• Prohibits the legislative body from closing the public comment period until the public comment period has elapsed or until a reasonable amount of time has elapsed; and WHEREAS, the City has already implemented and is in full compliance with the requirements listed above when conducting public meetings via teleconference, which are now codified in Government Code § 54953(e)(2)(B-G); and
WHEREAS, pursuant to Government Code § 54953(e)(B), the legislative body shall hold a meeting during a proclaimed state of emergency for the purpose of determining, by majority vote, whether as a result of the emergency, meeting in person would present imminent risks to the health and safety of attendees. The City Council must make these findings no later than 30 days after the first teleconferenced meeting is held pursuant to AB 361 after September 30, 2021, and must also make these findings every 30 days thereafter, in order to continue to allow teleconference accessibility for conducing public meetings; and
WHEREAS, incidents of new cases, hospitalizations and deaths associated with COVID-19 continue to be at rates for which federal, state and local officials recommend or require health precautions be taken, including, but not limited to, masking, limiting prolonged interior exposure to other individuals, limiting the size of gatherings indoors, and, for those with compromised health conditions or those without vaccines, limiting attendance at functions indoors.

THEREFORE, BE IT RESOLVED by the City Council of the City of San Marino, California, as follows:

SECTION 1. The City Council hereby declares that the recitals set forth above are true and correct, and incorporated into this resolution as findings of the City Council.

SECTION 2. The City of San Marino continues to follow safety measures in response to COVID19 as ordered or recommended by the Centers for Disease Control and Prevention (CDC), California Department of Public Health (DPH), and/or County of Los Angeles, as applicable.

Based upon that guidance, in person attendance indoors at public meetings continues to present a health risk for certain segments of the San Marino population, necessitating teleconferencing to allow for meaningful public participation options for all San Marino constituents.

SECTION 3. The City Council hereby declares that, pursuant to the findings listed in this Resolution, the City Council and the City’s boards and commissions are authorized to continue utilizing teleconferencing accessibility to conduct public meetings pursuant to AB 361 and Government Code § 54953, as amended thereby.

SECTION 4. The City staff is directed to agendize for Council consideration no less than every 30 days consideration of the need to continue with teleconferenced meetings as allowed by AB 361.

SECTION 5. Severability: If any section, subsection, subdivision, sentence, clause, phrase, or portion of this Resolution is, for any reason, held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining PAGE 282 of 344

portions of this Resolution. The City Council hereby declares that it would have adopted this Resolution and each and every section, subsection, subdivision, sentence, clause, phrase, or portion thereof, irrespective of the fact that any one or more sections, subsections, subdivisions, sentences, clauses, phrases, or portions thereof be declared unconstitutional.

SUBJECT: UPDATE ON CITY RESPONSE TO THE COVID-19

PANDEMIC

STRATEGIC PLAN CRITICAL SUCCESS FACTORS
Efficient, Responsive, and Effective City Services
Engaged and Connected Residents
Safe Community
Fiscally Responsible and Transparent City Government

BACKGROUND
On March 17, 2020, the City Council proclaimed a local emergency due to the COVID-19 pandemic. The federal government, State of California, Los Angeles County Board of Supervisors, and the Los Angeles County Health Officer have also declared public health emergencies. On March 19, 2020, both the County and State issued “Stay at Home” orders. Over the past year, modifications to these orders have been announced gradually.

Most recently, on Friday, March 4, LA County Department of Health updated their Health Order regarding masks to change the requirement for indoor masking to recommended, but not mandatory, masking indoors. Effective March 8, the City changed masking requirements in City facilities to align with this order and masks are now optional for City staff and patrons.

DISCUSSION
COVID-19 Response Update
The City has made every effort to provide a coordinated response to ensure resident and employee safety while still providing essential City services.

While our overall response efforts have been managed by the City Manager’s Office and the Fire Department, each City department has played an active role in the development and execution of new policies and procedures, both in response to orders from the County Health Officer and the State of California and based on the specific needs of our own community. The City’s Executive Team continues to meet frequently to coordinate efforts, update each other on conversations with other agencies, discuss necessary changes or adaptations to our City services and procedures, and proactively plan for the weeks and months ahead.

On March 17, 2020, the San Marino City Council approved Resolution No. R20-09, proclaiming the existence of a local emergency concerning the COVID19 virus. On July 14, 2021, the City Council revisited this proclamation and directed staff to schedule the local state of emergency for periodic review by the City Council. The City of San Marino continues to operate under that proclamation of local emergency. Conventional emergency management favors not terminating a state of local emergency unless it is certain that it will not be needed. Establishing such certainty during this emergency has been particularly difficult, especially since the COVID-19 pandemic contains elements of novelty where well-established decision points for action do not exist.

Starting Tuesday, May 31, the management of the Resident Support Hotline services transitioned from the Fire Department to the Community Services Department/Recreation Division located at the Stoneman
Building. Recreation office support staff assumed 100% of the duties and responsibilities that encompass a seamless transition of these services. This includes answering phone calls to the hotline, monitoring the email account daily, and making quarterly outreach calls.

