Therefore, as long as the department as a whole is within budget, budgetary compliance has been achieved. The City actively monitors the budget status of each department and takes measures to address potential over budget situations before they occur.
For Enterprise and Internal Service Funds, the level of budgetary control is at the fund level. The City also monitors and addresses these fund types for potential over budget situations.

COUNCIL AGENDA REPORT
AGENDA DATE: April 18, 2023
TO: Mayor and Councilmembers
FROM: Administration Division, Parks and Recreation Department Engineering Division, Public Works Department
SUBJECT: Contract Amendment with RRM Design Group for Final Design and Construction Documents for the Dwight Murphy Field Renewal Project [Agreement]
RECOMMENDATION:
That Council authorize the Public Works Director to execute a contract amendment with RRM Design Group in the amount of $83,590 for design services for the Dwight Murphy Field Renewal Project.
DISCUSSION:
Background
The City Council initiated the renovation of Dwight Murphy Field in May 2018 with the development of a community-based master plan (Master Plan). Developed through a series of community workshops, surveys, and commission and design review board meetings, Council reviewed the Master Plan in January 2019 and in August 2019, authorized a Memorandum of Understanding with the Gwendolyn Strong Foundation (the GSF), a local non-profit 503(c)(3) organization, to collaborate with the City of Santa Barbara (City) for the fundraising, design, and construction of the park improvements. In December 2019, Council accepted a donation of $250,000 from the GSF and authorized the development of preliminary design documents for the Dwight Murphy Field Renewal Project (Project). In July 2021, the Parks and Recreation Commission made findings for the Project pursuant to Santa Barbara Municipal Code Section 28.37.025, and in August 2021, the Planning Commission approved the Coastal Development Permit. In December 2021, the City Council accepted another donation of $460,000 from the GSF for the preparation of final plans and construction documents.
Project Description
The Project includes the conversion of the existing regulation size turf soccer field to a multi-sport synthetic turf field; new natural turf youth baseball field; new natural turf informal activity area; new inclusive playground; new fitness area; new family picnic area; Agenda Item No. 12

new trash enclosure; new restroom; and the restoration of a portion of Sycamore Creek.
Other amenities include accessible pathways, a bus loading zone, fencing, lighting, rightof-way and park access improvements for vehicular circulation, and the increase of onsite and perimeter parking from 196 to 242 spaces.
Contract Amendment
On December 14, 2021, Council authorized the Public Works Director to execute a professional services agreement with RRM in the amount of $838,191 to prepare final design and construction documents, including specifications and estimates, for the Project.
The purpose of the contract amendment is to correct a math error in the contract scope of work and budget. The amount of the contract should have been $921,781. There are no proposed changes to the scope of work.
BUDGET/FINANCIAL INFORMATION:
There are sufficient expenditure appropriations in the Fiscal Year 2023 Measure C Capital Outlay Fund to cover the cost of the contract amendment.
SUSTAINABILITY IMPACT:
The Project will further the City’s sustainability goals through incorporating environmentally responsible design and construction techniques including, but not limited to, the specification of recycled content building materials, construction debris recycling processes, addition of electric vehicle chargers, and the use of drought tolerant landscaping.
A copy of the contract amendment may be requested from the Public Works Department for public review. Please contact [email protected] to request a copy.

