AGENDA REPORT
ADMINISTRATIVE SERVICES DEPARTMENT 117 MACNEIL STREET, SAN FERNANDO, CA 91340 (818) 898-1200 WWW.SANFERNANDO.GOV REVIEW: ☒ City Clerk ☒ Director of Admin. Services ☒ City Manager To: Mayor Victoria Garcia and Councilmembers
From: Kanika Kith, City Manager
By: Erica D. Melton, Director of Administrative Services

Date: September 8, 2026
Subject: Consideration to Adopt a Resolution Approving the Warrant Register RECOMMENDATION:

It is recommended that the City Council adopt Resolution No. 26-091 (Attachment “A”) approving the Warrant Register.

BACKGROUND:

For each City Council meeting the Finance Division prepares a Warrant Register for City Council approval. The Register includes all recommended payments for the City. Checks, other than special checks, generally are not released until after the City Council approves the Register. The exceptions are for early releases to avoid penalties and interest, excessive delays and in all other circumstances favorable to the City to do so. Special checks are those payments required to be issued between Council meetings such as insurance premiums and tax deposits. Staff reviews requests for expenditures for budgetary approval and then prepares a Warrant Register for City Council approval and or ratification. Items such as payroll withholding tax deposits do not require budget approval.

The Director of Administrative Services/City Treasurer hereby certifies that all requests for expenditures have been signed by the department head, or designee, receiving the merchandise or services thereby stating that the items or services have been received and that the resulting expenditure is appropriate. The Director of Administrative Services/City Treasurer hereby certifies that each warrant has been reviewed for completeness and that sufficient funds are available for payment of the warrant register.

ANALYSIS:

The San Fernando Pacoima Wash Bikeway and Pedestrian Path Project constructed a new bikeway and pedestrian bridge along the Pacoima Wash within the City, extending from Fourth Street/Bradley Avenue to the Cindy Montañez Natural Park. The newly constructed pedestrian and bicycle bridge at Eighth Street provides an important connection for students, residents, and visitors to the new trail, while expanding opportunities for recreation and providing additional options for bicycle and pedestrian commuting.

The Pacoima Wash Bikeway also provides a safe alternative to bicycling along local streets, consistent with the recommendations identified in the City’s Safe and Active Streets Plan. The project enhances connectivity to the broader bicycle and pedestrian network in neighboring communities within the City of Los Angeles and supports the development of a more connected and accessible active transportation system. Similar to the Los Angeles River Bike Path, the Pacoima Wash Bikeway transforms an underutilized area into a linear green space that improves the appearance of the surrounding area while providing valuable recreational and transportation benefits to the community.

This project consisted of constructing a 12-foot wide, 1.34-mile-long Class 1 asphalt concrete bikeway. Additional improvements constructed as part of the project included:
a. Construction of bioretention areas;
b. Construction of retaining walls;
c. Fabrication and installation of bike/pedestrian bridge; d. Installation of rectangular rapid flashing beacons for crosswalk; e. Installation of welded wire fencing;
f. Installation of solar lights;
g. Installation of protective bollards;
h. Installation of signage, striping, markings; and
i. Construction of wheelchair ramps to meet current Americans with Disability Act (ADA) standards.

The construction manager, design engineers, inspectors, and staff inspected the project and confirmed that the contractor completed the project in accordance with the approved plans, September 8, 2026 Special & Regular CC Mtg Page 123 of 202 Consideration to Accept Project Completion and Authorize the Recordation of a Notice of Completion for the San Fernando Pacoima Wash Bikeway and Pedestrian Path, Federal Project No. ATPL-5202(020), Job No. 7615, Plan No. P-737

specifications, and change orders. Staff therefore recommends filing a Notice of Completion with the Los Angeles County Registrar-Recorder/County Clerk.

BUDGET IMPACT:

Funding for this project was included in the Fiscal Year 2026-2027 Adopted Budget. Several funding sources, including the Congestion Mitigation and Air Quality Improvement Program (CMAQ) grant, Active Transportation Program (ATP) Cycle 3 grant, South Coast Air Quality Management District (AQMD)/ The Mobile Source Air Pollution Reduction Review Committee (MSRC) Assembly Bill (AB) 2726, Measure R, Measure M, Santa Monica Mountain Conservancy (SMMC) grant, and Caltrans Grant Funding were utilized to complete this project.

A total of 17 change orders were generated during the project for revisions to aerial design survey, topographic survey, revisions to construction plans, remedial grading not initially delineated on plans, environmental mitigations, unforeseen underground conditions, encounter with large boulders requiring additional heavy equipment and labor, additional safety fence, modifications to drain lines, modifications to bridge abutments, potholing for waterlines, retaining wall foundation modification, shoring for retaining walls, concrete riprap at retaining walls, buried asphalt, increase fence height, and adjustment of bid quantities. The change orders totaled $1,081,412 which were covered by the funding sources budgeted for this project.

