1 Residential Property $444.00 per Unit
2 Non-Residential Property $3,112.00 per Acre

Escalation of Maximum Special Tax
Each Fiscal Year following the Base Year, the Maximum Special Tax shall be increased in accordance with the Annual Tax Escalation Factor and otherwise adjusted as provided in this rate and method of apportionment.

Multiple Land Use Classes
In some instances, an Assessor’s Parcel of Developed Property may contain more than one Land Use Class. The Maximum Special Tax levied on an Assessor’s Parcel shall be the sum of the Maximum Special Taxes for all Land Use Classes located on that Assessor’s Parcel. For an Assessor’s Parcel that contains both Residential Property and Non-Residential Property, the Acreage of such Assessor’s Parcel shall be allocated to each type of property based on the amount of Acreage designated for each Land Use Class as determined by reference to the site plan approved for such Assessor’s Parcel. The CFD Administrator’s allocation to each type of property shall be final.

4. Method of Apportionment

The Special Tax shall be levied on Taxable Property each Fiscal Year as follows:

Step 1: The special tax shall be levied proportionally on each Assessor’s Parcel of Developed Property up to 100% of the applicable Maximum Special Tax; Step 2: If additional monies are needed to satisfy the Special Tax Requirement after the first step has been completed, the Special Tax shall be levied

Proportionately on each Assessor's Parcel of Approved Property at up to 100% of the Maximum Special Tax for Approved Property. No Special Tax shall be levied on Exempt Property.

5. Collection of Special Taxes
Collection of the Special Tax shall be by the County in the same manner as ordinary ad valorem property taxes are collected and the Special Tax shall be subject to the same penalties and the same lien priority in the case of delinquency as ad valorem taxes; provided, however, that the City Council may provide for other means of collecting the Special Tax if necessary to meet its financial obligations, including direct billings to the property owners.

6. Administrative Changes and Appeals
Any taxpayer subject to the Special Tax and who claims the amount of the Special Tax levied on his or her Assessor’s Parcel is in error shall first consult with the CFD Administrator regarding such error not later than twelve (12) months after first having paid the first installment of the Special Tax that is disputed. If following such consultation, the CFD Administrator determines that an error has occurred, the CFD Administrator may recommend changing the amount of the Special Tax levied on such Assessor’s Parcel. If following such consultation and action, if any by the CFD Administrator, the landowner believes such error still exists, such person may file a written notice with the City Manager or designee of the City appealing the amount of the Special Tax levied on such Assessor’s Parcel. Upon the receipt of such notice, the City Manager or designee may establish such procedures as deemed necessary to undertake the review of any such appeal. The City Manager or designee thereof shall interpret this Rate and Method of Apportionment and make determinations relative to the administration of the Special Tax and any landowner appeals. The decision of the City Manager or designee shall be final and binding as to all persons.

Interpretations may be made by Resolution of the City Council for purposes of clarifying any vagueness or ambiguity as it relates to the Special Tax, the Rate and Method of Apportionment, the classification of properties, or any definition applicable to CFD No. 0815.

7. Term of Special Tax
The Special Tax shall be levied annually in perpetuity, unless terminated earlier by a super majority of the City Council.

8. Prepayment of Special Tax
The Special Tax may not be prepaid.

MANAGEMENT REPORT

CITY OF SHAFTER

CITY COUNCIL REPORT
MEETING DATE: December 3, 2024
DEPARTMENT: Lance Lippincott, City Manager
SUBJECT: CONTRACT FOR AXON BODY CAMERAS, INCUSTODY/VEHICLE CAMERAS, TASER 10s, SUPPORT

SOFTWARE AND PROPERTY & EVIDENCE TECHNICIAN

RECOMMENDATION
Council find the action is not defined as a “project” per Section 15378(b)(4) of the CEQA Guidelines; approve contract with Axon and the addition of a Police & Evidence Technician position, with the understanding that additional revenue opportunities will be explored at the beginning of calendar year 2025 to offset the cost.

