BACKGROUND
The State of California, the County of Los Angeles and the City have proclaimed the existence of a state of emergency as a result of the threat of COVID-19. In an effort to reduce the spread of COVID-19 at public meetings, the Governor of California issued executive orders that authorize legislative bodies to hold public meetings via teleconferencing (including virtually via Zoom, etc.) without compliance with certain noticing and access requirements required by the California Brown Act (Brown Act).

During the COVID-19 pandemic, the City has conducted limited in-person public meetings while also offering teleconference accessibility to members of the public, City Council, members of City boards and commissions, City staff and consultants. The executive orders authorizing such hybrid meetings lapsed on September 30, 2021, replaced with legislation in the form of Assembly Bill 361 (AB 361).

AB 361 was signed into law by the Governor on September 16, 2021, which went into effect immediately as urgency legislation (codified under Government Code § 54953), and waived certain provisions of the Brown Act in order to allow local agencies to continue to meet remotely. Specifically, the bill allows remote teleconference flexibility, but only when there is a state of emergency that makes it unsafe to meet in person.

In addition, AB 361 adds new procedures and clarifies the requirements for conducting remote meetings, including the following:

TO: Mayor and City Council
FROM: Marcella Marlowe, Ph.D., City Manager

Page 1061 of 1126 ends

• Public Comment Opportunities in Real Time – a legislative body that meets remotely pursuant to AB 361 must allow members of the public to access the meeting via a call-in option or an internet-based service option, and the agenda for the remote meeting must provide an opportunity for members of the public to directly address the body in real time. A legislative body cannot require public comments to be submitted in advance of the meeting.
• No Action During Disruptions – in the event of a disruption that prevents the local agency from broadcasting the remote meeting, or in the event of a disruption within the local agency’s control that prevents members of the public from offering public comments using the call-in option or internet-based service option, AB 361 prohibits the legislative body from taking any further action on items appearing on the meeting agenda until public access is restored.
• Periodic Findings – Government Code § 54953(e)(B) requires the legislative body to hold a meeting during a proclaimed state of emergency for the purpose of determining, by majority vote, whether as a result of the emergency, meeting in person would present imminent risk to the health or safety of attendees.

The City Council made the above findings through Resolution No. R-21-22 at the October 13, 2021 City Council meeting. Council must also make these findings every 30 days thereafter, in order to continue to allow teleconference accessibility for conducting public meetings (Government Code § 54953(e)(3)). Council has re-affirmed the findings through the below resolutions:
• Resolution No. R-21-24 – November 10, 2021 City Council Meeting; • Resolution No. R-21-31 – December 8, 2021 City Council Meeting; • Resolution No. R-21-33 – December 15, 2021 Special City Council Meeting; and • Resolution No. R-22-01 – January 12, 2022 City Council Meeting.

AB 361 will sunset on January 1, 2024.

DISCUSSION
The City has already implemented the above stated requirements for conducting public meetings and is in full compliance with AB 361, thus there will be no change of the currently established procedures. In addition to the ability to attend public meetings in-person, teleconference accessibility via call-in option or an internet-based service option (via the Zoom Webinars platform) is listed on the published agenda for each meeting as well as on the City’s website. The City monitors attendance via teleconference as well as email correspondence (as published on the agenda) throughout each public meeting and provides access for public comment opportunities in real time both verbally and in writing.

The enclosed Resolution makes the required findings under AB 361, and if adopted, it will allow the City to continue to offer teleconference accessibility for public meetings, to help mitigate the spread of COVID-19, as well as during other state-proclaimed emergencies, such as earthquakes or wildfires, where physical attendance may present a risk.

Page 1062 of 1126 ends

The resolution also directs staff to agendize for Council consideration no less than every 30 days the need to continue to utilize teleconferenced meetings pursuant to AB 361.

FISCAL IMPACT & PROCUREMENT REVIEW
None.

LEGAL REVIEW
The City Attorney has reviewed and approved the staff report as to legal form.

RECOMMENDATION
Staff recommends the City Council adopt Resolution No. R-22-04. If the City Council concurs with staff’s recommendation, an appropriate motion would be:

BACKGROUND
On March 17, 2020, the City Council proclaimed a local emergency due to the COVID-19 pandemic. The federal government, State of California, Los Angeles County Board of Supervisors, and the Los Angeles County Health Officer have also declared public health emergencies. On March 19, 2020, both the County and State issued “Stay at Home” orders. Over the past year, modifications to these orders have been announced gradually.

