Subject: Withdrawal of Bid Protest – Sherwood Recreation Center Project Date: 12/5/25
City of Salinas
Jonathan Esteban
[email protected]
Adriana Robles
[email protected]
Dear Jonathan and Adriana,
Marvulli Inc. submitted a bid protest on October 17, 2025 concerning the Sherwood Recreation Center project. The basis of that protest was information provided to us by Val’s Plumbing & Heating, including written statements asserting that their bid could not be divided by scope.
We have since been informed that the statements provided to us by Val’s were inconsistent with the proposals actually submitted by Val’s to Precision Construction Services on bid day. We were unaware of these discrepancies at the time the protest was filed.
Because the protest relied on information that we now understand to be factually inconsistent, Marvulli respectfully withdraws the protest in its entirety. We believe this action is appropriate to ensure the accuracy and integrity of the City’s procurement process.
We appreciate the City’s attention to this matter and apologize for any inconvenience caused by our reliance on information that was subsequently shown to be incorrect.
Please confirm receipt of this letter and advise if any further documentation is required to finalize the withdrawal.
Sincerely,
Tim Williams
COO, Marvulli Inc.

CITY OF SALINAS
COUNCIL STAFF REPORT
DATE: DECEMBER 9, 2025
DEPARTMENT: PUBLIC WORKS DEPARTMENT
FROM: DAVID JACOBS, PUBLIC WORKS DIRECTOR
BY: ADRIANA ROBLES, CITY ENGINEER
TITLE: AMENDMENT TO AGREEMENT FOR SERVICES WITH BEAR
ELECTRICAL SOLUTIONS (BES)
RECOMMENDED MOTION:
A motion to approve a Resolution approving Amendment N o. 3 to Agreement for Services between the City of Salinas and Bear Electrical Solutions (BES) extending the term of the agreement through to December 31, 2027, and including a “not to exceed” amount of $4,320,000 for the contract established in 2018.
EXECUTIVE SUMMARY:
On December 18, 2018, the City Council awarded a traffic signal maintenance agreement to Bear Electrical Solutions, Inc. (“BES”). The traffic signal maintenance agreement was originally for a three-year term, through December 2021, with an option to award subsequent 2 -year extensions upon successful demonstration of exemplary performance. In 2021 City Council approved Amendment No. 1, increasing the annual not to exceed amount from $300,000 to $570,000. City staff recommends further extending the term of the agreement through to December 31, 2027, and including a total contract “not to exc eed” amount of $4,320,000 reflecting the total amount of compensation to be paid under the agreement, including the recommended one-year extension.
BACKGROUND:
The City operates 116 traffic signals and other electronic traffic devices such as pedestrian hybrid beacons. Included with these are signals along corridors that work together to provide traffic progression. Maintenance of traffic signals typically falls under two categories , preventative maintenance and responsive maintenance or emergency repair.
1. Preventive Maintenance is performed at regularly scheduled intervals for upkeep of signal equipment such as, but not limited to, signal cabinet s (which house electronics for signal operations), pedestrian push buttons, LED signal heads, and associated tasks such as record keeping and testing. Preventive Maintenance is designed to reduce the incidence of malfunctions and extend the life of a traffic signal. Signal malfunctions always create inconveniences to motorists and pedestrians and other road users.
Page | 2
2. Responsive Maintenance or Emergency Repair includes the repair of failed equipment and traffic signal infrastructure and its restoration to safe and normal operation. These are typically unscheduled and are a result of unexpected failure or damag e. Collision with a traffic signal, Acts of Nature, malicious mischief, or replacement of obsolete or deteriorated equipment are examples of responsive maintenance. These include calls outside of regular business hours, weekends and holidays. This speciali zed contractor performs responsive maintenance for the City on an “as needed” basis. Most emergency response calls need specialized equipment, certified signal maintenance personnel, and electricians to repair or replace signal poles, mast arms, component s of traffic signal cabinet or replacement of entire signal cabinets so traffic control can be restored within the least amount of time possible.
On October 5, 2018, Public Works staff released a Request for Proposals (RFP) for Traffic Signal Preventive Maintenance and Emergency Repair Services. The scope of work prescribed by the RFP scope of work include d providing preventative and routine traffic signal maintenance, responsive maintenance, emergency repair, inspection support, and supervision for the maintenance of traffic signals within the City of Salinas. The traffic signal maintenance agreement was awarded to BES on December 18, 2018, by Council Resolution No. 21536.
The traffic signal maintenance agreement was originally for a three-year term, through December 2021, with an annual not to exceed amount of $300,000. A n option to award subsequent 2 -year terms upon successful demonstration of exemplary performance was included in the original agreement.
