CITY COUNCIL
STAFF REPORT
MEETING DATE: January 12, 2026
ITEM TITLE: Deny Claim of Robert Hopkins.
RECOMMENDATION:
Staff recommend that the City Council deny the claim of Robert Hopkins as recommended by the City’s claim administrators at Carl Warren.
FISCAL IMPLICATIONS:
None for this action.
BACKGROUND:
This item is coming before the Council to act on the claim submitted by Robert Hopkins (“Claimant”). Staff recommend that the City Council deny the claim based on Carl Warren’s guidance.
The Tort Claims Act. California Government Code Sections 900, seq., mandates that all claims for money or damages against a public entity must be presented in writing to the public entity prior to filing suit. Generally, claims concerning personal injury, wrongful death, damage to personal property, or damage to crops must be presented to the public within six (6) months of the accrual of the claim. All other claims, principally claims on contracts and damage to real property, are subject to a one-year statute of limitations for presentation of the tort claim. Once a tort claim is received by the public entity, the entity has forty-five (45) days to act on the claim. A claim can be settled or rejected. If no action is taken within 45 days, the claim is deemed rejected by operation of law on the last day.
Claim Processing in San Carlos. When the City receives a claim, it is immediately forwarded to claims examiners at Carl Warren for investigation. Upon completing the investigation, Carl Warren provides the City with a recommendation on how to proceed with the claim.
About Carl Warren. Carl Warren is a leading national third-party administrator (TPA) that specializes in property and casualty claims management, subrogation recovery, and litigation management. Effective January 1, 2025, Carl Warren was hired by Pooled Liability Assistance Network Joint Powers Authority (PLAN JPA) to provide claims administration services to member cities. The City Council approved the City’s participation in the PLAN JPA (previously known as the Association of Bay Area Government Pooled Liability Assurance Network (ABAG PLAN) on November 27, 2017, and designated the Administrative Services Director and Senior

Management Analyst as primary and alternate PLAN JPA Board members.
ANALYSIS:
On behalf of the Claimant, Ryan Daneshrad, attorney from LA Century Law, filed a claim against the City for bodily injury related to a trip and fall incident. Claimant alleged that on September 23, 2025, he was walking on Devonshire Circle and Devonshire Boulevard, where he tripped and fell over an uneven/cracked sidewalk. As a result, the Claimant sustained physical and emotional injuries, including a fractured pinky finger. The Claimant is seeking $1 million in damages.
This does not appear to be a case of liability against the City as the incident location falls within the unincorporated area of San Carlos, which is under the jurisdiction of the County of San Mateo – not the City. As such, staff recommend formal rejection of Robert Hopkin’s claim.
The Council’s rejection of this claim does not prohibit staff or the staff of Carl Warren from continuing to work with the claimant to resolve the dispute.
ALTERNATIVES:
The alternatives available to the City Council include:
1. Deny claim of Robert Hopkins; or
2. Do not deny claim of Robert Hopkins; or
3. Provide staff with alternative direction.

