Agenda Number: 10 Section Name: CONSENT CALENDAR File ID: 22-6099 TO: City Council
FROM: Drew Corbett, City Manager
PREPARED BY: City Manager's Office
MEETING DATE: May 02, 2022
SUBJECT:
COVID-19 Declaration of Emergency – Termination
RECOMMENDATION:
Receive an update on operational impacts and other City efforts related to COVID-19 and confirm the decision to allow the City’s declaration of emergency to lapse as of April 30, 2022.
BACKGROUND:
On March 4, 2020, the Governor proclaimed a state of emergency in response to the outbreak of respiratory illness due to a novel coronavirus (COVID-19). As a consequence of this proclamation the City Manager, acting as the City’s Director of Emergency Services, was authorized to make and issue rules and regulations on matters reasonably related to the protection of life and property as affected by such emergency. In accordance with Government Code Section 8558(c), the City Council declared a local health emergency on March 16, 2020. Per Government Code Section 8630(c), the City Council is required to review the need for continuing the local emergency at least once every 60 days until the City Council terminates the declaration of local emergency.
In addition to positioning the City for potential mutual aid and cost recovery opportunities, the emergency proclamation also provides the City Manager broader authority to be able to expeditiously address issues related to the emergency.
With that said, actions taken by the City Manager outside of the general authority of the duties provided for in the City Charter are subject to confirmation by Council as soon as practicable.
While the State’s emergency declaration is still in effect and the City is still addressing pandemic-related issues, at this point in the pandemic staff believes the local declaration of emergency, which lapsed on April 30th, does not need to be renewed. It is expected that any further pandemic-related operational adjustments will be able to be made under the general authority of the City Manager’s duties as provided for in the City Charter. Should operational adjustments be needed beyond what is permitted under the City Manager’s authority, those adjustments can be brought for Council consideration at regularly-scheduled meetings.
There are two existing Council actions that are impacted by allowing the emergency declaration to lapse. The first is that the rents for tenants at City properties had been reduced to 50% of the standard rent during the emergency proclamation.
With the end of the emergency proclamation, rents will go back up to the standard amount starting May 1st. Tenants have been made aware of this situation. The second impact is related to Emergency Ordinance No. 2020-11. This ordinance imposed a COVID-19 related moratorium on evictions, which remained in effect until September 30, 2020. The ordinance also stated that the tenant’s obligation to pay any unpaid rent from this moratorium period would be deferred until 12 months after the emergency proclamation ended, beginning with an initial six-month period than can be extended for another six months with payment of a percentage of deferred rent, as specified. As such, the lapsing of the emergency proclamation means that any unpaid rent from the original moratorium period would need to be fully repaid no later than 249 of 250