At the end of 2021, the signal maintenance program kept reaching the annual $300,000 limit and staff required an amendment to continue outside on-call signal maintenance services. The City does not have the in-house ability to perform traffic signal repair and maintenance and must rely on contracting out this work. To streamline future maintenance and repair staff recommend ed increasing the annual contract limit to $570,000 each year. City Council in September 2021 approved Contract Amendment No. 1 through Resolution No. 22186 extending the maintenance agreement to December 31, 2023 with an annual not to exceed amount of $570,000 per year.
On December 31, 2023, the City Manager signed Agreement No. 2 which extended the terms of the Agreement until December 31, 2025 and increased the compensation schedule by 10%. This increase did not adjust the total annual compensation of $570,000, see Attachment 3.
BES has continued demonstrating exemplary performance, and Public Works staff wish to extend the current agreement through December 31, 2027. Bear has requested a 5% increase on their labor rates which can be absorbed within the current budgeted amount of $570,000.
In order to comply with updated purchasing policy, the “not to exceed” amount for the entire contract since inception must be identified. For this agreement the entire not to exceed amount of compensation to be paid under the agreement, including the proposed one -year extension, is $4,320,000.

(CCR Title 8, Section 16421)
This public works project is subject to compliance monitoring and enforcement by the California Department of Industrial Relations (“DIR”). All work shall be in accordance with wage scales and applicable determinations made by the Director of the DIR, as provided by Article 2, Chapter 1, Division 2, Part 7 of the Labor Code of the State of California, commencing with §1771.
Penalties for violations may be applied by the DIR pursuant to the Labor Code §1813 and §1815. The Contractor shall indemnify, hold harmless, and defend the City (with counsel reasonably approved by the City) against any claim for damages, compensation, fines, penalties, or other amounts arising out of the failure or alleged failure of any person or entity (including Contractor and its subcontractors) to pay prevailing wages as determined pursuant to Labor Code §1720, and hereby agrees to, §§1771-1774; to employ apprentices pursuant to Labor Code §1777.5 et seq., and/or to comply with the other applicable provisions of Labor Code §1720 et seq., §§1771-1774, §1777.5 et seq., and the implementing regulations of the DIR in connection with the scope of work. This indemnification section shall survive the expiration of the Term.
The Federal and State Labor Law requirements applicable to the Agreement are composed of, but not limited, to the following items:
1. Payment of Prevailing Wage Rates: All contractors, including subcontractors, shall pay no less than the prevailing rate of wages (Labor Code §1775), including the rates for holidays and overtime work (Labor Code §§1813 and 1815), to all workers employed in the execution of the contract (Labor Code §1774), pursuant to Labor Code §§1720-1784. The prevailing rates are those issued as wage determinations by the D IR, for each craft, classification and type of work. The current wage rate information can be found at the DIR’s website at:
https://www.dir.ca.gov/oprl/DPreWageDetermination.htm
.
Copies of the prevailing rate of per diem wages are on file at City’s Public Works Department (principal place of office). Contractor shall post a copy of the determination of the Director of DIR of the prevailing rate of per diem wages at each job site.
2. Apprentices: Contractor and subcontractors shall employ registered apprentices on this public works Agreement pursuant to Labor Code §1777.5.
All contractors on this project (prime and
subcontractors) are required to submit the Division of Apprenticeship Standards’ (“DAS”) Public Works Contract Award Information (DAS 140) form to all applicable apprenticeship committees no later than 10 days before commencing work. Additionally, all contractors are required to request registered apprentices (DAS 142 form).
Penalties for failure to pay prevailing wages (for non -exempt projects) and failure to employ apprentices include forfeitures and debarment under Labor Code §§1775 and 1777.7.
3. Certified Payroll Records : All contractors, including subcontractors, must maintain and file certified payroll records (“CPRs”) pursuant to Labor Code §1776. Additionally, all contractors and subcontractors must furnish certified payroll records into the DIR’s Electronic Certified Payroll Reporting (“eCPRs”) database

5. Proper Licensing/Registration: All contractors and subcontractors are required to be properly licensed, in accordance with the Provisions of Chapter 9 of Division 3 of the Business and Professions Code and subject to the requirements of §4104 of the Public Contract Code. Jobsites with multiple locations must include a portable poster board to ensure continued access to the information. Posters placed in foreman, supervisor, or employee vehicles, in an offsite job trailer, or inside a temporary restroom do not meet the posting requirement.
Posters may be printed from
the DIR’s website at: http://www.dir.ca.gov/wpnodb.html.
7. Nondiscrimination in Employment – Equal Employment Opportunity (“EEO”) :
Employment discrimination is prohibited, pursuant to Labor Code §1777.6, the Government Code, and Title VII of the Civil Rights Act of 1964.