Rebecca Mendenhall, Administrative Services Director

CITY COUNCIL
STAFF REPORT
MEETING DATE: January 12, 2026
ITEM TITLE: Consideration of Adopting a Resolution Awarding the Recipients of the 2025 Childcare Grant Program and Authorizing the Execution of Agreements for Receipt of Grant Funds with Shu Academy Preschool ($35,654), TBD/Curious Beans by Shu Academy ($100,000), and Bright Horizons ($100,000).
RECOMMENDATION:
Staff recommend that the City Council adopt a Resolution awarding the recipients of the 2025 Childcare Grant Program and authorizing the execution of agreements for receipt of grant funds with Shu Academy Preschool ($35,654), TBD/Curious Beans by Shu Academy ($100,000), and Bright Horizons ($100,000).
FISCAL IMPLICATIONS:
There is no fiscal impact and no additional appropriation is necessary.
The City’s biennial Adopted 2025-27 Budget allocates $250,000 to the Childcare Grant Program for fiscal year (FY) 2025-26 and a further $250,000 for FY 2026-27. A total of $640,116 is available in Fund 26: the Childcare Development Impact Fee Fund, comprised of childcare impact fee payments from new non-residential development projects.
Staff recommend awarding $235,654 out of the $250,000 budgeted for FY 2025-26 to support the 2025 Childcare Grant Program. As this disbursement is within budget, no additional appropriation is required.
BACKGROUND:
In 2017, a report from the San Mateo County Child Care Partnership Council identified a deficit of 180 infant-age childcare spaces and 476 preschool-age childcare spaces in San Carlos. City staff and the City Council worked to identify strategies to address the shortage, resulting in adoption of the Childcare Development Impact Fee in 2022. The Childcare Development Impact Fee, authorized under the Mitigation Fee Act, applies to new, nonresidential developments in San Carlos (such as office, hotel, and research and development uses) and is intended to offset the increased need for childcare that accompanies new employment growth. Collected impact fees must be used to create new childcare spaces within the community and cannot be used for operational costs.
In 2024, the City Council approved the Childcare Grant Program as a means for distributing collected Childcare Development Impact Fees. The program offers local childcare providers
10.a
January 12, 2026 Packet Pg. 1125
grants of up to $100,000 for projects that expand the number of childcare spaces in San Carlos.
Applicants may use grant funds to expand an existing childcare facility, construct or acquire a new childcare facility, or remodel an existing childcare facility to accommodate a different age group (such as remodeling from a preschool childcare facility to an infant childcare facility). Full eligibility criteria and applicable uses of grant funds are outlined in Attachment 2.
In late 2024, the City conducted the first round of the Childcare Grant Program. Five local providers (Challenge School, Happy Campers, Learn and Play Montessori, Little Troopers, and The Children’s Place) submitted applications. Following review and evaluation of the applications, City Council decided to increase the FY 2024-25 program budget from $250,000 to $500,000 so that all five eligible grant applicants could be assisted.
In August 2025, the City Council approved several administrative modifications to the Notice of Funding Availability (NOFA) for the Childcare Grant Program. These included adjusting the grant frequency to an annual award basis, adding an FAQ section, removing the formula-based matching requirement, and clarifying several requirements.
Since 2017, the San Mateo County Child Care Partnership Council has gone on to sponsor two subsequent reports on childcare needs: one in 2022 and the second in 2025. The most recent 2025 report shows a continued need for infant care spaces in San Carlos, while needs for preschool-age children are largely met within the community. The 2025 report also indicates that childcare demands for school-age children (between 5 and 12 years old) could gradually be increasing. Prior to the next NOFA cycle, staff will coordinate with the Childcare Subcommittee to consider how this trend interacts with the existing grant program.
ANALYSIS:
Staff published the updated 2025 Childcare Grant Program NOFA on September 8, 2025 and accepted applications through October 3, 2025. Five providers submitted applications (Shu Academy Preschool, Grains of Good Foundation, TBD/Curious Beans by Shu Academy, Bright Horizons, and San Carlos-Belmont After School).
Nonprofit Grains of Good Foundation (Grains of Good) ultimately decided to withdraw its grant application as it had not yet identified or secured a physical location in San Carlos. City staff provided Grains of Good with zoning and related information to assist in the search for a suitable facility and encouraged the representatives to re-apply to a future year’s funding cycle.
Grant application materials submitted by the remaining four childcare providers are included in Attachment 3. The grant requests are summarized below.
Shu Academy Preschool:
Shu Academy Preschool is requesting $35,654 to complete interior and exterior renovations at its 1601 Laurel Street facility. Inside, grant funding would allow for the conversion of an underutilized storage area into classroom space. Outside, grant funds would be used to re-grade, level, and remodel part of the playground so more children can utilize the space simultaneously. The grant- funded renovations would allow Shu Academy Preschool to expand its enrollment by eight spaces.
10.a
January 12, 2026
Packet Pg. 1126
TBD/Curious Beans by Shu Academy:
The owner of Shu Academy Preschool is in escrow to purchase, remodel, and open a new daycare facility at 1622 San Carlos Avenue. The working name for the new business is Curious Beans by Shu Academy, yet that is subject to change. The applicant is requesting $100,000 in grant funding to help recover some of the initial downpayment on the $2.1 million property (an eligible activity per the NOFA). Reimbursement of a portion of the initial downpayment expenses would provide additional cash flow for tenant improvements. At the time this report was written, the applicant’s building permit materials were under review. When open, the new facility is anticipated to create between 48 and 55 new childcare spaces in San Carlos, serving children between 18 months and four years old.
Bright Horizons:
Bright Horizons is in the process of applying for an expanded State of California Day Care Center License to serve children between 12 and 24 months old. Data from across San Mateo County consistently identifies gaps in the number of childcare spaces available for this age group. Bright Horizons is requesting $100,000 in grant funding to remodel the existing playground and create a new outdoor play area suitable for children ages 12 to 24 months. Bright Horizons would supplement the grant by using its own funds to remodel the play area for the older children.
Following the playground remodel and acquisition of the expanded State license, Bright Horizons would be able to accept 24 toddlers into its program.
San Carlos-Belmont After School:
San Carlos-Belmont After School is requesting $100,000 to renovate portable structures at Brittan Acres, Heather, White Oaks, and Arundel Elementaries. The portables are rented from the San Carlos School District and accommodate children in both the pre-kindergarten and after-school programs. Grant funds would be used to renovate bathrooms and kitchens, add new storage, and replace window treatments. Staff requested further documentation from the applicant to understand how the proposed renovations would increase childcare capacity within the portable structures. As of the writing of this report, the applicant had not provided that documentation.
Childcare Subcommittee:
Staff met with the Childcare Subcommittee on November 4, 2025 to review the submitted applications. The Subcommittee recommended the grant requests from Shu Academy and Bright Horizons and requested additional time to consider the application materials from TBD/Curious Beans by Shu Academy and San Carlos-Belmont After School.
Recommended 2025 Grant Awards:
Staff recommend awarding grant funding to Shu Academy Preschool, TBD/Curious Beans by Shu Academy, and Bright Horizons. Award amounts and approved projects would be as follows:

Project
Shu Academy Preschool $35,654 Interior remodel and
playground renovation
TBD/Curious Beans by Shu Academy $100,000 Property acquisition Bright Horizons $100,000 Playground renovation
TOTAL $235,654
Without additional details showing that the proposed kitchen, bathroom, storage, and window treatment renovations would expand childcare capacity in the rented portable structures, staff is not able to recommend the application from San Carlos-Belmont After School. The applicants are encouraged to re-apply to the program in 2026 or in a subsequent grant funding cycle.
The recommended awards to the remaining three applicants total $235,654. As this is within the Childcare Grant Program’s $250,000 budget for FY 2025-26, no additional appropriation is required.
Next Steps:
If the City Council approves the 2025 Childcare Grant recipients, City staff will proceed with the grant award notification and distribution process. This will include:
informing applicants of their award status
coordinating with recipients to execute Agreements for Receipt of Grant Funds collecting documentation demonstrating that the approved capital projects have been completed
distributing grant funds
monitoring the number of new childcare spaces maintained over the coming five years.
ALTERNATIVES:
The alternatives available to the City Council include:
1. Adopt a Resolution awarding the recipients of the 2025 Childcare Grant Program and authorizing the execution of agreements for receipt of grant funds with Shu Academy Preschool ($35,654), TBD/Curious Beans by Shu Academy ($100,000), and Bright Horizons ($100,000); or
2. Do not adopt the Resolution; or
3. Provide staff with alternative direction.

