ENVIRONMENTAL REVIEW
The Project went through the environmental and design review process and was subject to review under both CEQA and the National Environmental Policy Act (NEPA). The Project’s MND was adopted on February 9, 2017, by the Planning Commission and A Council Agenda Report
Increase The Contracts For Construction Management And Environmental Mitigation And Monitoring Services Of The Las Positas And Modoc Roads Multiuse Path Project March 1, 2022

Page 6 ends

Notice of Determination was filed on February 16, 2017. The Project was determined to be categorically exempt under NEPA on March 1, 2017, and re-validated on October 15, 2019. A staff level CEQA addendum was approved in 2019 to reflect minor adjustments to the Project’s final design as a result of value-engineering analysis. In addition, the recent changes to the mitigation plan are subject to CEQA review and will be processed by staff as a second CEQA addendum. Authorization of consultant contracts and appropriation of funding are administrative actions and are not considered a new project under California Environmental Quality Act (CEQA) as defined in the CEQA Guidelines Section 15378. The proposed actions do not commit the City to approving a new project nor does it prohibit further study of environmental impacts of a proposed project. Given the administrative nature, it can be seen with certainty that there is no possibility the proposed actions would have a significant effect on the environment, and are therefore exempt under Section 15061(b)(3) of the CEQA Guidelines. In addition, City staff will conduct separate environmental review in compliance with CEQA prior to performance of mitigation work within Mesa Creek.

COUNCIL AGENDA REPORT
AGENDA DATE: March 1, 2022
TO: Mayor and Councilmembers
FROM: Administration Division, Community Development Department SUBJECT: Amendments To Professional Services Agreements For Permit, Plan Check, And Inspection Services
RECOMMENDATION: That Council:

A. Authorize the Community Development Director to execute the first amendment to increase the amount of Santa Barbara City Agreement No. 26978 with Bureau Veritas North America, Inc., by $385,000, for a total contract amount of $465,000, to provide permit, plan check, and inspection services; B. Authorize the Community Development Director to execute the first amendment to increase the amount of Santa Barbara City Agreement No. 26979 with Interwest Consulting Group, by $100,000, for a total contract amount of $175,000, to provide permit, plan check, and inspection services; and
C. Approve an increase in Fiscal Year (FY) 2022 revenue and expenditure appropriations in the General Fund in the amount of $200,000, funded by building permit revenues projected to exceed the FY 2022 adopted budget amount by at least $200,000, to cover a portion of the costs of the recommended amendments to Santa Barbara City Agreements No. 26978 and No. 26979.

DISCUSSION:

Thorough and timely building permit plan reviews and inspection services help the community establish and maintain a safe, accessible, and healthy built environment. In order to provide appropriate service levels with acceptable turnaround time for permit, plan check, and inspection services of the State’s Title 24 Building Standards and local amendments, the use of contract services is necessary to address periods of increased demand as well as unanticipated staffing shortages.

Amendments To Professional Services Agreements For Permit, Plan Check, And Inspection Services
March 1, 2022

Page 2 ends

Contract building and safety program services are key to maintaining building permit program services for customers. These services prevent and reduce building permit plan check backlogs, expedite the plan check processes according to City priorities, and can provide other program services (management, inspections, permit counter staff, etc.) that improve the customer’s experience. These contract services will be used both to backfill work created by City staff vacancies and to supplement the services offered by City staff.

The Building and Safety Division has experienced sustained vacancy rates as high as 30 percent during Fiscal Year 2022. Backfilling Building Inspector vacancies with contract services and using contract plan check services has exhausted available contract amounts and driven the demand for increased contract services.

The recommended Bureau Veritas North America, Inc., contract amendment includes $375,000 for contract services to the Building and Safety Division and $10,000 to be funded by Measure C from the Police Station Capital Project. The Police Station Capital Project requires pre-application plan review services that can be filled through the Bureau Veritas contract. The recommended Interwest Consulting Group contract amendment includes $100,000 for contract services to the Building and Safety Division. The contract amendment amounts are summarized by funding source in the Budget/Financial Information section below.

The Building and Safety Division has an established working relationship with both Bureau Veritas North America, Inc., and Interwest Consulting Group. Both vendors have demonstrated expertise in the field, met promised turnaround times, and delivered a quality work product. Authorizing the recommended contract amendments will allow the Building and Safety Division to continue to provide timely, professional service while working through a period of high vacancy.

BUDGET/FINANCIAL INFORMATION:

The recommended contract amendments have three sources of funding. Funding includes existing appropriated expenditures in Building and Safety’s Fiscal Year 2022 General Fund Budget, existing appropriated expenditures in the Fiscal Year 2022 Measure C Fund Budget, and an increase in expenditure appropriations in Building and Safety’s Fiscal Year 2022 General Fund Budget funded by building permit revenues that are projected to exceed the FY 2022 adopted budget amount by at least $200,000.

In order to meet the revenue target required to fund the additional $200,000 in requested appropriations, building permit revenue needs to average at least $235,000 per month over the final six months of FY 2022. Over the past 30 months, the average monthly building permit revenue amount has been $355,000. With a high degree of confidence, revenue can be projected at a level adequate to support the $200,000 in requested appropriations.

Funding sources for the contract amendments are listed in the tables below.

COUNCIL AGENDA REPORT
AGENDA DATE: March 1, 2022
TO: Mayor and Councilmembers
FROM: Water Resources Division, Public Works Department SUBJECT: Report Of Emergency Purchase Order To Replace The El Estero Water Resource Center Substation B Transformer
RECOMMENDATION:

That Council receive a report regarding an Emergency Purchase Order issued to VISTAM, Inc., totaling $403,975 for an emergency replacement of the El Estero Water Resource Center Substation B Transformer.

DISCUSSION:

During an electrical system preventative maintenance inspection at El Estero Water Resource Center (EEWRC) on April 21, 2021, it was discovered that the transformer in Substation B was no longer safe to operate due to deteriorated electrical insulation. The transformer had to be de-energized immediately. Substation B powers critical and essential electrical circuits at the EEWRC, which include the Influent Pump Station, Administration Building, Water Resources Laboratory, and Tertiary Filtration Facility.

Upon discovery of the aforementioned safety issue, the City of Santa Barbara’s (City) policy was followed to secure the site and ensure the safety of staff and the protection of facilities, make the findings of an emergency, and request and receive the approval of the Public Works Director. An emergency purchase order to rent and install a temporary transformer was issued. The temporary transformer was installed on April 23, 2021. Once a temporary repair was made, VISTAM, Inc. (Vistam), was directed to procure and install the permanent replacement transformer due to their qualifications and familiarity with EEWRC’s electrical system. The permanent transformer went into service on October 29, 2021, the rental unit was removed from the EEWRC on November 3, 2021, and all other construction was completed on November 22, 2021. The EEWRC is the only facility capable of treating the City's wastewater, and the transformer needed replacement under emergency provisions in order to protect public health and the environment.

The standard procurement process would have required extended time to solicit proposals and execute a contract. The time to solicit multiple proposals would have significantly delayed the replacement, increasing rental costs and the risks associated with relying solely on the temporary transformer and emergency generator.

BUDGET/FINANCIAL INFORMATION:

The total cost of the emergency purchase order was $403,975. There are sufficient appropriated funds in the Facilities Maintenance and Equipment Repair accounts of the Wastewater Treatment Operating Fund to cover the cost of this Project.

ENVIRONMENTAL REVIEW:

The nature of the work was an emergency that threatened public service facilities necessary to maintain services essential to public health, safety, and welfare. Such work is exempt from California Environmental Quality Act (CEQA) under Public Resources Code § 21080 (b)(2) and CEQA Guidelines § 15269(b).

WATER COMMISSION RECOMMENDATION:

This item was presented to the Water Commission at its meeting on February 17, 2022, and the Commission voted 4-0 in support of staff’s recommendation.

COUNCIL AGENDA REPORT
AGENDA DATE: March 1, 2022
TO: Mayor and Councilmembers
FROM: Administration, Library Department
SUBJECT: Accept Grant Funding For Expansion Of Library On The Go Mobile Library To Add An Additional Mobile Van And Staff Support RECOMMENDATION: That Council:

A. Accept the California State Library grant; and
B. Approve an increase in revenue and expenditure appropriations in the Library’s Miscellaneous Grants Fund in the amount of $250,000, funded by the California State Library to expand the Library On the Go program to support additional outreach opportunities in the community.

DISCUSSION:

The Library Department has been awarded a $250,000 Stronger Together: Improving Library Access Grant from the California State Library. This additional funding will assist in the library acquiring another Library On the Go Vehicle and salary support for two part time staff members. The expanded Library on the Go project will support additional outreach opportunities for youth and families, including Stay and Play at off-site locations, school age programming at schools and afterschool program sites, and family STEAM activities in public parks. This will increase the Library’s reach in neighborhoods that don’t have a library branch and other underserved areas of the community in order to make programs more accessible.

BUDGET/FINANCIAL INFORMATION:

By accepting this grant, the Library Department will increase revenue and expenditure appropriation of $250,000 in the Fiscal Year 2022 Library’s Miscellaneous Grants fund.

CITY OF SANTA BARBARA

COUNCIL AGENDA REPORT
AGENDA DATE: March 1, 2022
TO: Mayor and Councilmembers
FROM: Housing and Human Services Division, Community Development Department
SUBJECT: Public Hearing And Adoption Of HOME American Rescue Plan Funds Allocation Plan
RECOMMENDATION: That Council:

A. Conduct a public hearing to obtain input on the City’s HOME American Rescue Plan (ARP) Allocation Plan;
B. Adopt the City’s HOME ARP Allocation Plan for submittal to the U.S. Department of Housing and Urban Development (HUD);
C. Approve the Substantial Amendment of the City’s Program Year 2021 Annual Action Plan to include the HOME Allocation Plan; and
D. Authorize the City Administrator to sign all necessary documents to submit the City’s HOME ARP Allocation Plan to HUD.

EXECUTIVE SUMMARY:

The City of Santa Barbara has been allocated approximately $1.8 million in supplemental HOME funds through the American Rescue Plan to undertake certain activities that will benefit persons who are experiencing homelessness, or are at risk of homelessness. In order to receive the funds, the City is required to adopt an Allocation Plan to establish the local needs and priorities and hold a public hearing.

Federal regulations of the supplemental HOME funds require that the City adopt an Allocation Plan identifying the types of eligible activities it will support with these funds.

Based on an analysis of local service gaps, staff is recommending the funds to provide support services for persons placed into housing, and for development of affordable rental housing. Adoption of the Allocation Plan does not commit funding to any one specific Agenda Item No. 17

activity at this time, and any specific commitments will be presented to Council for approval at a later date.

DISCUSSION:

Background
On March 11, 2021, the American Rescue Plan (ARP) was signed into law, which provides federal funding to address the continued impact of the COVID-19 pandemic on the economy, public health, State and local governments, individuals, and businesses.

As part of this plan, Congress appropriated ARP funds to be administered through the HOME Investment Partnership Program (HOME ARP funds) to carry out four activities that primarily benefit qualifying individuals and families who are homeless, at risk of homelessness, or in other vulnerable populations:

1. Development and support of affordable housing;

2. Tenant-Based Rental Assistance (TBRA);

3. Provision of supportive services; and

4. Acquisition and development of non-congregate shelter units.

The City of Santa Barbara is a Participating Jurisdiction that receives annual HOME allocations. As such, the City has been allocated $1.8 million in HOME ARP funds, which will be available for use until September 30, 2030, for the above-referenced activities.

The HOME ARP program is administered by the U.S. Department of Housing and Urban Development (HUD), which issued implementation guidelines via the HUD Office of Community Planning and Development Notice, CPD-21-10. HUD guidelines stipulate that recipients of HOME ARP funds prepare and submit an Allocation Plan describing the planned use for these funds, in accordance with federal regulations. Additionally, HUD requires recipients of HOME ARP funds to do a Substantial Amendment of its 2021–22 Annual Action Plan (AAP), which outlines the City’s planned use of other received federal funds, such as the Community Development Block Grant, to incorporate the HOME ARP Allocation Plan.

HOME Allocation Plan
The HOME Allocation Plan consists of the following required components:
 Consultation with local jurisdictions and service providers;  Public participation, including one public hearing and a 15-day public review period;
 Needs Assessment and Gaps Analysis, including:
o A description of HOME-ARP qualifying populations within the City; o An assessment of unmet needs of the qualifying populations; Council Agenda Report
Public Hearing And Adoption Of HOME American Rescue Plan Funds Allocation Plan March 1, 2022

Page 3 ends

o An assessment of gaps in housing and shelter inventory, availability of homeless assistance and services, and homelessness prevention service delivery system;
 A summary of the planned use of HOME-ARP funds for eligible activities based on the unmet needs of the qualifying populations;
 An estimate of the number of housing units that will be produced or preserved; and  A description of any preferences for individuals and families in a particular qualifying population or a segment of a qualifying population.

Staff consulted with the Santa Maria/Santa Barbara County Continuum of Care (CoC), and the Elected Leaders Forum to Address Homelessness to solicit feedback on prioritization of HOME ARP funds. Additionally, staff solicited feedback via email from organizations that provide services to persons experiencing homelessness.

The City’s Allocation Plan adopts HUD’s definition of “qualifying populations” eligible for assistance under the HOME ARP, which includes: any individuals or families who are, homeless; at risk of homelessness; fleeing, or attempting to flee, domestic violence, dating violence, sexual assault, stalking, or human trafficking; and other populations. “Other populations” are individuals and families who do not fit the above definitions, but have previously been homeless and are currently housed with temporary or emergency assistance, and need additional assistance or services to avoid returning to homelessness; or households that meet HUD guidelines for being “at greatest risk of housing instability” due to factors such as income level and disproportionally high cost of housing. Staff is applying the broadest definition of eligible persons due to urgent need among the aforementioned groups, and to maximize flexibility in funding activities.

The Needs Assessment and Gaps Analysis was developed by researching the 2020 Point in Time Count; the Santa Barbara County HOME ARP Plan, which contained significant data from the Homeless Management Information System, Vulnerability Index - Service Prioritization Decision Assistance Tool, and HUD performance data; the Santa Barbara County Community Action Plan to Address Homelessness, which the city formally supported in April 27, 2021; real estate data; and the City’s Housing Market Analysis.

Consultation and assessment revealed several key findings:
 The City of Santa Barbara has the highest population of persons experiencing homelessness in the county (48 percent).
 There is a significant shortage of temporary and permanent housing needed to house persons experiencing homelessness in the South County.  The City of Santa Barbara has few direct, readily available resources to assist persons experiencing homelessness.
 The feedback received from the consultation was to prioritize funding for supportive services, specifically for persons placed into housing so that they can remain housed. The second most common theme was support for the development of housing units for persons experiencing homelessness.

