Proposed Solid Waste Rate Adjustment Page 5
For the Meeting of November 14, 2023
Prop 218’s substantive requirements include:
1. Revenues derived from the fee or charge must not exceed the funds required to provide the property-related service (in this case, refuse services);
2. Revenues derived from the fee or charge must not be used for any purpose other than that for which the fee is imposed;
3. The amount of a fee or charge imposed upon any parcel or person as an incident of property ownership must not exceed the proportional cost of the service attributable to the parcel;
4. The fee or charge may not be imposed for a service unless the service is actually used by, or immediately available to, the owner of the property subject to the fee or charge; and
5. No fee or charge may be imposed for general governmental services, such as police, fire, ambulance, or libraries, where the service is available to the public in substantially the same manner as it is to property owners.
Cal. Const., Art. XIII D § 6.)
Provided there is no “majority protest” (50%+1 of all parcels) against the proposed rate increase, staff recommends the City Council hold the majority protest/public hearing, consider all evidence and testimony presented and adopt Resolution 2023-69.
DISCUSSION/ANALYSIS
To validate both the residential and commercial rate increases proposed, the City reviewed and then contracted with HF&H to conduct an analysis of the contractual compliance of the calculations, the mathematical accuracy of the calculations, and a comparison to industry benchmarks in other, similar jurisdictions. The calculations were conducted in accordance with the Agreement and were mathematically accurate. In addition, the rate proposal has been negotiated to be reflective of Waste Management’s costs of providing their service and proportional as between different ratepayer categories as required by Prop 218. Furthermore, because the fees are paid directly to Waste Management for their refuse and recycling services (including organics recovery), the fees are (i) used directly by Waste Management for its costs of making such services immediately available throughout the City, and (ii) are not otherwise allocated to other general governmental services outside of those directly attributable to solid waste services (thus satisfying Prop 218’s substantive requirements 2, 4 and 5 listed above).
ALTERNATIVES
Not applicable.
ENVIRONMENTAL REVIEW
The annual solid waste rate adjustment is exempt from the California Environmental Quality Act (“CEQA”) pursuant to State CEQA Guidelines Sections 15273(a)(1) on the grounds that CEQA does not apply to the establishment, modification, structuring, restructuring, or approval of rates, tolls, fares, and other charges that are imposed for certain purposes, such as meeting operating expenses, purchasing supplies and equipment, or funding capital projects that are necessary to maintain services within existing services areas.

Resolution 2023-69 Solid Waste Rate Adjustment Page 2
November 14, 2023
NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of San Dimas does hereby resolve that:
SECTION 1. The City Council approves the San Dimas Garbage Service’s Rate Adjustment Application to increase the solid waste collection rates by 4.70% as outlined per month for residential and commercial customers in Exhibit A, effective January 1, 2027. The Council hereby ratifies the Proposition 218 process and adopts the refuse rates proposed by Waste Management as set forth in the Notice of Public Hearing mailed to all residential and commercial property owners between September 28-29, 2023, and pursuant to Proportion 218 finds as follows:
a) Fee for Service Provided Only: Revenues derived from the fee may not be used for any purpose other than that for which the fee was imposed. The fees collected are used to pay Waste Management for the refuse collection and disposal services it provides to the City’s residential and commercial customers, and Waste Management’s accrual of direct and unforeseen costs incurred by Waste Management as a result of:
1. Increased costs related to the Consumer Price Index Adjustment of
4.70%;
2. This conclusion is further supported by all findings of fact presented at the City Council hearing, including without limitation those facts stated in the accompanying staff report, all of which evidence is incorporated herein by this reference.
b) Fee not to Exceed Cost of Service: Revenues derived from the fee may not exceed the funds required to provide refuse service. The City’s cost for refuse service is established by its agreement with Waste Management, which permits to recover its actual costs. It is found that Waste Management’s 4.70% increase per month residential and commercial rate increase will not result in more fees being collected than are needed to provide collection services in compliance with SB 1383 or other state mandates. This conclusion is further supported by all findings of fact presented at the City Council hearing, including without limitation those facts stated in the accompanying staff report, all of which evidence is incorporated herein by this reference. This conclusion is further supported by all findings of fact presented at the City Council hearing, including without limitation those facts stated in the accompanying staff report, all of which evidence is incorporated herein by this reference.
c) Fee Proportionality. The amount of a fee or charge imposed upon any parcel or person as an incident of property ownership must not exceed the proportional cost of the service attributable to the parcel. To validate both the residential and commercial rate increases proposed, the City utilized HF&H Consultants to conduct an analysis of the rate calculations. The rate proposal has been negotiated to be reflective of Waste Management’s costs of providing their service and proportional as between different ratepayer categories as required by Proposition 218. Any difference between the rates for commercial accounts versus residential accounts are directly reflective of the different costs of providing service to those respective account types (i.e., one ratepayer category is not subsidizing services for another ratepayer category). This conclusion is further supported by all findings of fact presented at the City Council hearing, including without limitation those facts
Resolution 2023-69 Solid Waste Rate Adjustment Page 3