3 Funding Priorities. Applications will be accepted until the deadline on Friday October 3, 2025 at 5 p.m. Each applicant must submit a grant request that best supports the adopted purpose, goals, policies and provisions of the City’s Childcare Development Impact Fee Ordinance (Ord. 1585) and 2024 San Carlos Strategic Plan Goals and Objectives to encourage and support the creation and expansion of quality childcare spaces available to residents and employees in San Carlos.
Qualification Criteria. To be considered for a grant, the childcare provider must meet the following criteria:
• Must be a commercial childcare center, family childcare home, faith-based childcare center, or non-profit childcare center located within the City of San Carlos; Public school district is ineligible
• Must be a childcare center that serves children aged 5 and under • Existing childcare providers must provide a copy of their State of California license; new childcare providers must provide a planned schedule for licensing upon start-up and provide a copy of their State license once obtained
• Must provide a copy of current business registration with the City of San Carlos (unless exempt from business registration requirements)
• Must demonstrate that funds will be used for capital improvement costs (not maintenance or operations)
• Application must be for a new capital improvement project or a capital improvement made after November 27, 2022 (the date the Childcare Development Impact Fee went into effect).
Applicants requesting retroactive grant funding will need to submit documentation showing the capital improvements and related payments were made after November 27, 2022 • Must agree to the terms in the “Agreement for Receipt of Grant Funds”
Prior recipients of Childcare Grant funds may only reapply to this program twelve (12) months after receiving their final grant payment. As such, childcare providers that received grant funding from the 2024 Childcare Grant Program are not eligible to apply for this current 2025 NOFA. Businesses interested in re-applying for future NOFAs will need to identify new capital improvement projects; applicants that received grant funding for a prior project cannot request additional funding for that same project. Prior grantees will also need to remain in compliance with their five-year reporting requirement to be considered for future Childcare Grant funding opportunities.
Project Commitment. To demonstrate long-term commitment to the childcare center, applicants must provide supporting documentation including but not limited to:
• Existing childcare providers must submit financial statements (income statement, balance sheet, or cash flow statements) to demonstrate financial viability and long-term commitment to the childcare center; new providers may submit a business plan • Copy of property deed or lease, as applicable
• If nonprofit, must provide proof of nonprofit status
• Copy of appropriate license or planned schedule for licensing upon facility start up • Must submit annual reporting and/or tracking for five years from receipt of final grant payment to demonstrate how grant funds were used to increase childcare spaces

4 Application Priorities. An application may be prioritized if a childcare provider meets one or more of the criteria below in addition to the qualification criteria above:
• Serves the infant children group (birth-2 years old)
• Accepts vouchers or provides State-subsidized childcare spaces, and/or • Serves children with special needs
Evaluation Criteria
City of San Carlos staff will evaluate applications according to the following criteria:
General Requirements (60 points; 20 points each)
• Project description and cover letter align with NOFA goals and City of San Carlos Strategic Priorities for childcare
• Application clearly explains how the indicated capital improvement(s) will result in the creation of new childcare spaces
• The funding amount requested is reasonable for the scope of work proposed
Project Commitment (40 points; 20 points each)

• serves the infant children group (birth-2 years old), • accepts vouchers or provides State-subsidized childcare spaces, and/or • serves children with special needs.
Funding Availability. The approved budget for grant expenditures from this fund for Fiscal Year (FY) 2025-26 is $250,000. Each applicant may apply for a maximum $100,000 in grant funding for a capital improvement project. The final grant amount will be determined by the City Council. Due to the limited amount of grant funds, the City Council may decide to award a childcare provider a lesser amount of grant funding than the provider originally requested. In such cases, City staff will work with the applicant to determine whether the proposed capital improvement project is still viable with a reduced award.
Funds are expected to be distributed amongst a few eligible candidates that best demonstrate the ability to meet the City’s childcare needs. The City retains sole discretion to evaluate and make grants available and is under no obligation until an agreement is executed.