The total construction cost of $6,945,012 included change orders, contingencies, construction management, construction inspection, construction testing, and construction support, and was under the total approved budget of $11,982,491. The remaining funds from Caltrans Grant (Luz Rivas) will be used for the design and construction of the Pacoima Wash Connectivity Project.

CONCLUSION:

Staff recommends the City Council accept the improvements as constructed by Toro Enterprises, Inc., and consider the work completed for San Fernando Pacoima Wash Bikeway and Pedestrian Path, Federal Project No. ATPL-5202(020), Job No. 7615, Plan No. P-737; authorize the issuance and filing of a “Notice of Completion” with the Los Angeles County Office of the Registrar-Recorder/County Clerk; authorize the release of the five (5) percent retention amount of $302,831.20 after the 35-day lien period from the date the Notice of Completion is recorded; and authorize the closure of escrow account.

Subject: Consideration to Approve the Small Business Grant Program Guidelines for Fiscal Year 2026-2027
RECOMMENDATION:

It is recommended that the City Council:
a. Approve the Fiscal Year (FY) 2026-2027 Small Business Grant Program Guidelines; and b. Provide staff direction, as applicable.

BACKGROUND:

1. On June 9, 2025, staff met with the CDBG Program’s Ad Hoc Committee to discuss recommended Community Development Block Grant (CDBG) program allocations for Fiscal Year (FY) 2025-2026. The recommended programs were the Neighborhood Clean-up Program, Access to Capital Program, and the Small Business Assistance Program.

2. On September 2, 2025, the City Council approved a CDBG allocation of $26,000 for the Neighborhood Clean-Up Program, $137,861 for the Small Business Assistance Program, and $25,000 for the Access to Capital Program, with the Access to Capital Program Guidelines to return to the City Council for final approval.

3. On March 16, 2026, City Council approved the guidelines for the Access to Capital program.

4. On March 26, 2026, staff met with the CDBG Programs Ad Hoc Committee to discuss recommended CDBG program allocations for FY 2026-2027. The two (2) recommended programs were the Neighborhood Clean-up Program and the Small Business Assistance Program. The Ad Hoc also recommended changes to the Small Business Assistance Program’s guidelines to include additional eligible uses.

5. On April 6, 2026, the City Council adopted Resolution No. 8444 approving the CDBG funding allocation for the 52nd Program Year (FY 2026–2027) and directed staff to update the Small Business Assistance Program Guidelines to allow the use of funds for interior business improvements, installation or upgrades to outdoor dining areas, payment of City permit fees required for grant-related work, and to require recipients to provide receipts for all items purchased with grant
ANALYSIS:

In 1974, the Community Development Block Grant (CDBG) Program was enacted through the Housing and Community Development Act of 1974. The City receives an annual allocation of CDBG funding from the United States Department of Housing and Urban Development (HUD) through its participation in the Los Angeles Urban County CDBG Program administered by the Los Angeles County Development Authority (LACDA). CDBG funds can only be used for eligible Community Development projects meeting national program goals, which include assisting the low and moderate-income residents of the community.

A total of $171,988 in CDBG funds is available for FY 2026-2027. On April 6, 2026, the City Council approved the continuation of two (2) established programs from FY 2025-2026 to extend the opportunity for more residential and business owners to improve the aesthetics of their properties. The Council approved two (2) programs which are:

1. Neighborhood Clean-Up Program (Recommended budget: $25,798) – This program supports efforts to keep the City clean, safe, and welcoming. For FY 2026–2027, the focus will shift from individual service grant awards to funding several organized neighborhood clean-up events across the City, including bulky item collections and other community clean-up initiatives. The recommended budget is 15% of the total annual budget, which is the maximum eligible funding amount allowable for public service projects or programs.

2. Small Business Assistance Program (Recommended Budget: $146,190) – Continue to support local small businesses, by providing up to $10,000 per business for improvements that enhance storefronts, their interior spaces and outdoor dining. By supporting these enhancements, the City not only strengthens its business community and property values but also establishes San Fernando as a desirable destination, enhancing community pride and encouraging sustainable growth.

Proposed FY 2026-2027 SBAP Guidelines.

The Small Business Assistance Program have previously been used for exterior business improvements to signage, painting (including anti-graffiti coating), outdoor security cameras, window shade, and other storefront enhancements such as installing eye-catching vertical landscape (green wall) to deter graffiti.

9. On August 31, 2026, the City met with Emprende to discuss the MOU, during which Emprende proposed revisions and also presented an alternative option to produce the parade independently without a City-approved MOU.

