(Ward 2)
Recommendation:

Reconsider Adoption of Resolution No. 2026-069 for the Mayor and City Council of the City of San Bernardino, California, approving Appeal 26-09, thereby overturning the Planning Commission’s denial of Subdivision 26-03 (Tentative Parcel Map No. 21096) and Conditional Use Permit 25-02 and allowing the request to consolidate six (6) parcels into one (1) parcel to facilitate the development, establishment, and operation of a 3,684 square-foot drive-thru restaurant (McDonald’s) on a parcel containing approximately 0.74 acres, located at 116 W. Baseline Street (APN: 0146-223-22, 23, 24, 25 & 26) within the Commercial General (CG-1) and Transit-Overlay District (TOD) zone presented on June 17, 2026 (Item #3).

City Manager's Comments
Reconsideration of an item allows the Mayor and City Council to revisit a prior vote and determine whether the matter should be brought back for further consideration if one member of the Council who voted in the majority brings the motion in a timely basis prior to the next City Council meeting. Council Member Flores has requested reconsideration of agenda Item No. 3 from the June 17, 2026, Mayor and City Council meeting. The City Manager and Planner will be available for questions related to the reconsideration. If voted to reconsider the item will be brought back for a full discussion at an August public hearing.

Executive Summary
Reconsideration of Item #3 pertains to the development of a McDonald’s drive-thru restaurant in a transit-overlay district, which went before Council on June 17, 2026. At the meeting, the Council voted to deny the developer’s appeal, ultimately preventing the McDonald’s drive-thru restaurant from being developed in this district. Council Member Flores would like to have this denial reconsidered. If the Council approves reconsideration. A new public hearing on this item will be brought back to the Mayor and City Council at a meeting in August.

Council Member Flores has requested reconsideration of agenda Item No. 3 from the June 17, 2026, Mayor and City Council meeting.

According to Council Member Flores, he later learned that the City had provided notice to property owners and tenants within a 1,000-foot radius of the proposed project site, totaling more than 600 occupants and 300 property owners, while State law requires notice within 500 feet. He further stated that the proposed development would comply with applicable Development Code standards, including parking, landscaping, building setbacks, and height; improve the appearance of the currently underutilized property through new commercial development and related site improvements; and include on- site and off-site improvements funded by McDonald’s that would further improve the immediate area.