6 Frequently Asked Questions
I operate a childcare business outside the City of San Carlos. Am I eligible to apply? No. Only childcare businesses located within the borders of the City of San Carlos are eligible to apply for this program.
I received a grant from the first round of this program in 2024. Am I able to reapply for this 2025 NOFA?
No. Prior grant recipients must wait twelve months after receiving their final grant payment before re-applying for another capital improvement project . Returning applicants will need to identify a new capital improvement project as the City cannot provide additional funding to a project that already received a Childcare Grant award.
My small/large family daycare is already licensed for the maximum number of childcare spaces.
Am I eligible to apply?
If you are licensed for the maximum number of spaces but are operating below full-capacity due to space limitations or other physical restrictions, the funds from this grant program could be used to make the modifications necessary to increase your capacity.
Am I able to request less than $100,000?
Applicants may request a grant of under $100,000 if a lesser dollar amount is needed to complete the capital improvement and add new childcare spaces.
Am I able to request more than $100,000?
No; the maximum grant amount possible through this program is $100,000. While some larger expansion or renovation projects may cost more than that amount , this program can only contribute a maximum of $100,000.
When will I know if my grant application has been approved? Following the close of the application process, City staff will evaluate applications for consistency with the program goals and eligibility criteria. Staff will then present the highest-rated applications to City Council for consideration during a public meeting. Although the final schedule may change, staff anticipate bringing the applications to City Council in November 2025. After that meeting, all grant applicants will be notified of their status and funding amount.
If my application is approved, when should I expect to receive my grant funds? City staff plan to present the applications to City Council in November 2025 (although the exact timing may change). If City Council chooses to award a grant to your business, you will receive an official letter from the City of San Carlos identifying your grant amount and explaining how to submit documentation for reimbursement. Due to the limited amount of grant funds, your application may be awarded less funding than you originally requested. The timeline for reimbursement will largely depend on the timeline of your project: if your project is already complete and you are able to submit all capital improvement documentation at one time, you may expect to receive your full grant amount relatively quickly. However, if your project has not yet
10.a
January 12, 2026
Packet Pg. 1137
7 started or is still underway, you may choose to submit documents on a rolling basis as different stages of the work are completed. After submitting sufficient evidence that the approved capital improvement was completed and paid for, you can generally expect to receive a reimbursement check within three to four weeks.
Is there anything else I’ll need to do after receiving my final disbursement of grant funds? Yes. To verify the grant funds have been used to create childcare spaces, you will be required to submit a monitoring form once a year for the next five years. The form will ask you to identify the average number of childcare spaces your business maintained over the previous year. Supporting documents such as current financial statements may also occasionally be requested. City staff will provide you with a copy of the monitoring form at the appropriate time.

Cover Letter – Shu Academy Childcare Grant Application
Dear City of San Carlos Childcare Grant Review Committee, On behalf of Shu Academy, I am pleased to submit our application for the Childcare Grant Program. Our proposal is strongly aligned with the City of San Carlos’ Strategic Priorities and the 2024 San Carlos Strategic Plan Goals to expand safe, high-quality childcare spaces. Below is a summary of how our project meets the evaluation criteria:
Expansion & Alignment with Goals
• Expanded licensed capacity from 40 to 55 in July 2023, yet indoor and outdoor areas remain unusable due to fixed structures and unsafe flooring.
• Proposed capital improvements will directly increase safe and usable childcare spaces for San Carlos families, and fully utilize the capacity of
55. Planned Capital Improvements
• Indoors: Remove fixed storage structures, re-level the floor, install new flooring, and connect the area to the classroom.
• Outdoors: Remove unused structures around the sandbox, regrade the ground, add a proper separator, and expand the surrounding playground area.
Project Description
• Indoor Expansion – Converting Storage to Classroom Space Shu Academy’s indoor space currently includes a storage area between two classrooms with fixed cabinets and shelving that are not suitable for childcare use. This space, as it stands, reduces the Academy’s ability to fully utilize its licensed capacity. The proposed project will:
o Remove fixed storage structures to eliminate unusable barriers.
10.a
January 12, 2026
Packet Pg. 1139
o Re-level and refinish the floor to meet safety and accessibility standards.
o Install new flooring and integrate the area with the adjoining classroom, creating a continuous, open space suitable for children’s activities.
By converting the storage area into usable classroom space, Shu Academy will increase the available indoor capacity for learning and play, improve classroom flow, and provide children with a safer, more engaging environment. This will directly result in more childcare spaces being available to families in San Carlos and a better enrollment to utilize the full capacity of 55.
• Outdoor Expansion – Reconfiguration of Sandbox Area
The current outdoor playground includes a sandbox, but the surrounding area is underutilized due to uneven ground and outdated structures. This limits the number of children who can safely play outdoors at one time. The proposed project will:
o Remove unused and unsafe structures surrounding the sandbox. o Re-grade and level the ground to maximize usable square footage for outdoor activities.
o Install a durable separator around the sandbox, ensuring sand is contained while freeing up adjacent space for safe play.
These improvements will transform the surrounding area into an expanded outdoor play space, increasing capacity and allowing multiple activity zones for children to explore simultaneously. This directly supports healthy physical development, social interaction, and overall program quality while increasing the number of childcare spaces safely supported by the center.

