To: Honorable Mayor and City Council Members
From: Darren Goodman, Chief of Police
Department: Police
Subject: Authorize the City Manager to Execute Amendment No.1 to the Law Enforcement Services Agreement with the San
Bernardino International Airport Authority (All Wards)
Recommendation:
It is recommended that the Mayor and City Council of the City of San Bernardino, California, authorize the City Manager to execute the proposed First Amendment to the Law Enforcement Services Agreement between the City of San Bernardino and the San Bernardino International Airport Authority.
Executive Summary
The City of San Bernardino Police Department is responsible for policing services at the San Bernardino International Airport. Currently, two Police Officers are stationed at the airport during departures and arrivals of domestic flights. The San Bernardino International Airport Authority funds two fully burdened Police Officers, and 25% of a Police Captain’s salary, for these services. The current service Agreement expires October 01, 2025, and SBIA has expressed interest in continuing this partnership through the renewal of the agreement until October 01, 2028.
Background
Since 2012, the City of San Bernardino and the San Bernardino International Airport Authority have had various Service Agreements for Law Enforcement Services at the airport. In total, there have been five (5) separate agreements, containing various terms; however, all with the intention of providing law enforcement services at the facility. The most recent Service Agreement, spanning 2022-2025, funded two fully burdened Police Officers; an administrative fee equal to 25% of a fully burdened Police Captain’s rate; and $625.00 per vehicle per month for the use of two (2) City-owned patrol vehicles. This agreement has provided SBIAA with sworn law enforcement services to achieve compliance for Federal Aviation Administration approval for the continuance of passenger services at the airport.
Discussion
The San Bernardino International Airport Authority is desirous of executing a First Amendment to the current 2022-2025 Service Agreement for continuing sworn police services at the San Bernardino International Airport. This First Amendment would extend the current agreement, beginning October 2, 2025, and ending October 1, 2028.
The First Amendment to the Service Agreement would continue to provide two Police Officers for general law enforcement services at the airport during departures and arrivals. SBIAA will continue to fund the actual expenses for the use of City services, which includes:
100% of the fully burdened costs for two (2) Police Officers. $625.00 per vehicle per month for the use of two (2) City-owned patrol vehicles. An administrative fee that is equal to 25% of the fully burdened rate of a Police Captain salary.
The fully burdened employee costs, and monthly patrol vehicle fees, funded by San Bernardino International Airport Authority, would be approximately $1,553,092.49 for the term of the Agreement, ending October 01, 2028. SBIAA will be billed quarterly for the costs. Additionally, any expenses related to specialized airport training, overtime, or special events for SBIAA, specifically identified in items 8(c), 9, and 10, of the Service Agreement, will be funded by the San Bernardino International Airport Authority. The approved First Amendment to the Service Agreement with San Bernardino International Airport Authority synthesizes with Key Target No. 3: Improved Quality of Life Constantly evaluate public safety service delivery models to enhance the quality of service. Providing law enforcement services to SBIAA helps ensure the safety of City residents who are utilizing the air passenger services at the airport and provides immediate law enforcement presence/response during passenger service time corridors.
Fiscal Impact
There is no net fiscal impact to the City’s General Fund. The San Bernardino International Airport Authority (SBIAA) fully reimburses the City for the cost of two (2) fully burdened Police Officers, 25% of a fully burdened Police Captain, and the use of two (2) City-owned patrol vehicles. For Fiscal Year 2025/26, the City adopted sufficient revenues and expenditure budget related to this agreement. This item does not require any additional appropriation.
Conclusion
It is recommended that the Mayor and City Council of the City of San Bernardino, California, authorize the City Manager to execute the proposed First Amendment to the Law Enforcement Services Agreement between the City of San Bernardino and the San Bernardino International Airport Authority.