AGENDA DATE: April 18, 2023
TO: Mayor and Councilmembers
FROM: Engineering Division, Public Works Department
SUBJECT: Contracts for Design of Fiscal Year 2024 Pavement Maintenance Projects [Agreement]
RECOMMENDATION: That Council:
A. Authorize the Public Works Director to execute a City Professional Services Contract with Flowers & Associates, Inc. in the amount of $395,807 for design services for the Fiscal Year 2024 Pavement Maintenance Projects, and authorize the Public Works Director to approve expenditures of up to $39,580 for extra services that may result from necessary changes in the scope of work; and B. Authorize the Public Works Director to execute the First Amendment to City Professional Services Contract No. 28,243 with Nichols Consulting Engineers, CHTD, in the amount of $181,500 for citywide pavement inspection services, for a total contract amount of $240,880.
BACKGROUND:
The City of Santa Barbara (City) is beginning design work for the Fiscal Year 2024 (FY24) Pavement Maintenance Projects and preparing the biennial Pavement Management System Report. To assist with these efforts, City staff are recommending two separate professional services contracts. The first, with Flowers & Associates, Inc. (Flowers), is for design of the FY24 Pavement Maintenance Projects, which includes the FY24A Slurry Seal Project and the FY24B Overlay Project. The second, with Nichols Consulting Engineers, CHTD (NCE), is for a citywide pavement condition inspection and assessment. The City will use the condition assessment information to plan for future road maintenance projects.
Project Description
Design of the FY24 Pavement Maintenance Projects includes the FY24A Slurry Seal Project and the FY24B Overlay Project, involving pavement maintenance of high-priority streets throughout the City. Specific locations for the different treatment options have tentatively been identified. The FY24A Slurry Seal Project will resurface streets with a thin coat of emulsified asphaltic material primarily in the upper Mesa area, Calle Cesar Agenda Item No. 14

Chavez, and parts of the San Roque neighborhood. The FY24B Overlay Project will include grinding existing asphalt and replacing with a new compacted roadway surface on sections of Upper State Street, Anacapa Street, Sola Street, Victoria Street, Anapamu Street, Canon Perdido Street, and Alameda Padre Serra. The FY24B Overlay Project will also provide construction of concrete improvements, including new access ramps and curb and gutter repairs in the San Roque and Lower Westside neighborhoods. Actual locations may vary based on budgetary constraints or conflicts with other planned work.
Staff recommends that Council authorize the Public Works Director to execute a contract with Flowers in the amount of $395,807 for design services and authorize $39,580 for potential extra services for a total budget amount of $435,387. Flowers was selected as part of a Request for Qualifications process to provide design and construction support services for the City’s Annual Pavement Maintenance Projects for Fiscal Years 2020 through 2025.
Citywide Pavement Inspections
On January 24, 2023, NCE was awarded a Professional Services Contract with the City to perform pavement inspection services for City Pavement Zones 5 and 6. NCE was selected through a competitive Request for Proposals process. NCE’s additional services will provide up-to-date pavement inspection data for the entire City, rather than focusing on only two pavement zones. These inspections will assist the City with the Pavement Condition Index (PCI) data necessary to prioritize and optimize future roadway repairs citywide.
The City was previously divided into six pavement zones and conducted pavement inspections of one-third of the City every two years. Since the passage of Measure C, capital pavement maintenance projects are focused on addressing high-priority needs rather than concentrating the work within a particular pavement zone. NCE’s comprehensive data collection will allow staff to manage the pavement asset more effectively by more accurately assessing and cataloging the City’s PCI.
Staff recommends that Council authorize the Public Works Director to execute a Contract Amendment with NCE in the amount of $181,500 for pavement inspection services for a new total not-to-exceed contract amount of $240,880. The amendment will add inspection services for Zones 1 through 4 to the existing contract covering Zones 5 and 6.

AGENDA DATE: April 18, 2023
TO: Mayor and Councilmembers
FROM: Budget Division, Finance Department
SUBJECT: City Administrator’s Recommended Two-Year Financial Plan for Fiscal Years 2024 and 2025 and Operating and Capital Budget for Fiscal Year 2024
RECOMMENDATION: That Council:
A. Receive the City Administrator’s Recommended Two-Year Financial Plan for Fiscal Years 2024 and 2025 and Operating and Capital Budget for Fiscal Year 2024; B. Hear a Report from Staff in connection with the filing of the Fiscal Year 2024 budget; and
C. Approve the Proposed Schedule of Council Budget Review Meetings and Public Hearings related to the Operating and Capital Budget for Fiscal Year 2024.
DISCUSSION:
In accordance with City Charter, the Recommended Two-Year Financial Plan for Fiscal Years 2024 and 2025 (“Recommended Plan”) has been filed with the City Clerk’s Office and is being submitted to Council today. The Recommended Plan covers a two-year planning horizon and includes the operating and capital budget for the first year of the plan. In June, Council will adopt a Two-Year Financial Plan for Fiscal Years 2024 and 2025, as well as an operating and capital budget for fiscal year 2024.
VISION 2030 & FISCAL SUSTAINIBILITY:
The City’s budget and financial strength relies very heavily on economic vitality. Two of the City’s most significant revenue sources, sales tax and Transient Occupancy Tax (TOT), are heavily reliant on the tourism industry and a strong economy. The City’s budget has been deeply impacted in years prior from the Great Recession and the Thomas Fire, and more recently due to COVID-19, from reduced revenue that puts added strain on the City to continue to provide services to the City when revenues decline.

