Subject: Reject All Bids Submitted for Construction Contract 2026-05 Sealcoat of Various City Streets and Parking Lots
____________________________________________________________________________
SUMMARY
Construction Contract 2026-05 Sealcoat of Various City Streets and Parking Lots was publicly bid on March 26, 2026. Staff received three formal bids, which were reviewed by City staff in consultation with the City Attorney’s Office. Staff recommends Council reject all bids for this project. The lowest bidder, Estate Design and Construction, Inc. failed to submit information regarding work they have performed of a similar character within the last five years as required under Section IB-9 of the Instructions to Bidders and Bidder’s Statement of Technical Ability and Experience. The second lowest bidder, Roy Allen Slurry Seal, Inc. did not include the signed addendum as required within Section IB-4 of the Instructions to Bidders. The sealed bid received from Carter Enterprises Group, Inc. DBA Pavement Rehab Company was significantly higher than the allotted project estimate and funding.
RECOMMENDATION
Staff recommends that City Council approve the following:
1. Reject all bids for Construction Contract 2026-05 Sealcoat of Various City Streets and Parking Lots and authorize staff to re-bid the project in accordance with Section
3.30.070(A)(1) of the San Dimas Municipal Code Rejecting Formal Bids.

BACKGROUND
Construction Contract 2026-05 Sealcoat of Various City Streets and Parking Lots includes placement of crack seal, application of sealcoat and replacement of traffic markings on various City streets and City Maintained parking lots as shown in the project location map in Attachment
1. In total this project will preserve a total pavement area of approximately 900,000 square feet.
Routine street maintenance is necessary for safety and prolonging the life of the roadway. This project will maintain our residential streets in accordance with the City’s pavement management plan, which is designed to minimize the cost of ongoing street maintenance. The sealcoat application will help extend the pavement life and serves to avoid the need for more costly asphalt overlay projects and/or pavement reconstruction.
DISCUSSION/ANALYSIS
On March 26, 2026, the City Clerk publicly opened three formal bids for Construction Contract 2026-05, Sealcoat of Various City Streets and Parking Lots. The preliminary bid results are as follows:
Contractor Base Bid
1 Estate Design and Construction, Inc. $ 214,792.73
2 Roy Allen Slurry Seal, Inc. $ 285,806.08
3 Carter Enterprises Group, Inc. DBA Pavement Rehab
Company
$ 636,341.76
Following the bid results, Staff reviewed the bid proposals in consultation with the City Attorney’s Office and recommends that Council reject all bids and authorize staff to re-bid the project due to the following:
1. The sealed bid submitted by Estate Design and Construction, Inc. failed to include information regarding work they have performed of a similar character within the last five years as required under Section IB-9 of the Instructions to Bidders and Bidder’s Statement of Technical Ability and Experience. Estate Design and Construction submitted documentation of recent projects, however none of the projects included seal coat or crack sealing. After discussion with Estate Design and Construction, the contractor indicated they had no seal coat or crack seal experience which is required by Section IB-9 of the project specifications.
2. The sealed bid submitted by Roy Allen Slurry Seal, Inc. was reviewed by City Staff. Staff found that the sealed bid did not include the signed addendum as required within section IB-4 of the Instruction to Bidders. Section IB-4 Addenda or Bulletins, specifically states the following:
“The effect of all addenda to the Contract Documents shall be considered in the bid, and said addenda shall be and are made a part of the Contract Documents and shall be returned with them. Before submitting their bid, each bidder shall be responsible to discover whether or not any addenda have been issued, and the bidder’s failure to include any such addenda issued shall render their bid informal, and result in its rejection.