Council Agenda Report

Planned Use of HOME ARP Funding
The HOME ARP Allocation Plan requires that the City identify the types of activities it will support with these funds for the duration of the HOME ARP grant. Based on the analysis discussed above, staff recommends using funds as follows:

Eligible Activity Funding Amount
Supportive Services $ 600,000
Acquisition and Development of NonCongregate Shelters $ 0 Tenant Based Rental Assistance (TBRA) $ 0
Development of Affordable Rental Housing $ 982,863
Administration and Planning (capped at 15%) $ 279,328
Total HOME ARP Allocation $ 1,862,192
Allocating funds to the other activity types (i.e., non-congregate shelter and TBRA) is less desireable for several reasons. First, the City has access to more funding sources that support the development of affordable rental housing than it does for non-congregate shelters. Additionaly, the City makes the majority of its regular HOME annual allocation available to support TBRA activities. To provide context of the other resources available to the City, Attachment 1 contains a list of all homelessness and housing funding available to the City, including Community Development Block Grant and Permanent Local Housing Allocation. There are significant gaps across the spectrum of shelter and housing inventory and service delivery available in Santa Barbara. The City leverages local resources to help meet local need, but it does not receive sufficient, consistent direct funding to fill all the gaps identified in the key findings. Additionally, the lack of supportive housing options hampers service providers’ efforts to help homeless individuals find and maintain permanent housing.

The State of California has made significant investments to provide financial assistance to local jurisdictions to address homelessness, such as Project Homekey and Homeless Housing and Assistance Program, but those funds do not come to the City directly and in cases like Project Homekey, are awarded competitively or are allocated through the County and/or the Continuum of Care.

Given the City’s limited resources, the rationale for prioritizing the activity types in the table above is that HOME ARP funds give the city the ability to leverage funds to acquire, develop, or rehabilitate housing with funds made available through financial programs like Project Homekey. Mindful of the high cost of real estate in Santa Barbara (where local real estate data shows that in the first three quarters of 2021, 33 commercial sales totaled $89.4 million), staff recommends leveraging the most amount of funding possible.

Council Agenda Report
Public Hearing And Adoption Of HOME American Rescue Plan Funds Allocation Plan March 1, 2022

Page 5 ends

Additionally, service providers and the County Continuum of Care have identified the need to provide support that ensures formerly homeless persons remain housed.

Adoption of the Allocation Plan does not commit funding to any one specific activity. Any specific commitments will be presented to Council for approval. The City has the option to conduct a Request for Proposals to select a qualified service provider, and/or development projects, or to consider written formal requests for funding from partner agencies such as Santa Barbara County, the Santa Maria/Santa Barbara County Continuum of Care, or the Housing Authority of the City of Santa Barbara. The City also has the ability to amend its Allocation Plan should the funding priorities change during the period of the funding.

The City has received a request for funding from Santa Barbara County Housing and Community Development to leverage HOME ARP funds to provide support services to persons placed into housing with the Emergency Housing Vouchers allocated to the City of Santa Barbara from the American Rescue Plan Act. The request is for $600,000 for the fiscal years of 2022–23 and 2023–24. The County has provided funding toward this effort for the first year of services countywide, and has asked for contributions from all cities countywide. The County’s proposal is in line with the City’s priority needs with HOME ARP funds, and the County’s proposal received support from the Elected Leaders Forum to Address Homelessness; however, staff is evaluating this request to ensure it meets all HOME ARP program requirements, and that the City has an approved allocation Plan accepted by HUD, before making a formal recommendation to Council.

Public Review Process
In accordance with the City’s Citizen Participation Plan for use of federal funds like HOME, the draft HOME ARP Allocation Plan was made available for a 30-day public review and comment period. The draft plan was posted on the City website home page, and a notice was published in the Santa Barbara News-Press. The required Public Hearing will be held as part of this agenda item.

Council approval of the Substantial Amendment of its Program Year 2021 Annual Action Plan is a standard requirement. Once adopted, the Annual Action Plan will be amended to include the HOME ARP Allocation Plan and will be submitted to HUD.

BUDGET/FINANCIAL INFORMATION:

The City has been allocated $1,862,192 in HOME ARP funds, which will be available for use until September 30, 2030. Appropriation of this funding will be brought to Council at a later date.

1 HOME-ARP Allocation Plan Draft
Participating Jurisdiction: City of Santa Barbara Date: January 26, 2022 Introduction
On March 11, 2021, the American Rescue Plan (ARP) was signed into law, which provides federal funding to address the continued impact of the COVID-19 pandemic on the economy, public health, State and local governments, individuals, and businesses.

As part of this plan, the Congress appropriated ARP funds to be administered through the HOME Investment Partnership Program (HOME ARP funds) to perform four activities that must primarily benefit qualifying individuals and families who are homeless, at risk of homelessness, or in other vulnerable populations. These activities include: (1) development and support of affordable housing, (2) tenant-based rental assistance (TBRA), (3) provision of supportive services; and (4) acquisition and development of non-congregate shelter units.

The City of Santa Barbara has been allocated $1.8 million in HOME ARP funds and has developed this HOME ARP Allocation Plan describing the planned use for these funds, in accordance with federal regulations. The HOME ARP implementation guidelines are codified by the U.S. Department of Housing and Urban Development Office of Community Planning and Development Notice, CPD-21-10.

Needs Assessment and Gaps Analysis
Describe the size and demographic composition of qualifying populations within the PJ’s boundaries:

Santa Barbara has the highest population of persons experiencing homelessness in Santa Barbara County. The 2020 Point in Time (PIT) count found 1,897 persons experiencing homelessness countywide, with 68% of those in the South Coast. Notably, of the total countywide homeless population, 48% were specifically within the City of Santa Barbara.

Notably, PIT count data only provides a snapshot of the current state of homelessness within the community on a given date, however Homeless Management Information System (HMIS) data shows that the numbers could be higher. According to the County of Santa Barbara 2020-2021 HUD performance data, 3,347 persons experiencing homelessness were served during this period, which is almost double than PIT counts.

In regard to demographics, VI-SPDAT (Vulnerability Index - Service Prioritization Decision 4 Assistance Tool) assessment data shows that: 80% of persons experiencing homelessness were White; 10% were Black/African-American; 2% were Native Hawaiian or Pacific Islander; 1% were Asian. Thirty one percent were Hispanic. These demographics are generally in line with U.S. Census demographics with two exceptions: Black/African-American persons only make up 2% of the overall citywide population, while making up 10% of the homeless population; and Native Hawaiian or Pacific Islanders, which only make up 0.2% of the general population, but make up 2% of the homeless population. While two different data sources were used for this assessment, this disparity should still be noted and a greater emphasis should be placed on addressing the needs of these particular populations.

Additionally, VI-SPDAT data shows that 19% have a physical disability, 44% have a chronic health condition, 30% have a substance use disorder, and 34% have mental health conditions or brain injuries.

Describe the unmet housing and service needs of qualifying populations, including but not limited to:
• Sheltered and unsheltered homeless populations;
• Those currently housed populations at risk of homelessness; • Other families requiring services or housing assistance or to prevent homelessness; and, • Those at greatest risk of housing instability or in unstable housing situations:

Although there are a number of shelter options in the city, there are not enough to meet demand.

According to the County Action Plan, an additional 68% emergency shelter beds above those currently available are needed countywide to house all the individuals that are living in cars, tents, parks, streets, and riverbeds. In 2019, the Santa Barbara County Community Action Plan to Address Homelessness identified the number and types of temporary and permanent housing needed to satisfy the current unmet need of persons experiencing homelessness in the South County.
• Temporary beds, i.e. shelter beds – 369
• Rapid Rehousing – 537
• Permanent Supportive Housing – 602
• Long Term Subsidy - 270
More recently, the Santa Maria/Santa Barbara County Continuum of Care annual gaps analysis found a continued large need for additional housing, shelter and services. Specifically, 551 interim housing beds; rental assistance for 801 households; 994 supportive housing units; outreach services for 886 individuals; prevention/diversion services for 430 households.

Low income households are at greatest risk of housing instability and are at greater risk of homelessness. Santa Barbara is one of the most expensive cities to live in. Real estate data retrieved by Compass Real Estate shows that as of October 2021, the median residential sales price in the City of Santa Barbara is $1,600,000: an increase of 7.2% from the previous year. The City’s annual rental housing survey in 2021 found that the cost of renting a house or apartment in Santa 5 Barbara is extremely high. The median rent for a studio apartment was $1,700 per month, and a one bedroom costs about $1,900 per month. Larger apartments increase significantly in cost:
$2,700 for a 2-bedroom apartment, and $3,950 for a 3-bedroom, which severely impacts larger households.

Additionally the Housing Market Analysis of the City’s 2020 Consolidated Plan found more than 3,400 households at 30% less of the Area Median Income, were “cost burdened” (defined as paying more than 30% of income on rent) or “severely cost burdened” (paying more than 50% of income on rent).

The Market Analysis also found that between 2000 and 2018 the median home value in Santa Barbara doubled (from $479,800 to $993,600) and median contract rent rose by 89 percent (from $886 to $1,671). Meanwhile, median incomes only rose by 22 percent (between 2010 and 2018).

Identify and consider the current resources available to assist qualifying populations, including congregate and non-congregate shelter units, supportive services, TBRA, and affordable and permanent supportive rental housing:

The City of Santa Barbara has a few resources directly available to assist qualifying populations.

The City is an entitlement jurisdiction for Community Development Block Grants (CDBG) and HOME Investment Partnership funds, and Permanent Local Housing Allocation (PLHA) from the State of California.

The City allocates its entire 15% CDBG Public Services cap for activities that provide shelter or housing to persons experiencing homelessness and victims of domestic violence. The City also has access to approximately $600,000 in CDBG Revolving Loan Funds for rehabilitation of multi-unit affordable housing.

Also, the City allocated the majority of its HOME allocation for TBRA activities for persons who are homeless or at-risk of homelessness. Additionally, the City also makes available General Fund dollars to supplement supportive services and shelter programs on an annual basis.

In fiscal year 2020-2021 the City committed funds as shown in the following table.

TYPE OF PROGRAM FUNDING SOURCE AMOUNT
Prevention Human Services (General Fund) $37,145
TBRA HOME Entitlement & Program
Income
$491,725
Shelter Services CDBG Public Services and General
Fund
$423,828
Supportive Services Human Services and California PLHA $402,200 The City Council of Santa Barbara recognizes the urgency of the homelessness crisis, and during 2021 approved three one-time funding allocations totaling $3.3 million in City reserves to provide non-congregate shelter to persons living in high risk encampments. However, as a result of the COVID 19 pandemic, the City has experienced a significant decline in major revenue sources, including sales tax, transient occupancy tax, and various departmental revenues. The City does not have the financial capacity to fund such large scale projects on an ongoing basis without a steady, 6 ongoing source of direct funding.

Identify any gaps within the current shelter and housing inventory as well as the service delivery system:

As stated earlier, the Santa Maria/Santa Barbara County Continuum of Care annual gaps analysis found a continued large need for additional housing, shelter and services. As demonstrated in the table below.

Source: County of Santa Barbara HOME ARP Allocation Plan Identify the characteristics of housing associated with instability and an increased risk of homelessness if the PJ will include such conditions in its definition of “other populations” as established in the HOME-ARP Notice:

Not applicable. The City does not plan to formally adopt a definition of “other populations”.

Identify priority needs for qualifying populations:

The priority needs for the qualifying populations include providing HOME ARP funds for acquisition, rehabilitation or construction of affordable housing, and supportive services that enable qualifying populations to obtain and maintain permanent housing. Based on feedback received during the consultation process the greatest priority should be given to the provision of supportive services.

Explain how the level of need and gaps in its shelter and housing inventory and service delivery systems based on the data presented in the plan were determined:

The Santa Maria/Santa Barbara County Continuum of Care’s annual gaps analysis was developed using data from the Point in Time Count, Housing Inventory Count, HMIS and Coordinated Entry System data from 2019, and available data from 2020 and 2021.

HOME-ARP Activities
Describe the method for soliciting applications for funding and/or selecting developers, service providers, subrecipients and/or contractors and whether the PJ will administer eligible activities directly:

The City will administer HOME ARP funds directly. For specific activities, when a program is outside the capacity of City staff, the City will conduct a Request for Proposals to select a qualified service provider. For housing activities, the City will conduct a Request for Proposals to identify a 7 qualified development project.

The City will also accept and evaluate written formal requests for funding from partner agencies such as Santa Barbara County, the Santa Maria/Santa Barbara County Continuum of Care, or the Housing Authority of the City of Santa Barbara.

If any portion of the PJ’s HOME-ARP administrative funds were provided to a subrecipient or contractor prior to HUD’s acceptance of the HOME-ARP allocation plan because the subrecipient or contractor is responsible for the administration of the PJ’s entire HOME-ARP grant, identify the subrecipient or contractor and describe its role and responsibilities in administering all of the PJ’s HOME-ARP program:

Not applicable. City staff will administer HOME ARP funds directly.

PJs must indicate the amount of HOME-ARP funding that is planned for each eligible HOMEARP activity type and demonstrate that any planned funding for nonprofit organization operating assistance, nonprofit capacity building, and administrative costs is within HOMEARP limits.

The following table may be used to meet this requirement.

Additional narrative, if applicable:

Not applicable.

Describe how the characteristics of the shelter and housing inventory, service delivery system, and the needs identified in the gap analysis provided a rationale for the plan to fund eligible activities:

As previously stated, the Continuum of Care’s gap analysis demonstrated continued need for additional housing, shelter, and supportive services countywide. Specifically, there is need for 551 interim housing beds, rental assistance for 801 households, 994 supportive housing units, outreach services for 886 individuals, and prevention /diversion services for 430 households. Considering that 48% of the countywide homeless population resides within the City of Santa Barbara, a significant amount of these resources are needed locally.

There are significant gaps across the entire shelter and housing inventory, and service delivery system. The City leverages local resources to help meet the local need, but it does not receive 8 consistent direct funding to fill all the aforementioned gaps.

The state of California has made significant investments to provide financial assistance to local jurisdictions to address homelessness, such as Project Homekey and Homeless Housing and Assistance Program (HHAP), but those funds do not come to the City directly and in cases like Project Homekey, are awarded competitively or are allocated through the County and/or the CoC.

Given the City’s limited resources, the rationale for funding the aforementioned activities is that HOME ARP funds give the city the ability to leverage funds to acquire, develop or rehabilitate housing with funds made available through financial programs like Project Homekey. Given the high cost of real estate in Santa Barbara, where local real estate data shows that in the first three quarters of 2021 there were 33 commercial sales that totaled $89.4 million, it is necessary to leverage the most amount of funding possible. Additionally, the need for supportive services dollars to help persons placed into housing remain housed has been identified as a crucial unmet need by both service providers and the County CoC.