City Administrator’s Recommended Two-Year Financial Plan for Fiscal Years 2024 and 2025 and Operating and Capital Budget for Fiscal Year 2024 April 18, 2023
Staff mobilized around an effort in FY2023 to consider additional revenue generating opportunities as well as strategies to align resources within our existing resources to achieve a level of financial sustainability the community expects from the City.
To that end, Vision 2030 was introduced to boldly respond to current civic challenges through a commitment to staff and community for smart, collaborative, and resilient government. This is a collaborative effort to address civic challenges by encouraging staff, the community, and the private sector to work together to explore and implement improved ways of delivering service in a fiscally sustainable way. Vision 2030 is the means to communicate to and include staff and the community in the Fiscal Sustainability process.
The FY2024 and FY2024 operating and capital budgets were developed in line with Fiscal Sustainability and Vision 2030 principles in mind.
BUDGET WORK SESSIONS & PUBLIC HEARINGS:
City staff has scheduled special budget work sessions over the next two months during which the details of the recommended budget will be presented and discussed as part of the budget public hearing process. Over the course of the public hearings, each City department will present their respective recommended budget, including their operating budget, capital program, and fee changes, as well as proposed performance measures and goals for their department.
The first of these special budget work sessions will be held on Wednesday, May 3, from 8:30 a.m. to 12:00 p.m. The proposed schedule for the special budget work sessions, during which the public hearings on the budget will be held, is included as an attachment to this report for Council’s approval.
In addition to the public review by Council, staff recommends that the Finance Committee review certain elements of the Recommended Budget in more detail.
The Fiscal Year 2024 budget is the second year of the City’s OpenGov Stories implementation to present the recommended budget online to the public in an interactive and transparent way. Staff further enhanced and streamlined the budget development process this year by leveraging this powerful tool further, which will streamline and improve the City’s budget process for years to come.
The City Administrator’s recommended budget for FY2024 can be accessed using the new online budget tool beginning today on the City’s website at http://www.santabarbaraca.gov/budget-reports.
FINANCIAL/BUDGET INFORMATION:
There is no direct financial or budget impact by the City Council taking action on staff’s recommendation to approve of the proposed schedule of Council budget review meetings Council Agenda Report

CITY OF SANTA BARBARA
COUNCIL AGENDA REPORT
AGENDA DATE: April 18, 2023
TO: Mayor and Councilmembers
FROM: Administration Division, Airport Department
SUBJECT: Santa Barbara Airport Master Plan Update
RECOMMENDATION:
That Council receive a status update on the Master Plan Update at Santa Barbara Airport.
SUMMARY:
Santa Barbara Airport (SBA) staff will provide an update to the City Council on the progress of the Master Plan Update (MPU). This informational item is the beginning of the public outreach on the process and an invitation to participate in the future of the SBA and possible new projects. Informational meetings will also be held with the Airport Commission on April 19, 2023, the Planning Commission on April 20, 2023, as well as a general public meeting on April 20, 20231. The draft plan will be reviewed in the Fall of 2023 and the City Council, upon a recommendation from the Airport Commission, will be the deciding body on the final draft.
DISCUSSION:
SBA is a “small hub” airport currently served by United, Alaska, American, and Southwest airlines and their affiliates. Since the new Airline Terminal opened in August 2011, SBA has experienced approximately 40 percent growth in enplanements (i.e. commercial passenger boardings).
SBA’s capital project program is “demand based,” i.e. development occurs in response to reasonably anticipated demand for facilities. In 2012, an aviation forecast was prepared in support of the 2017 Airport Master Plan which identified growth in commercial aviation at SBA reaching 657,000 annual enplanements by the year 2032.
While the most recent Santa Barbara Airport Master Plan (AMP) was completed in 2017, FAA guidance encourages updating Airport Master Plans periodically (every 5-10 years).
Such updates account for changes in conditions and operations, such as the recent change in fleet mix from regional jets to widebody jets at SBA, and to ensure that the document is responsive to current and forecasted needs. 1To receive updates on meetings sign up at https://flysba.santabarbaraca.gov/projects/master-plan-update Agenda Item No. 19