BACKGROUND
Body-worn cameras are widely used by state and local law enforcement agencies in the United States. They are worn principally by officers in the performance of duties that require open and direct contact with the public. A recent study by the Police Executive Research Forum (PERF) indicates that as of 2023, body-worn cameras are utilized in 100% of police departments in jurisdictions with populations exceeding one million residents, and 82% of other agencies responding to a survey had already implemented the technology. Additionally, a recent survey conducted by the City’s Risk Management staff revealed that all surrounding agencies in Kern County, including Bakersfield, Arvin, Delano, McFarland, Taft, Tehachapi, and Wasco, are using body-worn cameras, further highlighting the widespread adoption of this technology in the region. According to a 2018 Bureau of Justice Statistics report, the main reasons to implement body-worn cameras are as follows:
• Improve officer safety;
• Increase evidence quality;
• Reduce civilian complaints; and
• Reduce agency liability.

However, the benefits are not only associated with the topics highlighted above. Shafter PD has previously dedicated significant staff time looking into body- worn technologies, and in coordination with other City departments, Axon has been identified as the vendor of choice. Axon has provided a quote as follows:

Page 187 of 219 ends

CONTRACT FOR AXON BODY CAMERAS, IN-CUSTODY/VEHICLE CAMERAS, TASER 10s,

SUPPORT SOFTWARE AND PROPERTY & EVIDENCE TECHNICIAN
- 2 -
• Total Cost $3,667,743.94, spread out in equal payments over ten (10) years and includes:

1. Vehicle cameras (forward-facing and in-custody)

2. Body-worn cameras/chargers

3. Taser 10s to replace current non-lethal

4. Support software, Evidence.com
Axon will provide product support during the contract period, and as updates to hardware or software occur, Shafter PD will be provided with the latest equipment. This price is only guaranteed through December, and it is anticipated that the price could increase by as much as twenty (20) percent year over year.

The implementation of Body-Worn Cameras generates a substantial volume of video footage that requires effective management, review, and storage. In support of this initiative, the Police Department requests a Property & Evidence Technician position at range 163 of the City's pay scale. This role will work closely with the Property & Evidence Supervisor to ensure adherence to established protocols for evidence retention and transport. Additionally, the Property & Evidence Technician will assist in managing the extensive video footage produced by Body-Worn Cameras, which includes tasks related to data processing, providing administrative support, and addressing public records requests.

FISCAL IMPACT
No immediate budget action is required within the General Fund for the current fiscal year 2024-2025. Any short-term labor cost funding needs may be accommodated within the Police Department's existing operating budget due to savings from unfilled vacancies. However, the requested position of "Property and Evidence Technician" at Range 163 will result in a long-term ongoing fiscal impact to the General Fund of $121,303 annually. This cost represents the projected maximum (Step E) breakdown of $73,814 in wages and $47,489 in benefits.

The fiscal impact of the Body-Worn Cameras project is estimated at $366,774 per year for ten years. These costs can be covered using Public Safety Impact Fees, ensuring there is no immediate impact on the General Fund.

Over the long term, funding for labor and the Body-Worn Cameras project may have reallocation between the General Fund and Public Safety Impact Fees. To offset these expenditures, alternative revenue sources such as development agreements, community finance districts, or special taxes will need to be evaluated and considered by the City Council.

CEQA ANALYSIS
The action is not defined as a “project” per Section 15378(b)(4) of the CEQA Guidelines because the action is the approval of a discretionary reallocation of existing budgeted amounts related to community events; therefore, it is the creation of a governmental

BODY WORN CAMERAS
• The use of body-worn cameras has grown dramatically throughout the law enforcement profession and is considered a best practice for the industry.
• Each of our surrounding allied agencies uses BWCs; studies and evidence show that BWCs provide high-quality evidence for criminal cases and frequently mitigate citizen complaints. • BWCs that record officer interactions with the public have been widely viewed as tools that promote officer accountability, increased transparency, and public trust. All things that can protect the City from civil liability.
• In keeping with best practice standards, the following criteria were considered in selecting a BWC system:

Page 203 of 219 ends

BODY WORN CAMERAS
 The camera must be capable of pre-record, the recording of video prior to the activation of the device.
 The camera must be easy to manipulate to avoid missed recordings.  The manufacturer must offer secure, tamper-proof data storage.  The BWC videos must be easily downloaded and synced with the data storage.  The quality of the video and audio must be suitable for presentation in court.

BODY WORN CAMERAS
In 2021, the police department reviewed and assessed 9 manufacturers of BWCs. At that time, staff recommended AXON for implementing a BWC program.

The Axon Body Worn Cameras meet and exceed expectations by providing the following qualities:
• Durable design.
• Capable of pre-recording video prior to activation of the recording. • Simple design with a large activation button that is easily manipulated to turn the recording on. 12-hour battery life.
• Equipped with signal technology that will automatically turn the camera on when the emergency lights are activated in the patrol car, or a taser device or weapon are unholstered. • Downloading occurs automatically when the device is placed on the charging dock. • Data is stored securely on evidence.com, a secure platform requiring no local IT support. • Axon is a major manufacturer of BWCs with police agencies.

Officer Safety Functions:
• The Watch Me Button allows officers to notify a second set of eyes when needed, allowing a supervisor to communicate with the officer.
• Bi-directional communication allows officers to communicate hands-free with viewers without tying up the radio, allowing communication with dispatchers, supervisors, and translators. • The Fleet 3 Camera System includes an ALPR (Automated License Plate Reader) to identify stolen vehicles.
• The Fleet 3 Camera System utilizes two cameras: one forward-facing and one within the prisoner/transport compartment.

MANAGEMENT REPORT

CITY OF SHAFTER

CITY COUNCIL REPORT
MEETING DATE: December 3, 2024
DEPARTMENT: Michael James, Public Works Director
SUBJECT: BIDDING AND PROCUREMENT POLICY UPDATE DISCUSSION

AND DIRECTION

RECOMMENDATION
Council discuss proposed bidding and procurement policy updates and direct City staff on preparing a new ordinance for adopting said policy updates.

BACKGROUND
The City Municipal Code dictates bidding and procurement policies. The policies were last formally established via Ordinance 428 in 1990. Since then, there has been a lack of updates to address numerous changes, including inflation and new technology, which has sometimes complicated and delayed projects and purchases.

At the Council’s November 16, 2021 meeting, staff provided a summary of recommended policy updates. Some of the objectives of the updates are as follows:
• References to applicable laws and regulations
• Adjustments to authorized award values for key staff members • Leveraging new technology
• Identifying allowances for local vendors and contractor preferences • More efficient processes to deliver projects and acquire goods and services The policy updates were presented as a discussion item at the meeting. Upon receiving the presentation, the Council provided comments and direction to staff. Among the notable comments was a concern about the purchasing and contract award authority increases for the City Manager and Department Heads without prior Council knowledge or consent. Following the meeting, Public Works scheduled individual meetings with Councilmembers to receive additional feedback.

A second policy update summary table for Council consideration and discussion has been completed and included with this staff report. Highlights of the updates are as follows:
• Maintain a purchase or contract threshold of $15,000 or higher for requiring a bid process.

Page 212 of 219 ends

BIDDING AND PROCUREMENT POLICY UPDATE DISCUSSION AND DIRECTION - 2 -
• Increase the informal bid procedure budgetary cap from $50,000 to $100,000. • Require formal bid procedures for a purchase or project valued at over $100,000.
• Increase the City Manager purchase or contract award authority from $10,000 to $15,000 to match the no-bid requirement threshold.
• Increase the Department Head purchase or contract award authority from $5,000 to $10,000.
• Increase the Department Head Designee purchase or contract award authority from $1,000 to $5,000.

Not included in the summary table but among the recommended updates are as follows:
• Authorize cooperative purchasing agreements with vendors to leverage established competitive pricing for purchases and contracts. • Allow preferences for local vendors or contractors if they are within a five-percent cost differential not to exceed $5,000.
• Include environmentally preferable purchasing practices to minimize the City’s consumption of resources and address environmental initiatives. • Include software purchases and information technology projects with budgetary bidding thresholds.
• Authorize auctions and other resources to purchase used equipment.

Before the City Attorney develops an ordinance to adopt any policy changes formally, staff requests Council feedback and direction on the changes described in the summary table or any current or foreseeable issues. The Council can defer discussions on the proposed bidding and procurement policy changes, particularly if the current policies are deemed acceptable. However, these policies are restrictive by today's standards and can delay projects and other objectives. Therefore, alternative action is not recommended.

FISCAL IMPACT
The bidding and procurement policies are being prepared with staff and the contracted City Attorney within existing operating budgets. Therefore, no budget action is required.

