Subject:

Solid Waste Collection Service Rate Increase
Date:

May 13, 2025
Submitted By:

Justin Nartker, Public Works Director
Department:

Public Works
Recommendation:

Adopt a Resolution of the City Council of the City of Rocklin of Intent to Amend the Solid Waste Collection Service Rates Within the Incorporated Limits of the City of Rocklin and Setting a Time and Place for a Public Hearing Thereon.

Background:

Recology Auburn Placer (Recology) has a Franchise Agreement for Solid Waste Handling Services with the City that allows for an annual Cost of Living Adjustment up to a maximum of

4.0%, as established by Resolution No. 2009-42 and amended by Resolution No. 2024-32.

Recology has approached the City with a request for a Cost-of-Living Adjustment (COLA) of

2.5%. In addition, the Western Placer Waste Management Authority (WPWMA) is increasing the landfill rate by 2.58%, which is passed through to the City’s solid waste hauler and is applicable to Debris Boxes and Construction and Demolition (C&D) material.

Recology has been Rocklin’s solid waste provider since 1979. They operate under a Franchise Agreement originally granted by the City in 1979 and extended in 1999. In 2009 Recology was granted a new and revised Franchise Agreement in which they may apply for a yearly COLA rate adjustment based on a specified formula. There are procedures necessary for a solid waste fee increase in order to comply with Proposition 218.

Refuse collection services are not subject to voter approval, but are subject to the notice, hearing, and majority protest procedures set forth in Article XIIID, section 6(a). Approval of the staff recommendation will set a Public Hearing on the proposed rate increases for June 24, 2025.

Recology's rates compare favorably with neighboring communities in the region, especially when considering the expanded service Rocklin residents receive. Beyond the normal weekly trash service, Rocklin residents receive green waste pickup, street sweeping, curbside e- waste recycling, Spring Cleanup, cardboard recycling, and dead animal pickup, which are included in the monthly rate.

Item Number C20.

217
Below is a comparison of the existing and proposed rates for a sampling of the multiple rates provided within the Franchise Agreement. Cost projections are based on the Cost of Living Increase at 2.5% and a landfill rate increase of 2.58%.

Fiscal Impact:

The impact of the proposed rate increase on Recology customers is noted above. The fiscal impact to the City of the proposed rate increases would result in an increase in franchise fee revenue in the General Fund (100) of approximately $100,000 for Fiscal Year 2025/26.

Annexation Into Community Facilities District No. 1 (Chapa-De South Placer Clinic)
Date:

May 13, 2025
Submitted By:

Megan Bressem, Management Analyst
Daniel Choe, Administrative Services Deputy Director
Department:

Administrative Services - Finance
Recommendation:

Conduct a Public Hearing and Consider the Following Actions:

A
.

Adopt a Resolution of the City Council of the City of Rocklin of Annexation of Territory to Community Facilities District No. 1 (Annexation No. 91), Authorizing the Levy of a Special Tax, and Submitting Levy of Tax to Qualified Electors ( Chapa-De South Placer
Clinic
).

B
.

Adopt a Resolution of the City Council of the City of Rocklin Declaring Results of Special Annexation Election, Determining Validity of Prior Proceedings, and Directing Recording of Amended Notice of Special Tax Lien Pertaining to Community Facilities District No. 1 (Annexation No. 91) (
Chapa-De South Placer Clinic
).

Background:

On April 8, 2025, the City Council adopted Resolution No. 2025-059, a Resolution of Intention to Annex Territory to Rocklin Community Facilities District (CFD) No. 1 (Annexation No. 91) and to Authorize the Levy of Special Taxes Therein and Set a Public Hearing Date regarding Chapa-De South Placer Clinic, a business professional development property located at the northwest corner of the intersection of West Stanford Ranch Road and Wildcat Boulevard. A map of the annexation area is included as Attachment 3. A Notice of Public Hearing was published in the Placer Herald on April 25, 2025.

The development of Chapa-De South Placer Clinic is conditioned on, among other things, annexation into CFD No. 1. CFD No. 1 provides financing for the operation and maintenance of fire protection and suppression services and paramedic services.

There are two resolutions for City Council consideration. Resolution A (Attachment 1) finds that no majority protest exists, orders the annexation, and authorizes the levy of the special tax, subject to approval by a two-thirds vote of the landowners.

In anticipation of approval of the annexation, the election has already occurred, and Resolution B (Attachment 2) approves the canvass of the election, declares the results of the Item Number PH1.

234
election, and orders the recording of the amended notice of special tax lien, which gives notice that the land within the project area is now subject to the special tax.

