Act, this City Council finds that for purposes of these proceedings the qualified electors are the landowners within the territory proposed to be annexed to the CFD and that the vote shall be by said landowners, each having one vote for each acre or portion thereof such landowner owns in the territory proposed to be annexed to the CFD.
Section 6. Pursuant to Section 53326 of the Act, the election shall be conducted by mail ballot under Section 4000 of the California Elections Code. This City Council hereby determines that paragraphs (a), (b), (c)(1) and (2) of said Section 4000 are applicable to this election.
Section 7. The City Council hereby calls a special election to consider the measure described in the ballot referred to in paragraph 8 below, which election shall be held on August 13, 2024, in the regular meeting place of this City Council, City Council Chambers, 3970 Rocklin Road, Rocklin, California.
Section 8. The City Clerk is hereby appointed as the election official to conduct the election and cause to be provided to each landowner(s) in the territory to be annexed to the CFD, a ballot in the form of Exhibit A hereto, which form is hereby approved. 598

Section 9. The City Clerk shall accept the ballots of the qualified electors received prior to 5:00 p.m. on August 13, 2024 whether received by mail or by personal delivery.
Section 10. This City Council hereby further finds that the provision of Section 53326 of the Act requiring a minimum of 90 days to elapse before said election is for the protection of voters, that the voters have waived such requirement and the date for the election herein above specified is established accordingly.

BE IT RESOLVED by the City Council of the City of Rocklin as follows:
Section 1. The City Council of the City of Rocklin finds as follows:
1. In proceedings heretofore conducted by the City Council pursuant to the Mello-Roos Community Facilities Act of 1982, as amended (the "Act"), this City Council has heretofore adopted a resolution calling a special election of the qualified landowner electors in the territory of land proposed to be annexed to Community Facilities District No. 1 (Annexation No. 85) (the "CFD");
2. Pursuant to the terms of the resolution which is hereby incorporated herein by this reference, the special election has been held and the City Clerk has filed a Canvass of Votes Cast in Special Election, a copy of which is attached hereto as Exhibit A; and,
3. This City Council has reviewed the Canvass and hereby approves it.
Section 2. The issue presented at the special election was the levy of a special tax within the territory annexed to the CFD, to be levied in accordance with the formula heretofore approved by this City Council as described in Resolution No. 2024-153, the Resolution of Intention.
Section 3. Pursuant to the Canvass on file with the City Clerk, the issue presented at the special election was approved by the landowner-voter being the qualified electors of the territory annexed to the CFD by more than two-thirds of the qualified electors voting at the special election.
Section 4. Pursuant to the voter approval, the annexed territory to the CFD is hereby declared to be fully annexed to and part of the CFD and this City Council may levy special taxes therein as heretofore provided in these proceedings. 601

Section 5. It is hereby found that all prior proceedings and actions taken by this City Council pursuant to the CFD and the territory annexed thereto were valid and in conformity with the Act.
Section 6. Within 15 days of the date hereof, the City Clerk shall execute and cause to be recorded in the office of the County Recorder of the County of Placer, an amendment to the Notice of Special Tax Lien as required by Section 3117.5 of the California Streets and Highways Code.

Adopt a Resolution of the City Council of the City of Rocklin Providing for the Establishment of Territory as a Future Annexation Area of Rocklin Community Facilities District No. 5 (Vista Oaks, APNs 046-010-007-000 and 046-020-003-000).
Background:
On June 25, 2024, the City Council adopted Resolution No. 2024-154, a Resolution of Intention to Establish Territory as a Future Annexation Area of Rocklin Community Facilities District (CFD) No. 5 regarding Vista Oaks, a planned residential development property located along the northern terminus of Monument Springs Drive and western terminus of China Garden Road (Assessor's Parcel Numbers 046-010-007-000 and 046-020-003-000). A Notice of Public Hearing was published in the Placer Herald on July 12, 2024.
The development of Vista Oaks is conditioned on, among other things, annexation into Community Facilities District (CFD) No. 5. CFD No. 5 finances the operation and maintenance of publicly owned parks, parkways, landscaping and street/parkway lighting.
For CFD No. 5, City staff calculates the tax on the annexed property based on the projected costs of maintaining services (authorized by the CFD) as a result of a project’s improvement plans. Once the property is annexed into CFD No. 5, changing the tax rate assigned to the property is a lengthy process and requires further approval by the landowner(s).
Vista Oaks will be developed in three phases. As only Phase 3 is currently being developed, staff does not have enough information to determine the cost to the City of maintaining future services for the two remaining phases once they are developed. To ensure in the future that the City receives the funding needed to provide the services required once development within CFD No. 5 has taken place, it is necessary to establish the territory as a future annexation Item Number 2