CEQA ANALYSIS
The item is informational only and therefore, there is no discretionary action that triggers CEQA review for this item.

APPROVED BY THE CITY ATTORNEY

MANAGEMENT REPORT

CITY OF SHAFTER

CITY COUNCIL REPORT
MEETING DATE: December 3, 2024
DEPARTMENT: Alex Gonzalez, Deputy Public Works Director SUBJECT: CITY HALL RENOVATION DISCUSSION

RECOMMENDATION
Council receive and file. This item is for informational purposes only.

BACKGROUND
City Hall is an aging structure plus its floor plan and amenities no longer adequately meet the needs of the City and its staff. The building's limited space and outdated infrastructure present significant challenges, requiring a major renovation to comply with current building codes and to provide a modern, efficient workspace. In response to these issues, the City recently completed a roof replacement and renovations to the City Services Area and the City Manager’s Lobby. However, these improvements have not fully addressed the facility’s limitations.

Due to the constraints of the existing building, the City has been utilizing rented space across the alley and a temporary trailer in the parking lot to accommodate staff. Moving forward, the City must determine whether to pursue a renovation or expansion of the existing facility or to explore constructing a new facility on a different site. This discussion aims to evaluate these options to ensure the long-term functionality and efficiency of City Hall operations.

Additionally, the City is undertaking a project aimed at updating the City Manager Hallway and the Council Chamber. As part of this effort, direction is needed on whether to move forward with the proposed improvements to the Council Chambers.

Specifically, the City Council should provide guidance on the following items:
• Selection of the paint color for the Council Chamber Walls • Choice of stain color for the desks
• Whether to stain all areas of the desks or only the visible portions to reduce costs by avoiding the need to remove electronic wiring and replace it.

FISCAL IMPACT
This item is for discussion only and does not involve any discretionary action that triggers a review under the California Environmental Quality Act (CEQA). Therefore, this item is not considered a "project" as defined by Section 15378(b)(2) of the CEQA

MANAGEMENT REPORT

CITY OF SHAFTER

CITY COUNCIL REPORT
MEETING DATE: December 3, 2024
DEPARTMENT: Rogelio Sanchez, Finance Director
SUBJECT: FOLLOW-UP DISCUSSION ON ANNUAL ALLOCATION OPTIONS

FOR COMMUNITY EVENTS FUNDING

RECOMMENDATION
Council find the action is not defined as a “project” per Section 15378(b)(4) of the CEQA Guidelines; that the City Council should review and consider the options for funding community events, providing direction to the management team on the preferred allocation approach.

BACKGROUND
The October 15, 2024, staff report proposed an annual discretionary allocation of $4,000 per Council Member for community events. Following that report, the City Council requested that the management team present a range of options for consideration to better align funding with community priorities. In response, this report presents three alternative approaches for the allocation of funds in support of these events, enabling flexibility in funding while addressing community needs.

OPTIONS FOR CONSIDERATION:

1. In-Kind Contributions through Direct Cost Allocation Departments contribute directly to community events through in-kind support, which includes labor and other M&O expenses.

2. Annual $4,000 Discretionary Allocation per Council Member Similar to the October 15 proposal, each Council Member receives an annual discretionary fund of $4,000 dedicated to community events.

3. Status quo as "Community Events" account
Retains the current allocation method with a $40,000 budget pool for community events, managed centrally without specific Council Member discretion.

The management team will present a PowerPoint during the December 3, 2024, meeting to facilitate discussion. This presentation will allow the City Council to ask questions and offer guidance on the proposed options. It will also include cost information reflecting expenses already covered within the City’s existing operating budget.

FISCAL IMPACT

FOLLOW-UP DISCUSSION ON ANNUAL ALLOCATION OPTIONS FOR COMMUNITY EVENTS

FUNDING
- 2 -
There is no fiscal impact or need for a budget amendment, as the proposed allocations remain within the existing approved budget. Any budget reallocations will depend on Council direction based on the options previously discussed.

CEQA ANALYSIS
The action is not defined as a “project” per Section 15378(b)(4) of the CEQA Guidelines because the action is the approval of a discretionary reallocation of existing budgeted amounts related to community events; therefore, it is the creation of a governmental funding mechanism or other fiscal activity that does not involve any commitment to a specific project that can result in a potentially significant impact and not subject to CEQA.
