RATIFY PURCHASE OF TABLES FOR MANNEL PARK (CIP PROJECT NO. PK00004) IN THE AMOUNT OF $15,442.68 FROM GROUNDS FOR PLAY
- 2 -
The action is not defined as a “project” per Section 15378(b)(4) of the CEQA Guidelines because the action is the purchase of tables for a park and therefore, it is the creation of a governmental funding mechanism that does not involve any commitment to a specific project that can result in a potentially significant impact and not subject to CEQA.

APPROVED BY THE CITY ATTORNEY
No

ALTERNATIVES
There are no alternatives to the recommended action. The purchase and installation of outdoor tables under Mannel Park's new public shade structure are consistent with how similar shade structures are used at other park locations. The tables ordered would match what has been purchased in the past.

NEXT STEPS
The tables ordered should be received and installed before the end of this summer.

This purchase order for equipment and materials issued by the City of Shafter (“CITY”) to the Vendor designated in the purchase order must be promptly accepted and acceptance is expressly limited to the terms of this order. Any additions or different terms in the Vendor's forms are hereby deemed to be material alterations and notice of objection to them and rejection of them is hereby given. Vendor's shipment of goods in response to this order shall be considered acceptance by the Vendor.

2. Entire Agreement. Unless Vendor and CITY have entered into a separate written contract covering the purchase of the goods described herein, the entire contract between the parties consists of this order and the Vendor's acceptance as above stipulated, and said contract shall not be changed or added to except in writing signed by authorized representatives of each party.

3. Price. The price invoiced for the goods on this purchase order shall be no higher than the price stated on the front of this purchase order unless prior notification is received from Vendor prior to shipment and the change is accepted by CITY. Vendor shall deliver to CITY all invoices within 30 days of shipping or service delivery.

4. Payment. Payments will be made net 30 days unless otherwise specified as per agreements regarding discount terms. The period of computation will commence on the date of receipt of a correctly completed invoice. Payment may be withheld, in whole or in part, due to deficiencies in Vendor’s performance. Payment of an invoice by CITY shall be without prejudice to any and all claims CITY may have against Vendor in connection with such goods. Invoices are paid on a weekly basis and such practice may result in minor deviations from payment terms otherwise cited herein

5. Time of the Essence. Time is of the essence on this order. If delivery is not made in the quantity or quantities and at the time or times specified, CITY shall have the right, at its option, to cancel the entire order or that part of same not so delivered. If CITY accepts delayed delivery the time of payment shall be extended accordingly.

Unless otherwise specified, all goods are to be shipped prepaid, F.O.B. destination. No charge will be allowed for packing, crating, freight, express or other carrier's charges, or cartage, unless specifically agreed to by CITY. Title to equipment and materials purchased hereunder shall pass to Vendor at the designated F.O.B. point, subject to Vendor’s right to inspect and reject or revoke acceptance.

7. Warranty. Vendor warrants for a period of 12 months following start of use or 18 months from receipt, whichever occurs first, that the goods described herein will be free of defects in workmanship, design, materials, and title, and notwithstanding anything herein to the contrary, will conform to all applicable proposals, specifications, instructions, drawings, data, descriptions, and samples, and will be of good and merchantable quality and fit and sufficient for the purpose intended. Vendor shall obtain and provide to CITY Material Safety Data Sheets (MSDS) for each product that contains hazardous substances as defined by CalOSHA.

8. Rejection of Goods. CITY shall have the right, at its option, to reject or revoke acceptance of any goods which do not conform to these warranties or to the specifications. In case of such rejection or revocation of acceptance, transportation of the rejected goods, both to and from CITY, shall be at the expense of Vendor, said rejected goods are not to be replaced except upon specific instruction from CITY, and CITY shall have the right at its option to cancel the remainder, if any, of the order, by notice to Vendor at the time notice is given of rejection or revocation of acceptance. Vendor shall be liable to CITY for all damages proximately caused by breach of any of the foregoing warranties, including incidental damages but excluding special or consequential damages.

9. Returns. CITY reserves the right to return for full credit any excess over quantity called for in any order or orders. Vendor to bear the cost of transportation both ways.

10. Force Majeure. Vendor shall not be held responsible for failure or delay in shipping nor CITY for failure or delay in accepting goods described herein if such failure or delay is due to act of God, war, federal or state legislation or any regulations or orders, fire, accident, or other causes, either similar or dissimilar to the foregoing, beyond their control.

In the event of any such excused interference with shipments, CITY shall have the option either to reduce the quantity provided for in the order accordingly or to exercise its right of cancellation as set forth in these terms and conditions.

11. Additional Fees. Unless otherwise required by law or provided herein, Vendor assumes exclusive liability for, and shall pay before delinquency, all sales, use, excise and other taxes, charges or contributions of any kind now or hereafter imposed on or with respect to, or measured by the article sold or material or work furnished hereunder on the wages, salaries or other remunerations paid to persons employed in connection with performance of this order.