• Impact on Childcare Capacity
Indoor conversion will create additional usable classroom square footage, enabling Shu Academy to more comfortably serve its expanded licensed capacity of 55 children.
Outdoor reconfiguration will increase the number of children who can safely use the playground at once, improving daily scheduling and ensuring compliance with state outdoor space requirements.
Together, these improvements will expand both indoor and outdoor learning environments, making Shu Academy more accessible and responsive to the childcare needs of San Carlos families.
Financial Responsibility & Feasibility
• Shu Academy is financially stable and has demonstrated steady growth. • Signed a 10-year lease with two five-year extension options, ensuring long-term commitment to San Carlos families.
• Project will be completed within two months using two licensed construction companies; work will take place only on weekends to avoid disrupting daily operations.
Commitment to Serving Families
• Currently serving 16 toddlers beginning at 18 months old. • Participation in San Mateo County’s subsidized funding program. • Since 2023, Shu Academy’s own sponsorship program has waived over $21,000 in tuition to support low-income families.
This project will not only expand our physical capacity but also deepen our ability to serve diverse families in San Carlos with safe, inclusive, and high- quality childcare. We are confident this proposal meets and exceeds the City’s criteria for grant funding.
Sincerely,

Cover Letter – Childcare Grant Application
Dear City of San Carlos Childcare Grant Review Committee, Thank you so much for this opportunity. I am excited to submit my application for the Childcare Grant Program in support of a new childcare facility located at 1622 San Carlos Avenue, San Carlos. This project represents an important opportunity to expand access to high-quality early education and care for local families.
Role of Grant Funding
The City of San Carlos Childcare Grant would serve as the critical bridge that transforms this project from concept to reality. Specifically, the requested grant funds will be applied toward the down payment for the property purchase, enabling us to secure a permanent childcare facility rather than relying on temporary or leased spaces that limit stability and growth.
In San Carlos, extremely high property values—combined with increasing costs of development, permitting, and construction—make it financially challenging for small providers to establish or expand licensed childcare programs. On top of that, childcare facilities must meet strict building codes, safety regulations, licensing requirements, and ADA accessibility standards, all of which add substantial expense.
In addition to the property purchase, we anticipate approximately $800,000 in construction and renovation costs to bring the facility up to childcare licensing standards. These improvements include safety and fire system upgrades, accessibility compliance, and outdoor play area enhancements.
City funding would significantly reduce the financial burden and make this project achievable within a realistic timeframe.
Ultimately, city funding is not just financial assistance—it is a catalyst that enables the creation of long-term, stable, high-quality childcare infrastructure that directly benefits San Carlos families and the broader community.