Fiscal Impact:

There is no direct fiscal impact to the General Fund from the staff recommendation. Adoption of the attached resolutions will allow special taxes to be levied and collected for CFD No. 1 to pay for services provided to the annexation territory.

Annexation Into Community Facilities District No. 5 (Chapa-De South Placer Clinic)
Date:

May 13, 2025
Submitted By:

Megan Bressem, Management Analyst
Daniel Choe, Administrative Services Deputy Director
Department:

Administrative Services - Finance
Recommendation:

Conduct a Public Hearing and Consider the Following Actions:

A
.

Adopt a Resolution of the City Council of the City of Rocklin of Annexation of Territory to Community Facilities District No. 5 (Annexation No. 76), Authorizing the Levy of a Special Tax, and Submitting Levy of Tax to Qualified Electors (Chapa-De South Placer Clinic).

B
.

Adopt a Resolution of the City Council of the City of Rocklin Declaring Results of Special Annexation Election, Determining Validity of Prior Proceedings, and Directing Recording of Amended Notice of Special Tax Lien Pertaining to Community Facilities District No. 5 (Annexation No. 76) (Chapa-De South Placer Clinic).

Background:

On April 8, 2025, the City Council adopted Resolution No. 2025-060, a Resolution of Intention to Annex Territory to Rocklin Community Facilities District (CFD) No. 5 (Annexation No. 76) and to Authorize the Levy of Special Taxes Therein and Set a Public Hearing Date regarding Chapa-De South Placer Clinic, a business professional development property located at the northwest corner of the intersection of West Stanford Ranch Road and Wildcat Boulevard. A map of the annexation area is included as Attachment 3. A Notice of Public Hearing was published in the Placer Herald on April 25, 2025.

The development of Chapa-De South Placer Clinic is conditioned on, among other things, annexation into CFD No. 5. CFD No. 5 finances the operation and maintenance of publicly owned parks, parkways, landscaping and street/parkway lighting.

There are two resolutions for City Council consideration. Resolution A (Attachment 1) finds that no majority protest exists, orders the annexation, and authorizes the levy of the special tax, subject to approval by a two-thirds vote of the landowners.

In anticipation of approval of the annexation, the election has already occurred, and Resolution B (Attachment 2) approves the canvass of the election, declares the results of the Item Number PH2.

244
election, and orders the recording of the amended notice of special tax lien, which gives notice that the land within the project area is now subject to the special tax.

Fiscal Impact:

There is no direct fiscal impact to the General Fund from the staff recommendation.

Annexation into CFD No. 5 would allow special taxes to be levied and collected to pay for services provided to the annexation territory.

2024 ANNUAL MILITARY EQUIPMENT REPORT
ASSEMBLY BILL 481
Contact: Luke Sincerny, Captain – Operations (916) 625-5444, [email protected]

BACKGROUND
AB 481
Assembly Bill 481 (“AB 481” or the “Bill”) was signed by Governor Newsom on September 30, 2021, and requires that law enforcement agencies obtain approval from the agency’s governing body prior to purchasing, raising funds for, or acquiring “military equipment”, using “military equipment”, and collaborating with other law enforcement agencies in the deployment or use of “military equipment” within the governing body’s territorial jurisdiction.

The term “military equipment”, as used in AB 481, in fact does not necessarily indicate equipment that has been used by the military, obtained from the military, or is even considered military grade. Pursuant to AB 481, items deemed to be “military equipment” include, but are not limited to, unmanned aerial or ground vehicles (i.e. drones or bomb disposal robots), armored vehicles, command post vehicles, battering rams, water cannons, pepper balls, “bean bag” launchers, “rubber bullets”, long range acoustic devices, and commonly used long rifles. The Bill’s stated intent is to increase transparency, accountability and oversight surrounding the acquisition and use of the designated “military equipment” by state and local law enforcement.

After initial approval by the governing body, AB 481 requires law enforcement agencies that receive approval for the use of “military equipment” to submit annual reports to the governing body regarding the use of the equipment, any complaints received, any internal audits or other information about violations of the military equipment use policy, the cost and quantity of each type of military equipment, and the quantity of military equipment if the agency intends to acquire additional military equipment in the next year. The governing body is required to review any ordinance it has adopted at least annually and vote on whether to renew the ordinance at a regular, public meeting.

Rocklin Police Department’s “Military Equipment” Policy

The Rocklin Police Department’s “Military Equipment” policy complies with AB 481 and is based on a model 258

The “Military Equipment” policy is reviewed annually and published on the Rocklin Police Department’s website.