12. No Waiver. No exercise by CITY of its rights hereunder shall constitute a waiver of any rights it may have for breach of contract. CITY's waiver of or failure to enforce its rights on account of Vendor's failure or delay in performing any obligation of Vendor hereunder, or on account of Vendor's breach of contract in any respect, shall not constitute a waiver of any subsequent failure, delay or breach.

13. Compliance with Law. Vendor shall comply with all applicable laws and regulations of the federal, state and local government. The parties to this agreement hereby agree that:

1. Any changes in the scope of work shall be accommodated only with mutually approved, written change orders. Any CUSTOMER representative that acts as an authorized agent of the CUSTOMER will be assumed to have authority to approve and sign change orders.

2. GFP shall have the right to invoice the CUSTOMER and collect additional reasonable charges if unforeseen additional costs are incurred on this project for any of the following reasons:
• Permitting (building, dig, etc.), Bonds, Taxes, Storage and/or Transporting of Equipment, offloading not covered under proposed scope of work
• Prevailing Wages, Union Wages, Engineering Costs not covered under proposed scope of work • Contract price based on normal site conditions (normal digging, standard footer, etc.). Conditions such as underground obstacles (rock, coral, construction debris, paving sinkholes, etc.) which preclude the use of heavy machinery will require additional labor costs. Site accessibility included. Foundations shall be designed to provide adequate structural capacity, adequate foundation bearing capacity with acceptable settlements, and acceptable overall stability of slopes adjacent to the foundations. This is required by the CUSTOMER or the CUSTOMER consultant. GFP assumes no responsibility for soil and site conditions.
• While Grounds For Play makes every effort to provide accurate shipping prices, these are only estimates and additional charges may apply.

3. Failure of the CUSTOMER to make timely progress payments for equipment where such progress payments are required shall result in the cessation of production or the withholding of shipment of completed items until all progress payments are made in accordance with agreed upon terms.

4. Upon failure to pay required progress payments, GFP shall charge the CUSTOMER a storage fee equal to one percent per day of the project equipment total, or $50 per day, which ever is greater. The CUSTOMER shall pay any such storage fee charged before the equipment will be shipped. The CUSTOMER shall advise GFP of any delays in site availability, construction scheduling, site work progress, personnel absences, or any other event that might cause the CUSTOMER to be unable to receive shipments according to planned schedules. Once GFP commits the equipment portion of this order to manufacturing scheduling, and so advises the CUSTOMER, the CUSTOMER shall pay for said equipment when invoiced and any reasonable handling, transportation, and storage charges required to safely house the equipment until the CUSTOMER is prepared to receive it.

5. A 35% re-stocking fee will apply for any equipment item ordered and returned for any reason other than damage incurred during delivery. The CUSTOMER will have 72 hours after order placement to cancel any/all orders.

6. Job site must be ready by the scheduled installation date. Any downtime resulting from the delays in installation, additional travel times/trips, etc. may result in additional charges.

7. The CUSTOMER shall provide an accurate schematic or diagram of all underground utilities, inclusive of water irrigation systems, in the area in which playground equipment, fall zones, trike tracks, walkways, or other site amenities are to be installed, or shall provide a written statement that no such underground utilities exist. GFP shall be held harmless for any damage to or ramification resulting from damage to underground utilities should those utilities damaged be either improperly located in the schematics or drawings furnished by the CUSTOMER or by CUSTOMER error in determining no such utilities exist.

8. Existing drainage problems, if any, will not be solved by this playground project unless noted as a line item in the proposed scope of work. Any problems with drainage that occur after installation is complete shall be the responsibility of the CUSTOMER.

9. Heavy machinery may be required in the installation of the proposed scope of work. Grounds For Play will, within reason, try to leave site as it was found. If site does not allow the use of heavy machinery, additional labor costs will apply.

MANAGEMENT REPORT

CITY OF SHAFTER

CITY COUNCIL REPORT
MEETING DATE: August 1, 2023
FROM: Gabriel A. Gonzalez, City Manager
PREPARED BY: Alex Gonzalez, Deputy Public Works Director SUBJECT: AWARD CITY HALL ROOF REPLACEMENT PROJECT
[GE00006.1] TO FRESNO ROOFING, INC. IN AN AMOUNT NOT
TO EXCEED $430,000

RECOMMENDATION
Council find action is not defined as a “project” per Section 15378(b)(4) of the CEQA Guidelines; accept bids submitted for the City Hall Roof Replacement Project [GE00006.1]; authorize a budget amendment of $180,000 from General Fund Reserves; and authorize the Public Works Director to issue a notice of award and notice to proceed to Fresno Roofing, Inc. in an amount not to exceed $430,000.