Council Agenda Report
Santa Barbara Airport Master Plan Update
April 18, 2023
In 2022, the Federal Aviation Administration’s (FAA’s) Terminal Area Forecast (TAF) estimated SBA exceeding 668,777 annual enplanements in 2026. Thus, the most recent TAF indicates that the 2017 AMP build-out figure of 657,000 annual enplanements may be exceeded by 2026. SBA initiated a Master Plan Update in 2022 to account for additional growth that is currently outpacing the 2017 AMP and the most recent FAA TAF.
Airport Master Plan Background
An AMP evaluates an Airport’s needs over a 20-year planning period for airfield, terminal areas, and landside facilities. The goal is to document the orderly development of facilities essential to meet an airport’s needs, in accordance with FAA standards, and in a manner complementary with community interests. The plan results in a 20-year development for a financially resilient facility, reflective of the updated Airport Capital Improvement Plan and graphically depicted by the Airport Layout Plan drawings. An approved plan shows how an Airport will satisfy FAA design standards and seek project funding eligible under the respective federal and state airport aid programs.
An MPU was included in the Fiscal Year 2022 Airport Capital Improvement Plan, which is
90.66% funded by the FAA. A Request for Qualifications was issued by SBA staff in February 2022. Two proposals were received in March 2022, and interviews were held with both qualified firms in April 2022. Consultant interviews were held with a panel of Airport staff, which unanimously agreed to select Mead and Hunt, Inc. based on their qualifications and proposed team; they began work in July 2022 following Council approval. An update on Airport Capital Improvements and the MPU was presented to Council in August 2022.
Project Update
Technical Progress
The MPU was initiated by data gathering and site visits by Mead and Hunt to SBA in August 2022. This data included topographic and environmental surveys and baseline information on existing facilities. In addition, operational data was gathered related to commercial and general aviation at SBA, as well as financial information and facility conditions.
Based on data gathered, and new 2022 TAF data from the FAA, Mead and Hunt created a draft forecast chapter of the MPU, which will serve as the basis for planned future improvements over the next 20 years. The draft forecast chapter was reviewed by the FAA and was made publicly available for review and comment until March 30, 2023. The forecast chapter will be finalized Spring 2023, once the FAA approves the forecast.
Mead and Hunt also provided a draft Environmental Conditions chapter, based on information gathered by their subconsultant Rincon Environmental. Additional future deliverables for the MPU include: an Archaeological report; an Airport Recycling, Reuse, and Waste Reduction Plan; a Facility Requirement memorandum; an Alternatives working paper; a Financial Feasibility Analysis and Facilities Implementation Plan; an Aircraft Noise Analysis; and a revised Airport Layout Plan. Each of these deliverables will be part of the MPU and submitted to the FAA for review and approval.
Council Agenda Report
Santa Barbara Airport Master Plan Update
April 18, 2023
Lastly, Mead and Hunt are coordinating closely with simultaneous projects at SBA, which include the terminal addition and parking structure conceptual design, the Fixed Based Operator (FBO) redevelopment project, the Sea=level Rise vulnerability assessment and adaption plan, the Master Drainage Plan Update, and more.
Stakeholder Engagement
In September 2022, a series of meetings held with various SBA and community stakeholders. These meetings were conducted in person at SBA and included representatives from the City of Goleta, Visit Santa Barbara, UCSB, Santa Barbara County, Santa Barbara Channelkeeper, SBA commercial and general aviation representatives, and more. The intent of the stakeholder meetings was to gather feedback on the socioeconomic factors that influence the airport and vice versa. In addition, feedback was collected specifically on the SBA facilities and where improvements could be made. The stakeholder groups were also asked to provide feedback on environmental considerations, other trends, and possible impacts related to SBA.
Based on the participation from the August 2022 preliminary stakeholder engagement, two working committees were formed: a Community Input Committee, and a Technical Input Committee. Working meetings were held with both committees in October 2022 and valuable specific feedback was received from a Strengths Weaknesses Opportunities and Threats exercise facilitated by Mead and Hunt.
At the request of the FAA, SBA made the draft forecast chapter publicly available on the SBA website in early 2023. The availability was advertised in City News in Brief, Santa Barbara News-Press, Voice Magazine, and the interested parties list for the MPU, in both English and Spanish. Once the forecast chapter is officially approved by the FAA, additional Community Input Committee and Technical Input Committee meetings will be scheduled.
BUDGET/FINANCIAL INFORMATION:
The FAA, under authorization from the United States Congress, distributes Airport Improvement Program funds each year. The FAA grants fund will cover 90.66% of City staff time as well as consultant costs for the MPU.
SUSTAINABILITY IMPACT:
The Santa Barbara General Plan focuses on a stated mission statement of “Living within Our Resources” and stresses sustainability for development (City of Santa Barbara 2011).
Also, a guiding principle of the 2017 AMP and the MPU is to support the sustainable design of airport facilities and the wise use of resources. The MPU will be consistent with the Santa Barbara General Plan and will incorporate the guiding principles throughout the development of alternatives. The MPU will also support the policies of the Local Coastal Program for that portion of the Coastal Zone encompassing the Santa Barbara Municipal Airport that are protective of the natural resources abundant in Airport and Goleta Slough.
Also, the MPU will incorporate updated forthcoming sea-level rise data into the alternatives and will examine aircraft electrification and sustainable aviation fuels. The MPU will also Council Agenda Report

