SUBJECT: APPROVAL TO PURCHASE FIRE DEPARTMENT COMMAND

VEHICLE

STRATEGIC PLAN CRITICAL SUCCESS FACTORS
Efficient, Responsive, and Effective City Services
Fiscally Responsible and Transparent City Government
Safe Community

BACKGROUND
On May 27, 2022 the City Council approved the fiscal year 2022-2023 Operating and Capital Budget. As part of the capital equipment component of the budget, the Council approved $50,720 for the purchase of one command staff vehicle to replace the 2016 Ford Explorer currently assigned to the Division Chief.

DISCUSSION
In 2019 the Fire Department conducted an annual inspection and audit of all Department facilities, equipment, and apparatus. During this annual inspection, Fire and Parks & Public Works fleet personnel concluded that the two 2016 Ford Explorers in the Department’s fleet had exceeded their capability as emergency response vehicles. The City Council approved replacement of one command staff vehicle as part of the fiscal year 2019- 2020 capital equipment budget and one 2020 Chevrolet Tahoe was approved and purchased in September 2019. The purchase was made through National Auto Fleet Group, a cooperative purchasing alliance for government and nonprofit agencies.

Replacement of the second command staff vehicle at a budgeted amount of $50,720 was approved as part of the fiscal year 2021-2022 capital equipment budget. A Chevrolet Tahoe was once again selected to maintain consistency within the Department’s fleet. Unfortunately, due to production disruptions caused by the COVID-19 pandemic, the Department was unable to purchase a second Chevrolet Tahoe during the 2021-2022 fiscal year.

The second command staff vehicle was re-budgeted for $50,720 as part of the current fiscal year 2022-2023 capital equipment budget. Due to the increasing age and unreliability of the current command staff vehicle, it is imperative that the Department procure a replacement within the current fiscal year. The Department has successfully located one vehicle through National Auto Fleet Group; however, while inventory is guaranteed through November 30, 2022, they are unable to guarantee inventory will remain available by the date of City Council approval.

The Department will reach out to National Auto Fleet Group prior to the City Council meeting to confirm availability of the vehicle. If the vehicle is unavailable, the Department will reach out to local Chevrolet dealers to obtain at least three (3) written bids, per the City’s Municipal Code. The Department would then request authority to purchase from the next lowest cost vehicle with available inventory from among the quotes received. Due to private dealerships inability to hold vehicles, these quotes would be made available as supplemental materials the day before the City Council meeting.

FISCAL IMPACT & PROCUREMENT REVIEW
The City Council approved purchase of a command staff vehicle as part of the Fiscal Year 2022-2023 Operating and Capital Budget. $50,720 is currently available in account 591-34-4613-9300 (Fire Capitalized Equipment – Vehicles). The cost budgeted in the FY 2021-2022 capital equipment budget and carried over to the 2022-2023 budget was based on the MSRP of a 2021 Chevrolet Tahoe. There is a cost difference of $15,286 between the 2023 Chevrolet Tahoe available from National Auto Fleet Group and the amount budgeted.

The Fire Department is requesting a budget appropriation in the amount of $15,286 from the Capital Equipment Fund reserves to account 591-34-4613- 9300 for the purchase of the 2023 Chevrolet Tahoe from National Auto Fleet Group.

If the National Auto Fleet Group vehicle is unavailable, the Department is requesting a budget amendment and appropriation from the Capital Equipment Fund reserves in the amount necessary to cover the cost of the PAGE 690 of 727
next lowest priced available vehicle, not to exceed $25,000. The Department will reach out to local Chevrolet dealers to obtain at least three (3) written bids and select the lowest bidder per the City’s Municipal Code.

LEGAL REVIEW
The City Attorney's office has reviewed and approved as to form.

RECOMMENDATION
Staff recommends the Council (1) approve the purchase of one 2023 Chevrolet Tahoe from National Auto Fleet Group, and (2) approve a budget amendment and appropriation of $15,286 from the Capital Equipment Fund reserves to account 591-34-4613-9300. Further, in the event of unavailability of that vehicle, staff recommends that the Council (1) authorize purchase of the next lowest priced available vehicle from among the quotes received and (2) approve a budget amendment and appropriation from the Capital Equipment Fund reserves in the amount necessary to cover the cost of such vehicle, not to exceed $25,000.

If the Council concurs with staff’s recommendation, an appropriate motion would be:
“I move to approve the purchase of one 2023 Chevrolet Tahoe from National Auto Fleet Group and approve a budget amendment and appropriation of $15,286 from the Capital Equipment Fund reserves to account 591-34-4613- 9300. Further, in the event of unavailability of that vehicle, I move to authorize purchase of the next lowest priced available vehicle from among the quotes received and approve a budget amendment and appropriation from the Capital Equipment Fund reserves in the amount necessary to cover the additional cost of such vehicle, not to exceed $25,000.”

BACKGROUND
On February 14, 2018 the City Council approved Ordinance No. O-18-1334 an Ordinance of the City of San Marino Creating a Public Safety Commission and Amending Article 14, Chapter 2, of the City Code. At the time the Commission was established, the regular meeting location was the Council Chambers at City Hall. The Public Safety Commission remained in the Council Chambers at City Hall until March 2020 at which time meetings were moved to teleconference in accordance with “Safer at Home” orders in response to the COVID-19 Pandemic.

On November 18, 2020 the City Council adopted Ordinance No. O-20-1361 establishing the normal meeting for the Public Safety Commission on the first Monday of each month at 7:00 PM in the Barth Room at Crowell Public Library.