3. The sealed bid submitted by Carter Enterprises Group, Inc. DBA Pavement Rehab Company was significantly higher than the project estimate and funding.
Section 3.30.070 Rejecting Formal Bids states that the following rules apply to rejecting formal bids for public projects.
A. In accordance with Public Contract Code Section 22038, the city council may, in its discretion, reject any bids presented, if the city, prior to rejecting all bids, furnishes a written notice to an apparent low bidder. The notice shall inform the bidder of the city's intention to reject the bid and shall be mailed at least two business days prior to the city council meeting at which the city intends to reject the bid. If after the first invitation of bids all bids are rejected and after reevaluating its cost estimates of the project, the city shall have the option of either of the following:
1. Abandoning the project or re-advertising for bids in the manner described by this chapter.
2. Have the public project done by force account without further complying with this chapter, provided the city council has passed a resolution by a four fifths vote declaring that the project can be performed more economically by city employees.
B. Lowest Bidder. If a contract is awarded, it shall be awarded to the lowest responsible bidder.
C. No Bids. If no bids are received through the formal or informal procedure, the project may be performed by the employees of the city, by force account, or negotiated contract without further complying with this chapter.
(Ord. 1271 § 2, 2019; Ord. 1318, 12/10/2024)
Section 3.30.070 of the San Dimas Municipal Code allows the City Council to reject formal bids provided that the City provides written notice of this decision to the apparent low bidder at least two days prior to the City Council Meeting at which bids may be rejected. City Staff provided notice to all bidders on May 21, 2026.
ALTERNATIVES
The City Council may choose from the following alternatives:
1. If Council does not wish to re-bid the project, Council could direct staff to award a contract to the lowest responsible bidder. Staff would further evaluate all available options including any required additional budget allocation for Council’s review at a future Council Meeting.
ENVIRONMENTAL REVIEW
Staff evaluated and determined that CC2026-05 Sealcoat of Various City Streets and Parking lots is categorically exempt per CEQA under the “Class 1” (14 CCR §15301) exemption. This is considered maintenance of an existing infrastructure; no modifications to traffic flow and no additional vehicle travel lanes will be created.

Subject: Update on Pavement Conditions on Valley Center Avenue ____________________________________________________________________________
SUMMARY
Council requested an update regarding existing pavement conditions and planned pavement rehabilitation activities along Valley Center Avenue, with specific interest in the segment between Gladstone Street and Juanita Avenue.
RECOMMENDATION
Staff recommends that the City Council:
• Receive and file the update.

BACKGROUND
At the May 12, 2026, Meeting, Council requested an update regarding paving condition on Valley Center Avenue, with particular interest in the segment between Gladstone Street and Arrow Highway.
DISCUSSION/ANALYSIS
Update on Pavement Conditions on Valley Center Avenue from Gladstone Street to Juanita Avenue. Page 2
For the Meeting of May 26, 2026
Valley Center Avenue begins at Allen Avenue as a primarily residential two-lane roadway. Just north of Arrow Highway, it transitions to a four-lane roadway and continues south to Gainsborough Road. Valley Center Avenue traverses multiple jurisdictions. Attachment 1 provides an aerial detail of the various jurisdictional boundaries.
The table below summarizes the roadway jurisdiction, current Pavement Condition Index (PCI), and previous or planned maintenance activities for each segment of Valley Center Avenue.

San Dimas 48 Slurry Seal and Carack Seal 2024; Reevaluation 2026 As Council expressed particular interest in the segment from Gladstone Street to Arrow Highway, staff contacted the City of Glendora to obtain additional information regarding pavement condition and planned rehabilitation efforts for this portion of Valley Center Avenue.
Below is the response from the Assistant Public Works Director:
” Based on the Pavement Management Plan, the segment of Valley Center Avenue from Arrow Highway to Juanita Avenue has a Pavement Condition Index of approximately 28, which indicates a higher rehabilitation need. The segments north of Juanita Avenue are currently in significantly better condition, with PCI values of approximately 90 from Juanita Avenue to Gladstone Street and 77 from Gladstone Street to Allen Avenue.
Valley Center Avenue is not currently included in the City’s adopted 5-Year Capital Improvement Program; however, staff is currently compiling a list of street improvements to recommend to the City Council as part of a future amended 5-Year CIP. The Valley Center Avenue segment, from Arrow Highway to Juanita Avenue, is