ANALYSIS:

A Christmas Parade is a valuable community building and economic development event. It draws large crowds that boost foot traffic for local stores and restaurants, supporting businesses along the route and throughout the City. At the same time, the parade strengthens community connections by bringing residents together in a joyful, family friendly celebration. It offers meaningful participation opportunities for local performers, organizations, and families, fostering civic pride and encouraging continued support for the City and its businesses.

Emprende is a Section 501 (c)(3) nonprofit organization dedicated to empowering communities through education, cultural enrichment, leadership development, self-esteem building, entrepreneurship, and spiritual growth. Their mission includes a commitment to creating opportunities that strengthen individuals, families, and community. Through engagement spanning back to Fall 2025, staff has worked with Emprende to develop the framework for a Christmas Parade event that will accompany the City’s Annual Tree Lighting Ceremony.

On June 29, 2026, the City Council approved the 2026 Christmas Parade, to be held in coordination with the City’s Annual Tree Lighting Ceremony. This approval was contingent upon September 8, 2026 Special & Regular CC Mtg Page 146 of 202 Discussion and Consideration of Proposed Revisions to Memorandum of Understanding with Emprende to Produce a Christmas Parade in Coordination with the City’s Annual Tree Lighting Event and to Reimburse the City for Related Parade Expenses

finalizing an MOU with Emprende that outlined a defined scope of work and a process for collecting fundraising revenue to reimburse all parade‑related expenses totaling $37,718. This amount covers City staff costs, Los Angeles Fire Department, other related permit fees, and a traffic control plan. The City Council provided additional direction to include in the MOU, for Emprende to be responsible for completing the following scope of work:
a. Emprende to form a community committee that will meet more often than monthly to support parade planning efforts.
b. Emprende to provide rules to be established regarding sponsorship criteria. c. Emprende to provide bi-weekly updates on sponsorship activities beginning in August. d. Emprende to create a sponsorship flyer for their use that will be separate from a City created Save the Date flyer and Event flyer for all the events taking place that day which includes the parade, tree lighting, and photographs with Santa.

On July 20, 2026, the City Council approved the MOU with Emprende to produce a Christmas Parade in coordination with the City’s Annual Tree Lighting event and to reimburse the City for related Parade expenses. The City Council also provided direction to staff and requested that the following revisions be incorporated with the MOU:
a. City to design and post the “Save the Date” flyer and event detail flyer with no sponsorship information and advertise the event through the City's social media outlets. b. Emprende to solicit sponsorship information on Emprende website. c. Staff to provide update on sponsors and participants, through bi-monthly reporting by Emprende, in the Status Updates for City Projects and City Council Priorities agenda report that is a recurring item included in the City Council agenda packets. d. Emprende to provide small discount to businesses and non-profit organizations based in the community if participating in the event.

Following City Council direction, staff worked with the City Attorney to incorporate the approved revisions into the MOU. The revisions clarified each party’s responsibilities and deadlines to improve coordination between Emprende and the City. The City Attorney also incorporated additional provisions addressing City Council’s direction regarding financial reporting, including further clarification of Emprende fundraising efforts and revisions to the insurance provisions.

On August 17, 2026, the City Council approved the revised MOU incorporating all the changes recommended by the City Attorney and provided staff with direction to meet with Emprende and return with any proposed changes to the MOU at a future City Council meeting.

MOU Amendment Requests from Emprende.

On August 31, 2026, staff met with Emprende to review the City Council-approved MOU. During the meeting, Emprende proposed several revisions and explained that it would need to raise additional funds beyond the City’s $37,718 contribution to cover the costs of producing the parade.

Emprende proposed using fundraising proceeds, after reimbursing the City, to cover eligible parade-related expenses, including volunteer food and gas stipends, staff time, entertainment, stage and sound costs, and marketing. Staff requested a detailed parade budget to support these expenses. Emprende provided an organization report (Attachment B), but did not provide a detailed budget with cost estimates. As a result, staff recommends establishing a $25,000 notto-exceed amount for eligible parade production costs for Council’s consideration.

Emprende also initially requested to retain any fundraising proceeds remaining after the City was reimbursed and its parade costs were paid, to support a future co-sponsored parade. Following discussion, Emprende agreed to return any remaining funds to the City after the City’s $37,718 contribution and Emprende’s eligible parade production costs are reimbursed. In exchange, Emprende requested that the MOU be extended to allow it to produce the 2027 Christmas Parade.

Emprende’s proposed revisions are included in the revised MOU (Attachment “A”) and are as follows:

1. Term: Extend the agreement to allow Emprende to produce the Christmas Parade again next year in December 2027.

2. Termination: Change termination from “without cost” to termination “for cause” and identify the specific reasons that the MOU can be terminated for cause.

3. Sponsors/Donors: Revise Section 3(D) of the MOU with examples of the types of sponsors/donors that would not be allowed.