address known and foreseeable environmental challenges that may complicate projects, which will facilitate sustainable project implementation. Lastly, the MPU will update the existing SBA Recycling, Reuse, and Waste Reduction Plan.
A copy of the Mead & Hunt contract may be requested from the Airport Department for public review by contacting [email protected].
ENVIRONMENTAL REVIEW:
The projects and alternatives identified in the 2017 Airport Master Plan were included in the adopted 2017 Airport Master Plan Environmental Impact Report. The MPU, and any new projects or alternatives will be subject to additional California Environmental Quality Act (CEQA) review. Any projects that are selected for development as part of the MPU will be subject to the National Environmental Policy Act (NEPA), as well as the California Coastal Act.

CITY OF SANTA BARBARA
COUNCIL AGENDA REPORT
AGENDA DATE: April 18, 2023
TO: Mayor and Councilmembers
FROM: Planning Division, Community Development Department SUBJECT: Appeal of Project Design Approval for 101 Santa Cruz Boulevard RECOMMENDATION: That Council:
A. Consider the appeal of Jorene Lopez and Jeffrey Yen of the Single Family Design Board’s Project Design Approval for 101 Santa Cruz Boulevard; and B. Direct staff to return to Council with a Decision and Findings Resolution reflecting the outcome of the appeal hearing.
EXECUTIVE SUMMARY:
An application for a new residence at 101 Santa Cruz Boulevard was reviewed by the Single Family Design Board (SFDB) on June 6, 2022, and September 12, 2022. The Staff Hearing Officer granted approval of a front setback modification and an open yard modification on December 14, 2022. On January 17, 2023, SFDB granted Project Design Approval.
On January 27, 2023, Jorene Lopez and Jeffrey Yen, owners of the property at 1506 Shoreline Drive, directly adjacent to the project site, filed an appeal of the SFDB approval stating that the size and location of the second-story deck is inconsistent with Single Family Residence Design Guideline 36.2.4. (See Attachment 1 – Appeal Letter.) The appellants submitted written correspondence at multiple hearings and provided public comment remotely to express concerns regarding the impact of the project on their privacy. (See Attachment 4 – Written Correspondence.)
Staff contacted both parties to provide an opportunity to discuss the appeal issues and potentially mediate but were unsuccessful in scheduling a meeting. The applicant and appellant subsequently had a phone conversation but were unable to reach a compromise regarding this appeal.
Agenda Item No. 20
File Code No. 640.07
Council Agenda Report
Appeal of Project Design Approval for 101 Santa Cruz Boulevard April 18, 2023
Request for New Information to Be Considered
The Municipal Code requires that City Council decide the appeal based on the information provided to the SFDB; however, the code allows new evidence to be considered if Council determines that new evidence is relevant and could not have been produced or was improperly excluded from the SFDB’s review.
In this case, staff is requesting Council’s consideration of a shadow plan1 prepared by the applicant as part of the presentation. In an effort to resolve the appeal prior to a Council hearing, the architect prepared a shadow plan that was forwarded to the appellant. The shadow plan was not a requirement for the project, nor was it needed for the SFDB’s design review, and was therefore not submitted to the SFDB. Although it was not part of the public record for SFDB, including it as evidence in this hearing will illustrate a key issue raised in the appeal.
If Council determines that the shadow plan is relevant and generally could not have been produced as part of the SFDB record because it was not a requirement for approval of the project, then the study will be introduced at the appeal hearing.
DISCUSSION:
Project Description
The 5,863-square-foot site, located at the corner of Santa Cruz Boulevard and Shoreline Drive, is currently developed with a 1,095-square-foot single-story residence with a 237- square-foot attached garage. The existing residence and garage would be removed and a new 1,963-square-foot two-story residence with a 406-square-foot attached garage would be constructed. A new sidewalk would be provided along Shoreline Drive. The Parks and Recreation Commission approved the removal of one pepper tree and one palm tree. (See Attachment 2 – Project Plans.)
The project received approval for a front setback modification to allow the new residence to encroach into the required 20-foot setback from Santa Cruz Boulevard, and an open yard modification to allow the open yard without the required minimum dimensions.
Additional information about the proposed project is included in Attachment 5 – Staff Hearing Officer Resolution and Staff Report.
Appeal Issues
The appeal letter refers to specific guidelines from the City’s Single Family Residence Design Guidelines document. These design guidelines are intended to help applicants design homes that are compatible with the surrounding neighborhood and to serve as a 1 A shadow plan or diagram provides a visual model of how a proposed development will cast its shadow during a specific time and day of the year.