Since our last report on September 14, 2022, the following updates have occurred:
• Updated booster vaccines are now available and recommended at least 2 months after your most recent COVID-19 vaccination shot. • As of September 30, 2022, the City of San Marino has 2,175 COVID cases, an increase of 1% (27 cases) since September 30, 2022.

PAGE 285 of 344
• The Los Angeles County Department of Health continues to recommend vaccines as the best way to prevent severe illness and
hospitalization. As of October 31, 2022, 94.5% of San Marino residents age 5 and older have been fully vaccinated. 67.1% of residents age 12 and older have received a vaccine booster.
• The City monitors information from the Los Angeles Department of Public Health and the Center for Disease Control and Prevention (CDC) regarding the Omicron variant. It will provide information to residents as it becomes available. Weekly COVID-19 community updates have continued.
• Masking is optional in City facilities.
• The Los Angeles County Department of Health has issued a Health Officer Order to recommend, but not require, masks indoors. • The City of San Marino’s vaccine mandate is in place for all non-sworn civilian employees (unrepresented and represented), as well as sworn members of the San Marino Fire Department.
• The Community Services Department continues to manage the City’s Resident Support Hotline in the EOC, which provides a lifeline for residents in need of critical supplies and information. • The City’s EOC remains open during business hours at Level 3; this level provides regular monitoring of information briefs and reporting to the County and State on the City’s COVID response, monitoring PPE for City Departments and prepare documentation for cost recovery. The EOC monitors critical updates regarding the COVID virus and the City’s response.
• As of September 30, 2022, Recreation revenues are $186,773. This time last year, Recreation revenues were $98,744. Year-To-Date, Recreation revenues are approximately up 122% compared to the previous year COVID-19 Financial Update
As of October 28, 2022, the City has incurred $15,279 of new expenses in materials & supplies and personnel expenditures related to COVID-19 since the last City Council update. The City now has expended a total of $629,911 since the emergency was declared. Attachment I of the staff report includes the expenditures by line item. These expenditures utilized the proper procurement process and are within the City Manager’s regular purchasing authority for purchases under $30,000. The table breaks out expenses already reported to City Council and new costs.

SUBJECT: APPROVAL OF CROWELL PUBLIC LIBRARY CLOSURE
CALENDAR FOR 2023

STRATEGIC PLAN CRITICAL SUCCESS FACTORS
Engaged and Connected Residents
Fiscally Responsible and Transparent City Government
Inviting and Relevant City Facilities

BACKGROUND
Each year, staff present a closure calendar for the Crowell Public Library to the Library Board of Trustees, and ultimately seek City Council’s approval.

Council approval is needed to close on any days that are not City approved holidays.

On September 26, the Library Board of Trustees approved the Crowell Public Library closure calendar (Attachment 1) and request City Council’s approval.

DISCUSSION
Staff are requesting the below closures for the Crowell Public Library in 2023:
• Martin Luther King Jr. Day (January 16): historically, the Library has been closed to the public in order to allow staff to participate in an allday training. The goal is to offer a CPR/First Aid/AED training (8 hours), customer service training, or other training as determined by the Library Manager.

• Easter Sunday (April 9): historically, the Library has been closed to the public, as circulation and gate count have been lower than an average Sunday.
• Thanksgiving Eve (November 22): staff are proposing an early closure (5 PM) due to historically low number of patrons in the building on this day.

FISCAL IMPACT & PROCUREMENT REVIEW
The anticipated revenue loss is nominal. The main reason for revenue loss will be because passport services will not be offered. Revenue for the last two months averaged $30 on a Sunday, $720 on a Monday, and $800 on a Wednesday. However, on Thanksgiving Eve (Wednesday), staff propose only a 4-hour closure, so not all revenue will be lost.

This report requires no procurement review.

LEGAL REVIEW
The City Attorney's office has reviewed and approved as to form.

RECOMMENDATION
Staff recommends the Council approve the Crowell Public Library closure calendar for 2023. If the City Council concurs with staff’s recommendation, an appropriate motion would be:
“I move to approve the Crowell Public Library closure calendar for 2023.”

HINDERLITER DE LLAMAS AND ASSOCIATES TO PROVIDE

BUSINESS LICENSE SOFTWARE SERVICES THROUGH
NOVEMBER 11, 2024

STRATEGIC PLAN CRITICAL SUCCESS FACTORS
Engaged and Connected Residents
Efficient, Responsive, and Effective City Services
Safe Community
Fiscally Responsible and Transparent City Government

BACKGROUND
On November 11, 2020, the City Manager signed a Professional Services Agreement (PSA) with Hinderliter De Llamas and Associates (HdL) in order to provide business license software services in the amount not to exceed $21,161 with a term to expire on November 11, 2022 (Attachment 1). The City requires a business license for all businesses regardless of trade, profession or occupation, or whether the business is located within or outside the City boundaries. The City is currently managing approximately 2,771 business licenses (includes renewals).

