Thank you for submitting your request for technical assistance to the Department of Housing and Community Development (HCD) regarding Government Code sections 66411.7 and 65852.21 (SB 9). This email memorializes the meeting between HCD and the City on November 3, 2025.
As was stated during the meeting, HCD finds nothing in state law that would prohibit the City from establishing an infill subdivision ordinance that is separate from, more permissive than, and not intended to implement SB9. If the City adopts such an ordinance, HCD encourages the City to ensure that the two distinct pathways – the local infill subdivision ordinance and the SB 9 pathway – are clear.
