WHEREAS, pursuant to Government Code § 54953(e)(B), the legislative body shall hold a meeting during a proclaimed state of emergency for the purpose of determining, by majority vote, whether as a result of the emergency, meeting in person would present imminent risks to the health and safety of attendees. The City Council must make these findings no later than 30 days after the first teleconferenced meeting is held pursuant to AB 361 after September 30, 2021, and must also make these findings every 30 days thereafter, in order to continue to allow teleconference accessibility for conducing public meetings; and
WHEREAS, incidents of new cases, hospitalizations and deaths associated with COVID-19 continue to be at rates for which federal, state and local officials recommend or require health precautions be taken, including, but not limited to, masking, limiting prolonged interior exposure to other individuals, limiting the size of gatherings indoors, and, for those with compromised health conditions or those without vaccines, limiting attendance at functions indoors.
THEREFORE, BE IT RESOLVED by the City Council of the City of San Marino, California, as follows:
SECTION 1. The City Council hereby declares that the recitals set forth above are true and correct, and incorporated into this resolution as findings of the City Council.
SECTION 2. The City of San Marino continues to follow safety measures in response to COVID19 as ordered or recommended by the Centers for Disease Control and Prevention (CDC), California Department of Public Health (DPH), and/or County of Los Angeles, as applicable.
Based upon that guidance, in person attendance indoors at public meetings continues to present a health risk for certain segments of the San Marino population, necessitating teleconferencing to allow for meaningful public participation options for all San Marino constituents.
SECTION 3. The City Council hereby declares that, pursuant to the findings listed in this Resolution, the City Council and the City’s boards and commissions are authorized to continue utilizing teleconferencing accessibility to conduct public meetings pursuant to AB 361 and Government Code § 54953, as amended thereby.
SECTION 4. The City staff is directed to agendize for Council consideration no less than every 30 days consideration of the need to continue with teleconferenced meetings as allowed by AB 361.
SECTION 5. Severability: If any section, subsection, subdivision, sentence, clause, phrase, or portion of this Resolution is, for any reason, held to be invalid or unconstitutional by the decision of any court of competent jurisdiction, such decision shall not affect the validity of the remaining PAGE 264 of 355

BACKGROUND
On March 17, 2020, the City Council proclaimed a local emergency due to the COVID-19 pandemic. The federal government, State of California, Los Angeles County Board of Supervisors, and the Los Angeles County Health Officer have also declared public health emergencies. On March 19, 2020, both the County and State issued “Stay at Home” orders. Over the past year, modifications to these orders have been announced gradually.
• Most recently, on Friday, March 4, 2022, LA County Department of Health updated their Health Order regarding masks to change the requirement for indoor masking to recommended, but not mandatory, masking indoors. Effective March 8, the City changed masking requirements in City facilities to align with this order and masks are now optional for City staff and patrons.