On Friday, January 29, 2021, a revised Health Officer Order titled “Reopening Safer at Work and in the Community for Control of COVID-19” was issued as a response to the State’s lifting of the Regional Stay-at-Home orders based on ICU capacity projections. Since then, multiple revisions have been made to open up our economy based on lower case rates, hospitalizations, and test positivity rates. On June 15, 2021, the State and County revised their Health Officer Orders to ease most capacity limits, distancing requirements, and mask mandates for vaccinated people. Because of the rise of the Delta variant and a rise in community spread, the County continued to make revisions and updates to their Health Officer Order, most notably with the reinstatement of indoor masking for all people regardless of vaccination status. Other updates have been focused on testing and vaccine requirements at large events and schools, and youth sports. Due to the Omicron Variant, the County of Los Angeles Department of Public Health mandated that on January 15th, all employers in Los Angeles County were required to provide high-grade surgical, KN95, or N95 masks to employees. All City employees are being provided properly rated face coverings and are required to wear those at all times.

The City reopened City facilities to the public on June 1, 2021. As a result of the July 17, 2021 Health Officer Order, masking is required for all people who enter City facilities, but City staff is maintaining normal operations and staffing.

DISCUSSION
COVID-19 Response Update
The City has made every effort to provide a coordinated response to ensure resident and employee safety while still providing essential City services. While our overall response efforts have been managed by the City Manager’s Office and the Fire Department, each City department has played an active role in the development and execution of new policies and procedures, both in response to orders from the County Health Officer and State of California, and based on the specific needs of our own community. The City’s Executive Team continues to meet frequently to coordinate efforts, update each other on conversations with other agencies, discuss necessary changes or adaptations to our City services and procedures, and proactively plan for the weeks and months ahead.

On March 17, 2020 the San Marino City Council approved Resolution No. R-20-09, proclaiming the existence of a local emergency concerning the COVID-19 virus. On July 14, 2021 the City Council revisited this proclamation and directed staff to schedule the local state of emergency for periodic review by the City Council. The City of San Marino continues to operate under that proclamation of local emergency. Conventional emergency management favors not terminating a state of local emergency unless it is certain that it will not be needed. Establishing such certainty during this emergency has been particularly difficult, especially since the COVID-19 pandemic contains elements of novelty where well-established decision points for action do not exist.

Since our last report on January 12, 2022, the following updates have occurred:
• At-home COVID-19 testing kits have become available; the City has advertised how to access these through several communications channels.
• As of January 30, 2022, the City of San Marino has 1,261 COVID cases, an increase of

54.3% (576 cases) since January 1, 2022.
• The Los Angeles County Department of Health continues to recommend vaccines as the best way to prevent severe illness and hospitalization. As of December 30, 2021, 83.6% of San Marino residents age 5 and older have been fully vaccinated. 47.5% of residents age 12 and older have received a vaccine booster.
• The City is monitoring information from the Los Angeles Department of Public Health and the Center for Disease Control and Prevention (CDC) regarding the Omicron variant and will provide information to residents as it becomes available. Weekly COVID-19 community updates have resumed.

Page 1070 of 1126 ends

• Masking continues to be required for all people (visitors and staff) in City facilities. Physical distancing and capacity limits are now required again in city facilities. • The County revised the Isolation and Quarantine Health Orders to supersede the previous November 8, 2021 orders. This revised order changed the recommended timeline for quarantine after exposure, and isolation if positive for COVID-19 for fully vaccinated and boosted individuals.
• The City of San Marino’s vaccine mandate is in place for all non-sworn civilian employees (unrepresented and represented), as well as sworn members of the San Marino Fire Department.
• The Fire Department continues to manage the City’s Emergency Operations Center (EOC) and coordinate with the City’s Disaster Management Area and Los Angeles County. The Resident Support Hotline in the EOC provides a lifeline for residents in need of critical supplies and information.
• The City’s EOC remains open during business hours at Level 3; this level provides for regular monitoring of information briefs and reporting to the County and State on the City’s COVID response, monitor PPE for City Departments, and prepare documentation for cost recovery. The EOC continues to monitor critical updates regarding the COVID virus and the City’s response.
• The Community Services Department is heavily modifying all February programming and canceling rentals through February 28th to maintain the health and safety of participants and staff.
• As of December 31, 2021, Recreation revenues are $151,758. This time last year, Recreation revenues were $63,974. Year-To-Date, Recreation revenues are approximately up 137% compared to the previous year.

