Subject: Side Letter Agreements with Bargaining Groups
Regarding Sick Leave Accrual Language and Implement
3/12 Police Dispatch Work Schedules.

Recommendation:

It is recommended that the Mayor and City Council of the City of San Bernardino, California, adopt Resolution No. 2026-122, authorizing the City Manager to execute side letter agreements with the applicable bargaining groups and the Management/Confidential employee group to restore sick leave accrual language and implement 3/12 work schedules for eligible Police Dispatch operations employees.

City Manager's Comments
The City Manager recommends approval.

Executive Summary
The proposed action approves side letter agreements amending the 2025-2028 Memoranda of Understanding for the Police Dispatch, Police Civilian, General Unit, and Middle Management bargaining units, and the Management/Confidential Employee Compensation and Benefits Plan, to restore sick leave language that was inadvertently omitted during final preparation of the agreements.

The restored language addresses paid sick leave eligibility for regular full-time employees hired on or after July 1, 2017, consistent with the prior agreements and the parties’ stated intent.

The proposed action also approves a side letter implementing a 3/12 work schedule for employees represented by the San Bernardino Police Dispatch Association (SBPDA) and Teamsters Local 1932 Middle Management bargaining unit who are assigned to Police Dispatch operations. The revised schedule is intended to improve operational efficiency, enhance continuity of dispatch services, and provide greater staffing flexibility to support the operational needs of the Police Department. 3 4

Background
During final preparation of the 2025-2028 Memoranda of Understanding and the 2025- 2028 Management/Confidential Employee Compensation and Benefits Plan, language from the prior agreements regarding sick leave eligibility for regular full-time employees hired on or after July 1, 2017 was inadvertently omitted. To reflect the parties’ intent and maintain continuity with the prior agreements, the City and the affected employee groups have agreed to restore the omitted language. This correction applies to the Police Dispatch, Police Civilian, General Unit, Middle Management, and Management/Confidential employee groups.

Additionally, Teamsters Local 1932, representing the Middle Management bargaining unit, and the San Bernardino Police Dispatch Association (SBPDA), representing the Police Dispatch bargaining unit, requested that the City implement a 3/12 work schedule to better support Police Department dispatch operations. The proposed schedule is intended to enhance operational efficiency, improve staffing flexibility, and better meet the operational needs of the dispatch center.

Discussion
Approval of the proposed amendments will restore language that was inadvertently omitted from the 2025-2028 Memoranda of Understanding (MOUs) and the Management/Confidential Employee Compensation and Benefits Plan. Specifically, the following provision will be added to the MOUs for the Police Dispatch, Police Civilian, General Unit, and Middle Management bargaining units, as well as to the Management/Confidential Employee Compensation and Benefits Plan:
"Regular full-time employees hired on or after July 1, 2017, and who are covered by this MOU are eligible to receive thirty (30) hours of paid sick leave after the new employee has been employed with the City for ninety (90) days." In addition, staff recommends approval of the side letters authorizing the implementation of a 3/12 work schedule for employees represented by the San Bernardino Police Dispatch Association (SBPDA) and Teamsters Local 1932 Middle Management bargaining unit who are assigned to Police Dispatch operations. From an operational perspective, the 3/12 schedule is expected to reduce the number of shift changes and daily handoffs, thereby improving continuity of operations and reducing the potential for communication gaps during critical incidents. The schedule also provides greater staffing flexibility to support the operational needs of the dispatch center.

Upon approval, the following work schedule language will be incorporated into the applicable MOUs:
"3/12 Work Schedule: The 3/12 work schedule shall consist of three (3) consecutive 12-hour workdays per week, inclusive of any meal periods assigned by Management.

Additionally, employees assigned to the 3/12 schedule shall work one (1) 8-hour shift 3 4

every other week. The 8-hour shift shall be scheduled immediately before or after the employee's regular three-day workweek and shall not include hours outside of the employee's normal working schedule."
Strategic Targets and Goals
Authorizing the City Manager to execute side letter agreements with the City’s various bargaining groups support Key Strategic Goal 2. Focused, Aligned Leadership and Unified Community by building a culture that attracts, retains, and motivates the highest quality talent.

Fiscal Impact
Restoring the omitted sick leave language does not create a new fiscal impact because it reinstates language from the prior agreements and reflects the parties’ original intent.

Implementation of the 3/12 work schedule is not expected to require an additional appropriation. Any payroll impacts, including overtime, leave accounting, or premium pay, will be managed within existing departmental appropriations and administered consistent with applicable wage-and-hour requirements.

Conclusion
It is recommended that the Mayor and City Council of the City of San Bernardino, California, adopt Resolution No. 2026-122, authorizing the City Manager to execute side letter agreements with the applicable bargaining groups and the Management/Confidential employee group to restore sick leave accrual language and implement 3/12 work schedules for eligible Police Dispatch operations employees.