Re: Bright Horizons at San Carlos Grant Application – Playground Improvements Dear Grant Committee Members,
Our San Carlos childcare center has been a cherished part of the community for more than 30 years, nurturing generations of families through high-quality early childhood education and care. Many of our devoted teachers have been with us for decades, with some serving since the center first opened. Their long-standing commitment reflects the deep trust and connection we’ve built with families over the years.
Our Center Director is a well-known and beloved presence in San Carlos. She has formed lasting relationships with families, and it’s not uncommon for her to be warmly greeted by former students and parents while out in the community—whether at the grocery store or local events. These everyday interactions speak to the meaningful role our center plays in the lives of San Carlos families and the enduring impact of the care we provide.
We are now in the process of extending our state license to serve toddlers aged 12 to 24 months. Toddler care is one of the greatest needs for families in the Bay Area, and we are committed to helping fill that gap. The biggest obstacle we face is our playgrounds: the current equipment is designed for older children and is not safe or appropriate for toddlers. To move forward with licensing, we must update these spaces to meet safety standards, State regulations, and developmental needs.
Once these improvements are made, we will be able to welcome 24 toddlers into our program. While our overall licensed capacity will not increase, this change will allow us to provide care for younger children while continuing to serve children aged two to five. Updated playgrounds will create a safe and engaging environment for all children, while helping San Carlos reach its goals to expand and support childcare options for families who live and work here.
We are proud of the history we have in San Carlos, and the trust families place in us. With the city’s support, we will be able to meet an urgent need for toddler care and continue to be a resource for the community for many years to come.
Thank you for your time and consideration.
Sincerely,
Catherine Trabanino

CITY COUNCIL
STAFF REPORT
MEETING DATE: January 12, 2026
ITEM TITLE: Consideration of Adopting a Resolution Approving the Interim City Manager Agreement, Including a 5% Base Pay Increase.
RECOMMENDATION:
Staff recommend that the City Council adopt a Resolution approving the Interim City Manager agreement.
FISCAL IMPLICATIONS:
There is no fiscal impact and no additional appropriation is necessary. The proposed 5% salary increase nominally increases the payroll expenses for the City after thirty (30) days and until appointment of a permanent City Manager. There is sufficient budget available.
BACKGROUND:
On November 24, 2025, the City Council appointed Nil Blackburn as Interim City Manager effective January 16, 2026 at 5:01 p.m., which is the effective date of Mr. Maltbie’s last regular workday. This item is placed before the City Council to extend the term of the temporary assignment pay contained in the Management Salary and Benefit Resolution to coincide with the full term of the assignment.
ANALYSIS:
Under Section 3 of the Management Salary and Benefits Resolution the Temporary Assignment allows for an increase in pay of 5%.
3. PAY FOR TEMPORARY APPOINTMENT TO A HIGHER
CLASSIFICATION When an employee has been appointed temporarily to perform the work of a position having a different classification either within or outside of the employee group and being paid at a higher rate, and if he/she has worked in such classification for five (5), but less than thirty (30) consecutive workdays, he/she shall be entitled to payment at five percent (5%) above his/her regular pay. For temporary assignments greater than 30 days, the City Manager can approve the salary rate within existing range of the new classification. Payment shall commence with the first (1st) workday of the temporary assignment and shall continue, including holidays, during the period of temporary assignment. Such appointment shall be in writing by the Department Head and approved by the City Manager or his designated representative.
10.b
January 12, 2026
Packet Pg. 1163
3 8
3 9
Although the language states that it is initially limited to 30 days, the provision also allows for the City Manager to approve a higher salary if the appointment goes over 30 days. It is likely this assignment will last for more than 30 days given the recruitment schedule. The City Manager position does not have a salary range; so, therefore the pay would remain at 5% over her existing salary during the term of her appointment.
Ms. Blackburn has accepted this appointment effective January 16, 2026 at 5:01 p.m. as well as this compensation arrangement. There are no other changes to her current compensation package. This Resolution and agreement will not otherwise affect Ms. Blackburn’s current employment status with the City.
ALTERNATIVES:
The alternatives available to the City Council include:
1. Adopt Resolution approving the interim City Manager Agreement; or
2. Do not adopt the Resolution; or
3. Provide staff with alternative direction.
Respectfully submitted by:
Gregory Rubens, City Attorney
Approved for submission by:
