CITY OF SANTA BARBARA
COUNCIL AGENDA REPORT
AGENDA DATE: January 11, 2022
TO: Mayor and Councilmembers
FROM: Environmental Services Division, Sustainability and Resilience Department
SUBJECT: Approval Of Agreement With MSW Consultants For City-Wide Solid Waste Cost Of Service Study
RECOMMENDATION:
That Council authorize the Sustainability and Resilience Director to execute a Professional Services Agreement with MSW Consultants for a City-Wide Solid Waste Cost of Service Study in the amount of $99,520 and to approve contract amendments up to $9,952 for extra services that may result from necessary changes in the scope of work.
DISCUSSION:
The Environmental Services Division is undergoing an evaluation of the City’s entire solid waste system in preparation for the expiration of the City’s current Solid Waste Franchise Agreement on June 7, 2023. The Solid Waste Cost of Service Study will provide comprehensive analysis of the cost to deliver the solid waste services that are currently provided to the community as well as calculate the cost of services required to comply with relevant laws and regulations, particularly requirements for Senate Bill 1383 (Chapter 395, Statutes of 2016) for organics diversion, and Proposition 218 for public noticing of utility rates. The study will also include a review of the City’s residential and commercial solid waste and diversion rates to ensure that they sustain the enterprise while protecting the interests of the community. Together, this report will give staff critical cost information to consider in the next Solid Waste Franchise Agreement.
In October 2021, staff issued a request for proposal (RFP) for the Solid Waste Cost of Service Study and received two proposals. After careful consideration, staff selected MSW Consultants (MSW), whose proposal best demonstrated the necessary qualifications and understanding of the scope of work.
MSW provides solid waste consulting services exclusively to local governments and has over 30 years of experience working with more than 60 jurisdictions. MSW is also very familiar with the solid waste systems in the Santa Barbara area, having previously contracted with the City to assess the hauler’s operating profitability and for evaluating Agenda Item No. 10

the costs and terms of the County’s proposed Material Delivery Agreement related to the Tajiguas Resource Recovery Project.
To complete the study, MSW will work in accordance with generally accepted professional practices and principles. Work will be performed in two phases, with the first phase including a review and analysis of existing conditions (e.g. costs, rates, fees, methodologies, level of service, etc.) to determine the current cost of service for the solid waste system, and during the second phase, MSW will develop proposed rates, fees, and options for further consideration and potential adoption, as well as a 10-year financial plan.
BUDGET/FINANCIAL INFORMATION:
There are sufficient expenditure appropriations in the adopted Sustainability and Resilience Solid Waste Operating Budget in Fiscal Year 2022 to fund the contract, including extra services with MSW.
SUSTAINABILITY IMPACT:
The Solid Waste Cost of Service Study will allow staff to set rates that ensure the City’s material diversion goals are met while providing revenues to support the enterprise.
A copy of the contract may be requested from the Sustainability and Resilience Department for public review; please contact [email protected] to request a copy.

COUNCIL AGENDA REPORT
AGENDA DATE: January 11, 2022
TO: Mayor and Councilmembers
FROM: City Attorney’s Office
SUBJECT: Authorization For Legal Services With Kaplan Kirsch & Rockwell, LLP For Special Counsel Services And Related Costs
RECOMMENDATION: That Council:
A. Authorize the City Attorney to execute a legal services agreement with Kaplan Kirsch & Rockwell, LLP, for specialized legal services and related costs for on-call legal services for matters specifically arising from the City’s development and operation of the Santa Barbara Municipal Airport, in an amount not to exceed $250,000; and B. Increase appropriations in the Fiscal Year 2022 Airport Department budget in the amount of $110,000 funded from the Airport Operating Fund reserves.
DISCUSSION:
The City Attorney’s Office provides general legal advice to the Santa Barbara Airport.
Issues arising out of operation and development of the airport often require specialized legal expertise, particularly matters involving application of Federal Aviation Administration and the Transportation Security Administration rules and regulations. In certain instances, rather than the City Attorney’s Office researching these specialized legal issues, it is in both the Airport and the City Attorney’s Office’s best interest to retain outside legal counsel that specializes in airport law. In those instances, the City Attorney’s Office often retains the law firm Kaplan, Kirsch, & Rockwell, LLP (KKR) to provide additional legal support to the Airport. KKR’s legal practice focuses on advising airports across the country.
Rather than come to Council with requests for authorization to retain KKR on an issue by issue basis, the City Attorney’s Office and the Airport would like to enter into a legal services agreement that would allow the City Attorney’s Office to engage KKR’s service as the issues arise without the need of entering into separate contracts. Issues arising at the Airport are often time sensitive and this larger global legal service agreement will allow the City Attorney’s Office to more quickly address the issues and accommodate the Airport’s needs.
Agenda Item No. 11
Council Agenda Report
Authorization For Legal Services With Kaplan Kirsch & Rockwell, LLP For Special Counsel Services And Related Costs
January 11, 2022
The City Attorney’s Office is requesting authorization to engage KKR’s services in an amount not to exceed $250,000, however, the initial contract will only authorize work up to $110,000. If over the next couple of years, KKR’s legal services reach the intial $110,000, the Airport will appropriate the additional $140,000 to reach the approved not to exceed amount of $250,000. The City may terminate the legal services agreement with KKR at anytime it determines that KKR’s services are no longer needed.
As the City Attorney’s Office has advised Council in the past, we only consider retaining outside after serious consideration whether the issue or matter meets one or more of the following four “warrants”:
1. We need specialized expertise of a nature that it is not cost-effective to develop the expertise in-house;
2. When the severity or the importance of an issue justifies hiring “marquee” talent for the work;
3. When we have a conflict of interest; and
4. When existing workload requires “overflow” counsel.
In this case, due to the specialized nature of legal issues surrounding airport operation and development, KKR is being retained to satisfy the first warrant.
BUDGETARY IMPACTS:
The cost for legal support and related costs for this case will be paid from the Airport Operating Fund reserves.

COUNCIL AGENDA REPORT
AGENDA DATE: January 11, 2022
TO: Mayor and Councilmembers
FROM: Fire Department- Administration
SUBJECT: Professional Services Agreement For Fire Department Community Risk Assessment And Development Of A Fire Apparatus and Station Location Study
RECOMMENDATION:
That Council authorize the Fire Chief to execute a professional services agreement with AP Triton Inc. in the amount of $50,296 to conduct a Community Risk Assessment Analysis and Standards of Cover Deployment Analysis.
DISCUSSION:
For Fiscal Year (FY) 2022, City Council authorized funding to the Fire Department to conduct a Community Risk Assessment Analysis and Standards of Cover Deployment Analysis. This type of study has never been done by the Fire Department. As the name implies, the first part of the study will analyze the fire (including wild fire), EMS, technical rescue, hazardous materials, transportation and natural hazards that our unique community faces.
After a detailed analysis of the community’s risk, the Study will review the deployment of our fire department including personnel, fleet, capital facilities and services provided.
Significant analysis will be conducted of historical system performance including: call types, unit-hour utilization (UHU) and Effective Response Force.
The study will additionally look at the County’s ambulance contract and current new Request for Proposal (RFP) for ambulance service. The study will analyze the proposed ambulance coverage to ensure our citizens are/will be receiving timely ambulance care and transport.

This study will ensure that our Fire Department is serving the community in the most efficient manner with correct amount of on-duty personnel, apparatus and station locations to currently mitigate any incident in the City. Efficiency and future needs will be specifically evaluated.