included for review as part of that effort (subject to available funding and coordination with any underground utility work that could affect the timing of street improvements). While we do not have a construction date at this time, we are hopeful that, pending available funding and City Council approval, this segment can be addressed in the near future.”
Los Angeles County currently does not have any rehabilitation projects scheduled for the segments of Valley Center Avenue between Arrow Highway and Badillo Street.
Valley Center Avenue south of Badillo Street is within the City of San Dimas’ jurisdiction. The City currently plans to complete slurry and crack seal improvements in 2027 for the segment between Badillo Street and Cypress Street. The segments south of Cypress Street received slurry seal and crack seal treatment as part of the City’s 2024 pavement maintenance program.
The City is currently conducting a citywide pavement management update, which includes a reevaluation of all streets and associated Pavement Condition Index values. This update will review all pavement segments and reassess future rehabilitation timing and recommended treatment methods. The pavement management update is being completed by Nichols Consulting Engineers (NCE). The update is estimated to be completed in September of 2026.

SUMMARY
At its meeting of February 24, 2026, the City Council requested that staff provide a 90-day progress update on the project to restore the historic Santa Fe Cantilever Railroad Signal.
This report provides that requested update.
RECOMMENDATION
City staff recommends that the City Council:
• Receive the report and provide direction to staff.

BACKGROUND
The City Council will receive an update on the project to restore and relocate a historic Santa Fe Railroad cantilever signal and historic caboose to the San Dimas Railroad Museum. The City Council accepted the donation of the cantilever and approved the project on April 13, 2021. The City Council subsequently accepted the donation of a caboose on September 28, 2021. Since the

City Council’s acceptance of these donations, staff has learned that the caboose is no longer available for this project.
At its meeting of February 24, 2026, the City Council received a report from volunteer project coordinator, Paul LaCiura on his efforts to complete the project. At the conclusion of the meeting, the City Council asked staff to schedule another progress update in 90 days specifically to report the following:
1. Fundraising - If 25% of project costs have been raised for the $60,000 project ($15,000);
2. Letters of Support - If Mr. LaCiura obtained written verification from Los Angeles Metro and Burlington Northern Santa Fe Railroad (BNSF) that the placement of the cantilever and rail signal will not interfere with their use of the track; and
3. Project Timeline - Confirmation from Mr. LaCiura that the project is still on schedule to be completed no later than Thanksgiving, 2026 (November 26, 2026).
DISCUSSION/ANALYSIS
Fundraising - Mr. LaCiura was able to collaborate with the Pacific Rail Society to develop a “Go Fund Me” page to solicit donations for the project. To date, $6,000 has been raised to complete the project. This includes donations made through the through the Go Fund Me page ($2,900), other donations the Pacific Rail Society has received to support the project ($1,500) and funds that are available in the project bank account ($1,600). This falls short of the 25% of funds the City Council had requested to be raised after 90 days, as $6,000 raised for a project that costs $60,000 represents 10% of the total budget. Mr. LaCiura states that the Pacific Rail Society and the Santa Fe Rail Society have agreed to publicize the project to assist in soliciting future donations. Mr. LaCiura also continues to solicit donations of materials and labor from local rail contractors.
Letters of Support - Mr. LaCiura reports that he has not secured written approval for the project from Los Angeles Metro or BNSF, confirming that the placement of the cantilever and rail signal will not negatively impact the use of the rail track by other operators. He states that he has contacted these organizations and is awaiting a response.
Project Timeline - Mr. LaCiura believes that the project still can be funded and completed by the end of 2026.
ALTERNATIVES
1. The City Council could provide additional time to Mr. LaCiura to raise the funds needed to complete the cantilever rail signal project and to obtain written acknowledgment from Los Angeles Metro and BNSF that the placement of the cantilever signal will not negatively impact rail operations. Under this scenario, it is uncertain when sufficient funds could be raised or when the project could move forward.
2. The City Council could decide not to proceed with the cantilever rail signal project. Under this scenario, Mr. LaCiura would be responsible for removing the cantilever from Horsethief Canyon Park. Staff would work with Mr. LaCiura to remove the cantilever within 90 days of the City Council‘s decision not to proceed with the project.
Progress Report on the Project to Restore a historic Santa Fe Cantilever Railroad Signal and Relocate it to the San Dimas Railroad Museum in Rhoads Park. Page 3 For the Meeting of May 26, 2026
Mr. LaCiura has indicated that other parties are interested in the potential donation of the cantilever and rail signal, including the Pacific Electric Society in Pasadena and the Travel Town rail museum, located in Griffith Park. In either case, Mr. LaCiura states that the new recipient of the cantilever and rail signal could potentially provide the necessary equipment to remove the cantilever from the park.