area.
California Government Code Article 3.5 of Chapter 2.5 of Part 1 of Division 2 of Title 5, Annexation of Territory, provides for a resolution to identify property proposed for future annexation into an existing CFD with the condition that parcels within that territory may be annexed with unanimous approval of the owner or owners of each parcel or parcels at the time the parcel or those parcels are annexed. This will allow the project (and therefore all three phases) to be approved to be designated as a future annexation area.
The territory to be designated as a future annexation area is two parcels of approximately 91 acres. The proposed future annexation map is included as Attachment 2 for reference. The phase designated for immediate development of Vista Oaks (Phase 3) can be annexed into CFD No. 5 right away with unanimous approval of the owner, which meets the condition to development of the project. The two remaining undeveloped phases (Phases 1 & 2) will be placed for future development that will require the owner of those phases to annex into CFD No. 5 prior to approval of maps or improvement plans for development.
Staff recommends the City Council to approve the Resolution (Attachment 1) to establish the Vista Oaks territory as a future annexation area, which will allow for the territory to be annexed into CFD No. 5 as development occurs and the necessary services within the special district are able to be determined.
Fiscal Impact:
There is no direct fiscal impact to the General Fund from the staff recommendation.
Establishment of the future annexation area, and subsequently future annexations into CFD No. 5, would allow special taxes to be levied and collected to pay for services provided to the annexation territory.

BE IT RESOLVED by the City Council of the City of Rocklin as follows:
WHEREAS, this City Council has conducted proceedings to establish Community Facilities District No. 5 (the “CFD”) pursuant to the Mello-Roos Community Facilities Act of 1982, as amended (the "Act"), Chapter 2.5 of Part 1 of Division 2 of Title 5, commencing at Section 53311, of the California Government Code; and WHEREAS, in order to provide for the possible future annexation of certain territory into the CFD (the “Future Annexation Area”) upon the approval of landowners, this City Council has heretofore adopted Resolution No. 2024-154, its “Resolution of Intention to Establish Territory as a Future Annexation Area of Rocklin Community Facilities District No. 5” (the “Resolution of Intention”), and held a public hearing on the matter of the establishment of territory as a Future Annexation Area of the CFD, as described in the Resolution of Intention; and
WHEREAS, at the public hearing all interested persons desiring to be heard on all matters pertaining to the establishment of a Future Annexation Area of the CFD were heard and a full and fair hearing was held.
NOW, THEREFORE, IT IS HEREBY ORDERED as follows:
1. Prior Proceedings. All prior proceedings taken by this City Council with respect to the CFD and the proposed establishment of a Future Annexation Area of the CFD have been duly considered and are hereby determined to be valid and in conformity with the Act.
2. Prior Resolution. The provisions of the Resolution of Intention previously adopted by this City Council for the CFD, are by this reference incorporated herein, as if fully set forth herein.
3. Territory Described. The boundaries of the Future Annexation Area which is being established as a Future Annexation Area of the CFD, as set forth in the Annexation Area Map No. 72 heretofore recorded in the Placer County Recorder’s Office on at Book 5 of Maps of Assessment and Community Facilities Districts at Page 8 as instrument No. 2024-0036022, are hereby approved, are incorporated herein by reference and shall be a Future Annexation Area of the CFD, as so designated in such map.

4. Annexation of Future Annexation Area into the CFD. In accordance with the Act, the Future Annexation Area has been validly established as a Future Annexation Area of the CFD pursuant to the Act.
Parcels within the Future Annexation Area shall be annexed into the CFD from time to time only with the unanimous approval (each, a “Unanimous Approval”) of the owner or owners of each parcel or parcels at the time that parcel or those parcels are annexed, without any requirement for further public hearings or additional proceedings.
The City Council hereby determines that any property for which the owner or owners execute a Unanimous Approval shall be added to the CFD, and the Clerk shall record an amendment to the notice of special tax lien for the CFD pursuant to Section 3117.5 of the Streets & Highways Code.
5. Effective Date. This Resolution shall take effect upon its adoption.