HOME-ARP Production Housing Goals
Estimate the number of affordable rental housing units for qualifying populations that the PJ will produce or support with its HOME-ARP allocation:

The City estimates it will produce or support the development of 10 -30 affordable rental housing units for qualifying populations. No less than 70% of the affordable rental housing units acquired, rehabilitated or constructed with HOME-ARP funds must be occupied by households in the qualifying populations.

Describe the specific affordable rental housing production goal that the PJ hopes to achieve and describe how it will address the PJ’s priority needs:

The City of Santa Barbara continues to place as high priority on decent housing. As described in detail in the City’s 2020-2024 Consolidated Plan Needs Assessment and Market Analysis, the city has a shortage of affordable housing units, a shortage of accessible housing units, relatively older housing stock, and rental units that are in poor condition.

The need for decent housing has consistently been identified as a top concern in Santa Barbara, coupled with the high number of persons experiencing homelessness in Santa Barbara. As such, the City has prioritized the acquisition, rehabilitation or construction of affordable housing, as well as provision of support services to homeless individuals over numerous years. The City will provide HOME-ARP funding to achieve the goal of increasing the inventory of affordable rental housing units, and supportive services. It will support the provision of decent housing by increasing the availability and accessibility of affordable housing for qualifying populations. 9 Preferences
Identify whether the PJ intends to give preference to one or more qualifying populations or a subpopulation within one or more qualifying populations for any eligible activity or project:
• Preferences cannot violate any applicable fair housing, civil rights, and nondiscrimination requirements, including but not limited to those requirements listed in 24 CFR 5.105(a).
• PJs are not required to describe specific projects to which the preferences will apply.

Not applicable. The City intends to support activities that provide housing and support services to all qualifying populations as defined in section IV.A. Qualifying Populations of HUD’s Notice CPD-21-10, which establishes the implementation rules of the HOME-ARP program.

If a preference was identified, explain how the use of a preference or method of prioritization will address the unmet need or gap in benefits and services received by individuals and families in the qualifying population or category of qualifying population, consistent with the PJ’s needs assessment and gap analysis:

Not applicable.

If a preference was identified, describe how the PJ will use HOME-ARP funds to address the unmet needs or gaps in benefits and services of the other qualifying populations that are not included in the preference:

Not applicable.

HOME-ARP Refinancing Guidelines
If the PJ intends to use HOME-ARP funds to refinance existing debt secured by multifamily rental housing that is being rehabilitated with HOME-ARP funds, the PJ must state its HOME- ARP refinancing guidelines in accordance with 24 CFR 92.206(b). The guidelines must describe the conditions under with the PJ will refinance existing debt for a HOME-ARP rental project, including:
• Establish a minimum level of rehabilitation per unit or a required ratio between rehabilitation and refinancing to demonstrate that rehabilitation of HOME-ARP rental housing is the primary eligible activity
• Require a review of management practices to demonstrate that disinvestment in the property has not occurred; that the long-term needs of the project can be met; and that the feasibility of serving qualified populations for the minimum compliance period can be demonstrated.
• State whether the new investment is being made to maintain current affordable units, create additional affordable units, or both.
1 • Specify the required compliance period, whether it is the minimum 15 years or longer.
• State that HOME-ARP funds cannot be used to refinance multifamily loans made or insured by any federal program, including CDBG.
• Other requirements in the PJ’s guidelines, if applicable:

Not applicable. The City of Santa Barbara will not use HOME-ARP funds to refinance existing debt.

CITY OF SANTA BARBARA

COUNCIL AGENDA REPORT
AGENDA DATE: March 1, 2022
TO: Mayor and Councilmembers
FROM: Transportation Planning and Parking Division, Public Works Department
SUBJECT: Annual Update On Bicycle Share Pilot Program
RECOMMENDATION:

That Council receive an update on the development and implementation of the Bicycle Share Pilot Program.

EXECUTIVE SUMMARY:

The three-year Bicycle Share Pilot Program (Program) launched on January 28, 2021, with BCycle as the permitted operator. In the year since launch, the Program has developed significantly and now provides the City of Santa Barbara (City) with an additional transportation option that is widely utilized. As of the end of January 2022, over 15,000 BCycle riders have ridden over 320,500 miles and taken around 81,000 trips on the fleet of 140 electric-assist pedal bikes that are located at 50 different stations throughout the City. Currently the bike share system is at slightly more than half capacity, with much of the initial siting efforts focused on establishing stations near key destinations in the Downtown, Waterfront, Eastside, Westside, and Oak Park Neighborhoods. Even at half capacity, the Santa Barbara BCycle Program logged the most trips in the first year of operation of any BCycle owned bike share system.

Future efforts will focus on expansion of the Program to the intended pilot size, overcoming Program challenges like theft, vandalism, and location limitations, as well as measuring impact via ridership metrics. Only when the Program is fully launched will these metrics truly indicate how successful the Program is, and whether City Council should consider a more permanent bike share system in Santa Barbara.

DISCUSSION:

Background:

Bike share has been a requested transportation option for over a decade in the City. In the past, City staff delayed the implementation of bike share for various reasons, including Agenda Item No. 18
Council Agenda Report
Annual Update On Bicycle Share Pilot Program
March 1, 2022

Page 2 ends

the high costs of programs, the untenable aesthetics, potential for sidewalk clutter, and the general question of program viability in Santa Barbara.

In April 2019, City Council directed Transportation Planning staff to develop and implement a bike share program. In June 2019, a request for applications was released, and three different vendors submitted applications for the initial three-year pilot program.

After significant review by a bike share selection committee, staff recommended City Council accept the application from BCycle, a bike share operator with over ten years of experience, a unique low-impact docking system, and the backing of the Trek Bicycle Corporation. After further Program development, BCycle and the City signed a “Bike Share Operator’s Permit” in February 2020, and began work on Program implementation.

The first docks and pedal-assist e-bikes went live on January 28, 2021.

Bike Share is a point-to-point service that is meant to provide an active transportation option and reduce vehicular traffic congestion and parking demand for those that prefer to drive. The Program, when complete, will contain about 500 docks and 250 pedal-assist electric bikes that users take for one-way trips throughout the citywide bike share network.

BCycle’s operation is built around an all-electric fleet and the 3.0 bike dock, a low profile docking system that is similar in size to a conventional bike rack. The bikes are governed to a maximum pedal-assist speed of 17 miles per hour (mph), and are designed for the rigors of public bike share usage.

BCycle users must be 18 years old to sign up for a membership, and though riders 18 and over are not required to wear helmets in California, BCycle encourages safer riding by offering helmet incentives to their members. BCycle offers several membership options–Annual ($150), Monthly ($30), and Low-Income ($25 annually for those that demonstrate SNAP/CalFresh eligibility). Members receive unlimited 30-minute rides, and are charged a lower rate for any trips over 30 minutes. Walk-up users can also try BCycle for $7 per 30 minutes.

Challenges and Implementation:

There have been certain challenges to implementation related to permitting, siting of docks, and public outreach, as well as complications resulting from the COVID-19 pandemic. In response to these challenges, BCycle and City staff worked to develop a bike share system compatible with the temporary State Street Promenade, and to navigate the permit process including a Coastal Development Permit for the Program to allow bike share stations in the Coastal Zone. If Council were to approve a permanent program, a more permanent design for bike share in the future State Street Promenade, and a subsequent Coastal Development Permit, will be required.

The siting of dock station locations requires ensuring pedestrian through zones on sidewalks and sightline visibility requirements of intersection/driveways are met. Once a station is selected, stakeholder outreach is conducted to determine if there would be any operational issues with adjacent properties.

Page 3 ends

At the City Council meeting on February 2, 2021, Council approved two Enrollment Kiosks for installation on Cabrillo Boulevard on the east and west sides of State Street. Due to unanticipated supply chain delays, the installation of these two kiosks have been delayed.

Once additional docking infrastructure has been added to the bike share network, staff will work with BCycle to install these two kiosks.

Additionally, the initial strategy to minimize the feel of “municipal” bike share by keeping stations small and frequent has proven challenging–smaller stations do not perform as well as larger stations. This is due to the perceived unreliability of smaller stations, as there is no guarantee that a bike or empty docking space will be available for users. Staff and BCycle are exploring larger station sizes to determine the right combination of usability and aesthetics.

Operations:

There have been several operational challenges: delays related to the pandemic, network outages, collisions, bike theft and vandalism, and general public concerns regarding ebike speeds.

COVID-related global semiconductor shortages have caused dock installation delays amounting to around six months. BCycle is working with their dock supplier to distribute docks throughout the BCycle systems nationwide, and expects that more docks will be available for Santa Barbara later this year.

Since launch, BCycle Santa Barbara has experienced a number of network connectivity issues. Initial siting was somewhat delayed along State Street due to connectivity issues that have since been resolved, but BCycle also experienced a short-term system-wide outage that occurred in August 2021. It is important to note that other means of public transit, including bus and train, are also subject to service delays and cancellation.

To date, of the over 81,000 rides taken, there have been three collisions reported to BCycle and/or the Santa Barbara Police Department (see below). BCycle will continue to notify staff of any reported collisions.

1. February 27, 2021: Solo rider lost control heading downhill. Rider was transported to Cottage Hospital with injures to face and a dislocated shoulder;

2. July 21, 2021: Vehicle hit rider with no injuries. Crank arm bent on bicycle; and

3. August 24, 2021: Solo rider lost control on road base/uneven substrate. Rider was transported to hospital with injuries to head and body scrapes.

Theft and vandalism are a dynamic challenge. Since the launch, around 100 bikes have been returned improperly to a docking station, abandoned, or stolen. However, BCycle has a robust recovery plan, aided by the installation of GPS trackers, and all but three of these bikes have been recovered. Eleven batteries have been stolen from the bikes, and at least 50 other bikes have seen some type of vandalism, ranging from graffiti to cutting of grips or snipping cables or other functional components.

Council Agenda Report
Annual Update On Bicycle Share Pilot Program
March 1, 2022

Page 4 ends

These theft and vandalism numbers are consistent with other bike share programs, though the number of recovered bikes in Santa Barbara is higher than many other bike share operations. Most of these bikes were repaired and returned to service.

Since the pandemic, there has been an overall increase in bicycle ridership, especially with e-bikes. With the increase in e-bike ridership, there is also some concern by the community about the higher speeds and perceived safety of electric bikes in our local bike share network, and on our City streets. The State of California regulates e-bikes to 20 mph on Class 1 (off-street) and Class II (on-street bike lanes) facilities. Most off-theshelf e-bikes are pedal assist bikes that are governed to 20 mph. Any electric bike exceeding 20 mph is required to share the vehicle lane with vehicles. BCycle’s pedal assist e-bikes are governed to 17 mph, and are slower than the majority of e-bikes sold in California. As a frame of reference, an average bike commuter rides around 10-18 mph on City streets, depending on traffic, fitness, age, and other factors.

Feedback from Bike Shops and Rental Companies:

In August and October of 2021, staff reached out to six retail bike shops and two bike rental companies located in Downtown Santa Barbara in an effort to understand any potential impacts to their business since the Program launch. Generally, bike shops were supportive of the Program, and felt no discernable negative impact.

Two Bike rental companies offered the feedback that they perceived a small dip in shorterterm rentals, and felt that BCycle’s pricing for walk-up users undercuts their bike rental business.

Staff will continue to check in with shops and rental companies, as well as other neighborhood and business stakeholders, to gain a better understanding of these concerns.

NEXT STEPS:

About a year since launch, bike share is generally performing well and ridership numbers and community feedback are promising. As the Program evolves and expands, staff will continue to monitor individual station and ridership data to assess overall Program performance. Feedback from stakeholders, ridership data, and overall system performance will help determine if bike share is a good fit for the City of Santa Barbara, and whether the Program should be continued or made more permanent in nature. In addition to regular updates on the Program, staff will return to Council at the end of the three-year Program for further direction.

City staff are in discussions with other local municipalities to assess potential for a regional bike share network. There are significant complications that arise from a crossjurisdictional program, but there is interest in exploring this option, and ridership data shows that riders travel throughout the region on BCycle bikes.

BUDGET/FINANCIAL INFORMATION:

Operation and docking infrastructure is the responsibility of BCycle. Operator fees set by the City are intended to offset management costs, but not costs associated with aesthetic changes. At the end of the shared mobility three-year pilot program period, the fees and required City resources will be re-evaluated.

SUSTAINABILITY IMPACT:

As mentioned in the Circulation Element, an effective bike share program can increase personal mobility options, potentially reduce air pollution and greenhouse gas emissions, reduce parking demand, and decrease the overall cost of transportation to individuals. It may support the City’s sustainability goals to reduce emissions and traffic congestion.

CITY OF SANTA BARBARA

COUNCIL AGENDA REPORT
AGENDA DATE: March 1, 2022
TO: Mayor and Councilmembers
FROM: Community Development Department,
Streets Operations & Infrastructure Management Division, Public Works Department
SUBJECT: Public Hearing To Consider Declaration Of A Public Nuisance Resulting From The Operation Of A Drive-Through At The
Restaurant Located At 3707 State Street
RECOMMENDATION: That Council:

A. Conduct a public hearing to consider a declaration of a public nuisance resulting from the operation of a drive-through at the restaurant located at 3707 State Street and to order the abatement of the nuisance by cessation of use of the drive-through facility; and
B. Based on the evidence presented at the public hearing, direct the City Attorney to prepare appropriate findings and an ordinance for Council to introduce and subsequently adopt declaring a public nuisance and ordering the abatement thereof.

DISCUSSION:

In 1979, the City of Santa Barbara (City) enacted an ordinance prohibiting new or expanded drive-through facilities. Today, the ban is codified as Municipal Code section

30.185.160. The drive-through restaurant at 3707 State Street was initially permitted in 1978 as a Burger King, and is considered a legal, non-conforming use under the City’s Zoning Ordinance. The facility has operated as a Chick-fil-A restaurant since 2013. Over the last several years, the City has received numerous public comments regarding the vehicle queue at 3707 State Street. The public comments discuss traffic safety issues, auto collisions, cyclist safety issues, and several requests to remedy the issues caused by the drive-through facility at 3707 State Street. Staff has compiled these comments, which are included as an attachment to this CAR.

The City Principal Transportation Engineer analyzed the situation and issued an engineering report on January 11, 2022, concluding that the operation of the drivethrough causes persistent back-ups of traffic on State Street. See Attachment 1.

Page 2 ends

Previous attempts to informally remedy the situation have been unsuccessful. It is unlawful to stop in the travel lane, and there are traffic control signs posted that advise motorists not to stop in the travel lane, but Chick-fil-A customers routinely ignore those signs.

In early 2019, the Public Works Department and City Attorney’s Office actively began considering enforcement options to address the ongoing issue of vehicle backups onto State Street caused by the drive-through. City staff attempted to work with Chick-fil-A representatives regarding a solution. In January and March of 2020, the Public Works Director sent letters to Chick-fil-A directing the abatement of the traffic nuisance. (See Attachment 2.) Chick-fil-A has tried various methods of reducing the traffic back-ups by reconfiguring its on-site queuing and stationing mobile order takers, but none have appeared to work, and traffic back-ups on State Street persist. Posting a police officer and citation of motorists is not an effective remedy, creating its own problems and requiring a substantial expenditure of public resources. See Attachment 3.

Chick-fil-A submitted a development application to the Community Development Department in January of 2021 to expand its drive-through from one lane to two lanes to increase the on-site capacity. Chick-fil-A’s proposal would widen the driveway and make minor modifications to the drive-through configuration to formalize a two-lane configuration for the drive-through. The application requires Architectural Board of Review (ABR) approval, but ABR review is limited to aesthetic design considerations only. Chickfil-A has operated the drive-through with two lanes for several years by manually taking orders. Despite the two-lane drive-through operations, the queuing persists. Staff has reviewed Chick-fil-A’s proposal for functionality and believes that widening the driveway and creating a permanent two-lane drive-through will not eliminate queuing. See the Attachment 4, a memorandum from the Community Development Department and City Traffic Engineer.

Based on the complaints and the City’s observations of the Chick-Fil-A drive-through, there is a chronic adverse traffic impact caused by the operation of the drive-through restaurant facility. Each time a queue forms on State Street, the eastbound number two traffic lane is blocked leaving only one lane available. The queuing increases the risk of collisions, particular rear-end collisions and side-swipe collisions. Queued vehicles persistently block the sidewalk and bike lanes, creating a danger to pedestrians and cyclists. The queuing of vehicles routinely blocks access to adjacent businesses, which affects customer and delivery access to these businesses. The operation of the drivethrough facility has caused queued vehicles to block the sidewalk in front of 3707 State Street. Not only does blocking the sidewalk present a danger to all pedestrians, but people with disabilities are more likely to have difficulty maneuvering around the vehicles blocking the sidewalk. As a result of the drive-through facility’s queue, vehicles also block the disabled parking spots at 3707 State Street. The Santa Barbara Metropolitan Transit District (MTD) has experienced service difficulties in the area surrounding 3707 State Street. When there is a queue of vehicles backing onto State Street, buses must change lanes to bypass the queue. It is more difficult for buses to bypass the queue in comparison to passenger vehicles, which increases the risk of collision. The queue of vehicles may Council Agenda Report

also cause delays to transit vehicles such as the MTD, resulting in service disruptions.

See Attachment 5, a letter from Santa Barbara MTD.

The City’s Traffic Engineer, Police Chief, and Community Development Director have evaluated the situation and believe that the persistent traffic back-up onto State Street is a public nuisance and that the nuisance is caused by the operation of a drive-through at the Chick-fil-A restaurant.

Council adopted Resolution No. 22-008 on February 1, 2022, setting the time and date of the public hearing. Notice of the hearing has been given as directed by Resolution No. 22-008. The public hearing will be held according to the procedures applicable to quasijudicial hearings set forth in Section 4.14 of the City Council Procedures. Under the proposed resolution, the order of proceeding will be generally as follows:
 Staff presentation – 30 minutes;
 Owner/operator presentation – 30 minutes;
 Public comment – 2 or 3 minutes per speaker;
 Owner/operator response/closing – 20 minutes;
 Staff response/closing – 20 minutes; and
 Council deliberations and decision.

After the public hearing, Council may determine whether a public nuisance exists, and if so, may order the appropriate abatement thereof, including but not limited to, alteration of operations or revocation of nonconforming use status for the drive-through facilities, operations, and uses at 3707 State Street.

For these reasons, staff recommends Council declare that a public nuisance exists at 3707 State Street and direct abatement of the nuisance by cessation of use of the drivethrough facility and direct the City Attorney to prepare an ordinance containing appropriate findings declaring the nuisance, ordering its abatement, and authorizing the City Attorney to take appropriate action to enforce the ordinance.

Memorandum
DATE: January 11, 2022
TO: Mayor and Council
FROM: Derrick Bailey, Principal Transportation Engineer SUBJECT: Traffic Conditions Associated with Chick-fil-A Queuing The purpose of this memorandum is to document the traffic conditions associated with queuing for the Chick-fil-A restaurant drive-through at 3707 State Street and provide a professional opinion on the effects the queuing has on traffic safety and operations.

Executive Summary and Professional Opinion:

Queuing from the Chick-fil-A drive-through is routinely observed blocking the sidewalk, bike lane, and number two (outside) traffic lane of eastbound State Street. The location and typical queuing area are illustrated in attachment #1.

I have reviewed traffic data and conditions caused by queuing from the Chick-fil-A drivethough. The queuing increases the risk of collisions and injuries, and decreases mobility for all modes of travel by creating a condition that State Street was not intended to accommodate. Based on observations, the queue blocks the number two traffic lane of State Street an average of 70 minutes per day on weekdays, and 92 minutes per day on Saturdays. Chick-fil-A is closed on Sundays.

The queuing is also routinely blocking access to adjacent businesses, which affects the ability for customers and deliveries to access these businesses. For example, the driveway for Rusty’s Pizza Parlor (115-feet west of the Chick-fil-A driveway) is blocked an average of 15 times per day.

As a principal arterial street, State Street is intended to provide the highest level of mobility within the City’s street network for all modes of travel. The effects of queuing on each mode of travel and the effect on adjacent businesses is described in more detail below in the Analysis section.

Based on the existing environment, I do not believe that a reasonable solution exists to safely accommodate the queue within the public right of way. Further, I do not believe that on-site improvements can be made that will prevent the queue from blocking State Street.

Discussion - Analysis
Staff set up video recording cameras near the Chick-fil-A drive-through entrance every three months beginning in the spring of 2021. For each video data collection period, two weekdays and Saturdays were recorded (Chick-Fil-A is closed on Sunday). Staff played back the video recordings and noted each time a queue began to form in the street, the time the queue in the street ended, and the maximum length of each queueing event.

Below is an analysis of the following:
 Traffic safety and operations
 Pedestrian safety and mobility
 Cyclist safety and mobility
 Transit safety and operations
 Access to adjacent businesses
Traffic Safety and Operations
Mobility of traffic is negatively affected by queuing onto State Street. Each time a queue forms in the street, the eastbound number two traffic lane is blocked and the capacity of that lane effectively becomes zero, thus traffic has only one lane available. The capacity of the number two lane is zero regardless of the length of the queue. In other words, the effect on roadway capacity is the same when a queue has one vehicle in length compared to a queue of ten or more vehicles. In addition, longer queues affect access to adjacent businesses which is described in more detail below.

Findings for the duration of queues blocking the number two lane are summarized below.

Summary of Observed Duration of Lane Blockage (In Minutes) Average Daily Duration of Blockage Maximum Daily Duration of Blockage Weekdays 70 minutes 91 minutes
Saturday 92 minutes 155 minutes
The average weekday cumulative duration of queuing onto the street is illustrated in attachment #2. Also shown in attachment #2 is the hourly weekday traffic volumes.

The graph in attachment #2 demonstrates the traffic volumes on eastbound State Street are above 1,000 vehicles per hour between 12:00 P.M. and 6:00 P.M. during typical weekdays. The majority of queuing onto State Street coincides with the busiest travel times of typical weekdays.

January 11, 2022

Page 3 ends

The average Saturday cumulative duration of queuing onto the street is illustrated in attachment #3. Also shown in attachment #3 is the hourly Saturday traffic volumes.

The graph in attachment #3 demonstrates the traffic volumes on eastbound State Street are above 800 vehicles per hour between 11:00 A.M. and 4:00 P.M. on a typical Saturday. The majority of queuing onto State Street coincides with the busiest travel times of typical Saturdays.

In addition to the negative effects on mobility, queuing into the street increases the risk of collisions, particularly rear-end collisions and side-swipe collisions. During the review of video of the queuing, erratic and last second lane changes were observed. Drivers were also observed getting stuck in the queue because they were unable to change lanes. There has been one reported collision to the Santa Barbara Police Department (SBPD) involving a rear end collision with a queued vehicle (11/5/2018).

Pedestrian Safety and Mobility
Attachment #4 illustrates what typically happens during queuing on pedestrian access.

Queued vehicles persistently block the sidewalk and pedestrian path of travel, thus pedestrians have to deviate from their normal path of travel and maneuver through tightly spaced queued vehicles. This increases the risk of collisions involving pedestrians and also creates a challenging condition for pedestrians with disabilities and mobility challenges. Photos of the sidewalk blockage are contained in attachment #8.

There have been no collisions reported to SBPD associated with queued vehicles involving pedestrians.

Cyclists Safety
The State Street bike lanes are one of the most important cycling facilities in the City’s cycling network. The 2016 Bicycle Master Plan described State Street as the north/south spine of the City’s network.

Attachment #5 illustrates what typically happens during queuing on cycling access.

One of two scenarios typically happens:

1. Some drivers waiting in the queue will pull to the right, blocking both the bike lane and the number two (outside) traffic lane. This forces cyclists to merge out of the bike lane and into vehicle traffic to bypass the queue. This maneuver puts cyclists at increased risk of collision due to the frequent, erratic and last second lane changing near the queue.

2. Some drivers do not block the bike lane, and instead queue only in the number two traffic lane. Cyclists can ride past the queue in the bike lane up to the Chickfil-A driveway, but are exposed to right hook collisions at the driveway entrance.

Both scenarios create dangerous conditions for cyclists. Of all the increased risks of collision and injury to the various modes of travel, I believe that risks to cyclists is Traffic Conditions Associated with Chick-fil-A Queuing
January 11, 2022

Page 4 ends

highest due to the persistent queues. It is likely that some cyclists have stopped using State Street due to the conditions created by queuing.

There have been no collisions reported to SBPD associated with queued vehicles involving cyclists.

Transit Safety and Operations
Santa Barbara Metropolitan Transit District (Santa Barbara MTD) lines 3, 6, and 11 provide service along this section of State Street. During daytime service hours, there are six scheduled buses that pass Chick-fil-A per hour. Buses generally stop at the Hitchcock bus stop, which is about 260-feet west of the Chick-fil-A driveway.

When there is a queue backing onto State Street, buses must change lanes to bypass the queue. Buses are more difficult to maneuver than passenger vehicles, which increases the risk of collision. The erratic and last second lane changes mentioned above increase the challenges maneuvering transit vehicles through the queueing area.

Depending on traffic conditions, the queue can also cause delays to transit vehicles.

Santa Barbara MTD has communicated to City Staff that queuing from the Chick-fil-A parking lot and drive-through creates adverse conditions for transit operations.

Attachment #6 illustrates the location of the Hitchcock bus stop and the proximity to the lane changing zone when queues are present.

Access to Nearby Driveways
The driveway to Rusty’s Pizza Parlor is located 115- feet west of the Chick-fil-A driveway. A queue that is approximately five vehicles long blocks access to the Rusty’s Pizza Parlor driveway.

The driveway to the Educated Car Wash is located 180-feet west of the Chick-fil-A driveway. A queue that is approximately eight vehicles long blocks access to the Educated Car Wash driveway.

The exit driveway for the Jack In The Box drive-through is located 240-feet west of the Chick-fil-A driveway. A queue that is approximately ten vehicles long blocks access to the exit driveway of the Jack In The Box drive-through.

Attachment #7 illustrates the locations of nearby private driveways, and the length of queue that blocks access to these driveways.

As part of Staff’s data collection, the maximum queue lengths were noted for each queueing event. The table below summarizes the average number of queuing events that block access to the neighboring businesses’ driveways.

Conclusion
Queuing for the Chick-fil-A drive-through increases the risk of collisions and injuries, with the highest risk of injury being for cyclists. Mobility is negatively affected for all modes of travel due to decreased roadway capacity and decreased safety.

As a principal arterial street, State Street is intended to provide the highest level of mobility within the City’s street network. Persistent queuing onto State Street is a condition that State Street was not intended for, nor a condition that drivers, cyclists, and pedestrians expect to encounter.

The queuing is also routinely blocking access to adjacent businesses, which affects the ability for customers and deliveries to access these businesses.

Based on the existing environment in the vicinity of Chick-fil-A, I do not believe that a solution exists to safely accommodate the queue within the public right of way.

Further, I do not believe that on-site improvements can be made that will prevent the queue from blocking State Street. Chick-fil-A has proposed to physically reconfigure their onsite circulation to create a dual lane drive-through. Chick-fil-A has been operating a make-shift dual lane drive-through throughout most of the pandemic, and while throughput is likely significantly higher, the queues persist. As Chick-fil-A improves onsite capacity, it appears they are attracting more customers, meaning the queue persists.

SUBJECT: Drive-Through Queuing onto State Street at Chick-fil-A, 3707 State Street Dear Ms, Daw,
I received your letter dated March 25, 2020. I appreciate that you have been working with Mr. Dayton and our team to resolve the public nuisance caused by patrons of your drive-through queuing into the street right of way, blocking traffic, and creating safety issues for all modes of transportation using State Street. Although you expressed concerns about the ability of security personnel being able to control traffic outside the Chick-fil-A parking lot, we appreciate Chick-fil-A's willingness to move forward with the use of security personnel on location. That way, your patrons can be instructed by the security personnel to move on and not block traffic in the right-of-way. We hope that this will be effective. It is critical for your team to eliminate queuing into the right-of-way immediately.

During the COVID-19 crisis, your operator's strategy of a dual lane drive through seems to be working well. We are hopeful that this operational strategy will keep the queue out of the right-of-way following the crisis and return of normal traffic,
Finally, you mention that Mr. Dayton and Mr. Wei "seemed to be in agreement with us regarding our revised plan. " I have confirmed with Mr. Dayton and Mr. Wei that they expressed no formal opinion on the revised plans and reiterated that Chick-fil-A is responsible for conducting its operations in a manner that does not constitute a public nuisance. Your organization has the expertise to accommodate them and your drive-through generates. We will process any permit you submit, but our approval of any plans submitted will be limited to typical planning and permitting standards.

Chick-fil-A has the sole responsibility for operating in a manner that eliminate this public Nuisance.

I would be happy to discuss or answer any questions you have by phone.

Sincerely,
Rebecca J.

Dear Ms. Daw,
On January 23, 2020 I sent you a letter regarding the nuisance created by the failure of Chick-fil-A to adequately manage the queue for the drive-through. In that letter I suggested that Chick-fil-A hire a security firm to manage the parking queue in such a manner as to prevent vehicles, from waiting in the street; either by periodic closure of the drive-through lane, or by directing drivers into parking spots when there is no room to safely wait in the drive-through lane or simply by moving people along when there is no space in your restaurant. You have not only failed to hire a firm to perform this operational function as suggested, nor have you taken any actions to address the offsite nuisance you are creating.

Pedestrians, bicyclists, and other vehicles are all at risk from the queue that forms on State Street. We have heard reports of accidents and near misses. I am 'extremely concerned that it is just a matter of time until there is a serious accident or worse Therefore, the City staff are recommending that the City Council hold a council hearing to consider the evidence to declare Chick-fil-A's operations, a public nuisance.

I strongly encourage you to take immediate actions. The life safety of your customers and the general public are at risk. Waiting for changes to the configuration of your drive-through lane and parking lot is not an acceptable approach. While this may resolve issues in the long term, as previously expressed, this change alone may not meet the latent demand for your drive-through services and ongoing on-site operational management of the queue may be required to prevent the public nuisance.

As before, I am available to discuss this by phone or in person if you would like.

Sincerely,
Rebecca BJork

SUBJECT: Chick-fil-A Queuing On Upper State Street
Dear Ms. Daw,
Thank you for taking the time to again meet with City staff in an attempt to correct the drive-through queuing out onto State Street at your Chick-fil-A restaurant located at 3707 State Street. The reoccurring drive-through queue onto State Street is both a safety hazard and traffic congestion generator for many more people than are served by your restaurant. State Street is a central arterial roadway and bike lane for this portion of our City. The continued queuing onto State Street blocking the bike lane and/or the number 2 lane of traffic is a serious safety and traffic congestion concern that cannot continue.

The City appreciates that Chick-fil-A has acknowledged its responsibility to make changes to its operations to address the queuing problem. I understand that you have discussed with City staff a new short-term operational strategy and a plan for a longer-term reconfiguration of the drive-through queuing line that will increase its capacity. But, I am also informed that while you have been attempting operational changes to solve the problem, some of those attempts have actually exacerbated the frequency and extent of the queuing on the sidewalk, bike lane and street. Thus, I am writing to emphasize both the urgency of the matter and that immediate steps must be taken to prevent queuing onto State Street on a temporary basis while work on a permanent solution continues.

I also understand you have expressed willingness to fund the stationing of police officers near your restaurant to move people along. However, I do not believe this is an effective use of our very limited police resources. Rather, the funding you offered should be used to hire your own permanent, official and uniformed security detail to manage the entrance to your driveway in such a manner that customers are directed into the parking lot if there is not sufficient room for them in the queue. Importantly, the security detail should prevent people from queuing on the street, much in the same manner that airport patrol officers move cars along in front of the airport. May I also suggest that you physically close access to the driveway apron when a vehicle cannot enter because of drive-through queuing. Whatever it takes, this situation is not safe for motorists or cyclists on our streets and you need to take action now to eliminate the issue to prevent further liability exposure to Chick-Fil-A.

I want to also point out that my staff has advised that your restaurant may have latent drive-through demand that is not coming onto the site because of the current queuing onto State Street. Queuing on State Street is a vehicle code violation. Some drivers who are not willing to make an unsafe, illegal maneuver to access your restaurant are likely bypassing the queue altogether. Please be aware that regardless of any site adjustments that are made, the City has an ongoing legal and ethical responsibility to pursue remedial actions if the on-street queueing continues unabated.

Thank you again for your collaboration and willingness to respond thus far. The significance of risk to the public's safety is such that I feel Chic Fil A must take immediate actions while pursuing a long term modifications. Please feel free to contact me directly if you have questions.

Sincerely,
vt^, a^t^\^\

City of Santa Barbara
Police Department
Memorandum
DATE: January 17, 2022
TO: Santa Barbara City Council
FROM: Chief Bernard Melekian
SUBJECT: Santa Barbara Police – Chick-Fil-A Traffic Recommendation Traffic-related issues pertaining to the Chick-fil-A restaurant drive-through, located at 3707 State Street, Santa Barbara have been a concern for the police department for several years. Since 2013 when the business first opened, the department has conducted several enforcement campaigns in an effort to mitigate the specific problems during peak business hours.

Specifically, vehicles are impeding the flow of traffic while waiting to enter the restaurant’s drive-through lane. This traffic impediment is a violation of California Vehicle Code 22400(a). These vehicles are also creating a back-up of traffic in the #2 eastbound lane and create a hazardous traffic situation, especially for bicyclists traversing east in the 3700 block of State Street in the marked bike lane.

This traffic congestion also creates a hazard for other motorists attempting to drive in the area as well as pedestrians who are forced to walk around the vehicles when they block the sidewalk.

Attempts at educating the public about these safety concerns has also had no effect on solving this problem. There are several large, clearly posted signs explaining the legal ramifications for blocking traffic or stopping on the sidewalk, and drivers still fail to obey the educational signage.

As mentioned, Santa Barbara Police Officers have conducted enforcement activities specifically dealing with these violations. Though Officers have issued warnings and citations to drivers for the above-mentioned vehicle code infractions, the enforcement has had little to no effect on solving the issue. Additionally, ticketing the customers frequenting the drive-through makes them feel targeted for a problem they did not create. It is the position of the department that this problem cannot be solved solely by enforcement unless such enforcement were to be constant.

Public Works Department
Memorandum
DATE: February 9, 2022
TO: Mayor and Council
FROM: Derrick Bailey, Principal Transportation Engineer Allison DeBusk, Senior Planner II
SUBJECT: Evaluation of Proposed Chick-fil-A Site Modifications at 3707 State Street
The purpose of this memorandum is to document staff’s evaluation of Chick-fil-A’s proposal to convert the existing one-lane drive-through to a two-lane drive-through.

Executive Summary and Professional Opinion:

The Chick-fil-A site has one drive-through lane, although Chick-Fil-A has been operating an interim two-lane drive-through utilizing roving staff to take and deliver orders. Chickfil-A has submitted a development application to make physical alterations at the site in order to create a permanent two-lane drive-through.

It is staff’s opinion that the proposed alterations will not eliminate the chronic, routinely occurring vehicle queuing onto State Street caused by the drive-through facility. The alterations will result in a minor improvement in site capacity over the interim two-lane drive-through, but the minor increase in site capacity is not sufficient to prevent the vehicle queue.

Discussion – Analysis:

Existing Site Configuration
The existing ingress driveway is approximately 25-feet wide, and feeds into 2 on-site lanes: a single drive-through lane, and a lane that circulates through the parking area.

See Attachment 1 for the existing site configuration.

The ordering station is approximately 110 feet from the entry driveway, which is long enough to store approximately five to six vehicles. The pick-up window is approximately 85 feet from the ordering station, which is long enough to store approximately 5 additional vehicles.

There are currently 45 parking spaces and racks for 2 bicycles.

Page 2 ends

Interim Site Configuration and Operations
The physical site is identical to the description above. Chick-fil-A has increased the capacity of the drive-through by creating an interim two-lane drive-through using the parking lot lane. Chick-fil-A staff take orders from customers in vehicles shortly after entering the site. Orders are manually delivered to the interim drive-through lane, because it does not have access to the existing pick-up window.

By using the parking lot lane as a second drive-through lane, the interim configuration impedes the ability of dine-in customers to quickly access parking spaces.

As documented in the Traffic Analysis memo, despite operating two interim drivethrough lanes, routinely occurring queuing onto State Street persists.

Chick-fil-A Proposed Site Plan
Chick-fil-A has submitted plans to the City’s Community Development Department for review by the Architectural Board of Review to make physical alterations to the site in order to create a permanent two-lane drive-through.

The ingress driveway is proposed to be widened from 25 feet to approximately 42 feet wide, which exceeds the City’s maximum allowable driveway width of 30 feet. The City Administrator per Santa Barbara Municipal Code Section 22.60.105 must approve widths exceeding 30 feet. Wide driveways are generally less desirable as they can promote higher turning speeds and increase the area that pedestrians on the sidewalk are exposed to traffic.

The 42-foot wide driveway is proposed to feed into 3 on-site lanes: 2 drive-through lanes and a parking lot lane. See Attachment 2 for proposed site configuration.

The ordering station is proposed to be approximately 68 feet from the driveway, which is long enough to store approximately 4 vehicles. The pick-up window is approximately 127 feet from the ordering station, which is long enough to store 5 to 6 vehicles. The additional space between the ordering station and pick-up window provides additional time for customers’ orders to be prepared.

The driveway exit onto State Street is proposed to be altered to force drivers to turn right onto State Street. Left turning drivers can take longer to find a suitable gap in traffic, which in turn can cause drivers behind them to wait. Staff has not observed this to be a significant contributor the queue onto State Street.

The proposed site plan includes a reduction in parking from 45 spaces to 30 spaces, and increases accommodations for bicycle parking from 2 to 8 bicycles. The proposed parking supply meets City zoning requirements.

Operational Analysis of Proposed Site Plan
Staff prepared a matrix to evaluate different aspects of the proposed site plan and likely operational outcomes compared to the interim condition.

Analysis of Site Changes Compared to Interim Operations:

Feature Interim Condition Proposed Site Plan Likely Operational Outcome
Two Drive-Through
Lanes Yes Yes No improvement
Exclusive Parking
Area Access Lane No Yes Improvement
Ordering Station
One physical
ordering station.

Chick-fil-A staff
take orders from
customers in their
vehicles shortly
after entering site.

Two physical
ordering stations.

No improvement
when mobile staff
are taking orders.

Space Between
Ordering Station
and Pick Up
Window
Approximately 85
feet from pick up
window, although
mobile Chick-Fil-A
staff take orders
elsewhere on site.

Approximately 127
feet from pick up
window.

No improvement
over interim
condition when
mobile staff are
taking orders.

Parking Lot Exit
onto State Street Right turn only sign.

Driveway shape
points drivers to the
right.

Very minor
improvement.

Drivers trying to
turn left onto State
Street is not a
significant
contributor to the
queue.

The cumulative improvement of the proposed site changes over the interim condition will likely be very minor and may result in a small reduction in the overall duration of the queue. The improvements will not improve site capacity enough to eliminate the queue.

Additionally, the improvements may be offset by increased demand. Currently, some potential customers destined for Chick-fil-A likely choose to not join the queue after recognizing the length of the queue. Even if the site changes made the queue shorter, customers may be incentivized to join the shorter queue, thus lengthening the queue and offsetting any improvements.

Evaluation of Proposed Chick-fil-A Site Modifications

Page 4 ends

Review of Pending Application:

The project requires review and approval by the City’s Architectural Board of Review (ABR) because it involves alterations to a nonresidential development. In addition, the project would require ABR approval of an Alternative Landscape Design to remove some existing landscape island planters between parking spaces.

The ABR’s purview is limited to consistency with applicable design guidelines and compatibility of the design with the neighborhood, and appropriateness of the landscaping. The ABR review can only focus on the aesthetics of the proposal, not the operational impacts. Therefore, an ABR approval is not an endorsement of the site operations.

The most recent submittal documents for ABR review have been deemed incomplete by the City’s Land Development Team, so no hearing is currently scheduled.

Nonconforming Drive-Through
Drive-through facilities are prohibited by the City of Santa Barbara Zoning Ordinance:

30.185.160 Drive-Through Facility. New or expanded drive-through facilities are prohibited. There shall be no new floor area, and no intensification of use on existing structures developed with a drive-through facility. Existing financial institution drivethrough facilities may be replaced in kind with automated teller machines provided the number of drive-through lanes does not increase.

The subject parcel received approval for the drive-through in 1978, prior to the prohibition, which was enacted in 1979 in order to reduce air pollution. Therefore, the existing drive-through is considered nonconforming. It was determined that the proposal to add a second lane to the drive-through did not constitute an expansion of the nonconforming use, and therefore the application was allowed to proceed.

Conclusion:

The features in the proposed site plan are insufficient to ameliorate the vehicle queue that routinely flows onto State Street. The proposed changes will likely result in minor improvements in site capacity over the interim two-lane drive-through configuration. As noted, the interim two-lane drive-through operation results in routinely occurring queuing onto State Street. The minor improvements will not eliminate the routinely occurring queues onto State Street. The minor improvements could generate additional demand from customers that currently choose to pass by the queue. Additional demand would offset the site capacity improvements.

Dear Mr. Bailey,
Per your phone inquiry, I am writing to share Santa Barbara MTD’s concerns with regards to extensive queueing in the number two southbound lane on Upper State Street between Hitchcock Way and South Ontare Road.

MTD has a bus stop on that block near the Hitchcock Way intersection and regularly experiences conflicts with queueing motorists mid-block. Our Bus Operators and Operations Supervisors report adverse conditions in that area.

When cars queue in the number 2 lane up ahead from the bus stop, buses need to wait for an opening in traffic to merge over to the number 1 lane, causing delays. Additionally, if the queue is long enough, the bus does not have enough room for the bus to pull away from the curb and get into the number 1 lane.

We would appreciate anything the City can do to resolve this queueing issue and help improve transit circulation in the Upper State Street area.

Sincerely,
Hillary Blackerby

Traffic Tie-ups at Chick-Fil-A on outer State
Sunday, November 4, 2018 12:10:09 PM
In mid-August and again currently, there are extended discussions on the community platform, Nextdoor, regarding the traffic blockage caused by the drive-through line into Chick-Fil-A on State Street. Here's a link to the current discussion (https://nextdoor.com/news_feed/? post=95818590&is=notification_center) but you may not be able to view it unless a member ofNextdoor. Perhaps one of the several City officials (Anthony Wagner is the Police PIO with access) who post on Nextdoor can access it.

It's not clear what a solution might be but the problem is obvious at certain times of the day.

Standard signage at the site referring to CVC 22400 is routinely ignored by drivers fearful of losing their places in the order line or who underestimate the wait time.

There is substantial comment about the problems from many neighborhoods (West Mesa, Oak Park, Mission Canyon, San Roque, Bel Air, San Roque Gardens, and Westside for the current discussion) so it clearly is not a nearby issue. It affects citizens across the City who travel that route; it's reported that police and emergency vehicles are also impacted.

If there is anything that citizens can do to improve enforcement and traffic flow at this spot, please let me know. I'm a Lead for the Nextdoor San Roque neighborhood and would be eager to help.

I promised I'd keep you in the loop on this Nextdoor discussion. It is very active. Leads have taken down the more aggressive posts (and been accused of censorship for it) but the interest rolls on. I encourage you to find a member ofSBPD who is a member ofNextdoor and can view all the comments in real time. Just to stay informed.