Approval of SB 707 Policies for City Council Meetings Page 2 For the Meeting of May 26, 2026
BACKGROUND
At the April 14, 2026, City Council Study Session, the City Council reviewed Senate Bill 707 teleconferencing and remote participation requirements and discussed the use of Zoom and hybrid meeting participation for public meetings. The Council directed staff to return with additional policy language and operational procedures for further review and direction.
The discussion focused on balancing public access and participation rights under the Brown Act with the City’s responsibility to maintain orderly and legally compliant meetings. Council also discussed practical operational issues related to remote participation, including disruptive conduct, visual presentation standards, speaker management, and accessibility accommodations.
DISCUSSION/ANALYSIS
SB 707 expands Brown Act teleconferencing requirements by establishing new remote participation rules for legislative body members and enhanced public access and language accessibility requirements, effective January 1, 2026, and July 1, 2026, respectively. During the April 14, 2026 Study Session, the City Council discussed implementation issues related to video participation, call-in access, Zoom administration procedures, disruptive conduct enforcement, digital filters, public comment logistics, accessibility accommodations, and legally defensible enforcement standards consistent with the Brown Act and First Amendment requirements.
SUMMARY OF MODIFICATIONS TO THE ORIGINAL POLICY
Following direction provided by the City Council during the April 14, 2026, Study Session, staff and the City Attorney revised and expanded the proposed SB 707 Virtual Participation and Enforcement Procedures to address operational, legal, and administrative concerns identified during Council discussion.
Key modifications to the original draft policy include the following:
• Clarified Video Participation Requirements and Call-In Access The revised policy now expressly distinguishes between participants using Zoom video participation and participants joining by telephone only. The policy permits call-in participation without video while requiring video for participants using the Zoom audiovisual platform. Language was also added that background blur features will be permitted, but all other visual filters or digital masking features that obscure the speaker’s appearance will be disabled.
• Formalized Zoom Administration Procedures
Additional operational procedures were incorporated regarding participant muting, use of the “raise hand” feature, speaker order management, active speaker display protocols, neutral screen backgrounds, and disabling of Zoom chat functions. These modifications implement Council direction intended to improve meeting administration, reduce distractions, and provide more consistent public participation procedures. • Expanded Participant Identification Standards
Approval of SB 707 Policies for City Council Meetings Page 3 For the Meeting of May 26, 2026
The revised policy includes more detailed standards governing participant display names, including prohibitions on names that are obscene, incite violence, impersonate others, or materially disrupt the orderly conduct of the meeting. The policy also authorizes administrative renaming of participants for compliance and operational purposes. • Added Legally Defensible Standards for Disruptive Conduct and Speech To address First Amendment concerns raised during Council discussion, the revised policy prohibits obscene speech, incitement of violence, threats of violence, and speech outside the subject matter jurisdiction of the City Council, and for other types of speech such as profanity, racist, or abusive speech, incorporates the statutory standard requiring that prohibited conduct or speech “actually disrupt, disturb, impede, or render infeasible the orderly conduct of the meeting.” This standard was applied consistently throughout the policy in connection with speech, visual content, participant names, and meeting disruption enforcement provisions.
• Clarified Enforcement Authority and Staff Roles
The revised policy provides that the Presiding Officer is responsible for determining when muting, removal, or limitation of participation is appropriate, while staff’s role is limited to implementing those directions. However, the presiding officer may seek input from staff or advice from the City Attorney to assist in making enforcement decisions. • Enforcement Procedures
The policy requires a verbal warning to any member of the public in violation of the policy.
If the behavior continues, the participant may be muted, video disabled, renamed, or removed from the meeting entirely, as needed based on the conduct in question as determined by the presiding officer.
• Added Public Comment Administration Procedures
New language was added regarding speaker recognition, time limits, and limitations on repetitive comments during public comment periods, while preserving protections for lawful criticism of the legislative body.
• Added Documentation and Safe Harbor Provisions
The revised policy now authorizes staff documentation of enforcement actions and incorporates Brown Act “safe harbor” language addressing inadvertent procedural errors in policy implementation.
Overall, the revisions were intended to create a more operationally clear, legally defensible, and administratively consistent framework for remote public participation while preserving public access rights and maintaining orderly meeting procedures.
ALTERNATIVES
The City Council may wish to direct staff to modify the draft policies prior to adoption.