COVID-19 Financial Update
As of January 31, 2021, the City has incurred $21,356 of new expenses in materials & supplies and personnel expenditures related to COVID-19 since the last City Council update. The City now has expended a total of $452,771 since the emergency was declared. Attachment I of the staff report includes the expenditures by line item. These expenditures utilized the proper procurement process and are within the City Manager’s regular purchasing authority for purchases under $30,000. The table breaks out expenses already reported to City Council and new expenses that have occurred.

STRATEGIC PLAN CRITICAL SUCCESS FACTORS
• Efficient, Responsive, and Effective City Services
• Fiscally Responsible and Transparent City Government

BACKGROUND
In 2016, then-Governor Brown signed into law SB 1383, which set targets to reduce disposal of organic waste (which includes food, paper, cardboard, greenwaste, and woodwaste), and also established a target for edible food recovery. As part of the rollout of SB 1383, the State of California requires all cities to both adopt an organics disposal reduction ordinance, and provide organics collection and edible food recovery programs by January 1, 2022. The City adopted said ordinance on November 10, 2021 and is now eligible to receive a non-competitive grant from the California Department of Resources Recycling and Recovery (CalRecycle) of up to $20,000.

In order to receive the grant funds, the City Council first must approve a resolution authorizing staff to file an application.

DISCUSSION
The City is eligible to receive up to $20,000 in grant funds from CalRecycle. Per CalReycle’s application guidelines, grant funds may be used for capacity planning, organic waste collection, edible food recovery, education and outreach, enforcement, program evaluation, training, and procurement of recycled organic products. After discussion with Lacy Park staff, staff has determined the most feasible use of these funds is for the construction of a small compost storage area at Lacy Park and procurement of compost and organic waste storage bins. This would help create a central storage area for compost at Lacy Park, and would also provide the public with TO: Mayor and City Council

an accessible station to gather their own compost (a self-fill station). Furthermore, it would encourage the re-use of organic waste by staff and residents. The City will monitor other potential uses for these funds should they be received.

FISCAL IMPACT & PROCUREMENT REVIEW
CalRecycle has informed the City that it is eligible to receive funding in the amount of $20,000.

Grant funds would be encumbered in April of 2022, and would be eligible to be spent until April of 2024. These funds will be paid on an upfront basis by CalRecycle, rather than via reimbursement. Since these funds are not in the current FY 2021-22 budget, they will be included in the FY 2022-23 proposed budget.

Procurement review is not applicable.

LEGAL REVIEW
The City Attorney’s office has reviewed this staff report and has approved it as to form.

RECOMMENDATION
Staff recommends the City Council approve Resolution No. R-22-03 approving the filing of an application for SB 1383 Local Assistance Grant funds from the California Department of Resources Recycling and Recovery (CalRecycle) If the Council concurs with staff’s recommendation, an appropriate motion would be:
“I move to approve Resolution No. R-22-03 approving the filing of an application for SB 1383 Local Assistance Grant funds from the California Department of Resources Recycling and Recovery”.

STRATEGIC PLAN CRITICAL SUCCESS FACTORS
• Well-Maintained Infrastructure
• Fiscally Responsible and Transparent City Government

BACKGROUND
On May 28, 2021 the City Council approved the fiscal year (FY) 2021-22 Budget, which included $70,000 from the Air District Fund, as well as $12,000 from the Capital Equipment Fund, for the replacement of two (2) detective cars for the Police Department. In January 2022, the Police Department purchased a 2022 Ford F-150 using these funds. The Police Department has also identified a 2022 Ford Escape to be used as part of the detective fleet, which, after outfitting, will exceed the amount originally approved by the City Council.