tool to help SFDB members determine if the required Neighborhood Preservation Ordinance findings can be made. The guidelines referenced in the appeal letter are discussed below, as are the SFDB hearings. (See Attachment 3 – SFDB Minutes.) Appeal Issue 1 – Size and Location of New Deck
Design Guideline 36.2.4: The relevant appeal issue is the size and location of the new second-story deck facing Shoreline Drive. The appellants state that the size and location of the deck do not follow Design Guideline 36.2.4, a Good Neighbor Guideline addressing privacy and upper-story decks. The guideline suggests projects: “set back upper-story or balconies over 20 square feet at least 15’ from interior lot lines when possible.” The appellants are concerned that allowing such large decks overlooking the street would set a bad precedent for the neighborhood.
The upper-story deck is approximately 91 square feet (6’-11” by 12’-11”). The deck is located less than 15 feet from the property line; however, the existing residence is located just two feet from the property line and the new residence and deck would comply with the interior setback of 6 feet.
Initially, the SFDB had concerns about the proposed location of the second-story deck as it was proposed within the 15-feet of the property line, thus not adhering to the Good Neighbor Guidelines2. The Board provided further guidance to the applicant at the second hearing to study reducing the square footage of the second-floor deck, but they stated that they: “generally find the proposed privacy screen plantings sufficient along the property lines.” Before the scheduled Project Design Approval hearing, the applicant made additional design modifications, specifically adding the wing wall to the western side of the deck to provide privacy to the neighbor, which satisfied the SFDB’s concerns. The SFDB made the required Neighborhood Preservation finding that the project generally complies with the Good Neighbor Guidelines with the proposed landscaping and a wing wall at the deck to address privacy, landscaping, noise, and lighting concerns.
Appeal Issue 2 – Shading of Front Yard and Windows
The appeal letter contends that the deck area would reduce the amount of sunlight to the appellants’ front yard and front windows, although this was not an issue that was previously brought up at a hearing. The SFDB did not express concern about the development and potential for shading, and the project complies with the City’s Solar Access Height Limitations, a standard that protects adjacent properties sharing a northerly lot line from excessive shading. The shadow plan prepared for this appeal illustrates effects of the proposed development.
2 The 15-foot setback from a lot line for a deck or balcony is a guideline, not a requirement. Projects that do not adhere to this design guideline generally address noise and privacy impacts through additional screening or landscaping if identified as a potential issue.
Council Agenda Report
Appeal of Project Design Approval for 101 Santa Cruz Boulevard April 18, 2023
Appeal Issue 3 – Outdoor Fireplace
Design Guideline 34.2: The appellants state that the project goes against Design Guideline 34.2. This guideline addresses the location of outdoor fireplaces. The proposal does not include an outdoor fireplace; therefore, it is not relevant to the appeal discussion.
Appeal Issue 4 – Visual Distance between Structures
Design Guideline 36.1: The appellants’ letter states that the project goes against Design Guideline 36.1 (Visual Distance), which recommends locating structures to increase visual distance between buildings and avoiding large two-story building masses at the sides and rear of adjacent rear yards. The second-story element is set back at both the front and the rear of the residence as shown on the East and West Elevations. This structural setback results in one story at the front, two stories in the middle, and a rear step-down to a one-story garage (Plan Sheets A-6.1 and A-6.2). As such, the proposed design avoids a second story that spans the entire length of the lot. The SFDB made the required neighborhood compatibility finding related to mass, bulk, and scale as the applicant satisfied all of the Board’s requests.
ENVIRONMENTAL REVIEW:
On December 14, 2022, the Staff Hearing Officer confirmed the finding that the project is exempt from further environmental review under Section 15301 [Existing Facilities] and Section 15303 [New Construction of Small Structures] of the California Environmental Quality Act (CEQA) Guidelines, because the project involves demolition of the existing single-family residence and construction of a new single-family residence.
BUDGET/FINANCIAL IMPACT:
This action does not have a budget/financial impact on the City.
CONCLUSION:
Staff recommends that City Council consider the SFDB’s approval of the project. If Council concurs with the SFDB’s decision to grant Project Design Approval and that the Neighborhood Preservation Ordinance criteria have been met, then the appeal should be denied.
If Council does not agree with the SFDB’s decision to grant Project Design Approval, the appeal may be upheld, and Council should identify the reasons.
Staff also recommends that Council direct staff to return with a Decision and Findings Resolution reflecting the outcome of the appeal.

The proposed second story of 101 Santa Cruz already blocks sunlight to the entire structure of 1506 Shoreline, to the detriment of our property value, yard plantings, and quality of life. This arguably goes against SFR Design Guideline 36. 1. But we respect our neighbor's right to build a second floor, and can live with our reservations with respect to 36. 1. However it is clear that the proposed deck goes against SFR Design Guidelines, yet equally clear that compliance with these guidelines will greatly mitigate the adverse effects to us, our property, and our lives.
Also, we want to raise the point that allowing such large decks overlooking the street may set an unwanted precedent for other homeowners to build large side decks that are not in the spirit of
36. 1.
Additionally, we respectfully asked that the Design Review Board protect our option to one day build our own second story. We feel that this extended deck on 101 Santa Cruz will require us to build a large deck so that we can share in the same advantages that 101 Santa Cruz is attempting to attain with their deck overlooking Shoreline Dr. We feel that this would set a bad precedent for the neighborhood.
Thank You.
Kindest regards,
Jorene Lopez and Jeffrey Yen

(Proposal to demolish the existing 1,095 square foot one-story residence and construct a new 2,105 square foot two-story single-unit residence with a 410 square foot attached garage. Project includes a new driveway, removal of an existing pepper tree and palm tree, and hardscape and landscape improvements. As currently proposed, Staff Hearing Officer review and approval is required for a Front Setback Modification to allow the residence and garage to encroach into the required 20-foot front setback along Santa Cruz Boulevard, and a Coastal Development Permit may be required. The proposed total of 2,425 square feet on a 5,863 square foot lot is 91% of the maximum required floorto-lot area ratio.) This is a One-Time Pre-Application Consultation. No final appealable decision will take place at this hearing.