DISCUSSION
COVID-19 Response Update
The City has made every effort to provide a coordinated response to ensure resident and employee safety while still providing essential City services.
While our overall response efforts have been managed by the City Manager’s Office and the Fire Department, each City department has played an active role in the development and execution of new policies and procedures, both in response to orders from the County Health Officer and the State of California and based on the specific needs of our own community. The City’s Executive Team continues to meet frequently to coordinate efforts, update each other on conversations with other agencies, discuss necessary changes or adaptations to our City services and procedures, and proactively plan for the weeks and months ahead.
On March 17, 2020, the San Marino City Council approved Resolution No. R20-09, proclaiming the existence of a local emergency concerning the COVID19 virus. On July 14, 2021, the City Council revisited this proclamation and directed staff to schedule the local state of emergency for periodic review by the City Council. The City of San Marino continues to operate under that proclamation of local emergency. Conventional emergency management favors not terminating a state of local emergency unless it is certain that it will not be needed. Establishing such certainty during this emergency has been particularly difficult, especially since the COVID-19 pandemic contains elements of novelty where well-established decision points for action do not exist.
Staff plans to recommend to the City Council, an end to the City of San Marino’s proclamation of local emergency on February 24, 2023. This will coincide with the State of California COVID-19 State of Emergency that will end on February 28, 2023.
Starting Tuesday, May 31, 2022, the management of the Resident Support Hotline services transitioned from the Fire Department to the Community Services Department/Recreation Division located at the Stoneman Building.
Recreation office support staff assumed 100% of the duties and responsibilities that encompass a seamless transition of these services. This includes answering phone calls to the hotline, monitoring the email account daily, and making quarterly outreach calls.
Since our last report on September 14, 2022, the following updates have occurred:
• Updated booster vaccines are now available and recommended at least 2 months after your most recent COVID-19 vaccination shot.
• As of December 31, 2022, the City of San Marino has had 2,316 COVID cases, an increase of 3.5% (80 cases) since November 30, 2022. • The Los Angeles County Department of Health continues to recommend vaccines as the best way to prevent severe illness and hospitalization.
As of December 31, 2022, 88.1% of San Marino residents age 5 and older have been fully vaccinated. 68.3% of residents age 12 and older have received a vaccine booster.
• The City monitors information from the Los Angeles Department of Public Health and the Center for Disease Control and Prevention (CDC) regarding the Omicron variant. It will provide information to residents as it becomes available. Weekly COVID-19 community updates have continued.
• Masking is optional in City facilities.
• The Los Angeles County Department of Health has issued a Health Officer Order to recommend, but not require, masks indoors. • The City of San Marino’s vaccine mandate is in place for employees. • The Community Services Department continues to manage the City’s Resident Support Hotline in the EOC, which provides a lifeline for residents in need of critical supplies and information. • The City’s EOC remains open during business hours at Level 3; this level provides regular monitoring of information briefs and reporting to the County and State on the City’s COVID response, monitoring PPE for City Departments and prepare documentation for cost recovery. The EOC monitors critical updates regarding the COVID virus and the City’s response.
• As of October 31, 2022, Recreation revenues are $301,502. This time last year, Recreation revenues were $131,803. Year-To-Date, Recreation revenues are up approximately 145% compared to the previous year.
COVID-19 Financial Update
As of November 30, 2022, the City has incurred $2,794 of new expenses in materials & supplies and personnel expenditures related to COVID-19 since the last City Council update. The City now has expended a total of $632,851 since the emergency was declared. Attachment I of the staff report includes the expenditures by line item. These expenditures utilized the proper procurement process and are within the City Manager’s regular purchasing authority for purchases under $30,000. The table breaks out expenses already reported to City Council and new costs.

RECOMMENDATION
Staff recommends the Council receive and file this report. If the City Council concurs with the staff’s recommendation, an appropriate motion would be:

SUBJECT: ACCEPTANCE OF $1,013.86 DONATION FROM THE SAN
MARINO WOMEN’S CLUB
STRATEGIC PLAN CRITICAL SUCCESS FACTORS
Efficient, Responsive, and Effective City Services
Fiscally Responsible and Transparent City Government
BACKGROUND
On November 17, 2022, the Community Services Department, Library Division received a generous $1,013.86 donation from the San Marino Women’s Club (Attachment 1).
From a financial perspective, this gift represents an unbudgeted revenue source. The City’s Donation Policy requires a formal budget amendment to properly document and receive the funds (Attachment 2).
DISCUSSION
The requested budget amendment is administrative. It accepts and acknowledges the San Marino Women’s Club’s gift and approves a revenue and expenditure budget amendment – both in the amount of $1,013.86 – to the City’s Restricted Donations Fund.
The monies are to be used for children’s activity cubes for the Children’s Room.
With the purchase of these items, the Library can continue to support children and families by providing an opportunity for them to benefit from the power of play. Research shows that play can help children develop and thrive emotionally, mentally, and physically. These two activity cubes feature a Steve Talt, Mayor

FISCAL IMPACT & PROCUREMENT REVIEW
The subject donation will have no impact on the General Fund and represents an unexpected benefit to the City’s Restricted Donations Fund budget (Fund No. 281) for this fiscal year. The donation will be recorded to the following accounts:
Revenue: 281-92-3601-0000: Children’s Material Donations Expenditure: 281-92-4376-0000: Children’s Materials & Supplies This report requires no procurement review.
LEGAL REVIEW
The City Attorney's office has reviewed and approved as to form.
RECOMMENDATION
Staff recommends the Council accept the $1,013.86 donation from the San Marino Women’s Club. If the City Council concurs with staff’s recommendation, an appropriate motion would be:
“I move to (1) accept the donation of $1,013.86 from the San Marino Women’s Club; (2) approve the fiscal year 2022-23 revenue budget amendment to recognize revenue of $1,013.86 in the Restricted Donations Fund at Account 281-92-3601-0000 (Children’s Material Donations) and; (3) approve the fiscal year 2022-23 expenditure budget amendment of $1,013.86 in the Restricted Donations Fund at Account 281-92-4376-0000 (Children’s Materials & Supplies).”

SUBJECT: RATIFICATION OF THE FY 2021-22 CALIFORNIA STATE
LIBRARY REPORT
STRATEGIC PLAN CRITICAL SUCCESS FACTORS
Efficient, Responsive, and Effective City Services
Fiscally Responsible and Transparent City Government
BACKGROUND
Each year, the California State Library requires all public libraries to submit an annual report. The California State Library Report summarizes financials, staffing, and programs / services offered by each public library. The data submitted acts as a tool for analysis among libraries and can be used to support funding requests.
Pursuant to California Education Code §18927, the Library Board of Trustees is required to submit the California State Library Report to the City’s legislative body, the City Council. On November 28, 2022, the Library Board of Trustees voted to receive and file the Report and recommend it for ratification by the City Council.
DISCUSSION
Attachment 1 is Crowell Public Library’s fiscal year (FY) 2021-22 California State Library Report submission. The report was submitted to the State on November 8, 2022. Some highlights of the report are:
• Library visits increased significantly from last year; 183,064 people walked through the doors in FY 2021-22, compared with 8,100 in FY Steve Talt, Mayor

Tony Chou, Council Member

2020-21. The FY 2021-22 figure is 63% of the number of Library visits in FY 2018-19, and represents a return of patrons to the Library postpandemic. • The number of questions answered at the Reference Desk also saw a significant increase, from 1,218 in FY 2020-21 to 6,863 in FY 2021-22.
Staff expects this number to increase as there are more staff to address patron needs at the Reference Desk.
• Collection expenditures decreased by 23% from prior year due to staffing capacity issues; several vacant full-time and part-time positions made it difficult to develop the collection / maintain consistent purchasing. Despite that decrease, collection use increased; 180,851 items were checked out during FY 2021-22 as compared with 59,321 in FY 2020-21.
• Children’s program participation increased from the previous year by 167%, from 690 participants in FY 2020-21 to 1,845 in FY 2021-22, despite having to cancel programs in January and February due to high numbers of COVID-19. Numerous take and make kits (self-directed activities) were still offered for children and young adults as pandemic restrictions lifted.
• The number of digital audio and video materials increased from 3,763 to 5,535 items, while the number of physical audio and video materials decreased from 7,390 to 6,634; this is a trend the Library will continue to move towards as staff work to provide content to patrons on digital platforms where demand is highest.
FISCAL IMPACT & PROCUREMENT REVIEW
There is no fiscal impact and procurement review is not applicable.
LEGAL REVIEW
The City Attorney's office has reviewed and approved as to form.
RECOMMENDATION
Staff recommends the Council ratify the FY 2021-22 California State Library Report. If the City Council concurs with staff’s recommendation, an appropriate motion would be:

SUBJECT: APPROVAL OF CONTRACT EXTENSION FOR IT
CONSULTING/MANAGEMENT SERVICES WITH
INTELESYS
STRATEGIC PLAN CRITICAL SUCCESS FACTORS
Fiscally Responsible and Transparent City Government
Efficient, Responsive, and Effective City Services
BACKGROUND
On November 14, 2018, the City Council awarded a three-year contract to Intelesys for Information Technology Consulting/Management Services. On January 12, 2022, the City Council approved the extension of Intelesys’s contract for one year until January 13, 2023.
DISCUSSION
Staff at this time is recommending the City Council extends the IT management services contract with Intelesys for one additional year.
Intelesys has provided IT services to the City the past four years and is accustomed to the City’s IT infrastructure. Attachment 1 of the staff report provides the various IT specific projects Intelesys has accomplished over their contract life, the list below are highlights of completed IT projects:
• Upgraded City’s phone system to Voice Over Internet Protocol (VOIP) • Upgraded City Facility Servers
• Setup Audio Visual (AV) in the Emergency Operations Center (EOC) Steve Talt, Mayor
Steven W. Huang, DDS, Vice Mayor
Tony Chou, Council Member
Calvin Lo, Council Member
Gretchen Shepherd Romey, Council Member
• Installed Mobile Digital Communicator (MDC) in police vehicles • Deployed Mark43 RMS for Police Department
• Upgraded City Facility Servers
The City will undergo various IT projects in the near future which include upgrading City servers, Citywide Wi-Fi, SMC technology consulting and installation, and Office 365 integration that would require a vendor that is acclimated to the City’s IT infrastructure. Staff believes finishing up these IT projects with the same IT vendor will be critical for integration to the City’s IT network. Additionally, staff will be pursuing a Request For Proposal (RFP) later in the year for Information Technology Consulting/Management Services.
FISCAL IMPACT & PROCUREMENT REVIEW
The total costs for the entire one-year contract with Intelesys for IT Management Services is $183,744, which includes annual security software, cloud backup storage, security training for employees, as well as on-going email security and six fixed hours per week of an IT engineer on-site to provide assistance with necessary day-to-day IT requests. Intelesys is not increasing the contract price for the second-year extension. The Adopted Budget for FY 2022-23 includes a sufficient appropriation for this proposed contract and no additional appropriations are requested at this time.
The Finance Director has reviewed this report and determined this is in accordance with S.M.C.C. 02.06.05.B.2 as the best interests of the City are served by dispensing with competitive bidding, as the City will undergo various IT projects in the coming year and Intelesys are experts in regards to the City’s IT infrastructure. Their expertise will provide an efficient and smooth integration of the various IT Projects.
LEGAL REVIEW
The City Attorney reviewed the staff report and proposed agreement and has approved it to legal form.
RECOMMENDATION
Staff recommends the City Council authorize and direct the Acting City Manager to execute a contract extension with Intelesys for the City’s IT management services for one year. If the City Council concurs with staff’s recommendation, an appropriate motion would be:

23.0 Final Payment Acceptance Constitutes Release
Consultant’s acceptance of City’s final payment under this Agreement shall operate as and be a release of City from all claims and liabilities for compensation to Consultant for the Services or anything done or furnished relating thereto. Neither City’s payment to Consultant nor approval of payment constitute, nor be deemed, a release of the responsibility and liability of Consultant, its employees, sub-contractors and agents for the accuracy and competency of the information provided and/or work performed; nor shall such or payment or approval be deemed to be an assumption of such responsibility or liability by City for any defect or error in the work prepared by Consultant, its employees, subcontractors and agents.
24.0 Prohibited Interests; Conflict of Interest
24.1. Consultant covenants that it presently has no interest and shall not acquire any interest, direct or indirect, which may be affected by the Services, or which would conflict in any manner with the performance of the Services. Consultant further covenants that, in performance of this Agreement, no person having any such interest shall be employed by it. Furthermore, Consultant shall avoid the appearance of having any interest, which would conflict in any manner with the performance of the Services.
Consultant shall not accept any employment or representation during the term of this Agreement which is or may likely make Consultant “financially interested” (as provided in California Government Code §§1090 and 87100) in any decision made by City on any matter in connection with which Consultant has been retained.
24.2. Consultant further warrants and maintains that it has not employed or retained any person or entity, other than a bona fide employee working exclusively for Consultant, to solicit or obtain this Agreement. Nor has Consultant paid or agreed to pay any person or entity, other than a bona fide employee working exclusively for Consultant, any fee, commission, gift, percentage, or any other consideration contingent upon the execution of this Agreement. Upon any breach or violation of this warranty, City shall have the right, at its sole and absolute discretion, to terminate this Agreement without further liability, or to deduct from any sums payable to Consultant hereunder the full amount or value of any such fee, commission, percentage or gift.

24.3. Consultant warrants and maintains that it has no knowledge that any officer or employee of City has any interest, whether contractual, noncontractual, financial, proprietary, or otherwise, in this transaction or in the business of Consultant, and that if any such interest comes to the knowledge of Consultant at any time during the term of this Agreement, Consultant shall immediately make a complete, written disclosure of such interest to City, even if such interest would not be deemed a prohibited “conflict of interest” under applicable laws as described in this subsection.
25.0 Attorneys’ Fees
If either party commences any legal, administrative, or other action against the other party arising out of or in connection with this Agreement, the prevailing party in such action shall be entitled to have and recover from the losing party all of its attorneys’ fees and other costs incurred in connection therewith.