DISCUSSION
The Air District Fund (Fund 212) is used for the purchase of the vehicles. Due to inflation costs, the proposed amount for the purchase of the vehicles will be $3,400 more than originally budgeted. The San Marino Police Department is requesting authorization by the City Council to modify the budget by the following amounts:

Budgeted Amount – Vehicles Fund 212 $70,000
Ford F-150 Cost ($46,350)
Ford Escape Cost ($27,050)
Amount Overbudget – Vehicles Fund 212 $3,400
The Capital Equipment Fund (Fund 591) is used for the outfitting of the vehicles after purchase so that they can be utilized for the numerous functions required of a police vehicle. Due to TO: Mayor and City Council

inflation costs, the proposed amount for the outfitting of the vehicles will be $3,000 more than originally budgeted.

Budgeted Amount – Outfitting Fund 591 $12,000
Outfitting Cost ($15,000)
Amount Overbudget – Outfitting Fund 591 $3,000
In summary, the Police Department requested funding in the FY 2021-22 Capital Equipment budget for the purchase and outfitting of new detective vehicles. One vehicle, a 2022 Ford F150, has already been purchased using the budgeted funds. The original budget provided for the purchase of a second vehicle. However, due to inflation and inventory shortages, the purchase of a second vehicle would exceed the originally budgeted amount by approximately $6,400, due to increased costs for both the vehicles and their outfitting.

Total Amount Overbudget/New Amount
Requested (Fund 212 + Fund 591)
$6,400
National Auto Fleet, the vendor from which the City procures vehicles, has indicated a lead time of several months for the order to be processed and the vehicle to be outfitted. In order to ensure the Police Department receives their new vehicle during the current fiscal year, an order should be placed in the near future. If the Council does not approve, the Ford Escape likely will not be procured until the next fiscal year, and the budgeted funds for the current fiscal year would not be entirely expended.

The Southern California Air Quality Management District (AQMD) has confirmed that both vehicles are compliant with their standards.

The cost difference for the vehicles themselves would be covered by an additional appropriation of Air District Funds (approximately $3,400), with City Council approval. The cost difference for outfitting would be covered by an additional appropriation from the Capital Equipment Fund (approximately $3,000) with City Council approval.

FISCAL IMPACT & PROCUREMENT REVIEW
The total cost for the purchase of the 2022 Ford Escape for the detective fleet is $27,050. When combined with the already purchased 2022 Ford F-150, an additional $6,400 is needed. As noted above, funding for the additional $3,400 (for the vehicle purchase) is available in Air District Funds. The Air District Fund has enough reserves for this additional appropriation. Additionally, $3,000 of additional appropriations (for outfitting) is requested for the Capital Equipment Fund budget.

The Finance Director has reviewed the purchases to ensure that the purchase is in compliance with the City’s procurement policy.

LEGAL REVIEW
The City Attorney has reviewed the staff report and approved it as to legal form.

RECOMMENDATION
Staff recommends that the City Council approve the requested budget modifications as described herein. If the City Council concurs with staff’s recommendation, an appropriate motion would be:
“I move to direct the Finance Director to amend the FY 2021-22 Air District budget (Account 212-30-4613-0500) from $70,000 to $73,400, and the FY 2021-22 Capital Equipment budget (Account 591-30-4613-0594) for the Detective Car Replacement from $12,000 to $15,000, for a total of $6,400 in additional expenditures.”

FW: [EXTERNAL] RE: [EXTERNAL] Purchase of Electric Vehicle Using AB2766 Funds Ford F-150 2WD 4WD 3.SL - EO A-010-2365 signed_ TC.pdf
Please see below from the AQMD noting that the 2022 F-150 2WD & 4WD, 3.SL, is eligible for AB2766 Funding while other similar vehicles do not qualify. He also noted the 2022 Ford Maverick Hybrid is eligible as well. • Mark Siegfried, CPA

Good evening Mark,
We have determined that the vehicles that are described by the attached CARB certification: 2022 F-150 2WD & 4WD,

3.SL, are eligible. Although this form describes them as rated by CARB with a ULEVS0 emission rating, the emission tests of all the pollutants of concern meet SULEV30 standards. Thus, the vehicle models described at the bottom of the attached document are eligible for AB2766 funds. Please make sure that the vehicles you purchase fall under this test description "A-010-2365" because the 2.7L, the 3.3L, The Raptor, Tremor, and the HEV do not meet SULEV standards. The new 2022 Ford Maverick Hybrid also falls into this rare category of being rated as a ULEVS0, but meets the SULEV30 standards and thus is eligible for AB2766 funds. I have not attached that CARB certification form; it is A010-2388.