Staff comments: Mr. Robert Dostalek stated that proposed project is a demolition and rebuild for a corner lot on Shoreline and Santa Cruz Blvd., including a request for a front setback modification, an open yard modification, and a Coastal Development Permit (CDP). Additionally, Transportation Planning Division staff requests a 17-feet, 6-inch setback (usually 20-feet) from the garage to the ATTACHMENT 3

Ms. Plummer commented that the project has not completed its design review process and will be required to comply with all Storm Water Management Program compliance requirements, including flood abatement, etc., prior to receiving any approvals from the Staff Hearing Officer on the modifications.
Board comments:
1. In general, the Board finds that the front setback modification and the open yard modification requests are aesthetically appropriate.
2. Study getting closer to an 85% floor-to-lot-area ratio (FAR), even though other properties along Shoreline Drive or in the immediate neighborhood may have similar or higher than 85% FAR.
3. Study tucking or pulling the garage back into the site to make it less prominent from street view. As designed, the Board finds the garage from street view is not aesthetically appropriate (plan sheet A-7.1).
4. Restudy the west elevation to make more harmonious with the other elevations; add articulation.
The south, north, and east elevations are architecturally appropriate in style and massing.
5. The Board finds the project to be an aesthetic improvement over existing site conditions, stepping back the second-story helps to make the bulk and massing more acceptable and in general the mass, bulk, and scale fit the Neighbor Preservation Findings aesthetically.
6. Restudy the view from the upper floor bedroom window down to the northern property line/neighbor; the garage may provide partial screening; study additional landscape screening opportunities.
7. Restudy and consider reducing the 10-foot first story plate. The Board would support a 9-foot plate height and the second floor being an 8-foot plate height. Perhaps reduce the profile only on one side of the house.
8. In general, the Board finds the proposed project fits the SFDB guidelines and the architectural details are interesting and appreciated.
9. No significant trees are being removed. The Board looks forward to seeing additional proposed trees.
10.Remove the proposed cupola above the proposed garage.
11.The Board finds the proposed Spanish Colonial design acceptable.
12.Balance the roof plan.
13.The Board cannot support the proposed location of the upstairs second-story balcony as it is currently proposed within 15-feet of the property line and not supportable per the SFDB Guidelines.
Consider relocating to the east elevation and subsequently restudying the 3-way fireplace element.
14.Study relocating the large second-story bedroom window to the front area to avoid privacy issues.
15.Reconfigure the north elevation fireplace pop out to be a straight wall back behind the fireplace.

Hi Allison,
It was just brought to my attention that there is a concept review planned for 101 Santa Cruz Blvd. today. I am not sure if you are the person I need to contact, or what the proper protocol here is, so please advise. I am the homeowner at 1506 Shoreline Dr., next door to 101 Santa Cruz, and have a few concerns. Since the review is today, I am just copying and pasting my letter below for your review.
Thank you.
Best regards,
Jorene Lopez
Dear Board Members;
Currently, our only concerns about this project are its impact on our back yard. The house is quite tall and bulky and will loom over our private open space, with four windows and a deck facing our property.
We ask that you encourage the applicant to moderate the west elevation with more articulation, and to protect our privacy and our future option of a second story.
Thank you for your time.
Sincerely,
Jorene Lopez and Jeffrey Yen

Dear Board Members:
After reviewing the revised plan for 101 Santa Cruz Blvd, our only remaining concern at this time is the privacy of our back yard and back house from the windows of Bedroom 2 (both West and North facing). The current placement of the windows will allow for an unobstructed view onto our open yard, as well as an ability to see directly into our back house, which has an East facing floor-to-ceiling glass wall.
If the applicant could modify the windows in Bedroom 2, and/or incorporate strategically placed trees (or a green screen) into their planting plan, we feel this could be an adequate solution.
Thank you for your time.
Best Regards,
Jeffrey Yen and Jorene Lopez
