SIDE LETTER TO THE MEMORANDUM OF UNDERSTANDING
BETWEEN THE CITY OF SAN BERNARDINO (“CITY”) AND THE SAN BERNARDINO POLICE DISPATCH ASSOCIATION (“ASSOCIATION”)
During the final preparation of the current Memorandum of Understanding 2025-2028, (hereinafter referred to as “MOU”) between the City of San Bernardino and Association certain language of the prior MOU (2020-2025) between the parties pertaining to the crediting of sick leave for newly hired employees was inadvertently omitted. As a result, the parties have agreed to reinsert such inadvertently omitted language.
The modification of the terms and conditions set forth in the MOU (2025-2028) between the City and the Association are as follows:
1. Article V, Section 3, Subsection B(6) of the MOU shall be revised to read as follows:
A. Sick Leave Usage for Employees:
6. Regular full-time employees hired on or after July 1, 2017, and who are covered by this MOU are eligible to receive thirty (30) hours of paid sick leave after the new employee has been employed with the City for ninety (90) days. Such paid sick leave may be used for employee or family illness or for medical reasons or other reasons provided under the City’s Paid Sick Leave Policy (AB 1522) adopted by the Mayor and City Council on June 18, 2015 by Resolution 2015-116. At no time may an employee accrue more than 1,040 hours of sick leave.
The Association approached the City requesting implementation of a 3/12 work schedule to better support police dispatch operations. From an operational standpoint, a 3/12 schedule can reduce the number of shift changes and daily handoffs, which may improve continuity of operations and minimize the potential for communication gaps during critical incidents.
The modification of the terms and conditions set forth in the MOU (2025-2028) between the City and Association are as follows:
2. Article VI, Section 1, Subsection A of the MOU shall be revised to read as follows:
B. City Work Schedules: City work schedules shall be as herein defined, except as otherwise provided for:
1. 4/10 Work Schedule: The 4/10 work schedule shall consist of a forty (40) hour work week consisting of four (4) ten (10) hour workdays, exclusive of any meal periods assigned by management.
2. 3/12.5 Work Schedule: The 3/12.5 work schedule shall consist of three (3) consecutive 12.5-hour workdays, inclusive of any meal periods assigned by Management. Additionally, with each 28-day work period, employees assigned to the 3/12.5 schedule shall work one (1) 10-hour shift, which shall be scheduled on a day immediately before or after the employee’s regular three- day workweek and shall not include any hours outside of the employee's normal working hours.
3. 3/12 Work Schedule: The 3/12 work schedule shall consist of three (3) consecutive 12-hour workdays per week, inclusive of any meal periods assigned by Management. Additionally, employees assigned to the 3/12 schedule shall work one (1) 8-hour shift every other week, which shall be scheduled on a day immediately before or after the employee’s regular three- day workweek and shall not include any hours outside of the employee's normal working hours.
The parties agree to collaborate in identifying a schedule that effectively supports the operational requirements of the dispatch center and appropriately serves the needs of the community.
Work schedules shall be posted on all department bulletin boards showing the employees’ shift, work days and where known, hours.
3.All other terms and conditions of the MOU shall remain the same.
4.This Side Letter Agreement shall become effective upon City Council approval. ___________________________________