Though the Commission continued to meet via teleconference in accordance with “Safer at Home” orders.

On April 13, 2022 the San Marino City Council adopted Ordinance No. O-22- 1387 an ordinance amending the San Marino Municipal Code to allow the City Susan Jakubowski, Mayor

Members of the Public Safety Commission recently expressed interest in changing the location of regular meetings. At the November 21, 2022 regular meeting of the Public Safety Commission, members were invited to discuss a potential location change from the Barth Room at the Crowell Public Library to the Council Chambers at City Hall.

SUBJECT: APPROVAL OF THE INSTALLATION OF STREET POLE

BANNERS IN RECOGNITION OF LUNAR NEW YEAR

STRATEGIC PLAN CRITICAL SUCCESS FACTORS
Efficient, Responsive, and Effective City Services
Engaged and Connected Residents
Fiscally Responsible and Transparent City Government

BACKGROUND
The Chinese Club of San Marino, a community non-profit organization, has requested permission to install banners along Huntington Drive from January 9th through March 1, 2023. The banners will celebrate the Lunar New Year, which begins on January 22, 2023.

DISCUSSION
The cost for City Public Works personnel to install and remove up to 50 banners provided by the Chinese Club of San Marino is approximately $2,000, based on hourly salaries for the City’s street maintenance team. The City Council has adopted a policy governing the use of City street poles for banners (Resolution No. R-14-22, see Attachment 1) that enables the City Council to review such requests and determine if they are suitable.

FISCAL IMPACT & PROCUREMENT REVIEW
If the City were to be a co-sponsor of the banners, the City would provide inkind services through City personnel time and materials utilized, and the Chinese Club of San Marino will reimburse the City for one-half of the City’s Susan Jakubowski, Mayor
Steve Talt, Vice Mayor

costs. If approved, no additional budget appropriation is required as the Parks and Public Works Department personnel has the capacity to install and remove the banners during regular working hours and the material costs can be paid out of the supplies expenditure line item.

Procurement review is not applicable.

LEGAL REVIEW
The City Attorney's office has reviewed and approved as to form.

RECOMMENDATION
Staff recommends that the City Council approve the request from the Chinese Club of San Marino and the City’s contribution of one-half of the cost of the City’s in-kind services for Public Works personnel time and material utilized.

This means that the City would sponsor one-half of the installation costs. If the City Council concurs with staff’s recommendation, an appropriate motion would be:
“I move to approve a request from the Chinese Club of San Marino that is in accordance with Resolution No. R-14-22 for the installation and display of banners between January 9, 2023 through March 1, 2023, subject to reimbursement of one-half of the installation costs by the Chinese Club of San Marino.”

SUBJECT: APPROVAL TO WAIVE SPACE RESERVATION FEES FOR

LUNAR NEW YEAR FESTIVAL IN LACY PARK

STRATEGIC PLAN CRITICAL SUCCESS FACTORS
Efficient, Responsive, and Effective City Services
Fiscally Responsible and Transparent City Government

BACKGROUND
The City’s long-time community partner – the Chinese Club of San Marino – has approached the City with an opportunity to collaborate on a Lunar New Year Festival event in Lacy Park. Community Services Department staff and City Manager’s Office staff have met with the Chinese Club several times to discuss at-length the nature and planning of this event. The result of these meetings has been a special event permit application, submitted by the Chinese Club, to host a Lunar New Year Festival in Lacy Park on January 28, 2023 from 10 AM to 2 PM. In their application, the Chinese Club has requested a partnership on this event from the City in the form of waiving reservation fees for the park space.

DISCUSSION
Lunar New Year is typically celebrated in China and other Asian countries and begins with the first new moon of the lunar calendar and ends on the first full moon of the lunar calendar, 15 days later. As the City works to celebrate a broader selection of cultural holidays, the opportunity to partner with the Chinese Club for a half-day festival is welcomed. This event is targeted at all San Marino residents to bring together an understanding and appreciation for this holiday and how it is celebrated in other countries.

Since this will be the first year of this event, participation is estimated at about 800 attendees. The activities will include community information booths, activity/craft booths, food sales, and celebratory performances. The event footprint will take up approximately half of the park to still allow for passive use and morning classes. Park entry for non-residents will still be charged by the City per normal operations. The Chinese Club has stated their intent is not to gain a profit from this event and has invited all community agencies to participate in the event through booths and volunteers. The event permit application has been reviewed by all departments and is included as Attachment I to this report. The Chinese Club has agreed to adhere to all safety and park preservation requests (I.E. not attaching anything to trees, no ground stakes, etc.). Portable restrooms will be supplied by the Chinese Club to facilitate the number of attendees.

FISCAL IMPACT & PROCUREMENT REVIEW
Estimated lost revenue for waiving fees for the use of all rental spaces is between $870 - $1,740.
a. If all areas are rented by residents = 6 areas X $145 = $870 b. If all areas are rented by non-residents = 6 areas X $290 = $1,740

LEGAL REVIEW
The City Attorney's office has reviewed and approved as to form.

RECOMMENDATION
Staff recommends the Council waive the reservation fees for Lacy Park for the Chinese Club to hold a Lunar New Year Festival on January 28, 2023. If the City Council concurs with staff’s recommendation, an appropriate motion would be:
“I move to approve the waiving of reservation fees for the Chinese Club Lunar New Year Festival.”