Let me know if you have any further questions.

Sincerely,

STRATEGIC PLAN CRITICAL SUCCESS FACTORS
• Efficient, Responsive, and Effective City Services
• Fiscally Responsible and Transparent City Government

BACKGROUND
On December 14, 2021, the Community Services Department, Recreation Division received a generous $2,000 donation from the San Marino Community Athletics Association. The monies are to be used for materials and supplies for the 47th Annual All City Track and Field Meet to be held in March 2022.

From a financial perspective, this gift represents an unbudgeted revenue source. The City’s Donation Policy requires a formal budget amendment to properly document and receive these funds (Attachment 2).

DISCUSSION
The requested budget amendment is administrative. It accepts and acknowledges the San Marino Community Athletics Association’s gift and approves a revenue and expenditure budget amendment – both in the amount of $2,000 – to the City’s Restricted Donations Fund.

The donation will greatly support the Track and Field Meet, which has historically hosted over 350 children participating in 7 different types of events each year. This year is the 47th annual installment of the beloved community event. The plan is to use the monies to purchase award medals for the event winners and banners to promote the event.

2 FISCAL IMPACT & PROCUREMENT REVIEW
The subject donation will have no impact on the General Fund and represents an unexpected benefit to the City’s Restricted Donations Fund budget (Fund No. 281) for this fiscal year. The donation will be recorded to the following accounts:

Revenue: 281-66-3601-0002: Track Meet Donations
Expenditure: 281-66-4376-0002: Track Meet Materials & Supplies This report requires no procurement review.

LEGAL REVIEW
The City Attorney reviewed the Staff Report and has approved it to legal form.

RECOMMENDATION
Staff recommends that the City Council accept the $2,000 donation from the San Marino Community Athletics Association and amend the City’s Restricted Donations Fund to reflect the donation as well as the corresponding expenditure. If the City Council concurs with Staff’s recommendation, an appropriate motion would be:
“I move to (1) accept the donation of $2,000 from the San Marino Community Athletics Association; (2) approve the fiscal year 2021-22 revenue budget amendment to recognize revenue of $2,000 in the Restricted Donations Fund at Account 281-66-3601-0002 (Track Meet Donations) and; (3) approve the fiscal year 2021-22 expenditure budget amendment of $2,000 in the Restricted Donations Fund at Account 281-66-4376-0002 (Track Meet Materials & Supplies).”

STRATEGIC PLAN CRITICAL SUCCESS FACTORS
• Efficient, Responsive, and Effective City Services
• Fiscally Responsible and Transparent City Government

BACKGROUND
On September 22, 2021, the Community Services Department, Library Division received two generous donations ($1,000 and $2,725) from the San Marino Public Library Foundation (Attachments 1 & 2). The $1,000 is to be used for adult book purchases and programming. The $2,725 is to be used for children’s book purchases and programming.

From a financial perspective, this gift represents an unbudgeted revenue source. The City’s Donation Policy requires a formal budget amendment to properly document and receive these funds (Attachment 3).

DISCUSSION
The requested budget amendment is administrative. It accepts and acknowledges the San Marino Public Library Foundation’s gifts and approves two revenue and expenditure budget amendments to the City’s Restricted Donations Fund. The first set of amendments are in the amount of $1,000 and the second set of amendments are in the amount of $2,725.

The $1,000 donation will greatly support the Library’s Adult Services function. The plan is to purchase high-demand, best-selling fiction and non-fiction materials. Maintaining a comprehensive catalog of the latest research in nonfiction, as well the works of best-selling fiction authors such as James Patterson, Matt Haig, and Louise Erdrich, supports the Library’s mission of maintaining a book collection to serve the educational, cultural, and recreational interests of all people.

The $2,725 donation will greatly support the Library’s Children’s Services function, which has experienced significant demand for new titles and updated youth materials during the pandemic.

Areas of focus for purchase include paleontology, anthropology, astronomy, and mythology.

These funds will allow the Library to maintain access to current information and trends in these fields, keeping our students curious and engaged.