DISCUSSION
The PSA with HdL expires on November 11, 2022 and an extension of the current agreement is requested to allow HdL to continue to assist the Community Development Department staff in the issuance and administration of business licenses. Staff is requesting that the PSA with HdL be for the Susan Jakubowski, Mayor

amount not to exceed $23,045 total for a term to expire on November 11, 2024. The PSA extension will allow HdL to continue to provide business license software support to the Community Development Department to manage the approximately 2,771 current active business licenses. The business license software services agreement will continue to assist the City in the following manner:
• Store, print, process all business license records, including annual licenses and those which may be issued on a daily, monthly, quarterly or semi-annual basis.
• Allow easy data entry of the information contained in business license applications. Based on business type and rate tables, calculate fees and print licenses.
• Track and notice un-renewed licenses.
• Allow staff to track and notice delinquent licenses.
• Generate a journal entry for entering business license payments into the accounting records.
• Maintain business license history for active and closed businesses. • Audit features that allow cross checking against other data sets such as property tax and sales tax.
• A variety of reports are available based on business name and type and mandated reports to the Franchise Tax Board.
• Management of online business license.

FISCAL IMPACT & PROCUREMENT REVIEW
The City and Consultant desire to amend the original Agreement, in accordance with Section 16 of the Agreement to include an additional 24 months of service from November 11, 2022, through November 11, 2024. A budget amendment to the FY 2022-23 Adopted Budget is not required as City Council approved an appropriation of $11,352.20 for the service. The remaining balance of $11,692.76 will be considered through the FY 2023-2024 Adopted Budget review process.

Procurement review is not applicable.

Though rare, additional costs may apply depending on the extent of the upgrade. Potential additional costs include training, consulting, configuration, or other requested services.

As such, it is critical that any outside connection to the database be implemented with Consultant’s full knowledge and participation. Only “read only” connections will PAGE 335 of 344
1211698.5 Page 2 of 5
be established to Consultant’s database. No modifications will be made to the Consultant database, including database/table design and data content. Any repair work necessary due to violations of the above items will not be covered by the Software Use Fee, and as such will be billable to the client on a time and material basis. The Client shall contact Consultant for instructions if any added functionality is required, including reading additional data or writing to the Consultant database.

1.6. Out of Scope Support – Client agrees to pay additional hourly fees according to Consultant’s then current hourly rates if the Client desires Consultant’s assistance for matters which are not caused by any defects in Consultant’s software.

2. Online Payment Processing – Consultant’s software is bundled with PCI compliant payment gateway services powered by FIS Global, which supports both credit card and eCheck transactions. If a different payment gateway is required there will be a programming cost to establish the custom payment gateway integration.

SUBJECT: APPROVAL OF CITY SIGNAGE AND BUILDINGS FOR A

DOCUMENTARY FILM PERMIT

STRATEGIC PLAN CRITICAL SUCCESS FACTORS
Efficient, Responsive, and Effective City Services
Fiscally Responsible and Transparent City Government

BACKGROUND
The City Council adopted Ordinance No. O-22-1393 on July 29, 2022, which amended chapter 11.08 of the City Code to edit the film policy. These edits included a requirement for City Council approval for a production company to use “references, shots, or film footage of exteriors of City landmarks, City seal, location identifiers/street signage, City entrance markers, City-owned vehicles and buildings, and private property addresses.” The San Marino Police Department and the City Manager’s Office received a film permit request from Sprite Halo LLC for a series called “Blood Money.” This is a documentary series about true crimes, voiced by Dick Wolfe. The episode proposed to be filmed in San Marino is regarding a 1985 missing persons/murder case that took place in the City. Sprite Halo would like to film City streets, buildings, and landmark signs to be used in the documentary episode. The specific desired filming locations are the exterior of San Marino City Hall and Police Department, Huntington Drive and San Gabriel median sign, and the San Marino Centennial Clock.

According to the application materials submitted, all references to City of San Marino and its Police Department will “highlight the good detective work done by the San Marino Police Department to solve this murder.”

DISCUSSION
This film permit application has been reviewed by the Acting City Manager, Mario Rueda, and Police Chief, John Incontro. Staff does not believe that this will negatively impact residents. If allowed, all film activity will still be required to fully meet all other Municipal Code requirements. Staff is also prepared to issue the permit with any additional contingencies or conditions that the Council sees fit to legally require.

FISCAL IMPACT & PROCUREMENT REVIEW
There is no fiscal impact or procurement review for this item.

LEGAL REVIEW
The City Attorney's office has reviewed and approved as to form.

RECOMMENDATION
Staff recommends the Council approve the use of references, shots, or film footage of exteriors of City landmarks, City seal, location identifiers/street signage, City entrance markers, City-owned vehicles, and buildings for the Sprite Halo LLC “Blood Money” production permit. If the City Council concurs with staff’s recommendation, an appropriate motion would be:
“I move to approve the use of references, shots, or film footage of exteriors of City landmarks, City seal, location identifiers/street signage, City entrance markers, City-owned vehicles, and buildings for the Sprite Halo LLC “Blood Money” film permit.”