BACKGROUND
The City Hall roof has deteriorated to the point where it leaks and even floods areas inside the building. Therefore, at the request of staff, the Council authorized bidding on the City Hall Roof Replacement project this past January. The project includes completely removing the existing materials to the roof sheeting, replacing the existing roof sheeting in select areas, installing a new underlayment, new roofing tiles, new attic vents, and replacing damaged fascia board. A portion of the finished roof facing the alley will be surfaced asphalt shingles to facilitate future solar panel installations. The results of the public project bid opening, which took place on June 30, 2023, are as follows:

Contractor Total Bid Price
MSH Development Group, Inc. $149.002.00
Fresno Roofing, Inc. $346,941.63
Nations Roof West, LLC $355,166.22
Best Contracting Services, Inc. $499,511.65

ANALYSIS
The apparent low bid provided by MSH Development Group, Inc. was determined to be non-responsive because it failed to include the final updated bid form provided before the bid date and, as a result, did not propose to perform all required work for the price bid. Staff consulted with the City Attorney's office, who concurred the City could reject

Page 173 of 193 ends

AWARD CITY HALL ROOF REPLACEMENT PROJECT [GE00006.1] TO FRESNO ROOFING, INC.

IN AN AMOUNT NOT TO EXCEED $430,000
- 2 -
the lowest bidder for being non-responsive. The confirmed lowest responsive bid was submitted by Frenso Roofing, Inc., which has not done any past work for the City but has been in business constructing private and public roof projects for approximately 70 years.

As authorized by the Council, Public Works has already purchased the replacement roof tiles, which are now stored at the Corporation Yard and ready to be installed. An appropriate budget for the tile purchase and roof replacement work is $430,000.

FISCAL IMPACT
Capital Improvement Program Project #GE00006 has $250,000 budgeted for City Hall improvements, including the roof project. Covering the recommended project budget of $400,000 could be completed by allocating $180,000 in General Fund reserves.

CEQA ANALYSIS
The action is not defined as a “project” per Section 15378(b)(4) of the CEQA Guidelines because the action is approval of funding for a roof replacement at City Hall and therefore, it is the creation of a governmental funding mechanism that does not involve any commitment to a specific project that can result in a potentially significant impact and not subject to CEQA.

APPROVED BY THE CITY ATTORNEY
Yes

ALTERNATIVES
While the confirmed lowest responsive bid is nearly $200,000 higher than the apparent low bid was, the Council does not have the option to award to the apparent low bidder because it is non-responsive. The Council can reject all bids and direct staff to conduct another round of bidding and possibly end up with a lower cost. However, another bid would significantly delay the project and likely extend construction into the rainy season, resulting in additional roof leaks and flooding. Also, there is no guarantee a second bid would be more competitive. Therefore, no alternative action is recommended.

NEXT STEPS
Upon Council approval, staff will issue a formal contract award to Fresno Roofing, Inc. The project should commence within the next 60 days. It is expected that City Hal will remain open during construction.

AT THE INTERSECTION OF WEST TULARE AVENUE AND

SANTA MARIA WAY

RECOMMENDATION
Council find the requested action is exempt from the California Environmental Quality Act; authorize the installation of pedestrian safety improvements at the intersection of West Tulare Avenue and Santa Maria Way, subject to review and approval by the Public Works Director.

BACKGROUND
City staff and one Councilmember have received complaints from residents concerning traffic safety conditions at West Tulare Avenue between Poplar Avenue and State Route 43 for both motorists and pedestrians. In response, staff prepared a traffic study that documents observations of street conditions, traffic patterns, data provided by the Police Department covering accident and traffic violations, and specific analyses of the intersections along this corridor.

The department later requested and received authorization from the Council to have a consultant specializing in traffic safety studies provide additional feedback and recommendations. In a technical memorandum dated May 25, 2023, the City’s consultant, TJKM, addresses the main topics of interest to the City, which include the feasibility of four-way stops at West Tulare Avenue, pedestrian access, and school safety. They also identify other general remedies to enhance traffic safety.

The primary focus for providing a four-way stop along West Tulare Avenue is at the intersection at Santa Maria Way. The intersection currently consists of a two-way stop for both directions of Santa Maria Way. It also has yellow-painted crosswalks at the north and east boundaries of the intersection, primarily to facilitate pedestrian access across West Tulare Avenue to and from nearby schools.

The application of four-way stops is discussed in the Federal Highway Administration’s (FHWA) Manual on Uniform Traffic Control Devices (MUTCD). A modified version of this document has been adopted by the State of California. The CA MUTCD provides multiple warrant categories for determining the appropriateness of a four-way stop installation. These include:

WEST TULARE AVENUE AND SANTA MARIA WAY
- 2 -
• Intersection crash history
• Traffic volumes and patterns
• Pedestrian safety issues
• Line of sight limitations
• The character of the intersecting roadways
• The character of the surrounding vicinity.

ANALYSIS
The specific findings pertaining to the need for a four-way stop at the intersection of West Tulare Avenue and Santa Maria Way are as follows:
• Intersection Crash History - A review of the recent crash history at and near the intersection does not indicate that a four-way stop would provide remedial benefits (the CA MUTCD suggests installations for reducing reported angled and pedestrian-vehicle collisions specifically).
• Proximity to Schools -The intersection is within ¼-mile of a public school campus, including Redwood Elementary and Richland Junior High. North of the intersection, there are approximately 200 residential lots, either developed or under development, that potentially need a safe crossing at this intersection to access the schools. Per Richland School District officials, this intersection is not staffed with a crossing guard.
• Speed Survey – This past June, a speed survey showed that nearly all motorists exceeded the posted speed limit of 25 miles per hour. The FHWA and Institute of Transportation Engineers do not recommend using stop signs to control speeding.
• Characteristics of Roadway and Vicinity - West Tulare Avenue is classified as a collector street, meaning it should be an intermediary between local streets and arterial roads. Collector streets are designed to gather traffic from local streets within a residential or commercial area and direct it towards larger arterial roads, highways, or major transportation routes. Preferably, traffic on collector roads moves with minimal stops. While the surrounding areas all appear to be residential, there are noticeable inconsistencies in how West Tulare Avenue was developed to facilitate traffic flow. The more modern lots have homes facing opposite the street and block walls to prevent direct access. Still, other lots, including those immediately west of Santa Maria Way, have direct access to West Tulare Avenue via residential driveways. The widths of West Tulare Avenue are also inconsistent, with a noticeable reduction of approximately 20 feet in pavement width when comparing the west and east sides of Santa Maria Way. The north side of West Tulare Avenue, east of Santa Maria Way, also lacks sidewalks, presumably because of overhead power lines and older development standards.

WEST TULARE AVENUE AND SANTA MARIA WAY
- 3 -
• Sight Distances – There do not appear to be sight line visibility issues for motorists or pedestrians accessing this intersection in any direction. • Community Engagement – the matter was brought to the attention of the city manager, who consulted with one resident living close to the intersection, who cited a history of speeding and, on one occasion, damage to a fire hydrant and possibly private property due to unsafe driving.

The installation of stop signs should be based on legitimate safety concerns. In the case of this intersection, the findings above do not warrant a four-way stop, except for possibly the proximity to schools and roadway characteristics. The existing crosswalk across West Tulare Avenue served as an interim measure for pedestrian access to nearby schools, but safety for those needing to cross the street could be enhanced with a properly signed all-way stop with advanced warning signage and pavement markings.

An all-way stop could also regulate traffic flow, particularly with West Tulare Avenue's inconsistent development and pavement width.

Because West Tulare Avenue is a collector street intended to have minimal stops with pedestrian crossings limited to certain times of a typical day, alternative safety improvements should be explored before installing an all-way stop. Recent traffic studies have already covered some improvements, including improved advanced warning street signage and striping. Others include "bulbouts," which delineate vehicular traffic to a narrower corridor through the intersection that would at least improve the visibility of pedestrian crosswalks. These all-way stop alternatives can be installed and assessed to determine their effectiveness.

FISCAL IMPACT
Public Works and contracted crews can perform the installation and ongoing maintenance of street signage, striping, and other enhancements within existing operational budgets. Therefore, no budget action is required.

CEQA ANALYSIS
The proposal is exempt from the California Environmental Quality Act (CEQA) pursuant to Section 15301 of the CEQA Guidelines in that only minor changes to the existing intersection are being proposed and public safety will be improved by the project.

APPROVED BY THE CITY ATTORNEY
Yes

ALTERNATIVES
The primary alternative to recommended action is to install an all-way stop. While this scenario would better ensure that motorists yield to pedestrians, traffic flow could also be congested unnecessarily with mandatory stops for no pedestrians or cross traffic on Santa Maria Way. There appear to be solutions for improving safety without impacting efficient traffic flow through the intersection. Regardless of what type of improvement

project is prioritized, safety would be enhanced if there could be increased patrols by the Police Department to monitor traffic and enforce the applicable laws.

NEXT STEPS
Upon Council approval, staff will purchase the necessary materials and obtain the necessary resources to install and monitor pedestrian safety enhancements.

