SIDE LETTER TO THE EMPLYEE COMPENSATION AND BENEFITS PLAN (RESOLUTION NO. 2025-336) BETWEEN THE CITY OF SAN BERNARDINO (“CITY”) AND THE SAN BERNARDINO CONFIDENTIAL AND MANAGEMENT ASSOCIATION (“ASSOCIATION”)
During the final preparation of the current Employee Compensation and Benefits Plan (2025-2028), (hereinafter referred to as “the Plan”) between the City and Association, certain language of the prior Plan (2020-2025) between the parties pertaining to the crediting of sick leave for newly hired employees was inadvertently omitted. As a result, the parties have agreed to reinsert such inadvertently omitted language.
The modification of the terms and conditions set forth in the Plan (2025-2028) between the City and the Association are as follows:
1. Section 14, Subsection A of the Plan shall be revised to read as follows:
A. Sick Leave Accruals. Regular full-time employees hired on or after July 1, 2017, and who are covered by this MOU are eligible to receive thirty (30) hours of paid sick leave after the new employee has been employed with the City for ninety (90) days. Paid sick leave may be used for employee or family illness or for medical reasons or other reasons provided under the City's Paid Sick Leave Policy (AB 1522), adopted by the Mayor and Common Council on June 18, 2015 by Resolution 2015-116 and incorporated into this MOU. After ninety (90) days of employment, a new employee will accrue four (4) hours of sick leave per pay period. At no time may Unit Members accrue more than 1040 hours of sick leave.
2.All other terms and conditions of the Plan shall remain the same.
3.This Side Letter Agreement shall become effective upon City Council approval. ___________________________________