4. City Reimbursement: Clearly state the total reimbursement amount due to the City, which is $37,718.

5. Eligible Parade Costs: Allow the money they fundraise to pay for additional costs for producing the parade (these costs include volunteer stipends for food and gas, staff time, entertainment, stage and sound costs, marketing, etc.).

6. Participant List; Revised deadline to provide the draft participant list by October 7, with a final list due by November 5.

7. Event Plan: Revised deadline for the Event Plan to be due on or before September 23, 2026. Staff has added further details specifying the required components of the Event Plan.

8. Community Committees to meet according to the following schedule:
• August – One (1) meeting (held on August 31, 2026, from 6-8pm) • September – One (1) meeting
• October – One (1) meeting
• November – Weekly meetings (four (4) in total)

9. Excess Fundraising: Revised Section 3(A) to detail how excess funds raised would be managed, with Emprende returning any remaining fundraising dollars to the City once both the City’s costs and Emprende’s eligible parade production costs were reimbursed.

All of Emprende’s requested revisions are incorporated in the redlined MOU in Attachment “A”.

Christmas Parade Option B as presented by Emprende
As an alternative, Emprende also let the City know that they are open to producing the Christmas parade privately, on their own. Option A is to continue with the MOU and partner with the City on the Christmas parade. Option B is for Emprende to produce the parade on their own without City involvement. This option would utilize the City’s special event permit process and willrequire Emprende to obtain all needed permits, licenses, traffic control plan, security plan, etc.

Emprende noted that they would seek to utilize this path if the City Council does not approve their requested revisions to the MOU at the September 8 City Council meeting.

Emprende’s Requirements for Option B would include providing the following on or before October 1, 2026:
• Site Plan
• Traffic Control plan – this needs to be done in coordination with the City’s Public Works and Police Departments
o Traffic control company also needs to be in contact with City’s Public Works department and police department by September 15, 2026, so that traffic control plan can be completed by October 1, 2026.
• Security Plan
• Sound Amplification permit
• Certificate of Insurance
• Los Angeles Fire Department approval of Site plan and issuance of permit September 8, 2026 Special & Regular CC Mtg Page 149 of 202 Discussion and Consideration of Proposed Revisions to Memorandum of Understanding with Emprende to Produce a Christmas Parade in Coordination with the City’s Annual Tree Lighting Event and to Reimburse the City for Related Parade Expenses

Building the Legacy: The Hispanic Youth Enterprise (HYE) Initiative of the Mexican Chamber of Commerce U.S.A.

At the Mexican Chamber of Commerce U.S.A., we firmly believe that young entrepreneurs are a fundamental pillar of the future U.S. economy.

However, the entrepreneurial journey is fraught with challenges. Many talented young people, driven by passion and vision, often encounter obstacles due to a lack of structure, mentorship, and a solid financial strategy. This is where the Mexican Chamber of Commerce U.S.A.—with its unwavering commitment to economic and social development—steps in with a transformative solution: the Hispanic Youth Enterprise (HYE) Initiative.

More Than a Business: Building a Legacy
The HYE Initiative is not merely a program; it is a comprehensive platform designed to nurture, support, and empower the next generation of Hispanic business leaders. Our core message resonates with a profound truth: "Don't just start a business. Build a legacy." This initiative serves as a bridge connecting young Hispanic talent with the real U.S. economic ecosystem, transforming "dreamers" into "CEOs" with a solid, sustainable foundation. We understand that a legacy is built not only through effort but also through a robust structure and expert guidance.

The Four Pillars of Sustainable Success
The HYE Initiative rests on four fundamental pillars designed to address every critical aspect of the entrepreneurial journey:
1 M.E.T.A. Model: A strategic framework encompassing Mindset, Strategy, Technology, and Financial Acceleration. This model provides conceptual and practical tools for effective business management.
2 Youth Academy: An intensive 12-week program that equips participants with tactical business skills, ranging from planning to execution.
3 Support System: Personalized, ongoing mentorship with established business leaders, offering invaluable guidance and a support network.

September 8, 2026 Special & Regular CC Mtg Page 177 of 202 4 Capital Access: Direct pathways to a Seed Fund and comprehensive preparation to secure external capital, ensuring the financial viability of the projects.

City Council Letter Supporting Humane Treatment of Immigrant Families Letter Supporting the Humane Treatment and Protection of Immigrant Families Detained at the South Texas Family Residential Center (Dilley)
Reason for City Council Action
The City Council should consider taking a position in support of the humane treatment and protection of immigrant children and families detained at the South Texas Family Residential Center.

Families and children, regardless of immigration status, deserve to be treated with dignity and provided access to adequate medical care, clean water, education, legal representation, and safe and humane conditions.