CITY OF SALINAS
COUNCIL STAFF REPORT
DATE: DECEMBER 9, 2025
DEPARTMENT: HUMAN RESOURCES
FROM: MARINA HORTA-GALLEGOS, HUMAN RESOURCES DIRECTOR TITLE: MODIFICATION TO THE CLASSIFICATION – SALARY
SCHEDULE AND WORKFORCE ALLOCATION ADJUSTMENT
RECOMMENDED MOTION:
It is recommended that the City Council approve a resolution to amend the Classification -Salary Schedule for the following actions:
1. Adjustment of temporary employee hourly rates to comply with the state minimum wage pursuant to SB 3, approved April 4, 2016;
2. Approve previously authorized salary adjustments for Confidential Non -Management, Confidential Management, and Department Directors;
3. Add the classification and salary of Chief of Planning to the Classification – Salary Schedule;
4. Adjust the Classification – Salary Schedule to reflect the correct monthly rates for the Permit Services Technician and Plan Checker I classifications; and
5. Adjust the authorized workforce for the Library and Community Services Department by unfreezing the Recreation Assistant and adjusting the workforce to reflect one additional position effective January 1, 2026.
EXECUTIVE SUMMARY:
Staff recommends that the City Council approve a resolution modifying the Classification - Salary Schedule to reflect 1) new minimum wage adjustments; 2) previously authorized wage adjustments for Confidential Non -Management, Confidential Management, and D epartment Directors; 3) the addition of Chief of Planning classification and salary ; 4) correct monthly rates for two classifications; and 5) Adjust the FY 2025-26 authorized workforce to include one Recreation Assistant effective January 1, 2026.
BACKGROUND:
Senate Bill 3 provided for six minimum wage stepped annual increases from $10.00 per hour to $15.00 per hour, between January 1, 2017 and January 1, 2022. Senate Bill 3 further provides annual minimum wage adjustments based on the Consumer Price Index (CPI) measurements. Consistent with the provisions of SB3, the current rate of $16.50 per hour is increasing to $16.90 per hour effective January 1, 2026. This increase correlates to an increase in the CPI of 2.49% as determined
Page | 2
and certified by the Director of the CA Department of Finance. The City of Salinas has eight classifications that fall below the $16.90 per hour range. Therefore , it is necessary to take action to adjust the Classification-Salary Schedule to reflect the increase of any salary ranges that are below the $16.90 hourly rate to comply with the current state law and to adjust impacted classifications.
Additionally, staff recommend an adjustment to the Classification-Salary Schedule consistent with a 3% salary increase as previously approved for the Confidential Non -Management, Confidential Management, and Department Directors groups, effective in the first full pay period of January 2026.
Staff rec ommends adding the classification of Chief of Planning to the Classification -Salary Schedule. One of the two Assistant Community Developer Director (ACDD) positions has been vacant since August 2025, and it has been hard to fill. T he department has identified the need for dedicated leadership and coordinated planning functions. This focused oversight is essential to support the completion of the General Plan Update, two specific plans, the Zoning Code Update and processing of Future Growth Area applications. It is therefore proposed that the vacant ACDD be replaced with a new Chief of Planning position. The Chief of Planning will plan, organize, direct, and manage all City planning, permitting, and environmental review programs an d activities in the advanced and current planning divisions and will serves as technical advisor to the Planning Commission and Historic Resources Board.
Staff identified an error in the monthly rates for the classifications of Permit Services Technician and Plan Checker I as listed in the Classification-Salary Schedule. The monthly rates need to be adjusted to correspond with the hourly rates.
Lastly, with construction of the new Hebbron Family Center nearing completion in early January 2026 the Library and Community Services Department will begin recruitment to help staff the new recreation center. One Recreation Assistant was frozen during construction. As contemplated in the FY 2025-26 City Budget, staff recommends unfreezing the position to start recruiting and staffing the new recreation center, thus adjusting the FY 2025-26 approved workforce to reflect the addition of one Recreation Assistant.
CEQA CONSIDERATION:
Not a Project. The City of Salinas has determined that the proposed action is not a project as defined by the California Environmental Quality Act (CEQA) (CEQA Guidelines Section 15378).
CALIFORNIA GOVERNMENT CODE §84308 APPLIES:
No.
STRATEGIC PLAN INITIATIVE:
The proposed action meets the City Services Council goal ensuring fiscal responsibility and financial management while providing high quality customer service.
Page | 3
DEPARTMENTAL COORDINATION:
Human Resources coordinated with Community Development, Library and Community Services, and the Finance Department in this effort.
FISCAL AND SUSTAINABILITY IMPACT:
Currently, departments use temporary staff while funds are available. There may be adjustments necessary in the mid-year budget and next fiscal year’s budget to reflect the increase in minimum wage for 2025.
The salary adjustments for the Confidential and Department Director groups were previously approved in October 2024 and were budgeted as part of the FY 24-25 budget process and do not require further appropriation.
The addition of the Chief of Planning does not require any further appropriation. This position replaces one vacant Assistant Community Development Director.
The addition of one Recreation Assistant for half of FY 2025-26 has a cost of approximately $53,615. Ongoing annual cost is approximately $107,230.