I spoke to Carol Ruiz at length today. As you can imagine, she is very well informed about the problem, it's history, and steps she wants to take as remedy. She has an expected ownercentric view of things and feels (1) the City has been less than cooperative (how often have we heard that?), and (2) she and her crew have done everything humanly possible to mitigate the problem. She and corporate are apparently preparing proposals to the City for changes, but these were not described to me nor was a timeline offered. She specifically lays blame for the eastbound traffic constriction on the extension of the median strip on State Street, preventing westbound traffic from crossing to her entrance. (No need to explain that decision; I agree with it.)
Attached is an image of my recent post outlining my contact with you and Carol, as well as some housekeeping notes to Nextdoor members.

PLEASE DO SOMETHING ABOUT THIS! how did this ever get approved? Chick Fil-A traffic concerns, again
Here's a typical view of the problem. I spoke with a gentleman from the restaurant who told me that the city and the company are working on a resolution. He expressed frustration that ideas proposed by Chick Fil-A have been rejected by the city. I told him Qiy-iegly interest is driver, pedestrian and bicycle safety and every day there is a problem, which is pretty clear.

There are obvious signs posted to warn that waiting to enter the driveway is illegal yet as recent as yesterday i watched an SBPD SUV drive right on by the line. The restaurant is doing everything they can to solve the problem, with employees in the lot taking orders. The SBPD is the only entity that can solve the problem and they seem totally uninterested.

I wouldn't say that this fast food place is doing "everything" they can to solve the problem. If that were true, they would eliminate the obvious source of the problem which is the drive-thru. Maybe that's too much to expect from a profit strand point.

does *exactly zero to enforce that*. I believe the proper course of action is to write/call your district council member. That's Eric Friedman primarily (site located) and Kristen Sneddon (impacted area). Of course a number of us have done that, they likely are reading this, and nothing has happened to change things. It is their responsibility to follow through with city zoning and police. That's their job. Ask them to do it. Be nice. They are our neighbors and surely want to help. This traffic at peak hours is caused by their own success. The City has allowed too much development in the upper State St area that is adding more traffic. I'm not a fan, don't get it but the lines do result in slowing people down which actually increases safety, people are very careful and slow when the line spills out into traffic. To look at it in a positive way, slowing down increases safety, to me what looks the most problematic is the pedestrian side walk becomes blocked, could they put some red zebra stripes across the crossing there so they leave it open for pedestrians?

A bunch of cars idling in the roadway is no doubt inconvenient and frustrating but my concern is more for the pedestrians and bicyclists. hlow are they supposed to safely maneuver through this mess when the sidewalk and bike lane are completely blocked by vehicles, as clearly illustrated in the photos that Larry posted? I totally get that Cluck-Fil-A doesn't want to shut down their highly profitable drive-thru and there's certainly nothing wrong with trying less drastic measures first but for how long? This ongoing issue appears to be as bad as it ever was, despite their efforts. At some point, the obvious solution may be the only solution.

Rosanne- the line up does not increase safety, considering the adjacent businesses where their patrons cannot exit their lots, car approaching from Hitchcock must change lanes to avoid the bottleneck, and, of course, bike riders literally have no safe passage as they, too must move through one blocked lane into the second lane while motor vehicles are doing the same.

Meredith-1 am fully aware of the company's politics. It bothers me on so many fronts. Many of their patrons are not so aware but this is not the forum to use to educate them. It is not the issue here. This IS a forum to help activate neighbors to take appropriate, responsible action to address traffic, pedestrian and bicycle safety concerns.

We just have more traffic now everywhere at all hours. All the development in the area not to mention all the work commuters from Ventura and Lompoc moving about at various hours, contribute to this problem. I avoid the "peak" traffic times in general anywhere, which are pretty predictable, this does not go on all day .This picture was taken at peak time, and yes we have all seen this from time to time. I heard at that MTD is actually going to be taking out less utilized buss stops because traffic is being slowed and backed up due to some buss stops.

Now where will that put people dependent on bus lines, walking another mile, what about senior citizens or disabled riders if their stop is taken out. Sure hope their is a plan other than one more bicycle lane , cars are not going \/

Perhaps a red velvet rope and extra employees to wave cars passed until a line has moved to allow another car. Or a police car parked inside the lot to enforce the signage for a few hours randomly during the month. It is a huge safety issue as angry /hurried drivers change lanes unsafely when this line occurs. The sign is a waste of money and and insult if it's not taken seriously by anyone.

I just wrote to the Mayor and City council and sent them Larry's photos. I suggested that the law be enforced. Then, the profitability of the drive through will be reduced. The grandfathered drive through should be challenged by the city attorney based on public safety issues. If Chik Filet needs a bigger parking lot, perhaps they leased the wrong space. Public safety should come first.

This is a traffic issue and no fault of the restaurant. If the PD starts handing out tickets, it will be to drivers (not the restaurant). Ever tried to get past Foothill school during pickup? You literally cannot drive on the street to pass cars blocking it from BOTH directions. Should the PD hand out tickets for that too? All of you "traffic nannies" have nothing better to do then complain about a few cars waiting for a drive through? Should the PD enforce cars blocking the intersection when the fair is in town too? Maybe they could START by enforcing obvious and much more "unsafe" practices like bicycles (99% of them) running stop signs? Drivers downtown on Anacapa and Santa Barbara streets running red lights? Pedestrians in the downtown corridor jaywalking? Seems the big problem here is most of you just don't like capitalism and don't have enough foresight to change lanes.

David, I'm quite happy with capitalism, I have a gallery in downtown Santa Barbara and my husband has a home-based business. Chick Fil-A needs a better location so that they can accommodate their traffic without blocking our main artery, State Street. Its not about changing lanes, its about pedestrian and bicycle safety, as well as blocking other businesses driveways/right of way. Does anyone remember how long Whole Foods waded through years with people who were up in arms about the traffic jams they would cause? I wonder how Chick Filet got a pass on traffic issues without so much as a whimper from anyone?

Hopefully when the traffic studies for the proposed 500+ units of housing at the Sears site will take this situation into consideration, along with any other lines of traffic hogging public streets and creating public safety issues. I've avoided the new Target so have no first-hand knowledge but someone mentioned that one too. I will say that I generally avoid shopping and doing errands on Upper State because of traffic. Much more is coming with additional likely housing projects.

Of course, one option here would be that if a customer sees that buying drivethru is going to block traffic, he could always park in the lot (assuming there's available space) and order over the counter. But I guess that's asking a lot these days. :-)

I bicycle past there several days per week, and it's truly a hazard for bicyclists. I'm always very careful as I navigate this area. I do not understand how/why the City consciously allows this type of traffic congestion on a major thoroughfare. State Street can have up to 6 cars "lining up" in the right hand lane STOPPED ON STATE before entering their location, which I've never seen before. Why does the City allow traffic to be stopped on a major thoroughfare due to people wanting to buy fast food? Crazy. This is unacceptable in my opinion, and very dangerous for us bicyclists.

Thanks!
No private entity can use a traffic lane as a parking lot. Try it in front of your house for any party there!
A cop there at peak lunch rush with some NO Parking signs and I guarantee you that the problem will go away, especially if there are a few publicized tickets given for people that need a hit in the head with a 2X4

: Hello Honorable City Officials, I would like to request that official enforcement action be taken against the dangerous situation at Chik-Fil-A (3707 State Street) with cars almost always blocking a busy part of the street while waiting to turn into the Drive-Thru, despite a sign reminding drivers that they MUSTN'T block the street. I travel that stretch daily, and I can tell you that almost always, the right lane is blocked. Is there a way to require that the restaurant have an employee stationed on the curb to wave on the motorists, telling them that blocking the roadway is not allowed? I'm not being a busy-body; this really effects our citizens' day-to-day lives; and I'm sure it effects emergency vehicles (fire trucks, ambulances) which use this busy stretch of our city's main thoroughfare with regularity.

Perhaps the restaurant's popularity has outgrown its current location and it would be appropriate for them to relocate to a property with enough room to handle the volume of automobile traffic that they attract. I certainly appreciate your consideration of my concern, and I hope to hear from you soon about a possible solution. Thank you again. ~Brier Random Garden Street Santa Barbara

A External - Do not click links or open attachments from unexpected senders Hello Denny and Anthony,
Thank you for your reply. I have called and complained to SBPD twice already over the last several months, and this is what I heard both times - it is illegal to queue in the traffic/bike lanes, and no enforcement action is being/will be taken against the drivers that block the lanes.

I would really appreciate a better explanation. This has been going on for quite a while, and I have not heard of any progress toward resolution. One Saturday night several months ago, when the situation was particularly bad (backed up to the comer), I parked my car down the street and walked in and talked to the restaurant manager about the problem. They were courteous but were also quick to place blame on the city for the lack of a solution. I have also spoken to a friend who is a traffic engineer at the city (maybe a year ago?), and they said they were aware of the problem but not sure what the solution might be, or who was working on it.

I am working all day tomorrow but could talk between 8:30 and 9 am, 1 to 2:30 pm, or after 3:30 pm. Please let me know what time works for you. My cell is 805-259-6834. Just to be clear, I work for local government, but this inquiry is of a personal, non-work nature.

Thanks for your help!

Hi Danny,
I am a longtime resident of Santa Barbara, and I live in the San Roque neighborhood. I both drive and ride my bike on Upper State Street as does my whole family. The problem at Chick-fil-A, with drivers blocking the bike lane and the driving lane, is an ongoing problem with no apparent solution. I have contacted sbpd, and they said they are not taking any enforcement action per direction from your office. I think people need to know that if there is a line that is blocking traffic, they need to move on, find a safe place to park, and walk into the restaurant. It's as simple as that. I believe it is a moving violation to stop your car in the bike lane and/or a traffic lane, unless there is some special event or a person directing safe travel for others. Why can't the police department enforce the traffic laws that we all need to obey? I look forward to discussing this with you. Please let me know what time is good, as I work full time.

Regards, Molly Pearson

Almost every time i have to negotiate the terrible back-up of traffic waiting to enter that restaurant. It's really hard on the bus drivers and creates a scenario ripe for an accident. The only way to solve this is to eliminate the drive-through feature. Patrons should park and get their food just like at every other fast food restaurant. They should not be allowed to create a traffic hazard on State Street.

: Please do something bout the Chick Fil-A drive through spilling out onto State Street. As walker, I am often blocked by cars on the sidewalk. It's equally dangerous when I am driving by. Yesterday they were stopped in the middle of the State/Hitchcock intersection.

Thank you, Anita Sonquist

I appreciate your fast response, Eric! This problem is created wholly by a Drive-thru that doesn't suit the location at all. I suspect that some drivers turn into the lot and then just get sort of stuck because of the back up at the drivethru.

What 1 am going to do next is contact Mr. Dan Cathy at Chick-fil-a directly and ask him to fix this problem.

The complexity is that this location is considered legal nonconforming, meaning that if permitted by today's standards there would not be a drive thru, but one was allowed at the time it was approved. However, City staff including the City Attorney; City Administrator; Public Works; and Community Development are working with Chic Fila to redesign the drive thru to take cars off the street. If this measure doesn't work, the City Attorney will consider other enforcement options related to it being a nuisance. In addition, I am informed that the Police have been authorized to ticket cars that are blocking traffic. >

: I live in the neighborhood as does my mom. Please act NOW to have the drive-thru removed at Chic-fil-a on State Street because the back up of cars onto State Street creates a hazard for drivers, pedestrians, cyclists, and creates excess air pollution. a drive-thru restaurant there is unnecessary and just plain wrong. The City of San Luis Obispo has no drive-thru restaurants/fast food and they were smart to do that. > This form-generated email was sent to SBCityCouncil@SantaBarbaraCA. gov on 1/19/2020 at 7:58:55 AM from IP address 68.6. 106.56. : Dear Mr. Friedman: I am not sure if it is appropriate to write to you since you are my district councilman but I am writing about a problem that is in an adjacent district. In brief, every evening I drive down State Street there is a long and dangerous line stretching out of the Chick Filet onto State Street. I often go to the YMCA and then turn right on State from Hitchcock to go home, and sometimes the line of cars stretches half way down Hitchcock.

There is such restrictive zoning in SB and businesses have to have adequate parking, but obviously the drive-through window here cannot accommodate the cars and is causing a huge and dangerous traffic jam, causing cars to change lanes on State Street to escape the backup coming from Chick Filet. I rarely write my elected representatives. This is a daily hazard that is at best an inconvenience but will eventually cause accidents of State Street since cars must merge left in traffic to escape the back up that stretches down State Street past the traffic light on Hitchcock. Is there anything that can be done? I am sure this was not anticipated when the business got permission to have a drive-through window. Thank you. D. Marshall

: I am guessing that you all are aware of the traffic hazards being created be people stopping on State Street to enter the Chick Fil-A parking lot/drive-thru. I just want to communicate that it is a serious and regular hazard but I don't really want to blame the restaurant when it is the customers who are breaking the law. Is there someway to get an officer stationed there to ticket those customers? Or perhaps require the restaurant to station an employee or hired security there to direct traffic? Thank you for your attention. I don't like to be a complainer but I find the situation to be very worrying.

: I am writing to bring to your attention the untenable situation on Upper State Street.

Between all of the new development traffic has become a nightmare. The worst offender right now is the line due to the Chick-Fil-A drive through. It is impossible to navigate that area during mealtimes as traffic backs up into the street. It isn't safe and all the cars idling aren't doing our air any favors either. Thank you for your attention to this matter.

: Hello. I am writing because I almost got into an accident on Upper State Street this weekend. After crossing Hitchcock on a green light, headed toward downtown in the right lane, I suddenly had to slam on the brakes. Traffic was suddenly at a standstill in the middle of the block, which turned out to be cars lining up for Chick-Fil-A. I remember now that another time I saw a near-accident as a car stopped (for the same reason) in the right lane tried to move too quickly into the left lane. This is a MAJOR problem in our city. How did this ever get approved in the first place? PLEASE attend to this problem. Thank you.

We choose this life style as a way to reduce our personal GHG emissions, reduce air and noise pollution within our community, improve our health, be more efficient with our time, and best of all... save money. My wife, 1-year old daughter, and I regularly use the cargo bike together to run errands around town. I'm writing today to voice my concern over the lack of safety throughout the upper State Street corridor, particularly in front of the Chick fil a. There have been countless times I've been riding my bicycle with my daughter on board, and been forced from the bicycle lane because of the cars parked waiting to enter the drive thru of this restaurant. They block not only the sidewalk, preventing pedestrians from passage, but also the bike lane. We're forced to maneuver into the far left lane, into oncoming traffic, in order to be able to proceed in the direction we are headed. This is extremely dangerous. We are very vulnerable in this situation and have had numerous close calls with almost being hit by speeding 2-3 ton vehicles. It's not a matter of if, but when, someone gets injured or killed as a result of this dangerous design. At that point, who is liable? The driver? The pedestrian? The business? The city? This is a well known and highly publicized issue for over a year. The drivers waiting to enter the drive-thru are doing so illegally and the city is choosing not to enforce this law despite being fully aware of the implications. So who will be held accountable when someone is injured or killed as a result? However, priority #1 shouldn't be about assigning blame, it should be about resolving the issue immediately, living up to Vision Zero, and protecting the most vulnerable road users.