TJKM was asked to review an undated document, “Traffic Study W. Tulare Avenue between SR 43 and Poplar Avenue.” Our general comments are listed below:

1. 4-Way Stop
Based on our separate discussion, it is our understanding that the main purpose of the traffic study is to determine if a 4-way stop should be installed at the intersection of W. Tulare Avenue and Santa Maria Way. The report language doesn’t explicitly mention this until the very last sentence of the 10 page report. The report touches on many issues that are only peripherally related to the main question. The report quotes the main guidance, the CA MUTCD, on page 6, noting that when considering 4-way stops the following factors can apply:
a. Five or more correctable collisions per year is one guidance factor b. Volumes of 300 vehicles per hour for eight hours on the main street and a combination of 200 vehicles, bikes and peds per hour on the side street is another guidance factor
c. Intersection delay caused by the combination of vehicles, pedestrians and bicycles is a factor
d. Controlling vehicular left turn delay or ped/vehicles conflicts are factors e. For speeds over 40 mph, volumes above are reduced by 30 percent The report should explore these issues. Traffic volumes on at least two legs of the intersection should be determined. On accidents, the report indicates there are not enough accidents to qualify, but it should give directional, time of day, and other information about the reported accidents to determine if there is a pattern or points of commonality among the previous collisions. The current report quotes generic vehicle code violations for individual accidents but other than collision times, gives no details about the location or type of accident. These are the main issues related to the need for 4-way stop signs at Santa Maria Way.

2 2. Pedestrian Crossings at Santa Maria Way.

TJKM recommends that at the intersection of Santa Maria Way and W. Tulare Avenue a crosswalk should be added crossing the south leg, as the report recommends. However, it is not appropriate to add a crosswalk on the east leg of the intersection whether or not a 4-way stop is created. A stop bar would be needed, but an additional crosswalk would result in two locations for school age pedestrians to cross the busy street to walk to school, rather than the preferable single point. This is especially true if a crossing guard is at the intersection, as hinted at in the report. If a crossing guard is present, that should be clearly stated. Such a guard would be a valuable source of information about how traffic and pedestrians interact at the intersection.

3. School Safety
As noted in the report’s reference material, in California, school crosswalks are required to have SLOW SCHOOL XING painted on the approaches to each such crosswalk except for intersections that are controlled by STOP or YIELD signs or signals, where SSX cannot be placed. STOP AHEAD is the appropriate pavement marking but is optional. There are many yellow school crosswalks in Shafter but few, if any SSX markings, meaning the City is not in compliance with the CVC in an important way. This is also true along W. Tulare Avenue at Santa Maria Way.

Also, the City of Shafter may be overusing yellow crosswalks. The limit typically is within 600 feet of the school grounds, with some exceptions. The idea of routing pedestrians to cross W.

Tulare at its intersection with SR 43 instead of Wall is not recommended by TJKM. It would expose pedestrians to a large and awkward intersection, then require them to walk a longer distance while walking on a narrow sidewalk adjacent to a high-volume, high speed street (SR 43). However, by examining attendance boundaries and locations of homes, there are likely very few pedestrians involved. A well-signed and marked Wall Street intersection would be a better location and would likely be where pedestrians would choose to travel anyway because it is the direct route to the elementary and junior high schools involved.

There may be a misunderstanding of a school zone. A school zone, with 25 mph speeds, only occurs on streets that front a school. A school crosswalk does not establish a school zone, only a school does. W. Tulare Avenue is not a school zone although pedestrian signs are appropriate, as depicted in the CA MUTCD illustrations.

4. Other Issues
a. It is not clear if the City has established a speed limit on W. Tulare Avenue. Google photos do show two eastbound 25 mph signs and no westbound signs. It is unknown if a 25 mph limit is appropriate in any section of the roadway. There is a report reference to “multi-day collection of speed surveys” but no disclosure of findings.

Motorists may be confused as to what the speed limit is on W. Tulare Avenue.

Page 182 of 193 ends

3 b. The Stop Ahead pavement marking on eastbound W. Tulare Avenue for SR 43 is too far from the intersection. It is actually placed in advance of the Wall Street crosswalk, which is potentially confusing to motorists.

TJKM will be happy to respond to any questions on this matter.

TRAFFIC STUDY
W. TULARE AVE BETWEEN SR 43 AND POPLAR AVE
The Engineering Department, under direction of the Public Works Director, conducted a traffic and pedestrian safety assessment of W. Tulare Ave with a focus on the pedestrian crossing at Santa Maria Way. Due to growing residential developments to the west, the vehicular and pedestrian traffic has multiplied in an already heavy traffic area. Surroundings along W. Tulare are mostly residential except for the west end of W. Tulare at Ryan where westbound W. Tulare enters a primarily agriculture area. Mid W. Tulare Ave are mainly tract homes. To the east end of W. Tulare are many multiplex units. These multiplex residential units add to on-street vehicle parking encroaching on the line-of-sight at Wall St. entering W. Tulare. There is a local church on the north side of W. Tulare at Wall St. Wall Street is also a major vehicle and pedestrian traffic area feeding from the elementary school just two blocks away. W. Tulare is a collector street. W. Tulare Ave ties into a busy State highway at the east end. A grocery store, a hardware store, auto parts, and a social services office share a large shopping center area at the southeast side adding to the vehicles entering W. Tulare Ave. Past and recent accidents and continuous high vehicle speeds prompted local residents to raise concerns for pedestrian safety. “Stop” Signs have been suggested to be installed at Santa Maria to mitigate the safety of the crossing. The Engineering Department proceeded to an evaluation of the existing traffic control devices along the roadway in means to mediate some of these issues and concerns.

