SIDE LETTER TO THE MEMORANDUM OF UNDERSTANDING
BETWEEN THE CITY OF SAN BERNARDINO (“CITY”) AND THE TEAMSTERS, LOCAL 1932 (“UNION”) REPRESENTING THE MIDDLE MANAGEMENT

EMPLOYEES
During the final preparation of the current Memorandum of Understanding 2025-2028, (hereinafter referred to as “MOU”) between the City of San Bernardino and the Union certain language of the prior MOU (2020-2025) between the parties pertaining to the crediting of sick leave for newly hired employees was inadvertently omitted. As a result, the parties have agreed to reinsert such inadvertently omitted language.

The modification of the terms and conditions set forth in the MOU (2025-2028) between the City and the Union are as follows:

1. Article V, Section 3, Subsection B of the MOU shall be revised to read as follows:

A. Sick Leave Accruals. Regular full-time employees hired on or after July 1, 2017, and who are covered by this MOU are eligible to receive thirty (30) hours of paid sick leave after the new employee has been employed with the City for ninety (90) days. Paid sick leave may be used for employee or family illness or for medical reasons or other reasons provided under the City's Paid Sick Leave Policy (AB 1522), adopted by the Mayor and Common Council on June 18, 2015 by Resolution 2015-116 and incorporated into this MOU. After ninety (90) days of employment, a new employee will accrue four (4) hours of sick leave per pay period. At no time may Unit Members accrue more than 1040 hours of sick leave.

After ninety (90) days of employment, employees who are compelled to be absent from work on account of illness or injury other than that which is compensable under Article V, Section 5, Leave of Absence Without Pay, shall be compensated for sick leave, provided that such compensation shall cease upon the exhaustion of all accumulated sick leave. Employees shall not accumulate sick leave while compensated under the provisions of Article V, Section 5, Leave of Absence Without Pay.

In the event an employee is compensated for less than fifty percent (50%) of the total normal work hours in the pay period, he/she shall accrue no sick leave for such pay period and shall not be credited for the 4.0 hours of sick leave.

Whenever the employee uses all allowable sick leave, further absences may be charged against accrued vacation or administrative leave (if eligible), upon approval of the Department Head. If all allowable sick leave has been used and use of accrued vacation and/or administrative leave is disapproved, the employee will take loss of pay for the time not covered by allowable sick leave.

The Union approached the City requesting implementation of a 3/12 work schedule to better support police dispatch operations. From an operational standpoint, a 3/12 schedule can reduce the number of shift changes and daily handoffs, which may improve continuity of operations and minimize the potential for communication gaps during critical incidents.

The modification of the terms and conditions set forth in the MOU (2025-2028) between the City and Union are as follows:

2. Article VI, Section 1, Subsection A of the MOU shall be revised to read as follows:

B. City Work Schedules: City work schedules shall be as herein defined, except as otherwise provided for:

1. 5/40 Work Schedule: The 5/40 work schedule shall consist of a forty (40) Hour work week consisting of five (5) eight (8) hour workdays, exclusive of any meal periods assigned by management.

2. 9/80 Work Schedule: The 9/80 work schedule shall consist of eighty (80) Work hours in a two (2) week period consisting of eight (8) nine (9) hour workdays, and one (1) eight (8) hour workday, exclusive of any meal periods assigned by management.

3. 4/10 Work Schedule: The 4/10 work schedule shall consist of a forty (40) hour work week consisting of four (4) ten (10) hour workdays, exclusive of any meal periods assigned by management.

4. 3/12.5 Work Schedule: The 3/12.5 work schedule shall consist of three (3) consecutive 12.5-hour workdays, inclusive of any meal periods assigned by Management. Additionally, with each 28-day work period, employees assigned to the 3/12.5 schedule shall work one (1) 10-hour shift, which shall be scheduled on a day immediately before or after the employee’s regular three- day workweek and shall not include any hours outside of the employee's normal working hours.

5. 3/12 Work Schedule: The 3/12 work schedule shall consist of three (3) consecutive 12-hour workdays per week, inclusive of any meal periods assigned by Management. Additionally, employees assigned to the 3/12 schedule shall work one (1) 8-hour shift every other week, which shall be scheduled on a day immediately before or after the employee’s regular three- day workweek and shall not include any hours outside of the employee's normal working hours.

The primary work schedule will continue to be the 4/10 work schedule, as defined above, unless changed by action of the Mayor and City Council.

The parties agree to collaborate in identifying a schedule that effectively supports the operational requirements of the dispatch center and appropriately serves the needs of the community.

Work schedules shall be posted on all department bulletin boards showing the employees’ shift, work days and where known, hours.

3.All other terms and conditions of the MOU shall remain the same.

4.This Side Letter Agreement shall become effective upon City Council approval. ___________________________________