1.0 BACKGROUND
Senate Bill 707 (2025) amended the Brown Act to require eligible legislative bodies to adopt, on or before July 1, 2026, a policy addressing how the agency will respond to disruptions in telephonic or internet service that prevent members of the public from attending or observing a meeting remotely. This policy is adopted to comply with that requirement and to ensure continuity of public participation during technical disruptions.

“The City Council has made good faith efforts to restore telephonic or internet service in accordance with its adopted policy, and the public interest in continuing the meeting outweighs the public interest in remote public access.” Upon adoption of the finding, the legislative body may proceed with the open session even though remote access services have not been restored.
3. RECORDKEEPING
The Clerk shall enter a brief statement into the meeting minutes, including the following:
• The nature and time of the disruption

FISCAL IMPACT
Adopt Resolution 2026-32 Confirming the Diagram and Assessment for Fiscal Year 2026-27 for Open Space Management District No. 1 (Tract No. 32818, Boulevard). Page 2 For the Meeting of May 26, 2026
The funds collected from the assessment are used to offset costs incurred by the City for the maintenance of the Boulevard Landscape District. The fund balance for the Boulevard Assessment District has decreased in recent years due to activity, including extensive tree removal. An assessment increase is recommended to reflect a change in the Consumer Price Index and is proposed to stay current with maintenance expenses for this district. The assessment rate for the Fiscal Year 2025-26 was $643.98 per parcel. The rate proposed for Fiscal Year 2026-27 is $662.66 per parcel, an increase of $18.68.
BACKGROUND
On March 24, 2026, the City Council adopted Resolution 2026-21 approving the Engineer’s Report and declaring its intention to levy and collect an assessment for fiscal year 2026-27 for Open Space Maintenance District No. 1 (Tract No. 32818 - Boulevard) and set a Public Hearing for May 26, 2026. The Boulevard Assessment District includes 19 homes, as noted in the Engineer’s Report.
Quarterly maintenance service in the Boulevard Assessment District is provided in January, April, July, and October of each year. The trees in the District were last trimmed on the grid pruning schedule in Fiscal Year 2022-23 and are scheduled to be trimmed again in Fiscal Year 2026-27.
In addition to scheduled tree pruning that is performed at four-year intervals, a City arborist provides tree maintenance services throughout the year, as needed.
DISCUSSION/ANALYSIS
The Engineer’s Report was prepared with the scope of work to include quarterly general landscape maintenance, tree trimming, water and electricity, and an assessment increase of
2.9%, reflective of the change in the Consumer Price Index between February 2025 to February 2026. The 2025-26 assessment rate was $643.98 per parcel. The recommended authorized assessment rate for Fiscal Year 2026-27 would increase by 2.9% or $18.68 per parcel, which equates to an annual assessment rate of $662.66 per parcel.
Upon the conclusion of the Public Hearing, staff recommends that the City Council adopt Resolution 2026-32 to increase the annual assessment by $18.68 per parcel, from $643.98 to $662.66 for FY 2026-27 to reflect the increase in the Consumer Price Index rate of 2.9% for the Open Space maintenance District No. 1 (Tract No. 32818 – Boulevard) for FY 2026–27. This option would result in a projected ending fund balance of $156.04.
ALTERNATIVES
1. The City Council could elect not to adopt Resolution 2026-32, Boulevard Assessment District and move forward to keep the same assessment of $643.98 in FY 2026-27. This option would result in a negative fund balance of $198.88.