This study considers field data, field observations, residents’ statements of concerns, and Shafter Police Department prepared records of accidents and citations. Please note that I extracted citations for parking or fix-it tickets. The field data includes multi-day collection of speed surveys performed by the City of Shafter. City engineering staff also conducted field observations relating to traffic conditions, patterns, and maneuvers. Attached you will find a Vicinity Map and all referenced data material.

My evaluation provides:
 Surrounding sites of interest and existing traffic control devices.  Recommendations in guidance with the California Manual of Uniform Traffic Control Devices (MUTCD), City of Shafter Standards, and applicable vehicle code law.

A Vicinity Map has been provided outlining the existing traffic control devices and markings specified in following observations.

ACCIDENT AND CITATION DATA
Data is for a three-year span from March 2018. The requirement for “Stop” signs is most critical when there are 5 or more accidents within 24-months or 3 or more within a 12-month period within a specific crossing.

W. TULARE AT CENTRAL VALLEY HWY (SR 43)
OBSERVATIONS:

There is an existing white-striped crosswalk Across W. Tulare Ave w/ “Stop” sign on eastbound.

There is a “Stop Ahead” warning sign approximately 500 ft. before the “Stop” sign.

OPINION:

Devices and striping are sufficient for this intersection approach.

W. TULARE AT WALL ST.

OBSERVATIONS:

W. Tulare at Wall St is a “T” intersection. There is an existing white-striped crosswalk across Wall St w/ a “Stop” sign at northbound Wall. A yellow-striped crosswalk extends from the southwest corner at Wall St. perpendicular to the north side of W. Tulare Ave. Midway between SR43 and the crosswalk at westbound Wall is an existing “School Pedestrian Crossing” signage with a “School” supplemental plaque” assembly. The same assembly exists approximately 100 ft. west of eastbound Wall. These assemblies suggest being warning signs for the yellow-striped crosswalk. Approximately 450 ft. west of Wall St is a 25 MPH “Speed Limit” sign for eastbound W. Tulare Ave.

Concerns:
 Line-of-sight
 Speeds
 Vehicle congestion
GUIDANCE PER MUTCD/CVC:

MUTCD - Section 7A.02 School Routes and Established School Crossings Support:
01 To establish a safer route to and from school for schoolchildren, the application of planning criterion for school walk routes might make it necessary for children to walk an indirect route to an established school crossing located where there is existing traffic control and to avoid the use of a direct crossing where there is no existing traffic control.

Guidance:
02 School walk routes should be planned to take advantage of existing traffic controls. 03 The following factors should be considered when determining the feasibility of requiring children to walk a longer distance to a crossing with existing traffic control:

A. The availability of adequate sidewalks or other pedestrian walkways to and from the location with existing control,
B. The number of students using the crossing,
C. The age levels of the students using the crossing, and D. The total extra walking distance.

Page 187 of 193 ends

W. Tulare Ave, SR 43 to Poplar Ave Traffic Study

Page 5 of 10 ends

MUTCD - Section 7C.02 Crosswalk Markings
Guidance:
01 Crosswalks should be marked at all intersections on established routes to a school where there is substantial conflict between motorists, bicyclists, and student movements; where students are encouraged to cross between intersections; where students would not otherwise recognize the proper place to cross; or where motorists or bicyclists might not expect students to cross (see Figure 7A-1).
02 Crosswalk lines should not be used indiscriminately. An engineering study considering the factors described in Section 3B.18 should be performed before a marked crosswalk is installed at a location away from a traffic control signal or an approach controlled by a STOP or YIELD sign. 03 Because non-intersection school crossings are generally unexpected by the road user, warning signs (see Sections 7B.11 and 7B.12) should be installed for all marked school crosswalks at nonintersection locations. Adequate visibility of students by approaching motorists and of approaching motorists by students should be provided by parking prohibitions or other appropriate measures.

CVC 22352:

The prima facie limits are as follows and shall be applicable unless changed as authorized in this code and, if so changed, only when signs have been erected giving notice thereof:
(b) Twenty-five miles per hour:
(1) On any highway other than a state highway, in any business or residence district unless a different speed is determined by local authority under procedures set forth in this code. (2) When approaching or passing a school building or the grounds thereof, contiguous to a highway and posted with a standard “SCHOOL” warning sign, while children are going to or leaving the school either during school hours or during the noon recess period. The prima facie limit shall also apply when approaching or passing any school grounds which are not separated from the highway by a fence, gate, or other physical barrier while the grounds are in use by children and the highway is posted with a standard “SCHOOL” warning sign. For purposes of this subparagraph, standard “SCHOOL” warning signs may be placed at any distance up to 500 feet away from school grounds.