Cities Across America Ban Drive-Thrus to Fight Emissions Wednesday, January 22, 2020 7:14:39 PM

Have you seen this? Have you heard about this? It's time to shut down and ban all drive-thrus on the grounds of fighting emissions - an easy victory for you and for any progressive, environmentally-responsible city in California.

Don't be afraid. This is California. You can't lose when you're defending the environment. Chick Fil A first please and thank you.

FOOD FOR THOUGHT
Why U.S. Cities Are Banning New
Fast-Food Drive-Throughs
October 10, 20198:20 AM ET

JODI HELMER
More cities are passing legislation to ban the construction of drive-through windows in an attempt to curb emissions, reduce litter and improve pedestrian safety. The bans are also sometimes touted as a way to help fight obesity, but past studies suggest they don't have that effect.

Tim Boyle/Getty Images
Pulling into the drive-through lane to order a burger
and fries is getting harder in some U. S. cities.

In August, Minneapolis became the latest city to pass
an ordinance banning the construction of new drivethrough windows. Similar legislation restricting or banning the ubiquitous windows has also passed in
Creve Coeur, Mo. ; Long Beach, Calif. ; and Fair Haven, N.J.

Most bans focus on curbing emissions, reducing litter,
improving pedestrian safety and enhancing
walkability. In Minneapolis, City Council President
Lisa Bender notes that the ordinance fits in
with Minneapolis 2040, a plan for growth and
development that includes achieving an 80%
reduction in greenhouse gas emissions by 2050.

But such legislation is also sometimes promoted as an
opportunity to create healthier food environments
and curb obesity. In a study analyzing drive-through
bans in 27 Canadian cities, researchers noted, "health
promotion and chronic disease prevention are public
health gains from the implementation of fast food
drive-through sendce bylaws."
In South Los Angeles, where an estimated 45% of the
900 restaurants in the area served fast food and
almost 37% of adults and 30% of children were obese,
a 2008 regulation that prohibited opening or
expanding stand-alone fast-food restaurants and
drive-through windows was aimed at curbing that
health epidemic.

Article continues after sponsor message
In the report "The City Planner's Guide to the Obesity
Epidemic: Zoning and Fast Food, " researchers
support the idea that zoning could help protect
residents from high-calorie, high-fat foods, saying
that the purported public health benefits provide "a
logical and compelling justification for the regulation of fast food outlets by zoning laws to protect the
public's health from the devastating obesity
epidemic."
Roland Sturm, a senior economist at Rand Corp., a
nonprofit research firm, calls the notion ridiculous.

Proponents of the bans often tout potential health
benefits, he explains, but there is no evidence to back up those claims.

Obesity rates went up, not down, after South Los
Angeles banned new stand-alone fast-food
restaurants and drive-through windows, according
to research published in the journal Social Science &
Medicine in 2015. Sturm, the lead author, notes that
the rates of overweight and obesity continued
climbing in the three years following the ban.
"We need to be careful not to overstate what these
bans can do," says Sturm. "If we want to lower obesity
and want people to be healthier, [drive-through bans]
are not going to achieve that."
Indeed, the move appears to be less successful than
other legislation aimed at controlling calories and
reducing obesity. Soda taxes were linked to a 52%
decrease in the consumption of sugar-sweetened
beverages among low-income residents in Berkeley,
Calif. Evidence about the impact of menu labeling is
less clear, but some studies have found that it affects the number of calories in meals purchased at fastfood restaurants.

Hank Cardello, director of the Hudson Institute's
Food Policy Center and author of Stuffed: An
Insider's Look at Who's (Really) Making America Fat
and How the Food Industry Can Fix It, warns that
attempting to address obesity with legislation is a
supersize task.

The bans are not meant to abolish fast food. Existing
drive-through windows are often exempt from bans,
and customers can still get out of their cars and
venture inside for grab-and-go tacos, burgers, chicken
tenders and milkshakes. In the absence of a drivethrough option, famished customers might order their dinner through an app like Uber Eats or
Grubhub, which Cardello says he believes might be
worse for the environment.

Change, he argues, needs to start with the industry,
not local legislators. New research published in
the Lancet medical journal implicates the food
industry for fueling obesity and climate change and
suggests restricting global brands such as McDonald's
and Coca-Cola from participating in policy-related
discussions.
"Instead of banning drive-throughs, we need to put
pressure on the restaurant chains, " Cardello says. "As an industry, they haven't stepped up to make a
commitment to cutting calories and improving
nutrition ... to make eating healthy more of a default
choice."

: I am writing to discuss my concern with two items. First is the problem with the Chick-FilA on upper state street. While I know you have heard this issue before, the problem is getting worse daily. Last evening the traffic was backed up to La Cumbre Mall. The right hand lane was impassable for cars and bicyclists. The cyclists had to swerve into the middle of the lanes to just get around. This has become a serious traffic hazard. I wondered last night how emergency vehicles will have to deal with this problem when they come across it.

Yet alone the business next door ( Rusty's Pizza ) that cannot get in their parking lot nor exit without great difficulty. I also notice that there are quite often many parking places at the restaurant but people instead choose to sit in the drive thru line. The simple solution is to rescind the drive thru exemption and close it. Also, a study done by Houston University 3 years ago, shows that cars sitting in lines such as this cause more air pollution. Something must be done before a a person gets hurt in the area. Which brings me to my second point.

Why can we not get 4 way stop signs on the corners of E De La Guerra and N. Quarantina Street and also E. Canon Perdido and N. Quarantina Street? The bulb outs that were put in to slow traffic and help the students crossing do not work well. Also the trying to turn from N. Quarantina to either of thee streets is very difficult and unsafe, especially before and after school hours. I have heard all about traffic flow being hindered by four ways stop signs. Yes that is what they are suppose to do. I can never understand why as a community we end up being reactive, rather than proactive. We had to have three people killed on Milpas street before we finally got the blinking lights to help pedestrians cross the street.

Thanks you for listening.

; Hi Mayor Murillo, I just wanted to write in to express concern about the long line of cars that forms on upper State Street while waiting to get into the Chick Fil A drive through. I'm a cyclist who has to commute home along this route every evening, and it feels deeply unsafe to be forced into traffic while cars occupy the cycling lane. There are even signs warning cars not to stop here, but they are ignored. I've even seen police drive right by the cars parked in flagrant violation of the signs and take no notice. I'd very much like to see enforcement of the ban on cars occupying the lane of travel while waiting for the drive through, because it represents a very real public hazzard. I've had cars lay on their horns and loudly and violently threaten me on my bicycle when I was forced into the traffic lane, because cars are occupying the cycling lane. This is very discouraging and frightening, as I'm riding my bicycle in an attempt to help reduce traffic congestion in Santa Barbara.

Thank you very much for your time and consideration. Best, Colin Jordan This form-generated email was sent to [email protected] on 1/24/2020 at 1:47:52 PM from IP address 98. 179. 249. 247. If you feel you have received this email in error, please report it to HelpDesk@SantaBarbaraCA. gov.

: Re: Chick-fil-A - Traffic Hazard & Obstruction on State Street Eric Thank you for returning my telephone call and taking the time to discuss the traffic congestion problems and hazards caused by the Chick-fil-A Drive-Through facility. Our discussion helped focus my thinking on the need for a long term solution, but there is an immediate pressing need for an interim solution. Both solutions can be pursued simultaneously. For more than two years, I have been unable to understand why the City has not done anything to eliminate the traffic hazards and obstructions in front of the Chick-fil-A. I was an Assistant City Attorney for Santa Barbara during the late 1970s and early 1980s when the City of Santa Barbara prohibited Drive-Through facilities. The Burger King (predecessor of the Chick-fil-A) was the last Drive-Though facility approved before the adoption of the prohibition. The review of the plans for the Burger King were expedited and rushed though in a very dubious and controversial manner - just before the adoption of the prohibition. At the time of the prohibition, the primary concern was reducing air pollution, not traffic congestion. The S-D2 Zone Overlay Zone (Upper State) was adopted at about the same time because of the severe traffic congestion on Outer State. And it also prohibited Drive-Throughs, even though traffic congestion was not considered the primary problem at that time. In the subsequent decades, traffic congestion has greatly increased on State Street. Now there is a pressing need to regulate Drive-Throughs, especially on Outer State Street. IMMEDIATE SHORT TERM SOLUTION The queuing of traffic to enter the Chick-fil-A Drive-Through violates numerous existing laws by obstructing traffic on State Street and blocking pedestrians on the sidewalk. The most obvious are: Vehicle Code 22400 (a) which states in relevant part "No person shall bring a vehicle to a complete stop upon a highway so as to impede or block the normal and reasonable movement of traffic unless the stop is necessary for safe operation or in compliance with law. " Vehicle Code 21663 which states in relevant part "No person shall operate or move a motor vehicle upon a sidewalk except as may be necessary to enter or leave adjacent property. " (emphasis added - does not permit stopping) SBMC 9.98010 provides in relevant part "No person shall stand, or sit, or congregate in or upon any street, sidewalk or crosswalk in the City with the intent to hinder or obstruct the free passage of pedestrians thereon, or to annoy or molest such pedestrians, or to block the entrance to a building, and refuse to disperse afterbeen ordered to do so by the police when the police reasonably believe an immediate threat to public safety is present. " (I believe that this section includes a person who stops a vehicle on a sidewalk that obstructs. ) The California Vehicle Code authorizes municipalities to adopt laws regulating traffic. I believe the Police Department knows of many other specific laws that can be immediately enforced to eliminate the dangerous conditions, obstructions and hazards before somebody is seriously hurt or more property is damaged. LONG TERM SOLUTION The Burger King and Chick-fil-A have not had to comply with this zoning requirement (prohibition of Drive-Throughs) for approximately 40 years. As I recall, there were approximately 40 drive-through facilities when the prohibition was adopted. SBMC

30. 185. 160 and its predecessor 28. 87. 240 prohibited Drive-Through facilities. The S-D-2 Zone Overlay Zone (Upper State) also prohibited Drive-Throughs. Most of the DriveThroughs have not been used for many years and their right to the nonconforming use has expired. It has been stated that nothing can be done to regulate legal nonconforming uses.

But SBMC 30. 160.030 (Discontinuation of Use) addresses this issue and states in most relevant part: "A. ...The right to continue a nonconformity shall terminate once it has been abandoned. 1.Abandonment. A nonconformity is considered to be abandoned after any of the following have occurred: a.Change to a Conforming Use or Configuration. The nonconformity has been changed to a conforming use or configuration. b. Discontinuation of Use. The use has been discontinued pursuant to Section 30. 140.080, Discontinuation of Use. c. Substantial Redevelopment. The structure containing the nonconformity is demolished or substantially redeveloped and not reconstructed pursuant to Section

30. 165.080, Substantial Redevelopment and Replacement of Nonconforming Structures. B.

The right to continue does not apply to nonconforming structures, site development, or uses deemed to be a public nuisance because of health or safety conditions, as determined by the Chief Building Official." (emphasis added) A good argument can be made that the queuing is a nuisance and the City Building Official can make that determination. Has the Community Development Deparirment confirmed that the Burger King did not cease use of the Drive-Through for 12 months which would have been tantamount to termination of the nonconforming use? When did Burger King cease operations on State Street? Were the physical portion of the Drive-Through facility modified or expanded by the Chick-fil-A remodel or thereafter? Another approach is to identify existing nonconforming DriveThroughs, set a termination date for such uses and require an application for a Conditional Use Permit to continue such a use. Moreover reasonable restrictions can be included in a CUP. There can be a reasonable application fee to cover some of the costs for processing and enforcement. The elimination of "Pole signs" in Santa Barbara is a good example of terminating nonconforming structures. In the 1970s, the City prohibited "Pole Signs" (ground signs exceeding 6 feet) and gave owners 5 years to comply with the law. This sign regulation eliminated a blight and was so effective that this restriction has not been an issue for decades. An argument could be made that restricting the Drive-Through at the Chick-filA could result in liability to the City but the problems caused by the queuing are hurting many people. I believe the Rusty's Pizza Parlor has a better lawsuit against the City than Chick-fil-A because the City has permitted numerous violations of the law that have restricted access to and egress from Rusty's. It is outrageous that the City has allowed repeated blockage of one of the two eastbound lanes on State Street - the largest crosstown arterial in Santa Barbara. At the meeting that you convened at the Hope School in April 2018 concerning traffic issues concerning the proposed Target, a resident raised the problems of traffic obstruction related to Chick-fil-A, but nothing has been accomplished to resolve the problems. The queuing on State Street because of the Chick-fil-A adversely impacted me, my neighbors, people who use State Street and many others. The Chick-fil-A has many valuable uses of its facility without its Drive-Through portions. Does the unrestricted right to use a Drive-Through that results in violation of many laws more important than protecting the right to use State Street for its intended purpose? I hope that I have made some suggestions which might help to resolve the problems. Do not hesitate to contact me if I can be of any further assistance. My home address 3709 Dixon Street. You have my cell number and email address. Jim

: Hi Eric, I sent the following to Rob Dayton wanted to ec you (my city council person) and our mayor but since your emails aren't publics After reading your quotes in the SB Independent I was a little confused. If a company has a "highly profitable" asset that is creating a public safety hazard resulting in 3 car crashes in the last year, it would be prudent for the city to close down the drive-thru and let the company figure out how to solve their problem. Since the drive-thru is highly profitable, they will have plenty of incentive to sort it out and demonstrate to your team that they have solved it permanently.

I fail to see how this is the city's problem to solve. If this is the biggest issue facing the city as you were quoted saying, why haven't you done anything about it? I can think of two easy cost free solutions, formally close their drive-thru or station a traffic police officer at the entrance to their drive-thru and ticket motorists who impede the flow of traffic on State Street.

We've read that it's being handled by the City & Chick-fil-A administrators, but nothing has improved for buses, vehicles, pedestrians, neighboring businesses. In fact, it is only getting worse! I've observed many traffic delays, near-accidents, forced illegal lane-changing (including at the intersection), and no tickets being issued (as reported would happen). There are so many more vital issues for you & law enforcement to deal with than this fast-food franchise causing road chaos & potentially dangerous (even fatal) accidents.