RECOMMENDATION
City staff recommends that the City Council:
• Conduct a public hearing on the proposed assessment rate for Open Space Maintenance District No. 1, Annexation No. 3 (Tract No. 32841, Northwoods) for Fiscal Year 2026-2027

FISCAL IMPACT
The funds collected from the assessment are used to offset costs incurred for maintenance of the Northwoods landscape district. The Assessment District was created in 1978 without an allowance for an annual Consumer Price Index (CPI) or other rate adjustment outside of that allowed per Government Code Section 53753 which requires a vote from all properties within the

district. At this time, the fund balance for the Northwoods Assessment District is negative with a shortfall of $25,686.29. The Engineer’s Report does not call for an increase.
BACKGROUND
The Northwoods Open Space Maintenance District was formed in 1978 under the provisions of the Landscape and Lighting Act of 1972, Division 15, Part 2, of the Streets and Highways Code of the State of California. The City collects an annual assessment from 38 private homeowners to provide general maintenance services to the landscape district. The Streets and Highways Code of the State of California further establish procedures for the annual levy of assessments, which includes the approval of an Engineer’s Report that estimates anticipated expenses incurred by the City for maintaining the area in the upcoming fiscal year.
On March 24, 2026, the City Council adopted Resolution 2026-22 approving the Engineer’s Report and declaring its intention to levy and collect an assessment for fiscal year 2026-27 for Open Space Maintenance District No. 1, Annexation No. 3 (Tract No. 32841 - Northwoods) and set a Public Hearing for May 26, 2026.
DISCUSSION/ANALYSIS
The Engineer’s Report was prepared with the scope of work to include general landscape maintenance, tree trimming, water, and electricity on a quarterly basis.
The residents of the Northwoods Assessment District were given the option to vote for an increase in the assessment on May 9, 2023. The vote was opposed by 70% of the ballots submitted. At meetings prior to the vote, residents vehemently voiced opposition to any future increase in the assessment, as well.
The City Council then directed staff to revise the original Engineer’s Report for reduced maintenance to correspond to the amount that is collected through assessments. The revised report reflects the following reduced Scope of Work: elimination of tree trimming, reduced irrigation and reduced utilities. The quarterly maintenance service will remain. The responsibility of property owners within the district to maintain the landscaping, trees, and irrigation system on their properties in compliance with Municipal Code property maintenance requirements will remain. All trees included in the Northwoods Assessment District are on private property.
No increase is proposed in the Assessment rate for Fiscal Year 2026-27. The 2025-26 assessment rate was $898.42 per parcel. In Fiscal Year 2026-27, homeowners will be assessed ½ of the annual assessment, or $449.21, to pay for maintenance services for ½ year, from July, 1, 2026 through December 31, 2026).
The assessment sunsets on January 1, 2027, at which time the City will no longer have any responsibility in the maintenance of these properties. City staff sent a letter to property owners in the Northwoods Assessment District on January 13, 2026 notifying them that the City will cease maintaining properties in the Northwood District after January 1, 2027. Staff did not receive any phone calls, inquiries or questions regarding the scheduled sunset date.
ALTERNATIVES
Adopt Resolution 2026-34, Confirming the Diagram and Assessment for Fiscal Year 2026-27 for Open Space Maintenance District No. 1, Annexation No. 3 (Tract 32841, Northwoods) Page 3 For the Meeting of May 26, 2026
The Council could elect not to adopt Resolution 2026-34, Northwoods Assessment District and move forward without an approved assessment which would lead to all costs associated with maintenance of trees within the Northwoods Assessment District being supplemented by the General Fund.

Pursuant to CEQA guidelines Section 15061 (b)(3), CEQA does not apply to this item because there is no potential for causing a significant effect on the environment. Therefore, no additional environmental review is needed at this time.