OPINION:

School zones may be established within 500 -1,000 feet of a school. Crossing guards often assist student crossings during established school entry and exit times. If this crosswalk at Wall has been stablished as a route to school, the existing traffic control devices or pedestrian walkways are not sufficient to provide a safe and compliant route for students considering the speed concerns and traffic accidents in a vehicle traffic congested area:
 The north side of Tulare has no sidewalk or ADA accessibility.  A Crosswalk on Colvard Street at Wall St should be installed.  Inadequate “School” Traffic Control Devices on W. Tulare Ave:
o School signage at the crosswalk
o Adequate Advance warnings
o School Speed Limit signs
o School Zone Limits
o Markings.

Page 188 of 193 ends

Page 6 of 10 ends

Until proper control devices are installed, walkways constructed, and an adequate route to school designation can be established, removal of the crosswalk traversing W. Tulare Ave at Wall St should be removed. Removal of the cross will encourage pedestrians to cross at the existing crosswalk at Central Valley Hwy which has an accessible curb ramp on the south side and sidewalk that ties to Wall St.

W. TULARE AT SANTA MARIA WAY.

OBSERVATIONS:

Santa Maria Way is one of two entry/exits to a residential tract north of W. Tulare Ave. Santa Maria is a four-way intersection at Tulare. An existing yellow-striped crosswalk extends from the northwest corner at Santa Maria to the northeast corner at Santa Maria. An existing yellow-striped crosswalk extends from the northeast corner at Santa Maria across W. Tulare Ave to the southeast corner at Santa Maria. There is no crosswalk from the southeast corner of Santa Maria to the southwest corner of Santa Maria to tie the sidewalk to the walking path. All corners are ADA accessible per code compliance at the time of installation. There is school pedestrian crossing signage on both eastbound and westbound W. Tulare except that eastbound has no “warning” of crossing ahead. The crosswalk across W. Tulare has been noted to have crossing guards at entry/exit school times. There are “Stop” signs at both southbound and northbound Santa Maria.

There is a request by concerned residents for an “All-Way Stop” be installed at this location. W.

Tulare begins to widen approximately 150 before Santa Maria. Road width is about 10ft wider than the road to the east. Cars heading westbound were noted to speed up as the road starts to widen.

GUIDANCE PER MUTCD/CVC:

MUTCD - Section 2B.07 Multi-Way Stop Applications
Support:
01 Multi-way stop control can be useful as a safety measure at intersections if certain traffic conditions exist. Safety concerns associated with multi-way stops include pedestrians, bicyclists, and all road users expecting other road users to stop. Multi-way stop control is used where the volume of traffic on the intersecting roads is approximately equal. 02 The restrictions on the use of STOP signs described in Section 2B.04 also apply to multi-way stop applications.

Guidance:
03 The decision to install multi-way stop control should be based on an engineering study. 04 The following criteria should be considered in the engineering study for a multi-way STOP sign installation:

A. Where traffic control signals are justified, the multi-way stop is an interim measure that can be installed quickly to control traffic while arrangements are being made for the installation of the traffic control signal.

B. Five or more reported crashes in a 12-month period that are susceptible to correction by a multi-way stop installation. Such crashes include right-turn and left-turn collisions as well as right-angle collisions.

C. Minimum volumes:

1. The vehicular volume entering the intersection from the major street approaches (total of both approaches) averages at least 300 vehicles per hour for any 8 hours of an average day; and

2. The combined vehicular, pedestrian, and bicycle volume entering the intersection from the minor street approaches (total of both approaches) averages at least 200 units per hour for the same 8 hours, with an average delay to minor-street vehicular traffic of at least 30 seconds per vehicle during the highest hour; but

3. If the 85th-percentile approach speed of the major-street traffic exceeds 40 mph, the minimum vehicular volume warrants are 70 percent of the values provided in Items 1 and 2.

D. Where no single criterion is satisfied, but where Criteria B, C.1, and C.2 are all satisfied to 80 percent of the minimum values. Criterion C.3 is excluded from this condition.

Option:
05 Other criteria that may be considered in an engineering study include:

A. The need to control left-turn conflicts;
B. The need to control vehicle/pedestrian conflicts near locations that generate high pedestrian volumes;
C. Locations where a road user, after stopping, cannot see conflicting traffic and is not able to negotiate the intersection unless conflicting cross traffic is also required to stop; and D. An intersection of two residential neighborhood collector (through) streets of similar design and operating characteristics where multi-way stop control would improve traffic operational characteristics of the intersection.