Hello Gordon,
Of course, I remember you as that super cool and generous YARDI guy ©.

The City as a whole is aware of the issues with Chic Fil A, however there is no quick or easy solution.

Currently there are zoning laws that allow the business to operate (but not to create nuisances).

Without getting in to greater detail, the City is trying to work with the establishment to solve their own problems to avoid closing down their drive through business. We are anxiously awaiting the new restaurant ownership to address and manage these issues more aggressively. I know we had a PD representative at a meeting today along with the City Attorney and Traffic Engineering.

We have found enforcement doesn't and wont solve the engineering issues, but for safety reasons we will use it as a tool to attempt to keep things safe as best as we can. I will keep your email as we move forward and collect documentation on the nuisance issue.

External - Do not click links or oper'i attachments from unexpected senders Hi, Lori,
Remember me? I know it's been a while and I also know you have way better things to worry about than this, but I wanted to send a quick note about the Chick-Fil-A issue on upper State. I live nearby and generally I stay out of these types of things, but it's really a problem. I've had near misses walking (my house to the Y is pretty common) and on my bike. I'm attaching the photo taken a week ago, but I'm sure you're well aware of what is happening. So ... is there anything you can do to help the City fix this? Or, is it time for the police to actually enforce the signage in the photo? I'm the last one to wish ill on a business, so I'm hoping there's a solution that allows them to keep their income, and allows our residents to enjoy their food (though I've never been, I hear it's pretty good!). I hope you can help, and if there's anything I can do, please let me know.

Besides this ... I hope all is well with you.

Regards,
Gordon

EricReduce? How many cars blocking a lane will reduce? This is not the responsibility of Chick-fil-A; it is your responsibility and that of your fellow council members to have State Street and all other streets flowing! .

You put a cop there and start writing tickets and watch the problem go away! Time to get traffic moving safely on State!

TylerLoved your piece. I have one chicken bone to pick with your observations.

The lane closure and the accidents it has brought is not the fault of Chick-fil-A. It is strictly the fault of a mayor who, sadly, has not shown the ability to project and lead in a national crisis and a city council which has not shown the ability to do their jobs and protect the citizens of our city during a growing national crisis.

All they have to do place a cop on the sidewalk during the peak time and start writing tickets if people park in the Sate St. traffic lane. It ain't rocket science.

The mayor and council have still not taken the local threat coronavirus seriously enough. They dithered for weeks on the cruise ship issue until Princess finally took action to keep their ship out of our city. Yesterday, Mayor Murillo and the council finally "asked" other cruise lines to keep their ships out of Santa Barbara. I would have "told" them that they cannot port here until further notice.

The situation in Italy is a snapshot of what will happen here if the virus takes hold! Best,
Ernie

The sidewalk at Chick-fil-A on upper state Street is blocked every day at noon and dinner time by cars waiting for drive through service. This is in violation of ADA requirements.

Posting signs and talking to Chick-fil-A have not corrected the situation. Numerous complaints about the dangers of this situation have been made but little has been done. The city is negligent in not correcting this situation.

Please take effective steps to prohibit cars from blocking the sidewalk. Please do not wait until a serious accident occurs.

Hi Ronda - I think Ariel is replying to a question you asked Eric Friedman. I am hearing from Tony Brougham in planning that it's not a third lane the restaurant is pursuing, but a wider driveway that would allow a third way to get into the parking lot itself, rather than the drivethru. Also that the application is not yet final.

Hi Ariel - As you may know, I handle op-eds at the Independent. Ronda wrote one recently about Chick-fil-A and how they continue to block the lane on upper State Street. https://www. independent. com/2021/l 1/18/chick-fil-a-needs-to-stop/ In it she quoted the City Attorney's office from an April decision regarding adding a second lane to the drive-thru, and I believe she's wondering if the same procedure will allow a proposed third lane (according to Jim Dewey at Public Works):
"The City Attorney's Office has determined that the project does not rise to the level of an expanded use of the nonconforming drive-through as described in section

30. 185. 160fordrive-through facilities ... "
I am not reporting on this story. As Ronda is trying to call attention to the next opportunity for public comment on the restaurant, I was trying to find out when that might be and the best way to weigh in. (all that seems to be pending)
I hope that clears things up, but please feel free to ask if you have questions. And to reply to Ronda.

Thanks.

Chick-fil-A Needs to Stop
Drive-Through Backs Traffic onto State Street

Santa Barbara's Chick-fil-A is owned by McCollum, LLC of Atlanta, Georgia, which has little interest in our community other than our dollars. The ka-ching of their cash registers is far more important to them than any crash-bang of our auto accidents. The Chick-fil-A drivethrough has been an issue since its inception many years ago. The ongoing hassles continued this February 2021, when Chick-fil-A filed an application for expanding their facilities. Their application (PLN2021 - 00093) said:
"Existing Chick-fil-A restaurant to complete a remodel of their site.

Remodel to include widening the entrance driveway apron, convert the 1-lane drive-thru to a new 2-lane drive-thru, construct a retaining wall along the southerly side of the property, provide a new storm water BMP, and other site improvements."
This application is in violation of our municipal code on drive-throughs which states:
"New or expanded drive-through facilities are prohibited. There shall be no new floor area, and no intensification of use on existing structures developed with a drive-through facility. Existing financial institution drive-through facilities may be replaced in kind with automated teller machines provided the number of drive-through lanes does not increase."
When the planning staff initially reviewed this application, they acknowledged the problem, noting that "improvements to drive thrus (sic) are prohibited." There are also issues with the San Roque Creek and setbacks.

In April, the City Attorney's Office decided that this expansion wasn't really an expansion and that doubling the number of lanes from one to two wasn't an intensification of use on existing structures. And that even though banks can't add additional drive-through lanes, it's perfectly fine for Chick-fil-A.
"The City Attorney's Office has determined that the project does not rise to the level of an expanded use of the nonconforming drive-through as described in section 30. 185. 160fordrive-through facilities ..." It is possible that the city was in hopes that allowing this unlawful expansion might ameliorate the illegally blocked sidewalk, the illegally blocked street, the illegally blocked driveway at Rusty's Pizza, the inaccessible bus stop, and prevent future bicycle fatalities due to the blocked bicycle lane.

Despite the fact that the February application was never approved and its status is listed as incomplete, Chick-fil-A has gone ahead and created a second on-site drive-through lane. But surprise! The traffic congestion has not gone down, and the long line of cars still persists. If only Chick-fil-A and city attorneys had read the Wikipedia article entitled "Induced Demand."
Since the 1940s, planners have recognized that adding more traffic lanes does not reduce congestion. Adding more lanes merely encourages new drivers to join in the fray. And so, with this new "induced traffic, " the long line of cars and its accompanying nightmares continue.

With this in mind, astonishingly, Chick-fil-A is now in the process of adding a third lane and are in plan review for that. A city Public Works employee thought adding a lane could solve the queueing problem, which he blamed on customers not obeying vehicle codes. Has the city never heard of "if you build it, they will come"?
It is past time for the city and Chick-fil-A to acknowledge the reality of this situation. It is impossible to accommodate a large number of cars on a very small lot. It is impossible to have both a popular drive-through at this location and maintain safety and legally required accessibility.

Unless Chick-fil-A has an on-site atom compressor, this number of cars just isn't going to fit.

Chick-fil-A's never ending "we're working with the city" and the city's never ending "we're working with Chick-fil-A" is delaying the inevitable:
the only long-term solution to this long-term problem is to revoke permission for the drive-through. Hopefully soon. Hopefully in my lifetime.

Note: Chick-fil-A may be in the process of resubmitting their proposal. If you would like to be kept updated you can email William Russell (WRussell(a)santabarbaraca. goy) and ask to be added as an interested party for PLN2021-00093.

Mr. Calonne -
Chick-fil-A is a serious safety nuisance to our community. The congestion related to their drive-through queue presents hazardous conditions on a daily basis. Based on the attached PDF from Derrick Bailey, the total number of reported collisions in the 3700 block of State Street in the eastbound direction is roughly 60% greater than in the westbound direction (approximately 16 eastbound vs. 10 westbound depending upon the criteria used to count them). There also is a significant difference in collisions in the 3700 block related to "stopping in the road". In the time period from January 2013 to November 2021, there were 5 reported collisions in the eastbound lanes related to "stopping in the road":

April 26, 2014
January 28, 2016
November 5, 2018
October 31, 2019
Febmaryl 1, 2020
In contrast, the westbound lanes had less than half this number of collisions related to "stopping in the road":

March 2016
January 2019
It is my sincere hope that the city will take effective steps to correct this dangerous situation at Chick-fil-A.

I have been seeing recent media coverage about the Chick-fil-A drivethrough issues; this is not new. To me, it just highlights what I feel is lacking in the City - no enforcement of laws that are in effect. Cars blocking the street - ticket them! Ironic that there are huge signs there but they are ignored because people know that nothing will happen.

Same with the fairly new smoking ban. I see people smoking all over the place - yet it doesn't appear that there is any enforcement of that ordinance either. And in my neighborhood, people run the stop sign at Barker Pass all the time. This has been an issue for a very long time and it is quite scary to pull out of my street (Cedar Lane). These examples, in addition to escalating dangerous elements downtown, all show a need for action and consequences.

Cory,
I admit to being a bit taken aback by the tone of your original e-mail. Specifically, the assertion that this problem somehow exists only because the police department isn't writing tickets.

In actuality, Chick-Fil-A was permitted to operate with their current drive-through format in 2012.

There have been numerous approaches taken to dealing with the resulting traffic issues including heavy enforcement. None of the approaches have had any long-term success. The problem with using the PD to write tickets is 1) the random nature of who gets the ticket and 2) resource management. The latest plan is to come back to council on February 1st with the intent of declaring them a nuisance. I'm not sure how the council will go with this I hope you and your family have a wonderful Christmas and a Happy New Year.

Take care,

Hi Barney,
Long time no talk. I hope all is well with you and your family. I have an issue that would usually be way below your pay grade but years of inaction by the city has made it appropriate for you to weigh in. The tone may not come off well in writing but I am simply looking for answers that have been literally non-existent from your department.

Yes, it's everyone's favorite topic: Chick-Fil-A traffic. KEYT and the Independent have done recent stories but neither of them really pressed your department on why your officers refuse to enforce traffic laws, though when I followed up with KEYT they said, "In this case, I reached out to the SB Police to give comment yet they deferred to have the SB City spokesperson speak on their behalf." Why is SBPD abdicating it's responsibility? Maybe KEYT's questions weren't as specific as mine, but in my opinion the issue at hand has absolutely nothing to do with permits at this point and everything to do with SBPD sitting on their hands. I have spoken to a watch commander who admitting they could and should do more. This was 3 years ago and nothing has changed. I also did a PRA looking for citations in that block, not traffic accidents like others have asked about. It showed zero additional enforcement for cars sitting in the street.

So my question is why does SBPD simply refuse to enforce the law already on the books? Can I basically park in front of the police station for half the day and expect equal treatment? How many citations has the department issued for this particular moving (or lack thereof) violation? Does the traffic division have a list of priorities so that we can see why this issue on State has been continually neglected? I don't want a response from a PIO or for you to forward this issue. I simply want to hear from you that SBPD will do its job starting immediately. Additionally I want to know WHY SBPD hasn't been doing its job for several years, though I know you can't answer for your predecessors.

The solution is not that hard: stick a patrol car there at busy times, light people up and give them tickets, not warnings. That will change human behavior of everyone who sees it happening and it wont take but a few weeks to see a vast improvement. Are you willing to commit to that strategy? If not, why not? Given the number of sworn officers per resident in SB compared with other jurisdictions who seem to hand out tickets just fine, I really hope you and/or the traffic commander aren't going to blame staffing issues.

Again, I don't mean to sound like a jerk here but the buck stops with the chief on this.

Unless I am totally wrong (which does happen!) it doesn't seem like I am asking much here. What am I missing?
Thanks,
Cory Bantilan

Hello,
Today I left a phone message for you that may have included too much information. I'm attaching an email I sent a couple of weeks ago to a friend that summarizes the situation. As with the email to my friend Sarah Knecht, I'm really hoping to contact someone close to any process that might solve the described situation (whether it's a "problem" or not seems to be in the eye of the beholder. There is now a variety of over 50 replies to the current Nextdoor.com discussion about it). Any help you can provide in passing this information along to someone more directly interested, would be appreciated.

Regards,
Rick Closson

Hi Sarah,
I'm asking for help again to reach the person in your office involved with oversight of the permitting process. I'll give you a little background - not for your own consumption, but with the expectation you'll just forward this email to the appropriate person.

For the last 6 months, neighbor-users ofNextdoor. com have been concerned about the traffic tie-ups at 3707 State Street, the site ofaChickfil-A restaurant. The cause seems to be vehicles lined up waiting to order in the restaurant's drive-through lane. City signs are posted there alerting drivers to the violation ofCVC 22400 for waiting on the street and blocking the pedestrian walkway. Nobody (not the owner, SBPD, or me) wants a process of regular ticketing of waiting drivers.

I have discussed this with the restaurant owner, Carol Ruiz (multiple communications by phone and email), SBPD Officer Ethan Ragsdale (phone and email), and my Council member Eric Friedman (personal conversation).

The restaurant owner states she's made a number of efforts to make the drive-through more efficient, e. g., additional assigned staff. She says her corporate office is planning a response to the problem, but she has not shared it.

Both Ethan Ragsdale and Eric Friedman allude to grandfathered permits that allow the property to be used for a drive-through restaurant. They seem to suggest any change in that would be difficult if not impossible.

I'm hoping to engage both the owner (and her corporate team, if necessary) and the City to solve what my neighbors and other residents feel is not just an inconvenience, but a possible safety issue for emergency vehicles using that stretch of the corridor.

Because I feel large corporate businesses know their operations well, someone on the permit applicant's side knew (or should have known) their anticipated Chick-fil-A drive-through volume would overwhelm the physical capacity of the site. If so, that representative may not have been forthcoming in order not to damage the application.

It just seems to me the situation cannot stand in limbo forever. The violations ofCVC 22400 occur every day, predictably at mealtimes. State Street in that block has a raised median strip that prevents easy circumvention by emergency vehicles or others attempting to make way for a siren. A new condominium development across the street will only aggravate the situation.

The online Community Development Department Street File on the property is over 100 documents and I need to view the file in person, which I have not done. I hope to find a record of the pennit process.

My question to a City Attorney is whether the City has any recourse against a permit applicant who might have made incomplete impact statements during the process. Could that permit be reconsidered? Is the City truly bound by a prior drive-through restaurant permit designation that may not fit a higher volume operation? I have no plan to act on those possibilities, but want to know the range of options.

Regards,
Rick Closson