stated in the accompanying staff report, all of which evidence is incorporated herein by this reference.
d) Other Findings. Proposition 218 also requires that the fee or charge may not be imposed for a service unless (i) the service is actually used by, or immediately available to, the property, and (ii) the fee or charge is not imposed for general governmental services. Both these findings are met. Because the fees are paid directly to Waste Management for their refuse and recycling services (including organics recovery), the fees are (i) used directly by Waste Management for its costs of making such services immediately available throughout the City, and (ii) are not otherwise allocated to other general governmental services. This conclusion is further supported by all findings of fact presented at the City Council hearing, including without limitation those facts stated in the accompanying staff report, all of which evidence is incorporated herein by this reference.
SECTION 2. The Council has fully considered this matter and has:
i. Reviewed the information submitted herewith regarding the proposed solid waste service rate adjustment for residential and commercial accounts, the parcels to which the proposed fee adjustment would apply, and the reasons and basis for the adjustment and the fees;
ii. Provided notice of the proposed fee adjustment to the record owners (or renters responsible for payment of the fee) of all parcels to which the proposed fee adjustment would apply in accordance with Article XIIID of the California Constitution;
iii. Heard and received all written protests from any owners (or occupants) of real property subject to the fee;
iv. Taken and received oral and documentary evidence pertaining to the proposed fee adjustment; and
v. Been fully informed of this matter.
SECTION 3. The Council finds that insufficient written protests were presented to prevent the residential and commercial component of the proposed Waste Management refuse rate schedule from being imposed.
SECTION 4. The Council finds that based on these facts and the circumstances and information received during the public hearing, the changes in residential and commercial refuse rates proposed by Waste Management are necessary and are hereby adopted, contingent upon there being no majority protest from a majority of all property owners under an omnibus protest by all those permitted to protest the proposed new rate system. (Morgan v. Imperial Irrigation District (2014) 223 Cal.App.4th 892.) Said refuse rates shall take effect on January 1, 2024.
PASSED, APPROVED AND ADOPTED this 14th day of November 2023. _________________________________

Dear Mr. Constantin:
Pursuant to our franchise agreement, Section 22.6, WM has completed the rate adjustment methodology for the 2024 rate year. Based on the calculation, the rate adjustment would be a 4.70% increase to current rates. This adjustment is determined by calculation 75% of the service component and 25% of the disposal component. This year’s service co
3.75% and the disposal component is .95%.
Additional fees related to the proposed 2024 residential rates include:
• Additional organic cart carts (two or more carts) $14.00 fee/per cart o This fee is being phased in two calendar years—2024 is the second phase (2023:
$7.00 and 2024: $14.00)
Attached for your review is the Schedule of the Rates for 2024 with the supporting calculation data. Should you need additional information or have any questions regarding the rate adjustment, please contact me. We look forward to proudly serving the City of San Dimas.

Staff recommends that the City Council:
• Open the public hearing as required by Proposition 218; • Take public testimony and accept any additional written protests; • Close the Public Hearing, and the Mayor shall ask the City Clerk to provide a count of all written protests received; and
• Provided there is no “majority protest” (50% + 1 of all parcels) against the proposed rate adjustment, consider all evidence and testimony presented and adopt Resolution No. 2023-69 adopting solid waste rates to be effective January 1, 2024-December 31, 2024 including a five-year adjustment methodology without the Proposition 218 notification process if the annual CPI does not exceed 5%.