MUTCD - Section 7C.02 Crosswalk Markings
Guidance:
01 Crosswalks should be marked at all intersections on established routes to a school where there is substantial conflict between motorists, bicyclists, and student movements; where students are encouraged to cross between intersections; where students would not otherwise recognize the

Page 8 of 10 ends

proper place to cross; or where motorists or bicyclists might not expect students to cross (see Figure 7A-1).

CVC 22352:

Whenever a marked pedestrian crosswalk has been established in a roadway contiguous to a school building or the grounds thereof, it shall be painted or marked in yellow as shall be all the marked pedestrian crosswalks at an intersection in case any one of the crosswalks is required to be marked in yellow. Other established marked pedestrian crosswalks may be painted or marked in yellow if either (a) the nearest point of the crosswalk is not more than 600 feet from a school building or the grounds thereof, or (b) the nearest point of the crosswalk is not more than 2,800 feet from a school building or the grounds thereof, there are no intervening crosswalks other than those contiguous to the school grounds, and it appears that the facts and circumstances require special painting or marking of the crosswalks for the protection and safety of persons attending the school. There shall be painted or marked in yellow on each side of the street in the lane or lanes leading to all yellow marked crosswalks the following words, “SLOW—SCHOOL XING,” except that such words shall not be painted or marked in any lane leading to a crosswalk at an intersection controlled by stop signs, traffic signals, or yield right-of-way signs. A crosswalk shall not be painted or marked yellow at any location other than as required or permitted in this section.

OPINION:

School zones may be established within 500 -1,000 feet of a school. There is no information as to whether this crossing has been officially adopted as a route to school. Most signage is installed however, have lost their reflectivity. A crosswalk needs to be installed to connect the southwest

Page 191 of 193 ends

W. Tulare Ave, SR 43 to Poplar Ave Traffic Study

Page 9 of 10 ends

corner to the southeast corner at Santa Maria. If an “All Way Stop” is to be considered, a fourth crosswalk would be need from the southwest corner at Santa Maria to the Northwest corner at Santa Maria. To complete a route to school, a crosswalk is needed at the west end acroos Colvard Street.

Although the amount of traffic accidents in this area do not meet the minimum criteria to install an “All Way Stop” at this intersection, preliminary speed studies show an 85th percentile 20 MPH above the school zone limits. These higher speeds combined with the accidents that have occurred and the citations given, pose a safety concern; especially for pedestrian school children crossing at this location.

W. TULARE AT REIKER ST
OBSERVATIONS:

W. Tulare at Reikers St is a “T” intersection. There is a “Stop” sign with a “Stop” bar on northbound Reiker.

OPINION:

Devices and striping are sufficient for this intersection approach. Except, this crossing may be designated as a route to school tying in at Santa Maria. If so, a crosswalk would be advised.

W. TULARE AT VERA CRUZ WAY
OBSERVATIONS:

W. Tulare at Vera Cruz Way is a “T” intersection. There is a “Stop” sign with a “Stop” bar on southbound Vera Cruz.

OPINION:

Devices and striping are sufficient for this intersection approach. Except, this crossing may be designated as a route to school tying in at Santa Maria. If so, a crosswalk would be advised.

W. TULARE AT ENNS ROAD
OBSERVATIONS:

W. Tulare at Enns Rd. is a “T” intersection. There is a “Stop” sign on northbound Enns Rd. with a white-striped crosswalk.

OPINION:

Devices and striping are sufficient for this intersection approach.

W. TULARE AT RYAN DRIVE
OBSERVATIONS:

Page 192 of 193 ends

W. Tulare Ave, SR 43 to Poplar Ave Traffic Study

Page 10 of 10 ends

Ryan Dr. makes a four-way intersection at W. Tulare. There is a “Stop” sign on northbound Ryan with a white-striped crosswalk. A “Stop” sign is proposed for southbound Ryan Dr. for the future Tract on the north side of Tulare.

OPINION:

Devices and striping are sufficient for this intersection approach.

W. TULARE, WEST OF RYAN DRIVE
Shafter City Limits end approximately 400-ft west of Ryan Drive. From that point on, is Kern County limits. Just before entering the Shafter city limits on eastbound W. Tulare, the County has a 25 MPH speed limit sign. Eastbound W. Tulare, starting at the Shafter City limits, there are “No Dumping” signs at roughly, 200-ft intervals up to Reiker St. No other Traffic Control Devices or markings are present other than described above. W. Tulare, westbound, ends with a “Stop” sign and “Stop” bar at Poplar Ave.

In summary,
Further review should be considered in establishing a safe route to school across W. Tulare.

Existing Traffic Control Devices need to be addressed in regards to those that require replacement and those that need to be additionally installed. An “All Way Stop” at Santa Maria Way can be justified as a safety measure considering the accident, citation, speed data, and observations.
